Byron Council may be about to move its Australia Day ceremony back a day in order to acknowledge that January 26 marks ‘the day the cultural decimation and denigration of the first Australians began’. In a development that may bring howls of protest from traditionalists, mayor Simon Richardson (Greens) will put a motion to Thursday’s Council meeting proposing that the 2019 Australia Day event be moved to the evening of January 25. The proposal also includes an attempt to change the day of Byron’s Australia Day citizenship ceremony. Cr Richardson told The Echo, ‘The majority of our community feel desperately uneasy about celebrating Australia Day on a day that is associated with a lot of hurt and anger for Indigenous people.’ ‘Why would we, being a nation that prides itself on the values of a “fair go”, equality and “mateship”, willingly choose a date that is not fair, hurts our fellow Australian mates and suggests that some Australians are more equal than others? ‘I believe Byron has an opportunity to help the nation make the transition away from the historical problem of this date while still honouring the needs and values of those who enthusiastically wish to celebrate our successes as a nation…’ Should it adopt Cr Richardson’s motion, Byron Shire Council would follow in the footsteps of other councils, such as Melbourne’s Darebin and Yarra councils, both continued on page 3

Council staff ‘acquiesce’ to Bruns Holiday parks Hans Lovejoy

Byron Council staff have been accused by local NSW MP Tamara Smith (Greens) of being ‘strongarmed into agreeing with developers demands’ over an approval to operate (ATO) request from the managers of the three holiday parks in Brunswick Heads. In this week’s Council agenda, senior staffer Shannon Burt and building certifier Stephen McCarthy made the remarkable claim that they have ‘acquiesced’ to Reflections Holi-

day Parks over the ongoing issues at the Terrace Reserve holiday park. And while staff recommend ATO approval for The Terrace Reserve Holiday Park, subject to conditions, staff also offer two other options for councillors. One is restricting camping in the southern end of the park and the other is only allowing ‘new works or activities’ in the area once appropriate planning consent/ approvals are in place. One of the developers behind the contentious and large-scale West Byron urban/commercial development on Ewingsdale Road is taking Council to court over a deemed refusal, despite it being yet to be determined by the government-appointed Joint Regional Planning Panel (JRPP). According to Council staff, property development management firm Site R&D Pty Ltd has asked that Council’s deemed refusal ‘be set aside and that the applicant’s development application (DA) be granted.’ According to www.au.linkedin. com, the director of Site R&D Pty Ltd is Stuart Murray, who is based in Newcastle. The Echo understands Site R&D is one of a group of ‘locals’ who submitted their West Byron DA to the JRPP. A separate West Byron DA was submitted to the JRPP by QLD-based developer Villaworld and Sydney developer Terry Agnew. Senior legal counsel Ralph James told The Echo Council believes that development consent should be refused. ‘Council’s statement of facts and contentions was filed on September 11, 2018. The applicant is to file and serve its statement of facts and contentions in reply by October 24. The proceedings are listed for a conciliation conference under Section 34 of the Land and Environment Court Act 1979 on February 12, 2019.’ Mr James added, ‘In the meantime, the proposal will go before the JRPP on October 8. If the JRPP refuses the proposal, the appeal is likely to continue as scheduled. If the JRPP grants consent, it will be a matter for the applicant as to the fate of the appeal.’
