Professor sues University for gender, racial discrimination

Education Dept. questions Duke-UNC Mid East program

In a newly released letter, the U.S. Department of Education informed the DukeUNC Consortium for Middle East Studies that it may have violated federal rules.

After launching an investigation in June, the Department of Education determined that the program had misused Title VI funds, which support international studies and programs at U.S. universities.

Robert King, assistant secretary of postsecondary education, originally sent the letter Aug. 29.

The Department of Education, led by Betsy DeVos, announced the investigation in June in response to a request from Rep. George Holding, R-N.C. Holding’s push for federal oversight came after the consortium hosted a controversial conference on Gaza in March.

The letter takes broad aim at Duke-UNC CMES’ activities.

Among other things, the Department of Education criticizes the program for its lack of focus on neither the historical persecution of religious minorities in the Middle East nor their current circumstances.

“There is a considerable emphasis placed on the understanding the positive aspects of Islam, while there is an absolute absence of any similar focus on the positive aspects of Christianity, Judaism, or any other religion or belief system in the Middle East,” according to the letter.

Other criticisms leveled at the joint endeavor include cross-department initiatives that do not meet federal standards and an excessive focus on the arts over national security and stability.

The Department of Education also determined that Duke-UNC CMES doesn’t meet Title VI grants’ foreign language program requirements.

“The teacher-training activities hosted by the Duke-UNC CMES lack lawful focus on language development and instead advance narrow, particularized views of American social issues,” King wrote.

The notice points out that while many instructors in the program are tenured or on tenure track, most foreign language classes are taught by non-tenure track faculty.

The Chronicle reached out for comment to the Duke University Middle East Studies Center’s contact email. DUMESC has not replied in time for publication.

In order to qualify for future Title VI funding, the Department of Education is requiring Duke-UNC CMES to send a full schedule of its activities for the next year. The program also has to include justifications for all activities, including how they each advance foreign language teaching and promotes “national security interests and economic stability.”

The Department of Education set a deadline of Sept. 22 to respond to the letter with a plan and timetable for sending the schedule.

The letter was sent to Terry Magnuson, vice chancellor for research at the University of North Carolina at Chapel Hill. Duke President Vincent Price and Jack Bovender, chair of the Duke Board of Trustees, were copied on the letter.

A public notice about the letter was published in the “Federal Register” on Sept. 17.

Duke slides in US News Ranks

Duke is tied with Johns Hopkins at 10th place in the latest U.S. News and World Report rankings, a fall from its position at No. 8 last year.

Last year, Duke climbed a spot in the U.S. News rankings to tie the University of Pennsylvania at eighth on the list. The University had remained at the 8th position since 2015 except for a blip in 2018, when Duke fell to ninth after being overtaken by Penn.

Princeton reigns for the ninth consecutive year atop the list, and Harvard continues to play second fiddle in its seventh straight year at the No. 2 position.

Following the two Ivy League giants are the Massachusetts Institute of Technology, Yale and Columbia all tied for third.

Stanford, the University of Chicago, the University of Pennsylvania and Northwestern University round out the top 10.

The Wall Street Journal/Times Higher Education rankings—released Wednesday— ranked Duke 10th, a fall from its seventh place position last year and No. 5 position the year prior.

Duke also came in at 17th for Best Undergraduate Teaching in the U.S. News rankings, compared to its 10th place finish a year prior. Ranked No. 13 for in the Best Value category last year, the University climbed to 8th place.

The University of North Carolina at Chapel Hill—which was tied for 30th in last year’s rankings—jumped to 29th place, where it is tied with the University of Rochester, Tufts University, New York University and Georgia Institute of Technology.

After the round of questioning, Senator Jackson Kennedy, a sophomore, delivered a negative speech on chartering the group.

He mentioned that the group, in its SOFC application, registered as having a national affiliation with Young Life as well as the fact that its national policy contradicts Duke’s nondiscrimination policy.

Kennedy argued that DSG could not recognize the group given the issues with the national organization’s policies. No positive speech on the topic was given.

The Senate then proceeded on the final vote, in which it unanimously turned down official recognition of Duke Young Life.

In other business:

The Senate unanimously approved $2,500 in funding for the Duke Spoken Verb club’s Poet Feature Event. The Senate also unanimously chartered Sikh Society, a club aiming to create a community among those following Sikhism at Duke as well as raise awareness on the religion in general.

Unlike Duke’s, the Johns Hopkins Office of Research Administration has existed for “at least 20 years” and was not formed “in reaction to any sort of scandal,” according to Julie Messersmith, executive director for research at Johns Hopkins University. She added that the office aims to “centralize as much as possible the processes and opportunities for faculty.”

Johns Hopkins has the highest annual research and development expenditures of any U.S. university, spending $2.562 billion in 2017.

Prior to the creation of the new Office of Research, Duke had a more decentralized research structure. Michael Schoenfield, vice president for public affairs and government relations, wrote in an email that the formerly decentralized structure “served the university well by fostering innovation and collaboration.”

However, the 2015 lawsuit wasn’t Duke’s first research scandal—former Duke cancer researcher Anil Potti was charged with falsifying clinical data and using those baseless findings to enroll new patients in clinical trials in 2010. This case, along with other research misconduct cases and grant management issues, led the National Institutes of Health to issue new, tightened regulations for Duke researchers in spring 2018.

In the modern research climate, Schoenfeld wrote, “issues like research oversight, federal regulation, grants management, training and scientific misconduct now require a much higher degree of central leadership to ensure consistency and the application of best practices across the whole institutions” which is the goal of the new Office of Research.

In a March email, President Price reminded Duke that, despite the widespread financial and moral impacts related to the scandal and settlement, “it does not reflect the vast majority of our students, faculty, staff, and trainees.”

Duke may be late to the game when it comes to establishing a centralized Office of Research, but faculty and administrators have high hopes for its potential to move the university’s research practices and culture in the right direction.

He’s short a couple consonants in his last name and 54 years of life experience, but the resemblance is there.

If their identical jet-black hair and 6-foot stature didn’t give them away, the same understated humility and passion certainly do. Their similarities nearly make “The Brotherhood” of Duke men’s basketball a reality.

Those two are head coach Mike Krzyzewski and his grandson, freshman walk-on Michael Savarino. Savarino never had any trouble getting seats right behind Duke’s bench when he was a boy. Now, he has made his way onto that bench—or even further, if he plays his cards right.

“It’s an unbelievable feeling to have this Duke jersey on with my last name on the back,” Savarino said.

He likely won’t make an impact on the floor, but rather on the sidelines with his grandfather. Yet, despite all the Durham native and the legendary coach have in common—genes and otherwise—Savarino is his own man.

Mike and Michael

Imagine you’re a pretty talented middle school basketball player, but you want to step up your game. Luckily, you’re on a nickname basis with the most qualified basketball coach in the world, in this case a record-setting, legendary college basketball figure you call “Poppy.” Unfortunately, Poppy has never approached you about basketball, and his five national championships make him just a bit intimidating.

This is the situation that faced Michael Savarino as a youngster. Having inherited only 25 percent of Krzyzewski’s basketball’s wisdom, Savarino had to initiate any basketball talk with his legendary grandfather to gain more.

“He and I never really talked about basketball,” Savarino said. “But there was one instance in sixth grade where he sat my brother and I down and said, ‘If either of you want to walk on, that opportunity will always be there.’ I don’t think he remembers that conversation, but—trust me—I remember that conversation.”

Since then, Savarino and his grandfather have held an ongoing conversation about Savarino’s basketball career.

Krzyzewski attended several of Savarino’s high school games at Durham Academy and reviewed film with his grandson.

Savarino went on to record 7.3 points and 2.9 assists per game in his senior year at Durham Academy, while shooting 91 percent from the charity stripe. Those aren’t otherworldly numbers, but he got them on a team with M.J. Rice, the No. 13 prospect in the Class of 2022. Plus, his grandfather proved you don’t need to dominate as a player to make an impact. Krzyzewski scored just 6.2 points per game in his three seasons at Army.

team, first instinct led some to point to favoritism by the Duke head coach, now in his 40th season at the helm of the program.

Krzyzewski tried to squash any talk of nepotism.

“He’s not on the team because he’s my grandson,” Krzyzewski said. “He would be a pretty good Division II player, but he wanted to come to Duke. He could get in. He knows the lay of the land.”

Krzyzewski also reported that during Duke’s preseason combine, Savarino hoisted the 185-pound bench press more times than anyone on the squad, though, as Krzyzewski pointed out, “Maybe that says something about the strength of our team.”

There is one problem, though. Krzyzewski strictly addresses his grandson as “Michael”, but what do Savarino’s teammates call him?

“He’s been accepted by his teammates as Michael or Mike or whatever the hell they call him—knucklehead probably sometimes,” Krzyzewski said.

‘You’ve got to be pretty old’

Savarino’s family has been fighting for him throughout his basketball journey. The freshman suspects that his mother, Debbie, discussed his becoming a walk-on with her father before Michael told Krzyzewski himself. Even after practices started, Krzyzewski faced pressure to help his grandson—this time from his own wife, when she questioned why her husband wasn’t reviewing Savarino’s performance in scrimmages.

It leaves no doubt that if Savarino scores in Cameron Indoor Stadium underneath those five championship banners, it’s going to be a big deal.

“Hopefully, I’ll have my whole family here when that happens because that would be a really special moment for everybody,” Savarino said. “But I hope my grandfather—oh, excuse me—Coach isn’t too excited because I’m pretty sure he knows I can score the ball a little.”

The Karsh Center was formally debuted to students at the grand opening Sept. 28 from 1:00-4:00 p.m., but it is already fully operational and has had student traffic.

DISCRIMINATION FROM PAGE 2 For example, the complaint stated that in 2015, Muir delayed Abdelmalek’s promotion to the rank of full professor for two years by advancing his own dossier and that of another male candidate. As a result of her delayed promotion, the complaint noted that she lost additional salary and benefits that would have accompanied her promotion to the rank of full professor with tenure.

Additionally, Abdelmalek complained that Muir denied her a proper salary. In 2016, she requested a salary increase that corresponded to “the amount of money that she was bringing into the University and what she understood her white male counterparts were being paid.”

However, Muir blocked her request, according to the complaint.

Muir denied Abdelmalek her earned financial incentives for clinical work and research for meeting certain benchmark measures, along with cutting her ability to do the work that would earn her more such payments, the complaint stated. As a result, she lost approximately $43,293 in payments over the next three academic years.

Duke’s answer denied that the University has attempted to justify such actions and that gender and ethnic discrimination were motivating factors.

The complaint alleged that Abdelmalek was subjected to threats of dismissal and “unjustified disciplinary measures” based on “hearsay and anonymous complaints.”

Muir and Mary Klotman, dean of the School of Medicine, put Abdelmalek on a performance improvement plan (PIP) in September 2017, which was renewed in 2018. She remained on the PIP as of the complaint’s date. The complaint argued that “there was no substantial justification for placing Plaintiff on either PIP.” Duke’s answer acknowledged that

Abdelmalek was on a PIP but denied the rest of the allegation. Klotman declined to comment to The Chronicle.

Within the last year and a half, Abdelmalek was also allegedly subject to repeated, unwarranted audits, investigations and heightened scrutiny on the basis of “anonymous allegations.” However, Duke’s answer denied the allegation.

The complaint cited tension between her and Muir dating back to 2006—when she began working for Duke—including Muir attempting to serve as her mentor and reporting manager despite being of a lower rank.

It mentioned that in 2008, Muir allegedly accused Abdelmalek of “unprofessional” conduct after she spoke in her native language to a patient’s mother who did not understand English. The complaint also alleged that, in 2010, after overspending his research budget, he attempted to take money from her research account to transfer to his own.

Duke denied those allegations. It stated that the University “lacks sufficient knowledge or information to form a belief about the truth or falsity” of the complaint’s description of Abdelmalek’s interaction with the patient’s mother.

A world-leading researcher of non-alcoholic fatty liver disease, Abdelmalek has published more than 100 papers about the disease in medical journals, the complaint stated.

Prior to filing this lawsuit, Abdelmalek had filed three separate, timely charges of discrimination with the Equal Employment Opportunity Commission beginning November 2017, according to the complaint.

The EEOC issued a notice of right to sue in April 2019.

The complaint stated that Abdelmalek “seeks injunctive relief, monetary relief, compensatory damages, liquidated damages, punitive damages, and attorney’s fees” under federal law.

SAVARINO FROM PAGE 7 A brief blush followed. Yes, Savarino finds himself in the midst of a serious adjustment period, even though classes had been in session for more than four weeks. But who could blame him? Savarino must go from calling his grandfather Poppy to hearing him curse regularly on the sidelines.

“It’d be interesting if anyone else has had [his grandson on his team]. You’ve got to be pretty old,” Krzyzewski said, chuckling.

Krzyzewski indeed now plays the role of the elder statesman of college basketball. At 72, he is older than both UCLA legend John Wooden and Bobby Knight, Krzyzewski’s coach at Army, were when they retired.

It has certainly been a while since Krzyzewski donned a jersey at West Point. Even then, Krzyzewski was a leader. His viral West Point yearbook photo caption cites him as a leader of the Sesumarongi—an anagram of “ignoramuses.” He is pictured as a buttonedup (literally), disciplined Army officer with a bold combover.

Meanwhile, Savarino recently retweeted a picture of soft sugar cookies with pink frosting and sprinkles captioned, “Greatest creation in dessert history.” Last year, he retweeted a Spongebob-themed meme praising Moe’s and trashing Chipotle. Such behavior is just one of many privileges of college student life in the 21st century—even if Marketplace, Duke’s freshman dining hall, lacks both soft frosted cookies and edible Mexican cuisine.

Old face, new place

For one of Krzyzewski’s kin, leadership stands paramount and Savarino has plenty in the leadership department. He captained a 28-4 high school team to the semifinals of the NCISAA 4A state tournament. He was

also a captain the year before that. Savarino additionally attended many practices run by Krzyzewski growing up. Simply put, Savarino is the best man to help Duke’s many oneand-dones acclimate to the basketball climate in Durham.

But it can get lonely at the top. Thankfully, Savarino has a longtime friend in fellow walkon Keenan Worthington.

“We were great friends back when we were younger, and we kept in touch when I went somewhere else for high school, so it’s really cool that we play together again at the same school and everything,” Worthington said.

Before Worthington left for Blair Academy in New Jersey, Savarino and Worthington attended elementary and middle school together in Durham and played on some recreational teams together. The recollections are worthy of nostalgia for the native Durhamite.

“We only played one game together because Keenan broke his wrist at AAU practice or something, but of course we won,” Savarino said wistfully, before breaking out into a smile.

“We both had a pretty good game.”

The two local walk-ons aren’t roommates, though. Savarino has been assigned to room with Minnesota native Matthew Hurt. It seems Hurt is in good hands.

‘This is what I want to do’

When you talk to Savarino, your apprehensions about celebrities’ offspring disappear. Gone are the stereotypes of a coach’s son (or grandson, as it may be). In July, Savarino told WRAL he was willing to literally run through a wall for Coach K—so he’s your typical Duke student.

“I realized when I went on a tour here, like, man, this is what I want to do,” Savarino said. “This is where I want to be. This is my dream school, and I am just really grateful to be here.”

And I’m sure Poppy—oh, excuse me— Coach is happy he’s here, too.

Julian Abele and the Design of Duke University: An Extended Essay tells the story of how an African American architect came to design the new campuses for Duke University in Durham, North Carolina in the segregated South of the 1920s. Abele practiced his trade as chief designer of the architectural firm of Horace Trumbauer in Philadelphia, Pennsylvania which was selected by the benefactor, James B. Duke. Abele’s talent and contributions were well known in Philadelphia but his role was discovered gradually, both nationally and at Duke University. Since no records of the architectural firm exist, King’s essay pulls together scattered oral history interviews and articles written over a long period of time to place Abele’s role in the proper context of his life and times which also was a transitional period in the history of American architecture.
