he Washington Adult Protective Services 7th Annual All Staff Conference, held on October 25 and 26, 2023, at the Spokane Convention Center, marked a significant milestone in the journey of Washington’s Nationwide leadership in the Adult Protective Services field. This event included a convergence of expertise, innovation, and collaborative spirit, showcased what APS does and where we are headed.

The conference was a vibrant forum, uniting over 300 APS professionals, members of the Colville and Snoqualmie Tribes, and many great speakers and presenters. The rich content and variety of topics covered, reflected our commitment to advancing the care and protection of vulnerable adults. From discussions on legal strategies and safety measures to understanding non-verbal communication, the conference covered a spectrum of topics essential to APS work.

The emphasis on collaboration was evident throughout the conference. Panels and workshops underscored the importance of multi-disciplinary approaches, integrating legal, psychological, and social perspectives to enrich our understanding and effectiveness in protecting vulnerable adults.

Deputy Director’s Welcome Breaking Down Communication Disorders

I

n Adult Protective Services (APS), our commitment to safeguarding vulnerable individuals is an ongoing journey. One of the crucial aspects we face is effectively interviewing nonverbal adults, a challenge that demands specialized skills, patience, and empathy. This article delves into the intricacies of this process, drawing insights from Staci Whitney, LMSW, Senior Director of the Modell Consulting Group, who presented a workshop at the 7th Annual All Staff Conference.

Understanding Language and Perspective Language plays a pivotal role in how we approach nonverbal individuals. First, it is important to avoid broad strokes such as describing someone as “functioning like a 5-year-old” or having the “brain of a 3-year-old”. Such terminology can lead to dismissive attitudes and hinder the gathering of reliable information. APS professionals should use specific prompts that delve into the individual’s abilities, needs, and support systems.

Communication - Verbal Behavior Staci’s workshop highlighted the diverse forms of verbal behavior, challenging the misconception that “nonverbal” implies a complete lack of communication.

Expressive vocal verbal, receptive vocal verbal, expressive non-vocal verbal, and receptive non-vocal verbal are all avenues through which nonverbal individuals express themselves.

Understanding these nuances is crucial for effective communication.

Communication disorders are an additional layer of complexity, underscored the importance of time, patience, and recognizing communication as a twoway street. Apply essential strategies for those with difficult-to-understand speech by using yes/no formats, repeating and paraphrasing while waiting for confirmation, and embracing honesty, such as saying, “I didn’t understand, could you repeat?”

Communication Orientation and Validation Instead of making assumptions, interviewers are encouraged to ask specific questions about how the individual communicates. For instance, inquiring about gestures, writing, drawing, texting, or using augmentative or alternative communication devices can provide valuable insights.

Validation involves establishing a series of yes/no questions in random order. This technique ensures reliability in the information gathered, challenging preconceived notions and fostering a more nuanced understanding of the individual.

At the 7th Annual All Staff Conference in Spokane, Staci Whitney’s workshop was a beacon of knowledge and practical tools. Her emphasis on removing assumptions and biases, coupled with recognizing the diverse forms of nonverbal communication, has left an indelible mark on our approach to interviewing vulnerable nonverbal adults.

Some strategies, such as using yes/no question sequences for validation, have become integral to our training programs. The workshop enriched our understanding of nonverbal communication and emphasized the significance of individualized, person-first approaches.

Interviewing nonverbal vulnerable adults demands a holistic understanding of language, communication, and validation techniques. Staci’s workshop has empowered our professionals with the knowledge and skills to navigate this complex terrain with compassion and efficacy. As we continue our mission in Adult Protective Services, we are not just advocates but facilitators of voices that deserve to be heard, understood, and protected.

uiqin comes to us from the DSHS Office of Equity, Diversity, Access, and Inclusion, where she led the department’s initiatives and projects directed at reducing language barriers for Washington State’s limited- and non-English speaking residents in their access of state services. She directed the development of language access policy and standards, managed language service contracts, and oversaw the Language Testing and Certification program that certifies interpreters, translators, and DSHS bilingual employees. Before joining DSHS, Ruiqin worked as a Learning Delivery Professional with the Paid Family and Medical Leave (PFML) program at the Employment Security Department (ESD), where she developed curriculum for the PFML Customer Care Academy, tech training, and employee onboarding training during the preparation and launch stages of the program.

Prior to her career in state services, Ruiqin taught English, Chinese, and linguistics in universities in China and the United States. She served as

Associate Director of the Graduate English Teaching program at Shanghai Jiao Tong University, China. During her ten-plus years in academia, Ruiqin worked on various topics related to second language acquisition by adult learners, with a focus on pedagogy, learning assessment, and socio-cultural factors that impact learning outcome. She holds a Ph.D. degree in linguistics from the State University of New York at Stony Brook and a Master’s degree in Linguistics & Applied Linguistics from Hunan University, China.

Ruiqin permanently moved to the U.S. from China in 2015. She enjoys exploring nature on the hiking trails in the Pacific Northwest. She currently lives in Kent, WA, with her husband and two cats. Ruiqin likes reading historical fiction and biographies, and watching detective movies.

Ruiqin’s motto is “one is never too old to learn.” She is honored to be part of the APS Headquarters Training Team, which supports APS’ goal to serve Washington State’s vulnerable adults by developing and delivering high-quality training for employees.

EMPLOYEE SPOTLIGHT Recognizing Excellence in Our Workforce T

he APS Division is fortunate to have Timeo Kiertey as an APS investigator with the Kennewick office. She has been with APS for over 4 years. Timeo’s persona is like the light at the end of the tunnel, a breath of fresh air and the sunshine in your cloudy day. She is friendly, understanding and positive. Timeo is respectful to coworkers, management and gets along with everyone. She has great work ethics and integrity. Timeo never complains when taking on other investigations, conducting courtesy interviews or when she is hit hard with assignments, she continues her stride on working diligently on her cases.

Timeo is always open to new training and gives 100% of her participation even when her plate is full. She recently attended the Regional Leadership Development Workshop and for her graduation presentation, she presented on bringing one’s authentic self to work which Timeo models every day! She balances her professional and personal life. When away from work, she is very family oriented and devotes spending her time with her children and husband. She enjoys sewing and cooking.

ominic has worked as an APS investigator for two years. He grew up in the Bay area in California and went to school at Whitworth University in Spokane, Washington. Dominic moved to the western half of Washington shortly after accepting the role in the Everett office. Since joining our team, Dominic has proven himself to be an extremely competent investigator. When not protecting vulnerable adults, he has been having a great time exploring Snohomish County with his wife,

Hannah, and his dog, Buster. Some of his favorite places to explore are parks, trails, and his local library. Being a transplant from the San Francisco area, Dominic also enjoys rooting against the Seahawks two to three times a year.

Dominic loves the work he does for APS and is looking forward to continuing his career with Washington State.

aley Ness is an investigator in the Tacoma office. Haley works with integrity, positive energy and passion for the work APS does.

She has one of the highest investigation substantiation rates in the region and program managers, SHPCs and LBAs have commented on her thoroughness and ability to manage difficult situations. Haley also has developed meaningful relationships with community partners to protect our vulnerable adults.

She regularly takes on complex cases while maintaining a high closure rate in her caseload.

Haley is also quick to volunteer to help with additional cases, mentorship of new staff and is eager to participate in projects or pilot programs.

Haley has received high praise from various community partners. A professional with a local law enforcement behavioral health team told her supervisor that Haley had been, “Nothing short of exceptional working on a very difficult case. She is a go-getter and really does get things done. We have been incredibly impressed with her organization, effectiveness, compassion, caring spirit, follow through and reliability.” A nursing director at a local skilled nursing facility stated that Haley “restored our faith in DSHS and APS, we couldn’t have helped (the person) without Hailey and (the person) is safe now.”

Haley’s morals, values, positive energy, and experience shine through in all of her work and it is evident that she holds a real passion for carrying out the mission of APS.

In Washington State, we are known for our commitment to progressive policies, and are at the forefront of a crucial movement - transforming Adult Protective Services (APS) through the lens of Equity, Diversity, Access, and Inclusion (EDAI).

APS plays a pivotal role in safeguarding vulnerable adults from abuse, neglect, and exploitation. By incorporating EDAI principles into this essential service, we are setting an example for the nation, promoting not only the protection of our citizens but also ensuring that every individual, regardless of their background, receives the care they deserve.

Equity in APS Equity in APS involves ensuring that everyone, irrespective of their race, gender, age, disability, or socio-economic status, has equal access to protective services. It recognizes that vulnerable adults come from diverse backgrounds and experiences, and their needs may vary. The department is actively working on creating an equitable APS system by addressing these disparities. This includes providing culturally competent services that cater to the unique needs of different communities we serve.

Access to Services Access is a critical component of APS. Washington state recognizes that there can be barriers to accessing protective services, especially for those living in rural areas or facing mobility challenges.

In APS, we work to expand access by providing more localized services, promoting community partnerships, and leveraging technology to connect with those who might otherwise be isolated.

Inclusion for All Inclusion goes beyond physical access. It’s about ensuring that everyone is seen, heard, valued, and actively participates in decisions affecting their lives. Washington is making great strides in fostering an inclusive environment in APS to thrive in the spotlight across the United States. At the time, the survivor was only known as Emily Doe to the public.

Her story highlights cultural bias and a criminal justice system that is designed to fail victims. Her story helped inspire change in CA Law. When I read her story, I thought she is so brave, and this should be required reading to those in the criminal justice and judicial system.

This is an older book, but beautifully written, it is a letter to Ta-Nehisi’s son about his place in the world as a black male. It addresses American history on race in a very different frame.

By far one of my most favorite reads this year. It is fiction and I just finished this and loved it. Demon is a voice of rural America and this story takes you on his journey of being born to a single mother, ending up in the foster care system, attending inadequate schools and enduring addiction.

Data Updates

DataUpdate TIVA2: BIG CHANGES COMING SOON FOR DUPLICATE ALLEGATIONS The TIVA2 Team is always looking for ways to make the system work to best meet policies and procedures in the most simple and efficient way. With the Summer 2020 policy clarifications regarding incidents, and attaching intakes vs. opening a new investigation, there was an increase with instances of multiple allegations listed for the same incidents or self-neglect linked within 30 days on an investigation. This duplication of allegations related to the same incident or linked self-neglect intakes led to a sharp increase in the use of the “Closed No APS – Admin Error” finding used to address these duplications.

Example of current functionality:

Beginning tentatively February 1, 2024, in efforts to streamline the process when multiple reports are received for the same allegation on an incident under investigation in TIVA2, the system will stack the allegations with only one finding will need to be made for the allegation.

Example of new functionality:

This change will occur with new investigations created on or after the release February 1, 2024.

We are still evaluating the possibility to change the formatting on existing open investigations where the allegation stacking criteria are met. Along with updating how allegations are listed on investigations, this change will apply to how allegations are listed on referrals, requests for information, and outcome reports with only the singular instance of an allegation is listed. As we approach closer to release time, staff will receive more detailed information on the change, along with updates to the TIVA2 manual, and quick tip resources to help navigate this change.

PREPARING FOR THE WINTER MONTHS IN THE PACIFIC NORTHWEST As we enter the winter months, many may find themselves feeling a little down. For those of us in the Pacific Northwest, the beginning of our colder, shorter, darker days can have an impact on how we feel. During the fall and winter months, some people may notice feelings of sadness, fatigue, difficulty sleeping, and have less motivation.

If you find that you struggle a bit during this time of year, here are a few things to do to prepare for and better manage your well-being during the winter months:

Engage in activities that you can only do during the winter months. Find something that you enjoy doing and it can give you something to look forward to each year.

Increase exposure to light which can include outdoor light even when it’s overcast. Some research suggests that increased light exposure before 10 am is particularly helpful. Studies have shown that use of a light box (with 30 minutes to 2 hours or bright light exposure daily) can help improve how you feel.

Try to exercise and stay active.

Exercising for just 30 minutes, 2-3 times a week can have significant impact on your energy level and can improve your mood. Additionally, exercise under bright light may be even better, as it can improve general mental health, social functioning, depressive symptoms, and vitality.

As a result of the reduction of daylight hours, those living in the northern states are more prone to vitamin D deficiency. So, check with your doctor to see if a vitamin D supplement could be beneficial.

Prioritize social activities. It can be easy to decline an outing with a friend or loved one because it’s cold outside. However, it is important that you don’t do this too much so that you are not isolating from those you care about.

Listen to music. Researchers have found that listening to upbeat or cheery music can improve your mood in both the short and long term.

Studies have shown that a dawn simulator, a device that causes the lights in your bedroom to gradually brighten, can make it easier to get out of bed.

Try to stick to a regular sleep schedule. One possible reason for the fatigue some people feel at this time of year is because of the effect that changes in daylight hours have to your biological clock. This internal clock responds to light and dark to tell you when you should be awake, and when you should be asleep. People who are more sensitive to light will be more naturally inclined to sleep longer in the winter, so sticking to your regular sleep schedule will help your body better adjust to the lack of daylight.

A little compassion and professionalism can go a long way in transforming the lives of Washington’s vulnerable adults

Region 1

R

egion 1 investigators show their APS excellence responding quickly to the needs of a 77-year-old client related to allegations of financial exploitation, physical abuse, and neglect at the hands of their two adult children. APS was accompanied by local law enforcement for the initial visit at the client’s home, which they shared with the two alleged perpetrators. After some encouragement, the client confirmed the bruises on their body were caused by the alleged perpetrators, and in exchange for 1 can of soup per day, the alleged victim must cash their monthly check 17

and give it to the alleged perpetrators. The client shared that they “get sent to their room” for punishment without anything to eat for the day because of their “attitude”.

The client weighed only 90 pounds at the time of the investigation, and agreed to be transported to the hospital for evaluation, medical treatment, and to get away from the alleged perpetrators. While the client was at the hospital, our investigators continued to advocate to ensure protective services would be in place when the client was discharged from the hospital.

Region 2

A

PS received a report from a facility regarding a client who was at risk of eviction due to unpaid care. After further investigation, it was determined the client’s daughter, who also served as the power of attorney had taken over $100,000 from the client and purchased a home in their name resulting the client’s facility bill go unpaid. The amount owed to the facility was an estimated $90,000 in unpaid care.

The investigator worked closely with the Attorney General’s Office to obtain a vulnerable adult protection order against the client’s daughter that stopped further exploitation of the client. In addition, the investigator worked with the Assistant Attorney General’s Office, and the client’s other estranged son and daughter to file for conservatorship, appointing the daughter as guardian and son as their conservator.

Through this process, the investigator worked with the client’s new guardians to qualify for Veterans Administration services to obtain necessary medical care in the form of hearing aids which significantly improved their quality of life. The client moved to an affordable facility, and their family is working diligently with an attorney to seek judgement from the court to have the alleged perpetrator pay back client’s stolen funds.

attachment disorder. The client was taken advantage of financially and physically by multiple persons that have come and gone in her life due to client’s poor judgement, insight, and risk of victimization.

Most recently, the client had a baby and reported was unaware of the pregnancy.

Both the child and the client tested positive for methamphetamine at the hospital. The client stated that their boyfriend smokes methamphetamine around them, and forces client to have sex following the childbirth, despite doctor’s orders to abstain for a period of time. It is also alleged the client’s boyfriend and some of his family members take advantage financially, forcing the client to buy items like cell phones, food, and pay for hotel rooms.

The APS investigator has left no stone unturned digging into the multiple allegations surrounding the client. Numerous staffings have been held to include shared interest staffing with headquarters and countless collateral contacts with community partners, agencies and the Assistant Attorney General’s office for guardianship options. Although, there may not be a perfect right answer to all the client’s various challenges, the investigator continues to work tirelessly and collaboratively with community and state agencies to support the client to be safe and adequately cared for.

Through the investigator’s hard work, they were able to not only implement protective services for the client in terms of a vulnerable adult protection order and conservatorship, but also secured a stable living situation and assisted the client in accessing medical care.

Region 3

W

hile the client is only 30 years old, the list of services, resources, and housing options that have assisted in their lifetime nearly equals to the client’s age. Multiple professional assessments have documented the client’s diagnosis to include early onset schizophrenia with multiple developmental deviances, intellectual disability, PTSD, and 18

andi Ojeda’s story at APS is not just impressive but also inspiring. She joined APS in July 2022, and recently became the Administrative 5 in December 2023. Before joining APS, Mandi had a unique and varied mix of roles, from helping military families move to managing operations at Subway and Dairy Queen franchises. All these experiences have given her many skills that she now brings to her job at APS. When chatting about her journey, Mandi shared, “You’ve got to embrace every part of you. It’s not just about the job. It’s also about what fires you up outside of work.” This captures how she juggles her professional and personal life. At APS, she’s known for bringing her A-game, focusing on her strengths and contributions in a place that values everyone for who they are.

Mandi also highlights why it’s so crucial for the LGBTQ+ community to be visible.

“Seeing people who are like you out there makes a big difference. It starts conversations and breaks down barriers,” she notes, acknowledging the strides made and the hurdles still out there.

Mandi’s got some real talk for anyone grappling with their identity: “Be yourself and find your tribe. Understanding that we’re all different is what makes a place welcoming for everyone.”

Mandi’s own story, particularly as part of the LGBTQ+ community, is a tale of self-discovery and being cool with who she is. Her family, especially her mom, played a considerable role when she came out. “Having my mom’s support was a game-changer. It turned something scary into something empowering,” Mandi recalls, showing how crucial her family’s backing was.

One thing Mandi loves about APS is the vibe.

“It’s like a big family here. We don’t just recognize everyone’s unique stories; we celebrate them,” she says. You can tell she’s really into the inclusive and positive culture at APS.

Her skills in customer service and problemsolving shine at APS. Mandi praises her team for their trust and growth together. And she’s not just about the 9-to-5; her volunteer work at the South Whidbey Senior Center shows she’s really into giving back to the community.

Mandi sums up APS like this: “This place rocks.

It’s about making everyone feel like they belong and are valued. That’s the secret sauce here.”

Mandi has many hobbies outside the office, from latch hooking, to chilling with friends and family, to volunteering. Her cat, Nala, is her furry buddy and Mandi is all about the lush greenery and rainy days of Washington.

Now, here’s the thing about APS and why diversity is vital. Having staff like Mandi from all different backgrounds and perspectives is what makes APS awesome. It’s about bringing together a mix of experiences, ideas, and viewpoints. This diversity is not just nice to have; it’s essential. It helps APS understand and meet the needs of a diverse community, sparking innovation and making the workplace richer and more dynamic. It’s like having a palette with more colors – the more you have, the more vibrant and detailed the picture.

Mandi’s journey and role at APS perfectly exemplify why embracing diversity and creating an inclusive space is super important. She’s not just rocking it at APS; she’s also inspiring loads of people with her story.

POLICY UPDATES

he second round of the APS Policy Suggestion Box was again, a success! This time the APS Senior Policy Advisor met with staff who were interested in meeting, to discuss their suggestions while the suggestion box was open instead of waiting until it closed. Seven staff submitted ideas regarding the documentation policy. The APS Policy Unit continues to work through the ideas from the first suggestion box on decision-making. Drafts and discussions are in progress based on suggestions received.

We hope you have been enjoying the guest speakers at the recent Understanding Policy Webinars because we have more in the works. The goal of the series is to enhance understanding and communication with our partners in protection, which will ultimately lead to better outcomes for those we serve.

LEGISLATIVE UPDATES

t’s legislative session time! Washington State has a biennium system. This means legislative cycles are two-years, with odd numbered years lasting 105 days (long session) and even numbered years lasting 60 days (short session). The legislative session starts on Monday, January 8, 2024, and ends on March 8, 2024 (short session).

In any session, the Governor may also call a special session to address specific issues and lasts no more than 30 days.

Even though there are no plans to introduce new APS legislation in this short session, there will still be plenty of legislative work to be done. Every year the APS Senior Policy Advisor and headquarters leadership staff review and analyze many bills that may have an impact to ALTSA and APS. This is also time for planning and stakeholder work related to any potential legislation for the next biennium, which starts in 2025.
