Legislative Update: Criminal Jurisprudence Committee

In this week’s article, I want to follow up and give an update on this important legislative session that is well underway. Last month, March 13th marked the legislative filing deadline to file bills for the 84th Legislative Session. With this deadline now past, I want to take this opportunity to discuss some of the bills that have been filed and have been up for hearings in the committees that I now serve on. It is important to note, however, that while the bill filing deadline has passed, this does not mean that the dialogue has been finalized. House and Senate committees are hearing many bills and the next stage of the legislative session is in progress.

As your elected representative, I want to take this opportunity to feature some of the pieces of legislation that have been introduced and have come before committees that I serve on for this current legislative session. Below, I have listed some of the bills that were recently before the House Committee on Criminal Jurisprudence.

• HB 273: Relating to the minimum term of confinement for an offense of illegal dumping in a municipality.

• HB 511: Relating to the prosecution of certain offenses committed against a person in custody.

• HB 563: Relating to the prosecution of and punishment for the offense of official oppression.

• HB 597: Relating to the designation for criminal prosecution and other purposes of certain chemicals commonly referred to as synthetic cannabinoids as controlled substances and controlled substance analogues under the Texas Controlled Substances Act. • HB 1076: Relating to the authority of a magistrate to prohibit certain communications in an order for emergency protection.

• HB 1293: Relating to the confidentiality of identifying information of victims of stalking; creating a criminal offense.

• HB 1503: Relating to the rights of certain defendants who successfully complete a term of community supervision.

• HB 2185: Relating to the execution of a search warrant for taking a DNA specimen.

• HB 2263: Relating to warrants or orders issued to obtain location information from wireless communications devices and to public access to law enforcement or prosecutor requests for certain related location or communication information.

• HB 2525: Relating to the appointment of counsel to represent indigent defendants in criminal cases.

I will plan to do updates on bills being considered. This will give some information on what potential laws are being reviewed.

Senate News

Committee Hears Bills To Regulate Payday Lenders (Austin) Three bills aimed at reining in what supporters believe are unfair lending practices by so-called payday lenders were in front of the Senate Business and Commerce Committee on Tuesday. Critics of these lenders say that they offer unreasonable terms that trap borrowers in an inescapable cycle of debt paying exorbitant fees and interest payments. “Currently there are payday lenders charging rates of over 500 percent and borrowers are expected to pay the full sums of those loans within two weeks,” said San Antonio Senator José Menéndez.

Witnesses testified that legislative efforts to regulate the industry date back to the 1990s. After the Legislature put payday lenders under the same interest and fee restrictions as commercial banks in 2001, lenders reorganized as credit service organizations, which allowed them to escape fee regulation. Though they cannot charge more than ten percent interest on loans, there are no restrictions on fees. Further testimony showed that short-term payday or car title loans in Texas come with many more fees than in other states. Ann Baddour of Texas Appleseed told senators that a two-week loan of $500 comes with an average of $115 fees in Texas. That’s compared to $55 for the same loan in Florida and $65 in Oklahoma. She attributed it to a lack of a regulatory framework in the state. Senator Royce West of Dallas said that there are more than four times as many payday loans issued in Texas than commercial loans.

The bills considered Tuesday target various issues associated with payday lenders.

SB 1323 by Menéndez would categorize fees offered by payday lenders as interest for purposes

of usury laws. SB 92 by Senator Rodney Ellis of Houston includes more regulations. It would limit loans to twenty percent of a borrower’s gross monthly income. Auto title loans would be limited to the lesser of three percent of the borrower’s annual income or 70 percent of the vehicle’s value. The total number of loan payments would be limited to four, and each payment would apply towards a quarter of the loan principal. The third measure, SB 121 by Dallas Senator Royce West would limit to three the number of times a loan can be refinanced, limit the maximum term of a loan to 180 days and preserve the power of cities to regulate local payday lending practices. All three bills remain pending before the committee.

Also Tuesday, the conference committee on the state budget began public meetings. That’s the group made up of five members from each chamber that will hammer out the differences between the House and Senate versions of the budget. Senate Finance Committee Chair Jane Nelson said both versions fund the same priorities and include significant tax cuts. “These budgets have much more in common than they do in conflict and I am confident that we can work out the differences and pass a budget that will make Texas proud,” she said. The two budgets are already fairly close together according to Legislative Budget Board Director Ursula Parks, with only a $1.6 billion difference in all funds. That is a less than one percent difference in total funds, but there are differences in where that money is spent.

The committee will negotiate these differences and then present a product for final approval to each chamber before the session concludes June 1st.

Greetings! I have lived in the Coastal Bend my entire life and cannot remember a rainy spring like this. I am sure I am forgetting one but it has been something.

While we certainly need the rain and we all will be overheated soon, it sure has been an interesting rain filled spring. Come on sun. We need to see more of you.

The Padre Balli Park project on North Padre Island has been sent to the Purchasing Department of the County to procure bids. That is a good sign. While it will not happen overnight you should see significant improvements to North Padre Island soon. The plan is to spend roughly 2 million dollars in the Padre Balli Park area to improve and enhance the facility and generate new revenue from those who will use the new facilities. As previously mentioned Padre Balli Park makes money for Nueces County and if we can build additional revenue producing functions there then we can make more money and hopefully help me in my quest to not raise taxes.

I recently traveled to Austin to testify on Windstorm Reform bills in front of the Texas Legislature as the official representative for Nueces County. I spoke for all of Nueces County but put special emphasis on the negative effect windstorm rates have on North Padre Island, Port A and the rest of my precinct. A big majority of the claims payouts have come from hail damage which further emphasizes that this is a statewide issue and not just a coastal county issue. One day I have hope that the legislature will fully understand that. Until that time I will

continue the battle on windstorm. Kudos to State Representative Todd Hunter and his staff for leading the windstorm issue for us in Austin.

Sandfest by all accounts was a huge success again in Port A. I was pleased to be a sponsor of that event. My office volunteered time to assist in the event as well. That is a great event for the Coastal Bend. I was also pleased to be in attendance on the Island at the check presentation to the Big Brothers Big Sisters organization where $10,000 was donated as proceeds from the Barefoot Mardi Gras event sponsored by the PIBA. That event too has become a signature event for the Coastal Bend.

The county is working diligently on becoming the most ADA (Americans with Disabilities Act) compliant county around. We are working diligently to look at all of our facilities and ensure that all Americans have the ability to properly access our facilities. The expense for that will not come cheap but the importance of this is self-evident.

The plans for the IB Magee beach facility in Port A are still being worked on. Please contact the Parks Board for any input you have in their design process. Thanks again to the Nueces County Coastal Parks Board for their great efforts on the work for this facility and Padre Balli Park.

Our goal is to raise the millions needed to preserve the shrine and build an Alamo Museum and Visitor's Center to display Phil Collins' gift to all Texans: his Alamo artifacts.

This collection includes Jim Bowie’s legendary knife, one of only four remaining rifles owned

by Davy Crockett, letters from William B. Travis, and many other historical documents that shed insight on early Texas history. These Texas treasures now sit in storage, waiting for us to take action.

Travis' tenacity inspired his men, and showed the world what it means to be a Texan. To this day, the heroic story of the Alamo defenders and their defiance against tyranny define our state's character. The glory of this seminal battle draws visitors from across our state, the nation, and around the world to better understand what happened there in 1836.

A proper Alamo Museum and Visitor's Center would tell the story of the Alamo defenders, and help visitors better understand why this Spanish mission in downtown San Antonio means so much to us and the world.

Unfortunately, the carnival-like atmosphere they find at the Shrine of Texas Liberty and the lack of a cohesive narrative often leave them disappointed. Even worse, there is nothing to show the proper reverence and respect for the men who gave their lives for Texas. More critical at this moment is our knowledge that the Alamo itself is literally beginning to crumble.

Travis' plea came too late to help him and his men inside the walls of the Alamo, but it carried across the country and rallied support for their cause. His inspiring words are as valid today as they were then. The history of the people of Texas and our great state is reflected in the spirit of their bravery. It is time to honor that spirit again.

Tourism to Padre Island National Seashore creates $27,198,200 in Economic Benefits PINS Visitor Spending Supports 361 Local Jobs

A new National Park Service (NPS) report shows that 578,814 visitors to Padre Island National Seashore in 2014 spent $23,892,700 in communities near the park. That spending supported 361 jobs in the local area and had a cumulative benefit to the local economy of $27,198,200.

“Padre Island National Seashore welcomes visitors from across the country and around the world,” said Superintendent Mark Spier. “We are delighted to share the story of this place and the experiences it provides. We also feature the park as a way to introduce our visitors to southern Texas and all that it offers. National park tourism is a significant driver in the national economy, returning $10 for every $1 invested in the National Park Service, and it’s a big factor in our local economy as well. We appreciate the partnership and support of our neighbors and are glad to be able to give back by helping to sustain local communities.”

The peer-reviewed visitor spending analysis was conducted by U.S. Geological Survey economists Catherine Cullinane Thomas and Christopher Huber and National Park Service economist Lynne Koontz. The report shows $15.7 billion of direct spending by 292.8 million park visitors in communities within 60 miles of a national park. This spending supported 277,000 jobs nationally; 235,600 of those jobs are found in these gateway communities. The cumulative benefit to the U.S. economy was $29.7 billion.

According to the 2014 report, most park visitor spending was for lodging (30.6 percent) followed by food and beverages (20.3 percent), gas and oil (11.9 percent), admissions and fees (10.2 percent) and souvenirs and other expenses (9.9 percent).

Padre Island Business Association. The association is a not-for-profit organization whose primary purpose is to advertise and promote Padre/Mustang Islands, Flour Bluff and Corpus Christi while advancing the interests of the business community.

It is managed by a 9-member board of directors.

A membership luncheon is held on the 2nd Thursday of each month at Holiday InnPadre Island starting at noon. Mixers are held on the 3rd Tuesday of the month. The association annually has two fundraising events – Taste of the Island in the fall and a Wine Tasting in the spring.

P.I.E. Padre Island Enrichment Club, Inc, P.I.E. strives to enrich the lives of Padre Island women through social activities and community involvement. Full membership luncheon meetings are held the second Friday of each month at the Holiday Inn. Members may also participant in special interest clubs (bunco, bridge, spades, books, etc) that meet throughout the month. ARK – Animal Rehabilitation Keep.

Located in Port Aransas the ARK is affiliate with the University of Texas at Austin Marine Science Center. They handle the rehabilitation of most species of wildlife in the area with an emphasis on marine animals. They care for about 1300 animals each year, including about 300 sea turtles and more than 100 species of birds. Island’s PIPPs Chapter of Corpus Christi Red Hat Society. In 2004 a group of Island ladies got together under a Palapa and founded the Padre Island Palapa Pals (PIPPs). Our only rule is that there are no rules! We are all about fun and friendship.

The Texas Coastal Bend is about to be conquered.

Dotson’s Note: I believe that it will be very beneficial for all Veterans, their families and the public to attend this Town Hall meeting (see below). U.S. Congressman Farenthold will inform us as to what is going on with the VA and will listen to all questions. There will be a number of persons present who will answer individual questions and assist Veterans in registering with the Veterans Administration.

Also they will assist Veterans in applying for benefits which they and/or their families are eligible. Please call and/or Email me if you have any questions regarding this most important meeting.

The intrigue began in March 2015 when conspirators first met on a Thursday evening at the Winery on the Bay at 106 S. Austin Street in Rockport. The plot was hatched under the guise of something called Open Mic Poetry and Jazz Night.

Open Mic Poetry and Jazz night is the brainchild of Skoot Larson, a native of San Pedro who recently moved to Texas. A member of the Rockport Writers Group, Skoot is a novelist, poet and musician. A jazz authority whose knowledge of decades of jazz music is encyclopedic he was dubbed His Royal Hipness

by American stage performer, recording artist and hip poet/comic Lord Richard Buckley.

There’s not a tweed jacket in sight. Hawaiian shirts and graphic tee-shirts abound and there’s no coffee but there is wine. Winery on the Bay is no smoke-filled bar or stuffy coffeehouse.

Begun in Gruene, Texas, it’s a boutique winery that produces its own wine. Using juice from vineyards around the world, the vintners ferment, filter, bottle and label 30 varietals of red, white, fruit-infused and dessert wine and offer it for sale by the glass or by the bottle. You can sample four tastings for $3.00 or, buy and keep the souvenir glass for $5 and get those four tastings along with it.

As Open Mic night gained fans, the conspirators began to meet every Thursday evening to advance their plan to capture the hearts and souls of Coastal Bend residents with engaging music and riveting spoken word, holding the readings inside the Winery on the Bay or on its patio with views of the bay.

Those who have never been to a poetry reading probably imagine a stuffy academic type in a tweed jacket with elbow pads standing at a lectern droning something obscure and incomprehensible while the audience sips black coffee and tries to pay attention.

The Coastal Bend Open Mic nights are nothing like that. An aficionado of bebop, Skoot was inspired to launch Open Mic Night by a form of entertainment called “word jazz” where poets recite their work backed by jazz musicians, creating an especially intense aural experience. While those who want to perform are welcome to read favorites by other authors, most recite their own original work—poetry, short stories, and novel excerpts. Sometimes rhymed, sometimes free verse, the Open Mic night readings run the gamut from humorous to heart-rending, delivered with feeling by the person who wrote the words.

Rockport conquered, they targeted their next city: Port Aransas. The first Open Mic Poetry and Jazz night to be held on Mustang Island will be Sunday, May 3, 2015, beginning at 6 p.m. at La Barataria, 3500 Island Moorings Parkway in Port Aransas. La Barataria is also not a smokefilled bar or dim coffeehouse but rather a fine restaurant and wine bar with a deck overlooking Island Moorings marina.

Both Open Mic Nights are free for both readers and the audience. No RSVP or registration is necessary; just show up.

Lest we forget, Hitler died 70 years ago As the anniversary of the Nazi leader’s death approaches, there is a divide between the wish to avoid the shameful past and a need to acknowledge it.

Berlin is the capital of Europe’s economic powerhouse, a vibrant city with a rich cultural life and a palpable sense of growing confidence. But if its future looks brighter than in generations, it also has an awful lot of dark history weighing on its civic conscience.

This Thursday marks the 70th anniversary of Adolf Hitler’s death (4/30/45) but, like his birthday (4/20/1889) last Monday, it will understandably go unmarked. For many years the spot where he killed himself was also unmarked. The past can be an unwanted presence in Berlin.

It is, after all, only 25 years since a huge concrete wall separated east from west and communism from capitalism. At first, in an effort to reunify the divided city, the site of the demolished wall was so comprehensively built over that it was hard to know it had been there.

Tourists became so baffled that a cobblestone outline was laid down in the center of town to show where the wall had stood.

Today there are also a couple of preserved sections of the wall, a Checkpoint Charlie display, a dedicated museum and even kitsch celebrations of the infamous East German car, the Trabant. After a period of determined “moving on”, the German capital has grown more at ease with the past that it was in such a rush to escape.

But less so in the case of the past that originally led to the city’s division, the Nazi era. There are few surviving buildings or monuments to testify to the period in which Berlin was the Nazi capital, when it was to become Welthauptstadt Germania, an Albert Speer-designed world capital of a massively expanded German nation.

The Olympic stadium, site of the 1936 Games, still exists, the disused Tempelhof airport and, most notably, the forbidding former ministry of aviation from which Hermann Göring boasted of dominating the European skies. It is now the home of the ministry of finance, which many believe dominates Europe in a far more effective manner than the Luftwaffe could ever have done.

The rest of Nazi Berlin was buried at the end of the war by a mixture of RAF and US bombing and Red Army artillery. The memory of what it had been was further interred on both sides of the wall by a concerted effort to wipe out the legend of the man who continues to cast his ominous shadow over Berlin.

On 30 April 1945, with the Red Army only streets away, Hitler killed himself in the Führerbunker beneath the Reich Chancellery in the city center. His body was then taken out into the open, doused in petrol and set alight in a bomb crater.

No one is sure what happened to his remains, although the Soviets believed that they had taken possession of them and kept them hidden in secret. But like some cursed relic, they were deemed too dangerous to conserve and in 1970 the Soviets had them dug up, incinerated and the ashes thrown into a river.

The Führerbunker itself was blown up and built over. But when the Berlin Wall was dismantled, it was discovered that much of the bombproof structure was still intact and it was reburied all over again.

The Holocaust Memorial in Berlin will not rescue Berlin. By April 27, Berlin is cut off from the rest of Germany. Hitler receives reports that Heinrich Himmler, the leader of the SS, has offered to surrender to the western allies.

On April 29, Hitler marries Eva Braun in a civil ceremony held in the Führerbunker. Later that day Hitler, skeptical about the potency of the cyanide capsules he has received from the SS, tests one on his dog, Blondi, which dies.

At 1 a.m. on April 30, Hitler is informed by officers that all forces he had been hoping would come to the rescue of Berlin had either been encircled or forced onto the defensive.

Later that day Hitler commits suicide, shooting himself in the mouth. Braun takes a fatal overdose of cyanide. Hitler’s remains, as he had requested, are doused in petrol and set alight in the Reich Chancellery garden outside.

On the morning of May 1, Stalin is informed of Hitler’s suicide, but three days pass before his body is found. Germany officially surrenders on May 7 in the French city of Reims. Fighting ends at 11:01 p.m. on May 8, which is declared VE Day.

Dotson’s Other Note: When I was 14 (in 1942), I read in Life Magazine a futuristic article about a young girl in 1975 asking her mother if there had really been a German named “Adolph Hitler” who had started WWII? At that time I could not believe that anyone in the US of A would not know that “Herr Hitler” had existed.

Also about the same time, I asked my mother what she would have done if the Germans had occupied the U.S. My mother, being a very practical person said, “I would give the Nazi salute and yell ‘Heil Hitler.’” Putting it mildly…I was shocked! Veterans Town Hall Meeting Tuesday, May 5 Military Veterans in Nueces County are missing out on benefits because only 8900 out of 32,000 of them are registered with the Veterans Administration.

“Many of the veterans have private health insurance so they don’t register,” said Dotson Lewis, who is helping to organize the event.

“The VA is trying to cut the number of military doctors in Nueces County because we don’t have enough veterans registered. We have enough of them living here to quality for more doctors, but too many of them are not registered so they are not counted.”

A Veterans Town Hall Meeting is scheduled for Tuesday, May 5 at American Legion Post 364, 5323 Kostoryz Road at 11 a.m.- 2 p.m.

Tuesday May 5. Veterans can registered there to be included on the VA rolls. Food and soft drinks will be served.

The American Legion Post 364 will co-host the event with the Office of Congressman Farenthold. This will be an open meeting and all Veterans, spouses, dependents, and friends of veterans.

One soggy week in review…

Well, SandFest endured a week’s worth of adversity with monstrous thunderstorms as well as vandalism but still emerged our shining star. Kudos to the sculptors, volunteers and staff that pulled this one out of a soggy hat this year. There may have been big rain puddles everywhere but the sculptures were still amazing and the music still went on. .. and brother, the crowds did come.

The traffic gridlocked the streets of Port A on Saturday afternoon as it took over two hours to drive from N. Padre and the mega-long ferry lines tested everyone’s patience both coming and going. The clubs did very well over the weekend. Back Porch manager, Burke Dawson,

According to their Facebook page, “Buc Days grew out of the bathing beauty contest and picnic called “Splash Days” occurring on North Beach each year. In 1938, the newly formed, Buccaneer Commission, decided to stage a bigger and more elaborate celebration based on the history and legend of the days of long ago when pirate ships haunted the waters of the Gulf and preyed on merchantmen.” 2015 marks the 78th year for Buc Days and the 24th year of rodeos. An estimated 250,000 participants attend Buc Days each year and this springtime event boasts something for everyone, including a Pro PRCA Rodeo, a Carnival, a Rodeo BBQ Tailgate Party, and the largest event, the Illuminated Night Parade. Over 160,000 attendees line the streets each year awaiting the Buc Days Pirate Queens and Buc Days King scholarship contestants on the Buc Days float.

The Toman Brothers will play Giggity’s on Saturday night Sky Smeed & Joe Mack will play Shorty’s on Friday. up, he’s been know to actually set a guitar neck on fire with his fingers. He’s somewhere between Leo Kotke meets Flatt & Scruggs at Jerry Garcia’s house. Smeed joins Joe Mack on this run through Texas, Colorado, Oklahoma, Missouri, Kansas and New Mexico with a new CD, Drive All Night. These boys are truly a sight to behold and a lesson in hillbilly guitar picking. DO NOT MISS this show! And over at Giggity’s on Friday, Myndfield will make their debut with a repertoire of funk and soul and the big horn party band Cruise Control will play the Back Porch and everybody’s favorite coach, Jim Dugan will serve it up at

institution. Otherwise on Saturday, it’s Aaron Lewis at Brewster Street and Wings Over Society at the Handsome Sailor. On Sunday the 3rd, rock super-stars ZZ Top and Jeff Beck will play Concrete Street. It looks like the weather is finally going to be nice for a while, so this show should rock. If I have to tell you who ZZ Top and Jeff Beck are then go crawl back under that rock and stay there. And finally on Sunday, the Swinging Utters will play the House of Rock.

I have no idea who the Swinging Utters are but this may be my only chance to mention them in a sentence.

Uncle Lucius played an excellent show at the Back Porch last Friday reported SRO crowds for both weekend shows.

Uncle Lucius put on a stellar performance on Friday even though there wasn’t any room left to dance. People were showing up as early as 6:00 to stake claim on their tables. And the Gary P. Nunn show drew nearly 400 fans on Saturday. You needed a shoe horn to get in that room. Over at Giggity’s both the Lyrical Binge and Todd Dorn shows filled the house with SandFest revelers as did the Ty Dietz and 90 Proof shows at Shorty’s. I also heard from Capt. Tom Doran that the Handsome Sailor

Ray T popped up at the Monday jam and reunited one version of the City Crew with Chris Jorday and Reeves Allen Tiki Bar got their season rolling with a great turnout for Carol Elliott and later HOBO. It was great to see all of the bands received so well. I think we’re going to have a killer season this year. And one last thing, on Sunday at the weekly open jam at Giggity’s this week, Ray T was back in town and ran into a couple of ex-City Crew members: Chris Jordan on bass and Reeves Allen on drums. This made for a scalding reunion on stage and was a lot of fun.

Buc Days…

There are a couple of events coming up this week in Corpus. First of all, Buc Days is

Duke E. Brown will play Rockit’s this Friday Corpus Christi nightclub magnate, Mark Schaberg (Brewster Street Ice House and Concrete Street Amphitheater) has announced the opening of his newest acquisition, Rockit’s (formerly known as Doctor Rockit’s Blues Bar). The storied blues venue, located on N. Chaparral, across from the bus station in downtown Corpus, was host to hundreds of local, regional and national blues acts for 25 years. Schaberg and his partners, Bill Durrill and Eric Gutschow, took over this venue when owners Jennifer and Larry Williams decided to call it quits a few months ago. It’s my understanding that the entertainment will take on a bigger variety of genres and will encompass more Americana shows. Schaberg said, “We’re excited to bring downtown Corpus Christi an upscale but casual interactive entertainment experience.” They will open today, Thursday the 30th, and will have performances by Duke E. Brown on Friday and Flatbroke on Saturday.

Over at Shorty’s, Carol Elliott will play a song swap with a fellow singer-songwriter from Nashville, Janet McLaughlin who’s worked with the Indigo Girls and had songs recorded by Loretta Lynn. And a Giggity’s the mighty Toman Brothers (San Antonio, TX) will return. The Tomans are country super-star Gary Stewart’s old road band. All you Gary Stewart fans need to come check the Tomans out. Steve Earle and the Dukes will play the House of Rock on May 10 multi-GRAMMY winner Steve Earle and the Dukes (Nashville, TN) on a show with Ty Dietz & Pake Rossi and The Mastersons.

Earle is touring in support of his latest release, Terraplane. I’m a huge Steve Earle fan and have been since the release of Guitar Town in 1986. I recently read his biography, Hard Core Troubadour, and must say, that’s one tough hombre’. Originally from San Antonio, Earle is an advocate for no death penalty and an international star who came up in the Guy Clark, Townes Van Zandt, Rodney Crowell camp.
