gin Eden Mill Eden Mill unveiled its 2019 Release Single Malt whisky just in time for St Andrew’s Day. It was a limited release of 3,000 bottles and saw Eden Mill collaborate with Fife-based artist Hilke MacIntyre to create the art piece, titled ‘St Andrews’ for the presentation box. The artwork was inspired by pivotal moments in Eden Mill’s story and features famous landmarks of the St Andrews and Guardbridge coastline - Eden Mill’s home. The 2019 Release Single Malt was the third single malt whisky by Eden Mill in two years.

Pickering’s Gin Pickering’s Gin hit the headlines at the end of last year when it created the world’s first Brussels Sprout gin. It was made with 10,000 ‘lonely and forgotten’ Perthshire sprouts that were all sourced from Crofts Farm in Arbroath, then carefully picked, cut, and distilled. It sold gin-filled baubles at Edinburgh’s Christmas Market and Pickering’s Gin is made at Summerhall Distillery in the Capital.

Boë Gin Singer Paloma Faith is the most recent ambassador for the Boë Gin brand.

She fronted an ad campaign centring on the theme, ‘standing out from the crowd.’ Boë also added Boë Passion to its range, which uses passionfruit flavours, and which was also used in a signature serve for the singing star, called Paloma’s Boë. Made with Boë Passion gin, Tequila, lime juice, agave, chilli and cranberries, the cocktail was available for customers to order on request from bars stocking Boë Passion across the UK.

At the end of the day the responsibility is at the feet of the licence holder – the buck stops with you. This includes making sure your staff understand the specific licence terms that apply to the premises they work in. Staff should know what is, and is not, allowed on your premises and this does vary from premises to premises.

Staff should be re-trained on important items on a regular basis and these reminders should be recorded.

Fundamental points such as: The premises licence, operating plan and the mandatory conditions and any local or specific conditions relating to your licence should all be known by everyone, working not in the premises not just management. Keeping decent records of all ongoing staff training is a must. If something goes wrong and you end up before a licensing hearing, or in an intervention meeting with the police, then having evidence that you have taken all reasonable steps to stop problems from arising can only be a good thing. Although the law only requires a staff member to be trained once, a responsible licence holder will make sure the staff training is delivered properly on an ongoing basis and that proper records are kept. Failure to so do can mean that your licence is in real jeopardy if something goes wrong.

A daily or weekly reminder systems can be a boon. EPOS tills flag reminders for sales and instruction in record keeping for refusals and incidents should be carried out. Keep records of all of this! The training can be delivered by someone with a personal licence but ideally it should be someone who is not just a personal licence holder but who is half decent at delivering the training.

The hospitality sector can have a high turnover of staff. You will take new people on all the time.

Any time you take someone new on, the best bet is to retrain them with the 2 hour course before they start their first shift. Do not trust that a staff training certificate offered by a new staff member will be genuine or that it will enable the new staff member to be an effective part of your team. It will certainly not cover the details in your operating plan. Although previous training is transferrable to a new workplace, why risk it?

How do you know that the training was properly

CHALLENGE 25 Age verification: have a proper policy Most people now recognise the phrase “Challenge 25”. The legal age for consumption of alcohol is still 18 but your licence now has a condition that requires you to verify the age of anyone who looks under 25.

Although there is no specific requirement to have this policy in writing, it is sensible to have it down on paper. How else can you prove that you have one? There are a number of forms of acceptable ID including a European or UK Photo part Driver’s Licence, UK Passport and Pass Card. EU national identity cards, biometric immigration documents, and military ID. However, whilst staff can familiarise themselves with all of these documents by looking at www. challenge25.com, in my experience it is safer to refuse a sale unless you are 100% sure that the ID is genuine, and if you don’t know

RELATIONS WITH POLICE AND LSOs It is incredibly important that the licensed trade work to have a positive, respectful relationship with police officers and LSOs. Remember that police and LSOs can enter and inspect your premises at any time and have the right to ask for documentation such as the premises licence or personal licences or staff, or to see staff training records. Despite recent tensions between the licensed trade and Police Scotland, my advice is always to contact the police if there has been an incident on your premises. How better can you serve your customers, create a safe and welcoming environment and ensure that ultimately you have all bases covered, than by upskilling your staff.

MANAGER CHANGES? DON’T MESS AROUND Every premises has a named Premises Manager (PM). This is the person whose name appears on the licence and is expected to be the day to day manager of that premises. A person can only be a PM on one licence at a time. It is always best to have one spare personal licence holder on your premises staff as it can be nearly impossible to recruit, and or train anther person to take on the role in the 6 weeks period. This is incredibly important. If you miss the 7 day notice, or separately if you miss the 6

week deadline to name the new manager, then the police or the LSO can come calling and ask you to shut – it is unlawful to sell alcohol if the 7 days or 6 weeks deadlines are missed. Most local police and LSOs are pretty clued up as to who is named as a manager on which licence so don’t underestimate this point.

Not only might you have to close for a short period until a new manager is named, ultimately the premises licence could be subject to a review.

A PM does not need to be on the premises at all times. There is a general expectation that the person named should have day to day control of the premises but there is no legal requirement for that person to be physically present. That being said, as the police and LSOs will expect the named manager to have control of staff it is sensible to have someone named who is genuinely on or around the premises on a frequent basis. It was recommended you have at least one spare personal licence holder per premises so you can slot them in should you need to change the premises manager. You can always change this once you have had time to recruit and new person if needed.

WHAT YOU MUST DISPLAY IN YOUR PREMISES In addition to your weights and measures and smoking notices, you have a legal duty to display certain licensing notices too. The premises licence itself can be quite a large document, with the main licence encompassing the layout plan and the operating plan, and a separate licence “Summary”. It is the separate, smaller Summary document which has to be displayed prominently so it can be viewed by the public – not necessarily just behind the bar if it cannot be read from there. It is an offence not to have it displayed properly so make sure you’ve got this covered.

The main licence, which is normally a document that could be 10 – 20 pages long and sometimes more, does not need to be displayed but it does need to kept on the premises in a safe place where it can be accessed by staff both for training purposes but also because a police officer or LSO are entitled to see it upon request.

The main licence should either be the principal (original) copy, or a photocopy which has been certified by a solicitor as a true copy. It is good practice to keep a certified copy on the premises and the original in a safe place as it has to be

returned to the board if any applications were made such as a change of manager. We suggest you keep a copy of the whole premises licence in a folder behind the bar together with copies of all personal licences kept on the premises and copy staff training certificates behind the bar. Keep the originals in the safe in the office.

If the licence is lost or stolen, you must make a lost property report on the Police Scotland web site, in order to get a reference number, and a

duplicate requested from the licensing board, which normally attracts a small fee. In addition to displaying the summary of the licence, you must also display a notice referred to as the “Section 110” notice which details age related offences and confirms the position that alcohol will not be sold unless verification has occurred. In addition to this, whether or not if your premises allows under 18s, then a separate notice should also be on display indicating that under 18s can or can’t

Alcohol promotions, advertising and displays DO’s and DON’Ts

Wednesday and can only be changed on the Thursday morning. If the price rises to £7.50 on Thursday, then it must stay at £7.50 for at least Thursday, Friday and Saturday, and so on.

In the on-trade if a price change is undertaken, for example the price of a pint or lager is changed to £3 on Monday, it along with all other products on the drinks menu must remain fixed for Tuesday and Wednesday. The next change can only commence on Thursday morning. You can of course change more than one product price at one time. In shops and supermarkets, there are special rules about alcohol display areas and advertising. Most shops will have two areas: an area accessible to the public such as shelving in an aisle, and an inaccessible area such as a spirits display behind the counter.

Alcohol advertising can only be located in one of these defined areas, so you should not have posters, vinyls or A-boards at a shop entrance unless it is part of the approved area. Alcohol cannot be displayed for sale other than in one of these two defined areas. The area will be shown on the licence layout plan and cannot be changed without approval from the licensing board. There are special rules on mixing displays of alcohol and non-alcohol goods.

Restrictions even apply outwith the premises – drinks promotions cannot be advertised within 200 metres from the boundary of the premises although this only applies to promotions “in connection” with the premises, so would not stop, for example, an advert on a bus shelter or a passing brewery van.

Although there is nothing inherently illegal about a promotion of alcohol, the 2005 Act has created a list of types of promotions which are deemed to be irresponsible and therefore unlawful. The interpretation of these definitions can lead to local variances so that what might be considered by LSOs in one area, might not in another. Operators should always take specialist legal advice before running any promotions.

Types of banned promotions include: • Promotions likely to appeal to under 18s DRAM 2019 Page of 5 8 • Buy 1 get 1 free, and similar deals . “Upselling” of measures – for example an offer to “Make it a double” for an extra 50p - you can have a single s and doubles price list and the double price list does not have to be 2 x the singles price list. Unlimited alcohol for a fixed price Promotions which encourage people to drink more than they had perhaps intended, eg “Buy two glasses of wine and get the rest of the bottle for £5” Alcohol as a prize, unless in a sealed container for off consumption – so watch those pub quiz prizes: no round of drinks or bar vouchers please A separate rule, often confused with the rules on promotions, is the so-called “72 hour” rule which refers to the price of products.

The rules are slightly different for the on and off trade. In the offtrade the price of alcohol product cannot be varied up or down within a 72 hour window. So if a bottle of Merlot is £7 on Monday, it must remain at £7 on Tuesday on

DRUGS POLICY FOR LICENSED PREMISES IN SCOTLAND Everyone in every community has a part to play in tackling drug misuse. It is important to tackle the ‘drug problem’ and to ensure that licensed premises within SCOTLAND remain ‘drug free’.

Illegal substance must not be allowed to be supplied or consumed within licensed premises. The contents of this Drug Policy allow all staff employed in IF IN DOUBT should licensed premises to have a better CALL THE understanding of the law in relation POLICE to drugs and drug related incidents.

Complying with our legal responsibilities; 4. Working closely with local authorities and Police Scotland.

Classes of Drugs The Misuse of Drugs Act 1971, classifies drugs as follows: Class ‘A ‘ Includes Cocaine, Crack Cocaine, Heroin, Ecstasy, Cannabis Oil and LSD. Class ‘B’ Includes Cannabis, Cannabis resin and Amphetamine.

Class ‘C’ Generally tend to be prescribed drugs which are abused, the most popular include Temazepam, Diazepam and Steroids.

The Law The Misuse of Drugs Act 1971 creates a number of offences to control the misuse of illegal drugs.

Common Offences Possession It is an offence for a person to have a controlled drug in his/her possession.

Possession with Intent to Supply It is an offence for a person to have a controlled drug in his/her possession whether lawfully or not with intent to supply it to another.

Supply It is an offence for a person to supply or offer to supply a controlled drug to another person.

Concerned in the Supply It is an offence for a person to be concerned in the supply of a controlled drug to another person. Section 8 y permit or suffer any drug related activity on the premises is an offence.

Searching All licensees should introduce the use of searches as a condition of entry to their premises. Signs required to be clearly displayed regarding this and a ‘Zero Tolerance’ Policy in relation to drugs within licensed premises.

Power of Search Only the Police have power to search people without their consent.

Can a customer wishing to enter the premises be searched?

Yes, if it is clearly advertised as a condition of entry that customers are required to allow a search of their person. Searches can only take place with the permission of the person concerned.

A witness should always be present during any search to provide corroboration and prevent any allegations. If they decline to be searched, entry can be refused. Always remember your rights to refuse entry or to ask someone to leave your licensed premises. If an individual refuses, the Police should be contacted for assistance.

What can be searched?

The search should be restricted to outer clothing or pockets and should include bags etc. Great care must be taken whenever you are searching a person in relation to drugs. Never put your hand straight into someone’s pocket without first asking the person if they have any sharp objects

and patting the outside of the pocket. It may be preferable to ask the person to empty their own pockets and show you the contents. You should then ask if the pocket is empty and pat it from the outside.

This may be sufficient to establish if there is anything in the pocket. Great care must be taken so that an exposed needle for example, does not cause injury. You should also ask the individual to empty any bags and watch carefully whilst this is done. Again this may be sufficient to establish whether any drugs are present.

Obviously if the premises in which you are, are particularly busy, you do not want to take too long to carry out your search. Thoroughness should not however be sacrificed for speed.

You should attempt to put your customer at ease and make them as comfortable as possible in these circumstances.

Can a customer within the premises be searched?

Yes, however, it is not recommended. If a customer is searched prior to entry, there should be no need to do a further search. However, if it is still felt necessary to carry out a further search once on your premises, a sign should be clearly displayed setting out the Search Policy. It is of vital importance that licensees and staff are aware of the limitations on their power of search.

Searches can only take place with the permission of the person concerned to be searched.

The search should not take place in a public area of the premises. Again, corroboration during searches is essential. If the individual does not agree to a search, you have no legal powers to do it. If a subject withdraws consent during a search, you have no legal powers to continue, you must stop immediately and consider contacting the Police. Again you also have the right to ask someone to leave your licensed premises.

Can a male search a female?

No. A male should only search a male and a female should only search a female to prevent allegations of indecency/sexual assault. A witness should always be present to provide corroboration and help to prevent any allegations. The witness can be either male or female. If possible, carry out the search within the range of CCTV cameras if you have them.

Can force be used to search a customer?

No. The customer must always grant permission to be searched. There are no circumstances in which force may be used to carry out the search.

Power of Detention You have no power to detain a person for offences under the Misuse of Drugs Act 1971.

The person(s) must agree to remain with you and must be handed over to the Police as soon as possible. If a person commits a Common Law offence such as an assault on a customer or member of staff, or is committing a Breach of the Peace on the premises, then he/she can be detained but only for the Common Law offence.

Again the Police should be notified as soon as possible.

Drugs Seized or Found on the Premises If you find anything that appears to be an illegal drug, put it in a plastic bag or envelope and seal it: This must be signed by the finder and witnessed by another member of staff; Enter the details of the drugs found in the appropriate drugs register; If any member of staff or management finds drugs on the premises, they must immediately inform the most Senior Manager on duty.

Drugs Information Do not automatically think that because you know, the Police will know too. The Police can only act if they have information/intelligence to act upon. YOUR information may be the key to success. If you have any information about drug activities you should notify the Police immediately.

What to do if drugs are found whilst searching a customer?

Crabbie’s Yardhead takes its name from a distillery that operated in Leith in the 19th century, and whose warehouses had been used by John Crabbie & Co.

Glenfiddich Glenfiddich is owned by William Grant & Sons and is the world’s biggest-selling single malt brand will be exhibiting at the Fife Whisky Festival taking place at the Corn Exchange,Cupar on 7th March 2020. Last year it launched its new Grand Cru release is a 23-year-old single malt. It’s third annual Glenfiddich Festival Experiment #3 at its Dufftown distillery in Speyside was UK’s largest festival for the on-trade community, with more than 1,200 people attending.
