Dore & Rees do our best to ensure vehicles presented for auction are fairly and accurately described. Classic cars are by their definition collector's items and not intended to be sold in the same way as a modern car from a retail dealership. As such we would advise buyers to satisfy themselves as to a Lot's condition before bidding.

COLIN CRABBE - THE THRILL OF THE CHASE According to the publisher: “Dalton Watson’s latest autobiography is the life and times of that larger-than-life character, Colin Crabbe, who found himself at the forefront of motor racing, firstly as a privateer racing Ford GT40s in 1966 then driving in the 1967 World Championship. He cut his teeth during 1969 as an owner and team manager in Formula One having found he was too large to fit an F1. Colin reckoned he had to be one of the last great gentleman amateurs at the cutting edge of motor sport. In 1968 he located in East Germany one of the pre-war Silver Arrows, a Mercedes W125 Grand Prix car. Colin raced the Mercedes and numerous other historic racing cars until a bad crash put an end to this in 1988. When not motor racing, he travelled around the globe looking for forgotten treasures in the motoring world. A BRONZE SCULPTURE BY RENZO JARNO VANDI REPRESENTING 1964 F1 WORLD CHAMPION JOHN SURTEES AT THE WHEEL OF HIS FERRARI 158 In his book Piloti che Gente, Enzo Ferrari describes John Surtees as a serious driver, conscientiously preparing himself for racing, paying attention to the smallest particular, always looking for a detail that could give him an edge; as a real fighter also. The British driver won the 1964 F1 Drivers World Championship at the wheel of a Ferrari 158, fitted with an 8cylinder engine of 1.5 litre capacity. The man and his machine were sculpted in a striking way

by Renzo Jarno Vandi. It took the young Italian sculptor over two years and 2,000 work hours to achieve this unique piece, measuring about 75 cm long (scale 1/5) and weighing over 20 kg. £4000-£5000

MASERATI 4CL BRONZE BY MARDINI One can almost feel their heart beating in their chest as if they were the central figure of this bronze sculpture. A well-executed example, signed by “E. Mardini” along the rim, this piece captures the essence of an early single seater racing car driving on a banked oval. It conjures up the illusion of speed as the driver fights for control of his racer as he takes the turn. This racing car is styled after the famous “Bird Cage” Maserati (with a little artistic license). The sculpture measures 11” x 6-1/2 £300-£500

A CUSTOM FINISHED 1:18 SCALE FERRARI 330GT 2+2 BY BBR MODELS This model comes from the private collection of the Late Mr. Peter Marshall who owned a genuine 330GT which we sold in 2022. An example of the earlier Series 1 twin-light model, in 1/18 scale by BBR of Italy, with custom finish.

Mr. Marshall recalled the reasons he bought the car, “At the time I had recently fitted a new clutch on my everyday Fiat 850 Spider, which was a brilliant car, and which I had converted to r.h.d., commencing the first week that I had bought the car, as Fiat did not produce them. I needed to do an oil change. An oil change would be simple enough but there was bound to be something in the future.

I needed another car!”

“That is not really the usual reason for buying a Ferrari but ….. I had been toying with the least expensive V12 for a while. I went to view a 250, but it did not appeal, and then the 330, which did.” “…. it got me home, knowing before purchase that it needed clutch adjustment….” But the clutch adjustment did solve the problem?

“Mmmm, that did not help, so I took the gearbox out. 10 times easier than on the Fiat, to the extent that I did it in the road (albeit, private) outside the house. It had only done 1,000 miles since it was last changed! This time the flywheel needed changing too, it was blue with radial cracks and despite having it skimmed, the cracks were too deep to use again. It is amazing what must have been done posing up and down the Kings Road in London.”

This model is modified from 1/18th scale BBR model of John Lennon’s famous car, #BBR1834.

The model was adapted by stripping it down the model to its constituent parts, the transmission tunnel was modified to remove the later centre console then made a new radio mounting to fit under the dash as per the subject car. Humbrol enamel paints gave the red and black interior life.

It is crafted using the same technique and materials utilized at the Ferrari Factory, and is comprised of over 400 pieces including 26 hand formed sand cast aluminium parts with 7 core boxes, 31 turned stainless steel parts and 5 turned aluminum parts. The model is assembled by hand with 167 screws, without using any adhesives or plastic.

This faithful recreation of the original V12 makes a beautiful display in garage, office or den.

This large museum quality model is around 2 feet long – it measures 23″ / 58cm in length, 8″ wide and 12″ tall and weighs 18 lbs / 8kgs. It is complete with original certificate signed by the late Terzo Dalia, and dated ‘2003’.

THE FLYING SCOTSMAN MODEL ASTER GAUGE 1 STEAM TRAIN LSL01 Limited Edition #27 of a total of 88 built Factory Built Live Steam BR ex-LNER Gresley A3 Pacific No. 60103 ‘Flying Scotsman’. With double chimney and German type smoke deflectors. In BR lined green with late crest and shed plate 34A Kings Cross.

The prototype went into service from Doncaster Works as Great Northern Railway A1 No. 1472 in February 1923, becoming LNER No. 4472 in 1924. After WWII it then became LNER No. 103 in the 1946 renumbering scheme, shortly after rebuilt to become an A3, thence becoming BR No. 60103.

A factory built model by Aster, never steamed.

The scale is 1:32 (45mm) and overall length is 68cm over buffers. Used for display purposes only, with original Aster box, manuals. £2000-£2500

The car was converted to road use for the Sultan of Brunei.

1969 Lotus Elan S4 SE Fixed Head Coupe

● Desirable ‘Special Equipment’ version ● Originally maintained by Rob Walker at Corsley Garage ● In current private ownership for over 40 years

The new Elan, introduced at the 1962 Earls Court Motor Show was the creation of Lotus design and development engineer Ron Hickman. Using the ‘Chapman Bracket’, i.e. a steel backbone chassis with lightweight fibreglass bodywork, the latest model boasted fully independent suspension, four-wheel disc brakes, pop-up headlights and integral bumpers. With a lively ‘twin-cam’ mated to a four-speed (later fivespeed) manual transmission, the Elan changed the rules in terms of ride, handling and performance. The S4 gained a thinner and lighter body with flared arches allowing for wider wheels. A smaller percent of the 3000 or so Elan S4s were to ‘Special Equipment’ specification, featuring servo assisted brakes, an SE engine developing 118 bhp instead of 105 bhp, safety belts, a leather covered steering wheel, knockon wheels with chrome embellishers, carpeted boot interior and Special Equipment badges. The model’s weight advantage, powerful engine, and remarkable agility make the Elan as satisfying to own and enjoy now as it was in the 1960s.

First registered in March of 1969, we are pleased to see the history file for this S4 Fixed Head Coupe contains its original Lotus Service Voucher Book, stamped at 528 miles by F.Thomas & Co., and at 2,824 and 5,417 miles in 1970 Rob Walker at Corsley Garage. The Elan then moved to London, being serviced twice by Len Street Engineering in Chelsea until just over 10,000 miles.

1970 Fiat 124 Spider

Introduced at the November 1966 Turin Salon, the Fiat 124 Sport Spider boasted a handsome two-door monocoque body both styled and produced by Pininfarina, with Fiat taking on final assembly of the finished car. Mechanically very similar to its saloon car sibling, the Spider featured all-round coil-sprung suspension (independent double-wishbone front / Panhard rod-located ‘live’ axle rear), four-wheel disc brakes and worm-and-roller steering. Designed by ex-Ferrari engineer Aurelio Lampredi, its fourcylinder engine boasted an aluminium DOHC crossflow cylinder head. Progressively enlarged up to 2.0 litres by 1979, the free-revving unit was allied to four-speed (later five-speed) manual transmission. Incorporating such thoughtful features as intermittent wipers and a hood that could be raised in under twenty seconds, the Sport Spider proved a great sales success. A staple part of Fiat’s model range until 1982, just under 200,000 are thought to have been made (with 80% finding their way to the US).

You can thank the actor Peter Sellers for the trend for luxuriously-specified Minis. Sellers approached dealership H.R. Owen to convert his new Mini Cooper into something a little more opulent and exclusive. H.R. Owen commissioned Hooper, happily delivering the car in early 1963, alongside a rather juicy bill for £2600 (vs. £679 for a standard Cooper at the time). As word of Sellers’ car spread, demand built up, with other coachbuilders entering the fray. In April 1963 competitor Harold Radford announced a range of three off-the-shelf conversions, the “Mini de Ville”, the “de Luxe” and the “Bel Air”. The packages could be applied to any Mini saloon of the customer’s choice.

First registered in September of 1991, this unique Radford was built for the then owner of Radford (and former Le Mans driver), Mr.Costas Los, who ordered one in RHD and one in LHD for use at his Monaco residence. The only known Left Hand Drive Long Mini de Ville, the car was factory built during 1991, with the body at the same time being stretched by approximately 5.5” in the doors and roof areas.

The specification was extensive; a fully deseamed and lengthened body, wider wheel arches, an automatic gearbox, electric glass tilt and slide sunroof, and a luxurious custom interior with a Momo steering wheel. The car was fitted with air conditioning, electric windows, a full magnolia leather (including headlining)

The DB9 was the star of the 2003 Frankfurt Motor show, where it was unveiled to the public for the very first time. The DB9 was powered by a third generation version of the now familiar 6.0 litre V12, with a top speed of 186mph. It was the first of what was to become a long line of production Aston Martins to use VH architecture; Superformed parts were applied in the chassis and footwell as well as the body panels. A lightweight and nimble handling rear-engined, rear-wheel-drive, two-door sports car, Porsche’s 356 evolved from a streamlined little aluminumbodied coupe powered by a VW-derived, 46bhp, 1,100-cc air-cooled flat-four, to the mighty fourcam Carrera models of the early 1960s.

The 356 B from 1960 through 1963 represents the mid-point in the car’s design. The headlamps were raised, a larger bonnet handle added, and front vent windows appeared in the doors.

The Rod Emory-styled and race-inspired 1950s “Outlaw” aesthetic has its roots in Southern California, the premise being to lower the silhouette of the car while preserving essential elements of the factory design.

The 356 was lowered, the bumpers and wheel rims carefully removed and stored, burgundy racing decals applied, and a number of minor mechanical items attended to. Replacement Zenith 32NIX carburettors were fitted, as was electronic ignition with coil, a replacement clutch and flywheel, wheel bearings and attention to the braking system. The lovely interior now benefits from new carpeting, a Moto-Lita steering wheel and replacement headlining in black, which in our opinion suits the car well. Usefully the above cosmetic changes are very easily reversible if desired; the bumper and wheel trims will come with the car, and the decals can be simply removed. 1981 Ferrari 308 GTSi

Introduced at the Paris Auto Salon in 1975, the contemporary styled 308 GTB – Ferrari’s second V8 road car, marked a return to Pininfarina styling following the Bertone-designed 308 GT4.

Badged as a ‘proper’ Ferrari rather than a Dino, the 308 GTB had changed little mechanically apart from a reduction in both wheelbase and weight, retaining its predecessor’s underpinnings and transversely mounted engine that now featured dry-sump lubrication. Further developments included the introduction of an open-top GTS version with Targa-style removable roof and the adoption of Bosch KJetronic fuel injection. 1998 Ferrari 456M GTA

Produced from 1992 until 2003, the Ferrari 456 and later 456 M are front-engined “Grand Tourers’ in true Ferrari tradition, and a worthy replacement for the outdated front-engined 412 which had been the company’s premium fourseat V12 car for many years. The Pininfarinadesigned 456 was available in GT and (from 1996) GTA forms, the name 456 being derived from its 456 cubic centimetres per cylinder, the last Ferrari to use this naming convention. The “A” in GTA signifies the transmission; a fourspeed automatic gearbox, only the fourth automatic transmission ever offered by Ferrari.

The 5.5 Litre V12 engine was derived from the Dino V6, producing 436 bhp and topping out at an impressive 188 mph, making it the world’s fastest production four-seater at the time.

Acceleration to 60 mph was just 5.2 seconds, with a 13.4 second quarter-mile time. This was, aside from the F40, the most powerful road car ever developed by Ferrari.

The 456 was most recently serviced in January 2024 at 40,035 miles (by Bob Houghton), at a cost of c. £4,000 to address any additional advisory items. In September 2024 the Ferrari gained four new P-Zero tyres, and the air conditioning system was serviced. The vendor advises the interior switchgear is starting to become sticky once more and will need to be treated (a very common issue with Italian cars of this era). Otherwise the interior presents very nicely (we understand the dash has been previously re-trimmed at significant expense), the ceramic-coated coachwork is excellent, and

A full engine rebuild, using a new ‘short block engine’ was also carried out to selected models (including this car) This particular 986 3.2 Manual S was originally manufactured in 2001, in silver. 1962 Porsche 356 B Super 90 RHD Reutter Cabriolet

Porsche’s 356 Cabriolets were truly luxurious touring machines, as they offered a strong unitised chassis with a fixed windscreen, a plush interior with comfortable and heavily padded seats, and a thick, multi-layer fabric folding top, which helped to isolate the fortunate driver and passenger from road noise and vibration. The back jump seats also had folding backs that better lent themselves to additional luggagecarrying duties.

The 356 B was introduced in 1960 with the T5 body design, which included coupé, roadster, and cabriolet variants. In turn, the B further evolved into the T6 in 1960, offering a revised nose with a larger, squared-off front boot lid, the gas filler lid being relocated to the top of the right-front wing, and the addition of a second

grille panel to the engine lid. Several engine options were offered: the Normal in 6horsepower form, the 75-horsepower Super, the Super 90, and, of course, the rarely seen Carrera, all with 1,600-cubic centimetre capacity.

The Super 90’s Type 616/7 engine was a very strong unit, as it offered 90 brake horsepower at 5,500 rpm with the aid of 9.0:1 compression and a pair of 40-millimetre Solex carburettors. A reviewer of the day wrote that “Super 90s could be revved about 800 rpm higher than other 356

COLLECTOR’S CARS, AUTOMOBILIA AND WATCHES, WEDNESDAY, 4 DECEMBER 2024 B 1600s thanks to a special cooling layout that gathered in more air, plus a nitrided crank and cam-bearing surfaces, a lighter flywheel, stiffer valve springs, light-alloy rockers, largerdiameter (by five millimetres) main bearings, and cylinders lined with Ferral, a coating of steel over molybdenum. S90s also had a unique oil pickup system that allowed the engine to draw lubricant from the sump’s full side in hard cornering, thus ensuring proper lubrication at all times. It was an important advance that Porsche racers had wanted for several years and was especially welcome in the high-performance 90”.

This very attractive UK-delivered Right Hand Drive 356 Super 90 Cabriolet was completed in November 1962, to be despatched to its first UK owner in early 1963 via Porsche importers AFN of Isleworth, West London. A late B-model, this 356 Super 90 was specified with the T6 body by Reutter with twin grilles to the engine cover. The 356 was originally specified in Ivory with Red trim, and supplied with the additional options of an Armrest, Persenning (hood cover), Stone Guard for Headlights, Electric Headlamp, Kokomats in Grey and Expander.

Interestingly the first owner was Vincent motorcycle draughtsman Hans ‘Johnny’ Edwards. Hans was one of the first to own, and race, a Vincent in Canada back in 1947, arriving in the UK a few years later seeking work. Hans found himself at the door of the Vincent/HRD factory in Stevenage, where he settled.

According to the car’s accompanying Porsche Fahrzuegkartei, the 356 continued to be maintained by AFN up to c.20,000 miles in

August 1964. The car’s history picks up again in 1982, at which point the 356 was acquired by Polish film director Androres Anthony (Andrzej) Karpinski. Karpinsky started his career as a technician under the direction of such luminaries as Ridley Scott and Hugh Hudson, later to become a cinematographer in film and commercial television work. We are given to understand from the present owner that he was informed by Mr. Karpinski that he purchased the car from Ridley Scott in 1982.

Nicely finished in metallic silver with original red leather interior, we understand the 356 starts and runs extremely well, with ample power from the 1600c Super 90 engine, and crisp handling.

Front disc brakes haul the 356 up neatly. The car’s history file contains its Porsche Driver’s Manual, a copy of the factory original data card and Porsche Certificate of Authenticity, and MoT certificates dating back to 1982. 1960 Austin Healey 3000 Fast Road by John Chatham Cars

The enlargement of its C-Series six-cylinder engine to 2,912cc, and the adoption of Girling front disc brakes, differentiated the new-for1959 Austin-Healey 3000 from the preceding 100/6. In 3000 form the rugged Austin six delivered 124bhp at 4,600rpm, good enough for a top speed (in overdrive) of 114mph. Otherwise, the car remained much as the 100/6, though the more-powerful disc brakes were a welcome improvement. The original 3000 was built from March 1959 to March 1961 as models BN7 Mark I (2-seater) and BT7 Mark I (2+2 version), becoming known as the Mark I after the Mark II was released.

Replicas of the works rally cars are among the most sought-after variants, and an extensive cottage industry of recognised specialists exists to cater for the demand for Austin-Healey parts, servicing and competition preparation.

A UK home market matching engine number car, first registered in March 1960, this early 3000 Mark I has enjoyed a hugely comprehensive rebuild in recent years, to fast-road specification by leading specialist John Chatham Cars of Bristol.

During the restoration the car’s outer panels were removed, and (with the exception of the boot) reskinned in light aluminium. 2001 Jaguar XKR Silverstone Edition

In the run up to the 2000 British Grand Prix at Silverstone, Jaguar announced the launch of their new Limited Edition XKR, the aptly named XKR Silverstone. Based on the already superb specification of the XKR, the new Jaguar was enhanced both in performance and design. The cars were all finished in a Platinum Silver paint finish (with convertibles having a complementing black hood) and carried the new unique Silverstone badging. The Bentley Continental GT was the first car released by Volkswagen AG after their acquisition of the company in 1998 and was unveiled at the 2003 Geneva Motor Show, followed by Le Mans, Goodwood Festival of Speed and the annual Bentley Drivers Club meeting at Silverstone. An instant success, ushering in a new era for the famed luxury Marque.

Introduced in 1985 as a replacement for the aging Mulsanne Range, the Turbo R (the R standing for ‘Roadholding’) was described by the Motoring Press as ‘The first Bentley for decades worthy of carrying the name. The successor to the successful Series I was the Series II, which saw a production run from 1958 to 1961. It came in 88 in (2,200 mm) and 109 in (2,800 mm) wheelbases. This was the first Land Rover to receive the attention of Rover’s styling department- Chief Stylist David Bache produced the familiar ‘barrel side’ waistline to cover the vehicle’s wider track and the improved design of the truck cab variant, introducing the curved side windows and rounded roof still used on current Land Rovers. The Series IIa revised version of the Land Rover made its debut in 1961 and is regarded by many Land Rover aficionados as the version that Rover got right. It is generally thought of as the most durable and easily repairable of the “Series” Land Rovers.

This fabulous example of automotive history has benefitted from a very comprehensive restoration in recent years. Acquired by the previous owner in 1997 as a retirement project, due to his passing the project was picked up by a local enthusiast and fastidious classic car restorer. Over the years the Land-Rover has been dismantled and rebuilt from a brand new galvanised chassis. From the structure and coachwork, its mechanical and electrical components, to a myriad of trim and other finishing items, the amount of detail which this restoration has involved is exhaustive.

1969 Lotus Elan S4 SE Drophead Coupe

The ‘Darling’ of the High Street in the mid-sixties, Chapman’s technologically advanced Elan of 1962 featured a compelling package of revvy twin-cam motor, all-wheel disc brakes, rack and pinion steering and all-round independent suspension. Better in every regard than the Type 14 Elite that it replaced, the glassfibre-bodied sports car with separate backbone chassis is rightly regarded as the best of its breed of any generation.

A big part of that was the engine, a compact, potent and characterful mill that endowed the Elan with the performance to match its nimble chassis (the Elan was the first Lotus with a separate body/backbone chassis). Initial production used the Ford 1500cc motor, soon replaced by the 711 block based Twin Cam engine. Colin Chapman’s relentless pursuit of lightness resulted in a car weighing less than 700 kilos, achieving 60 mph in 7.5 seconds, and

Placing a V8 engine in the front of the traditional Morgan roadster was a wonderfully barmy idea in the 1960s. The Plus 8 was Britain’s fastestaccelerating production car for a time and proved so endearing that it remained on sale, in relatively little-altered form, until midway through the 2000s.

1949 MG TC “Midget”

● In current family ownership since 1966 ● Subject to ongoing restoration in current ownership ● For completion and recommissioning

The first of MG’s T-Series (the 1936 TA) built on the success established by the J2 model, later developing into the post-war TC model of 1945.

The TC Midget was the first post-war MG, although it was quite similar to the pre-war TB, sharing the same pushrod-OHV “XPAG” 1,250cc engine. However, the TC had a slightly higher compression ratio of 7.4:1 giving 54.5bhp (40.6 kW) at 5,200rpm, with several alternative stages of tuning for ‘specific purposes’. The TC featured a widened body and improved suspension with hydraulic dampers.

The TC was arguably the car which started the American/Anglo love affair of the British sportscar. The TC was exported to the United States in large numbers, despite only ever being built in right-hand drive specification. Between September 1945 (chassis number TC0251) and November 1949 (chassis number TC10252),

exactly 10,000 were produced. The TC cost £527 on the home market in 1947, and was replaced by the TD in 1950.

A UK-delivered example, this restored MG TC was first registered in the summer of 1949, by the 1950s residing in Derbyshire and by the mid1960s with the current family owners in Northamptonshire, In around 1968 the MG was stripped and comprehensively restored as time allowed over many years. Now largely finished, the MG only completed a handful of test miles before the sad passing of its owner. Having been more recently dry-stored, the MG will benefit no doubt from mechanical recommissioning and the fitting of weather gear before being used once more.

Very nicely finished in Woodland Green with a tan leather interior, and showing just 15 miles

recorded (presumably since restoration), this super TC is offered with a history file, buff logbook and V5C, and a number of spares. A charming example which we are sure will be a real pleasure for the next owner to recommission over the winter and enjoy in 2025. £7000-£11000

1951 Riley RM Drophead (RMD) ● Original historied factory car ● Matching numbers engine

Riley became part of the Morris-MG-Wolseley Nuffield Organization in 1938. The RM was announced in 1945 and would continue to preserve the Riley character with its technicallyadvanced chassis and with coach-built body choices of sporting designs. Riley’s successful pre-war engine design was carried over and featured hemispherical combustion chambers and twin camshafts operating valves through short pushrods. The four cylinder engines had a cubic centimeter displacement of 2443cc and were fitted with twin SU carburetors. The result was an impressive 100 horsepower and a factory advertised top speed of 100 miles per

hour. The engine was coupled to a four-speed manual gearbox and the chassis was fitted with an independent torsion bar front suspension and live rear axle with semi-elliptic springs. The Riley RM-series cars, often called ‘the last of the real Rileys’, were among the first redesigned British cars to be introduced after World War II, the swansong of the marque before it was subsumed into the mighty British Motor

Corporation. The model range was manufactured in Coventry until 1949, when production moved to the MG factory at Abingdon. The RMA/RME were large Saloons powered by 1.5-litre four-cylinder engines, while the 7-inches longer RMB/RMF models featured twin-cam 2.5-litre units. The RMC and RMD were limited edition soft-tops. While the latter was a conventional two-door Drophead Coupe, the RMC was a two-door Roadster version of the RMB.

This genuine 2.5 litre Riley RMD, one of only 502 produced, was first delivered in May 1951. A well known car, the RMD has had just six owners in all (with just just three until 1978), including long term ownership in Riley circles. This RMD has been fitted with a completely new convertible roof in the last 10 years, at a cost of c.£2,000.

The car’s interior has been refurbished, with original leather seats and finishing of the wood cappings. The wiring system has been overhauled and replaced/upgraded as required, such as with the fitting of indicators.

The interior is fitted with all original instruments, which are all working (with the exception of the chronometer), the original battery box is fitted (with a new battery), the car has a stainless exhaust system and good tread to the tyres all round (including the spare). The chromework is we understand in excellent order. Faults we are aware of are missing interior lamp covers, and

the near side front wing has been filled in the usual place above strut mounting. Mechanically we the car is in good order and drives very nicely.

An original and well preserved example, the RMD shows now just over 100,000 miles recorded, and is complete with an extensive history file with many invoices over the last 25 years, older tax discs, a complete run of MoT certificates back to 1979, older green logbook, and original instruction books. Finished in two-tone black/ivory with tan leather trim, and offered with a valid MoT certificate until March 2025 (with no advisories), this is a very genuine example of a desirable post-war touring Riley. £18000-£22000

Conditions of Sale BUYERS

This document acts to confirm the terms and conditions under which Dore & Rees, acting as agent, will sell Lots by auction to Buyers on behalf of Sellers.

11. Our Status a. We act as agent to sell the Lots on the Seller’s behalf by auction. b. You will pay the Hammer Price, with Buyer’s Premium at 25% together with VAT at the prevailing rate and any applicable charges within 5 working days following the Auction in which the Lots are purchased by you. Buyer’s Premium at 10% together with VAT at the prevailing rate and any applicable charges applies to Lots sold in auctions of Vehicles, Classic Cars, Motorbikes. c. We will always treat your data with care, personal details are held securely and will not be sold. Our Privacy statement is available at www.doreandrees.com

12. The Estimate a. The estimate is a guide to help you gauge how much you might have to spend to purchase the Lot. b. Estimates can change, they are not definitive and should not be thought of as the sale price. c. Estimates do not include the Buyer’s Premium or VAT at the prevailing rate and any applicable charges. d. Estimates may be altered by a saleroom notice or announcement by the auctioneer before the Lot is offered.

13. Buyer’s obligations and undertakings a. You warrant to us and to the Seller that: i. you will not bid on a Lot you do not intend to pay for ii. you have the funds to complete the purchase at the total value of Hammer Price, Buyer’s Premium together with VAT at the prevailing rate and any applicable charges; iii. the funds are not connected with any criminal activity including tax evasion, and that you are neither under investigation nor have you been charged with or convicted of money laundering, terrorist activities or other crimes iv. if the Lot you purchased is to be removed to a country outside the UK, all duties, taxes and licences on the export of the Lot are your responsibility. b. If you, the Buyer, decide to exercise your right to cancel, we are entitled to account directly to the Seller for any applicable refund and we shall retain on account amounts to compensate the Seller should the Lot be damaged or tampered with by you. c. You will indemnify us and the Seller in full on demand against all claims, costs or expenses incurred by us or the Seller as a result of any breach by you of any of the obligations in this clause.

14. Inspection of Lots a. As we act on behalf of the Seller, we are dependent on information provided by the Seller about their Lots. We may inspect Lots and will act reasonably in taking a general view about them. However we are normally unable to carry out detailed examinations of Lots to check their condition in the way a Buyer would do.

b. We strongly recommend that you attend the auction viewing in person if possible. You are responsible for your decision to bid for particular Lot. If you bid on a Lot, including by telephone, absentee bid or online bidding, we will assume that you have carefully inspected the Lot and satisfied yourself regarding it’s condition. c. Please note that the Lots (in particular second hand Lots) are unlikely to be in perfect condition.

Lots are sold ‘as is’ (i.e. as you see them at the time of the auction). Neither we nor the Seller accept any liability for the condition of secondhand Lots or for any condition issues affecting a Lot if such issues are included in the description of a Lot in the auction catalogue (or in any saleroom notice) and/or which the inspection of a Lot by the Buyer ought to have revealed.

15. Descriptions and condition a. Our descriptions of the Lot will be based on i i. Information provided to us by the Seller of the Lot (for which we are not liable); and i ii. Our opinion (although it is likely that we will not be able to carry out a detailed inspection of each Lot). b. We will give you a number opportunities to view and inspect the Lots before the auction. You (and any independent consultants acting on your behalf) must satisfy yourself about the accuracy of any description of a Lot. We shall not be responsible for any failure by you or your consultants to properly inspect a Lot. c. Representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion will be honestly and reasonably held and accept liability for opinions given negligently or fraudulently.

16. Registration, Bidding and the Buyer a. You are required to register to bid by 5pm on the day before the auction. We reserve the right to impose a deadline prior to the auction by which you must register or by which we must receive a absentee bid. b. If you wish to bid on high value Lots, the registration deadline may be several days before the auction in order to allow us sufficient time to carry out the necessary checks. c. We reserve the right to require deposits at the point of Registration on high value Lots.

Deposits are refundable after the auction if you are not a successful Bidder. d. Lots will be invoiced to the name and address on the Registration Form. e. Absentee bids may be left with us in writing indicating the maximum amount to be bid against a Lot (excluding Buyer’s Premium and/or VAT and any applicable charges). We will execute absentee bids as cheaply as possible having regard to the Reserve (if any) and competing bids. If two Bidders submit identical absentee bids we may prefer the first bid received (where this can reasonably be ascertained). Neither we nor our employees or agents will be responsible for any failure to execute your absentee bid, unless our failure to do so is unreasonable. f. Telephone bidding is offered on a first come first serve basis on high value lots. Neither we nor our employees or agents will be responsible for

any failure to execute your telephone bid, unless our failure to do so is unreasonable. g. Bidding online is available via doreandrees.com and our auction partners EasyLiveAuction.com.

We reserve the right to refuse to register you if you do not provide us with all the information and documentation that we ask for at our discretion. i. We may bid on Lots on behalf of the Seller up to one bid below the Reserve. j. We may refuse to accept any bid if it is reasonable for us to do so. k. Bidding increments will be at our sole discretion (and in line with standard auction practice). l. The Bidder placing the highest bid for a Lot accepted by the Auctioneer will be the Buyer at the Hammer Price. Any dispute about a bid will be settled at our discretion. We may reoffer the Lot during the auction or may settle the dispute in another way. We will act reasonably when deciding how to settle the dispute.

17. Anti-Money Laundering Regulation a. We are obliged to comply with Anti-Money Laundering regulations which apply to individuals and businesses who deal in the sales, purchases and storage of works of art with a value of €10,000 (or equivalent) or more. b. Buyers may be requested to provide photographic ID and proof of address documentation in advance of the Auction in which they are bidding in order to meet the requirements of the regulations.

18. The Purchase price a. As Buyer, you will pay: i. The Hammer Price; ii. Buyer’s Premium of 10% of the Hammer Price (12.5% on motor cycles) iii. Any artists resale right royalty payable on the sale of the Lot iv. Any VAT due11 19. VAT a. You are responsible for the payment of any VAT applicable on the Hammer Price and Buyer’s Premium due for a Lot. b. We will charge VAT at the current rate at the date of the auction.

10. Artist’s Resale Right a. From mid February 2006, living artists are entitled by law to receive a resale royalty each time their work is resold by or to and art market professional. From January 2012, the Right has been extended to include sales of works by artists who have died within the last 70 years (following the existing term of copyright).

Royalties will be payable to the families and the beneficiaries of these artists. b. An artwork must be resold for more than 1000 euros Hammer Price (or equivalent) to qualify for the right. The rates applicable are calculated as a percentage of the Hammer Price and are set out on a sliding scale from 4% to 0.25%. The charge is exclusive of VAT. We reserve the right to pass all the cost to the Buyer of the qualifying artwork.

11. The contract between you and the Seller a. The contract for the purchase of the Lot between you and the Seller will be formed when the hammer falls accepting the highest bid for the Lot at the auction. b. You may directly enforce any terms in the Terms and Conditions of Sale - SELLER against a Seller to the extent that you suffer damages and/or loss as a result of the Seller’s breach of the Terms and Conditions - SELLER. c. If you breach these Terms and Conditions – BUYER, you may be responsible for damages and/or losses suffered by a Seller or us. If we are contacted by a Seller who wishes to bring a claim against you, we may in our discretion provide the Seller with information or assistance in relation to that claim. d. We normally act as an agent only and will not have any responsibility for default by you or the Seller (unless we are the Seller of the Lot) e. In addition to any other rights we may have to cancel a contract for sale under these Terms and Conditions – BUYER, in the event: i. You are in breach of your warranties in clause 3; or ii. We have not completed our enquiries pursuant to the Money Laundering Regulations and related legislation to our satisfaction; or iii. We have reason to believe that the transaction might be unlawful for any reason, or that the sale might put us under any civil or criminal liability, we may delay the completion of the sale, delay a release of a Lot or cancel the sale of a Lot. 12. Payment a. Immediately following your successful bid on a Lot you will: i. Pay to us the Total Amount Due by one of the following methods: 1. BACS 2. Debit Card 3. Cash – up to a limit of £8000 in person

13. Title and Collection of Lots a. While you are bound by the contract for the purchase of the Lot from the fall of hammer on your successful bid, ownership in the Lot will not pass to you until you have paid us in full the Total Amount Due in cleared funds for that Lot; b. You may not claim or collect your Lot until you have paid for it and ownership has passed to you. c. You will (at your own expense) collect any Lots that you have purchased and paid for either: i. Not later than 5 working days following the day of the auction II. Not later than 5 working days following the date that we have received payment of the Total Amount Due in cleared funds, if later.

14. Storage of Lots a. If you do not collect the Lot within the time period set out in above, you will be responsible for any reasonable removal, storage and insurance charges in relation to the Lot. b. The risk of loss or damage to the Lot will pass to you when you (or your agents) take physical possession of the Lot.

If you do not collect the lot that you have paid for within 90 days after the auction we may sell the Lot. We will pay the proceeds of any such sale to you, we will deduct any storage charges or other sums that we have incurred in the storage and sale of the Lot. We reserve the right to charge you a selling commission at our standard rates on any such resale of the Lot.

15. Remedies for non-payment or failure to collect purchases a. Please do not bid on a lot if you do not intend to buy it. If your bid is successful, these Terms and Conditions of Sale - BUYER will apply to you.

This means that you will have to carry out your obligations set out in these Terms and Conditions of Sale - BUYER. If you do not comply with these Terms and Conditions of Sale BUYER, we may (acting on behalf of the Seller and ourselves) pursue one or more of the following measures: i. Take action against you for damages for breach of contract ii. Reverse the sale of the Lot to you and/or any other Lots sold by us to you; iii. esell the Lot by auction or private treaty (in which case you will have to pay any difference between the price you should have paid for the Lot and the price we sell it for as well as the charges outlined in Clause 8. Please note that if we sell the Lot for a higher amount than your winning bid, the extra money will belong to the Seller; iv. Remove, store and insure the Lot at your expense; v. f you do not pay within 5 days of your successful bid, we may charge interest at a rate not exceeding 1.5% per month on the Total Amount Due; vi. Keep that Lot or any other Lot sold to you until you pay the Total Amount Due vii. Reject or ignore bids from you or your agent at future auctions or impost conditions before we accept bids from you; and / or viii. If we sell any Lots for you, use the money made on these Lots to repay any amount you owe us. b. We will act reasonably when exercising our rights under clause 7. We will contact you before exercising these rights and try to work with you to correct any non-compliance by you with these Terms and Conditions.

16. Forgeries a. A sale shall be cancelled and the Buyer shall be entitled to a refund of both the Hammer Price and the Buyer’s Premium if a Lot bought by the Buyer through our Auction is shown to our satisfaction and within 14 days of the Auction to be a forgery.

17. Data Protection a. We will hold and process any personal data in relation to you in accordance with our current privacy policy, a copy of which is available on our website.

18. Liability a. Save as set out in these Terms and Conditions, we exclude to the fullest extent permitted by law all warranties and conditions, whether express or implied by statue, common law or otherwise. b. Nothing in these Terms shall operate to exclude or limit the liability of a party in respect of death or personal injury resulting from that party’s own negligence, for fraud or for any liability that cannot be excluded or limited under applicable law. c. No party to these Terms shall be liable to any other contract, tort (including negligence) or otherwise for any indirect or consequential losses, or for any loss of profits, loss of good will, loss of revenue, loss of business or loss of anticipated savings. d. Subject to Clauses 10.b and 10.c, our liability to you shall not exceed £5,000, unless your claim relates to an item sold through an Auction in which case our liability to you shall not exceed the greater of £15,000 or the Hammer Price for the relevant Lot. e. We will not be responsible or liable for errors and omissions to execute bids, caused by a loss of internet connection, a breakdown or interruption of the on-line bidding system, or a breakdown or failure of any internet connection, computer or IT system.

19. General a. No party shall have any liability in respect of any delay in performance or non-performance of its obligations under these Terms (other than an obligation to pay) owing to Force Majeure. If a party is affected by Force Majeure it shall notify the other parties as soon as reasonably possible, in any event within 5 days, and shall take reasonable steps to mitigate the effect of the Force Majeure. Subject to Clause 4.b, risk in the Lot remains with you at all times until risk passes to the Buyer. You will indemnify us and our employees and agents, and the Buyer (where applicable) against all losses, damages, claims, costs and expenses suffered or incurred as a result of any claim in respect of the Lot or proceeds of the sale of the Lot. b. Every person on our premises shall be deemed to be there at their own risk and, subject to clause 9.b, shall have no claim against us in respect of accident or loss, however caused. c. hese Terms are governed by in interpreted in accordance with the laws of England and Wales or the laws of Scotland or Northern Ireland if you live there). If you choose to bring proceedings in conjunction with these Terms you must do so in the courts of England and Wales, unless you live in Scotland, in which case you can choose to bring proceedings there, or in Northern Ireland, in which case you can choose to bring proceedings there. d. Any or all part of any term of these Terms that is found to be unfair or unenforceable by a court of competent jurisdiction will be treated as deleted and the remainder of the Terms will continue to govern each of our respective obligations. e. ny notice from you to us must be sent in writing to us at our address detailed on our website. f. f you elect to collect the Lot from us you will bear all associated cost, expenses and duties.)

CONDITIONS OF SALE

SELLERS

1. Our Status a. You appoint us to act as agent to sell the Lots on your behalf by auction. b. You will pay us the Sellers Commission together with VAT at the prevailing rate. c. We will not include any Lots in an auction until they have been received by us. d. We will pay the Hammer Price, with Seller’s Commission, Loss and Damage Warranty and any other charges incurred deducted and applicable VAT applied at the prevailing rate, to you at 28 working days following the Auction in which the Lots are sold, or if later, 7 days after payment by the Buyer.

2. The Reserve a. We will agree with you the Reserve, which may be higher than the starting bid. b. We shall not publicise the Reserve. c. We may bid on your Lot up to an amount equal to the Reserve. You may not bid on your Lot under any circumstances, nor maySyou permit any person to bid on your lot on your behalf.

3. Seller’s obligations and undertakings a. You warrant to us and to the Buyer that: i. you are the sole owner of the Lot and that you have full right, title and authority to sell the Lot; ii. you have no reason to believe that it is a Forgery; iii. all Lots sold by you are sold to the Buyer with full title guarantee and free from all encumbrances; iv. you have provided to us all of the relevant information and documents in your possession or control concerning the Lot, including information about its authenticity, history, condition, prior ownership and all such information is complete to the best of your knowledge; v. if the Lot has been removed from a country outside the UK, all duties and taxes on the import of the Lot have been paid, all export and import declarations have been properly made; vi. you will pay any and all duties and taxes that may be due in connection with the sale of the Lot; vii. you have given us notice of any alterations to the Lot of which you are aware; viii. you may not withdraw a Lot from an Auction without our consent. b. If you withdraw a Lot from an Auction without our consent, you will pay to us 15% of the Lot’s estimate and any related costs within 14 days of such withdrawal. c. If the Buyer of your Lot decides to exercise their right to cancel, you agree that we shall be entitled to account directly to the Buyer for any applicable refund and we shall account to you for any sums retained on account of the Lot being damaged or tampered with by the Buyer. d. You will indemnify us and the Buyer in full on demand against all claims, costs or expenses incurred by us or the Buyer as a result of any breach by you of any of the obligations in this clause.

4. Loss and Damage Warranty a. All Lots held with us are covered by insurance against risk of fire, burglary, water damage and accidental damage except to glass. For this we will charge you 1.5% plus applicable VAT of the Hammer Price for the Lot or the value the Lot would have achieved as assessed by the Auctioneer. b. Subject to this, risk in the Lot remains with you at all times until risk passes to the Buyer. You will indemnify us and our employees and agents, and the Buyer (where appliable) against all loss damage claims costs and expenses suffered or incurred as a result of any claim in respect of the Lot or the proceeds of the sale of the Lot.

5. Anti-Money Laundering Regulations a. 6. Images and Illustration a. We will take (or authorise others to take) photographs, video and/or produce images of the Lot and will own all intellectual property rights in any such images and may use them for any purpose, and you warrant that there is no restriction on our ability to do so.

7. Unsold Lots a. If at the end of the Auction, your lot is unsold (other than because it was withdrawn) the Lot will be available for After Sale offers. b. Registered Bidders may contact us and offer to purchase a Lot after the Auction. If the bid meets or exceeds the Reserve, we may authorise the sale of your Lot without contacting you and the sale will be completed as if the Lot had been sold during the Auction. If the bid is less than the Reserve, we will contact you. If you accept the bid and wish to proceed, the sale will be completed as if the Lot had been sold during the Auction. c. You may contact us at any time after the Auction to remove your Lot from the After Sale process. d. Subject to agreement with us, your unsold Lot can be re-offered at a future Auction at a revised Estimate and Reserve or can be collected by you, you are responsible for collection and transportation arrangements and costs.

8. Withdrawn Lots a. If we withdraw a Lot from Auction, we will notify you and you will collect the Lot from us within 30 days of our notification. b.You are responsible for collection and transportation arrangements and costs.

9. Forgeries A. A sale shall be cancelled and the Buyer shall be entitled to a refund of both the Hammer Price and the Buyer’s Premium if a Lot bought by the Buyer through our Auction is shown to our satisfaction and within 14 days of the Auction to be a Forgery. b. If this is the case, you shall refund to us on demand, the total amount paid to you in relation to the lot plus any costs incurred by us or by the Buyer.
