US

Dock can change between the time you place an order and the order is delivered, which could affect the calculation of sales tax. The amount appearing on your order as Estimated Tax may differ from the sales taxes ultimately charged. Where required, tax will also be applied to the shipping and handling charges. Depending on the tax laws in your state, you may be required to pay use tax on purchases for which we do not collect sales tax. If your order is tax exempt, please, send us a copy of your current sales tax exemption certificate via e-mail to accounting@dockbuilders.com or via fax to 1.800.734.0335.

Shipments

Unless you specify otherwise, we will ship your order in the most efficient way possible. If you have a preference of carrier, please tell us; we’ll honor your request if practicable. Smaller packages weighing less than 50 pounds are usually shipped via a parcel service such as FedEx or UPS, with charges prepaid and added to your invoice. Larger items are shipped via freight truck, with charges prepaid and added to your invoice. For freight truck orders, a shipping acknowledgement and verification form will be e-mailed and must be completed prior to shipment of your order. If you need your order rushed, please ask our representatives for a quote on expedited next-day or second-day air service.

Claims for Shortages or Damaged Goods

On a rare occasion, a package may be lost or damaged in transit. For your protection, you should always carefully inspect any shipment before accepting delivery. If damage has occurred, you must note it on the delivery receipt. If a freight truck shipment is damaged, you must also immediately have the shipment inspected by the carrier. Obtain an inspection report from the carrier, and forward a copy to us. All claims must be filed within 7 days of receipt of shipment. Returns

At Dock Builders Supply, we want you to be satisfied with your purchase. The vast majority of our products are eligible for return or exchange within 30 days of purchase provided they are unopened and unused; however, some products are not eligible for return. Products that cannot be returned or exchanged include, but are not limited to: custom colored dock sealants, aluminum gangways, piling wrap, filter fabric, mounted FlexMaster Fenders, power pedestals, 110 volt dock lighting, underwater lighting, solar illuminating buoys, and Dow Styrofoam™ Billets. In addition, orders that received special volume pricing or contain special order or custom fabricated items are also not eligible for return, unless specifically stated as such on the estimate or sales order.

If the products you purchased are eligible for return:

1. Call your Dock Builders Supply representative at 1.800.677.4710, and request an exchange, credit, or refund.

2. Your representative will issue a Return Authorization (RA) number – just include it with your package when you return it. We highly recommended that you use a shipping system that can track your shipment such as UPS or FedEx. If your order was sent to you via freight truck, then it will likely need to be returned via freight truck. All returns must be returned to Dock Builders Supply freight PREPAID. Dock Builders Supply is not responsible for freight charges on merchandise being returned for exchange, credit, or refund.

3. Exchanges, credits and refunds are typically processed within 5-10 business days following the receipt and inspection of your return. Refunds will be made using the same method and to the same credit card used on the original order. Please note all merchandise returned NON-DEFECTIVE will be charged a 15% restocking fee. Refunds are calculated based on the purchase price of the merchandise only. All shipping and handling fees are non-refundable. Merchandise returned damaged (cosmetically or otherwise) is subject to an additional fee on a case-by-case basis (please call for details). Items showing obvious signs of use are not eligible for return. Items returned with missing parts and/or accessories will be charged accordingly.

Note: Shipping costs for returns may be higher than the original shipment costs. The customer is responsible for ensuring the merchandise arrives at Dock Builders Supply in the same condition as when received.

Cancellation Policy

If you would like to cancel or change an order, you must contact us within 2 hours from the time the order was placed. We apologize, but orders placed online or over the phone begin processing immediately to ensure timely order fulfillment and shipping time. Our representatives will request a cancellation of your order at our warehouse. If successful, they will send you an email and the cancellation will be free of charge. If cancellation was not possible, the products will be delivered to you, which you will need to refuse upon receipt. The products will be returned to us and we will issue a refund for the merchandise only (including applicable tax); shipping and handling will not be refunded.

Export / International Orders

All international shipments must be prepaid in U.S. currency via bank wire transfer. Any applicable duties, taxes, and customs charges are the responsibility of the customer. Residents of Canada and most U.S. Territories may reach us by calling 1.800.677.4710. From all other areas, please email us at sales@dockbuilders.com or call us at +1.813.677.4000. It is the sole responsibility of the Client to select and work with a qualified freight forwarder in the continental United States who can assist Client with all import/export documentation and formalities in order to comply with customs regulations. Dock Builders Supply will provide the Freight Forwarder with a commercial invoice only. All Goods are assumed delivered in good condition upon delivery to such Freight Forwarder, unless Dock Builders Supply is notified within five (5) business days of delivery to Freight Forwarder. No returns will be accepted after this time.

Dock Plans and Designs

If you need help designing your floating dock or if you would like a quote based on your unique configuration requirements, please give our knowledgeable sales team a call. We can often provide you with a cost estimate and drawings that meet your needs. Please keep in mind any drawings we provide are to be used as a rough guide only. Dock Builders Supply assumes no responsibility or liability for the design, structural integrity, accuracy, or completeness of the drawings. If your project requires precise calculations or specific load requirements, you should consult with an engineer who can provide more detailed plans specific to your project.

Product Changes

Products are continually undergoing refinement in design and manufacture. Dock Builders Supply reserves the right to discontinue the sale of any product and to change pricing, terms, specifications, and warranties at any time without notice.

Product Use

Buyer is responsible for evaluating whether a product is appropriate for a particular use or application. The conditions of evaluation, selection, and use of a product can vary widely and affect the use and application of a product. Because many of these conditions are uniquely within the buyer’s knowledge and control, it is essential that buyer evaluate whether the product is suitable and appropriate for a particular use or application.

Order Acceptance

Dock Builders Supply reserves the right to cancel any order prior to delivery, at Dock Builders Supply’s sole discretion, whether or not payment was made. If payment was made and your order is cancelled, we will issue an appropriate credit to your account, or may contact you to collect information in order to do so.

Color Accuracy

We have done our best to display the colors of the products as accurately as possible in this catalog. However, due to printing limitations, we will not be held liable for variations in color. If the color of a specific product is extremely important to you, please call and ask if a sample is available before placing your order. Some products, such as our nautical hose holders and address plaques, are airbrushed by hand, so no two pieces will be exactly the same.

Misprints

At Dock Builders Supply, we strive to ensure our catalogs are correct before sending them to print, but occasionally errors do occur. Dock Builders Supply will not be held responsible for printing errors.

Local Standards and Regulations

Certain products sold by Dock Builders Supply are designed to satisfy state and federal requirements. Because local standards and regulations may vary significantly, Dock Builders Supply cannot guarantee products meet all applicable requirements in each locale. The purchaser assumes responsibility for compliance with local standards, codes, and regulations where the products will be shipped, sold and used.

Warranties

Many products sold by Dock Builders Supply are covered against defects by manufacturers’ warranties. A copy of each manufacturer’s warranty is available upon request. If you experience any product defects inside of our return period or have any questions, please call us at 1.800.677.4710. If failure of a product purchased through us occurs during the manufacturer’s warranty period, a claim for adjustment may be submitted directly to the manufacturer, or our company will assist on submitting such claims. Products sent to us for warranty consideration are accepted only under the conditions stated in the manufacturers’ policies. Please note acceptance of such items by us for submission to the manufacturer does not imply validity to any claim. All decisions regarding the repair or replacement of any items are the sole responsibility of the manufacturer. Under no circumstances are we as a distributor, authorized to replace a defective item prior to submitting such item to the manufacturer.

Disclaimer of Warranties

Dock Builders Supply disclaims all warranties either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose with respect to any product purchased from any Dock Builders Supply retail store, website, or catalog. Dock Builders Supply’s liability in connection with a customer’s purchase is expressly limited to Dock Builders Supply’s return policy set forth above, and all claims for consequential, incidental, or special damages are hereby excluded.

Indemnity

Neither Dock Builders Supply, nor W.R. Williams Enterprises, Inc. shall be subject to, and disclaims: (1) any obligations or liabilities arising out of breach of contract or of warranty, (2) any obligations whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by Dock Builders Supply, or any undertakings, acts, or omissions relating thereto, and (3) all consequential, incidental, or contingent damages whatsoever including, but not limited to, labor costs or loss of profits arising out of or in conjunction with the manufacture, sale, delivery, use of, or inability to use any products purchased from Dock Builders Supply.

Governing Law / Venue / Jurisdiction

This agreement shall be construed and enforced in accordance with the laws of the state of Florida without regard to the conflicts of law provisions thereof. ALL SALES TRANSACTIONS EXCLUDE THE APPLICATION OF THE 1980 UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALES OF GOODS, IF OTHERWISE APPLICABLE. All claims, actions, disputes, controversies or suits shall be litigated exclusively in the courts of competent jurisdiction in Hillsborough County, Florida, United States. Each party specifically consents to service of process by and the jurisdiction of and venue in those courts and Customer, if not a resident of the United States, hereby appoints the Secretary of State of Florida as its agent for service of process in the United States.
