Marshall “Duffy” Duffield fails to win a second term on Newport Beach City Council.

NEWPORT BEACH — The City Council member serving as Newport Beach’s mayor in 2014 and 2018 went on to lose his council seat in that year’s general election. Marshall “Duffy” Duffield was the headlining story in both instances – defeating then-Mayor Rush Hill in 2014 before coming full circle and losing to City Council candidate Tim Stoaks in 2018, coincidently as Newport Beach’s mayor.

Duffy, as he is commonly called, was part of an interesting sweep in 2014. He and a slate of three others swept the 2014 City Council race, promising to shake things up on the dais. In late 2017 he was elevated to Newport Beach’s top council position, three years after he unseated the sitting mayor. Duffield’s fortune appears to have soured one year later, as it’s now his turn to be elected off the City Council despite his role as sitting mayor on Election Day. Stoakes defeated Duffield in what was clearly the closest of four City Council races in Newport Beach.

Only 310 votes separated Stoaks from Duffield, with all precincts reporting.

The final vote was 14,017 (Stoaks) to 13,707 (Duffy). Stoakes stated his top priority on the dais would be to reduce noise and pollution.

Duffield’s defeat means the Newport Beach City Council now has one less boating interest.

Council member Brad Avery, a lifetime sailor and face of the OCC Sailing Center, joined Duffield in representing local boaters on the dais.

Southern California’s boating community was certainly influenced by Duffield. The now outgoing Newport Beach City Council member invented the Duffy boat.

WASHINGTON D.C. — Seafarers, for years, have heard the strange tale of the Bermuda Triangle. Explorers have long searched for the Lost City of Atlantis. Even tales of monsters, from Nessie in Loch Ness, Champ of Lake Champlain and the “headless chicken” sea creature, have fascinated and filled news feeds since the tabloid ages. Some of these stories have kernels of truths and some do not – or do they?

Sailor who perished in Pearl Harbor will finally be put to rest at home TRAER, Iowa (AP) — Officials say the remains of an Iowa sailor killed in the Pearl Harbor attack are being returned to his family for burial with full military honors.

The Defense POW/MIA Accounting Agency says the remains of 22-year-old William Kvidera, of Traer, will be buried Nov. 16. He was a carpenter’s mate 3rd class assigned to the USS Oklahoma. The battleship capsized on Dec. 7, 1941, after being struck by Japanese torpedoes. His remains were among

Robinson had joined West Marine on Jan. 29, 2018. Previously, he has worked for Lowe’s Home Improvement in executive roles for the past 13 years.

No further details were revealed as to why Robinson’s exit was so hasty.

“It’s a free-for-all out there,” says boater of small vessel anchorage dilemma off Sausalito SAUSALITO, California (AP) — Authorities are cracking down on small boats that have anchored off Sausalito, where the number of vessels that sit motionless away from shore has doubled over the last year amid a housing crisis in the San Francisco Bay Area.

Sausalito police over the weekend began placing bright orange warning stickers on the decks of dozens of small “anchor-out” vessels bobbing in Richardson Bay. They warn that police may remove any vessel left in city water for 72 hours, the San Francisco Chronicle reported.

About 250 boats in the water off Sausalito belong to people who appear to be living on the vessels but are unwilling or unable to pay $1,000 or more per month to tie up at a marina berth, the newspaper reported.

“The boats just sit there, like a giant parking lot,” said Sausalito Police Officer Brian Mather. “More like a giant junkyard.”

Lt. William Fraass said reports of thefts and other problems have increased along with the number of vessels.

Longtime anchor-outer Alden Bevington says he was evicted from his 33-foot (10-meter) yawl, Sanctuary, about a month ago and the vessel was hauled off by the city and destroyed.

“This is a social issue, not a law enforcement issue,” Bevington said. “This is a problem of the economy. Richardson Bay is one of the last places where people can

drop an anchor and stay.”

Bevington acknowledged that some of his fellow boaters are broke but being down and out isn’t a crime, he said, on land or on the water.

Sausalito Mayor Joan Cox said the city did “not want to go out and seize boats, (but) this is a public health and safety issue.”

Boaters who rent slips at high-end Sausalito marinas complain that many of the boaters paddle ashore in kayaks and rowboats to use the marina restrooms. But not everyone.

“The main problem is the lack of toilets,” said Harbormaster Mike Rainey.

“In theory, they’re supposed to have their toilets pumped out,” he added. “I’ve never seen a pump-out boat going out to service the vessels.”

Kirk Morrison and his friend Nick Masturzo pay about $700 a month to berth their 21-foot (6-meter) motorboat at Schoonmaker Point. They wave at their fellow sailors on the anchor-outs, but they’re not particularly happy about subsidizing them.

“It’s a free-for-all out there,” Morrison said. “It’s a problem. It’s like trying to solve the homeless problem in San Francisco. I don’t know what the solution is.”

Fisherman saves entangled whale off California’s coast despite experts’ claims his actions were dangerous MORRO BAY, California (AP) — A commercial eel fisherman jumped into the ocean off the central California coast to cut a humpback whale free from entangling ropes.

KNTV reports the rescue occurred last month off Morro Bay as the leviathan struggled to free itself from ropes attached to a buoy.

Nicholas Taron shot video and yelled encouragement as Sam Synstelian leaped from their boat onto the back of the distressed whale, which was swimming in tight circles.

KNTV says the men believe they were successful.

Experts say, however, that it could have turned out badly for the fishermen.

The National Oceanic and Atmospheric Administration’s pacific fisheries spokesman Justin Veizbicke says professional rescuers never get into the water with a whale.

The pumps at Seabridge were intended to circulate water at the small swim beach in the shallow bay that was originally proposed in the Seabridge project. This beach was never built. Instead the amphitheater was installed.

The pumps were never meant for anything at Kiddie Beach in Channel Islands Harbor.

Midterms 2018: Looking Ahead to Boating Politics in 2019 and 2020 Some waterfront communities elected new representatives, but what does this means for boaters?

SOUTHERN CALIFORNIA — The dust is finally settling on 2018 and the political landscape of the next two years will start to take shape almost as soon as the upcoming holiday season has come and went. These 2018 Midterm Elections, like the presidential canvas two years ago, was filled with a few twists and surprises. Some of those electoral shakeups occurred along the Southern California coast. Whether a new wave of political leaders in local city halls, Sacramento’s halls of legislation or Capitol Hill in Washington, D.C. will positively or negatively affect the Southern California boating community remains to be seen.

Democracy requires action and participation, regardless of who you voted for or whoever

won the election in your district. The only way to ensure local, regional and national politicians don’t overlook you entirely is to maintain an active and engaged voice. Be sure to communicate with those who represent you (we’re providing contact information for some of those leaders at the end of this column). Let’s take a look, nonetheless, at some of the changes voters endorsed on Nov. 6.

AVALON — Moviegoers filled cinema halls across the United States to watch ‘Bad Times at the El Royale,’ the fall thriller directed Drew Goddard and starring Jeff Bridges. The film’s opening scene had a familiar sound for Southern California boaters: Within minutes of the film starting the sounds of ‘26 Miles (Santa Catalina)’ blared from the movie theater’s sound system.

The song was an odd choice for the film, since the scene it was featured in was set in Lake Tahoe – which is nowhere near Avalon (let alone Southern California, for that matter).

‘26 Miles (Santa Catalina)’ was performed

by The Four Preps and reached as high as the number two slot on the Billboard Hot 100. The song was an ode to all things Catalina Island. The 26 miles reference, of course, is the travel distance across the channel, from Los Angeles to the island. Catalina Island’s coastline and surrounding environs were romanticized throughout the track.

We later find out the buried briefcase contained a large amount of cash, which was stolen by a gang or robbers. Perhaps the robbers were planning a getaway to Catalina Island once they were in the clear with the stolen money?

Maybe, but at minimum a piece of Catalina was featured in the opening scene of a Hollywood thriller.

DBW to host clean boating meeting in NorCal State officials will discuss sea level rise, copper-based paint regulations and pumpouts at Dec. 4 meeting.

By Parimal M. Rohit RICHMOND — California’s Division of Boating and Waterways (DBW) will be hosting a clean boating meeting at Richmond Yacht Club on Dec. 4.

Southern California boaters who would happen to be in the San Francisco Bay Area during the first full week of December are encouraged to attend the meeting, which is put on by DBW and the California Clean Boating Network. The meeting is free and runs from 9:15 a.m. to 1 p.m.

Those who are unable to make the trek to Richmond could perhaps campaign DBW staff to host a similar meeting in Southern California; contact info will be provided at the end of this article.

The Dec. 4 meeting will specifically cover the effects of sea level rise on boaters and marinas. Information about the new copper-based paint and coating regulations, as they pertain to recreational boaters, would also be provided.

Attendees will specifically be given an update on California’s Statewide Clean Boating Program. Information will also be provided for those who want to become involved with the program in 2019.

Reinhard Flick, a research associate at the Scripps Institution of Oceanography’s Center for Coastal Studies, will talk about predicted sea level rise and the phenomenon’s potential effects on marinas, coastal access and other boating infrastructure.

“The range of future sea level projections prepared as part of California’s Fourth Climate Change Assessment of 2018 will be shown. Illustrations of how sea level rise will increase the frequency and severity of extreme events later this century and how this may influence coastal marinas will follow,” a notice of the Dec. 4 meeting stated. “ [A] brief discussion of strong impacts that related changes will have on inland marinas will close the presentation.”

Also on the agenda is a session entitled, “Copper Antifouling Paints in California: Everything the Recreational Boater Needs to Know.” Aniela Burant of California’s Dept. of Pesticide Regulation will lead the session, which will focus on new copper-paint regulations for boaters. The new copper-based paint and coating regulations, which places a cap on copper leach rates from antifouling paints, went into effect on July 1.

“Information on the background of

the regulation, types of vessels affected, and details on existing stock will be presented. The presentation will conclude with ample time for questions and answers to clear up any confusion surrounding the new regulation,” DBW staff stated in the Dec. 4 meeting notice.

pouts and sewage. The team will talk located at 351 Brickyard Cove Road about a mobile application for pumin Richmond; parking, for those who pouts. A report on statewide pumpout make it up to the meeting, is free. data will also be presented.

Will the ultimate decision in San Clemente influence future seawall projects in boating communities, such as Dana Point, Oceanside, Long Beach, Newport Beach and elsewhere?

SAN DIEGO — Coastal armoring in Orange County was back on the docket again at the most recent California Coastal Commission meetings.

Commissioners postponed its deliberation of a proposal to build a seawall off the South Orange County coast, in hopes of giving Coastal Commission staff more time to craft alternate solutions.

The city of San Clemente hopes to build a new seawall to protect a 50-year-old building. The building – San Clemente’s Marine Safety Building – houses local lifeguard operations and supports coastal access. Erecting a new seawall, city officials argued, would help stifle sand erosion, which has marred the Marine Safety Building for decades. A seawall is currently in place; the new seawall would be built in front of the older structure.

San Clemente wants the seawall built, essentially, to give the city as much time as possible to build a new Marine Safety Building on the beach.

Coastal Commission staff presented two photos of the Marine Safety Building, which was built in 1968, to commissioners during its presentation: one photo was taken in 1972 and the other in 2018. The 1972 photo, taken as an aerial, clearly shows the building’s foundation area entirely covered or surrounded by sand.

Sand erosion at the same foundation area could clearly be seen in the 2018 photo, which was taken from ground level. The proposed seawall, according to Coastal Commission staff, is a short-term protection measure, which means its designed height does not take into account forecasted sea level rise.

“The city is characterizing the proposed project as repairs to extend the building’s life an additional five to 10 years, while a replacement

building is being designed and constructed,” Liliana Roman, a planner with the Coastal Commission, told commissioners.

Commissioner Donne Brownsey said she was concerned with the length of the project term, which was proposed to be 15 years.

“I am concerned about … the ability of this building to be maintained on the beach with seawalls,” Brownsey said. “You can see the degradation of the beach from the ’72 photo to the present.”

Coastal Commission Chair Dayna Bochco questioned why a new Marine Safety Building had to be built on the beach. Perhaps the city should consider erecting the new building in a parking lot or somewhere else off the sand – eliminating the need for a 15-year Coastal Commission permit in the process.

No one from the city of San Clemente was present at the Oct. 12 public hearing; the seawall discussion was the final item on the Coastal Commission’s October meetings in San Diego. Commissioners and Coastal Commission staff hoped representatives from San Clemente would be in attendance when its proposal is reconsidered at a future meeting.

The Coastal Commission’s final two meetings of 2018 are on Nov. 7-9 in San Francisco and Dec. 12-14 in Newport Beach.

San Clemente is located in between Dana Point and Oceanside harbors.

The city’s Marine Safety Building was built prior to the enactment of the Coastal Act. Coastal armoring has been on the commission’s radar recently. Various cities, counties and other agencies have contemplated coastal armoring as a defense mechanism to predicted sea level rise. Questions have been raised, however, whether the building of seawalls and similar structures in the water actually cause more harm than good. Do seawalls actually cause more beach erosion or introduce non-native species to local waterways, for example?

Removal of piles from waterfront building needs more vetting, according to state agency.

SAN DIEGO — Plans to reinforce a waterfront overhang at Redondo Beach’s King Harbor might have to go back to the drawing board. The California Coastal Commission postponed a planned discussion on a piles replacement project at King Harbor, Oct. 10. Coastal Commission staff originally recommended a denial of the project applicant’s request to move forward, stating plans were not consistent with the certified Local Coastal Program (LCP).

The applicant sought to remove five existing dock guide piles to support and reinforce a cantilevered portion of an existing 49-unit apartment building at King Harbor. A public walkway exists under the overhang.

“The improvements to the dock system would enhance public access and would develop new coastal-dependent uses seaward of the project site.

These elements are consistent with the Coastal Act and the certified [LCP] however, these elements of the project do not require the proposed fill for the apartment building foundational support,” Coastal Commission staff stated in a report to commissioners. “While the project would enhance public access and coastal dependent uses, the overall proposed project is inconsistent with the Coastal Act and the LCP.” Coastal Commission staff stated the proposed project is a “significant expansion” of waterfront land use.

“In this case, the addition of 16 new piles would more than double the number of support piles and result in a substantial expansion of the structure’s foundation system. Therefore, the proposed development is not allowed repair and maintenance, and is not consistent with the marine resource protection policies of the Coastal Act,” Coastal Commission staff stated in its report.

The project applicant was asked to provide alternative plans.

“The alternatives provided by the applicant would result in more fill than what is currently proposed, or would require a significant remodel, such as removing the portion of the building overhanging the water, that is not proposed at this time,” Coastal Commission staff stated.

Coastal Commission staff added the waterfront apartment building is not located on tidelands but any work would take place in submerged lands.

There are 23 slips nearby, according to Coastal Commission staff; all 23 slips would be replaced.

“The project includes demolition of the existing boat slips and reconstruction of the slips, with no loss to the number of slips, and installation of a

1,000-square-foot public dock area in the marina, immediately seaward of the apartment building, and allows for temporary dinghy or small craft docking and a launch point for hand-powered small crafts.”

The developer originally initiated this proposed project in 2013; its Coastal Commission application had been incomplete for three years, with the applicant withdrawing the application altogether in 2016.

ing in and around the city’s harbor area.

Voters elected Duffield to the City Council in 2014; he was elected by his colleagues as the Newport Beach mayor at the end of 2017. The Duffy inventor vowed to bring several harbor-themed issues to the forefront during his tenures as council member and mayor, but Duffield recused himself from several waterfront issues — effectively canceling out his voting power on a few boating issues. The recusals were always attached to Duffield’s business interests on the Newport Beach waterfront.

There were still a few significant changes on the Newport Beach waterfront during Duffield’s tenure. The city, for example, decided to no longer allow jetpacks in the bay, revamped the local harbor department, opened Central Avenue Pier (which includes valuable boat docking space), earned the power to grant local eelgrass permits and clarified speed limit rules (as they relate to regattas). None of these issues were specifically heralded by Duffield, though. The Duffy inventor, instead, positioned himself as a council member capable of giving his colleagues insight on what issues matter most to boaters.

At least one local publication had called the Stoaks-Duffield race too close to call, but if the current vote count maintains then the only boater left on the Newport Beach dais is Council member Brad Avery.

Newport Beach City Hall was not the only place where a seismic shift occurred on Nov. 6. The city’s congressional district also saw an incumbent go down, as Democrat Harley Rouda defeated multi-term Rep. Dana Rohrabacher, R-48th District.

Rohrabacher was elected to the House of Representatives in 1988; his loss ends 30 years of representing portions of Orange County (including Newport Beach) in Washington, D.C. Most of Newport Beach Harbor’s affairs would be handled at City Hall, the county office in Santa Ana or even Capitol Hill in Sacramento. Of course there are those times when city officials or local developers have to appear in front of the California Coastal Commission. Yet there are still federal issues pertaining to Newport Beach Harbor, such as dredging or the broad environmental issue. City officials might even rely upon federal funding to help pay for seawall repair or help restore an endangered species within harbor waters.

Rouda had to withstand Rohrabacher’s lack of concession, but now ends up representing the 48th district and will certainly have a lot on his plate, making it easy for the representative to focus on issues other than boating. The Log will keep boaters updated of when they should reach out to Rouda (assuming he is indeed the winner of the 48th).

House 49th District Democrat Mike Levin defeated Republican Diane L. Harkey in the race to succeed Darrell Issa and represent Oceanside and Dana Point boaters in Washington, D.C. Federal issues are a little more common in Oceanside, what with the city’s harbor abutting a military base and dredging constantly being an issue. Dana Point Harbor, meanwhile, is about to undergo a major overhaul. The revitalization, of course, is a local project backed by private developer money, but boaters at Orange County’s southernmost harbor still have to deal with dredging and the occasional military presence. Will Levin lend his ears to boaters in Dana Point and Oceanside?

There were clearly other elections in play, all of which couldn’t be addressed in this column. The Log will, of course, use this Standing Watch space to keep you updated on specific issues boaters should know about, and stay in touch with your representatives. Governor’s Race Gov. Jerry Brown will be wrapping up his second two-term stint as California’s top executive. Filling in for him during the next four years will be Gavin Newsom. Boaters were not high on Brown, especially after Cal Boating was stripped of its powers as an independent state department for boaters and whittled down to a division under the controls of another agency.

Will boaters see Newsom as an extension of Brown? Newsom, like Brown, is a Northern California politician. Questions, accordingly, might be raised as to whether Newsom will pay any mind to the Southern California electorate (let alone Southern California’s boaters). Various issues, though, are in play at the state level, such as the potential reorganization of State Parks, continued implementation of the Boater Education Card, copper regulations and invasive species management, among others. How will these issues take shape under Newsom’s leadership?

side of Southern California (it covers Fresno and much of the Sierras). What makes this district significant, however, is it was the one represented by Tom Berryhill (who has been termed out). Berryhill was the biggest advocate for fishing license reform, consistently pushing for his colleagues to support an annual fishing license regime (as opposed to calendar-based).

Succeeding Berryhill is Andreas Borgeas, a fellow Republican who most recently sat on the Fresno County Board of Supervisors. Will Borgeas take the torch from Berryhill and continue to advocate for fishing license reform?

His district is certainly home to many anglers and outdoors enthusiasts.

A large contingency of anglers from Southern California visit portions of this district, as well, so it would certainly behoove anglers to be in touch with Borgeas.

District waives rent for the next few months but commission expresses concern over maritime nonprofit’s future.

LOS ANGELES — The Port of Los Angeles’s Board of Harbor Commissioners unanimously agreed to forgive AltaSea’s rent obligations through August 2019, on Oct. 18.

AltaSea, a nonprofit maritime organization operating at the Port of L.A., has run into problems with utility services on the land it rents from the port district.

Mike Galvin, director of real estate for the Port of L.A., said AltaSea met some of its obligations on Aug. 23 but discovered some power issues with the L.A. Department of Water and Power (LADWP). Port of L.A. staff, accordingly, recommended the district wave AltaSea’s rent obligations until August of 2019, in order to allow the nonprofit to work out its issues with LADWP. The Port of L.A. and AltaSea initially agreed to pay $136,222 in rent in exchange for 34.75 acres of land for “water-dependent, academic and governmental uses, and a non-profit and for-profit marine research facility.”

“They identified an issue with the LADWP with regards to power sufficiency for the site, to actually allow them to bring tenants into site in the interim,” Galvin told commissioners.

AltaSea expected to have power at its Port of L.A. site by June of this year.

“That has been delayed until June of 2019, approximately,” Galvin said.

“They’re still working through that, they believe they’ve gotten through the issue regarding design and an interim power solution that will allow them to bring in tenants.”

A sinkhole was also discovered on AltaSea’s leased parcel, complicating matters further.

Galvin added AltaSea has experienced significant opportunity cost, possibly in the $500,000 to $700,000 range, as a result of the current standoff with LADWP and the inability to rent out portions of the leased parcel to other tenants.

“According to AltaSea, the loss of approximately $500,000 to $700,000 annually in potential revenue from rental income significantly constrains their annual budget,” port district staff stated in a report to commissioners. “Rental costs to the Harbor Department of $14,262 per month would further burden this situation until potential tenants can be accommodated.”

Commissioner Ed Renwick was supportive of the plan to forgive AltaSea’s rent through next summer but expressed concern about the nonprofit’s future.

“What I feel sad about for AltaSea is this is only part of their loss,” Renwick said. “They are a nonprofit doing their

best to survive, and because the DWP apparently is a year late in making a solution, I would ask that staff help do everything they can, and to help with the coordination with DWP. “We’re happy to do our part but we can’t turn on the power,” Renwick continued. “This is terrible for AltaSea. It sounds like … even after we forgive rent, they’re going to be out something like half a million dollars, which is, for a nonprofit who’s doing their best to change the world, is absolutely tragic.”

The port district specifically waived AltaSea’s rent obligations between Sept.

11 and Aug. 22, 2019.

Questions abound about Prowler vs. Attessa IV collision

SAN DIEGO — The weekend leading up to Halloween was met with a freaky collision off the San Diego coast, as a sportfisher and superyacht reportedly became entangled on Oct. 26. Several passengers had to be rescued by the U.S. Coast Guard and at least one person died, according to news reports and unnamed sources.

Several publications and online message boards have revealed the basic facts: Prowler, a 65-foot sportfisher, and Attessa IV, a 332-foot superyacht, were involved in an open ocean collision on the American side of the U.S.-Mexico maritime border, about 9 miles west of Imperial Beach.

The area where both boats collided is relatively busy with boats, as many vessels navigate through this stretch of the Pacific Ocean en route to Mexico, several sources confirmed with The Log. Attessa IV is a 332-foot yacht owned by businessman Dennis Washington.

The superyacht has a swimming pool, helipad, Jacuzzi, cinema, beauty salon and 10 guest cabins.

Collision Chatter: The Conditions Bloody Decks, the popular fishing website, featured an extended conversation about the two-vessel collision on its online discussion forum. Some questioned whether radar or Automatic Identification Systems (AIS) could have prevented the collision.

NEWPORT BEACH — Some back and forth about the urgency of dredging Grand Canal took place at the Newport Beach City Council meeting on Oct. 23. City Council members ultimately decided to move forward with a re-bid that would complete the second phase of the dredging operation.

The first phase of the dredging activity was completed in February 2017 from Park Avenue Bridge to South Bayfront (the south side only) for a total cost of $379,545.

In August, the first bid for the second phase was rejected due to limited work hours and calendar work days available. Harbor Resources Manager Chris Miller said one of the reasons re-bidding was recommended was to cut costs; the second phase cost was estimated at nearly $1.5 million.

Another reason for the rejection, according to Miller, was the previous bid only offered limited work hours and calendar days to complete the dredging project.

A re-bid, which was delivered to city staff in October, estimated a base cost of $1,283,070 and the Harbor Island location was added for $103,820, for a grand total of $1,383,070.

Council member Brad Avery mentioned the cost seemed like “a lot of money for a small channel.”

Miller, in response, stated: “There is nothing that says this project is critically urgent this year,” but also added the canal tends to omit a bad odor during low tides and that the canal’s oxygen levels benefit from being circulated.

In today’s economy, Miller also noted that only two companies really bid on these small dredging projects, so there is typically not a lot of flexibility in cost or competition for the bids.

Because the pricing quote is not likely to change any time soon, council members agreed not to wait.

Some council members were concerned about the possible noise, but Miller stated: “I wouldn’t characterize it [dredging] as quiet, but it wouldn’t be as noisy as you think.”

The canal, which is mostly navigated by boaters with small vessels or paddleboarders, is only 1,488 feet long and 95 feet wide, and it was first dredged in 1953. Miller also stated that the channel was closed from May to October during the busy months so as it does not become too crowded.

Mayor Marshall “Duffy” Duffield and Council member Scott Peotter recused themselves from this agenda item due to business conflict of interests.

Coincidentally, Duffield and Peotter were voted off the council during the last election on Nov. 6.

SAN DIEGO — Most residents of California, regardless of age or background, could probably recall poaching abalone, a typed of shellfish, is illegal.

In a recent poaching case involving members of San Diego Yacht Club (SDYC) harvesting lobster and abalone off of Catalina, it is a difficult pill to swallow. The Log can testify there are plenty of fishermen, yacht club members, sailors and other ocean activists who work to protect the ocean and its creatures. Besides, how can the future generations enjoy these same activities if we refuse to care for the ocean’s arena and her population?

The Lowdown On Aug. 25, an anonymous tip was given to the California Department of Fish and Wildlife. Men were allegedly diving into the water close to Catalina Island and catching lobsters (it is also illegal in California to catch the crustaceans outside of lobster season, which began on Sept. 29 and runs through March 20, 2019) and abalone.

While the boat was unoccupied, wardens searched it and found a slew of lobster and abalone carcasses beneath the boat, plus four shucked abalone and five lobster tails in a cooler. The wardens, eventually, were able to locate Nichols at Catalina Island nearby.

Why is poaching so wrong?

Ethos would mandate humans, as complex beings, should care for the pain and suffering caused to other life no matter how big or how small.

Poaching, however, is dangerous for many reasons beyond the cute factor of a poachable creature. Just as the environment on land has experienced changes since its creation, so has the marine atmosphere. It’s also important to note poaching also differs from fishing, angling and hunting because it is done for a profit.

For frequent readers of this publication, The National Geographic and even general Google searches, there is quite a bit of scientific backing to show how the ocean is adapting to increased traffic in the waters. Even dolphins are changing the length of their calls to navigate the increased boating traffic in the waters.

The ocean houses its own fragile ecosystem. One choice can alter the makeup of the ocean and cause imbalance to the delicate cycle of life.

According to National Oceanic and Atmospheric Administration (NOAA): “Abalone play an important ecological

role in marine ecosystems by helping to stabilize kelp forests and rocky reefs.

Unfortunately, the decline in abalone populations has drastically altered these marine habitats—a phenomenon scientists have witnessed across the West Coast.”

Poaching laws exist for a reason; going against those laws can interfere with years of scientific research and action to improve the ocean’s environment — or any ecosystem, for that matter. Not to mention, poaching can lead to additional problems such as funding criminal agendas, endangering local economies and harming tourism.

The attack of the purple sea urchins & examples of harm to local ecosystems Up north, the purple sea urchin population has exploded and, in a few short years, almost completely depleted the seaweed reefs. One reason this has happened is because hunters of the urchins, such as otters, have become endangered. In an article by NOAA, it was also stated that black abalone on California’s coast once kept the urchins in check. Due to the decline in abalone, this has additionally contributed to the destruction of the kelp forests.

NOAA states: “In an urchin barren, poor water quality from coastal degradation, lack of predators, and the absence of key species, like abalone, all contribute to uncontrolled population growth. The urchins begin moving away from cracks and crevices where they normally live and search for any kelp or algae in their path, eventually destroying kelp forest areas.”

There are several other examples of how a slight change to the environment can result in cases like this, for instance the introduction of non-native animals to Catalina Island or the illegal fishing practices that have completely destroyed the critically endangered vaquita porpoise’s population.

While a single poaching case may not seem like a big deal, the repeated cycle can cause lasting and dangerous effects to the natural world.

The third-ever Newport Beach Harbor Commission boat meeting tour will take place on Nov. 17. Attendees will meet commission members at Marina Park. Commissioners will meet in a community room first before boarding a barge to tour the harbor.

NEWPORT BEACH — The Newport Beach Harbor Commission appears to have established a pattern of hosting its even-year November meetings on the water.

Commissioners will meet at Marina Park on Saturday, Nov. 17. The general meeting, which is open to the public, will begin inside the second floor event room at 8:30 a.m. The meeting will continue with a boat tour around Newport Beach Harbor; the tour will take place aboard a Balboa Island ferry, rain or shine.

“The purpose of this Special Meeting is to build familiarity with the topics, terminology and geography frequently reviewed by the Harbor Commission, build rapport between the public and the commissioners, and identify additional areas of concern in the harbor,” city staff said about the meeting and boat tour.

“The tour route will cover approximately 6.7 nautical miles and topics covered along the way will include the current Harbor Commission objectives, city code enforcement efforts, stand up paddleboard safety, Title 17 updates,

dredging solutions, and much more,” city staff continued. “The commissioners will discuss the various waypoints along the route and there will be ample opportunity for public participants to ask questions during the tour.”

Meeting on the water every other year is starting to be a trend for the Harbor Commission. Similar Harbor Commission meetings were held in 2014 (Nov. 15) and 2016 (Nov. 19). Several dozen people attended the 2014 boat tour meeting, where commissioners discussed issues such as eelgrass mitigation, boat launch ramps, waterbus service, public anchorages, harbor speed limit, development of the Lower Castaways and water-propelled vessels.

The 2016 boat tour meeting addressed safe navigation standards, derelict vessels and establishment of the Turning Basin anchorage. Dredging, eelgrass, revitalization and sea lions were also on the agenda.

The boat tour will be two hours in length, with no stops once it leaves Marina Park. There are no facilities or services on board. Bottled water, coffee and light snacks will be available. The tour, due to the ferry’s limited capacity, will be available to the public on a firstcome, first-served basis.

Harbor commissioners meet once per month at Newport Beach City Hall.

said many sportfishing vessels have AIS installed but turn them off in order to keep their locations secret.

“Most, if not all sportys turn their units off, gotta keep their locations secret. That shit needs to change,” Charlie Gordon wrote on Bloody Decks.

What role human error played in this incident probably won’t be known until investigation of this collision is completed.

An AIS Class A device is required for any self-propelled vessel, measuring 65 feet or longer, engaged in a commercial service. Prowler measured 65 feet in length and, with more than one dozen passengers aboard for sportfishing, was engaged in commercial activity.

Someone launched a GoFundMe page for Capt. Andrew Viola, in response to the collision; Prowler was helmed by Viola.

“Due to a recent accident at sea a dear friend lost his boat. Let’s show our love for a great man and family in these tough times,” the fundraiser’s creator said on the GoFundMe page.

The campaign, which had a goal of $50,000, raised $43,601 as of Nov. 8.

Situational awareness is critical.

Always be aware of any other vessels or hazards around you and give them a wide berth. Remember the phrase “steady bearing, closing range” – if you see that you’re on a collision course with another vessel, adjust your course, whether you’re the give-way or stand-by vessel. Change your bearing significantly, make a U-turn or come to a dead stop to prevent a collision. Don’t stand on your “rights” – it’s always better to give way than collide, even if you have

SAN DIEGO — Despite much speculation, no one yet knows what really happened when Dennis Washington’s 332-foot megayacht Attessa IV collided with the 65-foot wooden charter fishing vessel Prowler the night of Friday, Oct. 26, about 9 miles off the coast of Imperial Beach near the international border.

San Diego Maritime Museum introduces new interactive pirate adventure, Boarded!

SAN DIEGO — No historical figures continues to keep audiences in awe quite like pirates.

From fictional portrayals like Capt. Jack Sparrow to legends of famed buccaneers like Black Beard, Anne Bonny and William Kidd, children and adults alike have long been curious about what pirate life was like. The new pirate-centric production Boarded!

by San Diego Maritime Museum, however, offers an entertaining and educational opportunity to interact with pirates for a day.

CATALINA ISLAND — Catalina Island’s airport, known as “Airport in the Sky,” has been in the news lately, as the U.S. Marine Corps prepares to repair the aging runway as a training exercise.

Those who are not too familiar with Catalina’s history and layout may not be aware of the airport’s own unique story. Airport in the Sky, another one of the island’s hidden treasures, is still active today and offers an array of activities, but how it began is truly an interesting part of the island’s beginnings.

The original airport hangar was actually created to operate in cooperation with Wilmington-Catalina Airline, Ltd. and was built on Hamilton Beach in the 1940s. Imagine if Hamilton Beach, one of the busiest tourist locations in Avalon, had remained an airplane landing area. Builders too must have also recognized this dilemma and carefully took the hangar apart, relocating it to the current location where

Airport in the Sky, hangar and all, still stands today.

Philip K. Wrigley, whose part in creating the Catalina Island many folks know today, was largely responsible for the construction of Airport in the Sky. The hangar, which can hold several large planes, also held Wrigley’s DC-3 when he visited the island. Airport in the Sky officially opened on June 27, 1946 and offered cross-channel flights through United Airlines, another partner with Wrigley who had been working for many years to offer flights to the island.

One feature of Airport in the Sky that attracted visitors was the patio near the airport’s iconic administration building – to this day, travelers can still enjoy lunch, such as a buffalo burger or notoriously famous cookies, at this location.

When the flights were introduced, United Airlines offered 10 flights a day (13 on Fridays, Saturdays and Sundays) at the price of $5.50 per individual for round trip. Born and raised islander, Hugh T. “Bud” Smith, who eventually

DANA POINT — If omens are to go by, then the unusually hot autumn day in Dana Point on Nov. 2 beaconed a bright future for the master ground lease signed between 5th District Supervisor Lisa Bartlett (on behalf of Orange County) and the developers known as Dana Point Harbor Partners (DPHP).

The agreement, using a term likely to be permanently imprinted into the minds of those close to the matter, has been more than 20 years in the making and will last for the next 66 years.

Developers and county leaders were all on hand during a Nov. 2 press conference to commemorate the lease signing. With the sun beating down on a diplomat-studded audience outside of Dana Point Harbor’s Coffee Importers, there was a fair turnout of people and an overall sunny atmosphere as the waterfront’s impending fate was signed and sealed. The sun even prompted one of DPHP, Bryon Ward of Burnham-Ward Properties, to comment: “If I’m sweating, it’s not because I’m nervous but because I’m enjoying the California sun.”

In truth, there is a little to be nervous about as the lease guides the $330 million project: Though a landmark moment for Dana Point residents, business owners and local politicians, this lease agreement is just the beginning of a long process to construct a unique harbor and landside project. The county of Orange, up until recently, has been quiet about the project, but has offered documentation the public can access on Dana Point Harbor Advisory Board’s official website.

The Partners: Completely ReImagining Dana Point Harbor DPHP, for those who have not been glued to the proceedings, is made up of four people: Bryon Ward and Scott Burnham of Newport-Beachbased real estate development company Burnham Ward Properties; Joe Uebberroth of Belwether Financial and Bellingham Marine (fun fact: Uebberoth is also one-time baseball commissioner and businessman Peter Uebberoth’s son); and R. D. Olsen, who has most recently constructed luxury hotels such as Lido House in Newport and Pasea in Huntington Beach.

To be clear, all of the partners are local to Orange County and have good reputations in the community. Each developer, during the lease-signing ceremony, did appeal to the ethos of

Dana Point locals and offered up their own stories of visiting the harbor during childhood or with their families.

According to DPHP, this harbor is a being designed to stand the tests of time for 100 years or more.

Of course, the first steps are decidedly working with the commercial core and erecting the parking structure. Lenthall also touched on PDI project management and that the permits were still good, and while revitalization may take the larger half of six to seven years, it may be for the better good of the community.

Donna Kalez, general manager of Dana Wharf Sportsfishing and member of DPHAB, spoke with The Log about the process of selecting tenants for the commercial core. Some tenants are currently on a month-to-month lease, while others will renew their leases in 2020.

Kalez, however, was optimistic and stated, “We trust the process,” and noted that finally many residents, whether business owners or not, could envision a newly revitalized harbor in the future.

Holiday Cup Regatta welcomes winter festivities at Lido Isle Yacht Club Sailors will have the chance to race sabots, lasers, CFJ vessels and more in this annual race, held Dec. 16.

By Devon Warren-Kachelein NEWPORT BEACH — Lido Isle Yacht Club (LIYC) will host the 2018 Holiday Cup Regatta, a chance for Sabot C3-A, Laser and CFJ class sailors to participate in a festive arena. The regatta will be held on Sun., Dec. 16 and will surely welcome holiday cheer from competitive boaters.

Eligible boats can enter the race by submitting a form and entry fee at the website liyc.net; the deadline to enter the regatta is Dec. 15 by 5 p.m., although participants can still register with a late payment of $10.

Entry fees are $15 for sabot and laser racers and $20 to enter a CFJ vessel; all entry fees are non-refundable according to the Notice of Race (NOR). Additionally, the NOR states that additional vessels may be eligible to participate if a writer letter of request is approved by LIYC Sailing Director.

In-person entries will also be accepted on the day of the race.

Prior to the first warning signal being fired off at 11 a.m., check-in meetings will be held from 9:30-10:30 a.m. and a competitor’s meeting will take place at 10:30 a.m., just short of the race beginning. Check-in is mandatory for all competitors. Sailing instructions will be discussed at check-in and follow the Racing Rules of Sailing by the International Naples-Sabot Association.

Lunch can be purchased in advance; orders must be placed by Wed., Dec. 12. Options include a turkey sandwich, hamburger, hot dog, peanut butter and jelly sandwich or chicken tenders. Each entrée is served with chips, cookie and

a drink. The snack bar will also be open during the holiday regatta.

Racing events will take place in the Lido Channel or harbor east of LIYC’s dock. Street parking for the regatta is available, but the club requests that participants do not park in front of residents’ garages or in red zones.

Trophies will be announced immediately after the races are completed.

SANTA BARBARA — Santa Barbara Yacht Club (SBYC) will deck the docks with holiday racers during the annual Holiday Regatta, the final installment of SBYC’s Challenge Cup Series. This annual sailing event will span over the weekend of Dec. 1-2, and will be open all fleets including Performance Handicap Racing Fleets (PHRF) and one design vessels.

Sailors can check-in at the front desk of the Santa Barbara Yacht Club before the event. According to the

Notice of Race (NOR), the race will start within two miles of the Santa Barbara Harbor entrance. A copy of the course chart can be accessed on SBYC’s official website.

Out-of-town participants in the regatta are offered free first-comefirst-served berthing. Those who are interested can contact frontdesk@sbyc. org. Reservations are required in order to secure a spot.

For each regatta, there will be prizes awarded to the top participants. Winners of the series will have their names engraved onto the SBYC Challenge Cup. There will also be some celebratory activities after the sailing events are completed held at Santa Barbara Yacht Club.

American Sailing Association raises $41,000+ for Hands Across America campaign Fundraising efforts reach $180,000 overall; money will support educational initiatives in Eastern Caribbean.

LOS ANGELES — The American Sailing Association, or ASA, announced it raised $41,379 in its most recent fundraising campaign to benefit Hands Across the Sea. The fundraiser, which has been in effect for seven years, has raised about $180,000 overall, all benefiting Hands Across America. The nonprofit organization specifically works to raise literacy levels of children across the Eastern Caribbean.

People donated money to ASA throughout September and October 2018 by watching a one-minute video about Hands Across the Sea. The video was available on ASA’s website.

Viewers, at the end of the one-minute video, were given the option to donate to Hands Across the Sea. Each donor was entered into the sweepstakes for a chance to win the grand prize of a weeklong sailing charter in St. Vincent and the Grenadines (courtesy of Horizon Yacht Charters and valued at $3,000), as well as chances to win a weeklong vacation at The Verandah Resort & Spa in Antigua or the St. James’s Club Morgan Bay Resort & Spa in Saint Lucia (courtesy of Elite Island Resorts and valued at $900 each).

majority of our members express an interest in sailing the waters that surround the islands that benefit from the work of Hands Across the Sea. Thus, it is our responsibility to help.”

Hands Across the Sea donates books from education publishers Scholastic, Penguin and Capstone, and Caribbean imprints such as Macmillan Caribbean and Editorial Campana Books. The charity, since its founding 11 years ago, has expanded its services to also providing teacher professional devel-

opment and student librarian training to Eastern Caribbean schools.

ASA has been the leader in U.S. sailing education for 35 years and has grown to include an international network of more than 350 professionally accredited sailing schools. More than one million certifications have been awarded to 500,000-plus people who have been introduced to sailing through ASA schools, clubs and programs since 1983.

Young angler wins fishing kayak at No Motor Tournament Angling event in Carpinteria returns to benefit local salt marsh.

CARPINTERIA — A large turnout of youth anglers showed up at this year’s No Motor Tournament, all of them joining their adult counterparts in dropping lines in the water to benefit work at the Carpinteria Salt Marsh.

Organizers estimated 60 anglers were on hand for the fundraising event, which was held to support The Land Trust of Santa Barbara County.

Elijah Gonzalez, a 10-year-old angler from Oxnard, won the event’s grand prize raffle, which was a fishing kayak.

Jeff Gallup earned first place honors at the No Motor Tournament, finishing with 137 total inches of fish. Rounding out the top three were Jim Rainer (92 total inches of fish) and Cory Wells (83 total inches).

The 9th annual No Motor Fishing Tournament, organized by The Sportfishing Conservancy, was held Nov. 3. Exact details of how much money was raised was not yet available as of press time.

All participants must either surf fish or drop a line in the water while navigating aboard a kayak, float tube or standup paddleboard.

SACRAMENTO — California’s Department of Fish and Wildlife (DFW) is accepting grant applications for those offering fishing activities, classes or programs benefiting Hispanic communities. The activity, class or program must educate or engage Hispanic communities in fishing.

The grants are part of the DFW’s larger efforts to increase fishing participation.

Programs must be ethnically inclusive, family-focused and metro-centric to be eligible for the grants.

“While a majority of participating families will be Hispanic, the event will

be open to families of all races/ ethnicities,” DFW staff stated in an announcement about the current grant application period. “[Programs must] encourage participation across multiple generations and genders ... [and] encourage focus in metro areas.”

The program seeking funding must also be focused on providing “multiple opportunities for the same audience to participate in fishing” and “promote good stewardship toward the state’s aquatic resources.”

Grant funding is made possible through the George H.W. Bush Vamos A Pescar Education Fund.

Nonprofit (specifically 501 (c) State officials are now accepting grant applications for fishing programs, specifically those benefiting Hispanic communities. Grants are awarded to increase fishing participation in California, be it through youth or other groups.

ESCONDIDO — San Diego’s freshwater anglers have their eyes on Escondido’s Dixon Lake, where 4.500 pounds of rainbow trout were stocked as of Nov. 14. The trout were stocked from Calaveras Trout Farm.

Dixon Lake will be hosting its 40th annual Dixon Lake Trout Derby, Nov. 30

to Dec. 2. It’s the first trout plant of the season for Dixon Lake.

Also receiving rainbow trout plants in November are Lake Jennnings (2,500 pounds, Nov. 12, season opener), Santee Lakes (1,000 pounds, Nov. 16) and Lake Cuyamaca (1,200 pounds, Nov. 20). Lake Jennings (1,500 pounds, Nov. 26) and Santee Lakes (1,000 pounds, Nov. 30) are stocked twice.

Anglers do not need a state fishing license to drop a line at Dixon Lake. A daily permit from the lake, however, must be purchased.

Dixon Lake is open daily, except for Christmas Day.

Tuna season rolls into mid-November

By Bob Vanian Dropoff at Point Loma, the Green Tank, Point Loma College, the upper end of La Jolla, Del Mar, Ponto Beach, the Carlsbad Canyon, the Buccaneer Pipeline and the area outside of the Oceanside Pier.

Some of the bonito have been biting while fishing along the edges of the kelp beds or next to structure but the majority were caught by getting trolling strikes out in the deeper 18 to 50 fathom depths. Feathers and Rapalas have been productive on the troll and once bonito are located, flylined sardines and small chrome Megabait style jigs have been working while drifting or anchored.

I hope you keep on fishing our local offshore waters until the warm water pelagic tuna, marlin and dorado actually leave for the winter. We have recently seen some of the best fishing of the year during a time of year often not associated with catching the warm water pelagic species. I hope you have a chance to get out on the water and participate in this late season action! Keep on fishing and I hope to see you out on the water!

SAN DIEGO — The 2018 Southern California offshore fishing season keeps marching right along as we are in the middle of November. We still have bluefin tuna, yellowfin tuna, striped marlin, skipjack, yellowtail and Dorado biting offshore. A lack of northern weather systems has allowed offshore water temperatures to remain relatively warm in the 66.5- to 68.5-degree range.

Plenty of fish have been content to stay in these water temperatures.

Bluefin tuna were biting very well on Nov. 10 and 11, with lot of sportboats and some private boats catching their respective limits of bluefin tuna. The best bluefin fishing has been at the Cortes Bank and areas to the north and to the east of Bishop Rock.

Bluefin have ranged in size from 20 to 300+ pounds and have been biting on flylined sardines, live squid, flying fish and Flat Fall jigs. Most of the action has come from drifting over meter marks, sonar marks or spots of breaking fish.

Capt. Ron Bowers of Salt Fever, a private boater, fished a recent extended weekend trip to the Cortes Bank and reported finding excellent bluefin fishing. The trip yielded 30 bluefin, a mixed size fish from 20 to 63 pounds. Most were up in the 50to 63-pound range. Bowers said they tried using flylined sardines, weighted sardines and Flat Fall jigs and said all their bluefin were caught while using flylined sardines. On the first day of their trip, Bowers reported getting a stop from a sonar mark he found in the early morning in the dark.

The fish came around the boat and stayed with them all day long and into the next night.

Private boater Tom Golding of Last Buck fished for bluefin at the Cortes Bank on Nov. 10 and reported a fantastic trip with the four anglers aboard catching their limits of bluefin tuna as well as catching and releasing an additional five bluefin.

Golding said four of their bluefin were in the 60- to 70-pound range and the rest were in the 25- to 30-pound class. They caught their bluefin by drifting in an area where they were getting meter marks and

would see spots of breaking fish.

Capt. Bob Woodard of Christina Lynn fished a long-range trip aboard Spirit of Adventure out of H&M Landing that returned to San Diego on Nov. 7.
