Mysterious, unclaimed wave glider washes ashore

By LINDSEY GLASGOW SCOTLAND —The Isle of Tiree Coastguard Rescue Team has been looking for the owner of a mysterious vessel that washed ashore on a Scottish island. The vessel was reported to the coastguard team on Sept. 28. The craft, a dark grey color and covered in solar panels and antennae, was reportedly found wedged in between a few rocks on the Isle of Tiree off the west coast of mainland Scotland.

“We are currently trying to find out some more information as to the objects origin and owner,” HM Coastguard Rescue Team Isle of Tiree wrote in a Sept. 28 Facebook post. “If anyone has any information please get in touch.”

People in the comment section of the post were quick to identify the vessel as an autonomous wave glider. These vessels gather ocean data using energy from the waves and solar panels and are used by research agencies across the globe.

“That is a Liquid Robotics wave glider, as all the UK science ones I’m aware of are bright yel-

low I would say it’s likely travelled a long way from home (which they are usually perfectly capable of doing),” one commenter, who said he worked for National Oceanography Centre, wrote in response to the post.

Wave gliders made by the U.S. company Liquid Robotics are capable of traveling thousands of miles and are used by both the U.S. Navy and Britain’s Royal Navy as well as other government agencies and scientific researchers.

There were no navigation lights or a radar reflector on the vessel, creating some speculation online about it operating covertly.

So far, no word on the vessel’s owner and what they were doing with the wave glider.

This is not the first time something like this has happened. A similar craft, in much worse condition, washed up on a beach less than a hundred miles away in Northern Ireland in September 2019. This one was also grey and was a bare hull with antennas and other attachments broken off.

There was no follow up as to whether that vessel’s owner had been located.

Since then 5 lawsuits were filed that have cost Redondo Beach millions to defend. One has to wonder why our city attorney was not more forthcoming and urged the council to just wait when he does so on just about every other topic.

Father Crespi arrives in San Diego Bay and Santa Barbara Harbor

By PARIMAL M. ROHIT S A C R A M E N T O —Lost amidst the C oronav ir us pa ndemic was a landmark “birthday” for the California Fish and Game Commission, which happens to be one of the state’s oldest agencies.

The Fish and Game Commission turned 150 on April 6. The commission was born in April 1850 as the California Board of

Fish Commissioners. California, interestingly enough, became a state on Sept. 9, 1850 – more than five months after the commission was created.

State historians said California already had several fish and game laws in place, courtesy of the Mexican and Spanish regimes in place in the years leading up to California’s transfer to the United States.

The first fish and game law with California being a state was

enacted in 1851 and regulated oysters. Laws about salmon, waterfowl and other wildlife were adopted in 1852.

The latter years of the 1800s saw the establishment of deputies (1871) and the Bureau of Patrol and Law Enforcement (1883).

A separate Fish and Game Code was established in 1993; fish and game laws were governed by the Penal Code up to this point in history.

When did the agency finally change its name and become the California Fish and Game Commission? That happened in 1909. The commission’s membership was expanded from three to five in 1937.

Sportfishing and hunting regulation became part of the commission’s core responsibilities in 1945.

news briefs NATION/WORLD NMMA cancels nine 2021 winter boat shows CHICAGO, ILLINOIS—The National Marine Manufacturers Association on Oct. 29 announced nine of its boat shows have been canceled for Winter 2021, leaving two proceeding as scheduled and one postponed.

NMMA said following a thorough market-by-market analysis regarding the feasibility of producing safe and successful winter events, they decided to cancel nine shows in the first quarter of 2021 and plan to move forward with three shows.

“These decisions are in the best interest of our consumers, staff, members, and industry and are the result of months-long conversations with exhibitors, health officials, venue opera-

tors, and other stakeholders on producing safe, successful, and high-quality consumer experiences,” said NMMA president Frank Hugelmeyer in a released statement. “We plan to resume our full show schedule starting in September 2021.”

The two shows proceeding as scheduled are the Progressive Insurance Atlantic City Boat Show, scheduled for Feb. 24-28 , with the option to delay the show to early April 2021 and the Progressive Insurance Northwest Sportshow scheduled for March 25-28.

NMMA said it is working with the Boston Exhibition and Convention Center to obtain dates later in the first quarter or early in the second quarter to reschedule the Progressive Insurance New England Boat Show..

For the three shows currently proceeding as scheduled

or postponed to the spring, plans will be guided by NMMA’s ‘health and safety first’ principle and are subject to change.

NMMA said it will continue to closely monitor the situation in each market and work with federal, state, and local authorities on those events.

Probate, Taxes and Selling a Boat

QUESTION:

I have a documented boat with some title problems. The boat was owned by my father who passed away last year. To complicate things, I have learned that he purchased the boat without paying sales or use tax, and the California State Board of Equalization recorded a Notice of Claim of Lien with the Coast Guard against the boat’s title. We would like to sell the boat, but I don’t know if I can sign a bill of sale on behalf of my deceased father, and I am concerned about how prospective buyers will react when they learn about the recorded tax lien. What can I do?

ANSWER: Our reader is confronted with two problems, one of which is relatively easy to solve. The other is not. We will start with the simpler of the two problems.

disposal to transfer property owned by the deceased. The initial problem is that the deceased person is not available to sign a bill of sale, so we must find a way to authorize his or her heirs to sign the paperwork used to transfer the property. The most basic procedure is to probate the estate.

All good things come to an end. Here’s to the end of one chapter – and the beginning of another.

hat a year 2020 has been, eh?

We’re in the final few weeks of the year, and we’re all rooting for this pandemic to be over so we can return to some sort of normal life.

The Coronavirus pandemic hasn’t been easy on us at The Log, as we’ve had to make several adjustments as each week brought on a new set of challenges.

Yet another adjustment is in store, as this is my final issue as editor of The Log. Thank you, readers, for allowing me to come aboard your boat every other week.

It’s been an honor curating issues for you twice a month, 26 times a year.

I’ve been with The Log for nearly 75 months – that’s 6 years and 3 months. In that time, I’ve been a part of almost 160 issues – most of them as editor. The Log looks much different today than it did when I agreed to come aboard the publication in August 2014. The front page’s format has been re-designed twice. We’ve added numerous sections, such as Standing Watch, Fast Facts, Blips on the Radar and Historical Photo. Other sections, such as Dock Lines and Nautical Banter, have come and went. Our maritime attorney column came, went, and came back.

We’ve published breaking news, infographics, investigative reports, policy updates, human interest stories and everything else in between. I’d like to believe The Log became the go-to publication for all things nautical in Southern and Baja California. I truly hope you’ve enjoyed reading every issue of The Log during my time here, both as a reporter (August 2014- September 2016) and editor (October 2016 to November 2020).

I’ve grown so much – professionally and personally – during my six-plus years here at The Log. I arrived here in the summer of 2014 knowing the basics about maritime. By no stretch of the imagination could I have been considered an expert or a go-to source for boating or fishing issues. Alas, the learning curve was steep, and I was up for the challenge.

I can now say, with 100 percent confidence, The Log has prepared me for my new adventures. This publication’s sto-

ries taught me how to report in a way I wouldn’t have learned anywhere else – I had to overcome my initial lack of knowledge to prove to you, our loyal readers, I was a worthy and respectable source of information. Please know I took my responsibility to you seriously, every single day. I would not have grown the way I did without you, so a heartfelt and sincere thank you, to every single one of you.

So, what’s next, you’re probably wondering? For me, I am moving to Austin, Texas, where I will be joining the Austin Business Journal. I’ll be covering commercial real estate, which is the publication’s largest and most consequential beat.

You’re probably also wondering what’s next for The Log. My successor has not yet been announced, so I am unsure as to who will be guiding The Log into the future. I have no doubt, however, the next person in the editor’s chair will grab the bull by the horns and elevate The Log to new heights.

It’s been a great ride. I couldn’t have imagined by tenure here at The Log would turn out to be as fulfilling as it turned out.

I thoroughly enjoyed writing every single story I published in the paper. The people who I worked with were of high character, each one a worthy teammate. The 10 awards I won at the San Diego Press Club on behalf of The Log is not a testament of my talents, but instead an acknowledgement of our amazing readers and special employees. It was truly a team effort to make The Log the best publication in Southern California.

The Log is on the verge of celebrating its 50th birthday in 2021, and I am saddened I won’t be around to celebrate. But the publication is in great hands and will continue to be a go-to source for Southern California’s boaters and anglers.

Thank you, again, for making these past six years so memorable. I’ll never forget my time here. I hope we cross paths again in the future.

“We took a calculated risk this year, making the decision to delay the creation of our educational programming to help us ensure that our courses meet the needs of the evolving market place,” MRAA President Matt Gruhn said in a released statement. “We saw our normal early-registration curve pushed back by the uncertainty the pandemic caused, but we have believed all along that, with the move to an online environment, followed quickly by the announcement of a powerful educational line-up, the dealers would find great value in the event. And that’s exactly what we have seen happen.”

Throughout June, July and August, registration numbers totaled only 35.

The annual conference of the MRAA, Dealer Week offers insights, ideas and inspiration for dealers to use as they begin preparing for 2021. It features nearly 30 individual sessions on topics such as boat shows, digital marketing, pre-owned boats, the customer experience and service department opportunities. New $53 million grant to create a world-wide fleet of robotic floats to monitor ocean health WASHINGTON, D.C.—On Oct. 29, the National Science Foundation (NSF) approved a $53 million grant to a consortium of the country’s top ocean-research institutions to build a global network of chemical and biological sensors that will monitor ocean health.

Scientists at the Monterey Bay Aquarium Research Institute (MBARI), University of Washington, Scripps Institution of Oceanography at UC San Diego, Woods Hole Oceanographic Institution, and Princeton University will use this grant to build and deploy 500 robotic ocean-monitoring floats around the globe.

This new network of floats, called the Global Ocean Biogeochemistry Array (GO-BGC Array), will collect observations of ocean chemistry and biology between the surface and a depth of 2,000 meters (6,560 feet). Data streaming from the float array will be made freely available within a day of being collected, and will be used by scores of researchers, educators, and policy makers around the world.

These data will allow scientists to pursue fundamental questions about ocean ecosystems, observe ecosystem health and productivity, and monitor the elemental cycles of carbon, oxygen, and nitrogen in the ocean through all seasons of the year. The data will be used improve computer models of ocean fisheries and climate, and to monitor and forecast the effects of ocean warming and ocean acidification on sea life.

LOCAL Dana Wharf’s 13th annual Halibut Derby opens DANA POINT—Dana Wharf’s 13th annual

Halibut Derby kicked off Nov. 1, encouraging anglers to participant for the chance to win prize money for topping the scales on halibut catches. The Derby runs from Nov. 1 to March 31.

Anglers can enter the contest by participating in the Halibut Drift Days, which take place Fridays and Sundays from 7 a.m. to 4 p.m. or enter on any open party half or three-quarter-day trip. So far, a 4-pound 12-ounce catch on Nov. 1 tops the leader board.

Anglers who catch the heaviest five halibut by March 31 will earn prize money, with first place taking home $1,500. The top 25 catches earn entry into a free fish-off drift trip in April, with the top angler on that trip earning an additional $500 prize. Additional prizes will also be awarded. Aquarium of the Pacific relaunches animal encounters LONG BEACH—With new Covid safety measures in place, the Aquarium of the Pacific in Long Beach has opened two animal encounter programs one with sharks and rays and the other with seals and sea lions.

The Shark and Ray Encounter is a private twenty-five to thirty-minute session where participants will get to feed the sharks and step into the touch pools to interact with the rays while learning about the animals with the aquarium’s staff. This encounter is offered Thursdays and Fridays at 8:30 a.m.

The Seal and Sea Lion Encounter is thirty-minute behind-the-scenes look at the Seals and Sea Lions Habitat. This encounter offers the opportunity to learn from the Aquarium’s staff members about how they care for these animals.

Participants also get the chance to offer the seal or sea lion their afternoon meal.

This encounter is offered Tuesdays, Wednesdays, and Thursdays at 1 p.m.

For both encounter experiences, participants must be age 7 or older. Those under age 16 must be accompanied by a paid adult. Encounters require a minimum of two people and a maximum of four, all from the same household, to participate.

for the moorings, dealing with weather changes, keeping boaters safe, addressing the budget and maintaining patrol boats and docks, a day’s work on Avalon Harbor is never really complete.

“You caught me at a good time,” Interim Harbor Master Orne Carstarphen said answering his phone on a Thursday afternoon. “I just came back for lunch.

We’ve been trying to get a boat in the water.”

30. Carstarphen will perform the duties of the harbor master until the city decides who will serve in the position going

forward.

“I feel pretty honored to be in this position,” Carstarphen said. “It’s your hometown, you’re honored to be able to work in any position serving your community.”

Carstarphen started working for the Avalon Harbor Department in 1991 as a part-time harbor patrol assistant. He moved up the ranks, joining the department as a full-time harbor patrol officer in 1997. He later was promoted to supervisor, where he served as the captain of rescue boat two and was responsible for training for the department. In 2017, he became assistant harbormaster.

“The idea of working on the ocean was obviously a lure,” Carstarphen said.

Carstarphen was exposed to the boating industry at a young age and grew up on the ocean. His parents, Jack and Ruth Carstarphen, ran a charter boat, Maverick, in the Caribbean in the 1960s and 1970s. His uncle also ran a charter operation out of Los Angeles Harbor, Resolute Sailing, which still runs to this day.

“I’m very comfortable working on the ocean,” Carstarphen said.

His parents moved to Avalon from the Caribbean in 1973, when Carstarphen was in the third grade. His parents had previously been liveaboards in Avalon Harbor, after World War II in the late 1940s. Carstarphen himself would later also be a liveaboard in Avalon Harbor on 36-foot monk trawler in the mid-1980s.

NEW PARKING GATES LOWERED IN DANA POINT HARBOR BOATER LOTS

New parking gates are lowered in Dana Point Harbor, bringing a new parking system for boaters and shared tenants.

New system brings changes for entering and guest reservation processes for slip tenants and a new parking fee for non-boater tenants and businesses inside the lots.

By LINDSEY GLASGOW DANA POINT—New parking kiosks and gates at the five boater parking lots in Dana Point Harbor have been activated, bringing new processes for slip tenants.

Parking remains free for boaters and guests remain unlimited, but non-boaters and businesses located in the lots will have to pay if they want to park.

New control gates for the lots were officially lowered on Nov. 2 and attendants were on hand the first week to help boaters adjust to the new system. The gates were originally slated to go live in April, with an event planned to help boaters get set up, but the event was canceled and the roll-out was delayed due to Covid19. Longtime Dana Point Harbor boater Hunter Brown said the delay left the parking lots unsecured for the past seven months, raising some security concerns for his boat.

“It’s been a little bit of a bumpy start to the whole thing,” Brown said.

Instead of flashing a key fob to get into the lot, slip tenants now use a windshield sticker or a mobile phone app to lift the arm of the gate. There is also a new process for getting a guest pass, instead of going to the marina office to get a paper

to display on the guest’s car dashboard, tenants must make reservations for their guests through the Park Mobile website.

Tenants will then be able to email or text a pass to their guest for them to flash at the entry kiosk.

The parking gate replacement was one of the first revitalization efforts made by Dana Point Harbor Partners, the collaboration created to operate and redevelop the harbor.

“We had a gate system that was about 20 years old and worked about half the time at best,” said Ralph Grippo, Principal at Bellwether Financial Group, which is part of Dana Point Harbor Partners and in charge of guiding marina operations.

While parking remains free for boaters, tenants who share the parking lot, such as Dana West Yacht Club, several yacht brokers, Aventura Sailing Association and a few other businesses, will now have to pay a monthly fee if they want parking inside those lots.

About one-fourth of the members of Dana West Yacht Club don’t own boats but use the parking lot for various club events.

“We’ve implemented a $25 fee for

those that may, those tenants that may require, request - and it’s on a limited basis – parking for their employees and themselves,” Grippo said.

Grippo said the fee is aimed at protecting boater parking, going on to say he felt the fee would deter people from using the lot that have been but shouldn’t have been.

“Since the new parking management system was announced earlier this year, your DPBA board has spent many hours analyzing the plan and surveying our boaters,” Dana Point Boaters Association said in an Oct. 29 eNewsletter. “We have been generally supportive of the plan as a means to protect dedicated boater parking from unauthorized and excessive shared use by non-boaters.”

A non-boater harbor stakeholder who

wanted to remain anonymous, said he felt the fee was lousy and was more about money than protecting boater parking.

“It’s a change and any change is difficult,” said Grippo.

Brown felt there seemed to be a lot of issues associated with the change.

He said a second entry and exit was removed from the east basin lot on Dana Island, leaving just one way in and out.

The lot is shared with Aventura Sailing, which hosts weddings, parities and other events. He said was worried about traffic and more people using the lots especially during the holidays and boat parade.

“You could have 100 cars coming in at the end of the party all those cars have to go back through the parking gate, one parking gate,” Brown said.

where a valid will was prepared, the executor will not automatically have the authority to sign papers unless and until that authorization is granted by a probate court. A probate is therefore necessary for all property transfers after death, unless some exception is available.

The most common exception to probate is probably where property is held by a revocable family trust. This requires some planning while the boat owner is still alive, and frankly it is something we all should look into. Unfortunately, it is not an option for our reader because the boat was in his father’s name without a trust. He may, however, qualify for a statutory exemption.

Where property is held by an individual, California law allows for transfer without probate if the total value of all the transferred property does not exceed $166,250.00. This limit is calculated on the value of the entire estate, not just a single asset such as a boat. Under the procedures set forth in California Probate Code sections 13100 through 13116, the heirs of the deceased person may prepare an affidavit which describes the property and their relationship to the deceased.

The affidavit may then be delivered to the Coast Guard with a Bill of Sale to transfer a documented vessel. If the value of his father’s property exceeds the limit, our reader may need to take steps to probate the estate.

Assuming he qualifies for a probate exemption, our reader still needs to deal with the tax lien. The California Department of Tax and Fee Administration (the “CDTFA” – formerly the California Board of Equalization) administers the assessment and collection of sales and use tax on the sale and purchase of personal property in California. They have the power to seize and sell any property owned by a delinquent taxpayer. To facilitate this process, and to get the attention of the taxpayer prior to seizing a documented vessel, they will sometimes record a Notice of Claim of Lien with the Coast Guard. This is an unfortunate practice, because a tax lien relating to personal property is a personal obligation of the individual taxpayer, and a subsequent owner of a boat cannot be held responsible for payment.

Maritime lien law provides that the vessel and the owner are both responsible for payment of goods and services used to equip, maintain, and operate the vessel. The vessel itself may therefore be held responsible for payment regardless of who owns the boat, and a valid maritime lien will remain with that boat until the claim is satisfied. A tax lien, however, is not related to the operation of a vessel. It is therefore not a maritime lien and the vessel itself is not responsible for payment of the obligation. The taxpayer will remain personally liable for the obligation after he or she sells the boat, and the tax agency must look to the taxpayer’s other property for payment. But the new owner is not responsible for the obligation.

The limitations of a tax claim against a boat or other personal property are

also reflected in California law, so we don’t need to rely upon maritime law for this. California Government Code section 7170(c)(4)(B) provides that a state tax lien is not valid as to personal property against a subsequent owner, even a prior notice of the lien was filed.

A claim for unpaid taxes therefore should not be recorded against the boat’s Coast Guard title. Unfortunately, the Coast Guard will allow practically anything to be recorded against the title of a vessel, without investigation or proof that the instrument supports a valid claim.

This is a significant problem with the recording system, but for reasons we will address in a future installment of this column the system is not likely to change anytime soon.

The claim of lien, whether it is valid or not, will be a problem for a subsequent owner, since any claim that is recorded with the Coast Guard will complicate any vessel financing or a future sale. Our reader should therefore contact the CDTFA and discuss the removal of the claim of lien. If they don’t comply, he will probably need to hire an attorney.

The bottom line is that when a tax claim against a former owner is recorded, the new owner has little choice but to work with his or her attorney and the tax agency to remove the claim.

We always remind our readers to seek their own legal counsel, but in this case our reader may need to talk to three lawyers! A maritime lawyer to evaluate the title history and validity of the lien, a tax lawyer to

work with the state agency, and a probate attorney to handle his father’s estate.

The end-of-year boat parade is the latest harbor and boating event to be canceled this year, because of the Covid-19 pandemic. The Celebration of Whales Festival, Fireworks by the Sea event to celebrate Independence Day, Concerts by the Sea and several car show events at the harbor have all been canceled this year because of the Coronavirus pandemic.

PORT OF L.A. BREAKS GROUND ON WILMINGTON WATERFRONT The $70.8 million project will soon be under construction. The port district expects the visitor-serving destination to be completed by 2023.

By PARIMAL M. ROHIT LOS ANGELES —Ground has officially been broken on the much-anticipated Wilmington Waterfront Promenade, a $70.8 million project city and port district officials hope will make the Los Angeles Harbor area a visitor-serving destination.

A groundbreaking ceremony was officially held on Oct. 29 at the planned site of the Wilmington Waterfront Promenade. Los Angeles City Council member Joe Buscaino and Port of Los Angeles officials were among those who took shovels and conducted the ceremonial groundbreaking. Buscaino represents Wilmington and San Pedro on the City Council.

The Wilmington Waterfront Promenade is part of the larger L.A. Waterfront redevelopment, which plans to revitalize

the Los Angeles Harbor area as a visitor-serving destination, similar to Downtown Santa Monica, Newport Beach Harbor and the Port of San Francisco.

“We have worked diligently over the years to create more open spaces and recreational areas for the residents of Wilmington,” Buscaino said. “It is most important that we are constantly creating buffers between the Wilmington community and heavy industry. This project will deliver a new waterfront that will be a game changer for Wilmington and the L.A. Waterfront.”

Sasaki Associates Inc., an engineering firm, designed the Wilmington Waterfront Promenade. The project, once completed, would realign Water Street and make various street improvements, such as new utilities, grading, striping, lighting and landscaping. The waterfront park area would feature a promenade, public pier and dock, public restroom, playground, and parking lots.

Plans also call for a community park to be built next to Banning’s Landing Community Center, irrigation improvements and new signage. Public seating, bicycle racks and drinking fountains would also be built.

Wilmington Waterfront Promenade

The Wilmington Waterfront is still three years away from being realized, but the Port of Los Angeles finally broke ground on the planned revitalization project (which is expected to cost $70.8 million). would ultimate occupy nine acres.

L.A. Harbor Commissioner Lucia Moreno-Linares said the new Wilmington Waterfront would improve “direct public access” to the harbor area.

“Providing more direct public access to Wilmington’s historic waterfront has been a long-time vision for the Port of Los Angeles, but also for me personally,” Moreno-Linares said. “As a Wilmington resident for more than 50 years, I am grateful to all who have played a role in keeping this project moving forward.”

Port of L.A. Executive Director Gene Seroka, meanwhile, said the development

of a “public-serving waterfront” has always been a priority for the port district and local community.

“The Port’s ongoing commitment to financially support public-serving waterfront development is made possible through our Public Access Investment Plan,” Seroka said. “The process makes sure that our communities participate in prioritizing projects that our most important to them.”

By LINDSEY GLASGOW REDONDO BEACH—Redondo Beach has

begun the planning and permitting process to dredge two areas in King Harbor to make the area more navigable for boaters. The Redondo Beach Harbor Commission discussed the dredging project at an Oct. 27 meeting.

Over the past 30 years, King Harbor has been dredged twice, first in 1988 and again in 2005. According to a staff report, the harbor is currently experiencing significant shoaling and needs maintenance dredging to maintain navigability and to ensure boater safety.

The city hired Noble Consultants to assist with the evaluation, planning, and permit acquisition for the dredging project. Initially, the city was looking to partner with the Army Corps of Engineers on portions of the harbor dredging, as the Corps may need to dredge portions of the harbor to conduct repairs to the

According to the project proposal, approximately 45,500 to 60,000 cubic yards would be dredged from a 4.1-acre site at the shoal fronting the north portion of the breakwater. Another 800 to 2,000 cubic yards would be dredged from a .35-acre site at the shoal fronting the inner portion of the south breakwater at the entrance of Basin 3. main breakwater. According to a staff report, no firm commitments have been made by the Corps and the timeline for the breakwater repairs are uncertain.

The city decided to move the dredging forward as a stand-alone project.

According to the project proposal, approximately 45,500 to 60,000 cubic yards would be dredged from a 4.1-acre site at the shoal fronting the north portion of the breakwater. Another 800 to 2,000 cubic yards would be dredged from a .35-acre site at the shoal fronting the inner portion of the south breakwater at the entrance of Basin 3.

According to the plans, approximately 29,000 cubic yards of the material dredged would be placed within the In-Harbor Placement Site, and approximately 33,000 cubic yards of the dredged material would be placed within the Corps’ Nearshore Placement Site.

The city has presented and received approval for the Sampling and Analysis Plan (SAP), outlining sediment sampling results and proposed sediment placement locations, which is one of the first steps in the project approval

process. The city still needs to prepare plans and specifications and obtain permits from the various regulatory agencies. The city estimates it will take up to 12 months to obtain these permits.

The city will also need to figure out funding for the project. The harbor does not qualify for federal funding to assist with dredging because it does not rise to the level of commercial activity required for such funding by the Corps of Engineers. If the city is able to forge a partnership with the corps on the breakwater project, there may be an opportunity for cost savings on the harbor dredging as the two parties coordinate their work effort.

According to a staff report, city staff will continue to explore federal and state opportunities for potential sources of funding that may offset the dredging cost. The city’s Capital Improvement Program included $500,000 for preliminary engineering, permitting, environmental review and design in fiscal year 2017-18 and proposes a total of $2.2 million for harbor dredging implementation and construction in fiscal year 2021-22 and fiscal year 2022-23.

NEWPORT BEACH VOTERS APPROVE MEASURE Z City Charter will be amended to include Harbor Commission.

By PARIMAL M. ROHIT NEWPORT BEACH—A local measure pro-

posing to update the Newport Beach City Charter to recognize the city’s Harbor Commission was approved by voters on Nov. 3. Measure Z, which proposed to make the city’s harbor advisory board “a City Charter designated Appointive Board and Council,” had 23,115 votes in favor and 18,732 votes against – or 55.24 percent “Yes” and 44.76 percent “No.” Newport Beach’s City Council proposed and advocated for the measure.

There was some formal opposition, as well – most notably by Newport Beach resident Jim Mosher.

The case for Measure Z in Orange County’s formal voting materials was made by Mayor Will O’Neill, Mayor Pro Tem Brad Avery and Council member Marshall “Duffy” Duffield; Mosher filed the official opposition statement.

Former Harbor Commission member Seymour Beek, meanwhile, expressed his position in favor of Measure Z in an opinion piece published by Newport Beach Independent.

“Measure Z was created to safeguard the Harbor Commission under our city’s charter,” Beek wrote in his editorial for Newport Beach Independent. “This will prevent future threats to Newport Harbor from political maneuvering.”

Avery and Duffield, like Beek, were former Harbor Commission members.

Duffield is also the inventor and founder of “Duffy” boats.

Mosher stated the measure was “poorly written” and would actually fail to protect the Harbor Commission from the “political whims of future councils.”

The measure, according to Mosher, would do nothing “to resolve the existing uncertainty about the division of labor between the council-created Harbor Commission and the pre-existing Parks, Beaches and Recreation Commission.”

Supporters for Measure Z, however, maintained the Harbor Commission would be able to focus on harbor-themed issues because of its inclusion in the City Charter. Those same supporters cited updates to Title 17 of the Harbor Code as the reason why Measure Z was necessary, “The need for the Harbor Commission’s specific expertise was evident recently when the commission spent three years preparing a comprehensive revision to our Harbor Code to reflect today’s modern uses and regulations,” O’Neill, Avery and Duffield said in their defense of Measure Z. The Harbor Commission was created in 2002 and advises the Newport Beach City Council on “operational, environmental and regulatory issues that control the harbor,” according to supporters of the measure.

Measure Z was not the only race in Newport Beach; Avery was up for re-election, as well. Avery, the former Harbor Commission member, was leading in the race his District 2 council seat. He was running against Nancy Scarbrough and had 59.94 percent of the vote, as of Nov. 5. The tally, at press time, was 25,241 for Avery and 16,868 for Scarbrough.

O’Neill, who is wrapping up his term as Newport Beach’s mayor, was also re-elected on Nov. 3; he ran uncontested for his District 7 council seat.

Noah Blom had the lead in the the other Newport Beach City Council seat up for grabs; Blom was running against Jeff Herdman.

The show will be held Nov. 14 and 15, from 10 a.m. to 3 p.m. at the Elite Theatre at the corner of Channel Islands Blvd. and Victoria Ave. The show will feature large and small paintings, home-garden rock art/boards, acrylics, canvas oil paintings, photography, loose coral for jewelry, 3-D art and more. There will also be live piano music performed by Barb Reid.

Santa Rosa Island could look slightly different in the not-too-distant future, as Channel Islands National Park is seeking a vendor to build something at Main Ranch. park staff stated.

“This exciting and unprecedented leasing opportunity will fulfil the vision of the park, as outlined in the park’s 2015 General Management Plan. We look forward to seeing the proposals envisioned,” Channel Islands National Park Superintendent Ethan McKinley said in a released statement.

Those planning to submit an RFEI would have to do so by 11:50 p.m., Pacific Time, Feb. 24, 2021. Proposals should be mailed to Channel Islands National Park, attention Commercial Services, 1901 Spinnaker Drive, Ventura, California 93001.

SANTA ANA WIND EVENT CAUSES TROUBLE ON CATALINA  AVALON—A strong Santa Ana wind event tore through Southern California Oct. 26 and 27, causing some trouble for boaters moored off Catalina Island. The Los Angeles County Fire Department, Lifeguard Division reported in an Oct. 27 Facebook post three people were rescued from three separate vessels. They also reported they responded to a vessel aground outside Avalon Harbor and assisted with multiple skiffs throughout the harbor that broke away from their moorings. Jon Council, reported on Facebook the Motor Vessel Wild Wave was the vessel that came aground on the eastern edge of Descanso Beach, prompting a clean-up effort to collect items strewn across the shore.

Santa Rosa Island, which measures 15 miles long by 10 miles wide and is 53,051 acres in size, is the second largest land mass within the Channel Islands network. The island, according to national park staff, is defined by rolling hills, deep canyons, a coastal lagoon, and beaches adorned with sand dunes.

“For thousands of years unusual animals and plants have made this windswept island their home. Flightless geese, giant mice, and pygmy mammoths are now extinct, while the island fox, spotted skunk, and Torrey pine still live here,” national park staff said. “The Chumash and their ancestors lived here for over 13,000 years. Ranchers raised sheep and cattle from 1844 to 1998. The US military used the island from 1943 through 1963. The National Park Service has made great efforts to preserve and protect island resources and restore native species.”

He began planning and building Avalon as the focal point of the island and hub of activity. Avalon’s first season as a resort community kicked off in the summer of 1888 under the ownership of Shatto. Ranch occupies more than 32 acres of “corrals, pastures, historic structures and scenic beauty” at Bechers Bay, according to Channel Islands National Park staff.

“Leasing opportunities may include occupancy of ten structures and land areas, including the historic Ranch House, Old Schoolhouse, Horse Barn, Generator Barn, and the non-historic Bunkhouse,” Channel Islands National Park staff said in a released statement.

“The park is also receptive to proposals that include providing vehicle transportation for visitors to access hiking trails and backcountry areas.”

The RFEI would help national park staff develop the next step in the political process, which would be Request for Proposals (RFP). The RFP would likely be issued in the fall of 2021, according to national park staff.

Whoever w ins the bid would be awarded a contract, which would likely start in the spring of 2024. The contract term would last up to 60 years, national

feeding grounds of the fishery has forced the season opener to be delayed.

The season opener will be delayed in order to avoid possible whale entanglements, according to California Department of Fish and Wildlife (CDFW) staff.

CDFW’s director will re-evaluate the re-assessment risk in mid-November and determine when the season can indeed move forward.

The director is also evaluating the risk of the commercial Dungeness crab fishery for the northern management area, which is scheduled to start on Dec. 1.

CDFW created the Risk Assessment

and Mitigation Program, or RAMP, with the commercial Dungeness crab fleet after a series of whale entanglements occurred during the 2015 and 2016 seasons.

“The risk assessment conducted by CDFW this week, in consultation with the Dungeness Crab Fishing Gear Working Group, is the first assessment under the new RAMP regulations,” according to a CDFW statement.

Charlton H. Bonham, CDFW’s director, said the assessment is necessary to protect whales from entanglements.

“While no one wants to delay the season, CDFW and the working group feel a delay is necessary to reduce the risk of entanglement,” Bonham said. “The fleet has gone to great lengths to be more nimble in order to protect whales and turtles, and the results are promising. This year,

for the first time in a long time, it looks like we don’t have to worry about domoic acid, which is good news.”

State officials opened the statewide recreational Dungeness crab season on Nov. 7.

The recreational season will open as planned with no health advisories in place,” according to CDFW staff. “The Fish and Game Commission will consider adopting new regulations at its December meeting that would give CDFW authority to address risk of marine life entanglement in the recreational fishery, as well.”

The commercial fishery will open once the whales migrate away from the fishing grounds, according to CDFW staff.

Continued data collection, according to CDFW staff, will help the state better manage the commercial and recreational Dungeness crab fisheries.

“CDFW is committed to collecting real time data regarding presence of humpback and blue whales, and Pacific leatherback sea turtles in Dungeness crab fishing grounds,” according to CDFW staff.

in 2020 has been bad or negative. The Newport Beach fishing fleet broke the record for largest tuna catch not once but twice – within a stretch of a few weeks – this year. The new record was set on Oct. 27, when a Thunderbird overnight fishing trip arrived at Balboa Angling Club and had a 361.2-pound tuna aboard.

The cow was weighed at Balboa Angling Club the morning of Oct. 27 and is officially the largest tuna ever caught by Newport Beach fishing fleets. Records for the fleet have been maintained since 1958.

global coral reef ecosystems and is committed to intervening in US reefs where it has the authority to act and support, and to promote the restoration and intervention of reefs worldwide,” NOAA staff said in a statement. “Given the accelerating pace of threats to reef ecosystems, it is clear that effective, timely interventions will need to be judiciously applied.”

The agency’s staff said the action plan would operate as a guide for NOAA as it tries to address coral interventions in the next one to three years.

“The plan encompasses four actions for NOAA: (1) research and test priority interventions, (2) develop local or regional structured decision support, (3) review policy implications of coral interventions, and (4) invest in infrastructure, research, and coordination,” according to the agency’s staff.

It’s not too late to prevent coral reefs from further harm, but the pace of work to reverse previous harms needs to be addressed at a faster pace, according to NOAA staff.

“We still have the capacity to save coral reefs from their current trajectories, but this requires accelerated rates of research and innovation, as well as increased and sustained investment,” NOAA staff stated. “Coordinated bodies of scientists, governmental officials, and other stakeholders will be critical in identifying which blend of conventional management and interventions will maximize their local reefs’ ability to persist considering budget, local buy-in, and policy.”

Nearly 60 percent of the world’s reefs, according to NOAA staff, have been degraded or destroyed because of overfishing, poor water quality, ocean warming and waterfront development.

“Reefs are predicted to be functionally extinct by 2050 under current environmental trajectories,” according to NOAA staff.

Angler Bailey Kelly made the record-breaking catch. Kelly and the Thunderbird crew posed with the cow immediately after the fish was weighed.

“The fish was caught offshore within U.S. waters, between Sunday-Monday afternoon,” according to Thunderbird staff.

“The Thunderbird 1.5-day overnight trip returned … with 11 total big bluefin tuna, ranging in size from 160 pounds to 361 pounds.

This was a trip with 24 open party guests.”

November brought with it a powerful northern weather system, resulting in Small Craft Advisories, 20- to 30-knot winds, rain and high seas. Prior to the storm, anglers were still enjoying good fishing for bluefin tuna, yellowfin tuna, dorado, skipjack and yellowtail and there were also some striped marlin and swordfish biting. This report is being prepared on the day the storm is clearing out and anglers are wondering if the storm might have rolled the water and dropped the water temperatures to the point where our warm water pelagic fish might depart now in search of warmer waters. Time will tell what species might still be around and biting after the storm but in any event, it will be interesting to see what skippers find once they get back out on the water to do some looking around.



Prior to the recent storm, bluefin tuna to 400-plus pounds had been biting for boats fishing the region of the Cortes Bank and some bluefin had also been found by boats fishing in the deep water to the southeast of the high spot at the Tanner Bank. The Cortes Bank was the best for the bluefin with the deep water to the northeast and to the northwest

of the Buoy being the best zones. In addition to the fish biting in the deep water to the northeast and northwest of the Buoy at the Cortes Bank, some of the 15- to 40-pound bluefin and some 15- to 40-pound yellowtail had been biting for boats fishing in the shallower 17 to 40 fathom depths to the east and to the southeast of the Cortes Bank Buoy.



In looking at a sea surface temperature chart before preparing this report on the day the storm cleared out, there is a break in the clouds where the chart is showing there is still 65.5-to 66-degree water present, in the deep water area to the northeast of the Cortes Bank. Time will tell if there are still bluefin holding around the Cortes Bank, but it is my guess is there are still some bluefin holding in water temperatures that are in the 65.5- to 66-degree range.

pete in the club’s Club Championship Regatta, which takes place Nov. 14 in Newport Beach.

The regatta is not a class or fleet race, but every skipper and crewmember must “possess sailing and racing skills appropriate to the Harbor 20,” according to the Notice of Race.

Five races are scheduled. At least two people must be aboard each competing boat. Registered skippers must skipper each race, according to the No-

tive Sundays, between Nov. 8 and Jan. 3, 2021. Ten boats will be assigned on a first-come, first-served basis.

The first race will begin with a warning signal at 1 p.m. on schedule racing days. The last warning signal will be given at 3:30 p.m.

The following items are permitted to be on board: basic hand tools; adhesive tape; elastic line; non-permanent mark-

ing pens; tell tale material; watch; timer; handheld compass; shackles; clevis pins; and, Velcro tape.

Crew substitutions, according to the sailing instructions, are encouraged.

“Special awards will also be presented to the top team with all crew at least 55 years old as well as top family team,” according to the Notice of Race.

By PARIMAL M. ROHIT SANTA BARBARA—Santa Barbara Yacht Club will host the Double-Handed/ShortHanded Race on Nov. 21. The regatta will be governed by the Rules of Sailing for One Design and PHRF classes, and the U.S. Safety Equipment Requirements (“Near Shore”).

Marine Industry Racer rules for the PHRF class will not be applicable, according to the Notice of Race.

Covid-19 regulations have been established for this regatta.

“All crew are required to have face covering for nose and mouth (such as a face mask, buff, or neck gaiter). It is highly recommended that they be worn at all times and in particular, while in the harbor at the dock and on the water when working in confined areas less than six feet distance from other crew members,” according to the Notice of Race. “It is recommended that all crew wear closed-finger gloves.

“It is recommended that crew be comprised of co-habitants and/or close contacts (also known as your ‘Quaran-team’),” the Notice of Race continued.

Members of Santa Barbara YC and other US Sailing-affiliated yacht clubs are eligible to participate in this regatta.

The following One Design classes will be featured in this regatta: Harbor 20; J/70; J/105; J/24; and, Melges 24.

Registrations for this regatta can be completed online at sbyc.org/racing.

“There is no entry free for this event,” according to the Notice of Race.

A competitor’s meeting will be held at noon, followed by the first warning signal at 1:30 p.m.

“Awards will be posted [after racing] and trophies available for pick up at SBYC front desk,” according to the Notice of Race.

Those competing tin the double-handed division are limited to two crewmembers per boat. Crewmembers for single-handed boats are limited as follows: three crew, 30- to 38-foot boats; four crew, 38.1- to 50-foot boats; five crew, 50.1- to 65-foot boats; and, six crew, 65.1foot boats and larger.

“The first boat must finish by [3:45 p.m.] or the race will be abandoned. All boats must finish within one hour of the first boat to finish, or they will be scored DNF,” according to the Notice of Race.

“Prizes will be awarded to the top finishers in the double-handed and short-handed division. The Bill Daffron Perpetual Trophy will be awarded to the winner of the double-handed division.”

Covid-19 forced cancellation of 2020 race, but the 73rd edition of the yacht race will kick off on April 23, 2021.

By PARIMAL M. ROHIT NEWPORT BEACH—The Newport Ocean Sailing Association (NOSA) announced nex t yea r ’s New por t-t o -Ensena da International Yacht Race will return.

Racing will begin on April 23, 2021.

NOSA canceled the 2020 version of the event due to the Covid-19 pandemic, but organizers said the 2021 version of the race, which will be in its 73rd iteration, will take place.

Next year’s race, as of right now, will include all three courses: Newport Beach to Ensenada, Newport Beach to San Diego, and Newport Beach to Dana Point.

The cross-border yacht race is commonly referred to as N2E. Contingencies are being considered for alternate courses, parties and celebrations, should things change between now and April 2021.

“If for any reason Mexico becomes off-limits, we will switch Ensenada entries to the San Diego course,” Commodore William Gibbs said. “In consider-

ation of this possibility, we have upgraded the N2SD course from a 60nm drag race into a challenging 100nm race into Mexican waters leaving the Coronado Islands to port. But there will be a race.”

Racing will begin at Newport Beach’s Balboa Pier on April 23, 2021. A Notice of Race should be available on the NOSA website. Registration is open. Those who register early will receive a 2020 early bird gift: a collector hat. Early bird registration ends on Dec. 15.

An official statement from NOSA about the 2021 race announcement said protocols will be followed to ensure the safety of all competitors.

“Sailboat racing is showing great signs of life with many offshore and closed course races getting back on the calendar, with Covid guidelines followed for the safety of everyone,” NOSA staff said in a released statement. “The safety and the well-being of participating sailors and volunteers is a priority for NOSA so all activities will follow concurrent health guidelines.”

Gibbs added the success of Newport-to-Ensenada is contingent upon having as many registrations as possible.

“N2E racers, while being safety conscious as always, deserve to have a good time on their boats again,” Gibbs said.

“There are traditions and institutions, such as the Newport to Ensenada International Yacht Race, that will persevere in the face of adversity.”

“I came back to Catalina because, I hate to say it, out of all the places I’ve been its one of the most unique,” Carstarphen said.

Prior to working for the Harbor Department, Carstarphen worked as a paidcall firefighter in Avalon for the Los Angeles Fire Department and obtained an EMT certification. He went on to get a U.S. Coast Guard Captain’s License.

While he was working in the harbor department as a part-time harbor patrol assistant, he also worked as a vessel assist captain and worked a few other parttime jobs, including a short stint working on one of the glass bottom boats. He eventually ended up owning 10 percent of the local vessel assist enterprise, Cat Tow, Inc. He seized the opportunity when a full-time position in the Harbor Depart-

In his time with the Harbor Department, Carstarphen has taken advantage of the training offered by the city including incident command training, law enforcement training and medical training.

With the many responsibilities and tasks that come with being the assistant harbor master and now interim harbor master, Carstarphen said his favorite part is being out on the water.

“My favorite is just really being out on the boat and working with the people,” Carstarphen said. “We really have a much closer bond with [the boating community], I think we’re really lucky to have that.”

He said he is grateful to be working for such a friendly and supportive boating community.

Funding for the Wilmington Waterfront Promenade was made possible by the port district’s Public Access Investment Plan, which was implemented in 2015. Ten percent of the port district’s annual operating income has been allocated to infrastructure projects since the investment plan was put in place. This is in addition to the money the port district already spends on the waterfront area, in general.

“The port [district] spends approximately $20 million per year maintaining, operating and programming the LA Waterfront,” according to port district staff.

“The port [district] has invested more than $600 million in public access projects since 2005, with an additional $400 million committed through 2025.”

“Our team and boating community were very hopeful that the Holiday boat parade could take place,” Mark Sandoval, the Harbor Department’s director, said. “This event has always been very well attended along the harbor shores, and as a result the responsible decision for the health and safety of our community was to cancel this event.”

Sandoval added safety is the priority right now, and the harbor’s many events will return again.

“We are living through unprecedented times and it’s important that we all stay safe,” Sandoval said in a statement.

“We are making progress as a County community, and it is imperative we continue to practice measures that allow our Harbor businesses to fully reopen and thrive again.”

Ventura County has hosted the Parade of Lights at Channel Islands Harbor for 54 years. This year’s boat parade was scheduled to take place on Dec. 12.

The boat parade has been canceled before, generally due to “poor weather conditions, which risked the safety of boaters and spectators,” according to Ventura County Harbor Department staff.
