Strange Bone Washes Ashore in San Francisco

SAN FRANCISCO — Shorelines are often littered with driftwood and other trash and treasures that wash ashore. But one item caught the eye of beachgoer Elke Teichmann when she spotted something unusual looking on the sand of Fort Funston beach.

The recent storms that California has been experiencing bring everything to shore. As a result, pieces of wood had washed up on the beach, and Teichmann said she’d been looking at reddish-colored wood fragments that she hadn’t seen washed up before. As she further investigated, Teichmann noticed a funny-shaped white object lying on the shoreline.

“It was clearly a huge bone,” said Teichmann in an interview with the Los Angeles Times

Teichmann said she could recognize the bone because of a marine biology class she took. As a result, Teichmann could recognize that it was a bone, but what part of the whale the bone was from was unclear.

Robert Boessenecker, a research associate at UC Berkeley’s Museum of Paleontology, told the San Francisco Chronicle the bone appeared to be the braincase of a gray whale, the part of the skull that encases the brain.

According to the National Oceanic and Atmospheric Administration, gray whales can reach 42 to 49 feet in length and weigh up to 90,000 pounds. The massive marine mammals are found mainly in the north Pacific Ocean. During the summer, the whales can be found feeding along the Pacific coast from southern Alaska to Northern California.

Teichmann, who frequents the beach with her golden retriever, said she’d never seen anything like that before on the beach.

“It was just really neat,” said Teichmann in the interview. “I wish I’d had my big camera. It was just so beautiful.”

Quarantine Comes from the Maritime Industry

After becoming very familiar with the term quarantine in recent years, it’s strange to think that the 14th-century term was originally derived from the maritime industry.

According to the CDC, the practice of quarantine, as we know it, began during the 14th century as an effort to protect coastal cities from plague epidemics. For example, ships arriving in Venice from infected ports were required to sit at anchor for 40 days before landing. This practice, called quarantine, was derived from the Italian term quaranta giorni , which means 40 days.

When the United States was first established, little was done to prevent the importation of infectious diseases. Protection against imported diseases fell under local and state jurisdiction. Individual municipalities enacted an assortment of quarantine regulations for arriving vessels.

State and local governments periodically made attempts to set quarantine requirements. However, continued outbreaks of yellow fever finally prompted Congress to pass federal quarantine legislation in 1878. While not conflicting with states’ rights, this legislation paved the way for federal involvement in quarantine activities.

Outbreaks of cholera from

passenger ships arriving from Europe evoked a reinterpretation of the law in 1892 to give the federal government more control over authorizing quarantine requirements. The following year, Congress passed legislation clarifying the federal role in quarantine activities. As local authorities realized the benefits of federal involvement, local quarantine stations were gradually turned over to the federal government. Additional federal facilities were built, and the number of staff was increased to provide better coverage. War Heroes on Water Announces 2023 Tournament dates

NEWPORT BEACH — War Heroes on Water (WHOW) – the annual sportfishing tournament that helps combat-wounded veterans recover from war’s physical and emotional wounds – announced the 2023 event will be held Sept.22 – 26, off the waters of Catalina Island. Dana Point Harbor Partners’ Underserved Youth Program Aims to Provide Ocean Experiences and Education to More Than 1,000 Underserved Youths

DANA POINT — The long-awaited $400 million, multiyear revitalization of Dana Point Harbor commenced at The Marina at Dana Point in August 2022.

In collaboration with the California Coastal Commission, DPHP will improve public water access through the intricate design of The Marina and the newly developed community outreach programs.

Bellwether Financial Group, a partner in DPHP and the firm responsible for The Marina operations and redevelopment, is spearheading a robust outreach program to expose underserved youth from both local and inland communities to aquatic activities, including swim lessons, ocean education, whale watching, surfing, kayaking, and sailing each year.

Since the program commenced in August 2022, the Underserved Youth Program has provided hundreds of underserved youths in the community the opportunity to experience ocean education and activities, often for the first time. This mammoth migration of over 20,000 whales and 6,000 miles twice a year remains a significant attraction in Southern California. What are the time limits for filing a lawsuit under Federal Maritime Law versus State Law?

QUESTION:

Two years ago I was injured aboard a boat during the Newport Beach Christmas Boat Parade. I waited a while to hire a lawyer, and when I finally had a firm retained, I was surprised to see that they filed the case in State Court in Orange County. I am concerned because I read that the time limit for filing a maritime personal injury lawsuit under Federal Maritime Law is three years, while the time limit under State law is two years. Is this correct? Should he have filed the lawsuit in Federal court?

ANSWER: I should first point out that if you are questioning your lawyer’s judgment this early in the case, you may want to talk to another lawyer (in person - not through a newspaper!). That said, based on what you have shared, it does not appear that he is missing any deadlines by filing in State court.

The answer to our reader’s question requires an understanding of Federal and State jurisdiction and the doctrine of Federal Preemption. Let’s start with jurisdiction.

“Jurisdiction” is the right and power of a court to hear a case and to interpret the law. We could spend a law school semester discussing the scope of “admiralty and maritime jurisdiction,” but it generally refers to a vessel accident that occurs on navigable waters or a contract or claim that directly effects a vessel’s operation, maintenance, repair, seaworthiness, or safety.

All U.S. Courts derive their authority from the U.S. Constitution, and when the framers of the Constitution addressed the question of admiralty jurisdiction, they simply extended the power of the U.S. Federal Courts to include “all cases of admiralty and maritime jurisdiction”(historically, the terms “admiralty law” and “maritime law” had distinct meanings, but today they are used interchangeably).

To confuse matters somewhat, the extension of the federal judicial power to maritime cases was implemented with a clause that allows plaintiffs in

most cases, at their option, to file a maritime case in State Court. The State Court judge in those cases will often need to apply the same maritime legal principles as a federal judge would apply in a federal maritime case. However, the attorney filing the complaint may prefer State Court for various strategic reasons such as the right to a jury. Our reader’s attorney filed their case in state court pursuant to this provision.

So, the case has been filed in State Court, but the choice between Federal and State law may not be immediately clear. State personal injury law in our reader’s case requires a lawsuit to be filed within two years after the incident, while Federal maritime law allows the case to be filed within three years. This is where we need to analyze the issues under the doctrine of Federal Preemption.

The Doctrine of Preemption addresses conflicts between state and federal laws. Preemption analysis considers whether a federal law or statute will preempt or take precedence over the state law. Such a conflict arises when compliance with both federal and state regulations is a physical impossibility, or when state law stands as an obstacle to the full purposes and objectives of Congress. In cases of a direct conflict, Federal law always prevails over State law. In our reader’s case, Federal and State laws regarding filing deadlines directly contradict each other, and as such the Federal law allowing a three-year filing dead-

line prevails. Our reader’s attorney complied with the applicable law when he filed the lawsuit.

So, let’s summarize. Broadly speaking, this case is analyzed under two legal principles: “Jurisdiction” and “Choice of Law.” When analyzing jurisdiction, we must ask whether the court selected by our reader’s attorney has the power to hear the case. Yes, it does. Under a choice of law analysis, we must ask whether - regardless of where the case was filed - what body of law is applied in this case to resolve the legal issues? The answer is that it depends on which issue is being considered. As we saw in our analysis above, Federal law is applied to determine the deadlines for filing the case, but other aspects of the case would be evaluated under State law if there is no contradicting Federal law.

A discussion of jurisdiction and the court system may be of little practical use to the average boater, but these are important issues that need to be considered in litigation. An experienced maritime attorney can help to navigate a legal claim through the system.

NOAA Awards $20.5 Million for Ocean and Coastal Resource Management

In a first-of-its-kind deployment under Bipartisan Infrastructure Law funds, today NOAA announced an approximately $20.5 million award for coordinating ocean and coastal resources around the country. The recommended federal funds will significantly enhance existing collaboration between states, tribal governments, and the federal government and provide needed capacity to advance their work.

Through this recommended funding, the awards will support projects to advance regional ocean partnerships and data sharing among ocean users and include the engagement of federally recognized tribes with existing regional ocean partnerships. Regional ocean partnerships are regional organizations convened by governors to work collaboratively across multiple states, in coordination with federal and tribal governments, on shared priorities and challenges.

“Advanced climate data is critical to helping communities act on the best available information when disaster strikes,” said Secretary of Commerce Gina Raimondo. “The Biden-Harris Administration is committed to addressing the climate crisis, and thanks to the Bipartisan Infrastructure Law, we can invest in collecting and disseminating lifesaving data to communities across the country, especially those that are often overlooked and left behind.”

“Equity remains at the heart of all we do at the Commerce Department, and this includes the continued effort towards environmental justice for our tribal communities,” said Deputy Secretary of Commerce Don Graves. “This funding is a necessary step in building on climate resilience efforts and protecting our coasts.”

“This recommended funding allows communities to better plan for future changes as we build a Climate-Ready Nation,” said NOAA Administrator Rick Spinrad, Ph.D. “NOAA values the contributions of all partners to better understand and manage climate-related risks.”

A total of 13 awards were distributed to tribes and partners:

• $15.7 million went to four existing regional ocean partnerships —

the Gulf of Mexico Allianceoffsite link, Northeast Regional Ocean Counciloffsite link, Mid-Atlantic Regional Council on the Oceanoffsite link, and West Coast Ocean Allianceoffsite link — to address increasing ocean uses, support sustainability, track climate impacts on shifting ecosystems and enhance regional capacity for sharing and integrating federal and non-federal ocean and coastal data.

• $1.1 million will go to four federally recognized tribes or tribal organizations — the Makah Indian Tribeoffsite link, Quinault Indian Nationoffsite link, Columbia River Inter-Tribal Fish Commissionoffsite link, and Quileute Tribeoffsite link — to support tribal actions related to the regional ocean and coastal priorities.

• $3.7 million went to five U.S. Integrated Ocean Observing System regional associations — the Alaska Ocean Observing Systemoffsite link, Pacific Islands Ocean Observing Systemoffsite link, Southeast Coastal Ocean Observing Regional Associationoffsite link, Great Lakes Observing Systemoffsite link and will soon be awarded to the Caribbean Coastal Ocean Observing Systemoffsite link — to enhance regional capacity for sharing data and better integration of federal and non-federal data in regions without existing regional ocean partnerships. After evaluating the quarantine program and its role in preventing disease transmission, the CDC pruned the program in the 1970s. It changed its focus from routine inspection to program management and intervention. The new direction included an enhanced surveillance system to monitor the onset of epidemics abroad and a modernized inspection process to meet the changing needs of international traffic.

By 1995, all U.S. ports of entry were covered by only seven quarantine stations. A station was added in 1996 in Atlanta, Georgia, just before the city hosted the 1996 Summer Olympic Games. Following the severe acute respiratory syndrome (SARS) epidemic of 2003, CDC reorganized the quarantine station system, expanding to 18 stations with more than 90 field employees.

CCA CAL Launches Campaign to Preserve Recreational Fishing Access in California’s 30x30 Plan

The “Stop the 30x30 Closures” 2023 theme will kick off with a multimedia frenzy to bring costal no-fishing area awareness to anglers.

The Coastal Conservation Association of California (CCA CAL) has launched a multi-media campaign to generate public awareness and political pressure in opposition to establishing more coastal no-fishing areas within the development of the State of California’s 30x30 plan.

The campaign is launched in association with major sportfishing brands during the 2023 fishing tackle and boatshow season with a “Stop the 30x30 Closures” theme. The outreach program encourages anglers and others to help battle ag ainst the potential for 30x30 fishing closures by joining and contributing to CCA CAL, spearheading the struggle to preserve coastal angling access at the state regulatory level.

The 30x30 process, set in motion by an executive order by California Governor Gavin Newsom two weeks after the st ate’s legislature failed to pass a 30x30 bill, seeks to conserve 30 percent of coastal waters and lands by 2030. State regulatory agencies have already begun 30x30 planning and will soon start to draw lines for 30x30 areas along the California coast and offshore islands.

“We know that the state intends to use 30x30 as a tool to shut down more coastal areas to fishing,” says Wayne Kotow, ex ecutive director for CCA CAL, in a press release from Jan 17. “As the only state organization fighting for anglers’

rights, CCA CAL is committed to ensuring that recreational fishing is included in the state’s 30x30 areas.

“The State of California views anglers as a problem, but in reality, we are the original conservationists with a vested interest in strong marine ecosystems and biodiversity,” said Kotow. “We are committed to working toward solutions that conserve marine resources and, at the same time, preserve coastal fishing access. That includes fishing access for kids, for under-served communities, for everyone.”

CCA CAL’s “Stop the 30x30 Closures” campaign will appear in a wide range of media outlets, including print publications, fishing websites, social media, emails, podcasts, videos, displays at tackle-store and sport-boat landings, as well as at boat shows around the country.

“To keep California’s coastal fishing open in the 30x30 process, we need everyone’s help to make our voices heard,” Kotow says. “We need every California angler to join CCA CAL…Look for our ‘Stop the 30x30 Closures’ ads, displays, posts, and literature, and visit the CCA CAL website to join,” said Kotow.

The Coastal Conservation Association of California was created in 2015 when recreational anglers and outdoor enthusiasts came together to work for the conservation and enhancement of marine resources and coastal environments. To day, CCA CAL is working to protect the health, habitat, and sustainability of marine resources, but also the interests of recreational saltwater anglers. Nouvoyage’s Luxury Amphibious Tender 33 has Raised the Bar

BOSTON — Nouvoyage, the Boston-based designer of luxury amphibious limousines, is leveling up. In addition to Nouvoyage’s concentration on selling its Limousine Tender 33 to the superyacht market— now, it’s striving for larger craft in the cruise line industry.

The company says its roughly 33-foot “shadow tenders,” complete with reclining leather seats, an under-counter styled refrigerator/freezer, WiFi, cable TV, galley, head, A/C, heat, retractable sunroof, and gull-wing doors, can follow (shadow) liners to take passengers to shore and back. A shadow tender is a yacht support vessel that is a specialized ship that provides support and auxiliary functions for

large sailing motor yachts.

“We plan to introduce an open version of the limo tender in the future that will include a seating area behind the helm that is covered by a retracting convertible roof, said Kevin Neprud, Owner and CEO of Nouvoyage. “The seating area includes a coffee table that converts to a dining table. The open model will also feature a rear deck that can be used for fishing, diving, skiing, grilling, etc.”

Th e tender is a modern interpretation of a Venetian limo tender with inspiration from early luxury automobiles. The tender’s bumper can slide in and out via a remote control to create a boarding surface and a swim platform. Additionally, the license plate valance can fold down, allowing a remote-oper-

ated passerelle that stows under the deck to be deployed. The tender can also fit

into a ship’s garage and be launched from an articulating beach deck. Then, passengers could board the tender while still in the garage and arrive at the shore destination well ahead of the crowds, ready to be driven around in luxury to visit sites off the beaten track— the ultimate flex. Additionally, the shadow tender includes a series of diesel-electric hybrid driveline that offers quiet, electric operation on land and water. Also, the air conditioning, lighting, and audio and visual systems can run for hours while the engine is off.

Th e 33-foot tender tops out at 28 knots on the water and 90 mph on land, with a land range of 1,200 miles at highway speed and 350 nautical miles; there are upgrade options available to increase top water speed. In addition, the vessel is handicap accessible via an optional automated ramp at the starboard entry.

IN MEMORIAM—JACK DORSEE

October 6, 1933-January 9, 2023

Surrounded by his loving family, Rancho Santa Fe resident Jack Dorsee passed away at age 89 after a lengthy battle with cancer.

Born in Washington, DC to Edmund Ballard Dorsee and Alice Emma Dyer, and raised in Silver Spring, Maryland, he is survived by his twin sister, Jill Navarro, and was preceded in death by his brother Ballard Dorsee. Jack earned a BS at the University of Maryland, and served his country as a submariner in the US Navy during the Korean War.

In the late 1960s, and over the next 40 years, Jack Dorsee Sailboats, located on San Diego’s Harbor Island, became one of the largest maritime dealerships in California with additional locations in Orange County and Hawaii.

During this time he met the love of his life, Karolyn, his wife of 52 years. Jack and Karolyn exchanged vows in 1970 on a yacht followed by a reception at the Bali Hai Restaurant, and participated in the Acapulco Race the very next day.

Residing in Rancho Santa Fe since 1971, they raised many farm animals and horses. They continued their love of sailing including staging the annual charitable “Go Fly A Kite & Sail Race” with over 250 boat entries each year. The Dorsees were active members of the San Diego Yacht Club where Jack competed in sailboat races including Transpacific Yacht Race, Ensenada, Acapulco and many others along the California Coast.

Active in his community, Jack was elected to the Rancho Santa Fe Association Board of Directors, and was appointed by Governor Pete Wilson to serve on the California Boating and Waterways Commission. He also was the Chair of the Southern California Marine Association.

In retirement, Jack pursued his interest in writing and authored several

books.

Also on his bucket list were singing lessons, which produced several albums and many fun singing opportunities. He also restored vintage tractors, including a 1940 red CASE that residents enjoyed

as an entry in the annual Rancho Santa Fe 4th of July Parade. Flying lessons were another fun adventure on his list.

Surviving family members are his beloved wife Karolyn Dorsee, treasured daughter Debbie Dorsee, and adored grandson David Keaka (Jack) Pacheco, his sister Jill Navarro, and several nieces, nephews and cousins.

A Celebration of Life will be held at the San Diego Yacht Club. His final resting place is El Camino Memorial, Sorrento Valley.

— Danielle E. Haulsee, Ph.D., most recently a Research Scientist at Stanford University’s Hopkins Marine Station, has been named Chief Science Officer for Hubbs-SeaWorld Research Institute (HSWRI) and assumes her new role today.

Dr. Haulsee will establish scientific priorities, coordinate support for HSWRI scientists, serve as a liaison to the community and develop communications to help attract further financial support for

Hopkins Marine Station, located in Pacific Grove, CA adjacent to the Monterey Bay Aquarium, is the oldest marine lab on the U.S. Pacific Coast and the second oldest in the nation, after Woods Hole Oceanographic Institution.

“Hubbs-SeaWorld Research Institute is internationally renowned for its marine science work within the ocean conservation sector, but deserves broader recognition, especially as it relates to sustainability and climate change impacts,” no ted Dr. Haulsee. “I look forward to raising the Institute’s profile and leading the science team into new and vitally important areas.”

Dr. Haulsee has published several papers and made numerous presentations on topics related to ocean conservation. In addition to advisory presentations and workshops, she has made scientific briefings to members of Congress, communicated scientific topics to local and national media, and served as a manuscript reviewer for 19 publications.

HUBBS-SEAWORLD RESEARCH INSTITUTE HIRES FLORIDA PROGRAM DIRECTOR

SAN DIEGO (JANUARY 18, 2023) — Dr. Jeff A. Eble has joined Hubbs-SeaWorld Research Institute (HSWRI) as its Florida Program Director effective January 3. In his new position, he will lead research operations at HSWRI’s Melbourne Beach facility, and interface with government agencies, academic institutions and the broader community.

Dr. Eble was most recently Visiting Research Assistant Professor and Project Coordinator at the Florida Institute of Technology. While there, he led a multidisciplinary, $2.5 million state-funded project to improve understanding and ma nagement of the imperiled Indian River Lagoon, where HSWRI has over 40 years of experience conducting research projects.

“Jeff’s experience with project management, along with his proven ability to develop technical and financial support, will be tremendous assets for our Florida operations,” said Danielle E. Haulsee, Ph.D., HSWRI’s Chief Science Officer.

“He also led development and application of new environmental DNA techniques to assess marine biodiversity,” Dr. Haulsee added. “This is just one example of how he will diversify the scientific expertise of our Institute.”

Dr. Eble earned his B.A. in biology and his Ph.D. in zoology from the University of Hawaii (Hilo and Honolulu campuses, respectively). He has published 27 articles in peer-reviewed journals and two bo ok chapters, and garnered $2.9 million in research and program grants and appropriations.

America’s Boating Club Will Host Several Required Education Classes

America›s Boating Club (ABC) - the largest boating education organization in the U.S.a non-profit - will soon be teaching several classes in San Diego.

SAN DIEGO — Beginning Feb. 7, America’s Boating Club will offer several different boating education courses. The first course is its introductory boating course and will be held on Feb. 7. This course, which runs for eight weeks, one night a week, will teach basic safe boating skills and Coast Guard requirements. UCI Health Has Launched a Clinical Affiliation with Catalina Island Medical Center

AVALON — On Jan. 18, UCI Health and Catalina Island Medical Center (CIMC) announced a clinical affiliation between the University of California, Irvine’s leading academic health system, and Catalina Island’s sole provider of emergency, primary and acute care services.

The affiliation will build on a collaboration launched in 2016 when UCI Health began providing emergency medicine specialists to expand care in the medical center’s emergency department.

“Working with UCI Health raises the level and quality of care available to our community,” said Jason Paret, CEO of Catalina Island Medical Center, in a press release from Jan. 18. “This new stage in our collaboration opens the door to expanding existing clinical services and increasing our community’s access to specialty care.”

As Avalon’s only hospital, CMIC serves the clinical needs of Santa Catalina Island’s 4,000 residents and the more than one million visitors who travel there yearly. The Catalina Island Medical Group serves the island’s medical needs with full-time physicians and nurse practitioners who are supported by ancillary hospital resources, including diagnos-

tic imaging, therapy services, nutritional counseling, and clinical laboratory services.

“We believe the successful relationship with CIMC in emergency medicine provides a solid foundation to explore the potential for UCI Health to support CIMC and the Catalina Island Medical Center Foundation in their mission to provide the highest quality healthcare for residents and visitors,” said Chad. T. Lefteris, CEO of UCI Health, in the press release. “This affiliation opens the door to [the] possible expansion of primary and specialty care as CIMC grows.”

The CIMC emergency department evaluates and treats 2,600 cases yearly, a 33 percent increase since the UCI Health collaboration began seven years ago. In addition, patients have consistently ranked CIMC’s emergency services as among the best in the nation.

CIMC and its predecessor, Avalon Municipal Hospital, have provided medical care at 100 Falls Canyon Road in Avalon since 1960. CIMC is one of the smallest hospitals in the state due to its unique island location. It historically has provided many of the health services typically found only at larger facilities. The original building had six beds and could serve eight people at a time. Subsequent expansions added emergency and operat-

Sailing’s Fate in the Paralympic Games

It was for good reason when sailing was dropped from the Paralympic Games after Rio 2016. Despite its suitability, the management of parasailing was not meeting the International Paralympic Committee requirements. While it was a surprise to some, it was a wake-up call for all.

Since that day, the mission has been to make changes required for reinstatement. While that effort failed for Paris 2024, World Sailing is making an even stronger case for Los Angeles 2028. In anticipation of that decision, World Sailing CEO David Graham submitted this op en letter to Para Sailors around the world on January 23, 2023:

“I am writing an open letter to you all at this time because the decision on whether sailing is reinstated to the Paralympic Games for LA28 is expected in the coming days. While we do not know the outcome, I would like to take this opportunity to thank everyone for their unwavering support throughout the #BacktheBid campaign since it was launched in the summer of 2021. When sailing was dropped from the Paralympic Games after Rio 2016, it was for good reason. Despite its suitability, the management of parasailing was not meeting the International Paralympic Committee requirements. While it was a shocker to some, it was a wake-up call for all. When we speak as one, sailing has a powerful voice, and it is incredibly important for the sport to unite behind big causes. It has been truly inspiring to see the global support for #BacktheBid. You have most definitely been noticed and we are extremely grateful for your support.

However, we must also recognize that there are 33 sports seeking inclusion for LA28 and no sport has successfully been reinstated after being dropped. While we have made an extremely powerful case for sailing, we also recognize that other sports will also have put forward strong proposals, and we appreciate that this is an incredibly difficult decision for the International Paralympic Committee (IPC) Board.

Regardless of the outcome, World Sailing is absolutely committed to the future of Para Sailing. Our efforts to grow the sport are just the start, and Para Sailing is going from strength to strength.

On Feb. 11, the Santa Barbara Yacht Club will host the Sweetheart’s Race. This event will be governed by the rules

“Near Shore.” This regatta is open to all members of the Santa Barbara Yacht Club (SBYC). In addition, members of other clubs belonging to US Sailing may race as guests of Santa Barbara Yacht Club. Eligible boats may enter by submitting a completed race entry form to the Santa Barbara Yacht Club no later than 11 a.m. on the day of the race. Since World Sailing launched its campaign to reinstate sailing into the Paralympic Games for LA28, the overriding message has been that sailing is a sport for all and is life changing.

Make Your Boat Warranty Work for You

Additionally, boatbuilders buy components from third-party vendors, like engines, air conditioning units, and electronics, which come with warranties. The boat ’s warranty normally covers them, but only up to the period of the original boat warranty. After that, problems have to be taken up with the respective manufacturers. This highlights an important point. Remember that warranties, whether for the entire boat or the VHF, are nearly always “limited,” which means that it’s up to you to return the boat, engine, or broken radio to the manufacturer for servicing.

It used to be that manufacturers seemed to believe new-boat warranties were an essential evil; the small print on the back of the sales brochures offered little and lasted for hardly a year. But now manufacturers admit that warranties can differentiate their products from their competitors and that buyers are catching on.

Warranties have improved, with adequate coverage and longer durations, and mos t are now transferable. Regardless of the improvements, warranty language could be more user-friendly, and exclusions often take up more space than coverages. The following are a few of the most frequent questions boat buyers have.

Q: I have several different warranties. Why isn’t there just one?

A: Boatbuilders typically provide a warranty that promises their boat will be free of defects for a period, often one to two years. This warranty covers things like steering systems, electrical and plumbing systems, and other items the manufacturer builds. In addition, builders often

Q: T he engine on my new boat broke down, and the boatbuilder won’t cover the repairs. What should I do?

A: Ge nerally, the engine manufacturer, not the boatbuilder, provides engine warranties. Often, the dealer handles the warranty for both, so it’s recommended that you buy from a dealer certified for engine warranties, too. Otherwise, you’ll need to take the boat to an authorized shop.

Q: Is my warranty transferable?

A: Most manufacturers allow the remainder of their new boat warranty to be transferred — but only to the second owner. Hull warranties are usually transferable to the second owner too, but remember that on both warranties, the time starts the day the boat is delivered to the first owner. In addition, unfortunately, some manufacturers charge up to $1,000 to transfer a warranty.

Us ually, blister warranties aren’t transferable. For example, if the boat has a lifetime hull warranty, it usually won’t transfer to the second owner. In any case, manufacturers have specific procedures to be followed to transfer a warranty, and

neglecting to dot all the i’s and cross your t’s can cause issues for the second owner.

Q: Can I take my boat to a local shop for warranty work?

A: That’s a no. Manufacturers arrange with their dealers to pay them for hourly warranty work and parts. Dealers are fa ctory-trained and know the ins and outs of manufacturers’ boats. Sometimes, a dealer, specifically a smaller one, cannot take care of complex or challenging repairs. The manufacturer will arrange a non-dealer shop to do the work and pay them directly. But the manufacturer must approve it before any work begins, or the owner will be responsible for the bill.

Ma nufacturers often want the boat returned to them for significant hull repairs, like cracks or delamination. But be ware. The Consumer Protection Bureau has received reports that some manufacturers are unwilling to pay for the transportation or that they keep the boat for weeks— you can negotiate the transportation costs. Be sure to get in writing what the repair entails and how long the factory plans to keep your boat. Know that warranties exclude fees for loss of use, and you’ll still have to pay loan payments and insurance if your boat is out of service. When buying a boat long-distance, try to arrange with the manufacturer to have the warranty work done by a dealer that’s closer to you.

Q: What can void my warranty?

A: Taking a boat to a dealer not authorized for warranty repairs will usually void the warranty and leave you with the bill unless approved beforehand. However, suppose a non-dealer shop or yourself conducts regular maintenance. In that case, it won’t void your warranty as long as the manufacturer approves the materials used (oils, lubes, and parts). If a dealer doesn’t perform the maintenance,

keep accurate records in case you need proof later.

In addition, commercial use of a boat usually voids the manufacturer’s warranty, and using an LLC to buy a boat could be construed as commercial use. Some manufacturers, such as Nitro, state that if a boat is registered to a corporation, or multiple persons (not a married couple), it’s assumed to be used commercially, and the warranty is void. Check with the manufacturer if you need more clarification. Federal documentation of ownership is not considered a commercial use. Racing, lack of proper maintenance, damage, abuse, installing too large an engine, and overloading the boat are all legitimate grounds for voiding a warranty.

Incidentally, manufacturers usually require that a new owner fill out a registration form within 15 days of purchase to validate the warranty. Federal law does not require doing this; however, it’ll likely make the paperwork process easier when repairs are necessary. It also gives the manufacturer contact information in case of a recall.

Q: My manufacturer was bought by another company. Will they honor my war ranty?

A: Not likely. When builders go out of business, the company’s assets, not the liabilities, will be sold to a new corporation, even if the name is the same and the ne w company keeps building the same boat. Not buying the liabilities frees them from having to honor warranties.

Ultimately, it’s better not to rely on a salesman’s assurance when they claim that everything will be taken care of. Instead, read the warranty or call the manufacturer to find out for sure. Warranties may be hard to navigate, but to head off surprises in the future, spend some time with yours.

A Southern California Fishing Guide with Something for Everyone

Southern California has picturesque landscapes where you can wake up by the beach and go to bed in the snow. The many different accessible landscapes make for not only great fishing, but they accommodate several different styles of fishing. Here are our recommendations for the best fishing spots in Southern California.

Lake Cuyamaca

Don’t let the size of this scenic 110acre reservoir fool you. Located an hour east of San Diego, Lake Cuyamaca’s fishing junctures are superior to local alternatives.

Fishing opportunities at the lake are offered year-round, stocked with vast populations of trout, catfish, bluegill, and sturgeon circling the waters. Lake Cuyamaca is also a favorite in California’s camping destinations—tents and la ke-view condos are available across the north shore. In addition, there’s a larger campground in Cuyamaca State Park, ma king it perfect for an RV road trip.

Diamond Valley Lake

Located between two mountain ranges near Hemet, this artificial reservoir is famous for its ginormous fish. Fishermen worldwide visit Diamond Valley Lake to partake in SoCal’s finest fishing—all while battling those 15-pound monsters.

Black bass, bluegill, channel catfish, and rainbow trout populate these waters. If you’re a shore-fishing aficionado, head west of the marina, where signs mark a designated 1.5-mile section.

Lake Gregory

Besides trout, the lake is home to an overload of native-born species. Populations of catfish, bullhead, bluegill and sm allmouth bass are among the residents of the lake. Every month, an orange-tagged fish is released into the lake an d marked at $1,500 for those who catch it.

Though fishing is accessible yearround, spring is the peak time at Lake Gregory—right after the lake is stocked. If you’re one to savor moments of solitude while fishing, avoid busy summer weekends.

Besides being one of the best spots for trout fishing in Southern California, Lake Gregory offers plenty of other recreational activities. Hiking trails, picnic areas, and a swimming beach compose this treasured terrain.

El Capitan State Beach

This sandy site is located 20 minutes north of Santa Barbara and is excellent for surf fishing. Surfperch dominate the waters of El Capitan State Beach, reaching an average of one to two pounds.

Th e coiled beach leads you north, where sand changes to rock. While fishing at the edges of the cliffs might seem enchanting, remember to be careful of the slippery surfaces.

Davey’s Locker

Maybe you’re a first-time angler or don’t have access to ocean fishing—experience Southern California sportfishing with Davey’s Locker located in Newport Beach—an excursion hosted by experienced anglers on the Orange County coa stline chartered with a crew of professionals. This charter will give you panoramic views of the Pacific while learning about marine life from the friendly and knowledgeable staff.

Santa Monica Pier

Located under a canopy of pine trees in the heart of the San Bernardino Mountains, fishing at Lake Gregory is delightful. A two-hour drive from Los Angeles will lead you to this rural 120-acre area home to brown and rainbow trout.

Every month, California’s Department of Fish and Wildlife stocks the lake with a large inventory of trout. Expert anglers

Extending about 1,000 feet beyond the tide, you will find various fish species from the Santa Monica Pier. You can find clams, black cod, walleye, mackerel, sea bass, corbina, rays, and other frequent visitors in these waters.

ANGLERS HOPING FOR BETTER WEATHER IN FEBRUARY

• With regard to fishing, the month of January in 2023 can be summed up by saying there were lots of days of bad weather that kept lots of anglers off the water. Many of the non-rainy days between storms were also days that were plagued by strong winds and high seas that kept boats tied to the dock. The good news is that despite all the days of bad weather there were also some good weather days when anglers were able to get out on the water and sample the fun wintertime fishing.

• I do not know of anyone out looking for bluefin tuna lately. The last reports are now several weeks old when boats were catching some 18 to 65 pound bluefin out by the Tanner Bank. A few days ago there were reports from a couple of boats that I believe were commercial drift net boats that were working in an area of relatively warm 62-plus degree water out by the Elephant Bank 125-plus miles southwest of Point Loma. As of their last report they had metered a couple of bluefin and had caught a swordfish along with a few makos and threshers. It was an area hold-

ing a decent amount of life as they were reporting having Humboldt squid, Spanish mackerel and greenback mackerel around the boat under the lights at night.

• With mostly bad weather during the month of January and with cool 59-to-60-degree water in local offshore waters there have been no recent reports of anyone trying to deep drop fish for swordfish. The most recent reports of local swordfish activity are now more than a month old but for someone who would like to give it a try in an effort to try and catch the first sport caught swordfish of 2023, areas that were last reported to have been showing signs of the possibility holding swordfish were the 9 Mile Bank, 178 Spot, the Radar Dome at San Clemente Island, the 152 Spot off the East End of Catalina, the Avalon Bank and 3.5 to 8 miles off Newport Beach.

• Some sportboats have been running 1.5-day trips down the Mexican coast to fish the Punta Colnett region and the area below Punta Camalu and they have been finding very good fishing for a mix of reds, salmon grouper, lingcod, and an assortment of rockfish and

have also found occasional yellowtail activity. The most recent trips found good fishing for the bottom fish species including lingcod but found the yellowtail fishing to be slow. If you do locate some Punta Colnett area yellowtail, best bets have been to try yo-yo iron or dropper loop fished sardines.

• Fish counts from the past weekend were Relentless out of H&M Landing that had 18 anglers out on a 1.5-day trip who caught 80 reds, 54 rockfish, 25 whitefish, 2 sheephead and 19 lingcod. Seaforth Sportfishing had Pacifica out on a 1.5 day trip with 14 anglers who caught 65 reds, 33 rockfish, 2 sheephead, 2 barracuda, 3 calico bass, 20 whitefish and 15 lingcod. Seaforth Sportfishing also had Tribute fishing a 1.5 day trip with 35 anglers who caught 105 rockfish, 60 reds, 64 whitefish, 18 lingcod, 3 calico bass, 7 barracuda and 8 sheephead.

• Very few boats have been fishing at Los Coronado Islands due to the recent bad weather but the few reports are that the surface fishing has been slow in the 59 to 60 degree water. There is usually very good bottom fishing for a mix of reds, assorted rockfish, sculpin and a few lingcod. The best areas for the bottom fishing have been to the northwest and to the north of North Island in 30 to 60

fathoms and at the hard bottom at the South Kelp Ridge below South Island in 25 to 50 fathoms. One of the best areas for lingcod where there have also been some sculpin, whitefish and sheephead biting has been at the Rockpile in 18 to 23 fathoms.
