UNITED STATES — In the dark and unfa-

miliar world that resides on the ocean floor, underwater fissures called hydrothermal vents exist to accommodate complex communities of life. These vents expel scorching hot fluids into frigid seawater, creating the chemical forces necessary for small organisms to thrive in this extreme environment.

Biogeoscientists Jeffrey Dick and Everett Shock have determined that specific hydrothermal seafloor environments provide a unique habitat where certain organisms can flourish.

This was determined in an Oct. 30, study titled, The Release of Energy During Protein Synthesis at Ultramafic-Hosted Submarine Hydrothermal Ecosystems, published in the Journal of Geophysical Research Biogeosciences by Dick and Shock; in so doing, they opened up new possibilities for life in the dark at the bottom of oceans on Earth and throughout the solar system.

“To grow and reproduce, organisms must synthesize biomass,” explained Dick and Shock in the journal. “In oxygenated conditions near Earth’s surface, this

is an energy-consuming process. Vastly different conditions prevail at submarine hydrothermal vents, where the mixing of oxygenated seawater with reduced fluids provides chemical disequilibria that sustain thermophilic microbial communities. Thermodynamic calculations for each protein in the genome of a model archaeal organism demonstrate the release of energy for protein synthesis from inorganic precursors over a wide temperature range in the mixing zone for fluids from an ultramafic vent but not a basalt-hosted one. These considerations point to particular submarine hydrothermal systems as hot spots of microbial proliferation for the fundamental reason that biomass synthesis is inherently favored, which is the opposite of the more familiar energetic situation in surface environments.”

On land, when organisms get energy out of the food they eat, they do so through cellular respiration, a process where there is an intake of oxygen and the release of carbon dioxide. However, for organisms living on the seafloor, the conditions for life are dramatically different.

“In other words, where there is life, there is water, but water needs to be driven out of the system for polymerization to become favorable,” said lead author Dick.

In 1894 Marconi began his experiments and was able to send a transmission 1.5 miles; however, his work was not encouraged in Italy. He moved to England in 1896, where he built his own wireless telegraph company, according to Oxford Open Learning.

Marconi succeeded in send-

ing a transmission over the English Channel in 1899, shortly before the jump across the Atlantic.

The transmission across the Atlantic is considered one of Marconi’s greatest achievements; in 1909, Marconi was jointly awarded the Nobel Prize in physic s w ith Ferdina nd Braun, another innovator in radio, after successfully sending a radio transmission from England to Australia.

Marconi passed away in 1937 at 63 years old. On the day of his funeral, the BBC observed two minutes of radio silence as a tribute to his contributions to broadcast.

—On Dec. 1901, Guglielmo Marconi, an Italian physicist, and radio pioneer, succeeded in sending the first radio transmission across the Atlantic Ocean.

The transmission was a simple ‘s’ in morse code that traveled more than 2,000 miles from Cornwall, England, to Newfoundland, Canada.

At the time, critics of the project told Marconi that the radio signal would be interrupted by the earth’s curvature and, therefore, the project would be unsuccessful. Nevertheless, Marconi continued with the project believing that the radio waves would follow the earth’s curvature.

migrated out of Fishing Zones 1 and 2, and crabs in those zones have passed quality testing. The commercial fishery north of the Sonoma/Mendocino County line to the Oregon state line opened on Dec. 1, allowing commercial crabbers to get crab on tables and menus before the year is finished. The commercial fishery is currently open in Fishing Zones 5 and 6, from Lopez Point in Monterey County to the Mexico border. The commercial fishery will continue to be delayed in Fishing Zones 3 and 4, from the Sonoma/ Mendocino County line to Lopez Point, due to the high numbers of humpback whales in the Gulf of the Farallones and Monterey Bay and the possibility of entanglement in trap gear. Early reports of successful crabbing are coming in from recreational crabbers in Fishing Zones 1 and 2 and those using hoop nets in Fishing Zones 3 and 4. Therefore, the recreational fishery for Dungeness crab is open statewide with a temporary crab trap restriction for Fishing Zones 3 and 4.

The temporary trap restriction does not affect the recreational take of Dungeness crab by other methods, including hoop nets and crab snares.

has extended the public review period for the Draft Program Environmental Impact Report (EIR) for the Port Master Plan Update (PMPU). The public review and input period will now conclude at 5 p.m. on Jan. 10, 2022. Previously the period was set to close on Dec. 23. The postponement comes from the Port’s encouragement for all feedback. In a press release from Nov. 24, the Port says they are grateful for the community’s enjoyment in the PMPU process.

The plan determines where port activities should occur, where recreational amenities should be located, and where commercial uses like hotels, restaurants, and visitor-serving retail may be built.

After years of conservancy by the U.S. Air Force, the Okaloosa darter has made a noticeable recovery. As a result, the U.S. Fish and Wildlife Service (Service) determined the small fish, found exclusively in two counties in Florida, no longer faces the threat of extinction and does not warrant listing under the ESA. “The recovery of the Okaloosa darter is another ESA success story,” said Estenoz in the Nov. 16 press release. “This rare fish would not have recovered from the brink of extinction without the planning, efforts, and long-term commitment of the U.S. Air Force as well as the leadership and dedicated staff from Eglin Air Force Base.” To guarantee that the fish remains healthy and secure from the risk of extinction after it is delisted, the Service is also offering an available draft post-delisting monitoring (PDM) plan. They are seeking information, data, and comments from the public regarding the proposal to delist the Okaloosa darter and on the draft PDM plan.

Accepted comments and information will be received or postmarked on or before Jan. 18, 2022. Comments submitted electronically using the Federal eRulemaking Portal must be received by 11:59 p.m.

IN MEMORIAM: PETE GAASLAND NEWPORT BE ACH — Pete Gaasland

passed away on Nov. 12. Pete was a marina industry pioneer and a member of Bellingham Marine’s founding family.

Pete was an accomplished businessman and a driving force behind the mass adoption of the concrete floating dock systems for marinas.

Pete was born in Bellingham, Washington, to Roy and Hazel Gaasland on April 11, 1937. He attended the University of Washington, where he graduated in 1959 before beginning his maritime career with Bellingham Builders Supply. He took over the business in 1968. The company became Bellingham Marine Industries before he sold the company in 1995. Many iconic

projects were built during Pete’s tenure with the company, but perhaps the most notable was the Port of Seattle’s Shilshole Bay Marina.

This 1,500-slip marina established the company’s reputation and products as a leader in the field of marina design and construction.

“The Bellingham Marine team is saddened by the loss of Pete Gaasland. We extend our sincere condolences and sympathy to Pete’s family. Our thoughts are with them during this difficult time,” said Joe Ueberroth, the current owner of Bellingham Marine.

law may step in to fill the gap. For example, the foreclosure of a maritime lien that may arise from a failure to payslip rent would proceed under maritime law principles. But the slip rental contract is prepared according to California state law and it may provide remedies that circumvent the procedures used under maritime law.

So what does California law say about a slip rental agreement? Not much. California has enacted a number of tenant protection laws over the past few years, including both general protections relating to rent increases and evictions and laws that are specific to COVID. But these laws do not apply to marina tenancies.

Most of the statutes that provide protection to renters in California are set forth in sections 1940 through 1954 of the California Civil Code. Section 1940 specifically limits those protections to persons who rent “dwelling units” in California.

Dwelling units are then defined as a structure on real property.

A boat is not a structure on real property. More to the point, a boat slip is not a structure on real property. Marina tenants who live aboard their boats are not renting their homes. They own their home and are renting a parking space.

There are no statutes or regulations enacted in California that specifically apply to a slip rental agreement.

We should note that California has an interesting set of laws that regulate a similar environment. The California Mobilehome Residency Law (Cal. Civil Code sec. 798) regulates occupancy, rental, and eviction procedures relating to mobile homes in California. A mobile home park is similar to a marina, in that the

tenant owns the unit but rents a parking place. But as noted above there is no specific set of laws dealing with a marina tenancy.

So with this in mind, is there any legal framework that controls the rights and remedies of the parties in a marina tenancy? The answer is “yes,” but we need to refer to general contract law. Slip rental agreements are month-to-month commercial contracts for the rental of a patch of water with an adjacent dock. Monthto-month agreements may be terminated or modified - by either party - on 30 days’ notice. This means that the boat owner may terminate the tenancy by providing 30 days’ notice. But of course, the more problematic event is when the marina exercises this right, similar to the problem faced by our reader. Returning his question, the marina is free to raise the rent and the security deposit at any time, so long as they provide 30 days’ notice to their tenants. And there are no “grandfather” rights.

Boat owners don’t have a lot of options when faced with a slip rent increase or an eviction. Contact an experienced attorney if you are faced with any of these issues.

Cause and Effect of Southern California’s Congested Ports cargo ships in Southern California’s busiest ports, Long Beach and Los Angeles has grown in recent weeks, creating a supply chain crisis As a result of the COVID-19 pandemic, an increase in buying consumer goods that were further buoyed by stimulus funding has overwhelmed the ports, averaging about 900,000 containers per month since the summer of 2020.

Proposed short-term solutions include convening with supply chain stakeholders to enhance system capacity, move towards a 24/7 operation, promote and share information, and closely monitor real-time system performance indicators through the Port Optimizer to assess the situation and develop policy and operational responses.

On Oct. 13, the Biden administration made a vow to expand port operations to address the problems accumulating amid an overwhelming demand for imported consumer products and a shortage of trucks, drivers, and warehouse workers. In addition, FedEx, and UPS, two of the U.S.’s biggest freight movers, have committed to significantly increase the number of goods they are moving at night.

The two ports take in 40 percent of the nation’s imported goods, and as of Oct. 19, there were 153 ships at anchor, berthed, or “loitering” outside of the ports, and more than 100 of those ships were containers, waiting to unload thousands of containers outside the ports. The backlog left ships drifting in the waters outside the ports for weeks, and the jam is expected to last into next year.

The average waiting time for a cargo ship to complete its process throughout the Port has doubled in the wake of the import surge. Before the surge, truck-

bound cargo typically left the port terminals in less than four days. In addition, the lack of industrial storage space has posed a problem for the region.

On Oct. 25, it was announced that fines will be implemented for idling cargo ships. The fines and are designated to keep the supply chain moving.

WHAT’S ON TAP : On Nov. 22, the ports of Los Angeles and Long Beach announced they would once again be pushing back the start of a new fine for idling container ships. The container fee program started on Nov. 1 and was going to charge ocean carriers $100 per container; the fine increased by $100 per container per day until the cargo ship moved. The condition of the dwell fee is that containers that are ready for truck transport have nine days before fines begin to incur. After the allotted nine days expires, a $100 fine per container will be implemented with an additional $100 every day the container remains in the Port. In addition, containers destined to be moved by rail would be charged a fee if they sat on the docks for six days or more.

A second delay of fines was implemented after a meeting with U.S. Port Envoy John Porcari, ocean liner companies, and marine terminal operators; officials say the container dwell fee would remain on hold until Dec. 6.

The decision to delay the fines was determined by the cargo ship backlog contributing to a national supply chain problem. The amended container dwell fee was presumed to go into effect on Nov. 22 but was rescheduled to go into effect on Nov. 29 and then again to Dec. 6. The postponement comes after both ports have progressed, with significant improvements in clearing the bottleneck The ports of Los Angeles and Long Beach are now also receiving aid from Navy officials at the Port of Hueneme to unload at a smaller port in Ventura County.

launched Fish to Families, a program that buys fish from local fishermen and distributes healthy, fresh, and sustainable seafood meals to people in need. The program has been running for a year and is currently blossoming during the holiday season.

Fish to Families is overseen by the San Diego Fisherman’s Working Group and Chef Phillip Esteban with his group OpenGym, a self-sustaining nonprofit based in San Diego; and is funded by the San Diego Foundation with support from Marine Alliances Consulting who leads the efforts to find and secure funding. Meal distribution to those in need is supported by charitable community organizations, including Father Joe’s Villages, Good Neighbor Project, Our Savior Lutheran Church, Olivewood Gardens, and Project New Village. Marine Alliances Consulting has and continues to lead efforts to find and secure financial support for the program.

California Sea Grant Extension Specialist Theresa Talley and National Oceanic Atmospheric Administration Fisheries Biologist Sarah Shoffler have created educational evidence presented with the meals meant to inform San Diegans about their local commercial fishing community and the sustainable seafood products they provide. They are also helping to track program impacts.

A similar program began in Honolulu during the summer of 2020; the City and County of Honolulu established the “Fish to Dish” program using Coronavirus Aid, Relief, and Economic Security (CARES) Act funds.

When the pandemic shut dow n restaurants and halted tourism, the fishing industry suffered some steep declines, but fresh fish is also an important food source for Hawaii residents, who eat twice as much seafood as average Americans. The “Fish to Dish” program is supporting Hawaii’s longline fishing industry and distributing fresh fish to communities across the island of Oahu. In addition, the program offsets vessel operating costs, and gets longline fishermen back out on the water to catch fish and supplies funds to purchase the longliner’s fish at auction. The program has ultimately donated more than 110,000 pounds of filleted fish to local k puna (seniors) and families in need.

Port of Hueneme and NBVC Have Joined to Alleviate Cargo Backlog in L.A. County

The Port of Hueneme is vital in the intermodal logistics supply chain and significantly contributes to the economic health of Ventura County and Southern California.

The Port generates more than $1.7 billion in economic activity, annually.

Base Ventura County (NBVC) announced it is lending its resources to help ease the bottleneck at Southern California’s ports along with the Port of Hueneme.

The announcement discussed an activated long-standing joint-use agreement (JUA) between the NBVC and the Oxnard Harbor District (OHD) and Port of Hueneme to help decrease the port congestion in Los Angeles County and ease the national supply-chain shortage. The JUA, which was activated this month to make Port Hueneme available to cargo ships waiting to unload their shipments off the ports of Los Angeles and Long Beach.

Resources that are being lent by NBVC include the additional space of the Navy’s famous construction battalion, the Seabees, the West Coast homeport of the Navy’s battalion. The Port of Hueneme complex is not only an international shipping business but is also an operating facility of NBVC. The Department of the Navy entered in a JUA with OHD in 2002, which authorizes commercial use of Wharf 3 which in onboard NBVC, including approximately 21 acres of neighboring land, buildings 546 and 548, and if available, another 10 acres of industrial land located outside the Wharf 3 area.

NBVC is composed of three facilities, Point Mugu, Port Hueneme, and San Nicolas Island, and is home to the Pacific Coast Seabees, the Westcoast Hawkeyes, three warfare centers, and the Navy’s “ghost fleet” of unmanned air and sea vehicles.

According to Jason Hodge, the President of OHD, which owns the Port of Hueneme, the commercial business at the Port of Hueneme has already increased significantly over the past year. The Port has been accommodating and flexible throughout the whole process.

In a press release put out by the Port of Hueneme Hodge said, “The Port appreciates the partnership with NBVC and locating additional space to accommodate excess holiday shipments coming through the Port. We are delighted to come together to meet the challenge of providing a solution to help keep essential goods moving. Keep Up With CARB: Where CARB is at with proposed engine regulations.

CARB has heard the pleas of the boating and fishing industry and some board members agreed with the expressed concerns. Next up, CARB will consider all the public comments and hearing testimony and could potentially amend the draft regulations based on the direction of the board, come 2022.

CALIFORNIA— On Nov. 19, the California Air Resources Board (CARB) listened to public testimonies from boat owners, anglers, marine-life enthusiasts, nonprofit organizations, marine operators, and small business owners about the proposed engine emission regulations that are to be implemented in 2023, and decided to revisit the regulations in 2022.

No action was settled upon and will be reevaluated and addressed in 2022 as well.

In addition, over 20,000 anglers signed a petition pleading with Governor Gavin Newsom to “Save Our Boats,” which began circulating on Sept. 28.

The petition asks Newsom to intervene before CARB implements engine emission regulations that if approved, will devastate small family-owned fishing and whale watching boats.

“The CARB board heard from boat owners that the proposed regulations are economically and structurally infeasible for their family operations,” said Ken Franke, president of the Sportfishing Association of California, in a press release from Nov. 22. “They also heard from Californians concerned that as boat owners go out of business, they will be denied access to offshore fishing and marine life and with this comes economic consequences for their coastal economies.”

Several board members acknowledged their mutual concerns with the testimonies, recognizing that boat owners are family-run businesses and that the feasibility, time allotted, and accessibility are all changes and regulations that need to be addressed in a matter that allows these concerned people to succeed.

“We are encouraged that some members of the board recognize that passenger boats are family-operated businesses, providing a valuable service to their community and that they are worth protecting,” said Franke in the press release.

“Boat owners have been repowering to lower emission engines for years, and we remain committed to the environment.

We just need to find a reasonable solution that does not require boats to be removed from the waters.”

The CARB board is expected to revisit the proposed regulations in early 2022; however, the extent of the revisions to the draft regulations has not yet been addressed.

“We just don’t know to what extent the current draft will be amended, if at all,” according to an anonymous source.

“If the current draft is amended the new draft is likely to go out for public comment once again before returning to the board for a vote. It is our understanding that if the changes are modest, the public comment period could be short and if substantial, the changes would circulate publicly for a 45-day period (like last time). We believe the next hearing will be 1Q next year, but this is mere speculation at this time. CARB’s website has no updates.”

A significant factor that weighs against CARB’s proposed regulations is that these proposed emission regulations have never been tested anywhere else in the country. CARB is aware the engines are infeasible, as they would require commercial passenger sportfishing and whale watching boats to be removed from service.

In the press release sent out by the Sportfishing Association of California (SAC), David Quiros, the manager of the freight technology section at the Air Resources Board, told the Los Angeles Times he believes that the majority, if not all, of the sport-fishing vessels, will need to be replaced to comply with the proposed regulations.

The board, charged with protecting public health by cleaning up the air in California, first adopted regulations for com-

mercial harbor crafts in 2007, amended them again in 2010, and is doing it again now. CARB drafted proposed regulation amendments in Dec. 2018, when they hosted a workshop that addressed the beginning of a feasibility study with Cal Maritime Academy and distributed surveys to owner-operators. The draft plan sparked concerns throughout several divisions of the fishing and boating industry, but CARB continues to review the plans as they move towards its future solidification.

The United States Coast Guard is responsible for regulating passenger vessels and has yet to approve the installation of the new engines. The proposed technology would upgrade boat engines to a Tier 4 engine, a model that has only been used on tractor-trailers and farm equipment.

However, the tier 4 engines have been known to overheat, stall, and catch fire, an unfortunate situation that is easier to handle on land than in water.

As a maneuver against CARB in their long-standing battle, SAC released an economic analysis that undermines CARB’s contention that it is economically feasible for boat owners to replace their vessels entirely. Many of the boats are constructed from fiberglass or wood, and because the Tier 4 engines run hotter, the vessels would need to be made of steel, resulting in the necessary need to buy new vessels. As a result, the regulations stand to remove 174 sportfishing and whale watching boats from the sea.

The analysis revealed the unintended consequences for the state’s economy, fishery, and conservation programs and the significant decline in fishing participation rates. The hardest-hit communities are expected to be the low-income ones.

Aquarium of the Pacific has opened its doors for visitors to experience the holidays with some new and old friends under the sea.

The Aquarium of the Pacific unveiled the newest resident in Shark Lagoon just in time for the holidays. A new sandbar shark can be seen cruising around the lagoon this holiday season.

“The sand bar shark has been with us in holding for a couple of months, and we just recently released her in our shark lagoon exhibit about a month ago,” said Rachel Munson, aquarist with the Aquarium of the Pacific. “We wanted to make sure that she was doing really well before announcing her, and she is doing so well in here; she is eating a lot and behaving well, and we are so happy to see her doing well in here.”

Sandbar sharks are one of the world’s largest coastal sharks; their name stems from their preference for sandy bottoms of the ocean. These

sharks generally don’t have distinctive markings or color patterns. Still, the newest aquarium resident has a beautiful bronze color that helps her stand out from the others swimming around in the tank.

She doesn’t have a name quite yet, but she plays an important role in the survival of her species.

“She came from another association of zoos and aquariums,” said Munson. “...It is really exciting, especially since sandbars are a vulnerable species out in the ocean, and so by having breeding programs in zoos and aquariums it really helps with populations not only within zoos and aquariums but also there is potential for releasing at a later time.”

Santa really ends up in the strangest of places while delivering gifts. A Santa diver at the Aquarium of the Pacific can be seen throughout December diving to the bottom of the Blue Cavern exhibit in the Aquarium of the Pacific’s Great Hall of the Pacific.

“Our holiday events last through Dec. 23,” said James Stewart, exhibition supervisor at the Aquarium of the Pacific. “The weekends will have most of our events going on and things to do, but you can come and see our decorations and our aquarium holidays materials throughout the month. Every weekend we will have the option for people to have their picture taken with our Santa diver; we will have animal treats going in at different times of the weekends.”

Aside from photo-op visits with Santa, guests will be able to experience Holiday Treats for the Animals Festival.

Keepers will be doling out holiday-themed treats to their marine-based charges at special times on weekends throughout the month.

Part of the joy of the aquarium is seeing the animals, and in some cases, you can even interact with them up close.

One of the charitable events the aquar ium r uns year-round is an adopt-an-animal program that allows guests to give back to our aquatic friends.

Donated funds help to fund educational programs, conservation initiatives, animal rehabilitation work, and animal breeding efforts.

You can adopt a penguin, like Gatz, a four-year-old Magellanic penguin who calls the aquarium home, or donations could go towards efforts to save sea birds like the juvenile, yellow-craned night heron nicknamed Batman, who was rescued earlier this year.

The Aquarium is following COVID19 protocols to keep staff and animals safe; visitors will need to make reservations in advance and wear a mask that covers their nose and mouth.

ISLAND YACHT ANCHORAGE The aquarium ramped up the holiday spirit with decorations spread throughout the exhibits and buildings to bring in a little holiday cheer.

Peppermint sticks and salt water-friendly Christmas trees were placed in exhibits throughout the aquarium, and lights were strewn throughout the halls, all in the spirit of the holidays.

the Bureau of Ocean Energy Management (BOEM) publicly announced they received bids for blocks offered in the Gulf of Mexico (GOM), Outer Continental Shelf (OCS), Gas Lease Sale 257, and Gulf of Mexico Lease Sale 257. The bids generated $191,688,984 in high bids for 308 tracts covering 1.7 million acres in federal waters off the Gulf of Mexico. All bids were received by BOEM prior to the sale, on Nov. 16 by 10 a.m.; bids were accepted by mail only.

BOEM has 90 days to accept or reject bids. Part of that determinization includes a two-phase post-sale bid evaluation process to determine whether a bid has met the fair market value requirement. Under its bid adequacy procedures, BOEM reviews all high bids received and evaluates all blocks using either tract-specific bidding factors or detailed tract-specific analytical factors to ensure that fair market value is received for each OCS lease issued. This bid adequacy process relies on both evidence of market competition and in-house estimates of tract value. If fair market value is determined to have not been received the bid is rejected.”

Thirty-three companies participated in the lease sale, submitting $198,511,834 total in bids.

Leases resulting from this sale include stipulations to protect biologically sensitive resources, mitigate potential adverse effects on protected species, and avoid potential conflicts associated with oil and gas development in the region.

Dana Wharf also announced that kids can whale watch for free throughout the month. With every purchase of two full priced adult tickets which cost $56 each, one child (up to the age of 12) is free.

Ventura Harbor Village’s Annual Winter Wonderland and Holiday Marketplace VENTURA— Ventura Harbor Village will host their annual Winter Wonderland and Holiday Market Place on Dec. 11 from 12 - 4 p.m.

The event will have a visit from Santa and Mrs. Claus and their team of live reindeer, live carolers, and a faux snowfall to bring in the holiday season.

The event will also host a Canned Food Drive benefitting Food Share Ventura County; participants who bring in ten cans will receive a free reindeer antler headband. Participants will be guided through the hunt by their smart phones, as teams try to make their way among well-known and overlooked gems of Avalon city while solving clues and completing challenges focused on the local history of Catalina. There are five quests available to choose from: Quest Walking and Walking2, Quest on bicycles, Quest on golf cart/walking and Quest Cart2 (cart only). Bicycles and golf carts can be rented at Brown’s Bikes, or Island Rentals Golf Cart Rental, both located on Pebbly Beach Rd. immediately after the ferry terminal. The quest begins when you want, and you play at your own pace. The quests will begin and end at the Green Pleasure Pier; it is a 1.9-mile journey that lasts two to two-and-a half hours. Significant points throughout the quest are the beach front, the Catalina Island Yacht club, the casino, city hall, the city park, and the Green Pleasure Pier. The price of a ticket for a team of 2-5 people is $49, prices vary by team size.

HUNTINGTON BEACH — On March 2, 2015, the city of Huntington Beach witnessed a very rare snow day. Although the white blanket that covered the sand on the beach was actually hail, the beach city was transformed into a winter wonderland for one day. The hail pellets were up to a quarter of an inch in diameter, relative to the size of a BB bullet or a pea, and covered the city an inch deep. The hailstorm occurred due to a convective rain shower with a fair amount of precipitation.

Residents of Huntington Beach got excited as they all made their way down to the pier to see the white dusted shoreline, surfers made snow angels, and kids made miniature snowmen. The hail had melted by the late afternoon. The beach was subject to a “special marine warning” from the weather service, which said a cluster of strong thunderstorms were centered on Huntington and Newport beaches at about 10 a.m., with the possibility of waterspouts. March 2, 2015 is the last day Orange County saw “snow” on their shores but according to the National Weather Service San Diego forecaster Mike Watkins, hail in warm beach cities is not unheard of nor is it a phenomenon.

Sailing The History of the America’s Cup Tradition By: KATHERINE CLEMENTS

will be raced in New Zealand between the Royal New Zealand Yacht Squadron and either the United Kingdom’s Royal Yacht Squadron Racing Ltd or the winner of a challenger series, such as the 2021 Prada Cup. The 37th America’s Cup follows Emirates Team New Zealand’s successful defense of the 36th Americas Cup in 2021 in Auckland, New Zealand. As a result, the Kiwis will again be the Defender when the next America’s Cup gets underway.

The Cup will be raced between the Defender; a yacht, not yet to determined, representing The Royal New Zealand Yacht Squadron (RNZYS), and the challenger; a yacht representing the United Kingdom’s Royal Yacht Squadron Racing Ltd. The America’s Cup has a long-standing history and tradition. American Yachtsman Dennis Conner lost the America’s Cup in 1983. Conner, now a contender for San Diego Yacht Club, is the world’s most successful Americas Cup skipper

NEW ZEALAND —The 37th America’s Cup

Emirates Team New Zealand and Oracle Team USA competed in the America’s Cup sailing races in San Francisco on Sept.12, 2013, the last time the cup was in America. after winning it four times throughout 1974, 1980, 1987, and 1988. Conner has mounted a multi-boat campaign, trailed boats in the mighty winds of Hawaii, and beat the Australian Defender of the Cup

to become the first person to both lose and then win back the America’s Cup. Because of Conner’s victory, the Cup was next held in the notoriously smooth sailing of San Diego in 1988. Conner admits

there was brief consideration to host the races in Hawaii, but the club’s authority had no part in the abandonment of tradition. Defenses are held in the home waters of the winning club, a tradition that is not up for debate.

The tradition continued with two exceptions. First, when the competitive sailing team Alinghi won in 2003, their home lake in Switzerland did not have ample climate, which prompted in 2007 what many consider the high-water mark of the event with 11 challengers in Valencia, Spain; in 2017 when the pursuit of commercialism took the event to Bermuda.

The yacht Te Rehutai is owned and sailed by the Emirates Team New Zealand syndicate, the successful defenders of the 36th America’s Cup in March of this year. The winner holds an important role. The winner decides the format, type of boat raced, and the venue. This role gives the British team a top-tier seat for the first time, opening the possibility for the next Cup to be held in the U.K. The Cup has not been held in America since 2013, when it took place in San Francisco.

will host their second annual Pancake Breakfast on Dec. 11 at 10 a.m. to benefit their Adopt-a-Family campaign through Human Options.

Low Tide began working with Human Options, an Irvine-based non-profit focused on assisting families in need only last year.

During the holiday season, Human Options will assign in-need families to groups or organizations looking to give back. The families submit a list of clothing and shoe sizes, favorite colors, potential gift ideas for the kids, and a list of basic needs. The lists are given out to those looking to give back, and the organization will then give the gifts to those families.

Brandy Hyham, a co-founder of Low Tide Yacht Club, had worked with Human Options previously through the Marriot.

When the hotel stopped participating in the fundraiser during COVID-19, Hyham took the idea to the yacht club.

“We took it upon ourselves, starting last year, to take it to the yacht club and say hey, we were looking for a second kind of donation group to do a fundraiser for because we want to do two a year,” said Hyham. “They all agreed that this would

be the perfect thing to do for us because we are all parents and grandparents, and you know [you] want to give back to the community.”

As part of the campaign, the club runs a pancake breakfast where people can come over to Dock 17 in Alamitos Bay and get some pancakes and mimosas while they drop off gifts or just donate money in a collection jar.

“Brandy and I try to set it up as a social event, come on over socialize, have some pancakes, wish everyone a Merry Christmas, but the whole goal is to collect money,” said Steve Hyhamn, a co-founder of Low Tide Yacht Club. “How much money can we get to support the families and bring everybody together… It is open to anybody who wants to contribute. It is basically a thank you.”

Last year the club raised $800 for a family in need. Unfortunately, because of COVID-19, they were unable to buy actual gifts, and were limited to gift cards; this year they, have taken on three families and are looking to make it the best Christmas they can.

“We decided to take on three families this year because everybody was so generous last year and loved to do it,” said Brandy. “...We try to go above and beyond what they put down and really try to give them good gifts and make their kids be

took on the 2021 annual Skiff and Nacra World Championships in Oman Nov. 16Nov. 21. Teams, including recent Olympic competitors Stephanie Roble (East Troy, Wis.) and Maggie Shea (Wilmette, IL) in 49erFX, walked away with what is reported to be some of the best scores the U.S. team has seen in decades. US Sailing reported that the final fleet and medal race delivered strategic execution and nail-biting finishes, with U.S. teams ranking among the world’s best.

Ian Barrows (St. Thomas, USVI) and Southern California local Hans Henken (Coronado, Calif.) tied for third place in the final race and placed fourth overall, leading the pack for the U.S.; Andrew Mollerus (Larchmont, N Y) and Ian MacDiarmid (Delray Beach, Fla.) placed sixth. “This was our first Worlds as a team, so our goal was to finish tenth in the fleet races and get a shot at the medal race,” said Hans Henken in a Nov. 21 article from US Sailing. “Heading into the

medal race with at least a top-10 finish locked in gave us a sense of freedom to sail and lay it all out on the water. We executed, we had fun, and we walked away with a 4th place finish. We’re proud of what we accomplished as a team and are just really stoked.”

Southern California Lifts Fishery Closures By: JORDAN B. DARLING SOUTHERN CALIFORNIA— The California

Department of Fish and Wildlife lifted the closure on Southern California fisheries on Nov. 30.

Fisheries were reopened after a notification from the Office of Environmental Health Hazard Assessment (OEHHA) was sent to the CDFW informing them

that there was no further risk to public health from consuming fish or shellfish from the affected area.

The closure prohibited the take of fish and shellfish from Huntington Beach and Dana Point, including shorelines, offshore areas, and bays.

The closure was prompted by the Oct. 2 Southern California oil spill and was signed on Oct. 3 after the OEHHA deter-

mined there was a threat to public health from consuming fish in the area.

On Oct. 5 and 7, the original closure area was expanded to include 650 square miles of marine waters and 45 miles of shoreline, including all bays and harbors from Seal Beach to San Onofre State Beach.

The OEHHA sampled catches in the area from Oct. 14 to Nov. 3 to evaluate lev-

els of polyaromatic hydrocarbons (PAHs), which are found in oil and can accumulate in fish and other marine life that, if consumed, can cause an increased risk of cancer and other health conditions.

The final reports and data summaries will be made available to the public at https://oehha.ca.gov/.

passengers got to see a rare orca pod sighting in Dana Point.

Six orcas, also known as killer whales, were spotted between Dana Point and Laguna Beach. Although it has happened before, it is very rare to spot a pod of orcas in Southern California waters.

The vessel passengers thought it was a pod of dolphins at first; upon realization that they were orcas, the Captain immediately called to other boats to keep track of them.

Improving Conditions Calls for the Release of Two Million Chinook Salmon CALIFORNIA — On Nov. 19, The California Department of Fish and Wildlife (CDFW) announced they have begun releasing juvenile fall-run Chinook salmon into the Klamath River in Oregon. The progress comes after watching river conditions improve with cooler temperatures and increased flow. The river’s improvement will give the young salmon the best opportunity for survival on their journey to reach the Pacific Ocean. In addition, the release of these fish will ultimately benefit commercial, tribal, and recreational fisheries and preserve the innate value of the fish and their genetics for the Klamath River population.

More than two million baby Chinook salmon were hatched in 2021 at the CDFW’s Iron Gate Fish Hatchery in Siskiyou County in Northern California. The baby salmon were held at three different facilities throughout California, including one million fish which were trucked to the Trinity River Hatchery through Redding. All three groups of fish did exceedingly well over the triple-digit heat waves that took place over the summer.

The Chinook salmon is the largest species of Pacific salmon averaging 37 pounds.

Some Chinook salmon are protected under the Endangered Species Act (ESA) depending on where they live. In the Klamath-Trinity River, the species is a candidate for the ESA. According to scientific projections, drought conditions impacting the Klamath River, including a disease outbreak of

the parasite Ceratonova shasta from earlier this year, were projected to kill about 90 percent of the young fish if the young

salmon had been released into the river.

So far, the CDFW has released 1.1 million of the juvenile Chinook salmon that were raised in the Iron Gate Fish Hatchery into the Klamath River. The release of those salmon provided room and sufficient water quality for the one million salmon that were relocated to the Trinity River Hatchery that will now return to Iron Gate Fish Hatchery. These fish have spent several weeks at Iron Gate to begin reacclimating to prepare them for the Klamath River.

Four different Klamath River dams are being targeted for removal in the upcoming years, the largest dam removal project in U.S. history. The elimination of these dams is predicted to restore fish access to historic salmon habitat in multiple rivers and tributaries that connect to the upper Klamath River above the dams. As a result, it is possible that the juvenile fish that have been released this year could be the first salon to return to a new Klamath River after their time spent in the ocean.

In addition, these fish are likely to find miles of additional spawning habitat and contribute to future wild fish generations.

san diego fish report EARLY DECEMBER OFFSHORE FISHING STILL OFFERING BLUEFIN TUNA, YELLOWTAIL, AND SWORDFISH!

By Bob Vanian of 976Bite.com SAN DIEGO— Recent years have seen

Southern California’s offshore fishing season last well into the month of December and this year is currently in line with that trend with the first part of December seeing offshore anglers catching bluefin tuna, yellowtail, and swordfish. The absence of powerful northern and western weather systems continues to allow the water temperature to remain at around 64.5 degrees where the bluefin has been biting at the Tanner Bank and good numbers of bluefin have been content to hold in the area with the current water conditions.

Recent bluefin catches have been made up of fish that have mostly been running from 25 to 80 pounds with a chance at locating some larger bluefin to 100-plus pounds still in the picture. It has been a while since I have had reports of bluefin biting that have been up into the 200-pound class.

Bluefin have been biting on sardines, mackerel, kite-fished frozen flying fish, flat fall jigs, and knife jigs with an occasional trolling strike also coming on spreader bar trolling rigs. What has also been effective at times and that has helped to target larger bluefin has been to slow troll live mackerel in areas where you are getting meter marks, sonar marks, or finding spots of breaking fish.

Boats that have been deep-drop fishing for swordfish report seeing occasional spots of breaking bluefin tuna off the backside of the 9 Mile Bank, at the Coronado Canyon, and around the 178 Spot. Most of the time the boats that see these fish are drifting with their deep drop gear in the water and do not chase after the bluefin they see. That aside, the common report from those that have tried to present baits and lures to the bluefin seen in these areas is that they do not seem interested in biting.

After a week or so of seeing the deep drop fishing for swordfish on the decline, the deep drop fishing for swordfish has rallied and boats in the San Diego region have once again been scratching out an occasional swordfish by deep drop fishing areas such as the Coronado Canyon, the 9 Mile Bank and the 178 Spot. The upper end of the 9 Mile Bank and the 178 Spot have been the best. There was a recent report of a boat catching two swordfish while in the region of the upper end of the 9 Mile Bank and the nearby 178 Spot.

The best areas around the Tanner Bank have been fishing to the northwest, the north, the east, and the southeast of the Tanner Bank high spot. A good overall depth range has been in 40 to 250 fathoms with a good percentage of the bluefin activity being found within the 50 to 100-fathom depth range.

The most recent fish counts start with Seaforth Sportfishing Capt. Bob Woodward Jr. with his 140.8-pound that reports that Pacific swordfish, caught near 178 Spot in San Diego.

Voyager got back from a 2.5day trip that saw 17 anglers catch 68 bluefin tuna and 27 yellowtail. The bluefin aboard Pacific Voyager was reported to have ranged from 35 to 80 pounds.

There were two swordfish caught Point Loma Sportfishing had New Lo-An by boats fishing the 178 Spot and upper return from a two-day trip that saw end of the 9 Mile Bank on Dec. 5. Woodard said he fought the fish solo for 2 hours and 10 minutes before help came aboard from Priceless and that it took another 20 minutes to get the fish to gaff and boat it. Woodard was thankful to the Captain and crew of Priceless for their assistance.

There have not been any recent reports coming from Los Coronado Islands but the most recent reports were of good fishing for a mixed bag of bonito, calico bass, reds, rockfish, lingcod, and whitefish to go with a chance at scratching out yellowtail.



At last report, the yellowtail fishing around Los Coronado Islands was slow but there was a chance at finding yellowtail along the weather side of North Island, at the Middle Grounds, or the South Kelp Ridge. At last report, there had also been occasional flurries of bonito activity, and the best areas for a chance at finding bonito were along the weather side of North Island and at the Middle Grounds. Most of the bonito were the smaller-sized two to threepound fish which were biting on trolled cedar plugs and sardines. The best areas for calico bass were the South Kelp, the Ribbon Kelp, and the Middle Grounds.



The best zone around Los Coronado Islands for bottom fishing that has been producing a mix of reds, salmon grouper, rockfish, and an occasional lingcod has been working hard bottom areas to the north and northwest of North Island in the 30 to 50-fathom depths. The outer part of the South Kelp Ridge below South Island has also been a productive area for the bottom fishing in the same 30 to 50-fathom depths.



The fishing along the San Diego County coast remains good for a mixed bag of reds, rockfish, whitefish, sculpin, bonito, and bass. The fishing for yellowtail along the San Diego County coast has been slow but there has been occasional yellowtail activity reported at the upper end of La Jolla.



If you find yellowtail working on the surface, good choices would be surface iron, slow trolled sardines, slow trolled mackerel, fly lined sardines, and fly lined mackerel. Try using yo-yo-ed iron, dropper loop fished sardines and dropper loop fished mackerel should you locate yellowtail meter marks.



Productive areas for the mixed bag coastal fishing for bass, sculpin, whitefish, reds, and rockfish have been hard bottom areas around the Whistler Buoy at Point Loma, the hard bottom to the northwest of Buoy #3 off Point Loma, hard bottom areas off of the Green Tank

at Point Loma, the Jetty Kelp outside of Mission Bay, The 270 located to the west of Mission Bay, the upper end of La Jolla, Del Mar, Solana Beach, Leucadia and Box Canyon.



When current and water conditions are right there has been good calico bass fishing at the kelp beds at the upper end of La Jolla and at the Jetty Kelp off Mission Bay. The afternoon hours tend to be the best for the calicos and the fish tend to get active when there is a steady downhill current flow.

Finding kelp bed areas with clean water and a water temperature of 64.5 to 65.5 degrees has been the combination of watercolor and temperature that has produced most of the good calico bass fish.



The fishing for halibut is still slow.

Recent weeks have seen occasional halibut being reported and some of the better areas for a chance at a halibut have been off Mission Beach at the sandy bottom next to the structure of the sunken NEL Tower and at the sandy bottom next to the structure of the Yukon Shipwreck. Additional areas that provide a chance at scratching out a halibut have been Imperial Beach, South Ponto Beach, the sandy bottom next to the Buccaneer Pipeline, and the sandy bottom next to the artificial reefs off Oceanside.



December can be a productive month for Southern California saltwater anglers and I hope you do not make the mistake of putting away your fishing gear for the winter while there is still good fishing to be had offshore, at the Islands, and along the coast.
