Do you remember the first time you visited Portugal?

My first visit was many years ago and I remember that the Algarve immediately felt like home. That very first visit, I made unforgettable memories with family and friends, enjoyed the relaxing lifestyle and ate delicious food. It was as if time stood still. Right at that moment, I knew I wanted to spend more time in this beautiful country.

I was working for a real estate company in Holland at that time. Each day, I experienced true joy as an estate agent. It was only weeks later that the idea of helping buyers and sellers in the Algarve was born.

With the first Divine Home office opening in Albufeira, our small team started helping buyers and sellers throughout the Algarve.

With this first office, we established the Divine Home brand in the Algarve.

In 2009, we opened an office in Holland to expand our market share among Dutch and Belgian clients. Being able to provide a local office near to their home has proven to be a great success.

Over time, we have faced some great challenges. You no doubt remember the economic crisis of 2009-2015. It was a hard time for many businesses, yet we decided to expand and open a new office in São Brás de Alportel in 2013. Working with a team of local professionals and having a well-positioned office at the town’s square are two factors that made this office a success from day one.

Another challenge was the loss of a business partner in 2015, a highly inspiring man and a great character, whom we all still miss to this day. Yet it made us grow, as the determination to deliver good service became even stronger from that moment on.

Together with the recovery of the economy and the growing demand for properties in the eastern Algarve, we opened our third office in

the village of Moncarapacho in 2017. A lovely area with beautiful properties and easy access to surrounding areas such as Tavira, Cabanas de Tavira, Luz de Tavira and Santo Estevão.

One of our successes is the highly effective international marketing package that we have developed for owners. Our advanced marketing package and broad international network made it possible to be successful, even during the time of the pandemic in 2020.

Another success factor is our growth mindset.

The Algarve has more sunshine than any other country in Europe, with the sun shining more than 300 days a year. The mild, sunny winters create truly beautiful scenes for nature lovers. In February and March, you can marvel at the blossoming almond and orange trees, and in April, there is an abundance of wild flowers to admire. As the temperature

in the winter months rarely drops below 16 degrees, it’s the perfect place for those looking to spend the winter in a warm country.

The beautiful rocky beaches of the Algarve have been voted several times as the most beautiful beaches in Europe. The Algarve coastline is almost 125 miles long and consists of small bays, impressive cliffs and long sandy beaches. But the Algarve has a lot more to offer than just these fantastic beaches. If you’re looking for an active

holiday, the Algarve is the perfect choice.

There are more than 40 golf courses here, including many famous ones such as Dom Pedro Victoria, Old Course, Faldo, O’Connor, Vale do Lobo, Quinta do Lago and San Lorenzo. Both Victoria and San Lorenzo are among the world’s most prestigious courses, and the International Association of Golf Tour Operators voted the Algarve the best golf destination in the world in 2020.

Eating and drinking are very important in Portuguese culture and the Algarve offers plenty of culinary delights. There are plenty of opportunities to enjoy the whole evening with family and friends, sitting at long, beautifully laid tables sampling delicious, healthy and, above all, affordable Portuguese cuisine.

Portugal is one of the 5 safest countries in the world*. The country has no immigration issues and is generally known to be very safe.

The economy is growing, and the country is politically stable. Travelling from the Netherlands, Belgium, England or France is a short journey and tickets are very affordable.

In 2009, Portugal introduced the NHR (Portugal’s Non-Habitual Residents tax regime), which was updated in 2020 and

will continue to apply to new residents in 2021. The non-habitual tax regime offers reduced tax rates and tax exemptions for new residents in Portugal for the first ten years.

Climate The Algarve is known as a popular holiday destination for a good reason. With more than 300 days of sunshine per year, the Algarve is one of Europe’s warmest and sunniest regions.

Being the southernmost location in Portugal, the Algarve experiences some of the most hospitable weather in Europe throughout the year.

With an Atlantic-influenced Mediterranean climate, the Algarve has mild winters and warm summers. The Algarve’s spring season is warm, with temperatures averaging around 20°C to 21°C throughout the season. Autumn in the Algarve is typically hot to begin with, cooling only slightly to warm temperatures in November. In general, it rains very little in the Algarve. Most of the rain falls during the period from November until the end of March. Though late-season sun seekers can still be found sunbathing throughout the autumn, enjoying average daily maximum temperatures ranging from 26°C in September to 19°C in November.

The warm climate is one of the reasons the Algarve is one of the most popular destinations for hibernators and retirees.

Albufeira was a logical place for us to start, being the most well-known city on the Algarve coastline and popular all year round. Beautiful beaches and much

Once a sleepy fishing village, this traditional Portuguese city is now one of the Algarve’s main tourist destinations.

The beautiful “blue flag” beaches, 18th century churches and cobbled streets of the “old town” are mixed with restaurants, bars, neon lights and the thriving nightlife of the “strip”. There are also several international schools in the area, and with some of the best golf courses in Europe right nearby, there really is something for everyone.

The combination of climate, culture and cuisine also make Albufeira the number one destination for property investors, expats and retirees.

A hidden gem in the hills

High in the hills of the Algarve lies São Brás de Alportel, a beautiful, traditional village with friendly and welcoming locals.

Officially declared a municipality in 1914, São Brás de Alportel was the centre of cork production for Portugal and, indeed, the rest of the world for many years. The village consists of traditional low white houses decorated with tile panels and natural stone, evidence of the prosperity of the cork industry.

Here, you can enjoy a walk through the winding streets and around the many small squares, admiring the Baroque decorations

and flowers in the windows, something that is very typical of the Algarve. The cork factory, the old Roman road and the museum of local costumes are also well worth a visit.

Go back in time in Mértola

In the Alentejo lies the beautiful white village of Mértola, where Portugal’s Moorish history is best represented.

Mértola is a small village with characteristic white houses and red rooftops in between the hills. It is a beautiful place with a fantastic historical atmosphere. Here stands the only remaining mosque in Portugal, now a church, but one in which the original structures and elements of the mosque still exist.

The castle of Mértola is also of Moorish origin. It towers majestically above the River Guadiana, the river that forms the border with Spain. The view from this castle is magnificent.

You see the Vale do Guadiana natural park.

The park is almost 70,000 hectares and well worth a visit. Nature is characterised by the Montado: a rolling, savannah-like landscape.

There are plenty of car routes, hiking trails and viewpoints in the park.

As befits the Alentejo, everything goes quietly and there are plenty of places to have breakfast, lunch, and dinner. And for all kinds of drinks and snacks in between. In Mértola, time almost stands still and it is wonderful

to experience that. Also the many beautiful vineyards should be mentioned when we speak about the Alentejo. Delicious wines come from this region.

Mértola is situated about 100 kilometres north of the Albufeira and from Mértola you can make a lovely day trip to the Algarve. The route winds through the Serra do Calderão (up to 600 metres altitude). The journey takes at least two hours and maybe three because the number of possible photo stops is infinite.

Buying process Buying a property in Portugal is an easy and transparent process. Yet, as it can be very different from buying a property in your home country, it is important to know the local rules and regulations when buying a property in Portugal.

Once you have found your dream property and your offer has been accepted, the buying process in Portugal has 5 important steps.

Reservation

The reservation form, drafted by the real estate agent, outlines all the terms and conditions agreed during the negotiations.

The form is signed by both parties. Once the reservation has been signed, the buyer is requested to transfer a reservation deposit, generally € 5,000 Euros, which is held by the buyer’s lawyer. When buying a property from a developer, you may be requested to transfer the reservation deposit directly to the developer’s company.

Once the due diligence is performed and all documents are in order, the buyer’s lawyer will draft a Promissory Contract. This contract contains all terms and conditions, agreed by both parties, relating to the purchase.

Together with the signing of this contract, the buyer pays a deposit to the seller, generally 10% of the purchase price, via the client account of the buyer’s lawyer. With signing the Promissory Contract and paying this

The final deed (named “Escritura”) is the contract that transfers the title of the property from the seller to the buyer. This final deed of conveyance is signed by both parties (or their representatives) in front of a public or private notary. At this point, the remaining amount is paid to the seller.

Registration

Once the final deed has been signed, the property has legally changed ownership, but the property still needs to be registered with the Land Registry office (named “Conservatoria do Registo Predial”). This task can be done by the buyer’s lawyer. The change of name on all utility bills is also often done by the buyer’s lawyer.

Buying costs When buying a property in Portugal, the following one-off taxes and buying costs are applicable:

IMT - “Imposto Municipal sobre Transmissões” Municipal PropertyTransfer Tax

This tax is to be paid by the buyer, at the tax department before the signing of the final deed at the notary.

The IMT rate for properties varies according to the purchase price and purpose of the property and usage by the owner. ~F or properties classified as a residence, the rate goes up to 6% and 7.5% for properties valued over EUR 1 Million. The rate varies also according to the purpose of the purchase, whether it’s a second home or primary residence. ~ Rural land has a rate of 5% ~ Properties classified for tourism and other property types have a rate of 6.5%

Stamp Duty - Imposto de Selo This tax is 0.8% of the purchase price. When buying with a mortgage, another 0.6% has to be paid over the value of the mortgage.

Lawyer’s fee Most lawyers will charge 1% + VAT of the purchase price. The lawyer will carry out all the necessary searches and prepare the documentation needed for both the Promissory Contract for purchase and sale, as well as the final deed.

Notary and registration fees This will have to be paid by the buyer when signing the final deed of conveyance.

These costs are around € 950. When buying with a mortgage or requesting extra services from the notary, the costs will go up.

Agency’s fee

Selling costs There are a number of important things that you should consider with respect to additional costs when selling a property.

Capital gains tax (IRS / IRC) ‘Capital gains’ are the profits earned from the sale of your property that was previously purchased at a lower price. How to apply for NHR?

Introduced in 2009 and updated in 2020, the non-habitual tax regime offers reduced tax rates and tax exemptions for new residents in Portugal for the first ten years. This makes Portugal a very attractive country for individuals to reside, especially for those who want to enjoy retirement in the country. With over 23,000 non-habitual tax regime residents registered in Portugal today, the scheme has been highly successful and the 2021 State Budget confirms that Portugal will continue to offer these benefits for new residents in 2021.

The first step is to prove that you have the legal right to reside in Portugal. Citizens of EU/EEA/Switzerland can register without a visa. They can register for residency at their region’s city hall given the freedom of movement within the EU.

Why become a non-habitual resident in Portugal?

• Flat 10% tax rate on foreign pension income. Private sector pensions are the ones accepted to qualify for NHR status.

•T ax exemption on many foreign sources of income, such as dividends, real estate gains, rental income and interest.

•F lat 20% tax rate for employed or self-employed Portuguese income from pre-defined scientific, artistic or technical professions.

• Exemption of tax on gifts or inheritance to family members.

•N o wealth tax.

•F ree remittance of funds to Portugal.

Who can apply for NHR? • Everyone who has the right to reside in Portugal either by being an EU/EEA/Swiss citizen, or has a residence permit from the Portuguese consular office in their home country and

Non-EU citizens must first receive a residence permit allowing them to settle in Portugal. They can obtain the permit in different ways, but the two most common methods are via the Golden Visa Program or D7 visa, also known as the “Passive Income” visa. They can do this either online (on the site of “SEF”) or in their country’s Portuguese embassy.

To successfully apply for NHR, you must be registered as Portuguese resident and tax resident and hold a place of abode by the 31st of December in the year of registration.

You can then apply for the Non-Habitual Resident programme until the 31st of March the following year.

How to maintain the NHR status?

To maintain the NHR status you must spend a minimum of 183 days in Portugal or when spending less than 183 days in a year, you should have a real estate property in a condition that makes it possible to presume the intention to keep it and to occupy it as your primary and usual place of residence.

What is my obligation when having NHR status?

Once registered as a Non-Habitual tax resident you are obliged to file tax returns in Portugal which include your total worldwide income and expenses.

Portugal Golden Visa

Since the Portuguese Golden Visa programme was launched in 2012, a total of 9,444 investors and 16,130 family members have benefited from the Portugal Golden Visa. With billions of direct investments resulting from the Golden Visa programme (reference date: February 2021), the programme has shown to be very popular and successful. It has therefore become known as the most successful residency-by-investment programme in Europe.

IMPORTANT UPDATE: Anyone seeking to buy property in exchange for a golden visa in Lisbon, Porto or a coastal area like the Algarve has a golden window until the end of 2021. The Golden Visa programme has been extended until January 2022. After this date new regulations come into effect.

Portugal Golden Visa Investment options

The benefits of the Portugal Golden Visa

• Purchase a property for at least € 500,000. If you purchase a property in a low density area, the minimum investment amount is € 400,000.

• Purchase a property for at least € 350,000 located in an area where urban redevelopment is taking place.

When located in a low-density area, the minimum investment is only 280,000 euros!

• An investment of at least € 350,000 in a qualified Investment Fund.

• Make a capital transfer of at least 1 million euros into a Portuguese bank account (set to be increased to 1.5 million euros after the 1st of January 2022).

• Purchase company shares worth at least 1 million euros.

• Invest in a company for at least 1 million euros.

•T he creation of at least ten new, full-time jobs for Portuguese nationals.

• I nvest at least € 350,000 for the creation of a commercial company or to reinforce the share capital of a commercial company, through which you create at least five full-time jobs.

•M ake a capital transfer of at least € 350,000 for research activities in science or technology by either public or private scientific research institutions (increased to € 500,000 from the 1st of January 2022).

•M ake a capital transfer of at least €250,000 to support the arts or reconstruction of national heritage.

The Portugal Golden Visa offers a wide range of benefits: • Freedom to travel throughout the entire Schengen Area.

• After 5 years you can apply for Portuguese citizenship.

• You can include ~ your spouse and your children - provided that they are younger than 18, or younger than 26 if they are single, and are studying full-time. ~ your parents and those of your spouse if they are over 66, or over 55 if they depend on you for care. ~ you or your spouse’s, siblings if under the age of 18.

• Unlike many other Golden Visa programmes in Europe, Portugal is not blacklisted by the OECD, the Organization for Economic Cooperation and Development. You are therefore using a reliable visa programme.

• You have the option to use the Portuguese Non-Habitual Tax Regime, and become eligible for tax benefits.

The Portugal Golden Visa has become known as the most successful residency-by-investment programme in Europe.
