JULY 2015

4TH OF JULY PARADE AND BBQ By Sharon Meyer The Hills at Sonterra HOA hosted a Parade and BBQ for its residents on July 3rd, 2015. The Parade was led by a fire engine from Station No. 46 and followed by its residents and securely protected by both SAPD and Sonterra Security cars. “What an incredible day for the Hills at Sonterra community,” said Board President Phil Franzone. “Our first ever 4th of July Celebration was a huge success! … It was awesome having the fire department, police SAFFE unit, and Sonterra security ensuring the children’s parade went off without a hitch.” Hills resident Kelly Merritt posted on Hills at Sonterra Community FB page, “Thank you to those who put the event together. Great job and great day! Loved meeting new people. Got our family away from the TV! Found out: we have a Facebook, that ladies might want to start a neighborhood 456 (slightly diff from bunco) group; got reunited with some old friends, my high schoolers met new friends, had great food and my son won a door prize!!! Who could ask for more!!!

Door prizes were provided by Edible Arrangements on Stone Oak Pkwy, Stone Oak Florist, J. Alexanders Restaurant in the Alamo Quarry, Copa Wine Bar & Tasting Room on Stone Oak Pkwy, and Southerleigh Fine Food & Brewery. Other prizes included several toys and coupons for kids’ meals at Taco Cabana and Jason’s Deli. Sherry McClanahan Carr said, “It really was great to see all the neighbors out together and the happy faces of the kids. We have a great community here.” The Hills at Sonterra Community is a neighborhood within a gated area in the Stone Oak area of San Antonio, Texas 78258, located north of FM 1604, between 281 and 10. The community consists of approximately 167 homeowners. Sharon Meyer Area Representative, The Hills at Sonterra Area.rep.hillsatsonterra@gmail.com 512 576-2980 Stone Oak - July 2015 - Vol 20 No 7

An Important Message from your Stone Oak SAPD SAFFE Officers Summer is here, and along with the heat, we typically see a rise in overnight vehicle burglaries. Unfortunately, this summer is already proving to be no exception. One commonality in many of the burglaries that we are seeing, is our victims are leaving valuable property in the front seat of an unlocked car. While this does not make anyone any less of a victim, your odds of being victimized multiply with this behavior.

may have missed, and vice versa. One person may not have all of the information needed to address this issue, but sharing information among yourselves could prevent future victimization or could even assist police in apprehending actors. For specific information regarding your neighborhood, contact your SAFFE officer.

A few tips to lessen your chance of being a victim:

• DON’T LEAVE VALUABLES IN PLAIN SIGHT, AND/ OR IN UNLOCKED VEHICLES!!!!!!

• Be vigilant. If you see something or someone that appears out of place, your instincts could be correct. Call police (non-emergency or 911 as needed) and be a good witness.

HOA/POA Bills Passed by the 84th Texas Legislature Art Downey, President, Texas Neighborhoods Together (TNT) The 84th Legislative Session is over! The Senate and House adjourned Monday afternoon, June 1, 2015. With nearly 6,500 bills and resolutions filed during this session, it was determined that no less than 200 of these bills affected community associations either directly or indirectly. Of those bills identified to affect community associations, only eleven became law: House Bills: 745, 939, 1072, 1455, 2489, & 3089; Senate Bills: 862, 864, 1168, 1626, & 1852. I will briefly describe the highlighted bills that will have the greatest impact on our associations. The first three bills are generally positive, while the last two may negatively impact some. SB 1168 (West) Relating to the operation of certain property owners' associations. This omnibus bill had many provisions; some of the bill’s more important are as follows: •

Allows members to attend open board meetings held by video conferencing using the same technology.

•

Allows more flexibility for boards to take day-to-day action outside of a meeting while clarifying that certain important votes (e.g. selling land or adopting a deed restriction) must be taken at an open meeting.

•

Provides privacy protection by allowing associations to adopt rules regarding use of secret ballots, and by making clear that any person who tabulates or recounts votes must not disclose to anyone how an individual voted.

•

Allows associations more flexibility in offering payment plans. Currently associations cannot offer payment plans for longer than 18 months; the bill removes that restriction.

•

Eliminates confusion and grounds for legal dispute by clarifying that Ch. 207 (applicable to homeowner association resale certificates) does not apply to condominiums. The resale certificate provisions applicable to condominiums are already in Chapter 82 of the Property Code.

•

Clarifies the manner in which votes may be cast. Although absentee ballots or proxy voting must be allowed, the association may also elect to offer other methods such as online or electronic voting.

SB 862 (Birdwell) Relating to voting methods in a property owners' association election or vote. This bill provides that a property owners' association is not required to provide an owner with more than one voting method so long as an owner may vote by absentee ballot or proxy, unless a dedicatory instrument provides otherwise. SB 864 (Birdwell) Relating to secret ballots in a property owners' association election or vote. This bill allows a property owners' association to adopt rules to allow voting by secret ballot by members of the association. The association must take measures to reasonably ensure that: (1) a member cannot cast more votes than the member is eligible to cast in an election or vote; and (2) the association counts every vote cast by a member that is eligible to cast a vote. HB 1455 (King) Relating to procedures required before a condominium association files a suit or initiates an arbitration proceeding for a defect or design claim. (Applicable to Condos.) HB 1455 greatly restricts a condominium association’s ability to file a construction-defect lawsuit or pursue such a claim through arbitration. It requires condominium associations to fulfill a large number of intricate and rather expensive requirements prior to filing a construction-defect lawsuit or pursuing the claim through arbitration. HB 2489 (Leach) Relating to the ability of a property owners' association to enforce certain provisions on the lease or rental of real property. This bill negated certain rights of a homeowner and condominium associations to obtain basic lease information from landlords. The complete text of all these final bills ("Enrolled") may be downloaded from the Texas Legislature's website as Word files, HTML files, or PDF files. WaterSaver Landscape and Patioscape Coupons The 2015 spring and summer coupon season just ended on June 30th with a record of 9,000 coupons being issued! However, do not feel sad if you did not participate. The new fall season begins on September 1st with a new concept that requires a minimum of 2 small trees and 5 perennials, rather than the previous required 15 shrubs and/or perennials. The standard removal of 200 ft² of lawn is still mandated. We are trying to encourage the planting of small, or aka understory trees, and perennials to create the concept of a “multi-layer canopy”, which is important for wildlife habitat and stormwater reduction. Interested? See our GardenStyle newsletter and website (www.gardenstylesanantonio.com) for more details in August.

Is Your Lawn Olive Drab? Many homeowners fret when they see their lawns turning an olive drab color and wilt. Do not! Warm season turf species like Bermuda, Zoysia, and even St. Augustine will naturally go dormant or semi-dormant in July and August. This does not mean they are dead! They are surviving the natural heat and wind by doing what comes naturally. Research conducted by Texas A&M University and SAWS in 2005-2007 demonstrated that lawns with 4 inches of soil needed water once every 18-21 days to survive. So, unless you are planning a vacation to the south of France for 4 weeks, you could shut done your irrigation system completely for two to three weeks. Or, you could simply leave it to run for no more than once a week like SAWS recommends.

The New and Improved SAWS Irrigation Design Rebate Program by Nathan Riggs, SAWS Conservation Project Coordinator

Irrigation systems represent a convenient avenue by which homeowners can apply water to their landscapes on a regular basis to keep them healthy and maintain their appeal. Any homeowner with an irrigation system also knows that it can be a real bear to maintain and can inflate a water bill very quickly if there’s malfunction, break or if the settings aren’t monitored. This is especially true when the irrigation system is set to operate at night or when the homeowner is away…a “set it and forget it” scenario. If you have been considering some changes to the irrigation system at your home, or even permanently shutting down the system and getting rid of it, SAWS has some very interesting and great news just for you! The SAWS Irrigation Design Rebate program is available for homeowners who are tired of their irrigation systems or want to make changes or improvements. In past years, the rebate has been available as a credit to the water bill, with half of the total rebate being applied up front and the second half being applied on the contingent that consumption is consistently lower after one year of monitoring. What has changed under the new and improved program? BEFORE any work on the irrigation system is started, homeowners interested in the rebate MUST call or email SAWS Conservation to schedule a free consult. *Any irrigation work initiated before the first consult will not be considered for the rebate.* Here’s how it works: 1. Call SAWS Conservation at 704-SAVE (7283) or email consult@saws.org to set up the free consultation. 2. A SAWS Conservation Consultant will come to your home and inspect the irrigation system to record the settings and then briefly test the system to collect information on the system’s average water flow rate and number of separate zones laid out across the landscape. The consultant will talk with you about the inspection results and discuss any questions you have about the system or landscape. 3. Based on the average water flow and number of zones in the irrigation system, the consultant will provide you with a personalized written rebate offer that is good for one year from the date of the consult. The offer contains: Stone Oak - July 2015 - Vol 20 No 7

a. The max rebate amount available for permanently retiring the functional irrigation system. b. The max rebate amount for making targeted changes to the irrigation system. Targeted changes include capping entire sprinkler zones, converting entire spray irrigation zones to drip irrigation (landscape beds only) or converting all conventional spray irrigation heads in a zone to pressure-reducing spray heads (grass zones only). The maximum rebate for making targeted changes is limited to 75% of the amount to completely retire the irrigation system. 3. After the consult, you have one year to complete any changes to the irrigation system and call or email SAWS to schedule a Final Rebate Inspection. The consultant will inspect and confirm all changes that you’ve made. 4. The consultant returns the Final Inspection paperwork to SAWS and the homeowner will receive an email within 48 hours confirming their final rebate amount. 5. Rebates will be issued as a check mailed directly to the homeowner within 2 to 8 weeks after the rebate is approved. Only homeowners are eligible for the rebate…tenants are not eligible. Personalized rebate amounts start at $450 for permanently retiring a non-functional irrigation system and could possibly exceed $2,000 (amount varies based on water flow and zones) for retiring a functional irrigation system. Based on system water flow, rebates (amounts vary based on water flow) for retiring individual zones start at $200 per zone, while rebates for converting spray to drip irrigation (landscape beds only) start at $100 per zone. Rebates for converting regular spray heads to pressure-reducing spray heads (grass zones only) start at $50 per zone and increase based on water flow of the system. If I have piqued your interest, go to the Irrigation Design Rebate page at GardenStyleSA.com by following this address: http://www.gardenstylesanantonio.com/ coupons-rebates/residential-irrigation-design-rebate/. Remember: ANY irrigation system work started before the initial consult WILL NOT be considered as part of the final rebate amount. Call or email SAWS BEFORE starting any work.
