Rules & Regulations Committee Proposes Update to Board of Directors The last complete review of the Rules and Regulations was done in 2012. Associations should review their rules and regulations every several years to ensure they are current and appropriate. The Strategic Plan also identifies updating the Rules and Regulations as one of its strategic objectives. The PLPOA Board decided to form a committee of owners led by the General Manager to review the rules and regulations and make any recommendations regarding changes, additions or deletions to the document. PLPOA advertised for volunteers and five owners came forward to volunteer on the committee. They have spent many hours reviewing and discussing the document and we thank them for their community service. The Committee will provide the Board of Directors with their recommendations to update the Rules and Regulations. A special meeting will be called by the Board of Directors to meet with the Rules and Regulations Committee to review and discuss their recommendations. This special meeting date will be posted in advance and is open to all owners.

On the Ballot PROPOSED BYLAW AMENDMENT Existing: SECTION 6. Absentee Ballot - Any voting Member may vote by an absentee ballot. The official absentee ballot shall only be valid when returned to the Secretary in accordance with the election instructions accompanying the notice and call. Absentee ballots are to be received by the Secretary of the Association or its designee. Notification of official Association elections shall be included with the official absentee ballot. Proposed Change: SECTION 6. Notwithstanding anything to the contrary, the Association will not be required to provide for or accept absentee ballots with respect to an owner meeting to ratify any budgets. Justification Because the Association’s Bylaws require an absentee ballot for all owner votes, The Association was required to use the absentee ballot process in order to comply with a new law requiring owner ratification of the budget. This cost PLPOA $21,600 to comply with this new state statute. The statute requires associations to send a summary of the budget adopted by the Board to all owners and call an owner meeting to ratify the budget. Unless a majority of all owners (not just those voting) veto the budget, the budget is ratified. Currently, there are 9,477 total possible votes in PLPOA meaning that there need to be 4,738 votes cast against the budget. In 2019, a total of 1,293 votes were cast, with 918 cast to ratify the budget. Unlike other meetings, a quorum does not need to be reached to hold the meeting. The absentee ballot system is costly to establish for each vote. Owners who wish to participate in the meeting but are unable to attend have the option of returning a proxy to have their vote cast, so eliminating the absentee ballot for this particular meeting does not prevent any Owner from being able to participate. Eliminating the absentee ballot requirement from the Bylaws for the budget ratification meeting, will save the Association approximately $16,905 in 2019/2020 and eliminate the need to include the cost in future budgets. One board position available Incumbent member Steve Schwartz is seeking reelections. Steve is the only member on this year’s ticket. Steve Schwartz Bio: Steve and his wife Robbie first discovered Pagosa Springs in 1986. Their love for the outdoors and the small town atmosphere made it an easy decision in 1996 to make Pagosa Springs their permanent home. Steve has been active in the community as a volunteer for the local Red Cross Disaster Team, Humane Society of Pagosa Springs, and the Town Building Committee. Steve has been the owner of Spectrum Construction since 1985. He was the Co-founder and President of the Builders Association of Pagosa Springs, Steve understands the need for common sense rules and clearly structured budgets. Steve is dedicated to working toward a positive outcome for everyone involved. plpoa.com

The mission of this department is to monitor and uphold the standards and rules for all properties within Pagosa Lakes. We take great pride in providing exceptional service to our members. Please give our office a call, (970)731-5635, if you have any questions regarding the standards for improvements or rules in regards to properties. We are happy to help. Looking into our reports for this past year, the top 4 types of violations fall into these categories:
Congratulations to these properties deserving our recognition for exceptional maintenance!
• 176 Parking in unapproved areas • 170 Issues with improper storage of misc. items • 97 Maintenance issues, painting, repairs needs, etc. • 93 Unattractive growth, grass more than 8 inches tall, etc. Please be aware of keeping up on the maintenance on your property and where you place or store items.

As we walk our dogs along our trails and roads, please pick up after your dogs. No one should have to walk around the mess you and your dog have left. There is, I am sorry to say, no way to deal with the goose droppings that we find on our trails. Let’s not add to the problem of having to avoid these piles. Barking Dogs, exterior light trespass and issues with vacation rentals have become some of the most common complaints we are hearing about in our office. • Please be aware if your dog barks a lot and address the behavior. We have information on our website (under “Living in PLPOA”, “Helpful Bulletins”, “Barking Dogs”). • To determine if your lights could become an issue for a neighbor, walk around your property lines. If you can see the bulb from your exterior light fixtures, you could be negatively affecting a neighbor’s enjoyment of their property. • In an effort to help with complaints about short term rentals, an abbreviated list of Neighborhood Rules, specifically edited for vacation rentals, is available on our website. Archuleta County is now requiring that all vacation rentals obtain a permit from their office. Please see our website for more information. (See “Living in PLPOA”, “Vacation Rentals in PLPOA”). We have had a good wet winter and early spring, great for grasses to become abundant and tall. Tall grasses dry out to be dry tall tinder…fuel for fires. Please remember to do all you can to protect your property in the event of a wildfire. (See plpoa.com: “Living in PLPOA”, “Wildfire – Protecting your Property”).

PLPOA Continues to Develop By: General Manager, Allen Roth
Pagosa Lakes continues to be a sought after community in which to live. The community offers a wide variety of housing to meet different needs and desires. Our five lakes, various great recreation amenities, events along with the standard of care of homes make PLPOA a desirable place to live. This popularity results with a majority of the county’s population residing in PLPOA. Over the past three years, a total of 247 new homes have been constructed in Pagosa Lakes. This year appears to be another one with 70 plus new homes being constructed. I bring this to your attention because this rising development not only brings more houses to our community, but also more demand on the services we provide: the recreation amenities we maintain and the need for additional programs, events and amenities. The Association is being proactive in its approach to development of the community. Not only did the Board approve its first-ever strategic plan, but also approved a capital improvement plan, updated the reserve study, along with trails and facility master plans. This year, PLPOA will be working on a few projects to expand our amenities to keep up with demand. The first project is the construction of Highlands Park. This property is located on North Pagosa Blvd. before Hatcher Circle as you are heading north. The development of this park comes from a resident survey and multiple owner input meetings. The park will feature a play structure and swings, picnic tables, parking area with an access gate into the National Forest. This park will ease the demand on other National Forest entry gates and provide a play area which has been highly requested. Another project is the expansion of the Rec Center parking lot. Too often, the parking lot is full and members are forced to park at the Methodist church. PLPOA is planning to increase the parking lot by at least 10 spaces. We are also looking into adding another entrance. This project is scheduled to begin this spring. One of our most popular amenities are the trails which wind through our neighborhoods. We continue to strive to keep up with demand for more trail improvement. This year, the Association will be planning and estimating the cost for completing the trail connection on North Pagosa Blvd. which goes across the Village Lake dam. Plans and cost estimates will be developed to construct a pedestrian bridge next to the road bridge with a curb and sidewalk path across the dam to meetup with the existing trail. This planning work will also provide us time to submit for a state grant in hopes to assist with the large expense for the project. PLPOA plans to begin this project next summer in 2020. A project planned for the future to accommodate our development is the consolidation and renovation of our mailbox sites. Obviously, with the increasing number of new homes, additional mailboxes have to be installed. One set of boxes costs the Association between $1,500 and $2,000 each. Some of these mailbox sites have reached their limit for space. The Association will research larger sites and where sites can be combined to save maintenance costs. PLPOA would also like to install roof covers over the mailbox sites and ensure there is plenty of space of vehicular traffic to access their mail. In order to keep up with the latest happenings in PLPOA, please be sure to register for weekly e-mail updates which not only include Association business, but fun events, activities and clubs. You will learn about various services that are available to you and much more. plpoa.com
Community Association Living Your Commitment as a Homeowner The PLPOA is glad you’ve found a home in our community. We presume it has all the amenities you were seeking and you’re settling in nicely. This is the time the association likes to remind new and existing homeowners that property owners associations, like ours, create some unique obligations to the community and to other residents within it. We recommend that you read and become familiar with the community’s governing documents. This not only includes the master declarations, but also your particular sub-division declarations. When you purchased your home, you should have received a package of documents well before you closed on your home. If you didn’t, or you cannot locate where you put them, check the website at plpoa.com or ask for copies at the administration office. Make sure you understand what’s included in them, particularly the rules and regulations. These rules fulfill the Association’s obligation to protect property values and provide criteria to keep PLPOA aesthetically pleasing and contribute to the quality of life. Our most common issues are pets, parking, improper storage and architectural permits for exterior improvements. Please become familiar with the rules and regulations to maintain our community as a wonderful place to live. As you maintain your property according to established standards, the community’s appearance can add value to all the homes within it— including yours—so it’s important to keep landscaping neatly groomed and your home’s exterior well-maintained. Please remember to keep your contact information current with the Association by providing that information to the Association staff. This allows the Association to make sure we know how to reach you in case of an emergency, or to keep you informed of upcoming association meetings and other important events. If you rent out your home, you are required to provide notice and contact information to the Association as well. Also, it is your responsibility to ensure that tenants, visiting relatives and friends, adhere to all rules and regulations. If you are leasing your home, you’re liable for maintaining the condition of the home and for the conduct of those who live in it. Treat Association leaders honestly and respectfully. Board members and Environmental Control Committee members are homeowners—just like you—who have volunteered to give their time and energy freely to govern the community. While you should share your concerns about the community with them, do so in a way that’s constructive, informative and helpful. We encourage you to volunteer and become involved in the Pagosa Lakes community. There are various committees each pertaining to certain amenities or a particular segment of the Association in which you can get involved. Numerous events and activities throughout the year are scheduled and can always use the extra help. Do you have an idea to better our community? Please share it with the Association and if accepted, take the lead to implement. Attend board meetings and vote in community elections. Board meetings are open to all who wish to sit in and keep up with issues under discussion. The Association is a democracy, and your voice and vote can affect important issues. Pay association assessments and other obligations on time. Assessments are due before May 1 of each year. Your regular assessments pay for common-area maintenance, amenities and other shared expenses. If you don’t pay on time, the burden for paying your portion of the association’s bills, falls on your neighbors. If you’re having problems, and would like to discuss alternative payment arrangements, contact the PLPOA Comptroller or General Manager. Pagosa Lakes is a special place to call home. We encourage everyone to do their part and work together to keep it a great community. 11
D EPARTM EN T O F PROP E RT Y AND E N VI RONM E NT By Property and Environment Manager, Larry Lynch
Lakes and Fisheries
All four lakes are in excellent condition currently. Early season spring runoff and cool water temps are favorable for high dissolved oxygen levels. All four lakes are generally spilling as water continues to flux the system. Stevens Reservoir completely filled last month and is now spilling which is great news for us going into summer. Having Stevens in full reserve going into the summer ensures that the lower lakes can be recharged continually as water demand peaks in July and August. We have stocked all four lakes in April with several thousand pounds of 12-18 inch rainbow trout as well as about 1000 pounds of cutbow trout that were stocked into Hatcher and Lake Pagosa specifically. The fishing has been very good this spring and we are definitely seeing the beginnings of a busy fishing season, permit sales are up and the common fishing areas are pretty active with owners enjoying early season fishing opportunities.
DPE Projects
The DPE crew will be extremely busy the coming couple of months with a number of planned projects. We have already begun work on the Highlands Park development project, the driveway is being roughed in, culverts installed for drainage. This month the driveway will be completed and the parking area suitable for approximately 10 vehicles will constructed near the rear property line. An area has been selected for the playground will be leveled and filled to prep and hopefully construction of the playground site and equipment can begin (to be built by play equipment company). A picnic area pad will be developed as well, and a gate installed in the boundary fence with a trail to be constructed approximately 1/2 mile to connect to Turkey Springs non-motorized Catamount Trail. Other upcoming projects this month will include repairs and maintenance of the National Forest boundary fence in preparation for cattle in June. We have a strong suspicion that the fence will require some fairly heavy maintenance this year due to the heavy snows this past winter. It could turn into quite a job. We will also be working under US Fish and Wildlife permit to do some goose nest egg oiling on many nesting sites around the lakes. Spring grounds and maintenance work is in progress, lawns will be fertilized this month and irrigation systems charged.
Enforcement
We have a new part time Conservation Officer that will be helping with lake fishing and boating regulation enforcement and other lake related projects. Steve Chaney is a retired National Park superintendent that worked at Yosemite, Arches, Sand Dunes and other National Parks. Looking forward to working with Steve this summer. He will be working with my other 2 part time guys, Claude Tuller and Lynn Ditto. The position is usually around 10- 15 hours a week and the goal is to have some presence around daily for enforcement of safety rules and lake use regulations. The contacts with owners and guests is always a friendly contact and most of our owners appreciate having an Association presence around the lakes and open area. Steve may also be helping with goose nest visits this spring.
Rec Center Parking Lot
We anticipate having final design drawings and plans from Davis Engineering this month for the expansion of the Rec Center parking lot. Allen and I met with Mike Davis in April to come up with a plan. The proposed parking improvements would include additional parking areas near the west entry and off the east end, plus a new driveway access to Park Avenue near the east side, allowing for full circular access to the parking lot. We will put this out to bid for board consideration this month.
Noxious Weed Control
I am planning to begin working on noxious weed control efforts this month beginning primarily around Association properties, near the lakes and buildings and then work out into the subdivisions. I am working closely with the Archuleta County weed and pest supervisor, Ethan Proud, to come up with a plan to better control Kochia, a troublesome weed that has been establishing in the road ditches and is quite tough to control. Some new products are available that should help. The county will be doing most of the applications along the roadway shoulders. 12

What’s new with the Department of Recreation & Amenities? By: Department of Recreation Manager, Robert Buck
We are already halfway through the year and the seasons are changing. For most of us in Pagosa Lakes, the signs of summer are a welcome change. We were lucky enough to experience one of the most impressive winters in the last 10 years, which made for some unbelievable skiing and snow sports. Along with the changing seasons, the Department of Recreation & Amenities is continuing to change as well. With feedback from our Activity Interest Survey guiding our efforts, we hope to bring you new and exciting programs and amenities that will continue to make Pagosa Lakes the wonderful community it is. See below for what we have been busy working on and what’s coming next. New fitness equipment at Pagosa Lakes Recreation Center - We are happy to announce the replacement of 7 new pieces of strength equipment. We have added a new Smith Machine and 6 pieces of Cybex Strength Machines. In addition to the Cybex pieces we added in 2018, we have upgraded all of the Cybex Strength Machines at our facility. If you haven’t had a chance to try them, come down to the rec center for a workout. Expanding our programs and events - The Activity Interest Survey that was distributed to the community really helped us get a snapshot of what the community of Pagosa Lakes would like to see offered in the future. After compiling the results of the survey, we went to work. Here are just a few things we have started to offer based on your feedback. -
Swim Lessons throughout the month of June Kids Yoga classes Cardio Kickboxing Outdoor drop-in Basketball and Sand Volleyball Health and Wellness classes and seminars
We are just getting started! If you have ideas for events or programs you would like to see offered through the Department of Recreation Amenities, either drop by the recreation center or give us call. If your idea is outside the box, even better! Remember, recreation is not just done at the rec center, if you have ideas for offsite programs and events, send them our way. Here’s to a great summer and fall!
