SABOR Announces 2016 Real Estate Award Winners

The San Antonio Board of REALTORS® recognized the outstanding achievements of several of its members during the Awards and Installation ceremony on December 8th at Pearl Stable. John Craig was recognized as the 2016 Broker of the Year. He is the broker for Key Realty and is dedicated to serving his agents and helping them to achieve their goals. He leads not just in his office but also in the real

estate community by being an instructor for the Real Estate School at SABOR. He has served at SABOR on committees such as REALTOR® Builder and Government Affairs, and he will also serve as a Director for the Texas Association of REALTORS® in 2017. Denise Graves won the award for 2016 REALTOR® Salesperson of the Year. A member of SABOR since 1991, Denise is a REALTOR® with the Phyllis Browning Company. Denise is known for her extraordinary service to her clients by offering expert guidance and a warm personality. Denise is currently the chairman of SABOR’s Small City and Towns Forum and in her spare time, she gives back to the community through participation in SA 2020 and the Hill Country Animal Defense League. Jeffery Shaffer received the award for 2016 Rookie of the Year. Jeffery is with Ultimate Realty and holds his GRI designation. His passion is helping people achieve their homeownership goals and he leverages his experience in operations and business development to serve his clients.

Marla Luciano was named the 2016 Affiliate of the Year. Marla works for Old Republic Home Protection and serves on the Affiliate Partner committee. Marla can be seen regularly at SABOR functions where she not only attends but often participates as an advertiser. She goes out of her way to stay involved with the real estate community because she genuinely cares about making this the best place to buy and sell property. Janice Lerma-Lozano was recognized as the 2016 Property Management Specialist of the Year. Janice is a Property Manager/Broker at Rental Property Pros and has been an active SABOR member for over a decade. She has previously been chairman of SABOR’s TREPAC and Property Management committees and has also served on the Government Affairs committee and the Political Advocacy subcommittee. Marietta Alba received the 2016 Lifetime Distinguished Service Award. Currently the broker/owner of the Apartment and

Relocation Center, Marietta served as SABOR’s Chairman in 2010. Throughout her years with SABOR she has served on the TREPAC, Government Affairs, REALTOR® Image, Program and TRLP committees. In addition to her involvement at the board, Marietta has served the San Antonio community through participating in charitable organizations. She is a leader in the real estate community as well as in the San Antonio community because of the professional example she sets. Greg Jones was name the 2016 Good Neighbor Award winner. Greg is with the Phyllis Browning Company and is a member of the Jones Real Estate Group. For six years Greg has been involved with J-Jireh Ministries and serves on their Board of Directors. Through his tireless efforts, he helped collect and deliver over 1,600 Christmas Shoebox gifts last year to distribute to abused, neglected and abandoned children and teens who are living in foster care and shelters. He has helped raise over $20,000 for the organization and has contributed thousands of hours of his time to volunteer. His compassion and integrity have helped shape San Antonio children and families lives for the better.

Women’s Council of Realtors can have a lifelong value beyond your career I’m a new man because of my time in Women’s Council of Realtors. My path to WCR SA President was not all that uncommon and the only reason I’m sharing is so that you don’t waste as many opportunities as I did. I joined WCR initially only because one of our agents was going to be leading WCR SA and wanted to show her my support. I didn’t even attend a meeting my first year. I renewed out of obligation but only made one event prior to Sheila Moran changing all that. Without going into detail as it still haunts me today, I was not selected to a leadership position within another organization I had applied for and thus caught Sheila’s eye. As the incoming President for WCR SA, Sheila asked me to run as Vice-President of Membership and join her leadership team, an

opportunity I couldn’t refuse. Sheila Moran, Corrie Boldt, Susie Sheffield and Robert Dunn were all complete strangers to me at the time and now are truly some of my best friends in and out of my career. The experiences we have shared since, many of which will never go to print or even be whispered aloud outside of our tight circle (which has become quite large and nationwide), have truly made me a better man, not just a better leader or producer. The revenue alone that I have generated from WCR referrals back and forth around the country would have been more than enough to compensate me for my investment of time, talent, influence and resources if that was all that I had received. We’ve accomplished a transitional year in 2016 and all of us are really looking ahead to the

brand new nationwide format in 2017. I’ll let our next President, Tiffany Wright, share all the details. I’m Changing Offices. Now what? In recent phone calls I have been discussing the various situations that occur when an agent leaves the working relationship with their broker. While this relationship has different levels, I want to specifically discuss what happens to listing agreements or buyer ’s representation agreements that are pending at the time an agent chooses to leave their broker. We start with the reminder that an agent’s listing agreements or buyer ’s representation agreements ultimately belong to their broker. Agents will often say to me that they were the procuring cause for acquiring the client so it belongs to them and not the broker. This is a misconception. Procuring cause does not decide if an agent or their broker is entitled to a client as only a broker is legally able to represent a buyer or seller. The agent acts as an extension of the broker for the purposes of the buyer or seller client seeking to assist

the client as an “agent” for the broker. This can be thought of another way. Brokers bear the responsibility for the actions of their agents and for the fiduciary responsibilities owed to the clients and as such are the primary party to the agreement with the client. What this means is that technically, when an agent leaves a brokerage they do not legally have the right to take their clients with them automatically. However, this does not mean it can’t be done. Brokers and agents can agree to any terms that they would like to implement for their business arrangement. This brings us to the independent contractor relationship. It is when the agent enters into the contractual relationship with their broker that they should discuss what will happen in the event their independent contractual relationship ends. This understanding should be in writing and signed by the parties so as to

have a binding effect. Absent the writing, then the law would look to pattern and practice of the parties. This type of analysis is apt for problems and subject to interpretation. If unfortunately there is a situation where there is a dispute as to whether or not a client is subject to staying with the original broker or signing with the new broker of the agent, this is a contractual dispute. As with all contractual disputes, they are handled through litigation in court

and with the added expense of attorneys. Agents should be proactive and have an understanding of what will occur in the event they leave their brokers while deals are pending. Brokers additionally should be proactive and clearly state in their agreements with their agents what will happen if this situation occurs. This approach by both parties will save many hours of frustration down the road.

SAMAC NARPM Ends the Year with Good Times and a Luau! The San Antonio Metro Area Chapter (SAMAC®) of the National Association of Residential Property Managers ® (NARPM®) continues to pull the sleigh through the third and fourth quarters with drive and enthusiasm! The August office social was hosted by the Evey Edwards Group. Members had a great time socializing with other Property Managers and vendors. Donations were accepted towards the SAMAC® Buddy Walk Team. The Buddy Walk took place on September 24th and SAMAC walked in honor of a fellow member ’s son, Adrian. September was a busy month for all. The R.L. Wilson Law Firm, a SAMAC affiliate, hosted an amazing Next Generation Professionals (NGP) event at Top Golf. Members enjoyed a meet and greet, golf,

hors d’oeuvres and drinks. The September member meeting brought Duke Dodson of Dodson Property Management who shared tips and insight on the “Customer Experience.” Duke grew his company from 0 units to over 3300 units under management in eight years by applying the principle he shared. October is always a month that NARPM® members look forward to. It’s when the National NARPM® convention takes place. A week before the convention, Property Management Services of Texas, Delaney Realty, Inc. and BRW & Associates, Inc. got everyone in the Hawaiian mood by hosting a Hawaiian-themed office social. There was great food, drinks and mingling amongst members. The theme of the 29th Annual Convention was “Engineered for Your Success”

and took place on the beautiful island of Maui. Participants enjoyed several educational classes, inspiring speakers, a fun luau, volleyball tournament, private parties and plenty of beach time! The Next Generation Professionals held another social on November 15th at Buffalo Wings & Rings. While the local members dined on wings and shared Property Management stores, the incoming SAMAC® President and President-Elect attended NARPM® Leadership Training in St. Louis, MO. They are excited to share their training and vision as we move in 2017. The November member meeting was energized by speaker and local member, Brian Birdy who shared his “Must Haves for Property Managers in 2017.” To wrap up the year, SAMAC members and affiliates celebrated with a Christmas party at Sonterra Country Club. The 2017 SAMAC Executive Board was inducted and consists of President Ronnah Stabenow, RMP®, MPM®, President-Elect Joyce Zimdahl, RMP®, Vice-President Cortney Gill, Treasurer Jessica Case, RMP®, Secretary Adam Acord and Past President Gregg Birdy, RMP®. 2017 Board of Directors are Evey Edwards, Connie Henline, Kyle Hendricks, Lacy Hendricks, Bill Williamson and

Thomas Zimdahl. Ronnah revealed her 2017 of Faith, Trust and Pixie Dust! Expanded it means Faith in Yourself, Trust in your NARPM family and Pixie Dust for the Wild Ride called Property Management! Holiday Mulled Wine

One 750 ml bottle full bodied red wine 1 cup honey 1/2 cup brandy 1/4 cup fresh lemon juice 1 teaspoon whole cloves 1 teaspoon whole allspice berries 3 cinnamon sticks Peel from 1 orange One 3 inch piece ginger, peeled and sliced Whole star of anise, for garnish Put the wine, honey, brandy, lemon juice, cloves, allspuce, cinnamon sticks, orange peel and ginger in a sauce pan and bring to low simmer. Strain through a fine mesh strainer and transfer to a thermal container or large teapot. Pour into glasses; garnish with star anise and serve. Enjoy! Happy Holidays!!

Hill Country Women's Council of Realtors Elects Exec. Board, All 4 Positions Filled With KW Agents WCR is a nationwide community of 16,000 real estate professionals (the twelfth largest U.S. women’s professional organization), and now is the time of year when the organization elects its executive boards. It is at this time former leaders will step down, and visions are formed using ideas for the future alongside experiences of the past. Across the country, executive boards will be named, and this Thursday, the four newly-elected executive board member positions of the Hill Country Chapter of the WCR will be installed. While this happens every year, this year is different: all four of these executive positions have been filled with Keller Williams agents. For the 2017 year, Paula Durocher has been named president, Jan Boyle has been named presidentelect, Patti McDaniel has been named treasurer, and Raquel Wallace has been named secretary. All four of these exceptional women are Realtors with Keller Williams New Braunfels. Durocher, a partner of the Smartt Team Real Estate Group and no stranger to the WCR, has served as the 2016 president-elect and the 2015 Outreach Chair. Additionally, she was named the WCR Hill Country 2015 Entrepreneur of the Year. Along with her dedication to the WCR, Durocher is extremely active in the community, with memberships in several organizations including SCUCISD PTO, TREPAC, and the Four Rivers Association of Realtors, where she

serves as co-chair of the Scholarship Committee. “I am both excited and looking forward to the upcoming year,” said Durocher. “The other board members and I have met and developed goals for 2017.
