CHILD CUSTODY AND TEXAS F A M I LY C O D E PRESUMPTIONS

Many parents are often confused by conservatorship in a child custody proceeding. Oftentimes, parents tell attorneys that they want “sole custody” or “full custody” of their children. However, parents are not fully aware of Texas law surrounding child custody proceedings; rather, parents believe they can easily limit another parent’s rights and duties, and possession of and access to their children.

The Texas Family Code requires that all rulings and orders entered by a court be in the best interests of a child.

This requirement seems simple enough, but there are some issues to consider. The Family Code presumes that the following are in the best interests of a child: (1) that both parents should be appointed joint managing conservators; and (2) that a standard possession order should be entered.

A joint managing conservatorship is typical in a child custody proceeding. In a joint managing conservatorship, both parents are essentially equal and maintain the same rights and duties regarding their children. However, one parent is generally provided the right to designate the primary residence of their children, while the other parent is obligated to provide child support and medical support. This is often what parents mean when they want “sole custody” or “full custody” of their children. Should a parent want a court to deviate from a joint managing conservatorship and limit a parent’s rights and duties, then it is that parent’s burden to show that a different form of conservatorship would be in the best interests of their children.

Additionally, a standard possession order is presumptively in the best interests of a child. Among other things, a standard possession order provides the parent who does not have the right to designate the primary residence of their children to have possession of their children every Thursday night and every first, third, and fifth weekend. If the parents live over 100 miles from each other, the standard possession order may change to one weekend per month. Parents seeking to deviate from the standard possession order must either overcome the presumption that the standard possession order is in the best interests of their children or agree to a custom possession order.

Regardless of whether discussing a parent’s rights and duties, or a parent’s possession of and access to their child, parents should be properly informed of the Texas Family Code’s presumptions and requirements in a child custody proceeding.

THE LIVESTOCK SHOW in pictures

The Annual Victoria Livestock Show The 74th Annual Victoria Livestock Show was an event in “Fairadise”! Thousands of visitors enjoyed the beautiful spring-like weather while experiencing the ripping rides along with the lights and sounds at the Pride of Texas Shows carnival. Over 200 volunteers plan and execute the show for about 400 4-H and FFA exhibitors. These showmen proudly brought their final projects in for the judges’ inspection in the hopes of bringing home top winnings! The county fair entries ranged from photography and fashion to cakes and canned goods. The livestock animals were an impressive collection of bovine to bunnies.

And our crossroads businesses and individuals who are so dedicated to our youth, came out to bid and purchase the top 265 animals in the ongoing efforts to support the 4-H and FFA exhibitors and the future of their projects as well as their education. The directors and committee members of the Victoria Livestock Show hope you enjoyed this year’s show and we invite you to be part of the 2021 festivities as we celebrate the 75th year!

to give you the solutions that have helped many during this time to get into the best shape of their life, which is the best insurance plan against any punk viruses floating around anyhow. So, let’s get to it, & not waste a minute longer, shall we?

There are 5 things you can do starting this week to turn it all around asap.

#1 GAIN CLARITY. Before you dive into any new goal unprepared, you need to

get very clear on a couple of things to ensure your LONGTERM success, instead of running out of steam or getting distracted after just a few days or weeks in. You’ve got to write down where you are right now. Get your starting weight, measurements, energy & happiness level written down. Take front, back & side photos to track your progress.

Jot down your goal for each of those categories (which is, where you want to be,) give it a deadline and then think of a reward for yourself you can

set your sites on while you’re working toward your goal; like a new outfit, trip, night out or etc. Get those details figured out so it’s real & clear and not just a fuzzy idea.

Lastly, determine why you want this at a deeper level.

Think about why you want to lose the weight, why you want more energy & better health. Put the goal, the reward & the why somewhere you will see them daily. It needs to inspire you just thinking about it.

Something you can see yourself doing for the rest of your life, because that is where the real transformation happens, when you can become & STAY the healthiest version of yourself through the many ups & downs of life.

#4. DRINK MORE WATER, EAT MORE VEGGIES & CUT THE SUGAR/PROCESSED FOODS/REFINED CARBS. Try to get in half

It needs to be a set time on the calendar, just like a doctor’s appointment, or you will be at high risk of skipping workouts and eating fast food. you work out at home, add some décor to the space to make it one you look forward to being in. Create an awesome music playlist, get your favorite workout gear ready to go & choose meals in advance you can really relish. Eating healthy does not have to taste disgusting.

Make this new effort something you can look forward to this time, because it can & should be exciting. Yes, some days you will not feel like it.

That’s normal and should be anticipated, however, you will need to reach down deeper those days to remind yourself of your why and strengthen your discipline muscle when motivation is lacking. On those days, “Just do it!” as Nike would say.

You’ll feel better after you do, and will have that lesson to lean on for the next time.

The more days that consistently start to add up, the closer you are to developing a new habit that will simply become part of your new healthier, happier identity, and that is truly where the blessing resides.

for Gonzales County EMS and that’s when I knew it was my career path.

I fell into something I enjoyed and wasn’t too bad at. I paid my way through Victoria College while working on the ambulance for a couple different services in the area and other part time jobs, to advance my way up to Paramedic.

Yoakum’s Petra English (Hajek) began her Emergency Medical Services (EMS) career in 2000, but she never envisioned doing it from the sky.

For the past three years, the single mother of 6-year old Abbi Camille and 2-year old Drake Allen, has worked as a flight paramedic for AirEvac LifeTeam, based out of La Grange.

Juggling her demanding work schedule and raising a family, Petra found a few minutes in her crazy schedule to answer a few questions about her unique career and herself: I know you said you were born in Killeen, so how old were you when you moved to this part of Texas? What brought you here?

My dad, Ervin Hajek, was in the Army when I was born. We lived in Killeen for a short period of time before getting sent to Germany. We moved back to Yoakum when I was around three years old. My dad is originally from Yoakum so that’s why we came back here. My mom, Debbie, has family here as well.

How old were you when you decided you wanted to be a paramedic? What work did you do before this?

I never really “wanted” to be a paramedic per say. When I was 14 we found out my mom had Hepatitis C and that she would need a liver transplant. When I was 15, I started working after school and by 16 I was working before and after school to help my parents out. My mom got a transplant in February of 1998.

You can only imagine what kind of financial strain that put on my parents. College wasn’t in the cards for me. I got into the work release pro-

What made you want to take the leap from ground work to air?

gram at school as soon as they would let me so I could work more hours.

My grandmother moved to Yoakum to help take care of my mom while I was at school and work, then after work I took care of her. I worked at Faulkner’s Cleaners for most of high school. I was active in FFA throughout high school, and when I was a senior, I won the Dekalb Award, which came with a $500 scholarship at the time. My scholarship money was about to expire and I found out that I could take the EMT class through Victoria College at night and still work full time and take care of my mom. The EMT class cost $500 at the time, so I enrolled just to not waste free money I had earned and I thought it would be helpful knowledge to have in my life. After earning my EMT certificate, I went to work

As a paramedic (if you aren’t afraid of flying), going from ground to air is like the pentacle of your career so to speak. When you become a paramedic there are very few ways to advance your career past that. You can either go into administration, education or flight. To me, flight seemed to be the most challenging step for me, which is why I chose it, plus I wasn’t ready to stop physically treating patients just yet.

What were your career dreams and asperations as a child? What did you want to be when you grew up?

As a kid I always wanted to be a veterinarian. As I got older I realized what it would cost to do that and felt like my parents needed me more at home.

What do you like most about what you do? What do you like least?

LIKE MOST: I love that I get to help people and see the critical thinking that we do on a daily basis change the course of someone’s health in a positive way. The shift work gives me lots of time off as well. Most services I’ve worked for, the schedule was pretty flexible so I was able to get the day off to get my mom to her doctor appointments and that type of thing when it was needed.

LIKE LEAST: The 20 years worth of death and trauma I have in my head, the things

hospital transports where the patient has multiple medications as well as a ventilator because most of those patients were flown due to their time sensitive nature. Also critical trauma patients are usually flown from the scene of the accident to the major trauma center so our time with the patient was just until the helicopter arrived. Now I am part of the team that transports the critically ill and injured patients.

the doctors told us that the liver would last about five years because the hepatitis would damage the new one as well. My mom made it almost 20 years with that liver! The last year before she died was extremely hard on her physically and mentally, but she never once questioned why she was the one going through it. She just always told us she would give it all she had until she wasn’t around to give anymore.

What do your children think about your career?

Please feel free to add anything else you’d like others to know about you and what you do?

My kids are little and it’s just what they have always known. The think the helicopter is super cool, but I don’t think they have a grasp of what I actually do other then “fly in a helicopter”. no person should ever have to visualize, much less live with not being able to fix, is a constant burden and not my favorite part of my job.

What’s it like flying all the time? What do you do in down time while at work?

I absolutely LOVE flying. It makes me wonder why I didn’t transition to it earlier in my career. The physical stress all the constant noise and vibration puts on you can be tiresome, but any time in the air is welcome with me!! In my downtime we do a lot of computer based learning, skills practice with mannikins, exercise, or on the busy days sometimes we just watch TV to separate our minds from the sick patient we just helped.

What training did you have to go through to get this job?

To become a paramedic you have to have a high school diploma or equivalent and enroll in a state approved course; generally through a college.

I did all my EMS training through Victoria College. From start to finish it takes about two years. To transition into flight, most rural flight services want you to have at least three years as a paramedic in a busy area that does 911 calls. Transitioning from ground to flight also comes with some educational gaps you have to be able to overcome as well.

Outside of work, what are some of your hobbies?

Hanging out with my kids just being home or watching them play at the park is what I mainly do when I’m not working. I also love working on my house, going to the gym to destress, and helping my dad on whatever project he has going on at the time.

Are you happy where you’re at with your career or is there more out there to achieve? If so, elaborate please.

If anyone knows someone that struggles with coping with depression or trauma from their career or personal life, please encourage them to seek help. Being mentally healthy is so important when you are trying to help others in a career like this. In the old days it was always said that these traumatic things we had to deal with “came with the job”, and yes to a point that is right, but seeking help to deal with them is not a sign of weakness, it is a sign of selfawareness. Suicide due to PTSD in these type of public service careers (police, fire, Ems, emergency nursing, military) is a real thing, don’t let your coworker/friend be a statistic.

I am very happy with my career and where I am in it right now. There is a possibility of advancing into administration at a later time, but for now I want to keep being able to treat patients and make a direct impact on people’s lives. I’m not ready to “come off the streets” as we put it.

Name anyone who has been inspirational in your life? Explain why.

My mom has been my biggest inspiration in my life. When we found out my mom was sick when I was a teenager, she showed me that something as “small” as an incurable disease wouldn’t stop her from living. She was the strongest person I knew and I strive daily to show my children that same kind of strength.

2 BENEFITS OF NICHE MARKETING Many of you have heard “the riches are in the niches”. Why is that often true?

1. You can be an Expert If you focus on a niche market then you can become an expert fairly quickly. Maybe you already have knowledge about the niche your target audience will appreciate and benefit from? To succeed in any niche you do need to know more than your audience, but you can go a lot further than that. When you are only dealing with a single niche, you will have more time to really hone your knowledge. People are always attracted to authority figures and it won’t be long before your target audience is actively searching for you if you play your cards right. Being the “go to” person in a niche is a real position of power. Your audience will devour your content and will want to interact with you as much as possible. They are far more likely to buy your products and any products you recommend.

2. Easier to Research a Niche Market You can’t know everything about everything. It is far better to focus on a single niche than try to be a “jack of all trades”. Researching a single niche means that you can concentrate on the really important things and only gather data about one thing.

One of the most important things for niche marketing success is to know your customer. You need to know the demographics of your niche market and what they want to know. What desires do your target audience have? What problems can you solve for them? Trying to do this for many different markets will require massive effort and time.

Are you like me and have a few circles of friends? And sometimes those circles overlap and create larger circles of friends with common interests and then they tend to grow and expand into more friendships? Well, that is what has inspired me to introduce you to the next great lady of the Crossroads – Mrs. Ana Lilia Iniestra Carroll – a very special friend of mine and this story with explain why.

Ana and I met about eight years ago through mutual

friends while weekending at Sunday Beach in Port O’Connor. What a fun and exuberant personality! Her smile radiates her positive disposition and makes you feel an instant warmth by just visiting with her. We have attended fashion shows and fundraisers together throughout the years and have enjoyed many more beach days.

But before Ana became a treasured part of the Crossroads, this amazing lady led an impressive life that began over 800 miles away in Mexico City.

As the oldest of five children, Ana grew up rather quickly and took upon many roles as the big sister. When her father resigned from the marines, the family moved to Matamoros, Mexico and it was then that Ana had to step up at the age of nine and began cooking meals and caring for her siblings while her parents worked. She finished high school and college in Mexico and earned a degree in communications. She held a great job with a television program that she describes as

sort of like Good Morning America – but in Mexico. She worked behind the scenes in production and writing scripts for the show while the hosts interviewed an assortment of guests. Ana enjoyed this position very much.

But knew she wanted to get more out of life. So, that is when she moved to Texas!

Are

moved to the U.S. when she was 21 years old. Her main goal was to learn English. But only two weeks into her life in the states, she met her true love – Jason Carroll. The two started dating after meeting in a pool hall. After six and a half years, they married and have been together ever since! They have no children but their sweet dogs, Chihuahuas, are their babies.

Sadly, one of their fur-babies was tragically hurt and passed away on the same day as when Ana was taking her final oath to become a U.S. citizen. That was March 23, 2017. It was a bittersweet day that Ana will never forget.

Of

course, Ana has always been a hard worker. When she moved to Victoria, her first job was at Casa Ole where she would translate the whole menu for Spanish-speaking guests.

Just kidding! She was head of waiters and manager of the restaurant. Ana has always been driven to participate in marathons, so to keep in shape, she joined DeTar Health and Fitness Center. After spending a lot of time at the gym, her instructors encouraged her to take training to become a fitness instructor. She was intimidated at first because of the language barrier, thinking that would slow her

down, but after a lot of work and dedication, Ana became a body pump instructor. That was the best decision she ever made with her career. She has been at DeTar for twelve years and has worked many positions at the gym along with the many classes she leads. And for the past eight years she has worked as a certified personal trainer.

And I can personally testify that she is worth every minute that she spends with her clients!

Her

mornings start early, and her day may end late. So, what does this fabulous lady and her husband do when she’s not at the gym? Ana and Jason are always taking road trips to see out-of-town-friends or they head to Mexico to visit her family. Her family adores Jason and her mother makes lots of Mexican food for him while they are there. Jason is also Ana’s biggest fan when it comes to her marathons. They love traveling to so many big races – New Orleans, Dallas, San Antonio, Houston, and many more. It is so important to have a cheerleader on the sidelines as you make those final strides to the finish line.

And he is always there to meet her at the end.

Our community is so fortunate to have such a beautiful lady as part of the Crossroads.

She is dedicated to her classes and clients and DeTar. And every time she participates in a marathon, her heart and soul go into supporting the variety of efforts that each one benefits. We are so proud of you, Ana! Thank you for being in our circle of friends!

If you are one who won’t hesitate to help when others are in need, consider the following tips: • Only donate to established charities that you are familiar with.

• Take a second to research any other charities you may want to contribute to.

• Hang up on robocalls. Don’t press any numbers if you are prompted to.

• Don’t click on any links in unsolicited emails from unknown sources.

• Don’t allow someone to take advantage of your generosity by pressuring you and rushing you into making a donation. Any legitimate charity will allow you time to decide and contact them.

• Don’t donate to solicitors requesting donations be made in cash, gift cards or by wiring money.
