MAINTENANCE COMMITTEE CHAIR 1. What makes you passionate about volunteering for FCAA? Being able to share my knowledge and watching people continue to grow in their career. I have had the opportunity to meet so many different people, and have built many friendships through the association. 2. What does your committee do? We discuss maintenance classes and always looking to add new hands on classes. We discuss the PMC and CAMT. We put together the maintenance appreciation breakfast and the Golden Plunger award. Always looking to broaden maintenance in any way we can. 3. Why should someone join your committee? We are always looking for new ideas, and trying to promote the younger generation to get more involved. 4. Why is your committee important for FCAA? We have so much to offer. It is great networking as we count on each other and their knowledge. Continuing education with a wide variety of classes that are offered to keep everyone abreast as far as changed in the law as well as upgrades to appliances, etc. There is maintenance mania/maintenance appreciation. 5. What are you looking forward to your committee accomplishing in 2019? To be able to offer different classes, and keep attendance up. Getting more maintenance personnel involved. Working on getting more involved with the trade schools for recruitment. Also, hoping to set up a scholarship program with vendors to sponsor a few individuals for classes. 6. How can people get involved with your committee? They can contact myself, or anyone at FCAA. They can also go on the FCAA website. Get on the e-mail list. We meet once a quarter for about an hour. We would love to have you be a part of our committee.

About six weeks ago, one of our residents marched into the office first thing in the morning and stated that she arrived home from her job and discovered a large piece of the kitchen ceiling on the floor with water dripping from the ceiling. We immediately processed a work order. Our maintenance supervisor was able to figure out the source of the leak. By the next afternoon, our staff had resolved the problem, and the ceiling was fully repaired. There was no communication from the resident until last night when we received a letter from the resident’s attorney requesting us to provide our insurance information .The letter stated the resident was injured when the ceiling “fell on her face”. We think this is a complete lie. Did we handle this properly? Do we have to send the insurance information to her attorney? Welcome to the world of frivolous and fraudulent insurance claims and lawsuits. You acted correctly by writing up a work order, but made a critical error in not sitting the resident down and having her write up a report or request. Your management company should create an “Incident Report” form for the resident to fill out. At the time of the incident, the resident has not had the time to think up a fraudulent claim or consult an attorney. This report should be used whenever there is an unusual occurrence, damage, theft or loss to a resident’s property, vehicle or any injury a resident reports. If a resident finds out that your company will not be reimbursing for a loss, then there is a strong probability that the resident will inflate or otherwise make a fraudulent claim. The disclosure of insurance information is required by law when properly requested, whether or not you view the underlying claim as frivolous. A resident recently moved into our apartment community and has been complaining ever since. Two weeks ago this resident called in an order about her washer and dryer malfunctioning. Our maintenance supervisor went by the apartment home two hours after the resident first reported the problem. Our maintenance supervisor knocked on the door, and no one answered. He heard talking through the door and saw the resident’s car in the parking lot. He then left a note on the door asking the resident to call and set up an appointment. The resident never contacted our office. Last week, the resident called again asking why the washer and dryer were not fixed. I scheduled a second appointment with her, and when my maintenance supervisor knocked on her door at the agreed upon time, no one came to the door again. Today, I received an email from an attorney stating that the resident is going to break the lease because repairs were not made. Can we enforce the lease? This is a classic lease break trick. The resident claims that your maintenance staff never showed up to make the requested repair. Of course, your maintenance supervisor will testify in court that he twice attempted to make the repair, but the judge may demand more proof. Whenever a resident has a maintenance request, a work order should be written up immediately. For example, if notice is necessary for a work order, written notice should be posted on the resident’s door stating the date and time

ADVOCACY Greetings FCAA members! My name is William Jaycox and I want to thank you for welcoming me to your team. As a newcomer, I thought I’d take the time to describe a little bit about myself, my role, and an important policy issue that has recently surfaced. Although I currently reside in Orlando, I was born and raised in Jacksonville. As such, I am very eager to be working with FCAA and the local elected officials in my hometown. I first moved to Orlando to study at the University of Central Florida, where I graduated with a major in political science and minors in both intelligence and Russian studies. Prior to my role as the local government affairs manager, I served as the government affairs intern for the Florida Apartment Association. In this position, I learned the intricacies of government affairs and saw firsthand the critical role that local advocacy plays in the continued success of the apartment industry. After the conclusion of my internship, I was excited to learn that FAA was looking to hire a local government affairs manager. I am honored to have been selected to fulfill this important new position and I look forward to working alongside all of you to enhance FCAA’s local advocacy program. How will my new role enhance FCAA’s advocacy program? As the local government affairs manager, I will assist FAA affiliates with monitoring local legislative activity to determine potential impacts on the apartment industry as well as help members achieve advocacy goals. The primary affiliates that I will assist are: the First Coast Apartment Association, the North Central Florida Apartment Association, the Southwest Florida Apartment Association, and the Space Coast Apartment Association. FCAA has already been successfully engaged on a variety of local advocacy efforts, including a recent discussion regarding short-term rental regulations. In my new role, I aspire to build on the connections FCAA has established with local government officials and other stakeholders within the community to increase the apartment industry’s influence in the policy-making process. In addition, I am excited to be your “go-to” person for policy research and assistance on all local government related issues.

ADVOCACY IN ACTION An important policy issue related to fire signal enhancers for multifamily properties has recently emerged. This issue has flown under the radar for some time, but it is quickly garnering the attention of some local governments now that compliance deadlines within state law are fast approaching. Although we have not seen any activity related to this topic in FCAA territory, I want to be sure you are upto-date on this issue. What are fire signal enhancers? Fire signal enhancers can be added to apartment communities to amplify the fire department’s radio signal within a building. These signal enhancers ensure firefighters can communicate throughout the building in the event of an emergency. The number of signal enhancers and the type of technology required for each property depends on a variety of factors, including the building’s construction materials and the local fire department’s radio technology. Where do local governments get the authority to require fire signal enhancers? Florida’s Building Code was amended in 2016 to give local jurisdictions broad authority in determining the minimum radio signal strength for fire department communication systems. Florida Statute 633.202, “Florida Fire Prevention Code” states, “The authority having jurisdiction shall determine the minimum radio signal strength for fire department communications in all new high-rise and existing high-rise buildings... Existing apartment buildings are not required to comply until January 1, 2025 . However, existing apartment buildings are required to apply for the appropriate permit for the required communications installation by December 31, 2022.”
How does this impact apartment communities?
Current statute does not articulate minimum requirements for municipal radio equipment or timelines for ongoing equipment inspection. In addition, state law does not preempt local governments from expanding the signal requirements to include other emergency radio equipment such as police or EMS systems. In light of this, some local governments are looking to add regulations at the local level, many of which will be damaging to apartment communities. Signal enhancing systems can range in cost from $15,000 to $300,000. In addition to these upfront costs, some local governments are seeking to subject apartment communities to annual inspections that can cost $3,000. We have also heard that some local jurisdictions are already withholding certificates of occupancy for newly constructed apartment communities until the radio signal strength requirements are met, which can significantly delay lease-ups and create astronomical cost increases for apartment operators. Since this is both a local and statewide concern, you can rest assured that FAA is working to address this issue during the 2020 Legislative Session. that entry will be gained for the repair. In the event the resident states that he or she must be present, you need to immediately send a confirmatory letter to the resident reiterating the fact that the resident has demanded to be present, and set up a date and time accordingly. If the resident misses the appointment, you need to write this down and immediately set another appointment. Document everything. Waiting for the resident to contact management can only help the resident in convincing a judge that the apartment community was not responsive. Finally, keep in mind that the landlord may enter the apartment home in an emergency situation at any time for the protection or preservation of the premises. The landlord may enter upon reasonable notice to the resident and at a reasonable time for the purpose of routine repairs of the apartment home. “Reasonable notice” for the purpose of repairs is notice given at least 12 hours prior to the entry, and reasonable time for the purpose of repair shall be between the hours of 7:30 a.m. and 8:00 p.m. We filed an eviction a few weeks ago on a resident that was severely delinquent with rent payments. The day before the deadline for the resident to file an answer to the eviction complaint, we received an email from his attorney proposing a settlement. The resident’s attorney would sign a stipulation which simply stated that if the resident did not vacate by the end of the week, a final judgment of eviction would be entered and a writ of possession would be issued to the sheriff without the need for a hearing. Our attorney recommended that we agree to this, but we passed on this offer because we did not believe the resident was deserving of the extra time. We just found out that earlier today the resident’s attorney filed an answer with the court, a motion to dismiss, and a motion to determine rent. A hearing is set for three weeks from now! Should we have taken our attorney’s advice? You really made an unwise decision here. It is very common for residents to ask attorneys for assistance. They often have a prior or existing relationship with the attorney. The attorney might be a friend, relative or representing the resident in a different matter. The resident’s attorney usually does not have any desire to be involved in the eviction case, but feels obligated to do so based upon the relationship with the resident. In many instances, the resident is just looking to receive a short extension of time in order to move to another location. In this case, you should have stipulated with the resident. You would have been virtually assured that the eviction would be approved by the judge if the resident did not move by the end of the week as was offered. While it is understandable that you felt that you were giving the resident something he did not deserve, what you really did was open the door for the resident’s attorney to file papers with the court and aggressively represent the resident. This instantly bought the resident much more than one week, and while you may still prevail in court, the resident will remain in the apartment home for at least three more weeks. It is critical that you trust your attorney’s judgment in these cases.
