Some Frequently Asked Questions about Divorce By Randy R. Rowney, Attorney at Law

The following is provided for informational purposes only and is not, nor should it be construed as legal advice. I have been representing men and women seeking divorces for over thirty years. These are a few of the recurring questions I answer on a regular basis. Question: Does the court require child support to be paid? Answer: Texas law requires parents to support their child until the child turns 18 or graduates from high school, whichever event occurs last. Judges will order the parent who has the child less than 50% of the time to pay child support based upon statutory guidelines. Occasionally, courts will accept agreements between parents that provide for reduced child support or no child support at all if such an agreement is in the best interest of the child. Question: Is it true that each spouse gets 50% of the property in a divorce. Answer: Not necessarily. Texas is a community property state meaning the court will presume that all property in the marriage is jointly owned. The Judge is not required to divide the community property equally. The Judge may order a disproportionate division of the community estate based upon factors such as fault, earning potential of the spouses, health of spouses, etc…. Question: Is it true that mothers always get custody of the children? Answer: No. While years ago, it was commonplace for the mother to be named the conservator who has the right to establish the residence of the child (custody), it is not unusual for fathers to now be named the primary custodial parent. The Judge considers the evidence produced in trial and makes the decision of “custody” based upon the best interest of the child.

Question: Is it true that my twelve years old child gets to decide with which parent he/she lives? Answer: No. This is a common misperception. Texas law says that a child, twelve years old or older, can talk to the Judge in the Judge’s office and state his/her preference as to which parent is named the primary custodial parent (the one who designates the child’s residence). The Judge still must decide if the child’s request is in the best interest of the child.

The sweet candy hearts that fill up store aisles and candy dishes in early February got their start around the time of the Civil War. The original candies, called cockles, were made from sugar and flour and contained sayings which were printed on thin paper and rolled up inside the folded, shell-shape candy. The conversation candy hearts that we know today date back to 1902. NECCO (New England Confectionery Company) makes more than 8 billion candy hearts every year to keep up with the demand for the sweet treat. Every day from late February through mid-January, around 100,000 pounds of conversation candy hearts are made. The entire amount produced during this time sells out in six weeks. Candy hearts are the best-selling Valentine’s Day candy. In 2010, for the first time in 145 years, the company discarded all of the sayings for the conversation hearts and created a new line with expressions selected by the public. The most popular new sayings for conversation candy hearts are “Tweet Me,” “Text Me,” “You Rock,” “Love Bug,” “Soul Mate,” and “Me + You.”

Sharing a Little (Organizing) Love

The month of February is all about hearts, flowers, candy and love. There’s a lot to love about organizing and productivity! Organizing is a gift you give yourself and a gift to others. In the book, The Five Love Languages, Gary Chapman refers to as gifts of service and gifts of quality time. An “act of service” is doing something for another person as an expression of love. A “gift of quality time” it is spending time together. A gift of organizing is a small act that makes a big emotional impact to us, to our colleagues and to our family. Share a little (organizing) love this month. Here’s a small sampling of these ways to get organized and share some organizing love. • Family dinner time together is often a shared act of love. It’s a gift of service for those who prepare the meal and clean up and a gift of quality time together. Start with an easy meal plan and use a list or grocery app. Organize and label your pantry so everyone knows what’s available and it’s easy to make dinner. Partner with a family member to make dinner and clean up together. I love the FamilyDinnerProject. org to find easy meals and table topics. • There are many acts of service as part of organizing. Here’s some gifts of love to do. Put away another family member’s laundry for them. Do one of your family chores for someone. We all love it when we have one less thing to do and that someone has helped us do something hard to do. What small gift, like unloading the dishwasher or vacuuming the car, can you do that will make your family or friend feel loved? • Our blessing others with our goods is an act of love. In the book, The Life Changing Magic of Tidying Up, Marie Kondo encourages us to keep only what “sparks joy.” Marie is sharing to keep only what we love. Take donations to a local charity with your family and see together the impact it can make. Our community is blessed to have so many ways to help others. • Organizing can be quality time together and lead to better productivity. Work together with a family member or friend to declutter a space. Listen to their ideas and help them make decisions and know what to let go. Or you can work alongside your friend or family member as a “body double.” My clients share stories that when they are organizing, just having another person in the space tethers them to the task,

helps them think through ideas and helps them get organized. Set aside time each day during homework time with your kids. While they are doing their work, you can work on your paper work and administrative tasks. • Share your gift of service by working on a family project together. Work together on a service project for a local philanthropy. When you model acts of service, you are sharing important values and giving back to our community. • Give yourself the gift of organizing. When you organize, it’s a type of self care that lowers your worries and makes you feel better. Spending a few minutes every day on organizing creates energy and positivity. The true gift of organizing is the connection you create with your family and friends. Just as important as words of love, these acts of love make an impact every day, not just on Valentine’s Day. Your little (organizing) love lasts all year!

Valentine’s Day Through the Ages by Eric Scott

Historical clues present interesting views on the origin of Valentine’s Day. Among ancient Roman holidays was a celebration called the Feast of Lupercalia. Gallons of wine were consumed in reveling and “romancing” from the evening of February 13 to the morning of February 15. If you could go back in time a couple thousand years, the streets of Rome might bring to mind a radical Mardi Gras where brazen men and immodest women staggered through city streets and embraced indiscriminately in public squares. Scantily clad young women stood in line to step onto a raised public stage and be “hit on” by men they didn’t know, who paid to whip them gently with strands of limp hides. Beyond the whelps that made their soft skin glow pink, extreme sadomasochistic participants voluntarily pressed to draw blood as spectators cheered. Pink and red became the backdrop for the holiday banner. The occasion also entailed a matchmaking lottery, in which men drew names of women from a jar, and paired up for the festival. Some of the coupling lasted beyond the holiday, and a lot of men found a mate by drawing her card. Hmm. Well kids, this is how I met your mom… In the third century AD, Emperor Claudius II executed two men, both named Valentine, on February 14 of different years. The Catholic Church honored their martyrdom with the induction of St. Valentine’s Day. Two centuries later, Pope Gelasius combined St. Valentine’s Day with Lupercalia in Rome in an effort to dilute the pagan sexual rituals. People dressed normally and stopped spanking young strangers, but that didn’t diminish 30 • www.forestimage.com

their emphasis on courtship. In the tenth century the Normans, or Norsemen, invaded the Anglo-Saxons from the north, establishing Normandy in France and occupying much of Italy and Britain. Normans celebrated Galatin’s Day, galatin meaning lover of women, and because they sounded alike, the holidays were combined. Later, writers like Chaucer and Shakespeare romanticized the dying holiday in literature and plays, and it regained popularity throughout Britain and western Europe. Handmade paper cards carried messages of friendship and amour in the Middle ages. But then, in 1913 Hallmark Cards changed the month of February forever when they began mass producing Valentine cards and paraphernalia. Holidays can be revived and redeemed for a better purpose. And, so can relationships. You have the power to initiate, stoke, confirm, or rekindle an important relationship in your life. Why not take advantage of St. Valentine’s Day this year to reach out with a card and a glass of wine to say, “I love you”? Treat someone you love and appreciate to a fancy meal and a bouquet of flowers. History tells me, dinner and a rose are a good investment on any St. Valentine’s Day.
