Message from the Chief Justice Welcome to the final DIFC Courts Bulletin of 2020.

On behalf of the DIFC Courts I would like to extend my best wishes and prayers to you all during this very difficult period.

Undoubtedly, 2020 has been a year that tested the resilience of every government service, private sector business, and individual. It has been a year that has forced everyone to re-shift focus; to reprioritise, and, to adapt to rapid changes.

For the DIFC Courts in 2020, I am proud and honoured to confirm that we maintained all services and continued at full operational capacity.

This successful preservation of full operational capacity would not have been possible without early foresight; technology has been central to the DIFC Courts’ operating model since starting operations over a decade ago. Early tech adoptions are now the bedrock that fortunately enables the DIFC Courts to maintain all core services and stay connected with court users.

In the second half of 2020, the DIFC Courts pushed ahead; with operational capacity at full strength, we sought out new inter-governmental partnerships, with the ultimate goal to ensure that together we are all working towards strengthening the UAE economy. Building on cooperation first initiated in 2015, the DIFC Courts signed a cooperation agreement with The Dubai Investment Development Agency (Dubai FDI), an agency of the Department of Economic Development (DED) in Dubai, to support the emirate’s economic ambitions outlined in Dubai Plan 2021.

Dubai and the UAE’s commitment to providing a highly competitive business environment is crucial to its long-term vision of economic diversification.

The ability of the UAE’s judicial systems to support and protect the businesses that operate here will prove crucial to the nations’ long-term objective to attract and retain foreign investment. Global investors and businesses recognise the importance of an advanced and mature legal framework for dispute resolution and a legal system that connects seamlessly with multiple jurisdictions around the world. This is especially true for multijurisdictional corporations.

The attraction of Dubai as one of the region’s top investment and retirement destinations was further boosted in November 2020 when the DIFC Courts signed a cooperation agreement with the Department of Tourism and Commerce Marketing (Dubai Tourism), to support the newly launched ‘Retire in Dubai’ programme.

With over two million expatriates residing in Dubai, the Government of Dubai and the DIFC Courts recognise the vital importance of our innovative service for residents and investors. Under the agreement, the DIFC Courts has developed enhanced Wills registration and Probate services at exclusive discounted rates. The services will assist retirees with securing their assets in the UAE, delivering final peace of mind and safe in the knowledge that their wishes will be respected.

For 2020, we have been successful in our aim to lead the way in technical advances, enabling us to continue, uninterrupted, with our support to the business community. For 2021, we will continue to consciously look at ways in which to improve and progress, not only the range of our services, but the manner in which they are delivered for court users and the public.

Volume of cases in the main Court of First Instance (CFI) grew significantly, increasing by 96% year-on-year

DIFC Courts leverages digital infrastructure to accommodate rapid rise in commercial claims In August, the DIFC Courts released its figures for the first six months of 2020, confirming a substantial increase in claims filed with Dubai’s English-language common law jurisdiction.

The volume of cases in the main Court of First Instance (CFI) grew significantly, increasing by 96% year-on-year. The total value of cases in the same period, including arbitration-related cases, amounted to AED 2.2 billion, with an average case value of AED 88.5 million.

Cases brought before the CFI covered a range of sectors including banking and finance, construction, rreal estate, manufacturing and also involving

disputes related to breach of contract, outstanding payments, insolvency, Wills & Probate, and employment. There was also a noticeable increase in the number of ‘opt-in’ cases for the first six months of 2020, with over 70% of claims in the CFI and arbitration-related cases originating from parties ‘electing’ to use the DIFC Courts to resolve their disputes.

Reinforcing the Courts’ record of certainty for business through enforceable judgments, the total value of enforcement claims filed amounted to AED 192.4 million for the first half of 2020, with an increase of 15% on the number of claims, as compared with the first six months of 2019.

Early technology adoptions are now the bedrock that fortunately enables the DIFC Courts to maintain all core services during this difficult period

The operational capacity of the region’s first Small Claims Tribunal (SCT) was strong in the first six months of 2020, with 213 claims filed and overall claim value totalling AED 24 million. Greater awareness and the innovative use of technology, including the region’s first “Smart SCT” virtual court, has led to over 50% of claims registered as ‘opt-in’.

H.E. Omar Al Mheiri, Deputy Chief Justice, DIFC Courts, said: “Choice is an extremely important factor for individuals and businesses when choosing a jurisdiction for the resolution of their dispute. For over a decade the DIFC Courts has demonstrated an ability to provide this choice for businesses, while guaranteeing the standard of service that leading international commercial courts are renowned for. At a time when the UAE is now the largest recipient of foreign investment in the Middle East, confidence continues to grow in our legal framework, contributing to the overall value proposition of the DIFC, Dubai and the UAE, for investors and the international business community.”

As a part of the UAE Government’s commitment to effectively employ advanced technologies and digital platforms to continue services to the public, the DIFC Courts leveraged its digital mediums to stay connected with court users during COVID-19 restrictions. Statistics confirm that the DIFC Courts is not only maintaining all services, but is simultaneously increasing operational efficiency, issuing over 500 digital Orders and Judgments over the course of the first six months of 2020.

By increasing utilisation of our digital infrastructure, such as existing videoconferencing and teleconferencing facilities for applications and hearings, we are enabling court users and the public to access extensive eServices remotely.”

Among the many technologies the courts has pioneered to re-engineer and increase access to justice, is the region’s first e-Registry in 2009, digitally integrated courtroom and state-of-theart e-Court Management System (CMS) in 2017,

as well as the region’s first ‘paperless’ e-bundling solution in 2018.

In February 2020, the DIFC Courts established its Arbitration Division, mandated to accommodate the rapidly increasing number of arbitration-related cases. Similar to the Technology & Construction Division (TCD) launched in 2017, the Arbitration Division is Chaired by H.E. Justice Shamlan Al Sawalehi and leverages dedicated judicial and registry oversight and case management expertise.

Streamlining the arbitration-related cases under the new division has also led to increased efficiency of process, with the ability to swiftly review applications for interim measures and injunctive relief mechanisms.

With the onset of COVID-19, the DIFC Courts also injected fresh digital systems for the registration of Wills. A joint initiative of the Government of Dubai and the DIFC Courts, the Wills Service has now re-engineered its digital service offering in light of the current pandemic and the Government’s nationwide initiative to Stay Home and curb the spread of the virus.

With individuals and businesses across the UAE operating remotely, the new video conferencing facility can be accessed via a smartphone, tablet, or a desktop device, allowing residents and investors to register their Will remotely, from the safety and comfort of their own home.

This digital offering is in addition to an existing Virtual Registry, which allows those living overseas to create and register a DIFC Courts Will.

Investors and former residents can access it from anywhere in the world and be connected, via video link, to a compliance officer sitting in Dubai.

The DIFC Courts has also introduced several initiatives aimed at alleviating costs for court users, including the suspension of all fees related to the e-Bundling service. In addition, applicants filing a claim at the Small Claims Tribunal (SCT) may also request a fee suspension. This facility enables eligible applicants the flexibility of paying the courts’ fees after the SCT case has concluded.

DIFC Courts and Dubai FDI partnership to boost investor confidence in Dubai

In September, the DIFC Courts signed a cooperation agreement with The Dubai Investment Development Agency (Dubai FDI), an agency of the Department of Economic Development (DED) in Dubai, to support the Emirate’s economic ambitions outlined in Dubai Plan 2021.

Building on cooperation first initiated in 2015, the terms of the memorandum state that the two entities will continue to further collaborate on the exchange of information and research, and the hosting of joint conferences and exhibitions.

According to Dubai Investment Development Agency (Dubai FDI), Dubai attracted Dh12 billion in foreign direct investment (FDI) through 190 projects during the first half of 2020, despite the coronavirus pandemic. In terms of investment sources, nearly 25 per cent of FDI capital flows came from the US, followed by France (18%), Belgium (9%), and the UK and China (8% each).

As commerce becomes ever more global and countries ever more connected, it is imperative that judicial systems keep pace and remain able

to support and protect businesses. It was this basic requirement that led to the creation of the DIFC Courts in 2004.

The DIFC Courts is Dubai’s English language, commercial common law judicial system, with the specific objective to enable the international community to have greater confidence in the Emirate’s legal framework, and further strengthen the trade relations with Dubai.

While every country has in the world has some kind of system for resolving disputes, those ranked highest by the World Bank have recognised that investing in efficient and well-respected business courts is essential

Dubai ranks first in the Middle East and North Africa (MEA) region and third in the world in the number of foreign direct investment projects attracted and ranks first in the Middle East and North Africa region and sixth in the world in terms of foreign direct investment capital inflows, after Singapore, Shanghai, London, New York, and Hong Kong.

For over a decade the DIFC Courts has a track record of resolving all commercial disputes, ranging from sophisticated, international financial transactions, to simple domestic contractual and employment disputes. Big business can – and increasingly does – bring its disputes to Dubai.

Through a series of memoranda with leading international jurisdictions the DIFC Courts has now established one of the world’s strongest enforcement regimes. Money judgments can be enforced internationally through treaties such as the GCC Convention and Riyadh Convention, conventions with China, India and France, and reciprocal arrangements with leading common law jurisdictions, such as the UK, the US, Australia, Singapore, and Hong Kong.

DIFC Courts launches new Arbitration Working Group In October, the DIFC Courts launched a new Arbitration Working Group, the first court in the region to introduce such an initiative. The panel of experts is tasked with reinforcing and sharing developments and best-practices, encompassing an advisory team of arbitration professionals, bodies, centres, educational institutions, and industryrelated organisations.

Since its inception, the DIFC Courts has dealt with a multitude of high-value arbitrations from across the world. As more and more parties choose the DIFC Courts as the preferred seat of arbitration, operations have been expanded to accommodate this influx under the new division, offering a wealth of judicial experience in dealing with high-value complex commercial disputes.

Zaki Azmi, Chief Justice, DIFC Courts, said: “As a Court, it is not our intention to compete with the arbitration industry, but rather to complement the service offerings of arbitration centres. Our long-

term vision is to work closely with as many experts and industry-specific organisations to gain a better understanding of how we can adjust and modify our Court services to better assist those with arbitration-related disputes.�

Lawyers, law firms and companies can best use the DIFC Courts by ensuring that they write the court’s jurisdiction into their contracts for dispute resolution. For arbitration-related disputes, the DIFC Courts can also be chosen as a ‘default’ seat/ supervisory court.

Launched through a partnership in 2015 between the DIFC Courts and the Government of Dubai, the Wills Service was established to enable nonMuslims who are investing and living in the UAE to pass on their assets and appoint guardians for their children in line with their wishes through a Will registration service.

As a part of the UAE Government’s commitment to effectively employ advanced technologies and digital platforms to continue services to the public during COVID-19 restrictions, in 2020 the DIFC Courts leveraged its digital infrastructure to offer videoconferencing for Will registrations.

With individuals and businesses across the UAE currently operating remotely, the new video conferencing facility can be accessed via a smartphone, tablet, or a desktop device, allowing residents and investors to register their Will remotely, from the safety and comfort of their own home. The new system now allows the Testator and two Witnesses to join in on the video conferencing call from different locations.

The system also allows an approved Will to be directly uploaded on the system and to affix electronic signatures.

Remote registrations add an additional layer of digital access to the current Virtual Registry for Wills, which allows those living overseas to create and register a DIFC Courts Will. Investors and residents can access it from anywhere in the world and be connected, via video link, to a compliance officer sitting in Dubai.

The DIFC Courts also provides an online automated will drafting service for the Property Will, Business Owners Will and Financial Assets Will, with comprehensive explanatory notes, should retirees wish to draft the Will independently.

‫يف المنطقة عند طرحه يف عام ‪2009‬؛ إىل جانب قاعة‬ ‫المحكمة المتكاملة رقميا مع أحدث نظم إدارة المحاكم‬ ‫اإللكترونية يف عام ‪2017‬؛ وإدخال أول حل يف المنطقة‬ ‫للتجميع اإللكتروين من دون ورق يف عام ‪.2018‬‬ ‫يف فبراير ‪ ،2020‬أنشأت محاكم مركز ديب المايل العالمي‬ ‫قسم التحكيم الخاص بها‪ ،‬الستيعاب العدد المتزايد بسرعة‬ ‫من القضايا المتعلقة بالتحكيم‪ ،‬على نهج قسم قضايا‬ ‫البناء والتكنولوجيا الذي أطلقته يف عام ‪ .2017‬وسيترأس‬ ‫القسم الجديد سعادة القاضي شمالن الصوالحي الذي‬ ‫يتمتع بخبرات متخصصة واسعة يف اإلشراف القضايئ‬ ‫والتسجيل وإدارة القضايا‪ .‬كما أدى تبسيط القضايا‬ ‫المتعلقة بالتحكيم يف إطار القسم الجديد إىل زيادة الكفاءة‬ ‫العملية‪ ،‬مع القدرة على مراجعة طلبات التدابير المؤقتة‬ ‫وآليات األوامر القضائية بسرعة‪.‬‬ ‫ويف ظل أزمة كوفيد‪ 19-‬العالمية‪ ،‬قامت محاكم مركز ديب‬ ‫المايل العالمي بتهيئة أنظمة رقمية جديدة لتسهيل‬ ‫التواصل والتعامالت مع مركز خدمة الوصايا التابع لها‪.‬‬ ‫حيث قامت بإعادة تصميم خدماتها استجابة لمبادرة‬ ‫الحكومة على الصعيد الوطني لتشجيع البقاء يف المنزل‬ ‫والحد من انتشار الفيروس‪.‬‬ ‫ومع التزام الجميع من أفراد وشركات بالتعليمات الحكومية‬ ‫بشأن البقاء يف المنزل والعمل عن بعد‪ ،‬طورت محاكم‬ ‫مركز ديب المايل العالمي خاصية إجراء مكالمات الفيديو عبر‬ ‫اإلنترنت لربط المتعاملين مع خدمة تسجيل الوصايا‪ ،‬سواء‬ ‫عبر الهاتف الذكي أو الجهاز اللوحي أو أجهزة الكمبيوتر‬ ‫لتسجيل وصاياهم عن بُعد من راحة وأمان منازلهم‪.‬‬ ‫ويتيح هذا الخيار الرقمي الجديد إىل جانب السجل‬ ‫االفتراضي لألشخاص الذين يعيشون يف الخارج إنشاء‬ ‫وتسجيل وصية لدى مركز ديب المايل العالمي‪ ،‬حيث يمكن‬ ‫للمستثمرين والمقيمين السابقين الوصول إىل السجل‬ ‫االفتراضي من أي مكان يف العالم‪ ،‬ويتم وصلهم عبر رابط‬ ‫فيديو بموظف امتثال يقع مقره يف ديب‪.‬‬ ‫كما أطلقت محاكم مركز ديب المايل العالمي يف األشهر‬ ‫األخيرة عدة مبادرات تهدف إىل تخفيف التكاليف على‬ ‫مستخدمي المحاكم‪ ،‬بما يف ذلك تعليق جميع الرسوم‬ ‫المتعلقة بخدمة التجميع اإللكتروين‪ .‬إضافة إىل ذلك‪ ،‬يمكن‬ ‫للجهات الالجئة لمحكمة الدعاوى الصغيرة طلب تعليق‬ ‫الرسوم أيضا‪ .‬وتتيح هذه التسهيالت لمقدمي الطلبات‬ ‫المؤهلين مرونة يف دفع الرسوم بعد انتهاء القضية يف‬ ‫محكمة الدعاوى الصغيرة‪.‬‬

‫محاكم مركز ديب المايل العالمي ُتس ّ‬ ‫خر‬ ‫بنيتها التحتية الرقمية الستيعاب االرتفاع‬ ‫المتسارع يف أعداد الدعاوى التجارية‬ ‫يف أغسطس أصدرت محاكم مركز ديب المايل العالمي‬ ‫إحصاءاتها لألشهر الستة األوىل من عام ‪ُ ،2020‬مظهرة زيادة‬ ‫كبيرة يف حجم الدعاوى المرفوعة أمام نظام القانون العام‬ ‫العامل باللغة اإلنجليزية يف ديب‪.‬‬ ‫فقد سجلت القضايا المعروضة أمام المحكمة االبتدائية‬ ‫زيادة كبيرة من ناحية الحجم‪ ،‬بنسبة بلغت ‪ ٪96‬على‬ ‫أساس سنوي‪ .‬لتصل قيمتها اإلجمالية إىل ‪ 2,2‬مليار درهم‬ ‫إمارايت يف النصف األول من العام‪ ،‬بما يف ذلك القضايا‬ ‫المتعلقة بالتحكيم‪ ،‬بمتوسط قيمة يبلغ ‪ 88,5‬مليون درهم‬ ‫إمارايت للقضية الواحدة‪.‬‬ ‫وشملت القضايا المعروضة أمام المحكمة االبتدائية‪ ،‬طيفا ً‬ ‫واسعا ً من القطاعات‪ ،‬بما فيها القطاع المصريف والمايل‬ ‫واإلنشاءات والعقارات والتصنيع‪ ،‬بخصوص نزاعات تتعلق‬ ‫بمخالفة العقود وعدم سداد الدفعات المستحقة والوصايا‬

‫وإثباتها وقضايا التوظيف‪ .‬كما كانت هناك زيادة ملحوظة‬ ‫يف عدد القضايا المعروضة اختياريا ً أمام محاكم المركز يف‬ ‫عام ‪ ،2020‬حيث أتت أ كثر من ‪ %70‬من الدعاوى المعروضة‬ ‫أمام المحكمة االبتدائية والدعاوى المتعلقة بالتحكيم من‬ ‫أطراف اختاروا اللجوء إىل محاكم مركز ديب المايل العالمي‬ ‫لحل نزاعاتهم‪.‬‬ ‫وبلغت القيمة اإلجمالية لدعاوى إنفاذ األحكام المقدمة‬ ‫‪ 192.4‬مليون درهم إمارايت يف النصف األول من عام ‪،2020‬‬ ‫ما يشير إىل تنامي ثقة الشركات بقدرة المحاكم على إنفاذ‬ ‫األحكام‪ ،‬بزيادة نسبتها ‪ %15‬عند المقارنة مع األشهر الستة‬ ‫األوىل من ‪.2019‬‬ ‫كما شهدت محكمة الدعاوى الصغيرة األوىل من نوعها يف‬ ‫المنطقة نموا ً قو يًا يف حجم القضايا المعروضة أمامها يف‬ ‫النصف األول من ‪ ،2020‬مع تسجيلها لـ ‪ 213‬دعوى بقيمة‬
