Dictum Society is affiliated as a College Society through Victoria University’s Student Union (VUSU). This means that Dictum Society is the peak student representative body for Victoria University’s College of Law and Justice.

Our content also caters for the lighthearted with our brainteaser puzzles and fun facts that are peppered throughout the magazine. Our newly introduced 'LOL: Laugh Out Law' column also aims to publish funny legal cases and narratives for the entertainment of our readers.

The Obiter is Dictum Society's official magazine. The magazine provides its readers with content that is fresh, stimulating, and diverse.

Dictum Society was established in 2012, and has successfully engaged and serviced a wide variety of external and internal stakeholders in this short time. We are a Society which aims to represent the diverse aspirations and attributes amongst our law students and improve their university experience.

Copright is 'Not Gonna Take It'

A popular case reference is the copyright infringement involving Twisted Sister's hit song, 'We're Not Gonna Take It' (WNGTI) wherein United Australia Party (UAP) founder, Clive Palmer was asked to pay a whopping AU$1 5 million as financial penalty pursuant to infringed copyright in WNGTI. The action was brought against Mr Palmer by joint applicants Universal Music Publishing Pty Ltd and Songs of Universal (collectively, Universal), which are the exclusive Australian licensee and copyright assignee respectively. Justice Katzmann further awarded AU$1.0 million in additional damages pursuant to s115(4) of the Copyright Act 1968 (Cth) (Act), the amount being equivalent to two thirds of the total award.

Napster,

Napster's argument was that they were not directly involved in transmitting copyright protected content as third parties were uploading this music by their own volition on the Napster program. However, this argument was not taken by the Court as they pinpointed that because Napster knew about the widespread and repeated sharing of copyright infringing content being transmitted in its network, it took no measures to prevent this from happening, and financially profited from such transmissions.

Napster was a peer to peer file sharing network which allowed users to transmit MP3 files. This created controversy among major record companies as it permitted free transmission of copyrighted music without reprimand. This was a landmark intellectual property case where the United States Court of Appeal of the Ninth Circuit affirmed the ruling by United States District Court for the Northern District of California stating that, peer to peer (P2P) file sharing service, could be held liable for contributory infringement and vicarious infringement of the plaintiffs' copyrights. This was the first major case to address the application of copyright laws to peer to peer file sharing.

According to Cooper Grace Ward Lawyers,' there are a number of digital marketplaces that facilitate the listing, buying and selling of NFTs The terms of use governing these marketplaces may also impose additional restrictions on the rights NFT buyers receive

Smart contracts are digital transaction protocols that get processed with the ocurrence of an event and blockchains are a secure and permanent digital ledger that keep a record of the transaction history related to the NFT between the network and its peers

NFT are a unique digital certificate which essentially translates into a digital asset. The difference between cryptocurrencies and NFTs are that NFTs are considered indivisible, i.e. it is one of a kind and cannot be broken down in parts in the manner in which cryptocurrency is distributed. Additionally NFTs do not represent a value or store of value but instead its value arises from the rights attached to the digital asset.

Therefore, an NFT can be an intangible or tangible asset in the form of music, art, collectibles, or in game assets as well.

The claimant lived in a house belonging to her husband’s employer. The claimant’s husband was a tenant, and she had a license to live at the property. Whilst using the lavatory, the cistern was dislodged by vibrations caused by the next door neighbour’s electricity generator, which fell on her causing her injuries. She sued her neighbour in nuisance. It was alleged that the claimant could not bring the suit because nuisance required the claimant to have an ‘interest’ in the land subjected to the nuisance.

It is hard being an outsider, whether you transferred university, come from another state or even another country. Victoria University is not an exception to any other university. It provides a home for International students.

Achieving a career in Law has always been competitive. Imagine being an outsider on top of it. This can be a nightmare. What would I know about this? Everything! As I am currently a fourth year law student completing my final units, I have lived the nightmare and survived to tell the tale.

I always remind myself of the reason I chose to be a lawyer I want to help the vulnerable I believe that to help the vulnerable, you have to be vulnerable at least once in your life and have overcome that vulnerability I believe this will give the strength and the passion you need to face what may come in the future

The same roads you walked exhausted after hours of studying will be the roads you walk wearing your gown as a lawyer Walk with your head high, with a vision of your dreams and with a heart to never give up Just remember, the day you feel like you belong is the day you won’t be an outsider anymore

Moving to a different country, getting to know a new culture, and meeting people is challenging. The main quality you will develop is mental strength. I learnt to never give up. If you give up, you will not see the end of any decision you make in your life. If you give up, you will never find the satisfaction of completing your goals. You will never be the lawyer you want to be.

The best part about being challenged is that you will recognise the worst days and the good ones You can feel proud about yourself, that you are able to persevere through the worst days, where other colleagues may struggle
