Notice is hereby given that our client, THE WEST INDIES RUM DISTILLERY LIMITED., a company organized under the Laws of BARBADOS at BRIGHTON, BLACK ROCK, ST. MICHAEL, BARBADOS, BB12051 is the Owner of the following Trade Mark
to be used under international Class:
Class 33: Alcoholic beverages, except beers; Liqueurs; Spirits [beverages]; Distilled wine; Rum
The public and the trade are hereby warned not to indulge in any activity that would infringe our rights as the proprietors of the above mark which would be in violation of the Intellectual Property rights of the proprietor.
The public and the trade are also hereby warned that any person who infringes or forges any mark or falsely applies to goods or services any mark or marks so nearly resembling a trademark as to be likely mislead or who makes any dye, block machine or other instrument for the purpose of forging or being used for forging a mark; or applies any false description to goods; or disposes of, or has in his possession, any dye, block, machine, or other instrument for the purpose of forging a mark; or caused to be done any of the things referred to above shall, inter alia be in violation of the IP rights of the proprietor.
Further any person who sells or exposes for sale, or has in his possession for sale for any purpose of trade or manufactures any goods or things to which any forged mark or false trade description is applied or to which any mark so nearly resembling a trademark as to be likely to mislead or falsely applies shall inter alia, be in violation of the IP rights of the proprietor.
The public and the trade are therefore, warned that if any person does any of the above acts which are illegal and unlawful, THE WEST INDIES RUM DISTILLERY LIMITED will not hesitate to exercise their legal remedies, both in a civil court and in the criminal court to prosecute the persons who indulge in the aforesaid illegal and unlawful activities, and they would also claim damages for the infringement and the dilution of their trademark.
