What is Estate Planning and Probate?

Just this past week I had a new client tell me that a friend told him he could avoid probate and did not need a Will if he had an estate plan. His statement and subsequent question about what an “estate plan” is served as a reminder for me that there is often confusion and misinformation around estate planning and property distribution after death. I want to take this opportunity to address some common questions and misconceptions.

What is an Estate Plan?

generally in reference to establishing a broad plan for how you manage your property (assets) as you grow older (including identifying and designating trustworthy people to help in the event you need it) and how your property gets distributed upon your death. An estate plan also typically includes identifying people who can help with medical decisions and care should you need it as well as end of life decisions.

A thorough estate plan includes not only preparing the legal documents you may need, but also ensuring your assets have beneficiary designations that align with your overall plan. A good estate plan also typically includes identifying and maintaining (with your Will and other legal documents) a list of your assets, emails, passwords, advisers and contact information so that your loved ones can efficiently manage your estate. I also generally encourage my older clients to consider prepaying for funeral arrangements to save their loved ones the time, expense and stress of making and paying for those arrangements while they are grieving.

What does “probate” mean?

process of distributing certain assets of a person after they die. It typically involves administration of an estate through a Court, either by asking a Court to validate a deceased person’s Will (if there is one) or determining a person’s heirs (when there is no Will) and appointing a representative over the deceased person’s estate to collect assets, pay valid debts, and distribute the remaining property to the beneficiaries or heirs.

Can I avoid probate? In most cases, you can avoid probate. If all of your assets have beneficiary designations (i.e., designating a beneficiary on your financial accounts and filing a transfer on death deed for your home) or your assets are held in trust, and you have no major debts (other than perhaps a mortgage), there may be no need for administration of your estate through court.

Do I need a Trust to avoid Probate? The short answer is NO. There are many reasons you may want to establish a revocable living trust, and yes, they can be used to avoid probate, but they are not required to avoid probate.

Financial Tips for Widows and Widowers

Losing a spouse is one of the most painful experiences anyone can have. Unfortunately, widows and widowers have to deal with more than just the emotional trauma — they also must consider a range of financial issues. If you’ve recently been widowed, what financial moves should you consider?

For starters, don’t rush into any major decisions. If you’re still in the grieving process, you are unlikely to be in the best shape to make significant choices affecting your finances and your life.

But once you feel ready to look at your situation objectively and make appropriate choices, consider the following steps:

•Review your finances. Look at your entire financial picture — your assets, investments, debts and income. If you and your spouse had communicated well about your finances, and you shared decisions, you hopefully won’t encounter any big surprises. But if your spouse was the partner who mostly handled financial matters, you may need to get up to speed quickly on what you have and what you owe. And if your spouse had provided a large amount of your household income, you will also need to determine what changes you may need to make to your lifestyle.

•Address insurance issues. If you will receive a death benefit from your spouse’s insurance policy, what will you do with the money? It may prove helpful in funding your own retirement or meeting other financial goals. But you’ll also want to be clear about what other beneficiaries, such as your children, might receive. And while you’re looking at insurance, you also might want to look at your own policies — do you need to change beneficiaries?

•Review your Social Security options. If you are at least 60 and you were married at least nine months, you may be entitled to Social Security survivor benefits. (If you remarry before age 60, you typically cannot receive survivor benefits, but you can reinstate them if this subsequent marriage ends.) The amount of your survivor’s benefits depends on your age and the age of your deceased spouse. You can’t claim your deceased spouse’s benefits along with your own retirement benefits, so if you qualify for survivor and retirement benefits, you’ll receive the larger amount. Depending on your situation, you might come out ahead by delaying your retirement benefits, giving them the chance to grow, while you accept survivor benefits. •Review your estate plans. The death of a spouse can certainly affect your family’s estate plans. So, it’s a good idea to review these plans to see what changes, if any, need to be made. When conducting this review, you’ll benefit from working with an estateplanning professional.

Finally, keep in mind that you don’t have to go it alone during this difficult time. If you’re already working with a financial professional, they can help. If you aren’t currently working with one, now might be the time to start. By looking at your finances and your family situation holistically, a financial professional can provide guidance that can help ease the stress you are naturally feeling.

5 Steps to Grill Vegetables

Burgers, brats, steak, chicken, pork chops and all the flavors of fresh meat get all the love on the grill, but a well-rounded meal calls for sides and veggies. Before you plan your next backyard barbecue, incorporate tasty vegetables – peppers, asparagus, onions, tomatoes, zucchini and more – for an all-out blitz of fresh-grilled flavor. Consider these simple steps to properly grill your crispy veggies:

1. Light the grill. Step one, of course, is to prep a hot grill. For the best cooking experience, you’ll want mediumhigh heat or even high heat for quick, direct grilling. By lighting the grill ahead of veggie prep, you’ll allow plenty of heating time to complete your other tasks.

2. Prepare vegetables. Depending on what you plan to cook, there’ll likely be some preparation to undertake, such as cutting off stems and blemishes or removing pits and seeds. In addition to cleaning up your ingredients, you may want to chop, dice or slice based on the recipe.

3. Coat vegetables with olive oil. Drizzling just a small amount of olive oil over your vegetables and tossing to coat adds a couple benefits. First, it helps the outer layer crisp rather than dry out, plus it aids in seasonings – like salt and pepper – sticking to the vegetable instead of falling off while on the grill or in a pan.

4. Consider using foil packets or skewers. If char marks aren’t your thing, tossing chopped or diced veggies into a foil packet before hitting the grill steams them for a bit of a softer texture. Alternately, wooden skewers soaked in water (to prevent burning) can help keep smaller chunks of veggies from slipping through the grill grates while still achieving a crispy exterior.

5. Pay attention to grill times. Different types of vegetables and preparation methods call for different cook times, but 5-10 minutes over direct heat generally gets the job done. The smaller you chunk, chop, slice or dice, the less time it’ll take. Find more grilling tips at Culinary.net.

5 Tips to Enhance Your Wedding Decor

Will Travel a $100K Grant for Shear Success Barber & Cosmetology Academy!

The West University Rotary Club extended an invitation to Have Shears Will Travel and other worthy non-profit organizations to apply for a grant from the West U Rotary Foundation. With the goal of supporting the completion of Shear Success Barber & Cosmetology Academy, we applied and hoped for the best. We are delighted to share the wonderful news that Have Shears Will Travel was chosen and received a $100,000 grant from the West U Rotary Foundation. This generous contribution will be instrumental in acquiring equipment, furnishings, and other essentials to launch the academy successfully. The longstanding support from West U Rotary Foundation has been invaluable to Have Shears Will Travel, and we are truly grateful for their continuous generosity and belief in our mission.

Have Shears Will Travel is a non-profit hair care ministry organized to serve the local community with special needs that restrict their ability to obtain these services due to physical impairment, lack of transportation, or financial means.
