By Fred Herbst TICONDEROGA Ñ Arts, historical and business organizations have joined to create the Ò Ticonderoga Area Summer.Ó The Ò summerÓ is a collection of events and programs that includes activities for both children and adults, from fireworks and carnivals, to art classes and programs, concerts and theatrical performances, historical events and more.

Events are being promoted by the Ticonderoga Area Cultural Arts Initiative as well as the Ticonderoga Area Chamber of Commerce.

“We are excited by the wide variety of cultural and fun events that so many different organizations in the Ticonderoga area have planned during the summer for both young people and adults,Ó said Vincent Smith, chairman of the Ticonderoga Area Cultural Arts Initiative.

To promote the activities the arts initiative has distributed maps of the arts, cultural and historic sites in Ticonderoga as well as information cards with a schedule of events.

Ò People come from all over to run the Tracy Road,Ó Moriah Supervisor Tom Scozzafava said. “I was at my niece’s wedding in Cape Cod and met a man from Ireland who had ridden the Tracy Road. Motorcyclists know about the Tracy Road.”

Historic battle to be re-enacted at Fort Ti

fred@denpubs.com TICONDEROGA Ñ One of the most famous battles in American military history will be reenacted at Fort Ticonderoga.

The 1758 Battle of Carillon will take place at the fort Saturday and Sunday, July 20 and 21 9:30 a.m. to 5 p.m.

“During this dramatic event, visitors will discover how the Battle of Carillon sealed the reputation of Ticonderoga for generations to come,Ó said Beth Hill, Fort Ticonderoga president and CEO. “The July 8 battle resulted in the greatest number of casualties in one day until the American Civil War and, as a result, Ticonderoga became a legend in its own time.”

The re-enactment will feature historians portraying French and British forces of the period as well as special programs highlighting the

battle.

“In July 1758 the British army attacked the French at Carillon (Ticonderoga) attempting to capture the fort and take control of the portage between Lake George and Lake Champlain. On July 5, the largest military force ever assembled in North America embarked by bateaux down Lake George,” said Stuart Lilie, Fort Ticonderoga director of interpretation. Ò AbercrombyÕ s army of British and Provincial soldiers landed at the north end of Lake George, after a long night packed into the fleet of bateaux. Sweeping through the LaChute valley, Brig. Gen. Lord Augustus Howe and the advanced guard encountered a lost patrol of French soldiers. In the ensuing confusing battle on July 6 Lord Howe was shot through the chest, and killed on the spot. The death of this leader, known as the darling of the army, struck a blow to British morale and tactical command.Ó Ò On the 7th of July the French at Ticonderoga constructed a half mile-long log wall protected in front by a

dense tangle of treetops and sharpened branches to serve as a barrier against the British attackers,” he added. “This fortification was known as the French Lines. On July 8 the British attacked. After seven hours of fighting, the British had suffered casualties of nearly 2,000 men killed and wounded. Broken and dismayed, the British retreated back to their camp at the southern end of Lake George. The retreating soldiers brought with them the story of this great battle, taking the name Ticonderoga home to taverns and newspapers in America and Britain. This fight for the Heights of Carillon at that time was the single most-bloody day in American history, and gave Fort Carillon a formidable reputation. News of this miraculous victory reached France by the fall of that year and marked France’s greatest victory of the French and Indian War (1754-1763). On Oct. 1, 1758, the French army staged a reenactment of the battle, to accompany fireworks to celebrate in front of Paris city hall.Ó Saturday’s activities will include inspection of the armies at 10 a.m., guided tours of the fort at 10:45 a.m., a French drill and musket demonstration at 11 a.m., a garden march featuring military musicians of the French Army from Fort Carillon to the King’s Garden at 11:30 a.m., a program highlighting personal stories of the battle at 11:30 a.m. in the Mars Education Center, a French garden and grounds tour at 11:45 a.m., a guided tour of the fort at 12:30 p.m., a fife & drum parade from the fort to the battlefield at 1 p.m., a battle re-enactment at 1:30 p.m., a battlefield tour at 2 p.m., a re-enactment of British troops learning of Lord Howe’s death at 2:30 p.m., a fife & drum march from the battlefield back to the fort at 3 p.m., and a guided fort tour at 3:15 p.m.

President’s Party to feature production Arts Trek offers ‘The Three Little Pigs’

TICONDEROGA Ñ The Ticonderoga Festival Guild President’s Party will be held Saturday, July 14, at 4 p.m. at the Ti Knights of Columbus.

Sue Liddell, president of the Ticonderoga Festival Guild, has chosen the program. The Adirondack Shakespeare Company will present “The Course of True Love.”

Hors d’oeuvres will be offered and a cash bar will be available.

Tickets are $15 each and are available from board members, by calling 585-7015 or by purchase at the door. An advance registration will be helpful in planning food quantities. The President’s Party is open to the public and is so named because the president chooses the format and program each year.

The Arts Treks are supported by grants from the Southern Lake Champlain Fund of the Vermont Community Trust, the International Paper Foundation, Essex Co. Dept. of Youth, North Country Cultural Center for the Arts (DEC), Charles R. Wood Foundation, Honeybee Community Fund, Wal-Mart Foundation, by donations from the Ticonderoga Federal Credit Union and from Stewart’s Shops, and by individual donors.

The Arts Trek program on Wednesday, July 17, is Ò The Three Little Pigs,” the 2013 childrenÕ s opera presented by the Seagle Colony.

The musical students from Schroon Lake will tell the old story with a new twist, completely in song. In their version, the “wise” little pig is a girl who studies house construction at the library, reinforcing the idea that reading is a good skill to have.

Arts Trek performances take place at the Knights of Columbus pavilion in Ticonderoga at 10:15 a.m. The programs are presented free to the community by donors and sponsors.

Apart from clearly identifying the horn’s owner, place and date of carving, the horn is decorated in other interesting decorative and military motifs. Bordering the cartouche containing Fairchild’s name is a simple floral and geometrically carved design. The back of the horn features a detailed image of one of the British sloops that sailed on Lake George during the war. A simple depiction of a four-bastion fort carved near the hornÕ s base may represent Fort William Henry under construction while Fairchild was at Lake George. Around the narrow end of the horn are carved rectangular panels, two of which depict showing cannon mounted on large-wheeled field carriages being fired with smoke billowing out their muzzles and cannonballs flying through the air.

“The decoration on this powder horn is really quite nice,” said Christopher Fox, Fort Ti curator of collections. Ò The military motifs, including the cannon firing and sloop, undoubtedly speak volumes about Fairchild’s experiences at Lake George which appears to have been the first year of his military service during the French & Indian War.” The powder horn’s spout has been cut off and there appears to be evidence that at one time a replacement (now missing) may have been attached. Exactly when or why this was done is not known. The powder horn may have seen use during several campaigns as Robert Fairchild is known to have served in militia and provincial regiments in the Lake George region in 1757, 1758 and 1759.

A rare French & Indian War powder horn was recently donated to Fort Ticonderoga. The powder horn originally belonged to Robert Fairchild (1737-1794) of Middletown, Conn., and was engraved at the British army camp at Lake George in 1756.

Students complete boating class Course to be taught again July 27

TICONDEROGA Ñ Commander Richard T. Gasser has announced 19 Ticonderoga Middle School students earned their Boating Safely Certificates from The United States Coast Guard Auxiliary Flotilla 15-13 of Crown Point.

The eight hour federal boating safely course meets all state requirements for New York as well as the rest of the country. The course, taught by certified United States Coast Guard instructors, covers all aspects of power vessel operation including, what safety equipment is required under both New York and federal statutes, what additional equipment is recommended, the correct personal flotation devices, emergency and first aid equipment and procedures, safe operation, basic navigation, proper docking, and discussions on various types of vessels, and which vessels have the right of way on open water.

This course satisfies New York’s required certification for operation of personal watercraft, or “wave runners.” New York State requires all operators of personal watercraft to have in their possession a card certifying that they have taken either this or some other approved course. It is widely believed that in the near future an eight hour course may be mandated for any power vessel operation on New York waters.

Flotilla 15-13 Crown Point, through cooperation with the Benevolent Protective Order of Elks, whom through a grant, provide the course material at no cost to children age 17 and younger. Flotilla 15-13 offers the course to any area school at no charge.

The flotilla’s seven USCG certified instructors have provided this course to both the Ticonderoga Middle School and Crown Point school. Any school interested in having their students partake in the program need only to contact the flotilla by calling CDR Gene Frost at 585-9034 for more information.

The flotilla will be offering this course to the general public on July 27 at the First United Methodist Church on Wicker Street, Ticonderoga. The course will be provided at no cost to students 17 and younger. Registration is required and the course will be completed that day. Lunch will be provided. TICONDEROGA — A rare French & Indian War powder horn was recently donated to Fort Ticonderoga.

The powder horn originally belonged to Robert Fairchild (1737-1794) of Middletown, Conn., and was engraved at the British army camp at Lake George in 1756. The inscription on the horn reads “Robert Fairchild His powder horn Made at lake George August the 27 AD 1756.”

In 1756 Fairchild served as a private in Maj. Jehoshaphat StarrÕ s company of Col. David WoosterÕ s 2nd Connecticut Provincial Regiment serving that year between April 8 and Dec. 3.

In 1756 several provincial regiments from New England and New York were stationed at the south end of Lake George helping to maintain a strong military presence on the lake and stem the southward encroachment of French forces occupying Fort Carillon (Ticonderoga). In addition, the provincials devoted considerable time constructing Fort William Henry.

This powder horn came to the museum as a result of the fort’s curatorÕ s appearance on the PBS television series Ò History Detectives” that featured the investigation of an unrelated powder horn. The donor of the Fairchild horn, Tonyia Baldwin, contacted Fort Ticonderoga after the show aired to discuss a powder horn that had belonged to her father.

Feeling that the powder horn needed to be preserved for future generations and made accessible to the public, she proceeded to donate it to Fort Ticonderoga.

TICONDEROGA Ñ The Ticonderoga Montcalm Street Partnership in coordination with the Ticonderoga High School recently coordinated a grocery shopping trip to benefit the Ticonderoga Food Pantry.

TMSP received a grant for $750 from the Stewarts Holiday Match Program; $250 was also donated by the Ticonderoga Montcalm Street Partnership to allow students from Ticonderoga High School an opportunity spend $1,000 locally on groceries for the food pantry.

Students were organized into teams and competed to see who can spend more wisely and obtain the most non-perishable foods.

Teachers acted as mentors for these student-teams and they were encouraged to make maximum use of coupons, discounts and sales. This was a learning exercise as well as a community service for the needy families in our area.

The Ticonderoga Montcalm Street Partnership is a not-forprofit organization established in 2007. Its mission is to create and enhance the economic, historic and social development of TiconderogaÕ s traditional business district, employing the National Trust Main Street CenterÕ s guidelines for organization, design, promotion and economic restructuring. Meetings are held monthly and volunteers are always welcome.

Summer hunger a growing Real life versus virtual reality problem in this region B

s you read this, there are hungry children nearby.

While itÕ s not often discussed, nearly a quarter of all American children live in poverty. Many children in the North Country are in a similar situation.

Poverty is defined by the federal government based on income and household size. A family of four earning $22,113 or less a year meets the poverty threshold. The income level rises to $26,023 for a family of five and so on.

According to the census, 16.4 million children now live in poverty in the United States.

ThatÕ s 22 percent of all American children, the highest percentage since 1959.

According to the New York State Community Action Association’s 2012 poverty report, 20.3 percent of Essex County children live in poverty. In Washington County 19.5 percent of children live in poverty, in Warren County 16 percent and Clinton County 16.1 percent.

Poverty Ñ at least in the North Country Ñ seems to be a silent problem. But those who see it know it’s children who suffer the most.

Earlier this year John McDonald, Ticonderoga school superintendent, pleaded with Dede Scozzafava, deputy secretary of state for local government, to take greater action to alleviate rural poverty. Ò ThereÕ s a lot of attention focused on poverty in our state, but itÕ s focused on urban poverty,Ó McDonald said. Ò I submit that rural poverty is worse. We need to focus on rural poverty as much as urban poverty.

“Poverty is a problem everywhere, there’s no denying it,Ó McDonald said. Ò But a poor person in New York City can go to a shelter (for heat) or a soup kitchen (for food). Even poor kids can go to museums and libraries if they choose to.

Our kids are isolated. They don’t have those opportunities.Ó Nearly a quarter of Ticonderoga students — 23 percent — live in poverty. That makes Ti the 623rd poorest district in the state. There are 684 districts. Crown Point is close. It has a poverty rate of 22.4 percent and ranks 618th.

Of course, poverty leads to hunger. Childhood hunger is especially a problem during the summer months. Many children who get free or reduced breakfast and lunch while attending school are now without those meals. That’s 10 meals a week they’re missing.

Fortunately, the United State Department of

AgricultureÕ s summer food service program is available in the region for children who can get to distribution sites. Meals are provided to all children 18 years and younger.

Essex County has Ò open sitesÓ at CV-Tech in Mineville, Moriah Central School in Port Henry and at Ticonderoga Elementary School. Ò Open sitesÓ serve all children.

Essex County also has Ò closed sitesÓ at the Bloomingdale Fire House, Petrova Elementary School in Saranac Lake, Noblewood in Willsboro and Crown Point Central School. “Closed sitesÓ serve income-eligible children. Children who are part of households that receive food stamps or Temporary Assistance to Needy Families are automatically eligible to receive free meals. For more information, call Essex County Community Resources at 873-3632.

Clinton County also offers the USDA summer food service program at the Evergreen Town House Community Center and the Ted K. Center in Plattsburgh. For more information, contact the Clinton County Social Services Department at 565-3370.

In Warren County children get lunch at East Field 11:30 to 12:30 each day through a program operated by the Action Committee for Economic Opportunity, the county and BOCES. The Heritage Museum in Ticonderoga holds free children’s summer workshops every Wednesday and Friday from 9-10:15 a.n. through Aug. 16. The theme this year is “Recycle, Reuse, Reinvent.” This week’s programs include a joint program with the Ti Festival Guild on Native American beaded necklaces and making a scrap quilt wall hanging for display in the Heritage Commons Nursing Home. Dictionaries have united people through the power of words since they were created over 2,000 years ago. The dictionary helps people express their innate gifts. Without words, we cannot share our ideas with others. The Dictionary Project puts words into the hands of children so that they can learn to express their thoughts and appreciations for each other and the world in which we live. Words help us make this world a better place for everyone to live in together. If you express appreciation and gratitude, people will have a high opinion of you because you are showing them the respect they deserve. “Please” and “thank you” are still the magic words.

Computer spell-check may be handy, but it does not replace the dictionary. Spell-check cannot increase the user’s understanding of words: it does no help someone become a better reader or more creative writer. Dictionaries make students selfreliant. They are an essential tool for a quality education. A child cannot do his or her best work without a dictionary.

We have high expectations for children. We believe that the greatest possible contribution which any one of us can make to the world is to be ourselves – at our best. The purpose of education is to help students develop their best selves. Unfortunately, it has become a challenge for educators to ensure that students have the tools they need to function effectively in the classroom.

The Ticonderoga Elks Lodge will be distributing student dictionaries to the third grade students to the following schools in our area — Crown Point Central, Moriah Central, Mountainside Christian Academy, Putnam Central, St. MaryÕ s Catholic School, Schroon Lake Central and Ticonderoga Central. All but two of the above schools have responded to our request for an approximate head count so we can order these dictionaries. Hopefully these two schools are still interested in this worthwhile project.

In addition to the third grade student dictionaries we are also providing French/English and Spanish/English dictionaries to any of the above schools who request them.

Anyone in the surrounding school districts wishing to make donations to The Dictionary Project please contact Richard A. Nadeau, chairman, at 585-7659. For a donation of $50 we will place a label in 30 of the dictionaries. The Crown Point Memorial Day Committee held its wrap up meeting for the 2013 celebration and has begun making plans for the 146th celebration in 2014. Please be sure to join us.

The winner of the bike contest was Harley Taylor. The parade winners were as follows: first place-Penfield Foundation, second place-CPCS Softball Team, and third place-Relay for Life.

Our thanks to all parade participants, community members and businesses as well as regional businesses for their continued support. This helps Crown Point to continue in its efforts to remain one of the oldest continuous Memorial Day celebrations in the country. Quite a feat for a small town!

Arts group could use help To the Times of Ti: The Schroon Lake Arts Council has a long history in Schroon Lake. SLAC was formed in 1974 to ensure that the arts were available to all the residences of the Schroon Lake region.

For 39 consecutive years SLAC has sponsored weekly summer concerts in the Schroon Lake Boathouse. The concerts have included jazz, country, folk, klezmer, celtic and classical music.

Presenting artists have included many local musicians as well as regional ones. This year we are proud to have three concerts by artists who have performed internationally (Acoustic Eidelon, Red Molly and Sean Tyrell). The fee is a $12 for adults and $5 for students. Families are given a reduced rate. This price has not been raised in many years.

For 24 consecutive years SLAC has hosted the Adirondack Folk Music Festival. The day-long festival is held outdoors in the town park overlooking the lake. Each year there is a new line-up of 6-8 musicians. The day is always a busy one with two simultaneous performances. While some musicians play outdoors in our gazebo, others are presenting workshops in the Boathouse.

These workshops allow audiences to experience the artists in an intimate, informal setting which includes conversation and questions. Audiences have experienced sing-a-longs, clogging and dance instruction, and the experience of trying an instrument.

This summer there will be two events for children, a sing-along (July 24) and a production of “The Secret Garden” by the Hampstead Stage Company (August 8). There is no cost for the children or adults.

Since 2008, SLAC has been hosting Monday night Jams, 7 to 10 p.m. in the Boat House, June through September. This night was begun to encourage all local residents to develop their interests in music, and to provide an opportunity to display their talents.

Up to 19 adult and child musicians and singers attend regularly each Monday evening. All are welcome!

SLAC is pleased to receive funding from sources such as the town of Schroon, the Schroon Lake Chamber of Commerce, Stewarts Stores and The Glens Falls National Bank. Memberships and donations also help sustain this organization.

While SLAC has a hard-working board of directors, they could not do this work without members and volunteers. Volunteering for SLAC is easy and fun. There are many tasks such as tickettaking, greeting at the farmers market, set-up and tear-down at the folk fest, selling water at concerts, assisting performers, putting up posters, etc. Please call Patti Rapoport (532-9986) if you have a spare hour or two in the summer. There will be a meeting of volunteers this month.

Special events to highlight farmers market

fred@denpubs.com TICONDEROGA Ñ The Ticonderoga Area Farmers Market will feature several special events this summer.

Sponsored by the Ticonderoga Area Chamber of Commerce in coordination with Inter-Lakes Health, the farmers market is held Saturdays through Oct. 12 10 a.m. to 1 p.m. on Route 9N south of Moses Circle and Liberty Monument.

The July 27 market will be moved downtown as part of the annual StreetFest celebration.

New for 2013 are special days at the market including education and interactive programs, entertainment and a youth market.

“Making Healthy Choices,” sponsored by Essex County Public Health/Creating Healthy Place to Live, Work & Play will be held July 13.

This special day will include education on making healthy food and activity choices, public health information and free healthy recipes.

Local Girl Scouts will hold a bake sale at the market July 20. A variety of baked goods will be available, including healthy options.

The fifth annual StreetFest in downtown Ticonderoga will be held 10 a.m. to 3 p.m. July 27.

The market will move from its regular location to Montcalm Street to be part of the festivities.

It will include sidewalk sales, vendors, a variety of food, live music, childrenÕ s activities and more. Ò History Day,Ó sponsored by the Ticonderoga Historical Society, will be held Aug. 3 at the market. A historic program will be presented by the society. Plans are still being made for special activities at the farmers market Aug. 10 and 11. Ò People interested in offering a program, entertainment or getting involved with the market can contact the Ticonderoga Area Chamber of Commerce,” said Matthew Courtright, chamber executive director. Ò In addition, the cham-

ber is working on establishing new and additional vendors for the market.”

Also new in 2013 is a youth market July 13 through Aug. 17. The youth market is being implemented as part of a Girl Scout Gold Award project. Becky Barber from Ticonderoga is taking the lead and has been working with the chamber, Essex County Public Health/Creating Healthy Places, NadeauÕ s Greenhouse and the Ticonderoga Community Garden at the First

United Methodist Church. Youth are growing produce and will be purchasing local produce which they will then sell at the market.

Adirondack stories to be told

PARADOX — “Adirondack Stories and Tall Tales” will be held on Tuesday evenings during July at the Paradox House Gallery Retreat.

It’s a story telling program for children ages 4 to 11. Various storytellers will be on hand to share their stories or tall tales for the children to determine if the story is true or just a tall tale.

People who have volunteered to be storytellers include Carol Gregson, Anne Gregson, Doris Cohen, Jane Jenks, Dave Jenks and the owners of the Paradox House Merritt Hulst and Analise Rigan.

Topics have included Native Americans, maple sugaring, farming, hunting, schools, growing up in the Adirondacks with various toys etc. Some storytellers will be in period costumes and clothing The stories begin at 7 p.m. and include a tour of the historic 19th Century Adirondack Victorian Farmhouse. The house was built by Merritt’s great-grandfather more than 100 years ago and Analise is an artist with a gallery in the house. Refreshments are served and concludes at 8:30 p.m.

The evening is free and children must be accompanied by an adult. Local children, seasonal residents as well as those visiting the Schroon Lake area are most welcome to come to the program.

The Paradox House Gallery Retreat, is the large three story red house at 167 State Rte 74. It is the first house on the left just East of the Schroon River and bridge on Rte 74. Crown Point monument re-dedicated CROWN POINT Ñ The Ticonderoga Chapter National Society of the Daughters of the American Revolution rededicated the Israel Putnam Monument in Crown Point recently.

The monument was originally placed there by the Champlain Chapter of Crown Point in 1923.

The event was featured Kathy Hyatt singing Ò My Country Tis of the TheeÓ and a talk by Tom Hughes, manager of the Crown Point State Historic Site. The invocation and benediction were given by the Rev. David Hirtle of the first Congregational Church of Crown Point.

Penfield Homestead Museum was represented by President Joan Hundson, Treasurer Kama Ingleston and trustee Bob Spring. Representing the National Society Sons of the American Revolution from the Saratoga Battle Chapter was Douglas Gallant.

WW II vet makes D.C. trip Ernest Clifford on Honor Flight

shaun@denpubs.com CROWN POINT Ñ As the sun rose over VermontÕ s Green Mountains May 18, 18 World War II veterans left Plattsburgh to visit the National World War II Memorial in Washington D.C. The trip marked the inaugural flight of North Country Honor Flight, a non-profit organization dedicated to honoring World War II veterans by taking them to the memorial.

Making the trip was Crown Point resident Ernest Clifford, who served in the Army Air Corps during World War II. Hundreds showed up at the Old Base Oval in Plattsburgh for a ceremony to see the veterans off.

More than a dozen uniformed troops, who stood at attention as the veterans and their guardians boarded the bus, were also on hand.

The crowd cheered and held up signsÑ Ó God bless WWII vets,Ó Ò One last missionÓ Ñ as the bus pulled away at 5:30 a.m., led by a motorcade of motorcycles including the Plattsburgh Harley Owners Group, Combat Veterans Motorcycle Association, the Patriot Guard and the Legion Riders.

The procession snaked through Plattsburgh as it headed for Interstate 87 and the Albany Airport, all the while passing crowds of people waving flags and saluting.

More motorcyclists joined the growing parade at every exit, and people waited on overpasses to celebrate as the veterans rode by.

Wilson, who has family members who live on the Tracy Road, said bikers often place people at each end of the Tracy Road and communicate by cell phone. When the road is clear of traffic — and police — they call and riders take turns speeding across the highway.

Scozzafava acknowledged groups do race on the road, but said itÕ s never safe.

“They know no traffic is coming, but there are other hazards,Ó he said. Ò There are animals all along that road Ñ a turtle can crash a motorcycle. There are homes. Someone may back out of a drive way.”

In fact, one YouTube video shows a car backing out of a drive way in front of motorcyclists.

Other posts rave about the Tracy Road ride.

“This road has been a playground for a few years since NY had it repaved,Ó reads one. Ò There are only a couple of sections that you should beware of. Also, there was a sour apple living at the halfway point who calls the state police on bikers and car enthusiasts. The road is 55 and on a bike, you’re gone... After midnight, this road gets serious.Ó “I finally made my way down to this road yesterday and had a blast going back and forth until going low on gas,” reads another. “Most of the road is great but there is one HUGE bump right in the center of the lane coming from the highway end up towards Power House road.

Beware of that bump! Though we took the first pass easy it still brought both my buddys wheels off the road!’

Scozzafava would like to see a motorcycle event held on the Tracy Road. He suggested closing the road to traffic for a day, setting up safety barriers, arranging for emergency medical support and letting riders challenge the road. It would similar to a car rally, he said.

“An event like that would be huge,” the supervisor said. “You would need to do it properly, taking care of all the safety aspects. The Tracy Road is internationally known. I know it would be big draw.”

In the immediate future, Scozzafava plans to ask the county to erect “user friendly” signs at each end of the Tracy Road urging caution. Ò My concern is inexperienced riders,Ó Scozzafava said. Ò Serious motorcyclists already know about the Tracy Road. I’m worried about an inexperienced rider getting into trouble.Ó In fact, a Ticonderoga man was injured in a motorcycle crash on the Tracy Road June 9. Police attributed the accident to driver inexperience.

Scozzafava thinks motorcyclists on the Tracy Road should follow the advice of Carlotta, his Harley Davidson. Ò When I ride Carlotta over the Tracy Road Carlotta tells me when I’m going too fast,” Scozzafava said. “At 35 mph her floor boards are almost on the road. ThatÕ s fast enough.Ó

“I don’t know the numbers of motorcyclists that ride the Tracy Road each season, but it is a lot,” Bryant said. “How many of those riders stop, have lunch or fill up with gas? A fair amount stop, but we believe there is an opportunity to serve more of them at our local businesses. Ò Motorcycle clubs are a big part of the tourism makeup now in the North Country,” he continued. “Look at Americade. We don’t have a lot of hotel beds in our town so we have to work with what we have, and what we have are a lot of motorcyclists. We are promoting this ride to motorcycle clubs throughout the Northeast. If we can attract a club to take a ride down the road, then stop for lunch, well, that helps our town.”

Scozzafava applauds the chamber for its efforts to promote the community, but he has concerns about making the Tracy Road any more of an attraction than it already is.

“I’m a biker,” said Scozzafava, who owns and rides a Harley Davidson. “I know it’s a great road for motorcycles, but itÕ s also very dangerous.

“I think the chamber has a great idea, but what’s missing is the safety factor,” he added.

“It’s a public highway and others are using it.”

The chamber is counting on all motorcyclist to be responsible riders.

“We want everyone to safe, we don’t want anyone getting hurt,Ó Bryant said. Ò If someone is a responsible rider there shouldnÕ t be any concerns, but if someone is irresponsible then they create safety issues any time they sit on a bike, not just on the Tracy Road. The Tracy Road has rules like everywhere else, and those rules are meant to be followed not broken.”

Jamie Wilson, MoriahÕ s superintendent of highways, believes chamber officials are naive to think motorcyclists come to the Tracy Road just to ride. The challenge for motorcyclists, he said, is to take the turns as fast as possible. Ò ItÕ s not safe,Ó Wilson said of the Tracy Road and motorcyclists. Ò Every turn on the Tracy Road is a blind turn. I know it’s a scenic road, but the bottom line is they come here to go fast.

They almost always cross the center line. This is a bad idea.Ó Wilson also owns and rides a motorcycle.

“I’m surprised the chamber would promote the Tracy Road as a tourist attraction,Ó said Steve Stahl of the Moriah Police Department. Ò The goal for motorcylists is to get from end to the other as fast as they can. WeÕ ve had accidents there and a lot of close calls Ñ a lot of near misses. ItÕ s just a matter of time until thereÕ s a serious head-on (accident) with a motorcycle.”

Stahl said three years ago community concern about motorcycles on the Tracy Road led to increased patrols by the Moriah PD and state police. Ò The motorcyclists are very organized,Ó Stahl said. Ò They put someone on each end of the road and if they see police they just wait until we leave.

Comedy show coming to Port Henry

Tours will be at 11 a.m. on July 16, 23, 30, Aug. 6, 13 and 27.

Cost is $35.

The Pavilion was built as a summer home in 1826 by William Ferris Pell. He and his family occupied it 1830s. By the early 1840s the house had begun to be used as a hotel, its primary function through 1900. After Stephen Pell’s death in 1950 his son John occupied the house through 1987.

Fort Ticonderoga to offer sunset tours on lake TICONDEROGA — Fort Ticonderoga now offers a sunset tour, “The Place Between Great Waters.” The 90-minute tour will take place on scenic Lake Champlain located just below the fort.

Costumed historic interpreters will lead the tour in an 18thcentury battoe while guests paddle along side in their canoes and kayaks. Fort Ticonderoga canoes will be available for rent the evening of the program. Some old, but not so familiar, fishing streams

ast week, I spent a day traveling around some old familiar grounds up and down the Pleasant Valley of the Boquet River.

Initially, I had intended to spend most of my time fishing on the Boquet’s smaller tributaries such as Barton’s Brook, The Branch, Black River, Spruce Mill Brook, Roaring Brook and the North Branch.

Unfortunately, by the time I made it over the hill to Elizabethtown, the Boquet was already at flood stage, and even the smaller streams were swollen and fast.

I took a few casts, just for old times sake, but the canoe remained strapped to the top of my vehicle all day.

I did manage to find a few deep holes, where some brookies were active and my line wasn’t swept downstream immediately. Fortunately, the heavy rains had not disturbed a series of small beaver dams that I decided to visit, and I was rewarded with a couple of hours worth of productive fishing.

However, by the time I finally left, I was far wetter than the fish I was catching. My hands looked like a pair of pale prunes, and I was soaked through to the bone.

Over the course of the day’s outing, I was astounded to discover the extent of the spread of invasive species, most notably the Japanese Knotweed.

Although I knew the problem existed along the Boquet River, especially from the Elizabethtown Fish and Game Club downstream to Willsboro, I was shocked to discover large swaths of knotweed upstream of Elizabethtown, especially on The Branch which has always been one of my favorite streams.

The Branch always runs cold, even during the heat of the summer. From its headwaters high on the shoulders of Hurricane Mountain, the tumbling, babbling little brook has long provided outstanding angling opportunities, even when the trout become slow and sluggish in the wider rivers below.

According to DEC fisheries reports, The Branch remains one of the most productive waters in the state for wild rainbow trout.

The naturally spawned rainbows have always been a joy to catch as they readily display the acrobatic maneuvers of fish many times their size. And the beauty of their vermillion side panels are worth every bit of energy that is expended in the rock-hopping obstacle course that provides a route up the creek to access their hiding holes.

Of course, the stream also provides a wealth of swimming holes as well, of which US Falls is by far the most popular. It seems like it was only a few years ago that I first discovered knotweed along the banks of the small stream, well below the Footbridge Park in Elizabethtown.

It seemed odd to see knotweed just below US Falls just a year later. It’s easy to understand how knotweek could be washed downstream with the highwater events of recent years. However, I couldn’t understand how the weed was able to advance up the stream, when the water flows down the stream.

However, over the last few years, the stalky, bamboo like weed has managed to spread far above US Falls, and it has now advanced well upstream of the Hurricane Mountain Bridge on Route 9N. It is an ugly sight to behold, with large patches of the plant straddling and strangling the stream in some places. Often, it is difficult to find a decent hole in which to cast a fly.

Unlike tag alders, which have long been the bane of many small creek anglers; knotweed can actually choke off the entire channel of smaller streams. When it does so, it is nearly impossible to find enough open water to land a fly.

The pervasive invasive has also supplanted many of the native ferns that once grew think along the Boquet’s riverbanks. In one particular section of the Boquet near where the outlet of Barbers Pond joins the flow, the riverbanks were once thick with tall ferns that grew to impressive height.

It may be that in my diminutive years as a youth, the ferns just seemed larger than they actually were.

But even as an adult, the fields of ferns stood tall enough to be at eye level.

Today, those vast fields of tall ferns are all but gone.

The old floodplains now resemble what I imagine the South Pacific jungles all look like. It is sad to discover

my old familiar stomping grounds no longer familiar.

And still with each passing year, the nasty knotweed continues to climb higher up the streams, and into the pristine valleys where it will weigh heavy on the shoulders of the mountains I once knew so well.

I sometimes wonder if the wrath of the wicked weed will eventually supplant our native white pines, or the majestic maples? WouldnÕ t it be horrible, to have to hack out a fresh route in order to return to Hurricane’s old tower?

It was a sad occasion for me to return home, and to realize it’s no longer the old familiar place where I once could roam at will.

I guess my time would be better spent chasing after warm water species such as largemouth bass or northern pike, as the negative impacts of climate change and invasive species begin to affect even the small stream fisheries.

But as most of the small stream, wild fish aficionados know all too well, it isn’t the size of the prize that matters. It’s a matter of its beauty!

Invasives in the Park

It is only fitting that this week kicks off events surrounding The Adirondack Park Invasive Plant Program (APIPP) training sessions for terrestrial invasive plant management.

Over the course of the week, experts will be providing a series of workshops on how to manage troublesome invasive plants, such as Japanese knotweed and garlic mustard.

Participants will learn how to identify common invasive terrestrial plants and how to apply effective management techniques on their own lands. The training will include presentations and in-field demonstrations. Landowners, landscapers, gardeners, resource managers and highway department staff are encouraged to attend.

The sessions are free and will be held July 25 at the Bolton Town Hall in Bolton from 10 a.m. – 12 p.m., RSVP by July 18; and, Tuesday, Aug. 13 at the North Elba Town Hall in Lake Placid from 1 p.m. – 3 p.m., RSVP by Aug. 6. Walk-ins are welcome, but RSVP is requested to Billy Martin at 518-576-2082 x 120 or wmartin@tnc.org.

Currently, there are more than 40 varieties of invasive plants invading the local woods, wetlands and waters of the Adirondacks. These infestations will continue to affect both public and private lands, and the landowners and land users who will continue to struggle with how to manage them.

APIPPÕ s terrestrial invasive plant management training sessions will inform participants about appropriate and effective management techniques.

Roger Burkert and his wife Linda of Ringoes, N.J. were fishing with Captain Jim Hotaling of Trolling Tina Charters on Lake Champlain, fishing out of Willsboro, NY, when he caught and released this massive 18-pound 11-ounce Lake Trout on June 20, 2013. Roger said this was his second largest laker that he has caught. His largest was in Canada and was 25-pounds 5-ounces. His previous largest New York Lake Trout, was 18-pounds 1-ounce and was caught in the Niagra River. Roger is quite the sportsman to release such a fish.

And I do mean the birds and the bees. Especially the bees.

There is a great concern about the loss of pollinating insects like the honey bee and its effect on agriculture. Our area of the country is not as critical as the midwest. Their loss of local plant diversity, pesticide overuse, drainage of potholes, vernal pools and wetlands, along with habitat loss are all culprits.

Photo by Diane Redman and mountain country. That’s why our property lines meander all over the place and are not square like out west. We also have more water and streams so they were easy to set as boundaries way back. Many town, county or state boundaries are based on streams or rivers.

Anyway, let’s get back to the birds and bees!

We need to remember our food comes from plants that flower and get pollinated by the bees, butterflies, and other insects. Ninety percent of the flowering plants and one third of the human crop foods need animal pollinators for their reproduction.

Apples, raspberries, onions, celery, beets, broccoli, cabbage, peppers, alfalfa, watermelons, tangerines, almonds, elderberries, blueberries, grapes, squash, cantaloupe, strawberries, and tomatoes all need pollinators along with a long list of other plants.

Pollination technically is: “the process by which pollen is transferred in the reproduction of plants, thereby enabling fertilization and sexual reproduction,Ó according to Wikipedia. Pollen grains containing male gametes (sperm) which get transported to the stigma, which is part of a double fertilization process, which I am not going into. You get the drift!

There are two types of pollination; abiotic and biotic.

Abiotic pollination is by the wind. Ten percent of the flowering plants get pollinated by wind.

Ninety percent of the work is left to other animals through biotic pollination.

Pollinators like the honey bee, bumblebee, butterfly, hummingbird, dung fly, wasp, midges, beetles, spiders and ants all make it possible for us to survive on this planet. The superstars of pollination are the honey bee and bumblebee. These two are the beasts of burden or the Ò AÓ team of pollen transfer in our area.

So what can you do to improve the habitat for the “A” team?

The greatest thing you can do is have a variety of flowering trees, shrubs and flowers around your property to provide food for the bees throughout the growing season.

By having flowering plants that bloom throughout the season, you are providing food for the pollinators. Remember bees need to store food away in their hives so they make it through the winter.

Plants for nectar, which I was told by a knowledgeable Wadhams, NY area bee keeper include: white sweet clover, white clover, alsike clover, alfalfa, buckwheat, basswood trees, red maples, willows, box elders, black locust, honeysuckle, raspberries, goldenrod, asters, trefoil, and many others. Make sure you have a variety of plants that bloom throughout the spring, summer and fall seasons to insure a long lasting food supply.

The second “A” team helper is having a source of water nearby, like a vernal pool, an open pond or wetland with a shallow water beach like area. Here the pollinators can easily get a drink. I can hear it now; he wants me to create a bee, beach area. Habitat is mainly about food, water and then shelter.

Shelter can be dead standing trees, exposed dry sandy dirt banks, and nonmowed areas. You can manage your land by creating habitat in hedge rows. Harvesting the non-flowering and non- mast trees for firewood and planting wild apple or other flowering trees and shrubs in their place will provide pollen for the bees. Releasing apple trees and having openings in the woods provide habitat, along with leaving a few standing dead trees for nests.

Thinning out wetland and riparian stream bank areas allows sun light so a diversity of plants can grow.

You need a mix of grasses, forbs, shrubs and trees. Leaving some standing grassy and shrubby areas provides shelter for bees and other pollinators. So park the mower and leave a strip of clovers, birds foot trefoil, dandelions, and other wildflowers along the road, driveway, or along sunny woods edges to provide food and cover for wildlife. More than just pollinators will benefit from doing this.

Reducing the use of bee and wasp sprays and insecticides around the garden and home will also allow populations to thrive. Nobody wants to get stung by a wasp, but they have a purpose so try and keep some around.

Who cares, you ask? With the growing demand toward local foods, and less foreign imports of fruits and vegetables you need to care. Homeland security is being independent on all fronts; fuel, food, fiber, manufacturing, etc. The US farm economy not only feeds our population, but it also helps feed other nations as well.

Keeping our agronomic potential high and environmentally sound is vital to our well-being as a country.

Pollinators supply the ability for plants to reproduce. No reproduction equals no food! So this is not just about the birds and the bees, it’s about our own survival as well. So plant a diversity of flowers, trees and shrubs, and manage your land.

Gabler, Bush race to victory Record field runs Ti’s Montcalm Mile

fred@denpubs.com TICONDEROGA — A record field set a blistering pace in the 27th annual Montcalm Mile road race in Ticonderoga.

The race, held just prior to the community’s July 4th parade, attracted 239 runners.

Leading the way were Lee Gabler in the men’s race and Dana Bush in the women’s event. Both are prior winners.

Gabler broke away from Jay Berube and Jesse Berube in the final strides to win. He was clocked in 4 minutes, 7 seconds.

Jay Berube was second in 4:08 and Jesse Berube third in 4:12.

All three are former Ticonderoga High School cross country and track stalwarts.

Bush was never challenged in the women’s race, winning in 4:46. Danae Polson was second in 5:00 with Julia Dmochowski third in 5:09.

The race is a downhill mile that follows the the town’s Independence Day parade route. Run just before the parade, the race draws hundreds of spectators.

The Montcalm Mile is sponsored by the LaChute Road Runners Club of Ticonderoga. Proceeds from the event are used to support youth running activities in the community.

Panther hurler named league MVP MVAC names softball, baseball all stars

Alexandra Macey of Crown Point is the Mountain and Valley Athletic Conference Division I softball Most Valuable Player.

Macey, a senior, led the Panthers to the MVAC and Section VII Class D championshps this spring. She was also named to the New York State Sportswriters Association Class D second team for her play.

Macey had an 8-1 record on the mound, her only loss coming to the eventual state champion in the state tournament.

She posted a 1.06 earned run average allowing just 36 hits and striking out 161 in 86 innings.

At the plate she had a .692 average, belting eight home runs, nine doubles and a triple.

Crown Point’s Brittany Foote and Maria Malone were named to the MVAC Division I first team all star squad.

Foote hit .483 this spring with seven home runs, nine doubles and a triple. Ò Brittany is only a freshman with potential to be the best hitter/power hitter to ever come out of Crown Point,Ó said Tony Macey, her coach.

Malone hit .327 and had an on-base percentage of .840. Ò Maria Malone had three wins on the mound as a freshman and as second baseman

State champ leads track all stars State champion Jay Hebert of Ticonderoga headlines the 2013 Champlain Valley Athletic Conference track and field boys all star team.

Hebert, who won the Section VII 110 hurdles title, won the Division II (small school) championship in the 110-meter hurdles at the New York State Public High School Athletic Association championship meet in Middletown June 8.

Hebert was clocked in 14.33 seconds to win the NYSPHAA title. He was second in the Federation race, running a personalbest 14.04 seconds. He was beaten by 9/100s of a second by Connetquot’s John Stallworth.

The NYSPHAA includes all the state’s public schools while the Federation includes both public and private schools.

Hebert won the outdoor state and Federation 110-meter hurdle crowns in 2012 as a sophomore. The Ticonderoga High School hurdler also won a pair of state titles at this year’s New York State Public High School Athletic Association indoor track championships March 2.

Joining Hebert on the all star squad is the Ticonderoga 4x100 relay team. That team included Hebert, Marcus Moser, Coleman Granger and Justyn Granger. The relay won the section championship this spring.

Upon a motion to consider from the floor, and the same appearing proper and necessary.

WHEREAS, the Board of Supervisors of the County of Essex (the ìCountyî), located in the State of New York, hereby determines that it is in the public interest of the County to authorize the financing of the costs of the acquisition of land for the mitigation of flood damaged properties, in and for the County, including demolition, re-conveyance for public purposes, the acquisition of any applicable equipment, machinery, apparatus, land and rights-in-land necessary therefor and any preliminary and incidental costs related thereto, all in anticipation of the receipt of grant funds from the New York State Office of Emergency Management and the United States Department of Homeland Security Federal Emergency Management Agency (ìFEMAî) as approved

by FEMA for said purpose, at a total cost not to exceed $5,500,000, pursuant to the Local Finance Law (the ìProjectî), and WHEREAS, the Board of Supervisors of the County has not taken any action or adopted any local law which would require the effectiveness of this bond resolution to be subjected to a permissive or mandatory referendum; and WHEREAS, the Board of Supervisors has determined it is in the interest of public safety and in the public interest to advance funds to be received

by FEMA as soon as possible from the proceeds of the obligations authorized herein.

Section 2.The respective estimated maximum costs of such specific objects or purposes, or class of objects or purposes, the principal amount of serial bonds authorized herein, and/or bond anticipation notes issued in anticipation of the issuance of such serial bonds, for such specific objects or purposes, or class of objects or purpose, and the period of probable usefulness of such specific objects or purposes, or class of objects or purposes, pursuant to the applicable subdivision of paragraph a of Section 11.00 of the Local Finance law, are as follows: (i) The acquisition of land for the mitigation

of flood damaged properties, in and for the County, including demolition, re-conveyance for public purposes, the acquisition of any applicable equipment, machinery, apparatus, land and rights-in-land necessary therefor and any preliminary and incidental costs related thereto, at a total estimated maximum cost of $5,500,000 for which $5,500,000 principal amount of serial bonds, and/or bond anticipation notes issued in anticipation of the issuance of such serial bonds, are authorized herein and appropriated therefore, having a period of probable usefulness of five (5) years pursuant to subdivision 12-a of paragraph a of Section 11.00 of the Local Finance Law. Such serial bonds shall have a maximum maturity of five (5) years computed from the earlier of (a) the date of the first issue of such serial bonds authorized herein or (b) the date of the first issue of bond anticipation notes issued in anticipation of the issuance of such serial bonds; Section 3.The Board of Supervisors of the County has ascertained and hereby states that (a) the estimated maximum costs of the Project are not to exceed $5,500,000; (b) no money has heretofore been authorized to be applied to the payment of the costs of the Project; (c) the Board of Supervisors of the County plans to finance the costs of the Project from the proceeds of the serial bonds authorized herein, and/or bond anticipation notes issued in anticipation of the issuance of such serial bonds, except to the extent FEMA aid for the Project is received by the County which shall reduce or be applied to repay the principal amount of such serial bonds or bond anticipation notes pro tanto; (d) the maturity of the serial bonds authorized in herein shall not be in excess of five (5) years; and (e) on or before the expenditure of moneys to pay for any costs related to the Project, for which proceeds of any obligations authorized herein are to be applied to reimburse the County, the Board of Supervisors of the County took ìofficial actionî for federal income tax purposes to authorize the capital financing of such expenditure.

Section 4.

Subject to the terms and conditions of this bond resolution and the Local Finance Law, including the provisions of Sections 21.00, 30.00, 50.00 and 56.00 to 60.00, inclusive, the power to authorize serial bonds, and bond anticipation notes issued in anticipation of the issuance of such serial bonds, including the renewal thereof, the power to prescribe the terms, form and contents of such serial bonds and such bond anticipation notes, and the power to issue, sell and deliver such serial bonds and such bond anticipation notes, are hereby delegated to the County Treasurer, as chief fiscal officer of the County.

The County Treasurer is hereby authorized to execute, by manual or facsimile signature, on behalf of the County, all serial bonds issued pursuant to this bond resolution and all bond anticipation notes issued in anticipation of the issuance of such serial bonds, and the County Clerk is hereby authorized to impress the seal (or to have imprinted a facsimile thereto) of the County to or on all such serial bonds and all such bond anticipation notes, and to attest such seal. Each interest coupon, if any, representing interest payable on such serial bonds, shall be

authenticated by the manual or facsimile signature of the County Treasurer. In the absence of the County Treasurer, the Deputy County Treasurer is hereby authorized to exercise the powers delegated to the County Treasurer by this bond resolution.

Section 5.

When this bond resolution takes effect, the Clerk of the Board of Supervisors shall cause the same to be published together with a notice in substantially the form prescribed by Section 81.00 of the Local Finance Law in the Press Republican, Post Star, Adirondack Daily Enterprise, and Times of Ti, newspapers having a general circulation in the County. The validity of such serial bonds authorized herein, and of bond anticipation notes issued in anticipation of the issuance of such serial bonds, may be contested only if such obligations are authorized for an object or purpose, or class of object or purpose, for which the County is not authorized to expend money, or the provisions of law, which should have been complied with as of the date of the publication of this bond resolution, were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, or if such obligations are authorized in violation of the provisions of the Constitution of the State of New York.

Section 6.

The faith and credit of the County are hereby and shall be irrevocably pledged for the punctual payment of the principal of and interest on all obligations authorized and issued pursuant to this bond resolution as the same shall become due.

Section 7.

The County intends to issue the obligations authorized by this bond resolution to finance the costs of the Project.

The County covenants for the benefit of the holders of such obligations that it will not make any use of the proceeds of such obligations, any funds reasonably expected to be used to pay the principal of or interest on such obligations, or any other funds of the County, and will not make any use of the Project which would cause the interest on such obligations to become subject to federal income taxation under the Internal Revenue Code of 1986, as amended (the ìCodeî) (except for the federal alternative minimum tax imposed on corporations by Section 55 of the Code), or subject the County to any penalties under Section 148 of the Code, and that it will not take any action or omit to take any action with respect to such obligations, the proceeds thereof or the Project financed thereby, if such action or omission would cause the interest on such obligations to become subject to federal income taxation under the Code (except for the federal alternative minimum tax imposed on corporations by Section 55 of the Code), or subject the County to any penalties under Section 148 of the Code. The foregoing covenants shall remain in full force and effect notwithstanding the defeasance of such serial bonds or any other provisions hereof until the date which is sixty (60) days after the final maturity date or earlier prior redemption date thereof. The proceeds of the serial bonds authorized herein, and of any bond anticipation notes issued in anticipation of the issuance of such serial bonds, may be applied to reimburse expendi-

tures or commitments made in connection with the Project on or after a date which is not more than sixty (60) days prior to the adoption date of this bond resolution and the County may expend general funds or other available moneys for the Project which shall be reimbursed from the proceeds of such obligations.

Section 8.

Prior to the issuance of the obligations authorized herein, the Board of Supervisors of the County shall comply with all applicable provisions prescribed in Article 8 of the Environmental Conservation Law, the regulations promulgated thereunder by the New York State Department of Environmental Conservation, and all applicable Federal laws and regulations in connection with environmental quality review relating to the Project (collectively, the ìenvironmental compliance proceedingsî). In the event that any of the environmental compliance proceedings are not completed, or require amendment or modification subsequent to the date of adoption of this bond resolution, the Board of Supervisors of the County covenants that it will re-adopt, amend or modify this bond resolution prior to the issuance of such obligations authorized herein upon the advice of bond counsel. It is hereby and has been determined by the Board of Supervisors of the County that the Project will not have significant impact or effect on the environment.

Section 9.

For the benefit of the holders and beneficial owners from time to time of the serial bonds authorized herein, or bond anticipation notes issued in anticipation of the issuance of such serial bonds, the County agrees, in accordance with, and as an obligated person with respect to the obligations under, Rule 15c2-12 promulgated by the Securities Exchange Commission pursuant to the Securities Exchange Act of 1934 (the ìRuleî), to provide or cause to be provided such financial information and operating data, financial statements and notices, in such manner, as may be required for purposes of the Rule. In order to describe and specify certain terms of the Countyís continuing disclosure agreement for that purpose, and thereby to implement that agreement, including provisions for enforcement, amendment and termination, the County Treasurer is authorized and directed to sign and deliver, in the name and on behalf of the County, the commitment authorized by subsection 6(c) of the Rule (the ìCommitmentî) to be placed on file with the County Clerk, which shall constitute the continuing disclosure agreement made by the County for the benefit of holders and beneficial owners of the obligations authorized herein in accordance with the Rule, with any changes or amendments that are not inconsistent with this bond resolution and not substantially adverse to the County and that are approved by the County Treasurer on behalf of the County, all of which shall be conclusively evidenced by the signing of the Commitment or amendments thereto. The agreement formed collectively by this paragraph and the Commitment, shall be the Countyís continuing disclosure agreement for purposes of the Rule, and its performance shall be subject to the availability of funds and their annual appropriation to meet the costs the County would be required to incur to perform thereunder.

July 13, 2013 The County Treasurer is further authorized and directed to establish procedures in order to ensure compliance by the County with its continuing disclosure agreement, including the timely provision of information and notices. Prior to making any filing in accordance with the agreement or providing notice of the occurrence of any material event, the County Treasurer shall consult with, as appropriate, the County Attorney and bond counsel or other qualified independent special counsel to the County and shall be entitled to rely upon any legal advice provided by the County Attorney or such bond counsel or other qualified independent special counsel in determining whether a filing should be made.

Section 10.

Any benefit incurred by any individual person or corporation from the objects or purposes authorized by this Resolution is incidental. The purpose of the financing authorized herein is to serve the public interest of the County.

This bond resolution shall take effect immediately upon its adoption by the Board of Supervisors of the County.
