Editor's Note: The Delta Upsilon Quarterly is pleased to present this timely article on the papers of the U.S. President, written by Herbert Brownell, Nebraska '24. Brother Brownell draws on a distinguished legal career as well as his service as Attorney General of the United States, a position he held for nearly five years, before returning to the private practice of law. The article originally appeared in the New York State Bar Journal, April 1978.

The answer is, "no one knows." The United States Congress, ifit takes action to implement the recent report of the National Study Commission on Records and Documents of Federal Officials, may provide an answer for the future. The Supreme Court, if it acts in continuing litigation relating to the Nixon papers and the Kissinger papers, may clarify the present nebulous state of the law.

At the height of the controversy over the Nixon papers and the tapes, Congress passed the Presidential Recordings and Materials Preservation Act.' Part I of the Act dealt only with access and control over the Nixon papers and tapes, and the Supreme Court has decided that this part of the Act, providing for screening of this material by Government Archivists, is constitutional under the circumstances there involved.

Part II of the Act established a National Study Commission to examine the problems with respect to the control, disposition and

preservation of the records and documents produced by or on behalf of Federal officials, with a view toward the development of appropriate legislation and recommendations for "the future. It directed the Commission to consider whether the historical practice regarding the records and documents produced by or on behalf of Presidents of the United States, based on the principle that such records and documents were privately owned, should be rejected or accepted and whether such practice should be made applicable hereafter with respect to all Federal officials. The House Committee Report recommending legislation for establishing the Commission stated: "The disposition and preservation of documents and records of public officials is a matter of continuing importance particularly to historians, political scientists and other scholars who have a special interest in the preservation of historical records of the nation."2 Thus, for the first time in its twohundred-year history, the Federal government authorized a comprehensive study of ownership, access to and disposition of the papers and records not only of Presidents and the institution of the Presidency, but also of all other officials of the Executive Branch and the Executive Branch itself, of the members of Congress, of the Legislative Branch, of the members of the Supreme Court and other Federal Courts, and of the Judicial Branch .

As directed by the Congress, the Com mission first studied the historical practices governing the records of Presidents of the United States. The most important statutes deal-

ing with the problem are the Federal Records Act of 1950,3 "the Presidential Libraries Act of 1955 4 and the Freedom of Information Act, as amended in 1974.5 These statutes purport to establish the public policy underlying Congress' stewardship of its constitutional obligation to regulate property of the United States. 6 The Federal Records Act was the first real attempt to provide a statutory scheme in the area of records management for agencies within the Executive and Judicial Branches. It sought thereby to make the ongoing business of government more efficient internally. The Presidential Libraries Act sought to preserve papers and documents of high ranking Federal officials, primarily Presidents, for the benefit of posterity. It dealt with papers developed by these Federal officials but not covered by the Federal Records Act and it assumed that such papers were privately owned. The Freedom of Information Act introduced a third public policy- that the public has a right to know the operations of its Government at the earliest possible date, including the contents of papers and documents produced in the course of exercise of Federal office. This right is subject to exemptions broad enough to enable officials to carryon their constitutional and statutory duties without disruption or peril to the national security.7 George Washington when he left office took his accumulated papers to his home in Mount Vernon. Indeed, he had good reason to do so because the Government did not provide a place for the papers to be stored.

Subsequent Presidents followed Washington's example in removing papers at the end of their term of office. Some of the early private collections were preserved ; others have been scattered to the four winds. Some papers were sold and others presented as gifts to friends , autograph seekers and, more recently, institutions. Some were destroyed while others fell victim to chance destruction . Many were passed on by will or iritestacy to family members or literary executives.

There is no evidence of the Government's laying claim to the papers removed by a President, until the Nixon case. Indeed, in 1924, when members of the White House staff discovered additional Taft, Wilson and Harding papers in the attic of the White House, they were sent away to be added to the collections of those Presidents and were subjected to the same private control and access restrictions as the existing collections.

Congress from time to time showed an awareness of historical value of certain of the collections and on several occasions appropriated funds for the purchase of privately held presidential collections, including those of Washington, Jefferson, Madison and Monroe.

The presidency was until after the days of President Coolidge a personal office. It did not have an institutional character like the State Department or the old War Department and it did not, therefore, develop facilities or procedures for creating a n ongoing record. This absence of institutional continuity inhibited the development of any clear distinctions between purely personal and public papers in the office of the

President. It was not until 1897 that one of the biggest problems, the lack of a suitable repository owned by the Government, was partially solved when the Library of Congress Manuscript Division was established.

Theodore Roosevelt and William Howard Taft, both avid record keepers , made arrangements to take advantage of the Library's custody of presidential collections, although they placed the control of their papers in their heirs. Mrs. Wilson likewise placed Woodrow Wilson 's voluminous papers in custody of the Library. The detailed account of the disposition of presidential papers included in the National Study Commission's report makes fascinating reading.

President Franklin D. Roosevelt was the first President to establish a presidential library, which was built with private funds in Hyde Park, New York. He arranged to deposit his Presidential and personal papers in the Library and appointed a private committee to screen the papers. He provided that certain categories of papers should not be made public and others were to be made public from time to time over a period in the discretion of the committee. Every President since that time has, through the use of private funds, built a presidential library or has announced that he intends to make similar provision for his papers and records.

Under the Presidential Libraries Act, the Federal Government may receive gifts of presidential papers and related papers, whether public or personal, and thereafter staffs and maintains the libraries at Government expense.

The growth of the size of the office of the presidency is reflected in the size of the collection in the various presidential libraries.

For presidential documents only, the approximate figures are : Herbert Hoover, 1,300,000 pages of documents for his four years; Franklin D. Roosevelt, 11,500,000 pages for his twelve years; Harry S Truman, 7,000,000 pages for his eight years; John F. Kennedy, 4,500,000 pages for his nearly three years; Lyndon Johnson, 18,000,000 pages for his over five years; Richard Nixon, 47,000,000 pages for his six years; Gerald Ford, 15,000,000 pages for his two years.

The presidential libraries are scattered around the country in locations designated by the various presidents. Access to the materials in the presidential libraries, based upon the FDR precedent, is usually at the discretion of a committee selected by the President, with certain records being permanently unavailable to the public. The presidents in recent years have usually donated all their so-called "personal papers," along with their official papers, to their library.

Aside from records of the President, the rules with respect to Federal agency records are laid down in the Federal Records Act, referred to above, and the regulations thereunder. The agency heads are primarily responsible for maintenance, access to and disposition of the records. The government archivist has a supervisory role . The records of these agencies are designated as property of the Federal Government. The definition of records in these statutes, however, is vague and in practice Federal officials accumulate information in the form of DELTA UPSILON QUARTERLY路

memoranda of conversations, transcripts, speeches, taped conversations, diaries and correspondence reflecting the private opinions and advice of colleagues and others and have treated this material as personally owned. s The Congress exempted itself and its members from legislation governing the records of the agencies in the Executive and Judicial Branches. The institutional records of the House and Senate are governed by rules of the respective Houses. While the rules have varied from time to time, such records are not generally available to the public. As to the individual members of the Senate and the House, such members have considered their office records to be their personal property. Some individual members have deposited their papers in public institutions, usually in their home districts.

The papers and records of the members of the United States Supreme Court have uniformly been treated as their private property. These papers include memoranda exchanged between the justices, memoranda prepared for the justices by their clerks and notes of oral argument and drafts of opinions relating to the cases heard by the Court. The institutional records of the Court, such as the docket files of cases, are public property. The records of the Judicial Conference, however, are not subject to public scrutiny.

The papers and records of the lower Federal Courts are governed by the same statute as the records of the Executive Branch, so that the official record of cases is preserved and disposed of in accordance with that legislation. However, the files kept by judges in their chambers have universally been considered to be privately owned by them. These include memoranda prepared by law clerks, memoranda passing between the judges as to cases heard by them, notes of oral argument, research notes by the judge and his clerks, conference notes, and drafts of opinions. In the absence of any official depository for papers of the members of the Judicial Branch of the Government, the practices as to access and preservation, as might be expected, have varied greatly and in many cases the files of the judges have been destroyed or lost.

After considering the welter of conflicting rules, or absence of rules, relating to the ownership, access to and disposition of records and papers developed by Federal officials, the Commission took testimony from officeholders and ex-officeholders of the Federal Government, as well as from historians, political scientists, representatives of the media, lawyers and judges as to the desirability of establishing by law the status of these papers and records. Studies were made of the practices of governments of various other countries in the western world and public hearings were held throughout the country. Memoranda on the existing state of the law and various constitutional problems were developed under the direction of former Solicitor General]. Lee Rankin. A detailed study of the disposition of papers of Supreme CourtJustices and Senators and Congressmen was made. 9 The Commission soon reached the decision that there was no constitutional bar to

legislation making the papers and documents of all Federal officials public property. It found no sufficient reason to differentiate between the three branches of Government and their officials in this regard. It unanimously recommended that Congress enact a statute providing that all documentary materials made or received by Federal officials in connection with their constitutional and statutory duties (other than personal papers) should be property of the United States. In other words, for the purpose of preserving these records for the benefit of the ongoing purposes of government and for historical purposes, the Commission decided that it was time to bring an end to the tradition that papers generated or received in the conduct of public business belong as a species of private property to presidents and other public officials. It registered the belief that this tradition of private ownership of public papers became established primarily by reason of the failure of the government to provide an alternative.

After the Commission's report was filed, the Supreme Court decided the case of Nixon v. Adrninistrat07' of the GSA 10 but did not rule upon the question oflegal title to documents and papers heretofore developed in the course of official duties by Federal officials. In fact, the majority opinion by Mr. Justice Brennan stated: "We see no reason to engage in the debate whether appellant has legal title to the materials .. . . Such an inquiry is irrelevant for present purposes because Section 105 (c) assures appellant ofjust compensation if his economic interests are invaded.

And even if legal title is his, the materials are not to be immune from regulation ."

The thrust of the opinion of Mr. Justice Brennan and of the other opinions making up the majority of the Court appears to uphold the view, I believe, that Congress has the power to establish the public ownership of the papers and documents of Federal officials developed in the course of their official duties.

Chief Justice Burger, however, in his dissent appears to question whether such a statute would be constitutional as to the socalled "Constitutional officers," i.e., Presidents, Members of Congress and Members of the Supreme Court. He stated: "The Constitution does not speak of presidential papers just as it does not speak of working papers of members of Congress or ofjudges. But there can be no room for doubt that up to now it has been the implied prerogative of the President-as of members of Congress and of judges-to memorialize materials, establish filing systems, and provide unilateral disposition of his working papers. Control over presidential papers is obviously a natural and necessary incident of the broad discretion vested in the President in order for him to discharge his duties. To be sure, we recognized a narrowly limited exception to presidential control of presidential papers in United States v. Nixon, 418 U.S. 683 (1974) but that case permits compulsory judicial intrusions only when a vital constitutional function , i.e. , the conduct of

criminal proceedings would be impaired and when the President makes no more than a 'generalized claim of ... public interest' ... in maintaining complete control of papers and in preserving confidentiality. United States v. Nixon provides no authority for Congress' mandatory regulation of presidential papers simply to 'promote the general welfare' which, of course, is a generalized purpose. No showing has been made, nor could it, that Congress' function would be impaired by the former President's being allowed to control his own presidential papers."

A split developed in the Commission as to whether, for purposes of access, publicly owned documentary materials should be governed by the Freedom of Information Act which now presently applies only to certain agencies in the Executive Branch of the Government. The majority of the Commission was of the opinion that the public should have access to Federal records and public papers but only "at the earliest feasible time." It recommended that the Freedom of Information Act be extended to institutional records of the Congress, the Federal courts and to certain units in the Executive office of the President. It recommended, however, that the Freedom of Information Act should not apply to "confidential communications between an official and his staff; conference notes ; and various other materials found in presidential papers, the office files of members of Congress, and the chamber files of judges." It recommended that because of the sensitive nature of these documents, access thereto could be limited by the Federal official who accumulates them for a period not to exceed fifteen years after the end of his Federal service, provided, however, they should not be exempt from access according to due process of law when required for purposes of the criminal or civil justice systems or for impeachment. At the end of the fifteen-year period, the majority recommended that Congress establish a mechanism similar to that contained in the Freedom of Information Act to provide the citizen with the legal right of access to these papers. It concluded that immediate application of the Freedom of Information Act to this type of document would create a substantial risk of interference with the continuing operation of government. It also stated that immediate ap-

plication of the Freedom of Information Act to these documents would result in less information being committed in writing and that which is written would be less than fully candid and complete. It pointed out also that if an incumbent president, a sitting Supreme Court judge or Federal judge, or member of Congress, were required to defend lawsuits brought under the Freedom of Information Act while at the same time attempting to perform his constitutional and statutory duties, the proper discharge of those duties would be disrupted.

The minority of the Commission, including the writer of this article, took the position that access to all documents of all Federal officials created or received by them in connection with the conduct of their public office should be subject to the same rules, including the Freedom of Information Act. It stated that if Congress decided that modifications ofthis Act were required to protect the functioning of offices whose records are not now covered by the Act, such modifications should be made. But the same rule should apply to all, and the Freedom of Information Act embodied a sound principle of Government.

Personal records which would be exempt include all materials created or received during the official's tenure of office dealing only with his personal affairs, such as family records, personal mementoes, personal correspondence and personal diaries. Perso nal records would also include extra copies of public records, provided the original or another copy is included in the public records. Records relating to personal participation in party politics (except in the exercise of the functions of office) were to be considered as personal records. Communications of constituents addressed to members of Congress in their role as ombudsmen to obtain assistance in accomplishing personal business would also be considered personal records.

From the above description of the report of the Commission, it will be noticed that the majority and minority agreed on two purposes to be accomplished by declaring the records and documents of Federal officials to be public property. They agreed first that the change would aid in the continuing operations of government and second it would make it possible for scholars more easily to preserve and reconstruct the history of government. The majority and minority split over a third governing principle. The minority placed strong emphasis on recognition of the people's right to know (without a delay of at least fifteen years) how the business of government is being conducted, subject to the well-recognized categories of information now exempted from the Freedom of Information Act and exemptions required by the Constitution.

Of special interest to lawyers is the effect of the Commission's recommendations on the papers and documents of Federal judges and on the Judicial Branch of the Federal Government. The major proposed alteration in existing practices involves the chamber files of Federal judges and justices of the Supreme Court. These preliminary working papers which have heretofore been treated as if they were the personal property of the

individual judge would henceforth be considered the property of the United States, with eventual access to them. The findings of fact by the Commission indicate that the customary treatment of these materials has resulted in the impoverishment of the historical record, with a consequent weakening of one aspect of the accountability of the Judiciary. The majority of scholars, judges and members of Congress, expressing an opinion on the issue of ownership ofjudicial working papers, favored the principle of public ownership of these materials and eventual public access to them.

Judge Carl McGowan of the United States Court of Appeals for the District of Columbia represented this position when he stated that neither government ownership of official papers of the judiciary nor disclosure of these papers would interfere with the effective functioning of the judicial process. He stated to the Commission: "I do not subscribe t~ the view that there is anything in the constitutional concept of the separation of powers which places the Judicial Branch in a preferred position with respect to official papers. There is no mystique about the functioning of the judicial process that should make the courts immune from the operation oflegislative policies governing the ultimate disposition of official papers generally. As in the case of other branches there may be a special consideration ... to be taken into account in prescribing at least temporary limitations upon public access. But I do not believe that the effective functioning of the judicial process will be impaired by the prospect of ultimate government possession and disclosure of the papers generated in that process.

* * * "I don't really see much difference between the principle that papers like what about the law clerk's memoranda?

Should a law clerk be able to say this is my property, my memorandum to the judge is my property, and I will do whatever I please with it?

"I don't believe that's right. I regard what he writes as a piece of paper generated in the decision of the case, and it's in that file along with the draft opinions and with the memoranda to the other judges voting on the case or discussing the law in the case.

"I don't see really any constitutional issue. We are talking constitutionally now ; I don 't see any constitutional difference between that and a lot of papers that Congress will call upon the executive or may call upon the executive to save, and always with limitations of various kinds with respect to time of making them public.

"But I don't see any constitutional difference in the two functions that somehow drapes over the judges this mysterious veil."

Professor Walter Murphy of Princeton University likewise stated to the Commission: "I also think that no other public official whetherjudge, executive or legislator can

claim any right to privacy in how he or she performs a public function . You might claim that there are certain issues of taste, certain issues of propriety, and so forth, but as long as this is a public function one can't say 'I have a right to privacy in how I decide a case' or how he decides to vote for a piece of legislation, or how he consults with the Secretary of State about what we should do about the latest crisis in the near east. As lon g as we, the genera l public, are affected by these decisions, I think it is a public function."

The opposite point of view on the issue of the public nature of the papers of Federal judges and their staffs was stated to the Comm ission by Judge James Oakes of the Court of Appeals for the Second Circuit, by Dean Norman Redlich of New York Un iversity School of Law, and by Dean Louis Pollack of the University of Pennsylvania Law School, among others.

In sum, the Commission's recommendations involve controversial issues that may result in extensive hearings before a comprehensive public policy is adopted. The need for congressional action, however, seems clearly demonstrated by the Commission's research and findings.

Treasurer Reports Inflation Effects Results of DU Operations, Programs

Rasmussen, Purdue '46, Treasurer For the year ended June 30, 1980, Delta Upsi lon Fraternity had an excess of expenses over income of$5,783 compared to a black figure of $10,586 last year. It is impossible to offer the best in creative, quality programming and remain immune to the inflationary pressures of the economy.

Many of our necessary expenditures reflect costs that are beyond our control.

Our financial planning and budgeting projected that we could achieve revenues of $455,275 for the year. Actually, our totals reflect an increase of $35,478 or 7.8% more than we had budgeted. A generous gift of $10,000 was added to our permanent trust fund and another gift of$1 0,000 was made a Part of our operating funds. One can easily see how gifts and bequests can be most helpful in the total finances of our Fraternity.

The prompt reporting and payment of pledge and initiation fees is vital to our proper financial controls . This past year, too 111UCh tilne and money was expended in collecting these fees. Our accounts receivable in

this area represent a potential income that cou ld have provided a black figure for our total operations for the year.

Prudent financial management indicates that we I1lust increase and expand our

sources of revenue. The alumni support progranl continues to beC0I11e a lTIOre iI11f . portant cOnlponent 0 our lI1COlne state-

ment. This past year the alumni provided 16.7% of our income. The total giving increased $6,510 enabling us to direct a check for $12, 125 to the Delta Upsilon EducationI F d' 0 P 'd 'C a oun allon. ur reSl ent s entury Club welcomed 230 members, an increase of 15 donors over 1979. For the sixth year in a row the alumni of the Purdue University chapter had more contributors than any other chapter. Hail Purdue!

To say the least, the management of our permanent trust fund was quite difficult and challenging during this past year. Our investment subcommittee increased our income $4,310 even though the principal remained about the same. The committee continued to upgrade the quality of our portC I' d k d f h II 10 IO an too a vantage 0 t e unusua y high rates that were available in the money markets.

Our interest income was $7,602 ahead of last year and importantly reflects the outstanding work of Director Terry Brady and his management of our Loan Fund Committee. Also, this higher interest income figure was increased by the prudent management of our short term funds. We were pleased to receive a grant of $12,291 from the Delta Upsilon Educational Foundation to help

satisfy the needs of our constant educational programming.

Now let us direct our attention to the expenditure items. We budgeted a figure of $450,850 for the year, but the actua l total exceeded this by $44,847 or 9.9%. Our national inflation is spiraling upward at an annual rate of about 13%. We will not know· ingly practice deficit spending, as we must try to balance the financial needs of our programming with the funds needed to support it. This was a difficult task this year.

We encourage each one of you to visit the International Headquarters here in Indianapolis. You will find a well·designed, modern facility that features a dedicated office staff providing the best in services to our members. The entire fraternity world recognizes that at the professional level, Delta Upsilon enjoys the very finest in creative, innovative people at the helnl. This year the cost of maintaining this exce llence went up 8.9%.

You will notice in the statement of functional expenses that $180,30 I or 36% of our total expenses were allocated to services for the undergraduates and chapters. An addi· tional figu re of $47,086 represents the cost of the leadership conference, convention, regional leadership seminars and the assembly of trustees. Together these two items comprise more than 45% of our expenses.

We are concerned that the major fraternities that we compete with on the college campuses have a larger endowment fund than we enjoy. It would appear that the appropri ate size for our permanent trust fund would be about three million dollars above the present size. The coming 150th Anniversary in 1984 will offer an unusual opportunity to attract major gifts and increase the size of our endowment.

Our independent accountants, Price Waterhouse & Co. have certified our audited financial statements that are a part of this report. We shall continue to follow the guidelines of the American Institute of Certified Public Accountants for not-far-profit organizations.

In summary, we have just completed a very successful year in the history of Delta Upsilon. Unfortunately, the spiraling of inflation caused us to run a small deficit, but we have taken action to be certain that the deficit is not repeated. Our well conceived financial programs feature the prudent management of our resources and they furnish the foundation for building and maintainingour excellent Fraternity. I deem it an honor to serve as your treasurer.

To the Directors of Delta Upsilon Fraternity We have examined the statements of financial position of Delta Upsilon Fraternity as of June 30,1980 and 1979, and the related statements of revenues and expenses and changes in fund balances, of changes in financial position and of functional expenses for the years then ended. Our examinations were made in accordance with generally accepted auditing standards and accordingly included such tests of the accounting records and such other auditing procedures as we considered necessary in the circumstances.

As explained in Note 2 to the financial statements, the Fraternity records marketable securities at cost, which exceeds the market value. It is not possible at this time to determine the ultimate loss, if any, that may result on the disposition of these securities.

In our opinion, subject to the effects, if. any, on the financial statements of the ultimate resolution of the maller described in the preceding paragraph, the accompanying financial statements examined by us present fairly the financial position of Delta Up§ilon Fraternity at June 30, 1980 and 1979, and the results of its operations, changes in its financial position, and its functional expenses for the years then ended, in conformity with generally accepted accounting principles consistently applied.

NOTES TO FINANCIAL STATEMENTS JUNE 30, 1980 AND 1979 NOTE 1 - FUND OBJECTIVES AND ACCOUNTING POLICIES: Delta Upsilon Fraternity is an international college fraternity with headquarters located in Indianapolis, Indiana. AtJune 30, 1980 it has 88 undergraduate chapters located throughout the United States and in Canada. Each chapter is a separate corporate entity having its own constitution and bylaws and thus their financial position and revenues and expenses are not consolidated in the accompanying financial statements of the international fraternity.

The various funds, maintained in accordance with their objectives as determined by the provisions of the Fraternity constitution and bylaws, are as follows: Operating Fund - Accounts for income and expense from the general operations of the Fraternity.

Educational Fund - The Delta Upsilon Educational Fund is a separate fund used exclusively for educational programs, purposes and activities of the fraternity. All gross income, except "exempt function income" as defined by the Internal Revenue Code is accounted for in this fund.

Chapter Loan Fund - Accounts for funds available for making loans to various chapters.

Permanent Tmst Fund - The permanent trust fund balance represents an investment portfolio primarily composed of stocks and bonds. Investment income accrues to the Educational Fund. Gain or loss on the sale of securities accrues to the Permanent Trust Fund.

The accounting records of the Fraternity are maintained on an accrual basis in accordance with accounting principles for "not-forprofit" organizations. Investment transactions are made from time to time based on the advice of the Fraternity's investment commillee and its advisors.

Although it is the Fraternity'S intention, as in prior years, to hold these securities as long-term investments and not to use the principal amount of the fund to finance cUlTent operations, certain of the investments may be disposed of in the coming year if, in the opinion of the committee, such dispositions are in the best interest of the Fraternity. Because of fluctuations in the market value of these securities, it is not possible, at this time, to detemine the ultimate loss, if any, that might result from future investment transactions.

NOTE 3 -

NOTES RECEIVABLE FROM CHAPTERS:

The notes receivable from chapters bear interest at 5% to 20% per year and are due in instalments through 1995, although payment dates on certain notes have been extended by the cha pter loan committee. Some of the notes are fully or partially secured by first, second or third mortgages on chapter properties.

NOTE 4 -

PENSION PLAN:

The Fraternity has a contributory, insul'ed pension plan covering eligible employees as set forth in the plan. Pension expense for the years 1980 and 1979 was $3,355 and $5,632 respectively. The Fraternity'S policy is to fund the pension costs accrued. The fund assets exceed the actuarially computed value of vested benefits and there is no past service liability under this plan.

NOTE 5 -

FUNDS HELD FOR INACTIVE CHAPTER:

During 1980, the Kent State chapter house was deeded to Delta Upsilon Fraternity upon suspension of that chapter. The property has been recorded as Assets of Inactive Chapter at fair market value determined by independent appraisal. It is the intention of the Fraternity to sell the Kent State chapter house and, if the Kent State chapter is reestablished before 1990, to remit the net proceeds from the sale to the Chapter. The fair market value of the chapter house, net of $6,857 due Delta Upsilon Fraternity, has been recorded as Funds Held for Inactive Chapter.

NOTE 6 -

CONTINGENT LIABILITIES:

The Fraternity has guaranteed certain liabilities of one of its chapters. AtJ une 30, 1980 guarantees were outstanding on approximately $15,100 of such liabilities.

by John Warfel, DePauw '39 During World War II, when the favor or dislike of an immediate superior could often determine whether you would spend your future stationed or transferred to " heaven or hell," I was on duty at an airfield in New Mexico. There was a reassignment to India of my immediate superior and in came a new Major in charge. For a few days, I felt it was touch or go for me. The new officer seldom spoke or smiled at me and was more or less withdrawn.

Then it happened! I walked into his office and found him reading the Delta Upsilon Quarterly. My face lit up!

"Are you a D. U., Major?" I asked.

"Yes, at California." he replied.

"So am I, at DePauw, " and from then on everything was "go" for whatever I proposed.

To my great sorrow, however, 11 months later Major Ed Bailey went down on a plane trip near Weatherford , Texas, in 1944, and was buried in Arlington Cemetery.

At this time when so many students of the highest scholastic standing apply to medical schools and competition is so keen, it makes me wonder how I got there.

A friend 's son, who flunked a course and had to repeat it in summer school , caused me to look back to my own experience over 50 years ago when I had the same thing happen .

I had failed in physics at the University of Washington , Seattle, so I had to repeat that subject in summer school. Now, I feel, that incident changed my college career and en-

tire future. Failure of this subject made me ineligible for football. I had been on the varsity squad the year before and felt I could at least make the football squad again the following year. Not being permitted to tu~n out for football was a catastrophe In my young life since athletics was my main interest. Even in high school in West Seattle football, basketball and baseball were my only interest and I don't remember ever studying.

Having failed eligibility for football at the University, I decided I had better spend my time studying. Of course, my low grades and football ineligibility did not help my status among my Delta Upsilon fraternity brothers.

As I look back, if I had played football , I doubt very much if my grades and intellectual interests would have been good enough to get me into medical school. Through the stimulus of Dr. Worcester, my professor in anatomy at the University, I really tried and enjoyed studying . I never did graduate from the University because of missing a trimester while in Alaska for a season with the U.S. Coast Guard and Geodetics Survey on Kodiak Island.

After graduating from medical school, I interned for two years at Barnes Hospital in St. Louis, did general practice for a short time, and then had a residency in orthopedics at the New York Orthopedic Hospital which is part of the Columbia Presbyterian complex. Since 1932 I have been practicing orthopedics in Trenton, New Jersey, and was on the staff of a number of hospitals including the University of Pennsylvania Hospital for many years.

(The following is a letter from a chapter counselor to an outstanding undergraduate in the junior class.)

As a new school year begins, I want to share with you some of my thoughts concerning your return to college and to Delta Upsilon.

Perhaps you wi" find some of my thoughts challenging and they may stimulate you to higher achievements in your personal life. I believe you realize that I have been counseling Delta U.'s for some 30 years now; so, hopefully there is some wisdom in what I shall present.

This probably will be your happiest and most carefree college year. Your upper class standing wi" command new respect at the chapter house. This new status brings privileges, responsibilities and many fine opportunities. Wi" you take advantage of these opportunities? I want to be certain that you identify them and understand them before returning to school.

By now you have identified your lifetime career and your academic courses should become more interesting. Your class work should be very practical as you wi" be able to understand how the lessons will D ELT A UPS I LO N Q UAR TE R LY 路

apply directly to your career. The basic background courses that can be so boring and tedious should a" be behind you.

Fraternity life emphasizes group living , group development, group discussions , group activities, but this is not the important lesson to be learned from fraternity life. I believe the most important lesson to be learned is to get to know yourself.

Identify your talents, your skills, your interests, and your abilities and at the same time get to know your limitations, your shortcomings and your inabilities. The greatest lessons that a fraternity can provide will a" be available this year.

Uniquely, the fraternity wi" offer the opportunity to volunteer for some committee work that could develop your management skills. You wi" have your chance to try to motivate people. Motivation can be difficult when your brothers live with you and really know you for what you are. When a committee's task has been completed, hold a critique of the group's performance. Be sure that the discussion thoroughly covers all aspects of the task and listen to any comments that may be offered concerning your ability or inabilities as a leader. This would be an extremely valuable experience to "learn about yourself" as others see you.

Try to aid others in their quest to live the better life. You can best participate in this valuable experience by volunteering to be a fraternity father for some fine pledge. Take him under your wing and help him through the sometimes difficult experiences of a freshman year. This can be fraternal brotherhood at its best. Maybe your pledge son will embarrass you at homecoming by introducing you to his parents and then stating that he hopes to be like you some day. Quite a compliment.

Time management. Perhaps this is the most important ski" for you to practice and develop. Mastering this ski" could be the secret to a successful life. Set your priorities in tasks to be performed and then

complete them to the best of your ability.

Spend some time alone. Develop your short term and long term goals.

Rather frequently evaluate your progress in achieving your goals. Be sure to set goals that are attainable and make sure that you are progressing towards them. You we" know that a fraternity setting provides little privacy or time alone.

Everyday keep and use the Christian principles that are so important in your life. Perhaps your fraternity brothers wi" sense your inner peace and some may come to you for spiritual guidance. A most rewarding experience.

Perhaps this wi" be the year when you find the fair lady that you wi" ask to marry you. Hopefu"y the wedding will not occur until after your graduation. As you mature and develop your self-confidence, you become better able to present yourself to a gal as a lifemate. Good hunting!

I would guess that you have always brought great joy and honor to your mother and father, and I am .certain that they have expressed their appreciation for this. As often as possible, do not fail to thank your parents for a" they have done for you. ' So in closing I have presented a number of challenges and a number of time-tested ideas and solutions that should be helpful to you .

Perhaps you wi" find this summary of my thoughts inspirational. If you consciously employ some of these in your life I will guarantee that you wi" become a more mature and successful young man. It should follow that you wi" enjoy a happier and more prosperous life. Strive to reach your potential.

May you have a great year, your junior year, and may the good Lord continue to bless you everyday.

Dr. Henri E. Abel, Colgate '20, and wife Jean were among the 40 Family Summer Program participants during July on the Colgate campus. Dr. Abel, now 81, and his three dermatologist children all practice together, with Abel going into the office early and leaving mid-morning ' to tend his garden.

Henry A. Wicke,jr., Denison '57, has been appointed to the Frank L. Babbott Chair of Literature and the Arts at the Packer Collegiate Institute. In nearly 30 years in the theatre, he has worked in over 500 productions. Wicke is completing his doctoral dissertation on opera stage direction at the Metropolitan Opera during the tenure of Sir Rudolf Bing.

Willis G. Corbitt, Washington '20, was honored in February by the Western Forestry Center, Portland, with an exhibit of his years of work with the center and a history of his career. Corbitt, a retired forester, poet, and genealogy buff works twice a month at the center, serving as a volunteer guide - a service he has enjoyed providing since 1971.

ROBERT J. DUFFY Colgate '62 Broadcasting Executive Robert J. Duffy, Colgate '62, has certainly left his mark not only in the sports field, but broadcasting as well.

In February 1980 elected to the Westchester Sports Hall of Fame, Duffy's professional basketball career 1962-1964 was with the St. Louis Hawks and Detroit Pistons.

He was top draft choice, second round. He was Helms Foundation Basketball ALL-AMERICAN at Colgate in 1962 and holder of all Colgate basketball scoring records from 1960 to date. He was the youngest major college varsity basketball coach in the country at Colgate, 1965-1967.

Arthur E. Wible, Jr., advertising director of the New York Daily News, has been elected a vice president of the company. Hejoined the staffin June 1978. Art came to the New York Daily News after holding numerous positions in advertising with the Chicago Daily Tribune following his graduation from the University of Michigan with a B.A. in journalism and advertising.

His first position in 1959 was as a classified advertising salesman. He then became the real estate manager of the classified section, and he won the Chesser M. Campbell Award for outstanding salesmanship in 1961. Other positions included vice president of the Suburban Tribune, a subsidiary of the newspaper. From 1975 to 1978, he held managerial positions in general, retail and display advertising with the Chicago Daily Tribune.

Art has been a guest lecturer at the American Press Institute, and 89

GJfall of GFame has also lectured at a number of colleges and universities on the subje ct of advertising . He has served on various committees of the International Newspaper Advertising Executives. A native New Yorker who was born in Queens, Brother Wible now lives in Greenwich, Connecticut.

ROBERT C. HAUGH Indiana '48 Marathon Competitor Robert C. Haugh, Indiana '48, President of the Dallas based Overhead Door Corporation, has set a new world record for age group 59 with a seven hour, 37 minute time for the 50 mile run. Competing in an AAU sanctioned and certified race over the Bachman Lake course in Dallas on January 19, Haugh bettered the existing record of nine hours, eight minutes by one hour and 31 minutes.

Although a veteran of 10 marathons (26.2 miles), including a three hour, five minute effort in the most recent Boston marathon, this was Haugh's first attempt at 50 miles.

Commenting on his record run, Haugh said: "At the 25 mile mark I seemed to get a second wind and just settled into a very strong and steady pace."

The grueling race clearly had no adverse effect on the Dallas executive who cruised the final 25 miles 16 minutes faster than the first 25 miles. Haugh averages runnmg 225 miles per month.

Oregon State '22 Scientist of Distinction Dr. Linus C. Pauling, Oregon State '22, a long-time member of the faculty at the California Institute of Technology, now heads the Linus Pauling Institute of Science and Medicine, a group of about 25 scientists at Menlo Park, California.

Much of the work there is on the application of chemistry to biological and medical problems. Dr. Pauling and his co-researchers are working on a project concerned with Vitamin C and cancer. They have concluded that Vitamin C has a dramatic, life-extending effect for patients with some kinds of terminal cancer.

He has written more than 400 scientific articles, but his worldwide fame for the general public now is linked to two books, Vitamin C and the Common Cold, and Cancer and Vitamin C. Maintaining a demanding schedule with his research and extensive travel, Dr. Pauling is considered one of his own greatest testimonials to Vitamin C. Pauling was awarded the Nobel Prize in Chemistry in 1954 for his research on the nature of the chemical bond and its application to the elucidation of the structure of complex substances. He received the 1962 Nobel Peace Prize for his worldwide campaign against openair testing of nuclear bombs.

G. Seely Johnston, Illinois '24, is a man who has grown very dear to the hearts of Illinois sporting enthusiasts, his community, and his fraternity.

Seely is the founder, owner and operator of Johnston's Sport Shop in downtown Champaign, which he opened in 1925. Throughout the course of 54 years in the sporting goods business, Seely has been the president of the Illinois-Indiana Sporting Goods Association and the president of basketball, baseball, and softball independent leagues of Champaign. For 41 years he has been the presentor and sponsor for the outstanding senior athlete of Champaign High School.

A strong community and civic leader, Seely has been a city councilman, a director of the Campus Businessmen's Association, director of the Champaign County Fair Association, State Secretary of Illinois Exchange Clubs and local president, Area President of the Sons of the American Revolution, Chairman of the Champaign Recreation Commission, and has been named the Champaign Amvets Man of the Year.

Douglas was named President of GTE Lenkurt Incorporated, San Carlos, Calif., following the acquisition of that company by GTE in 1959. Your alumni support check means that we can train and send to each and every chapter twice a year, a consultant who can provide help, information about new programs, service and activities of Delta Upsilon.

Alumni support makes possible the program of area alumni update events, or recognition for twenty-five and fifty year members, chapter awards, and a hundred other programs that we couldn't consider with the small endowment and the forty-five percent of the costs paid by undergraduate DU's.

Torrey replaces George W. Nichols, Jr., Cornell '45, who had been serving as Province Three Governor.

The newly appointed Province Five Governor is David N. Novelli, Rutgers '73. Province Five includes the chapters in the state of Ohio where there are presently chapters at Bowling Green, Dayton, Denison, Marietta, Miami, Ohio, Ohio State, and Case Western Reserve .

Novelli, also a former member of the Delta Upsilon professional staff from 1973 to 1977, is the Deputy Auditor for the City of Canton, Income Tax Department.

W. Brian Poykko, North Dakota '77, replaces Carroll L. Lurding, Ohio State '59, as the Province Six Governor.

Poykko was president of the highly succ(!ssful North Dakota Chapter in 1977 at which time it was recognized with the President's Trophy for Excellence for the third straight year. He is currently Manager European Sales for the Universal Electric Company of Owosso, Michigan.

Province Six includes chapters at DePauw, Eastern Kentucky, Indiana, Louisville, Michigan, Michigan State, Purdue, Western Ontario and the ADU colony at Michigan Technological University.

All four of these newly appointed Province Governors attended the 1980 Province Governors' Seminar at the Leadership Conference and Convention and met with delegates from their provinces.

Leaving the headquarters' professional staff at the end of the school year were two seasoned veterans, Rodney F. Kirsch , North Dakota '78, who had completed a second tour as undergraduate services director and Keith W. Weigel, Iowa '78, fraternity development director. Kirsch enrolled in graduate higher education at Indiana University; Weigel is employed with a banking consultants firm in Memphis, Tennessee; and retiring consultant Barney F. James, Oklahoma State '79, is working in his native state of Oklahoma.

Joining the staff are four new "riders of the blue and gold sagebrush." They will conclude visits to most chapters, colonies and petitioners by the end o[ the first half of this school year. The remaining time will be spent in revisits, reorganizations and new chapter development work, along with the Regional Leadership Seminar program that takes place at mid-year time.

Martin T. Baxter, II, Virginia '80, comes to the DU professional staff from his native state of Virginia. A graduate of the University of Virginia, Marty led his chapter while being active in campus extracurricular activities. He earned degrees in government and economics; enjoys cross country running, racquet ball and hopes to attend law school in the future.

Scott A. Johnson, a 1980 graduate of the University of Washington with a B.A. in accounting, was pledge educator, chapter relations secretary and then chapter president of the Washington Chapter. He is an ardent skier, enjoys jogging and eventually hopes to pursue a career in law .

Troy E. Horine was born and raised in Wichita, Kansas and is a graduate of Kansas State University with degrees in secondary education (history and journalism) and in business. While an undergraduate he served as scholarship chairman, alumni relations secretary and as chapter president.

He is a member of Phi Alpha Theta, history honorary, and as an undergraduate was involved in student senate, the university public relations council and library committees. He was a staff member of the university student newspaper and worked [or the office of Information at Kansas State.

Bradley K. Wolf, Kansas State '80, is the only member of the DU professional staff ever to graduate with a degree in milling science which deals with the production and processing of cereal grains . He was steward for the Kansas State chapter as well as pledge educator and chapter president. He enjoys running , tennis and woodworking.

Delta Upsilon President, Herbert Brownell, has appointed four new Province Governors in recent months.

Scott D. Hahner, Rutgers '78, has been appointed as Province One Governor, replacing William R. Gordon, Kansas State '60, who had served two terms in that capacity.

Hahner, a former member of the Delta Upsilon field staff in 1978-'79, entered a career in international banking following his service with Delta Upsilon's professional staff.

Province One includes chapters at Colby, Maine, Massachusetts, Middlebury, Rutgers, Technology, Tufts and Union.

William A. Torrey, Bucknell '75, has been appointed Province Three Governor. Torrey is employed in alumni development work at Bucknell University and also serves as the corporation president of the Bucknell Chapter.

Province Three includes chapters at Bucknell, Carnegie, Delaware, Johns Hopkins, Lafayette, Lehigh, Maryland, Pennsylvania, Pennsylvania State, and Swarthmore.

Delta Upsilon Celebrates One Hundred Years at Northwestern Delta Upsilon has been on the campus of Northwestern University for one hundred years, and the chapter is planning a year-long celebration with hopes that the alumni will drop by the chapter house during this year.

The Chapter extends an invitation to all alumni and friends to visit the house on October 11 or after any of the home games this fall.

Ninety-nine brothers in Delta Upsilon attended, nineteen of them being veterans of more than 50 years in Delta Upsilon! The Pfister Hotel and Tower was the setting for a splendid evening.

It was especially great to count 19 "50-Year-Men" among the 99 who attended.

Next December 5, Friday, we will hold our 57th Annual Dinner and will present 50 Year Awards to any who were initiated by Spring 1931 .
