2020 will be a year for the history books no doubt, for a bunch of reasons but mostly Covid-19, of course. There is an ancient Chinese curse which supposedly says: May you live in interesting times! Well, these have been interesting times. A year’s worth of ‘interesting times’ and let’s not fool ourselves, 2021 is probably going be an interesting year too.

2020 has consisted of tough lessons and reality checks. Recently we learnt that the USA democratic system is as much of a joke as any small third world country. We have seen that even when it comes to a lifesaving vaccine, money talks, and the ‘rich’ (first world countries) are getting the benefits while places like SA are left behind due to financial and infrastructure constraints. We have learnt that people are unable to follow simple health protocols that benefit other people; they are too selfish for that. We have seen that people will rather put their lives and those of others at risk, than be inconvenienced in some small way. We have seen politicians and preachers very publically pulled down off their pedestals and disgraced, but regardless still have a huge following and big clout. It has been a messed up year for sure and some of the lessons we have learnt have not been nice.

However, in among all this 2020 craziness, are some positive takeaways, not to be overlooked. We have realized a few simple truths about life and the world: that things could always be worse; an appreciation for simple pleasures like going outside, or hugging our loved ones and not to be overlooked has been the amazing amounts of time spent with family during lockdown. While we may have some of that next year, this has been a real stand out feature for 2020.

This month we delve into the highlights and lowlights of 2020, as well as some things to keep in mind as we transition to a new year. Who knows, you may even have a laugh or two (or shed a tear)?

With vaccines beginning to roll out, there has been a definite upswing in peoples outlook for the future, while at the same time pandemic fatigue has lead an increasing amount of people to skip simple Covid-19 protocols causing the virus to spread again like wildfire. The end of year break sadly looks like it will be a super spreader event in of itself. I hope the poor doctors and medical staff are ready for what’s coming.

There is some similarity between pandemic fatigue and debt fatigue.

Often over-indebted consumers would rather try get a new loan to try pay off their existing debt rather than change their spending habits.

People get tired of always counting cents and having to watch their spending. After months and months of sticking to a good financial routine, many just let loose and throw caution to the wind and spend recklessly, even when they know they shouldn’t. Then when the consequences come knocking, it is somehow unfair and not their fault.

Please don’t be one of those people, stick to your good habits. Take care over the end of the year as we say good bye and good riddance to 2020. Hopefully 2021 will be the year that you manage to get debt free.

INTRODUCTION There are many years in recent history that stand out for significant events; 1914 (World War One), 1918 (Spanish flu), 1939 (World War 2), 1969 (man lands on the moon), 1989 (the fall of Berlin wall) 2011 (Sept 11th). Well, 2020 has also shaped up to be one for the books.

When we discuss 2020 we will all think of Covid-19 and the subsequent lockdown, of course. There were, however, a number of other sad, exciting, interesting, silly or scary things that happened during this year.

WHAT A YEAR! We will not soon forget the dumpster fire that was 2020.

Hopefully some good things happened to you during the year, to help offset many of the challenging and difficult situations you faced.

In particular our hearts go out to those who suffered loss this year due to the pandemic. Please get (and give) the emotional support needed from those closest to you.

When the history books are written and people look back at this significant year in human history, it is sobering to think that you can say: ’I was there…sitting in the lounge in my underwear, working over zoom, social distancing and watching Netflix till late at night, I survived 2020!’

The end of the year is in sight and the festive season is upon us. With the pandemic disrupting all of our lives for the majority of the year nobody would blame you if 2020 actually felt like it had 16 months.

December is known for people overspending and perhaps with all the constraints we suffered in terms of travelling and shopping (not forgetting the ban on liquor and cigarettes) there might be a feeling of “Arrgh, Forget this! This December the family and I are going to enjoy it and next year I’ll worry about it”.

Think back on January 2020 (if you can remember that long ago), it seemed as if there were 64 days between December and January’s salary. You were probably so stressed out and desperate by the time pay day came along in January.

Don’t get caught in the same trap again.

DON’T LET DECEMBER SPOIL YOUR JANUARY

DECEMBER & JANUARY ARE NOT FRIENDS December buys presents that January must pay for.

December buys trolley loads of food and January must foot the bill. In short, December makes excessive purchases that upsets January and this rolls over to February, March etc. It can take you months and months to recover…if you ever recover.

This year, it would be an excellent goal to keep the harmony between December and January by spending wisely.

Oh yes if the thought has crossed your mind to skip a debt repayment during December because it’s been a hard year (I owe it to myself and my creditors will understand - after all it is only one month that I’ll miss the payment what’s the big deal?) then STOP and think again.

Your various creditors will try to leave the debt review and start new legal action. This can mean that all the progress you have made over the months or years of your debt review will be lost in the blink of an eye.

Don’t let December spoil your January – This year why not keep your wallet under lockdown?

LACK OF GOOD COMMUNICATION A lot of consumers who begin debt counselling do not make good notes or save vital documents about their extremely important and life changing debt review. This leads some to forget who their Debt Counsellors actually is.

Fortunately, most consumers know that they pay their debts via a regular monthly payment through one of 4 Payment Distribution Agents (PDAs).

This reflects on their bank statements and they receive emails (or SMS) reminding them of this every month.

At present, only 4 entities have been registered as PDAs with the National Credit Regulator who check up on them and audit them regularly to ensure consumer’s funds are safe.

A lack of regular and clear training and communication from their Debt Counsellor can unfortunately leave consumers confused, thinking that their Payment Distribution Agent (PDA) is actually their Debt Counsellor.

YOU MAY NOT HAVE SIGNED A CONTRACT Part of the problem is a lack of clearly worded service contracts from their Debt Counsellor.

Many Debt Counsellors still, despite requirements of the Consumer Protection Act, fail to provide detailed service contracts explaining what they will and won’t do. Most Debt Counsellors still only provide a long application form with lots of info called a Form 16. This is just an application document or form and is not a contract as required by law.

Due to this lack of clear explanation consumers can easily get confused.

PDA / DEBT COUNSELLOR

PDAS CONFUSED FOR DEBT COUNSELLORS A lack of clear information by their PDA and Debt Counsellor can end up confusing consumers. As a result, the PDAs regularly get flooded with questions about consumer’s debt review that need to actually be answered by their Debt Counsellor.

Consumer should note that the PDAs are not Debt Counsellors. The PDAs handle the payment or money side of things (the Debt Counsellor does not handle your money only the PDA does). This separation of duties helps protect consumers and Debt Counselors, ensuring there can be no fingers pointed about funds going missing or stolen. After all how can a Debt Counsellor steal money they never touch? It is a great protection for all parties involved.

Most Debt Counsellors have even signed conditions of registration with the NCR that prevent them from receiving any funds (even fees) directly from a consumer. These monthly fee payments have to be made via a PDA.

YOUR PDA WILL TRY HELP PUT YOU IN TOUCH WITH YOUR DEBT COUNSELLOR Fortunately, even though so many consumers forget who their Debt Counsellor is, the various PDAs track this information and can help put consumer clients in contact with their Debt Counsellors. They will happily provide email addresses or telephone numbers.

So please remember: the PDAs just handle the money side of the process and the Debt Counsellors help with everything else from budgeting advice, helping contact your credit providers, assisting the courts to come up with a plan to restructure your debts and reviewing your situation as the process progresses.

In December 2020, after decades in the banking space and more recently in the realm of debt review Mr. Harry Greene will officially be ‘hanging up his spurs’.

Debtfree Magazine got to ask Harry to share some of his career highlights with us - from starting out working with Standard Bank for 3 months just so that he could go on a holiday, to decades in top management positions. Harry has had a huge impact on Banking in South Africa and on the debt review process.

INTRODUCTION While I was born in the UK, I arrived in South Africa as a baby and grew up in Durban. I joined the Standard Bank of SA Ltd in January 1964, the day before my 17th birthday in order to accumulate some pocket money, as I had arranged to undertake a trip to Ireland to visit family, 3 months later.

The trip from Durban aboard the Union Castle liners outbound on the Pendennis Castle and returning on the Pretoria Castle, visiting St Helena, Las Palmas, Madeira and Ascension Island was absolutely magic.

On my return nearly 4 months later, I was contacted by the Bank and invited/ordered to report for duty the next day. I have no idea to this day how they had found out I had returned or where to contact me. So began the journey of 55 years with the Bank.

I am often asked why I stayed with the same bank for so long. In truth, whereas I was headhunted and did occasionally consider other positions, the culture of the bank was one with which I identified, and I really enjoyed what I was doing. Not to mention the fringe benefits offered by the bank which were often hard to match elsewhere.

The opportunity for me to develop practical leadership skills came in the early 1970’s through membership of the Junior Chamber of Commerce (JAYCEE) serving on various Jaycee committees, undertaking projects involving leadership training and development opportunities for members. I am proud to say I even received a leadership award for one of the programmes I ran.

I achieved my CAIB (SA) through the Institute of Bankers (IOB) in 1982, and I was elected a fellow of the Institute in 1994. My management skills were sharpened on the Advanced Executive programme which I completed in 1993, through the University of South Africa’s School of Business Leadership.

The bank recognized my leadership and awarded me the Managing Director’s Award in 1989 for the good performance of Smal Street Branch, of which I was the branch manager. Some years later the Bank even created a special award for me entitled the “Lifetime Award”. Other awards include one from the Banking Adjudicator captioned “for service beyond the call of duty” as well as, more recently, the Debt Review Awards | ONE Significant Contribution to the Debt Review Industry Award.

Outside of the world of banking, I spent 22 years in the scouting movement through the various stages from Cub Scout to Senior Scout, passing the required badges to qualify for Springbok Scout status. Then it was on to Scoutmaster and eventually Area Commissioner, all of which enhanced my practical leadership training. In 1975 as a scout officer managing a troop of 40 boys, I travelled through Europe and Denmark with the South African Contingent of 300 boys and officers to the World Jamboree in Norway. There we met up with 18 000 scouts from 100 different countries.

On the topic of a balanced life, Colleen and I have been married for 42 years and our daughter Camilla holds a senior leadership position in the London office of a global Bank. Over the years we have enjoyed travel and have been fortunate in being able to enjoy beach holidays in Ibiza, Marbella ,Nice, Positano, Ischia, Capri plus broad travel through Europe, the USA, Taipei and of course the UK and Ireland. In South Africa, Umhlanga is our favoured spot. For 17 years I enjoyed my 1951 Riley (an old restored classic car for those who have never heard of a Riley) which we used on a few rallies and the 1966 MGB GT, although currently both have moved to new owners.

IN THOSE DAYS When I joined banking, it was designed to provide a lifelong career and so training in the various parts of the bank was imperative. Today, given the age of the specialist, this has changed. Back then it was usual to move through the various departments learning how each formed part of the overall bank products. I served in the various branches in the Durban area and posts included various clerking positions, being a teller, an officer in charge of an agency (mini Branch), savings bank, working with fixed deposits, foreign exchange, in the managers department, with budgetary control, ledgers, correspondence, in the billing department and writing up the Branch books.

In those days, there were no credit cards, home loans were financed by building societies (not the banks) and asset finance was provided by other finance houses. Personal loans were only just in their infancy and inflation was at very low levels of around 3 percent. It is fair to say banking looked quite different.

I have many stories and anecdotes like, how as a ‘junior’ I was restricted to writing in pencil and even back then being required to seek permission from your employer to marry. I remember the old banking hours of 9.00am until 2pm and early closing on Wednesdays and country branches closing for lunch. On Wednesday afternoons golf was popular with managers and staff often played soccer or hockey against other branches or banks. These were the “good old days” of banking.

How things have changed!

Over the years, I spent 15 years as a junior, 15 years as a manager and 25 years as a general manager, although titles changed over the years.

Given the need for a firm grounding back then, these time periods were not really considered excessive at all.

I do consider myself fortunate in having lived during “old school” Banking (before the introduction of computers, before electronic banking and apps). Back then, the fax machine was ‘new’ technology and we had calculators which were manually operated. This helped me a lot because it helped me (and others at the time) learn the fundamental workings of banking and this has helped me later quickly recognise when outcomes are not going to be reasonable.

THE 80s In 1985, after spending some years in the regional credit department, I was transferred to Johannesburg as the Advances manager for the West Rand cluster of branches. Thereafter I was appointed deputy manager of Johannesburg Branch, then Manager of Smal Street followed by Commercial /Area manager for a cluster of city branches.

THE 90s In 1993 I was appointed to General management in Credit Division. In those days, we looked after all credit, both retail and corporate, in South Africa the various countries in Africa where the bank was represented and Taipei, London had an indirect link. Â

INSTITUTES & COMMITTEES I have also been privileged serve on various industry boards including the Institute of Bankers (12 years) which included the last 2 as Chairman of the Council, the Joint Banks Credit Bureau (Pty) Ltd, Servcon Housing Solutions (Pty) Ltd a public private partnership with Government created to address the problem of low income housing in the early 1990’s, and Diners Club SA (Pty) Ltd (12 years). I had 2 terms on the management committee of the present day SACRRA, and of course my involvement with the National Credit Act starting in 2005 when the concept was mooted.

THE NATIONAL CREDIT ACT I recall the many meetings, notably those at the Reserve bank in Pretoria, where the local stakeholders met in the afternoon with the legislation drafter located in Canada.

The locals tired after a long day and the drafter perhaps not quite awake being early morning in that country. There are those who consider this to be the reason for the perceived difficulties with the early application of the Act... However, it should be borne in mind that the exercise to bring banking, with their various products, overdrafts, cards, home loans, vehicle finance, suretyships, letters of credit, guarantees by Bank etc. into the fold, with micro loans with store card lending, could never be an easy task. Add to that repealing the Usury Act and the exemption clause and creating a new Regulator to control credit, when the Banks already had a regulator…it was never going to be simple.

The Act had numerous drafts, around 15 in fact, and with no track changes and one had to really concentrate when considering a new draft.

I retained an interest through membership of Banking Association committees, engaged in the life of the National Debt Mediation Association (NDMA) and ultimately in the Credit Industry Forum (CIF), where we continued to look at ways and means to ensure problems and concerns were and are addressed.

BASA On my retirement from the Bank after 55 years I was contracted to BASA where I have enjoyed 2 years continuing to share my experiences with colleagues.

Coaching and mentoring where experiences over the years are shared, have been enriching experiences for me. I have also enjoyed the many hours of interaction with other Credit Providers, Payment Distribution Agents and especially Debt Counsellors where we often spent time considering unusual cases and how to overcome their challenges.

Since the introduction of the Act in 2007 many issues have been debated and changes effected and in my opinion the legislation can be considered world class - evidenced by many countries studying the NCA. It is not perfect and as the dynamics of the economy and population change so will the Act to meet the objectives of the Act. I consider that many consumers have benefitted greatly from its provisions and many more will do so in the future. I see the CIF as the ideal forum for all stakeholders to meet with the Regulator and together in the great spirit and focus of finding solutions to take the industry forward.

As stakeholders, we may not always agree, but participation and compromise is so important.

As I look back over the years, the many changes come to mind and I recognise that with the 4th industrial revolution, the rate of change will ever increase. Exciting times ahead which should be embraced with vigor.
