Get Down, Get Recognized, and Stay Informed B y J im Benjamin The coming of spring marks a time for renewal, and within the legal community there are a number of chances in the coming months to renew your commitment to involving yourself with your fellow professionals, whether it’s getting down for a good cause, giving back to the community, or keeping track of happenings at the legislature.

Barristers Benefit Ball—Down & Derby The pride of the Denver Bar Association is its operation of Metro Volunteer Lawyers.

MVL provides pro bono and low-cost civil legal representation to persons in need who are otherwise financially unable to obtain representation.

MVL is staffed with full-time employees and shares office space with Colorado Legal Services, but the organization is sustained largely by the funding of the DBA and neighboring bar associations — namely the Adams/Broomfield Bar Association, the Arapahoe County Bar Association, the Douglas/Elbert County Bar Association, and the First Judicial District Bar Association.

The source of the DBA funds is generated primarily from the proceeds of the Barristers Benefit Ball. Although the ball is an event that most attendees find to be such fun that they attend for that reason alone, it is imperative that it sells out to ensure necessary funding for MVL. Interest earned on COLTAF accounts used to be a major source of funding to MVL; however, with interest rates of less than one percent per annum, this source has literally dried up.

the number of clients in need of MVL’s services. The need for a complete sell-out exists now more than ever.

Taking place on May 4, the same day as the Kentucky Derby, the ball committee has come up with an exciting theme to take advantage of the excitement of the day: “Down & Derby.” Half the fun of attendance this year will be the preevent shopping for derby bonnets and regalia. The event itself will include mint juleps, horseracing games, and pictures in the Winner’s Circle.

This year also marks the 25th year of the ball, which is a significant achievement for any fundraising event. It has weathered the down economy and continues to be one of the most important legal social events of the year. You can read more about how the ball was started on page 13.

Admission to Down & Derby has been designed to accommodate all. Firms are encouraged to purchase a patron table, which will ensure the best seating for the event and recognition in the dinner program. Patron tables, which seat 10 and are available for $3,250, result in the greatest funding for MVL. For our YLD members, tickets are priced at $100, and student members can attend for $60.

Seating is assigned preferentially according to when tables and tickets are purchased, so make your reservations today. You can do so at cobar.org/bball.

Be Recognized for Your Commitment to Pro Bono Our Rules of Profe s s i o n C o n d u c t suggest attorneys commit themselves to performing 50 hours of pro bono legal services each year. Those who commit to and achieve this goal will receive thanks and recognition from the Colorado Supreme Court at a series of ceremonies throughout the state this spring. If in 2012 your firm or

group has met this goal, outlined in Rule 6.1, contact the Colorado Supreme Court

The 50-hour goal per Colorado -licensed attorney is averaged across the firm and prorated for part-time attorneys, a substantial majority of which (35 hours or more per attorney on the average) is for indigent persons and/or organizations that serve indigent persons. The balance of the 50 hours per attorney on the average may include other types of pro bono legal services mentioned in Rule 6.1. You can find out more about this great program led by the Colorado Supreme Court on page 23.

Serving on LPC, a View under the Dome For four months out of the year, one of the Colorado Bar Association’s hardest working committees is the Legislative Policy Committee. When the General Assembly is in session the LPC meets every Friday morning at seven — dark — thirty. The role of the LPC, in general, is to promote the interests of the membership regarding proposed statutory law. During an ordinary legislative session, the LPC will review all bills being introduced and will determine the CBA’s position on those that on some level apply to the membership.

This role may cover decisions on behalf of the association to sponsor, support, or oppose proposed bills, and the LPC also may offer its services to assist a legislator in crafting statutory provisions designed to meld with existing law.

Whether the LPC determines to support or oppose a particular bill, an implicit philosophy of the bar association is that it will provide whatever professional assistance possible to attempt to ensure a proposed bill will be as unobjectionable from the CBA’s perspective as possible or simply to attempt to create clear and

One such instance, in which I became deeply involved, arose a couple of years ago.

In Boulder, an owner of a vacant lot in a subdivision learned that the neighbor with an adjoining lot had, for more than two decades, been in open, notorious, and hostile possession of a portion of the owner’s vacant lot. The situation resulted in a civil action in which the neighbor’s ownership interest in the vacant lot, acquired by adverse possession, was quieted in the neighbor.

The story was carried in the local newspapers, on many talk radio shows, and even in the Los Angeles Times. The media labeled the incident the “Boulder Land Grab Case” and members of the legislature adopted the slogan, “If you steal a person’s car for 18 minutes you will spend 10 years behind bars. If you steal a person’s real estate for 18 years, you will be rewarded with title.”

The LPC has a relevant slogan of its own: “If more than one newspaper carries the story, there will be legislation.”

Word quickly leaked out that a majority had been obtained in both chambers of the legislature to pass legislation to totally abolish the doctrine of adverse possession. The doctrine, you may recall from law school, dates back more than five centuries and it continues to have necessary and beneficial purposes today.

When the “Dean of Real Estate Law,” Wil-

lis Carpenter, was asked if incidents of adverse possession might exist in urban Denver, his response was that in his estimation “not a single fence exists exactly on the actual boundary line of any lot in Denver.” After all, Denver was laid out using surveyors with lengths of chains for measurement and now GPS systems can be accurate to fractions of an inch.

The LPC, together with the Colorado Bar Association’s Real Estate Section, embarked on a project with two primary goals: to educate legislators carrying the bill on the beneficial aspects of adverse possession and to assist in drafting a piece of legislation that would respond to the particular concerns of the legislators sponsoring the bill, while permitting survival of components of adverse possession.

Although no steward devoted to protecting real estate law would be proud of drastically bastardizing the centuriesold doctrine, after hundreds of hours drafting and consulting with the sponsors, volunteers from the LPC and Real Estate Section crafted a bill that retained the doctrine and satisfied all of the complaints about adverse possession raised by legislators and their constituents. The legislative session is kicking into high gear and the LPC has already experienced a month of Friday morning meetings analyzing such matters as an

omnibus probate bill drafted by the CBA Trust and Estate Section, a bill drafted by the Juvenile Law Section, and the civil unions bill. Putting Dating on Your D cket

A

s another Valentine ’s Day approaches and I am without a date, I wonder, did my law degree somehow deflect Cupid’s arrow?

With billable hour requirements, working late in the evenings, and spending some weekends preparing for trial, who has time to focus on dating and meeting someone new?

A lthou g h I me e t many male counterparts in the legal field, our interactions do not always lend themselves to romance, particularly when a conversation starts with, “If you don’t get me those documents by Friday, I’m going to file a motion to compel.”

When I do have free time, I hardly want to spend it on a blind date. Nor, after spending an afternoon poring over online legal research, do I want to spend a bleary-eyed evening surfing online for eligible bachelors.

However, as another Valentine’s Day approaches and I am still single (Did I mention that?), I am vowing to put more

effort into dating in 2013. For those who may be likeminded, I have included some ideas for busy professionals to meet potential mates.

Online Dating According to an article published in the February 2012 edition of the Psychological Science in the Public Interest, online dating has lost its social stigma.

If you haven’t tried it, now may be the time. The benefit of online dating is that it allows users to immediately rule out those who may have unsuitable traits, such as smokers or ultramarathoners.

Match.com and eHarmony (eharmony.com) are the most advertised online dating ser vices. Match.com boasts a large and diverse user base.

The site also has started hosting singles events in Denver for people to meet in person while bowling, cooking, or sipping cocktails. eHarmony claims to be more focused on people looking for committed relationships. This online dating site requires users to complete an intensive

questionnaire before registering, and then the website will send potential matches to you based on commonality in your questionnaires.

Both Match.com and eHarmony charge a monthly fee. If you don’t want to pay for online dating services, there are plenty of free websites out there.

Friends have recommended OkCupid (okcupid.com) and PlentyofFish (pof. com).

When you do connect with a potential date through an online service, make sure to meet the person in a public place, and be selective with the personal information that you immediately share.

Whether you should identify your career as “lawyer” on your online profile — well, that is the subject of a whole separate article.

It’s Just Lunch It’s Just Lunch (itsjustlunchdenver. com) is a service that arranges casual dates over lunch, brunch, or drinks after work for busy professionals. It requires a fairly substantial registration fee up

front, but the organizers arrange the dates for you. It’s Just Lunch might be the way to go for those who want someone else to do the matchmaking.

Meetup.com If activities are more your style, another avenue of meeting people that enjoy similar pursuits is meetup.com.

This site connects people who enjoy similar hobbies and activities. If you are trying to find other singles that enjoy hiking fourteeners, tasting wine, or reviewing new books, meetup.com may be a site to check out.

Some groups are focused on singles connecting, while other groups are open to singles and couples who enjoy certain pastimes. Either route may be a good way to take part in an activity that you enjoy while meeting new people.

Singles Events We are fortunate to live in Denver, the city of never-ending sporting and social events. Some events in Denver are tailored just for us single folks. 5280 Magazine will host its annual “Single in the City” party on Feb. 15 at the Exdo Events Center. Tickets start at $35, but you can get a discount if you get yours at one of their retail locations. For more information, visit bit.ly/VIBjqe.

If you’re looking for a more unique event before Valentine’s Day, you may want to check out Yoga Speed Dating on Feb. 9 at the River, a new yoga studio in Denver located at 1212 Delaware St. This

event is for singles in their 30s and 40s and combines yoga stretching and speed dating. The cost is $30 in advance or $40 at the door. For more information, visit bit.ly/XJwIXK. Singles events go beyond February. For example, organizers of the Skirt Chaser 5K, a coed race where women start off the race and men follow to “give chase,” boast that it’s a great way to get some exercise and to meet other fit singles. The event is generally hosted in June (skirtsports.com/skirtchaser5k/ denver).

When you do score a date, consider leaving some of your “lawyering” skills at home. Don’t run a criminal background check on your date (or at least don’t admit to it). Don’t treat the date like it is a deposition. And, don’t try to end the date with a closing argument on why there should be a second one. The Opposite of Romance

Dating isn’t all champagne and chocolate-dipped strawberries, but at least those less-than-perfect dates make for a good story. Three Denver attorneys share with us some of their more memorable adventures in dating.

“When I was planning the evening, my date told me not to go to one restaurant because she and her friend were caught stealing silverware — because they didn’t want to buy any. From then on, I had to make sure I kept an accurate count of the place settings!” —John V. “I was dating a new guy and was excited to spend Valentine’s Day with him.

He made a reservation at a nice restaurant, and I thought everything was going well, until he pulled out his cellphone and started showing me pictures of his ex-girlfriend.”

—Kari D. “When I was in college, my boyfriend went to a school about three hours away.

After giving him a guilt trip about not being very romantic, he set up a nice candlelit dinner in his fraternity house. I got lost on the way there and was a few hours late. I want to say there was a snowstorm, but I think I just got very lost. This was before cellphones, so I could not give him updates.

When I arrived, his fraternity brothers were making fun of him and the dinner was cold.

To top it all off, my gift to him was a book titled, ‘How to be More Romantic.’”

We’ve all been there before.

Whether we are riding the light rail, walking down the 16th Street Mall, or eating at Sam’s No. 3, there are those times when we are compelled to share our innermost feelings, thoughts, and

experiences with complete strangers.

“It’s snowing!”

“I’m bored right now.”

“I wish there was a word to describe hanging by a thread.”

“Look at my breakfast; it is soooo good!”

Close your eyes and imagine a world where you could actually share these and other important musings for everyone to hear and appreciate. Imagine this world where these musing have to be shorter than 140 characters. Now open your eyes, because the future is now, my friends, thanks to the wonders of Twitter.

Twitter graced us with its presence beginning in the summer of 2006. What originally began as an opportunity for small groups to communicate with each other has become a worldwide phenomenon. One of the founders of Twitter, Jack Dorsey, provided the first tweet to the world encapsulating all that Twitter has to offer: “just setting up my twttr.”

Short, succinct, and informative — how else are we supposed to know what Jack Dorsey was doing on 12:50 p.m. on March 21, 2006?

Dorsey’s “twttr” eventually became known as Twitter. As he told the Los Angeles Times, “We came across the word ‘twitter,’ and it was just perfect. The definition was ‘a short burst of inconsequential information,’ and ‘chirps from birds.’ And that’s exactly what the product was.”

Finally, after thousands of years, the world had found a way to share inconsequential information.

Sharing information of no consequence might at first appear easy and accessible to all of us. But first you must understand some specialized vocabulary so you don’t appear to be a twewbie (Twitter newbie).

These are some of the basics:

@[username]: Say you were walking through Park Meadows and you see your friends Pip and Estella. Of course you want to get their attention. That is the purpose of @[username] — getting the attention of a specific individual or individuals. In our example you would tweet the following, “@pip @estella Hi! just walked by you in Park Meadows.” Pip and Estella would be specifically notified.

This is also called a “mention.”

Hashtag (#): The hashtag has two uses. First, it is a way to categorize your tweets, and second, it is a way to create a dramatic aside, à la William Shakespeare.

Suppose while at a local steakhouse you are served the most delicious slice of carrot cake. Quick, put down that fork, moments are fleeting and the time to tweet is now. “Eating yummy carrot cake #dinner #cantwaitforanotherslice.”

Follower: A follower in Twitter is someone who follows what you tweet.

Followers receive your tweets in their feeds along with all the others they follow. When using Twitter you will be both

a follower and be followed.

Fail Whale: I probably don’t need to tell you, but Twitter is very popular.

More-than-500-million-users-popular.

So popular, in fact, that sometimes the site crashes. When visiting Twitter at those times, instead of seeing tweets you will see an image of a happy cartoon whale being supported by a bunch of birds — possibly symbolizing the Sisyphean burden we all carry to report everything in real time.

Retweet: When you see a tweet that you want to share with others you retweet it. For example, while it is snowing outside @pip tweets, “FYI snowing outside #weather.” @havisham, upon seeing this informative tweet, retweets it to all of her followers: “RT @pip: FYI snowing outside #weather #donewithwinter.”

Notice the dramatic aside — helpful and informative.

Tweet: A tweet is a single message on Twitter and it also functions as a verb to describe the act of sending a message on Twitter, as in, “Excuse me, I must be tweeting.”

Now that you have a comprehensive understanding of the basic terms, the moment has arrived and you are ready to tweet. The first step is to go to twitter. com and create an account. As with all social situations, it is often best to get the lay of the land. You can do this by following people and retweeting.

To make it easier to find people to follow, Twitter has provided ways to identify your awaiting friends within the twitterverse (or Twitter universe).

You can look at the tab “Who to follow,” find friends, or even browse categories of tweeters by topics such as news, entertainment, funny, or fashion. There are even legal tweeters.

Following those that tweet legal news and commentary is one way to get value from Twitter as a lawyer. Other lawyers might appreciate the opportunity to connect on another level with other lawyers, individuals, corporations, or businesses within their industry.

ome years ago, I had just landed a new corporate client and was working from home. While on the phone with this client, my 3-yearold yelled from the bottom of the stairs, “Mom, where are you? I want to watch Barney. Where are you?!” I deftly proceeded to quickly carry on my conversation with my client for several more minutes from inside my bedroom closet.

It is difficult when these two aspects of your life — the demands of your work and clients and the demands of your family — intersect and, sometimes, collide.

I can’t help in these instances but think of the Beatles; you really do get by with a little help from your friends. With this notion in mind, several women lawyers established a dynamic new group for those women who practice law and are parents: Denver MAMA. MAMA , shorthand for Mother Attorneys Mentoring Association, offers a supportive environment for mothers who are lawyers or law students. Group members share experiences and ideas, problem solve, and give feedback on issues relevant to them in both of their roles. The network also shares information on employment opportunities and business referrals. In essence, Denver MAMA is devoted to furthering the

MAMA originated in Seattle in 2006, and has expanded to several cities across the country, including Austin, San Diego, Sacramento, and Philadelphia. With support from MAMA Seattle, founding members Jenifer Ross-Amato, Jennifer Madsen, Christy Anderson, Catherine Brown, Kristen Carney, Angela Hahn, Laura Martinez, Sue O'Brien, Amanda Upson, and Julie Warren launched the Denver chapter in spring 2012.

“I’ve had times when I thought, ‘I don’t know if I can be a lawyer and a mom — and still be happy.’ Denver MAMA is about supporting women who have made that choice to be both an attorney and a mom,” said Denver

MAMA co-founder Ross-Amato. “We’ve created this community where there are other mom attorneys available. Just by our existence, we let mom attorneys know they aren’t alone and that they are appreciated.”

Since the chapter’s launch, Denver MAMA has taken off, boasting more than 100 members whose backgrounds range in terms of experience, practice areas, age of children, and geography.

Women lawyers from across the spectrum of positions — full-time, part-time, contract, and non-practicing — are welcome to join. There are no membership dues and most events are free of charge.

The group hosts monthly coffee meetings and brown bag lunches in Denver that address topics such as satisfaction in your job, choosing the best school for your child, and nutrition for children, among others. Although the monthly lunches are hosted downtown, other events occur throughout the metro area.

T he best thing about Denver MAMA? Kids are welcome at all events and events are planned around mothers’ busy schedules. The group also hosts weekend events with kids — past events have included a hike, a picnic, museum visits, portrait-taking, community service, and martial arts.

Part of the impetus to launch the Denver MAMA chapter arose from a conversation between founding members Ross-Amato and Madsen about the need for more family-friendly networking opportunities for attorneys raising children, and this is an important piece of Denver MAMA’s mission. At the group’s kickoff event in September, I was in a room with more than 25 attorneys and holding a baby at the same time — definitely a first in my 12-year career. This was the kind of event I, and many others, had been looking for.

My daughter is now 11 and I no longer work from home, so I don’t have to worry about conducting anymore calls

from a closet. But, right now it’s also science project frenzy time, so I still face issues and worries that straddle my attention and devotion across the work and home fronts. he Barristers Benefit Ball has taken guests on journeys on the Orient Express, along the Nile, into the future, and back to the past — 25 memorable journeys to be exact.

The signature fundraising event for the Denver Bar Association’s Metro Volunteer Lawyers marks its silver anniversary on May 4. Lovingly referred to as the lawyers’ prom, the ball was created out of one member’s simple desire: to dance.

“I could never understand why there was never a dance that the bar had,” said Administrative Law Judge Tom DeMarino. “Nobody danced and I thought that would be a neat thing to do.”

DeMarino was set to become the

Thursday Night Bar when the ball was launched. “Sometimes I think that attorneys don’t really understand that they are really making that difference, so I think it’s important that we continue to support MVL and see that we can serve as many people as we can in our community who obviously need the assistance of an attorney and can’t afford one.”

As they worked on this first ball, there began to be some anxiety about ticket sales. It was just two weeks away, and although the event planner assured Casteel and DeMarino that this was the time that most people RSVP, they decided to take matters into their own hands.

“Tom, in all of his energy, said, boy, let’s knock on some doors, and I said, let’s do it,” Casteel said. “We took off over a couple weeks period and went up and down 17th Street, small and large firms — went in unannounced sometimes, met with some of managing partners, chairs, and friends we knew at those firms to try to get them to commit to buying patron tickets and we were surprised at the success we had.”

In the end, that inaugural ball on May 6, 1989, entertained nearly 500 attorneys and raised more than $40,000 for the Thursday Night Bar. “With the enthusiasm of Charles Casteel and the energy of Tom DeMarino, it was bound to be successful,” said

DBA’s first vice president in 1988, and while meeting with incoming president Charles Casteel and the Board of Trustees, he asked Casteel what his role was.

Casteel responded that he didn’t know but DeMarino should come up with something.

DeMarino did have an idea: a dance for the members.

“The initial idea was just to have something social to get our lawyers together that would aid in collegiality and the like, but as we sat around talking about this at board meetings and committee meetings, it also became apparent we could use this as a potential fundraising event,” Casteel said.

Though there is debate about who specifically suggested benefitting Thursday Night Bar, the predecessor of MVL, the decision was made to benefit the organization that so many metro area attorneys gave their time to and that advanced access to justice.

After the success of this first ball, it became an annual event. It’s one that’s evolved over time, but the essentials — great food, killer entertainment, and an excuse to get dressed up for a good cause — remain the same.

“It’s always nice seeing lawyers in a non-work environment, dressed up and ready to party,” said Sheila Gutterman, who chaired the ball committee in 1993 and 1994.

Gutterman was an event planner before she became an attorney, and she jumped at the opportunity to get involved with the ball.

“I had this experience so I immediately thought, Barristers Benefit Ball, this could be wonderful,” she said.

She also brought on her former event planning partner Faye Gardenswartz, who has remained the ball’s event planner since getting involved in 1993.

“The lawyers have never stopped going after the funds they need to keep the programs going, and we’ve never stopped trying to make it a memorable

party,” Gardenswartz said.

As the ball enters its 25th year, many of the original planners marvel at the fact that it’s continued to remain one of the most important events on the legal community calendar.

“It’s just so incredible to me that it’s continued that long and what’s very, very important to me is that people go to the Barristers Ball who really were not very connected to MVL or TNB initially, but because of the publicity around the ball and their involvement with the bar association, people come year after year after year and continue to support it,” Weitzenkorn said.

Collier Smith agreed.

“Having this kind of event sustain itself for even eight or nine years is unheard of. They just kind of wind themselves down and the support doesn’t continue. So now to have us having a celebration for 25 years and raising the kind of money we continue to raise each year is unheard of across the country,” she said. “We are incredibly fortunate that our members are supportive of the event, they are supportive of MVL, and it’s still a fun place to be.”

That success may come from the consistent energy of those who serve on

the ball planning committee.

“I think that the key to the success of it is that it changes every year. It changes with the personality of the [chair],” Gardenswartz said.

There have been hundreds of members who have worked over the past 25 years to ensure the ball comes off without a hitch and raises valuable funds for MVL. “When something lasts for 25 years and is still going strong, between year one and year 25 there have been some people who have put in a lot of effort, and to those people, I take my hat off and I salute them,” Casteel said.

And, it all started with one member’s desire to dance.

“It’s a wonderful institution because it’s the one time when all of the bar gets together for a giant social event and everyone has fun,” DeMarino said. “I was thrilled every year to just go out and dance.” D

As lawyers, we expect our listeners will glide past a worn-out ring of technicality when we say “employer and employee,” “payer and payee,” “grantor and grantee,” or “benefactor and ben-

eficiary.” It’s almost legally normal, but probably not really sociable, to rattle off “settler and settlee,” “donor and donee,” or “maker and makee.” You lose your audience when you utter “executor and executee,” “trustor and trustee,” or “devisor and devisee.” Minds cast off to imagine prisoners and eyeshades. Only the analytically brave or anti-romantic blurt out, “testator and testatee” (or is it “testee” — a client worn out from litigation and fees). An insurance “adjustor” argues money with claimants, and, we hope, they are not feeling like “adjustees.” When are “probationers” seen with “probatees,” and does recidivism make them “reprobate(e)s?”

Speaking about a “deportee” sings it clearly, thanks to Woody Guthrie. I suppose we are spared an Immigration and Customs Enforcement cop being dubbed a “deporter.” Sadly, the plight of “refugees” remains prevalent as we rally to seek peace and justice, harkening to stem acts of terror by terrorists (“refugors”).

A flabbergastor (perhaps in some instances he could be seen as one whose critical outpourings hit you as coming from a tyrannical arbiter?) may get named otherwise. I am not sure what you should be called when you are forced, as in the Flatlanders song, to “walk blind-folded backwards through the discombobulator.”

Legal drafters can resist mechanical compulsion. We can avoid “stipulator and stipulatee,” “ejector and ejectee,” or “remediator and remediatee.”

Managing Millennials

ne of the most frequent questions I receive from law firm leaders today is, “How should I manage this new generation?”

The Millennial Generation (born from 1981 to 2000) has been entering the workforce for more than a decade now. Baby Boomer and Generation X leaders are sometimes perplexed with this tech-savvy, multi-tasking, and ambitious group of professionals.

Who are the Millennials?

The Millennial Generation are said to be “trophy kids” raised by “helicopter parents.” Their parents—often Generation Xers who grew up as “latchkey kids” with two working parents or a single working parent—tend to compensate for their lack of available parents by becoming very involved in their child’s activities. Millennials are used to having a parent “helicopter” in to save the day, whether it is forgetting their lunch at school or, as I have heard, appearing alongside their child at their first job interview.

Afraid of communicating a negative self-image, parents of Millennials made sure that everyone was a winner in child-

hood competitions, so everyone gets a trophy in youth sports and activities.

This is the “E” generation—a generation with high expectations of themselves and their workplace; a generation that feels entitled to a wide range of benefits from society; and a generation that is highly enthusiastic about work and life.

For Millennials, work is not a place to go; rather, it is a thing to do (and something that can be done anywhere, from home to Starbucks to the office).

More than other generations, they will surf jobs to be open to new opportunities. In general, they have a distaste for menial work and red tape. While they crave feedback, they have difficulties with conflict and negative feedback.

“Paying your dues” is something your grandfather did at work and is not for them. One HR manager told me: “Some Millennials seem to want to fit their work around their personal life, and not the other way around.”

Despite these negative stereotypes, Milliennials have a lot to offer their employers. In school, they were subjected to years of group projects, resulting in better teamwork and collaboration skills than previous generations.

They are highly networked and skilled at using social and virtual media to

accomplish goals. They are optimistic about the future. They want to save the world and focus their altruism through volunteerism, pro bono work, and philanthropy.

Perhaps the most vexing characteristic of this generation to law firm leaders is their attitudes and behaviors at work. To some Baby Boomer and Gen X managers, Millennials have appeared unengaged with work, aloof, and entitled. These issues often arise around the issue of work–life balance. Millennials are perceived by Baby Boomer (who are sometimes seen as workaholics) and Gen Xer (who felt like they had to work hard to compete with Boomers) managers as wanting too much life balance and not enough work.

How to Manage Millennials The goal in managing Millennials is to help them find the balance they seek while getting work done (and done well).

Here are some tips on managing Millennials: 1. Be the leader. Have a clear vision of the future for your team. Clearly communicate expectations to every team member. Give very specific direction, especially for new team members.

Focus on encouraging positive behav-

ior and attitudes. Don’t forget your role as a mentor.

2. Give meaning to work. Demonstrate how work makes a difference to clients, the firm, and the community.

Communicate the why, not just the how. Find ways for your team to give back, including group volunteer or pro bono projects.

3. Give feedback. Develop a team culture where constructive feedback among all team members is the norm.

Don’t wait until the annual review to give feedback. Integrate feedback into your daily management routine.

4. Share power. Respect their ideas and contribution. Find ways to give them a say in decisions and access to management without abdicating your role as leader. Focus on participatory leadership without making it a democracy.

5. Provide a clear path for advancement.

Provide options to advance in the department. Illustrate a career path.

Promote from within as much as possible. Support learning opportunities, including LMA and industry conference participation. Open the doors for experiential and on-the-job training in other disciplines.

6. Reward and encourage. Understand what motivates each individual team member and find ways to reward her or his effort and results with personalized rewards. Focus on performance-based incentives such as time off, sports or concert tickets, additional training, or conference attendance. Reward performance publicly and with fairness. How you reward people should reflect the values of the team and firm.

7. Be flexible. Understand that how the world works is changing and be open to flexible work arrangements.

Focus on the quality and completion of projects, not location. Understanding that face-to-face time is important in many jobs, be clear with team members what is negotiable and what is not regarding work location.

8. Encourage team work. Millennials will naturally want to work in small groups. Communicate that it is OK to work in groups, with certain parameters, such as deadlines, work quality,

and accountability. Be clear with the limits you set. Find a conference room or other shared space reserved for team work. Track contribution to team work and give feedback to both under-contributors and over-contributors.

9. Create community. Millennials look to work as a social outlet. Find time and ways for team members to get to know each other on a personal level.

Bring back the monthly team lunches, go bowling or skiing together, take the team to happy hour to celebrate a team success. Have fun.

10. Leverage their strengths. Look to the Millennials on your team to tackle technology-oriented projects such as coaching lawyers on how to use LinkedIn or Twitter. Let them use their extensive network to build relationships with peers in client industry associations. Plug into their altruistic nature to lead firm volunteer and pro bono efforts.

For Millennials who want to succeed in a Boomer and Xer dominated work place, consider this advice: 1. Learn the language of success. Understand the “optics” of your behavior, including use of smartphones, how you dress, and when you arrive and leave work. Showing old-fashioned manners, listening carefully, and being grateful will earn points with Boomers.

2. Use your strengths. Find ways to leverage technology to do your job more effectively and efficiently. Be a leader in your f i r m a nd t h e community.

It is better to try and fail (and learn from your mistakes) than not to take any action at all. Communicate often and ask questions.

5. Realize that constructive feedback is a gift. Welcome feedback to improve

your performance and career options.

Don’t take it personally.

Whenever a new generation enters the workplace, a shift occurs. How people get work done changes. The entrance of this generation will be no different. How law firm leaders manage these enthusiastic, optimistic, and ambitious employees will determine whether their teams succeed. ColoradoSupremeCourtWould Like to Recognize Your Commitment to Pro Bono

Notify the Court by Feb. 15 The Colorado Supreme Court takes great pride in recognizing and listing on its website and in The Colorado Lawyer those firms, government, and in-house counsel groups that have committed to the Colorado Rule of Professional Conduct 6.1 goal of annually performing 50 hours of pro bono legal services per Colorado licensed attorney, primarily for indigent persons and/or organizations that serve the indigent.

In addition, the court formally recognizes firms and groups that have achieved the Rule 6.1 pro bono legal services goal during the previous calendar year by formally presenting them certificates of achievement during a special annual ceremony. The 50-hour goal per Coloradolicensed attorney is averaged across the firm and prorated for part-time attorneys, a substantial majority of which (35 hours or more per attorney on the average) is for indigent persons and/or organizations that serve indigent persons. The balance of the 50 hours per attorney on the average may include other types of pro bono legal services mentioned in Rule 6.1.

The court is preparing certificates of achievement to present to firms and groups that achieved the 50-hour per attorney goal in 2012. The certificates will be signed by each member of the court.

AFFAIRS GOOD THINGS Bennett S. Aisenberg was honored with the Colorado Bar Association’s Award of Merit on Jan. 11. The Award of Merit, Aisenberg the association’s highest honor, is given annually to a member for outstanding service to the association, the legal profession, the administration of justice, and the community.

Aisenberg, a sole practitioner, has been a litigation attorney in Denver for 54 years. Presently, he specializes in arbitration, mediation, and matters involving legal ethics.

He served as a president of the Colorado Trial Lawyers Association from 1984–85, president of the Denver Bar Association from 1991–92, and president of the Colorado Bar Association from 1998–99. In 2003, he received the DBA’s Award of Merit — that association’s highest honor. He also has been honored by the Sam Cary and Asian Pacific American Bar Associations.

Greenberg Traurig LLP participated in Mayor Michael B. Hancock’s Trade Mission to Mexico City on Dec. 6. Key business leaders joined the trade mission delegation, including Greenberg Traurig’s Denver office managing shareholder David G. IN MEMORIAM Christine Rothe Hoth, 59, of Denver, died Dec. 2, surrounded by family and friends. She was born Nov. 5, 1953, in Hoth North Island, San Diego, Calif., the daughter of Mary and Jack Rothe. She was one of four siblings, and the proud mother of three amazing children, Kevin, Greg, and Katy.

Hoth graduated with honors from Raymond College at the University of the Pacific, and was a Harlan Fiske Stone Scholar graduate from the Columbia University Law School. She was a member of the New York and Colorado Bars. Hoth was recently included in the MartindaleHubbell® Bar Register of Preeminent Women Lawyers 2011 for her practice in real estate law. She was a founding member of the Senn Visciano Canges law firm, where she actively practiced.

Although her professional achievements were exceptional, she is best remembered for her kindness, her wisdom, and her quintessential decency.

Friends and family gathered to honor her life and many accomplishments on Dec. 8 at Horan & McConaty Family Chapel. Her children ask that in their mom’s memory contributions in her honor can be made to the Prostate Cancer Foundation or the Novato United Methodist Church in Novato, Calif.

John Grund, beloved husband, father, grandfather, brother, and son, passed away suddenly on Christmas Eve. He Grund was 62. A Denver native, Grund grew up in Littleton, graduating from Littleton High School in 1968. He

attended Pomona College, earned his master’s degree from the University of Washington, and his law degree from the University of Colorado Law School, where he would find his true avocation and a stellar career in insurance defense litigation.

Grund founded and served as managing shareholder of Grund ∙ Dagner, P.C. Earlier in his career, he was a partner in the Denver firms of Tilly & Graves, P.C.; Montgomery, Green, Jarvis, Kolodny & Markusson, P.C.; and Grund & Breslau, P.C. He sat on the Colorado Supreme Court Committee on Civil Pattern Jury Instructions (since 1987) as an appointed member and chaired the subcommittee responsible for Product Liability, Professional Malpractice, and Insurance Bad Faith.

Well-respected and admired by his peers, Grund was the first recipient of the John W. Grund Excellence in Leadership Award, 2001; first recipient, President’s Professionalism Award, 2010; and DRI Service Award Recipient, 1999.

He is survived by his wife Kyle; three children, Brandon, Kelly, and Eric; grandson Liam; mother Molly Grund; and siblings Steve and Chery.
