THE LATEST: It’s only fitting that the memorial service Sunday for Maddie James will be on a bluff overlooking Dana Point Harbor and her favorite spot, the Ocean Institute. The memorial will be at 5 p.m. on Sunday, March 20 at Heritage Park, 34400 Old Golden Lantern Road in Dana Point.

The Institute was Maddie’s favorite place.

Maddie, diagnosed just three months ago with an inoperable, malignant brain tumor called DIPG (Deep Infiltrating Pontine Glioma), passed away Sunday. Her parents, Collie and Kajsa, were by her side.

“It is with great sadness that Kajsa and I have to inform you that our dear, sweet Maddie has passed away and is now an angel in Heaven. She died at 9 p.m. on Sunday evening, March 13, 2011. Kajsa sang her the night-night songs she has sung to her since birth and kissed her on the cheek, and Maddie took her last breath. We were right beside her,” said her father on the Caring Bridge website.

…Huge Penalties Against Pot Shop?

THE LATEST: The Beach Cities Collective and its owner, David Lambert, have to pay $2.4 million for illegally running a marijuana dispensary in town, according to City Attorney Patrick Munoz.

Judge William Monroe this week signed the city’s proposed order that Beach Cities Collective and Lambert each be fined $2,500 a day for every day the pot shop was open in the 26000 block of Calle Hermosa. The store was open 479 days. The judgment also includes other fines.

The city challenged that the collective was operating illegally in a residential neighborhood without proper permits.

WHAT’S NEXT: After the initial ruling that permanently shut down the collective, Lambert told the Dana Point Times he planned to appeal the decision.

…Safety at SONGS?

THE LATEST: Officials at San Onofre Nuclear Generating Station said this week the plant has multiple measures in place to keep it and the wider community safe, despite radiation leaks at the Fukushima Daiichi nuclear plant following the 8.9 earthquake and tsunami in Japan.

Chief Nuclear Officer Pete Dietrich said SONGS was built to withstand a 7.0 temblor and a peak ground speed of .67 gs.

While the size of the quake in Honshu was greater than SONGS’ Richter-scale rating, its secondary scale for ground speed ensures site structures would still stand because Japan’s quake generated only .35 gs, Dietrich said. Also, SONGS tsunami wall is 30 feet above sea level, where the super wave in Japan rose to 23 feet.

The plant would apply the lessons learned from the tragedy in Japan, he said.

WHAT’S NEXT: The San Clemente City Council asked Dietrich to take steps like creating a report in 60 to 90 days detailing the lessons of the Japan quake and holding a public forum to address resident concerns.

…Planning Commission Appointments?

THE LATEST: The City Council on Monday avoided a major change in direction for the Planning Commission by reappointing two sitting commissioners and one new resident to the panel.

With 15 applicants and three positions open on the five-member panel, the council could have changed the majority, but instead reappointed Liz Claus and Gary

Newkirk. Claus was universally endorsed, while Councilman Bill Brough voted against reappointing Newkirk.

The council was unanimous in adding Tarquin Preziosi to the panel. He is a deputy senior attorney for the city of Oceanside.

The appointments came after the council publicly interviewed the candidates. Commissioner Ed Conway, who chaired the panel, had notified the city he would not seek another appointment. April O’Connor and Norman Denton III are the other two commissioners.

WHAT’S NEXT: The Planning Commission meets the first and third Mondays of each month at 6 p.m. in the City Council Chambers.

…A New Chamber Exec?

THE LATEST: Laura Ouimet, acting as Executive Director of the Chamber of Commerce since Nichole Chambers left under a cloud, has officially been given the position.

“I’m excited to officially join the Chamber,” Ouimet said. “My goal is to help create a vibrant economic future for all our members and local businesses, as well as stimulate new memberships and positive partnerships throughout our community,” Ouimet added.

Kelly Straine who has worked as the Chamber’s Events Director since February 2008 and has continued to be a vital part of the Chamber staff was promoted to Assistant Director at the March 10 board meeting.

Council Prefers Cloverleaf at Pico and I-5

Beach Replenishment Planned

A larger clover-leaf plan at Avenida Pico for Interstate-5 expansion was the preferred design by the City Council.

The council voted 4-0 Tuesday to recommend the option to CalTrans and the Orange County Transportation Authority with Council Member Tim Brown casting the lone vote against.

While only a recommendation, a majority of the council decided against the smaller diamond option for the clover-leaf, which would call for the taking of four properties and affect a portion of three more.

Listening to residents’ concerns about noise, council members also recommended those planning the expansion look seriously at the ways to reduce sound, particularly with respect to sound barriers. Council members also asked that construction be sensitive to students at San Clemente High, called for a continuous carpool lane and asked safety be a top priority for a planned bike lane under the overpass.

The $275 million San Diego Freeway expansion is funded by Measure M2, Orange County’s half-cent transportation sales tax.

Once the project is approved, construction is scheduled to start in 2015 and finished by 2018.

The City Council voted Tuesday to support the U.S. Army Corps of Engineer’s recommendation to add more sand to city beaches.

The council voted 4-0 to approve the project with Councilman Bob Baker recusing himself because his property lies near the project.

Recommended by the corps, the Shoreline Feasibility Study would place about 251,000-cubic yards of sand from Linda Lane south to the T-street restroom.

While the city approved the plan, the actual work requires federal, state and local funding of $155.6 million as well as other approvals before starting. Assistant City Engineer Tom Bonigut said the earliest the project would begin is in fiscal year 2014. —SNG

Motel Fire Ruled Arson A one-alarm blaze Saturday night at the boarded-up Riviera Hotel has been ruled arson.

Captain Greg McKeown, spokesman for the Orange County Fire Authority, said the fire at 2723 South El Camino caused $26,000 in damage and required the help of 25 firefighters to snuff out.

He would not say more about the cause of the fire because he said it was still under

Three boys, between 8-10 years old, were caught shooting Airsoft pistols at tennis

The fire authority responded to the blaze around 11:45 p.m. Crews were able to stop forward progress relatively quickly, but stayed overnight as a precautionary measure.

McKeown said firefighters were concerned about the presence of wood siding, rubbish and debris in and around the hotel and its potential to reignite with smoldering embers.

A majority of the building was gutted by the fire, McKeown said. He could not comment on whether or not anyone had been in the building prior to the fire. —SNG SAN JUAN CAPISTRANO

Tribe’s Bid for Recognition Denied The Juaneno Band of Mission Indians’ 30year bid to gain federal recognition has been denied, the tribe announced Wednesday.

The decision from the federal Department of the Interior, Indian Affairs comes four years after a preliminary report ruled the San Juan Capistrano-based tribe could not prove members lineage back to a historical tribe and had remained a governed group since then.

Wednesday’s ruling indicates the tribe could not make progress in proving the same four areas: That external observes have continually identified the tribe since players on a court. The children were told to stop, and threatened by one of the fathers.

A caller reported that workers were using a concrete cutter on the south side of the street. He was worried that the water coming form the machine and going into

Capistrano to Consider In-N-Out The San Juan Capistrano City Council on Tuesday told staff to go ahead with planning an In-N-Out Burger drive-through on the former Sizzler location on Del Obispo Street.

Tuesday’s action does not greenlight a restaurant in that location, only directs staff to move forward with necessary studies and public meetings before the project is considered for approval. The Planning Commission can ultimately approve the project, unless that decision is appealed to the City Council.

In-N-Out Burger wants to build a 3,700square-foot fast-food restaurant on a 45,900square-foot parcel. Council members will decide if the location is appropriate for a drive-through establishment and whether to move forward with formal reviews by the city’s commissions.

The council approved the measure 4-1.

Only Councilwoman Laura Freese voted against the study, saying In-N-Out wouldn’t fit her vision for the downtown and would create more traffic. —JV the storm drain was toxic.

Red Cross First Aid, CPR Day Set for April 16 The Red Cross will be offering low-cost classes at its Super CPR Day April 16 at Angel Stadium. CPR and First Aid courses will each be available for $10 per person with advance registration or $15 at the door. Upon successful completion, students will receive

Adult and child CPR is a two-hour course on recognizing and responding to breathing and cardiac emergencies. Dana Hills High Student Honored for Philanthropy Kaitlyn Waterbury, 18, of Dana Hills High has been recognized with the Heart & Soul Award for February by O’Connor Mortuary. The award honors the unsung heroes of Orange County for their dedication to making a difference in our community. Kaitlyn has been awarded for her contributions to “Be the Change,” a high school club that raises funds for schools. She founded the group during her sophomore year. Please make sure that you take the necessary precautions to stay in compliance with water quality regulations and complete the project in accordance with applicable city building and safety regulations. Whether you hire a contractor or work on the house yourself, it is important to follow these simple tips while renovating, remodeling or improving your home.

PERMITS Before beginning any project, it is important to check with the city to see if permits are required for your specific project. You can call the city’s Building Department at 949.248.3564 or review the information on our website at: www.danapoint.org/building.

Remember, building permits are required for you, your family’s and your patrons’ protection to ensure that your project meets current building and safety standards.

WATER QUALITY REGULATIONS Materials such as concrete, stucco, paint, landscaping materials and soil may be used to improve your home, but can be harmful to our beach water quality if these materials are not managed properly. “Only rain in the storm drain” is our mantra and construction materials must be kept out of the streets, gutters and storm drains. All construction projects require Best Management Practices (BMPs) to avoid release of these materials into the storm drain system. BMPs are based on the activities that are being conducted. You can find more information on construction BMP requirements at www. danapoint.org/constructionbmps, but some are provided below: CONSTRUCTION BMPS • Schedule projects or work tasks for non-rainy weather if possible.

the street, gutter and storm drain.

• Cover materials so that rainfall, runoff or wind won’t carry materials from the project site to the street, storm drain or adjacent properties.

• Please ensure that your contractors are aware of and comply with the city’s water quality regulations, as you are responsible for their actions. We have handouts for them at our counter or on the web.

• Never hose materials or wash water into a street, gutter or storm drain.

• Minimize waste by ordering only the amount of materials needed to complete the job.

• Wash concrete mixers and equipment in a designated waterproof washout area where the residue can dry and later be disposed properly.

• Brushes and other tools should only be washed in sinks connected to a sanitary sewer.

• Dispose of water-based paint by removing the lid and letting it dry completely or take leftovers paints, including all oil-based paints, to the Household Hazardous Waste Collection Center. RECYCLE Many projects are subject to the city’s Construction and Demolition Waste Recycling Program that requires 75 percent of the construction and demolition waste generated by a project to be taken to a city-certified recycling facility instead of the landfill. using an absorbent material such as cat litter, then sweep it up and dispose of it in the trash.

Go.See.Do Mission Set to Celebrate Swallows’ Return The swallows returned to Capistrano long before there was a parade, and Mission San Juan Capistrano’s celebration marking the onset of spring and the return of the swallows is set for March 19. The celebration begins with the ringing of the historic bells followed by performances from Renee Bondi, Mission Parish School, Ballet Folklorico and Mariachi Capistrano. Visitors can go to the historic bell wall to hear Acjachemen Prayer songs from Tushmal Singers just before the day’s official noon bell ringing. The bells will be rung at 10 a.m., noon and 3 p.m. Award-winning and Native American teacher Jacque Nunez will carry out her engaging Native American story telling performance. Later, the Mission’s docents host “Are You Smarter than a California 4th Grader?” followed by dance performances by a Native American dance duo and La Sole Flamenco. The day also features a special afternoon lecture by Charles R. Brown, a professor of Biological Sciences at File photo the University of Tulsa, preeminent expert on swallows and their migration patterns. On Saturday, March 26 the Mission continues to recognize the meaning of the swallows to Capistrano by participating in the annual Swallows Day Parade festivities by offering mariachi music immediately following the parade. The Bureau has not Been Adjusted

ne of the biggest movie cult writers of the 20th century, Philip K. Dick’s stories have been given some of the best science fiction and fantasy film adaptations of the past three decades. He’s given audiences everything from Blade Runner (1982) and Total Recall (1990) to Minority Report (2002) and A Scanner Darkly (2006). Now, screenwriter George Nolfi of Timeline (2003) and The Sentinel (2006) makes his directorial ©Universal Pictures debut with a big-screen version of The Adjustment Bureau for Universal Pictures.

Matt Damon stars as a young, politician named David Norris who has been struggling to gain votes for New York senator because of his party reputation. While practicing a TV concession speech one day, he stumbles across an upand-coming dancer named Elise (Emily Blunt), and from then it’s love at first sight. Only David soon discovers that there is an underground team of people trying to keep them from staying together. They are called the “adjustment bureau” and subconsciously run how people live their lives. They can be recognized by wearing hats and suits. David and Elise cannot be in a relationship because it’s not a part of their life plans. In a case of logic versus true love, David and Elise choose love and try to outsmart the bureau.

With The Adjustment Bureau there is plenty of potential in concept and production, but poor execution. While visually attractive and impressive aesthetically, the feature suffers from safe and typical writing, miscasting of stars (Damon too old and Blunt out of place). nitially, the earthquake and ensuing devastation of the Japanese coast threatened the traditional course of the Festival of Whales, but then actually enhanced it as an educational opportunity and chance to marvel at the power of the sea.

The Festival of Whales, which concluded last weekend, drew tremendous crowds, organizers said, even though the Harbor had been briefly closed out of concern of a tsunami reaching the West Coast.

“The county and the city worked so hard to get the harbor reopened again, after the tragic events in Japan that closed it,” Festival organizer Penny Elia. “We were truly blessed to get to be on that beach, enjoying nature’s beauty and grandeur.

environment, but also respect for each other out on the water. A lot of education goes on at the festival; it’s a classroom out in the middle of nature.”

Elia credited all the volunteers who help make the festival possible.

“A big thank you for all of the volunteers,” she said. “All the people that make it happen, so that they can bring joy to other people.”

This year, she said Mike Killebrew, Dana Point’s Assistant City Manager, was a “BBQ Machine.”

Killebrew reports going through 375 pounds of tri-tip, 140 pounds of chicken, 800 hot dogs, 45 gallons of baked beans and 45 gallons of potato salad. The BBQ raised $10,000 for charities.

“Almost every city staffer was involved in putting this together, so I don’t want to stand out as the star,” Killebrew said. “Our goal is to get some more of the local not-for-profits involved. Not only do they bring resources, but they bring a great energy and sense of community.

The great thing about this year is that people from these not-for-profits would just show up to help. It was a great team effort.”

Fittingly, among the closing events was a presentation from Mayor Scott Schoeffel to Don Hansen. Hansen founded Dana Wharf Sportsfishing & Whale Watching in 1971, starting something that makes the Festival of Whales possible. DP Page 13

Spring’s Elite Dana Hills High School’s student athletes are primed to compete this spring season

he ides of March are finally upon us signifying the beginning of springtime. With this magical season now almost in full swing, it renders images of flora and fauna in bloom, longer days lingering with a bit more sunshine, inescapable allergies for some and an overall change in the weather that entices one to break free from the icy clutch of old man winter.

Dana Hills High School’s student athletes are also heating up for a season’s worth of competition in their respective sports. And often there’s plenty of change associated with this perennial process. New faces abound on varsity rosters while the familiar ones have stepped up their game considerably, some even playing out not only their final season as a Dolphin, but possibly their final season of competitive sports. As a fan, make a point to enjoy the bounty of sports that close out the school year because all the teams that represent the blue and white are striving to make their school and community proud.

BOYS AND GIRLS TRACK AND FIELD // What else can be said about Dana Hills’ track and field team at both levels that hasn’t already been said before? Constantly humbling its opponents with its unrelenting speed, power and conditioning, it’s a good bet Dana Hills will look to send many of its finest athletes to CIF and state when the regular season ends.

Both levels enter 2011 with the target on their backs.

Last season, the boys team won the South Coast League outright sporting a perfect record. Leading the charge for the boys this season include senior Devin Harrison, who put up a county record 24-1 in the long jump in 2010, tying him for the second-best mark in county history. Harrison also finished with the third- and fourth-best times in Orange County in both the 200 and 400 last season. Others to watch also include Nick Ahrold (senior), Ricardo Campuzano (senior), Dylan Gourd (senior), Connor Kaddatz (senior) and Cody Meddaugh (senior).

SOFTBALL // Looking to climb the ladder in the South Coast League and finish better than last season’s third place finish (5-4 record), the Lady Dolphins (1-4) now have head coach Margo Melendrez back at the helm.

Melendrez replaces last season’s head coach Mitch La Riva, and also oversees a roster that’s laden with return talent. Though the Lady Dolphins lost four key players from last year’s squad to graduation, count on this team to build a foundation for success as the weeks roll by. Seniors such as Jordyn Larkins (CF), Kaylee Uddberg (RF), Kelsi Ott (P), Lindsey Bitowft (3B/OF/P), Sandra Bitowft (C/ OF/2B) and Jenny Hurst (3B/2B) are all crucial to Dana Hills’ efforts in 2011. However, the girls have had a tough start to the season losing games to Esperanza, El Toro and Huntington Beach. Baseball // The Dolphins (3-2) return in 2011 with plenty of firepower at the plate, in the field and on the mound in hopes of recapturing all the glory and magic that led the team to the CIF Finals last season. Despite losing to Mater Dei in the championship game, and finishing in fourth place in league with a 7-8 record, this team knows what it takes to stay confident during the grind of games that comprise the regular season, and will also

rely on its bevy of senior talent to spur on the wins when South Coast League play rolls around. Senior players like Nick Carter (P), Peter Maris (SS, .375 BA last season), Mark Wilson (3B/2B, .309 BA), Steven Connell (P/OF, .32 ERA last season), Nick Redding (3B, .217 BA), Eric Hsieh (P/1B, 2.89 ERA), Trevor Scott (P/OF, 4.94 ERA, .341 BA, 28 RBI), Nick Stavert (P), Brian Choi (C, .209 BA, 3 HR, 20 RBI), Kenny Murphy (UT, .200 BA) and Collin Gallagher (UT) will all be instrumental components in an effort to repeat last season’s successful run, and all return to begin where they once left off.

Dana Hills fared well at the Loara Tournament earlier this month beating the likes of Santa Margarita, Loara and Los Alamitos. The team then faced Woodbridge for a double-header on March 16 before traveling to take on rival San Clemente in its first league game of the season on Friday, March 18.

Boys Lacrosse // Still finding its way as a program in the formidable environment of the South Coast League, the Dolphins have a lot of work to put in if the team hopes to contend with perennial powerhouses like San Clemente and Tesoro. Dana Hills tied for third place last year with a 3-7 record in league. So far the Dolphins have proven their stock’s on the rise, crushing Laguna Hills 16-3 on March 3 before edging past San Juan Hills on the road by the final score of 11-8 on March 10. But the Dolphins (1-3) need to win the tight ones especially when the boys have home field advantage. A recent 9-7 loss to Pacific Palisades at home on March 12 should offer the team something to think about, especially as league play begins. Dana Hills faced South Coast League rival Tesoro at home on March 15, before heading off to face Mission Viejo on the road Friday, March 18. Boys and Girls Swimming // Dana Hills’ boys swim team has started off strong going 3-0-1 overall and 1-0 in the Sea View League. The Dolphins cruised past El Toro 154-132 on March 1, handled Millikan 98-72 on March 4 and then had no trouble dispatching Laguna Hills 111-58 on Tuesday, March 15.

Meanwhile, the girls swim team is looking to stay consistent after opening the season with a 177-108 loss to El Toro before getting back on track with a 91-79 win against Millikan on March 4.

Boys Golf // The Dolphins (1-0 South Coast League, 5-3) are looking good so far, having teed off in 2011 by beating Newport Harbor, Capo Valley, Palm Desert, Fallbrook and even rival San Clemente. Leading the charge both through the fairway and on the greens are players like Kevin Jackman, Riley Murphy and Slater Shaw. All three sticks have medaled at least once in their previous rounds.

SPORTS & OUTDOORS team lost in the first round of the post-season in 2010, key return players like Trevor Dell (senior, No.1 singles), Matt Labarre (sophomore, No. 2 singles), Shu Funato (junior, No. 1 doubles) and Chris Bloom (senior, No. 1 doubles) are definitely what Dana Hills needs to stay ahead of the pack. Top newcomer to the team this season is Chase Masciorini (freshman, No. 3 singles). “I’m mostly looking forward to another fun year with this group and trying to win South Coast League again,” Green said. However, there is a lot of youth on this year’s squad that has shown its age early, as the Dolphins have lost matches to Northwood, Woodbridge and Palos Verdes so far. But it’s still early in the process and the team is finding ways to win—this was especially evident in Dana Hills’ recent 10-8 scrap over Laguna Beach.

The Dolphins went on to face Marina on March 16 and Aliso Niguel on Thursday, March 17 before hosting the Dana Hills Coastal Classic at the Laguna Niguel Racquet Club March 18–19.

Boys Tennis // Dana Hills is always at the forefront of success throughout the county and the state. Last year the Dolphins won the South Coast League title yet again under the guidance of first year head coach Justin Green. Sporting a perfect 10-0 record in league and a 14-2 overall record in 2010, the pieces are still in place for Dana Hills to continue its dominance on the court. Though the

After tying for first place in the South Coast League last season with San Clemente and Tesoro, Dana Hills will continue to be a force with head coach Oz Simmons entering his 29th year at the helm. A second round loss to Huntington Beach in the CIF playoffs last year left Dana Hills with plenty to think about in the off-season. And despite returning only one starter to the court in Riley Murphy (senior, setter), the Dolphins are looking toward younger players like Karch Smith (junior, setter), Cory Swartzbaugh (junior, hitter) and Bryce Yould (sophomore, middle blocker) to help facilitate the offense and work open space for big points.

Despite opening the season with a 3-1 loss to Servite earlier this month, and then losing 3-2 to Laguna Beach on March 11, the Dolphins (3-2) have rattled off wins against the likes of Los Alamitos, Los Amigos and Claremont. After taking on JSerra on the road on March 16, Dana Hills went on to face a bevy of the best teams in the area at the annual Orange County Tournament March 18-19.
