Eyes on November Farms briefed in Federal Dairy Issues Forum By Cassie Olson

ONALASKA, Wis. – Amongst conversations regarding the 2016 presidential elections, agriculture is rising to the top of federal legislation discussion. Dairy farmers and business professionals gathered to discuss a variety of topics that will impact farmers following the general election during the 2016 Federal Dairy Issues Forum on Aug. 4 at the Stony Creek Hotel and Conference Center in Onalaska, Wis. Included in the discussion were the issues of immigration reform, the Margin Protection Program (MPP) and the development of the Trans-Pacic Partnership (TPP). The forum began by looking at the current state of immigration reform with Kelly M. Fortier, a partner in the Labor and Employment Relations Practice Group at Michael Best and Fredrich LLP in Milwaukee. Fortier said the immigrant removals are at an all-time high with a much heavier penalty for employer violations. “The Obama administration has deported more immigrants than any other U.S. administration, deporting more than 2.5 million people – a 23 percent increase from the George W. Bush era,” Fortier said. “As of Aug. 1, there are signicantly higher nes for employers violating immigration rules, as well.” Employers with I-9 paperwork violations for immigrant workers can expect to see up to a $2,156 ne per infraction, up from $1,100 prior to the increase. Additionally, knowingly employing an unauthorized worker could result in $4,313 in nes for rst time offenders and up to a $21,563 ne for repeat offenders. Now more than ever, Fortier recommends keeping a careful eye and taking second glances at I-9 forms for any farmer who may hire immigrant workers. “Fines can add up fast; now is the time to nd, review and correct your I-9 forms before it comes back to haunt you,” Fortier said. Fortier went on to explain President Obama’s executive order on immigration, which was announced on Nov. 20, 2014. Article II of the Constitution grants executive power to the President. Every President has issued executive orders since 1789, totaling over 13,000 issued orders. In regards to immigration, President Obama’s executive order includes a series of memos and guidance documents for federal agencies including United States Citizenship and Immigration Services (USCIS), U.S. Immigration and Customs Enforcement (ICE) and the United States Depart-

ment of Labor. The order also includes an expansion of the Deferred Action for Childhood Arrivals (DACA) program and H-4 spouse work authorization. The DACA program provides relief from deportation and the ability for immigrant workers to obtain employment authorization documentation. Additionally, DACA also pertains to migrant workers who are parents of children born in the United States who have been permanent residents and continuously present in the United States since January 2014. The executive order expanded to DACA program to lessen the age and entry date eligibility requirements. “This executive action is relevant to dairy as it provides an expansion of lawful workforce and the legalization of the current work force,” Fortier said. “It is estimated that ve million individuals could gain access to work permits and social security cards through DACA.” Despite this fact, the United States was sued by 26 states challenging the deferred action expansion as an unconstitutional exercise of power. The Supreme Court heard oral arguments this past April and issued a nal decision in June. The decision resulted in a 4:4 split, which means the program currently remains frozen while it is active in lower courts. “Talk with your federal and state legislators about your thoughts on immigration,” Fortier said. “Discuss possible state resolutions that could ease worker shortages.” Following immigration reform, the topic of the status of the MPP was presented by Professor Emeritus at University of Wisconsin-Madison, Bob Cropp. Cropp said there was a considerable change between the 2015 and 2016 premium signups. “Producers didn’t see the payout they had expected,” Cropp said. “Since producers who signed up for MPP are obligated to pay the $100 annual fee, those who bought up to $6 and $6.50 in 2015 dropped signicantly in 2014 and switched to the $4 free margin.” David Ward, Director of Government Relations and Dairy at Cooperative Network, added that the MPP’s payout was drastically lower than what was collected. “[Margin Protection] paid out less than 10 percent of what was collected by [the Farm Service Agency] in premiums,” Ward said. “Part of the problem was derived from how feed costs were calculated.” The Feed Cost Formula included in the 2014 Farm Bill created a generalized formula for calculating feed cost and margins. Ward said it failed to consider regional challenges, the cost of raising versus buying feed or the cost of organic feed protection, which all have a considerable effect on an individual’s margin. Now, I mostly x things that need xing, do a lot of maintenance work around the dairy and run machinery,” Trustheim said. “But, what I do on any given day changes. It all depends on what needs to get done.” That new responsibility came after time learning the ropes. “I had to be open to learn new things because I never knew when I was going to be asked to do something I had never done before and could be asked to do it again,” Trustheim said. “I had to catch on quick.” Jennissen saw that trait in Trustheim, as well. “He listens and observes closely and then does it in a way that closely represents the way we want it done,” Jennissen said. Although most of his current responsibilities have him working in other areas of the farm, he still helps milk on occasion. “I usually milk during the school year and ll in when other employees are gone,” Trustheim said. “It’s the best part.” He also had the opportunity to work more hours this year. “I had work release, which allowed me to leave school two hours early,” Trustheim said. “I got ve to six more hours in after school during the week. I was working 40 hours a week on the farm plus going to school.” For most high school seniors working that many hours can be overwhelming, but not for Trustheim. “I can’t stand not being busy,” he said. “I have more fun moving around. Doing the work on the farm makes me feel like I actually did something.” During the summer, Trustheim usually arrives at the Jennissens’ at 7 a.m. and works until 5 or 6 p.m. But when they are making hay, he starts at 4:45 a.m. and nishes at 10 p.m. “It all depends on what’s going on,” Trustheim said. After three years of working at the Jennissens’ farm, Trustheim was able to show one of their cows for the rst time at the Stearns County Fair Open Dairy Show. “That was the rst time I had ever

shown a cow,” Trustheim said. “Jerry told me they weren’t going to show Jackpot unless I took her. So, I did.” Trustheim practiced leading Jackpot with Jennissen in between chores. “He told me to hold her head up and make sure her legs were placed right underneath her,” Trustheim said. That practice and advice paid off when Jackpot was named reserve grand champion of the show. “It was pretty fun,” Trustheim said. “I wasn’t too nervous going in. She helped me out a little by behaving so well.” With his freshman year at North Dakota State University majoring in ag engineering mere weeks away, Trustheim will have to adjust to not being on the farm everyday. “I’m hoping to come back and help on the weekends,” Trustheim said. “It all depends on what I have for classes.” Looking ahead, Trustheim knows his time working on Jennissen’s dairy farm has lead him down the road to a career in agriculture. “I would love to work for an ag machine company or a robotic milking unit company,” Trustheim said But he also said the option of dairy farming is still on the table. “Jerry offered to go into partnership with me and have me eventually take over the farm,” Trustheim said. “It’s denitely up there in possibilities. I’m denitely thinking about it.” Offering Trustheim that opportunity is something Jennissen took seriously. “He doesn’t just do things to get it done, but he also looks ahead and see ways to improve our business,” Jennissen said. “He can also do almost anything on the farm. It’s not easy to nd someone to replace yourself, but for me, Austin could be a candidate. If it’s what he wants to do, he could do it. We’re going to miss him while he’s at school.” Seeing the potential for the future, Trustheim has been grateful for the three plus years working at Jer-Lindy Farms. “Jerry gave me a chance when he didn’t have to,” Trustheim said. “He’s kind of like another father to me and I’m grateful for everything he’s taught me. Now I know that a career in agriculture is the way for me to go.”
