COW PALACE MELIUS FARMS COMPLETE DISPERSAL TERMS AND CONDITIONS OF SALE Thursday, October 20, 2016 Terms: The terms of the sale are cash. All payments must be made to the clerk of the sale immediately after the close of the sale. No release of animals will be given until satisfactory settlement has been made with the clerk of the sale. Compliance with the above terms of payment on the part of the buyer will then entitle them to the guarantees offered and listed below.

Pregnancies 45 days and under are the findings of the veterinarian, but no guarantee is expressed or implied. Bids: The highest bidder shall be the buyer. In case of dispute, the animal may again be put up for advance bids, and if there be no advance bid, the animal shall be sold to the person from whom the auctioneer on the stand accepted the last bid.

Shipping: Assistance will be given in shipping the animals after the sale. All costs, risks, and responsibility will be borne by the purchaser. Transportation charges on animals subject to adjustment will be the responsibility of the purchaser.

Risk: All animals are the purchaser's risk as soon as struck off. Animals are at the seller's risk prior to selling in the event of fire or any eventuality.

Errors: The material in this catalog has been carefully edited. If any errors or omissions are discovered, they will be announced, such announcements to take precedence over the matter of print in this catalog. Neither the editors of the catalog, the sales management, nor the seller can assume any responsibility for any errors or omissions in the catalog.

Warranties: The seller warrants clear title the animals and right to sell the same. Health: Cattle have been vaccinated with 9-way vaccine. It is strongly recommended a 9-way booster be given approximately two weeks after the date of sale, unless otherwise announced. Out of state buyers must have cattle tested, where applicable, at buyer's expense and risk. Every precaution will be taken to represent the physical condition of each animal exactly as it is known. Announcements regarding health status or other conditions made on individual animals will be noted; no adjustments or returns will be allowed on these animals. No guarantee is made concerning freedom from hardware, disease, mastitis, BVD or any other condition unless so announced at the time of sale. Responsibility: The seller will represent and be responsible for their animals. Seller's responsibility and warranties will cease when the animal is resold. Accidents: The auctioneer, sales management, and the owner will in no way be responsible for the behavior of the animals and disclaim any liability in the event of personal accident or property loss. Johnne's Disclaimer: There is no warranty, expressed or implied, that animals being sold within this sale are uninfected with paratuberculosis (Johnne's Disease). All cattle are considered Maximum Risk from Untested Herds. This is buyer's written notice as required by Wisconsin Statute.

Breeding: All females, either open or bred, are breeders to the best of the seller's knowledge and belief. However, no breeding warranty is given or implied. There is no warranty or guarantee with regards to embryo transfer results on animals sold within this sale.
