Port Authorities signs declaration on Disruption, Digitalisation and Decarbonisation ANTWERP/SINGAPORE: The 19 port authorities from Africa, Asia, Europe, Middle East, and the US, signed a declaration on their collective response to disruption, digitalisation, and decarbonisation at the 6th Port Authorities Roundtable (PAR). Hosted by the Antwerp Port Authority, this virtual event was held on 22 and 23 June 2021. With this year’s PAR theme being “Ports as Levers for Change”, participants discussed issues of disruption, digitalisation, and decarbonisation facing the maritime industry, and how port authorities should remain agile, adaptable, and innovative in response to the challenges. The Maritime and Port Authority of Singapore (MPA) called on PAR members to strengthen collaboration on safe crew change, cyber resilience and response, as well as decarbonisation of the maritime sector. The declaration recognised work by the Singapore Shipping Tripartite Alliance Resilience (SG-STAR) Fund, the first global tripartite initiative established in 2020 on safe crew changes, through the CrewSafe audit programme to bring a higher level of confidence and quality control checks into crew change processes. The declaration also reflected PAR members’ agreement to consider joining the Port

Authorities CIO Cybersecurity Network (PACC-Net), established by MPA, to foster collaboration on maritime cybersecurity as a global network to facilitate early sharing of cyber threat information and enable timely responses to such threats. Port authorities also agreed to consider collaborating with MPA and like-minded stakeholders on maritime decarbonisation solutions through the maritime decarbonisation centre to be set up in Singapore, as well as overseas decarbonisation centres. MPA’s Chief Executive Ms Quah Ley Hoon said, “The COVID-19 pandemic has accelerated the pace of digitalisation and ports have adapted to quickly harness technology for contactless operations. The plight of seafarers amidst tightened border restrictions also has implications on global trade and their health and safety. The PAR is an important platform for port authorities to come together to leverage each other’s experience and expertise to tackle these challenges. Today’s declaration is an important step for ward to push forth with digitalisation and decarbonisation solutions in the face of disruption.” MPA first initiated PAR in 2015 to facilitate the exchange of ideas and to share best practices amongst leading ports.

Gujarat Maritime Cluster aims to develop APSEZ expecting to handle 500 MT a Marine Insurance Ecosystem in Gujarat throughput by 2025 GANDHINAGAR: Gujarat Maritime Cluster had organized a webinar on June 25, 2021, as a part of its Gujarat Maritime Cluster webinar series, to discuss about the prospects of setting up an ecosystem of marine insurers and reinsurers within the Gujarat Maritime Cluster coming up at GIFT City. The webinar was addresses by distinguished speakers Shri Anil Devli, CEO, Indian National Shipowners' Association (INSA), and Capt. Savraj Mehta, Chief Commercial Ofcer, North Group, The North of England P&I Association Ltd. Cont’d. Pg. 4

AHMEDABAD: In a bid to become the preferred logistics partner, Adani Ports and Special Economic Zone (APSEZ) plans to continue expanding its port cargo along with focus on logistical ser vices to grow the proportion ofits revenue stream. In its annual report for FY21, the company said it at present, enjoys a 25 percent market share of India’s exportimport cargo. “We intend to retain this position by achieving 500 million tonne cargo throughput by 2025 and will lead to enhancing our market share of the Indian market to Cont’d. Pg. 4 40 percent,” said the company.

Gujarat Maritime Cluster aims to develop a Marine Insurance Ecosystem in Gujarat Cont’d. from Pg. 3 The development of Gujarat Maritime Cluster by Gujarat Maritime Board, through its subsidiary company Gujarat Ports Infrastructure and Development Co. Ltd (GPIDCL), is envisaged with the impressive presence of the leading ship owners, ship operators & charterers, ship managers, port operators, maritime consultants, ship recyclers, clearing & forwarding Agents, key regulatory bodies, etc. Sensing the gap between demand and supply of certain key maritime support services, the Gujarat Maritime Cluster is also focussing on creating a sound base of specialised service providers engaged in the field of Marine Insurance, Marine Law, Ship Finance, etc. Presently, only ~8% of the India’s seaborne trade is being carried out by the Indian fleet, with the remainder of the trade being handled by the foreign vessels. The growth of Indian Tonnage will be instrumental for country to emerge as a marine insurance hub. Gujarat Maritime Cluster intends to address the regulatory & taxation disparities between India and other leading maritime centres, enabling creation of a level playing field for nation’s maritime & shipping businesses. The inclusion of ship leasing as a permissible activity in IFSC as well as Gujarat Maritime Cluster’s current attempts to rescind the payment of ‘withholding tax’ on payment of charter hire for the cluster members, could pave a new chapter in bringing the ship operating & chartering services, and subsequently ship owning and management, from overseas maritime hubs to India. “With the growth of trade and tonnage envisaged in India, it is imperative that our country not only has marine insurance / reinsurance capacity for its own increasing needs, but also be able to provide this service to other countries to gradually become a frontrunner in this domain”, said Mr. Anil Devli, CEO, INSA. “It is fitting that Gujarat – the frontrunner maritime state

in the country, takes a lead in filling the void in marine insurance ecosystem in our country. There is a strong merit in setting up the marine insurance ecosystem within the Gujarat Maritime Cluster (a strategic initiative by the maritime brand of India, Gujarat Maritime Board) in GIFT IFSC, by imbibing best practices from the leading maritime centres”, added Mr. Devli. The liberalised regulatory regime provided by the International Financial Services Centre Authority (IFSCA) – with special carve out for IRDAI, shall facilitate Ease of Doing Business as well as competitive infrastructure for the marine insurers / re-insurers intended in the Gujarat Maritime Cluster, in addition to the various fiscal incentives in the form of exemptions and concessions (entailed with IFSC business platform at GIFT City). “India will need to focus on the infrastructure requirements in terms of reinsurance arrangements, customer service, support teams, regulatory compliances, diversified portfolio (in terms of ownership & types of ships), knowledge database and expertise (including claim settlement on international timescales) to build its reinsurance capacity ”, said Capt. Savraj Mehta, Chief Commercial Ofcer, North Group, The North of England P&I Association Ltd. “Subsequently, India will need to build a roadmap to develop capacity for free reserves for P&I Insurance”, added Capt. Mehta. The webinar witnessed participation from over 100 prominent players of the maritime and insurance fraternity as well as from the wider industrial base in India and abroad.

APSEZ expecting to handle 500 MT throughput by 2025 Cont’d. from Pg. 3 In FY21, APSEZ handled a cargo volume of 247 million tonne, a growth of 11 percent from last year, as against a 5 percent decline registered by all India ports. With a clear focus to take the company’s return on capital employed (ROCE) to over 20 percent by 2025, as per the annual report, the Gautam Adani-led company reported an ROCE of 12 percent in FY21. “Our maturing ports and newly acquired ports are growing in tandem as twin growth engines in enhancing free cash generation,” said the company. The Dhamra and Kattupalli ports, acquired in 2015 and 2018 respectively, have turned around with positive returns on investments, the company said. During the year, the company announced four acquisitions — Krishnapatnam Port, Gangavaram Port, Dighi Ports and Sarguja Rail Corridor Pvt. Ltd (SRCPL) — thus improving East Coast – West Coast parity. It also announced the setting up of a container terminal at Colombo port in partnership with John Keells and SLPA. The company in 2019 also announced setting up of container terminal in Myanmar but due to military coup and subsequent violence is monitoring the evolving situation, which has created uncertainties and plans to abandon the project and write down project investments in full if country is classified under Office of Foreign Asset Control (OFAC) taking into account shareholder opinion . In the logistics business, the company scaled up and diversified its railway rolling stock business taking advantage of changes in the General-Purpose Wagon Investment Scheme (GPWIS) of Indian Railways. This allowed the company to add contracts to operate 16 new rakes for raw material transportation from the mines, which earlier allowed serving customers just from ports. “We set our sights to build 30 million square feet warehousing capacity during this period and has announced strategic partnership with e-commerce player Flipkart,” said the annual report.

Hapag-Lloyd orders another 6 Ultra Large Container vessels of 23,500+ TEU Ships to have dual-fuel engines that can use liquefied natural gas (LNG), Deliveries to begin in 2024, Green financing in line with the Green Loan Principles of the Loan Market Association HAMBURG: Hapag-Lloyd has commissioned the South Korean shipyard Daewoo Shipbuilding & Marine Engineering to build six ships, each with a capacity of over 23,500 TEU. The container liner shipping company had already placed an order for six ships of the same size at the end of 2020. Thus, the fleet will be expanded by a dozen 23,500+ TEU ships in total. The large container ships will be outfitted with a state-ofthe-art high-pressure dual-fuel engine that will be extremely fuel-efficient. Their engine will operate on LNG, but the vessels will also have sufficient tank capacity to operate on conventional fuel as an alternative. Hapag-Lloyd is focusing on liquefied natural gas as a medium-term solution, as it reduces CO2 emissions by around 15 to 25 percent and emissions of sulphur dioxide and particulate matter by more than 90 percent. Fossil LNG is currently the most promising fuel on the path towards zero emissions. The medium-term goal is to have ships that operate in a climate-neutral way using synthetic natural gas (SNG). The six additional ships have been financed via a syndicated green loan in the amount of USD 852 million that has a maturity of 12 years from the date of delivery. The transaction was concluded in accordance with the Green Loan Principles of the Loan Market Association (LMA) while also being verified by an independent expert in

the form of a secondary party opinion of the DNV. The credit facility is being backed by the Korea Trade Insurance Corporation (K-SURE), and the syndicate consists of 10 banks. “With this investment in the additional newbuildings, we want to take another step in the ongoing modernisation of our fleet – in terms of both ship size and sustainability,” says Rolf Habben Jansen, CEO of Hapag-Lloyd. “At the same time, we want to meet the persistently high demand and reduce our slot costs.” The vessels will be deployed on the Europe-Far East routes as part of THE Alliance and will thereby significantly boost Hapag-Lloyd’s competitiveness in this trade.

Yang Ming holds Virtual Naming Ceremony for YM Continuity TAIWAN: Yang Ming Marine Transport Corp. (Yang Ming) celebrated the naming of its 2,800 TEU class full container vessel, YM Continuity with a virtual naming ceremony on June 25th. Yang Ming Chairman Cheng Cheng-Mount and CSBC Corporation Chairman Cheng Wen-Lon, located respectively at Yang Ming’s headquarters in Keelung and CSBC Corporation’s administration building in Kaohsiung, jointly officiated the ceremony. Mrs. Chen Shu-Huei, wife of the President of National Ocean Taiwan University, Hsu Tai-Wen, had the honor to officially name the ship during the ceremony and wish the ship and its crew the best of luck on their future voyages. YM Continuity has a nominal capacity of 2,940 TEU and is equipped with 353 plugs for reefer containers. With a length of 209.75 meters, a width of 32.8 meters and a draft of 11.2 meters, YM Continuity is designed to cruise at a speed up to 21 knots. The newbuilding adopts the Sea Sword Bow design to significantly save energy and optimize hydrodynamic performances. The application of its electronic controlled fuel injection engine with low-load tuning Exhaust Gas Bypass (EGB) fuel control system will greatly enhance the new ship’s energy efficiency. The installation of scrubbers will help Yang Ming to fulfill its promise to reduce emissions of NOx and SOx. Furthermore, YM Continuity is certified with ABS’ Smart INF and Smart SHM notations and CR Classification Society‘s “Smartship H, Et, I” notations. The recognitions denote that the vessels is equipped with smart information infrastructure of big data acquisition and cloud transmission, which allow ship structure endurance monitoring and future structural health awareness through ABS’s customized analysis program to ensure sailing safety. In addition to achieving environmental sustainability through shipbuilding technology, nurturing industr y professionals is one of Yang Ming’s strategies to fulfill corporate social responsibility goals. The company has extended industryacademia cooperation with National Taiwan Ocean University. Together they have established postgraduate programs which offer opportunities for graduates with a bachelor’s degree to study in marine transportation & maritime science technology. The collaboration will help cultivating marine professionals and exploring diverse career paths for the youth. With Mrs. Chen as

India should be a leading Maritime Nation : Vice President • “Ancient India was a great mari me power. We have to regain that past glory”: VP • VP emphasizes the important role of ports in India’s economy Cont’d. from Pg. 3 Recalling that ancient India was a great maritime power and that the navies of Chola kings and Kalinga kings used to rule over the oceans, the Vice President said “we have to regain that past glory”. Touching upon the development of the port infrastructure in the country, he said that as part of the ambitious Sagarmala project, more than 504 projects have been identified to unlock the opportunities for port-led development and these initiatives are expected to mobilize more than 3.57 lakh crore of infrastructure investment. Noting the decline in the cargo trend at Visakhapatnam port during 2020-21 due to the pandemic after a healthy upward swing between 2015-16 and 2019-20, the Vice President expressed the hope that the port would regain its growth trajectory once the situation normalizes. “It is important to note that ports will play an important role in postCovid economic recovery”, he added. Lauding the ports for having played a proactive role in handling oxygen supplies and humanitarian relief work during the second wave of Covid-19 pandemic and cyclones Tauktae and Yaas, he said “I compliment you all for that”.

Referring to the Maritime India Vi s i o n 2 0 3 0 , t h e Vi c e P r e s i d e n t wanted the Port to adopt global best practices in port operations and development. He said that the Vision2030 is not impossible to achieve as India has the inherent strength of knowledge and wanted everyone to work together in the spirit of Team India. During the interaction, the Vice P resident was keen to know the measures taken by VPT to contain pollution and protect the environment. A p p r e c i a t i n g t h e Po r t ’ s g r e e n initiatives, he also wanted them to focus more on renewable energy and energy conservation. He also appreciated Visakhapatnam Port Trust’s initiatives in creating world-class infrastructure, port-led industrialization, digitization of processes and various green initiatives

for sustainability. “I am pleased to learn about the expansion plans of VPT in the coming years”, Shri Naidu added. Earlier, the Vice President was apprised of the expansion plans of the Visakhapatnam Port, including the proposed establishment of a Rs. 406crore Free Trade and Warehousing Zone (FTWZ) in an area of 103 acres. The proposed FTWZ is to be funded under Sagarmala and a Special Purpose Vehicle (SPV) will be set up to develop basic infrastructure like roads, electricity, rail and road connectivity. Shri M. Srinivasa Rao, Minister for Tourism and Youth Development, Government of Andhra Pradesh, Shri K. Rama Mohana Rao, Chairman, Visakhapatnam Port Trust (VPT), Shri D u r g e s h Ku m a r D u b e y, D e p u t y Chairman, VPT and other senior officials of the Port were present during the interaction.

MSME need to integrate with Global Value Chains: Union Minister NEW DELHI: MSMEs need to understand the importance of integration with global value chains which are driving the trade currently, Union Minister Pratap Chandra Sarangi said recently. The Minister of State for MSME said that at a present lot of trade is happening in the form of global value chains and MSMEs should understand the importance of integration with those chains and upgrade themselves accordingly. The integration of MSMEs is critical for the financial viability of global value

chains as not only do they provide a lowcost way of operations but also with their geographical reach and innovation capabilities, MSMEs form the cor nerstone for fostering global economic growth. In the process of integration to the global value chain, MSMEs face many challenges, therefore efforts must be made to strengthen the sector locally to enable their penetration and reach globally, he said at the Assoham webinar. The ministr y has undertaken

several initiatives to modernize the sector during the last year. These include putting in place financial support mechanisms through Fund of Fu n d s , b r o a d e n i n g d e f i n i t i o n o f MSMEs, introducing IT based Champions platform to provide solutions to issues of MSMEs. “The role and potential of Indian MSMEs along with the need to improve their efficiency, productivity and quality needs to be viewed in the context of a globally competitive landscape,” he added.

Cochin Port sees increase in cargo throughput COCHIN: The COVID19-related pressure on the businesses of ports is seen easing a little in the first two months of the current financial year with Kochi port seeing an upswing in volume of cargo throughput. According to figures from the Indian Ports Association, Kochi, saw volume of cargo throughput go up to a total of 5.17 million tonnes during April and May this year compared to 3.41 million tonnes during the same months in 2020. The upswing has been helped by substantial increase in POL products, the volume of which went up to 3.17 million tonnes during April-May 2021 compared to 2.24 million tonnes during the same months last year. Meanwhile, the pandemic impact on shipping business across the country during the last financial year was reflected

in the cargo movement through the port, which dropped marginally by about eight per cent for 2020-21. However, the port’s handling of container cargo saw an upward swing of about 11 per cent. The port handled a total cargo of 31.50 million tonnes during 2020-21 against the volume of 34 million tonnes during the previous financial year. The fall is 7.45 per cent. However container cargo movement saw an upward swing. The port handled 6.89 lakh TEUs of container cargo during the last financial year against 6.20 lakh TEUs during the previous year. The number of vessels handled by the port too saw a slight dip as COVID 19 significantly affected the pace of shipping operations across the globe. The port handled 1,475 vessels during 2020-21 against 1,589 vessels during the previous year. The port’s operating income for the

year 2020-21 stood at Rs. 683 crore against Rs. 649 crore during the previous year. The increase is a little more than five percent year to year. Despite the slight fall in cargo throughput, the income from cargorelated charges saw a slight increase by about five percent. This is on account of the increase in the volume of container cargo throughput. Vessel related charges went up by about nine per cent for the last financial y e a r. T h e c r e w c h a n g e f a c i l i t y implemented at the port has been pointed out as the reason for the increase in income in this category. The Port Trust also saw an increase in operating profit, which stood at Rs. 339.89 crore during 2020-21 against Rs. 293.16 crore during the previous year. The operating profit increase nearly 16 per cent year to year.

Commerce Ministry wants SEZ doors to be opened for non-export manufacturing units NEW DELHI: The Commerce & Industry Ministry is trying to convince the Revenue Department to allow non-export manufacturing units that produce only for the domestic market to operate within SEZs to take advantage of the infrastructure available in the zones. “The Revenue Department is examining the details of the proposal for domestic manufacturing and is yet to give its consent. But the Commerce Ministry is consistently pushing for it as it believes it would not result in any revenue loss for the exchequer while helping manufacturers to improve their efficiency and the SEZs to utilise their excess capacities,” an official tracking the matter told. According to the proposal, if manufacturing units for domestic sales are allowed to set up shop in SEZs, they will not be entitled to any of the tax benefits that SEZ units get, which includes zero rating of GST. On the taxation front, they will be treated as any other unit in the country outside the SEZ, and their sales in the domestic market will not attract customs duties. “There are a number of

manufacturing units that want to set up shop in SEZs not because of the tax benefits, but for the excellent infrastructure that is present there. The competitive infrastructure with integrated real estate, power and transportation facilities and smooth administrative processes are a big draw,” said the official. Moreover, most SEZs in the country are operating at low capacities, and allowing domestic manufacturing units will improve space utilisation, he added. With the pandemic-related slowdown hitting business, SEZ developers are keen on taking up more. The proposal was also reflected in the recommendations made by the Baba Kalyani-led committee constituted by the Ministry of Commerce and Industry to study the existing SEZ policy of India. The objectives of the committee were to evaluate the SEZ policy and make it WTOcompatible, suggest measures for maximising utilisation of vacant land in SEZs, suggest changes in the SEZ policy based on international experience and merge the SEZ policy with other

government schemes such as coastal economic zones, Delhi-Mumbai industrial c o r r i d o r, n a t i o n a l i n d u s t r i a l manufacturing zones, and food and textile parks. The committee had submitted its recommendations in November 2018. The Commerce Ministry is also considering a proposal made by SEZ developers and units to allow existing SEZ units to sell part of their produce in the domestic market at lower customs duties that are offered to Free Trade Agreement partners such as South Korea or Japan. “Here, one needs to actually look at the items that are being imported from FTA partner countries and maybe extend the same terms to items from SEZ units. This proposal, too, is being discussed with the Revenue department,” said the official. There are 265 operational SEZ units and 425 units that have been formally approved in India with a total investment of Rs. 6,07,679 crore as on December 31 2020, as per government figures. Exports from the SEZs in the April-December 2020-21 period declined 7 per cent to Rs. 5,53,396 crore (year-on-year).

Exotic dragon fruit or Kamalam from Maharashtra exported to Dubai NEW DELHI: In a major boost to export of exotic fruit, a consignment of fibre and mineral rich ‘Dragon Fruit’, also referred as Kamalam, has been exported to Dubai. A consignment of Dragon Fruit for exports was sourced from the farmers of Tadasar village, Sangli district, Maharashtra and it was processed and packed at APEDA recognized exporter –Kay Bee. Scientifically referred to as Hylocereusundatus, the dragon fruit is grown in countries such as Malaysia, Thailand, the Philippines, the USA and Vietnam. Dragon fruit production commenced in India in early 1990s and was grown as home gardens. Dragon Fruit has become increasingly popular in recent years in the country as it has been taken up for cultivation by farmers across various states. At present, dragon fruit is grown mostly in Karnataka, Kerala, Tamil Nadu,

Maharashtra, Gujarat, Odisha, West Bengal, Andhra Pradesh, and Andaman and Nicobar Islands. The cultivation requires less water and can be grown in various kinds of soils. There are three main varieties of dragon fruit: white flesh with pink skin, red flesh with pink skin, and white flesh with yellow skin. Prime Minister Shri NarendraModi in ‘Mann Ki Baat’ programme in July 2020 on All India Radio had mentioned about the dragon fruit farming in the arid Kutch region of Gujarat. He had congratulated the farmers of Kutch for the cultivation of fruit for ensuring India’s self-sufficiency in the production. The fruit contains fiber, vitamins, minerals, and antioxidants. It can help in repairing the cell damage caused by oxidative stress and reduce inflammation, and also improving the digestive system. Ambala Railway Division commences freight train service to Bangladesh AMBALA: The Ambala Railway Division, for the first time in its history, sent a special parcel train beyond India’s border to Benapole in Bangladesh with cotton yarn recently. This earned the division ₹25.69 lakh for carrying 468 tonnes of freight in collaboration with mgX.com, a subsidiary of MGH Group, a Singapore-based shipping conglomerate, officials said. This train, consisting of 20 parcel vans, was flagged off by Vivek Sharma, Senior D i v i s i o n a l C o m m e r c i a l M a n a g e r, Himanshu Pant, director and CEO of MGH India, and other railway officials. Sharma said that businessmen in and around Punjab and Haryana have been transporting commodities by road to Bangladesh in small quantities, which is costly for them.

“ D u r i n g t h e lockdown, they could not move goods by road. Then, railway staff and officials approached them and explained the transportation facilities by rail. To move the consignment by goods trains, it is mandatory for f a r m e r s a n d businessmen to mobilise the quantity in bulk,” he said. Officials in a statement said that each van was loaded with 430 cartons , weighing around 23 tonnes and the total weight carried by the special parcel express is around 468 Tonnes. “MGH will be providing end-to-end

transportation solution to its customers for exporting yarn, fabrics and FMCG goods from their respective factories across Ludhiana and Baddi to their buyers’ factories in Bangladesh, including the customs clearance on both the sides of the border,” a statement reads.

Power, Perks, & Non-Performance : The Major Port Authorities Act, 2021 " H u m A n g r e z o n Ke Z a m a n e Ke J a i l o r H a i n " Asrani spoofed Charlie Chaplin in Sholay. This evoked viral humour. Humour comes from sharp unexpected outcomes. And what was the unexpected part in what Asrani said? The unexpected part was our hypocrisy in not openly admitting the facts that the British colonists did a far better job in managing our jails than we did in a free India. We know this and yet it's politically incorrect to voice this in the open. Afterall, they were our erstwhile oppressors. We still live in that kind of denial of truth. You would say, how is this related to our so-called Port Sector Reforms of 2021? There is a strong connection here. Indian Ports Act was framed in 1908. Same was amended in 1963. And again in 2021. The basic framework of 1908 still stands. What was eventually gouged out of it in 1963 was its central mechanism of efficiency or the mechanism of getting things done. This was done by putting in place a system to reward (power & perks) a collection of politically favoured & powerful people in place of a responsible & accountable Conservator. And in 2021, that crowd was renamed, tweaked, made a bit smaller, and given more power, like selling port lands or allowing private operators whatever tariff they fancied. That's all that was done after more than half a century of poor show by the major ports. The British managed and developed our ports much more efficiently. Some would claim that they did this because they wanted to enrich themselves by exploiting our resources and so on and so forth. But that's besides the point. The point is how they did it and can we replicate it? The 1908 Act mandated one conservator to be assisted by a deputy. The tariffs and macro rules were set by the central government. The conservator was in a leadership role to get things done. He was like a CEO. He could hire or fire. Nobody could mess or meddle with him. If he did not perform, he was replaced. Simple & straightforward. That's how things get done in an efficient organisation. And that's how efficiently the Indian jails were being run then. Same was the case with the ports. Then we got independence and changed the rules of 1908 in 1963. We replaced the conservator with a board of trustees (17 to 19 trustees) headed by a Chairman & Deputy - a motley crowd to run & develop a port. The Chairman & the trustees were selected by the government(s). There was no requirement for qualification or competency other than what the central government deemed fit. The Act was more about 'Power & Perks '. Getting things done or performance was not even accidentally mentioned. The Act talked in length about power, perks, and disqualifications (not qualifications), making it extremely difficult to remove a selected person - unless of course, he committed a murder or big crime and convicted. And until then he could happily enjoy his power & perks in his tenure. At the same time, in the event where the Chairman wanted to act prudently & on time, there were 17 to 19 trustees to breath down his neck for their vested interests. Under such trying circumstances, where you are not even asked to perform, are throttled down by a mob of 17 to 19 persons (with no individual accountability) and are guaranteed your

'Power & Perks' for the full tenure, how would you perform? Therefore, our ports became progressively inefficient and costly. There were other things like setting up a body to set tariffs called TAMP and so on. Let's keep all those for another day. The Board was like a politicallyCapt. P S. Rath made heaven on earth. Only the favoured few would be sent there to enjoy power and perks with no requirement to perform. The change mandated the appointment of trustees from government departments (both centre and state), unions and such other interests as the Central Government deemed fit. Deemed fit is like a blank cheque. You could fill in what you wanted in future & encash it. Under ''such other interests'', they could pick a person(s) from ship owning or shipper and so on. There was intense lobbying to get into those slots. The result was all to see - inefficiency & high costs. Luckily for us, some container terminals were given to private hands on a landlord-tenant principle and we saw positive outcomes. But again, these relationships were mired with disputes and absurdities, resulting in move-counts and their ill effects. The end result is our terminals are far too inferior to support healthy international trade. Act 2021 had to address all these problems - inefficiency, cost, (performance), dispute resolution, fair pricing, and so on. But, what the Act did was ignore the basic issue of performance (inefficiency & cost). It's like old wine in a new bottle. The Board of Trustees was replaced with a Board with a slight reduction in no of members (earlier trustees). Being on the board entails benefits. It's all about how much you could extract - not contribute! Little wonder that a CM of a state came out complaining that he feared less representation from the state. Again this is all about power & perks - not performance! Therefore, it is not going to work. We will continue to have third class ports and harbours. The solution lies in spelling out two things with absolute clarity in the Act - performance & leadership. Performance efficiency & cost. Both are simple numbers. Number of moves per hour per gantry (averaged annually) must go up. Cost per move must come down. A timeline should be given to the Board. Second, the Board should be authorised to appoint one professional (A CEO or conservator) to achieve the set performance. The perks & pay of the Board should be linked to performance. If the Board fails, they should not be entitled to the perks. A new Board should be put in place. Review should be done annually by the central government. The Act has addressed other issues like tariff pricing, sale or use of port lands, dispute resolution, inactions by Board, investment, and development etc. Some are good. Some are not that good. We will discuss them another day. By Capt. P S. Rath Views expressed are of Author only.
