IMF cuts Global growth forecast due to omicron, other woes NEW YORK: The International Monetary Fund is downgrading its forecast for the world economy this year, citing the spread of COVID-19’s omicron variant, higher energy prices, an uptick in inflation and financial strains in China. The 190-country lending agency now forecasts the global economy will expand 4.4% in 2022. That’s down from an estimated 5.9% last year and from the 4.9% the IMF was forecasting for 2022 back in October. The IMF slashed the growth forecast for the United States — world’s

largest economy — to 4% from the 5.2% it predicted in October. The agency no longer expects any economic stimulus from President Joe Biden’s Build Back Better social policy bill, which has stalled in Congress. The US economy is also contending with supply-chain bottlenecks that prevent companies from filling customer orders, and from the Federal Reserve’s impending move to raise interest rates to cool off the hottest y e a r- o v e r- y e a r i n f l a t i o n i n f o u r decades. The Chinese economy is forecast to

grow 4.8% this year — down from 8.1% last year and 0.8 percentage points slower than the IMF expected in O c t o b e r. C h i n a ’ s z e r o - t o l e r a n c e approach to COVID is likely to take an economic toll as is financial stress on the country’s property developers, according to the agency. The IMF expects the 19 European countries that share the euro currency to collectively grow 3.9% this year, down from 5.2% in 2021. Japan is forecast to register 3.3% growth this year, up from 1.6% last year, as a result of continuing government support for the economy.

DGTR issues 56 final findings since April, 2021 in Anti-Dumping (AD) / Countervailing Duties (CVD)/Safeguard (SG) NEW DELHI: DGTR (Directorate General of Trade Remedies) of the Department of Commerce has issued 56 final findings since April, 2021 in in AntiDumping (AD)/Countervailing Duties ( C V D ) / S a f e g u a r d ( S G ) investigations.35 more investigations have been started since April, 2021 and many more are in pipeline. It may be noted that the Directorate General of Trade Remedies (DGTR) is a quasi-judicial body functioning under the aegis of the Department of Commerce, Ministry of Commerce and Industry, Government of India. The DGTR serves as a watchdog against unfair trade practices resorted by the producers/ exporters in foreign countries and aims to create a level playing for the Indian industry. The unfair trade practices that the DGTR acts against are in the form of dumped imports or subsidised imports or imports that circumvent existing antidumping/countervailing duties. DGTR also protects the domestic industry

from surge in imports that harm the Indian industry. The function of the DGTR is to conduct an elaborate investigation into the complaint filed by the Indian domestic producers allegedly injured by the unfair trade practices adopted by foreign producers/ exporters and then take a decision on whether or not to recommend imposition of duty. Final decision regarding imposition of duty recommended by the DGTR is taken by the Ministry of Finance, Government of India. An application to initiate an investigation is generally filed by the domestic industry, after which, the DGTR initiates the investigation and invites participation of all stakeholders – domestic industry, foreign producers, exporters, importers, users and their associations. The DGTR then gathers evidence from each stakeholder to examine the allegations of domestic industry. It is only after the detailed and elaborate examination of facts, data and

legal submissions of stakeholders that DGTR ar rives at the conclusion regarding recommendation of duty depending on whether or not the domestic manufacturers have suffered material injury or threat of material injury by the dumped or subsidized imports. All investigations are required to be concluded within 12 months. This period is extendable upto 18 months. However, the average time to complete the investigation has consistently been reduced by the DGTR and it usually endeavours to complete most investigations within 5-7 months for ensuring a faster relief to the domestic industry. Several reforms have been carried out by the Directorate in its processes and procedures through greater use of digital platform, simplification of application formats, annexures and questionnaires and introduction of selfcertification in conducting trade remedy investigations.

VOC Port records 10.37% growth in cargo handling in first three quarters TUTICORIN: Though the Covid-19 pandemic has upended the landscape of global maritime trade, VOC Port has handled 26.05 million tonnes of cargo and 5.93 lakh TEUs of containers till December 2021, during this financial y e a r. T h i s i s 1 0 . 3 7 % m o r e w h e n compared to the corresponding period

last year, chairman of VOC port trust T K Ramachandran said at the 73rd RDay celebrations at the port school ground. Addressing the gathering after hoisting the national flag and taking the salute from the Central Industrial Security Force (CISF) contingent, he

said that several events including e s t a b l i s h m e n t o f a Ta m i l n a d u Maritime Heritage Museum and VOC Museum will be organised by the port as a part of the ‘Azadi Ka Amrit Mahotsav’ to celebrate and commemorate 75 years of Indian Independence.

Raise customs duty on Aluminium scrap to 10%: Aluminium Association of India NEW DELHI: Arguing that growing imports of scrap is threatening the primary aluminium industry, an umbrella industry body has urged the finance minister to raise basic customs duty on aluminium scrap to 10% from 2.5% now. In a memorandum, Aluminium Association of India (AAI) said the duty increase will encourage recycling of domestic scrap and restrict its growing imports. The share of scrap in total imports of aluminium increased from 52% in FY16 to 66% in FY21, resulting in around Rs 15,000 crore worth forex

outgo. India imported a little more than 2 million tonne aluminium last fiscal. “Currently custom duty on primary aluminium is 7.5% and aluminium scrap is only 2.5%. This is the reason why despite having significant presence of primary aluminium capacity and potential to generate sufficient domestic scrap, India’s consumption of scrap is 100% import-dependent. The way forward is to increase custom duty on aluminium scrap from 2.5% to 10%,” it said. AAI said China’s renewed measures to restrict scrap imports is leading to

greater inflow of scrap into India. China imposed 25% duty on aluminium scrap imports from the US and classified aluminium scrap in restricted import list from July 2019, with plans to completely ban all scrap and waste imports. “Post that the share of import from the US in China’s total aluminium scrap imports has declined from 53% in 2017 to just 16% in 2019. India has overtaken China as world’s largest aluminium scrap importer due to the Chinese measures,” it said.

FIEO's wishlist for the Union Budget for sustaining high growth in Exports: Dr A Sakthivel, President, FIEO MUMBAI: Indian exports are on the upswing and we are within the range of reaching the milestone of US$ 400Bn during the current fiscal year. The order booking position of exporters across sectors is extremely encouraging, assuring us of continuing on the growth trajectory next fiscal as well. However, the logistics and few challenges are of grave concern to them. Shortage of containers, abnormal increase in freight and space constraints on ships are impacting our exports. Therefore, the budget should draw a road map for addressing these issues. 1. Logistics Issues: (a) Looking into our mid-term target of US$ 1Trillion by 2027-28 for merchandise exports, container manufacturing should be encouraged more so as we are also pushing coastal shipping in our country. A Production Linked Incentive (PLI) kind of scheme for container manufacturing can come handy to encourage domestic manufacturing of containers addressing some cost disadvantages. (b) Since international trade is emerging as an important component of the Indian economy, we should develop an Indian shipping line of global repute. We may be remitting over US$ 75 Bn or more as freight charges this year. An Indian shipping line, which gets 25% of this business can save US$17-20 Bn on recurring basis annually. This figure will increase as we move towards a trillion-dollar merchandise exports. Some tax concessions may be required so that such ships are encouraged to register in India. 2. Marketing issues: Our MSMEs lack exposure despite having the best of products. Many countries encourage overseas marketing though fiscal or tax incentives. We should consider providing a double tax deduction for overseas marketing so that for example for every US$ 1000 spent on global marketing, US$ 2000 may be provided as tax deductions under the income tax for specified kinds of overseas marketing for market exploration, market penetration and market promotion etc. A ceiling of USD 5,00,000 may be put under the Scheme so that the investment and tax deduction are limited. 3. Credit issues: (a) The Emergency Credit Linked Guarantee Scheme (ECLGS) has provided huge support to businesses particularly to MSMEs during the Covid. The scheme should be extended for one more year for seamless flow of credit to business particularly as the demand of credit has gone up with increase in prices of inputs, transportation cost including overseas freight and logistics disruptions. On the contrary, the value of collateral has deteriorated during the covid and thus ECLGS will provide the necessary oxygen to the industry. (b) Interest Equalisation Scheme (IES): The IES has helped exporters to get the credit close to the international benchmark. The scheme requires extension with effect from 1st October, 2021 at least for 3 years so that exporters can take long-term positions based on the competitive interest rates under the IES. 4. R&D Support: R&D and product development is key to sustained exports. Looking into the low R&D spending as a percentage

of GDP in India, we need to encourage such spending through liberal tax support as R&D is having a high gestation period with a lot of uncertainties. 200-300% tax deductions may be provided on investment in R&D and product development for a long-term exports strategy to increase value addition and diversify the exports base as well. 5. Agri Exports Support: Our agri exports have done exceedingly well both in 202021 and in 2021-22 but the share of the processed sector is still low in our agri exports. We need to provide a higher budget for agri exports more so for the Transport and Marketing Assistance (TMA) Scheme and backward and forward linkages in the agri sector. 6. Services: Services rendered to foreign nationals and paid in Free Foreign Currency to be given IGST/ITC Refund: Services Exports are growing with good performance from IT and IT-enabled services which accounts for twothird of India’s services exports. Services sector is not getting any support as SEIS benefits are also no longer available. The travel & tourism sector has been hit heavily due to pandemic and needs to be given encouragement. Mode-2 of services (service provided to a Foreign national in India paid in free foreign currency) have neither been provided exemption from IGST nor refund of accumulated input tax credit. While we appreciate the new provision incorporated under Section 15 of IGST Act providing the refund of IGST on supply of goods to tourists leaving India at the International airports, it is equally necessary that no taxes are imposed on the services being provided to them during their stay in India. The travel tourism sector including hotel and hospitality is already burdened with high taxation and tourists are preferring South East Asian countries. Tourism has one of the highest capital employment ratios and therefore, refund of IGST/ITC facility to Mode-2 of services will go a long way in providing competitiveness to the sector and helping the country to take its tourism earning to US$ 100 billion in next 5 years. 7. Restoration of facility for Import of Trimming and Embellishments under Customs Notication No.2/2021 dated 1st of February, 2021: The MSME exporters source most of their raw material from the domestic market and import only small lots of trimmings and embellishments under the EPC Scheme. Most of the exporters import these items because of the buyers' nomination. Hence need to be sourced from defined sources and within sharp timelines. This facility provided required flexibility to the smaller exporters to import such items just in time to meet the delivery schedule. The total duty foregone under the scheme in 2020-21 has been less than Rs.300 Cr as the duty foregone value against the utilized entitlements from various EPCs. Such entitlement certificates should only be issued for import purposes and in case, any domestic unit including SEZ is able to meet such requirement of exporters, the entitlement certificates may be surrendered to the concerned EPC and invalidation letter in lieu of the same may be issued so that the apprehension that the certificates may be utilized both for imports and procurement from domestic sources can be addressed.

Gems and Jewellery exports up 71% during Apr-Dec to $28.9 billion NEW DELHI: Gems and jewellery exports rose by 71 per cent during April-December 2021 to USD 28.9 billion as compared to USD 16.9 billion in the same period of the previous year, the commerce ministry said. In December 2021, these exports grew by 16.38 per cent to USD 2.99 billion, it said. The sector accounted for 9.6 per cent share of India’s entire exports basket during the period under review. Top five export destinations for the sector included the US, Hong Kong, the UAE, Belgium and Israel.

The industry contributes about 7 per cent of India’s total GDP and employs more than 50 lakh workers. The ministry added that the Centre has laid out four points to make India’s gems and jewellery a pioneer industry in the world and those steps include focus on design; diversification of export products; collaboration with other nations for cost-effective methods to enhance production of fusion jewellery, and promote lab-grown diamond.

International Maritime luminaries attend the 1st Meeting of the The Gujarat International Maritime Arbitration Centre (GIMAC)

Cont’d from Pg. 3 The meeting was attended by the following g l o b a l l y acclaimed Advisory Body members constituted by GIMAC: • Prof. Sundra Rajoo, President, Asian Institute of Alternative Dispute Resolution, MALAYSIA • Mr. Arthur Bowring MH, Maritime Arbitrator, President & Full Member, Hong Kong Maritime Arbitration Group & Full Member, London Maritime Arbitration Authority • Mr. Arran Dowling- Hussey, Barrister & Trustee, Board of Trustees, Chartered Institute of Arbitrators, Ireland • Dr. Asanga Gunawansa, Sr. Legal Counsel, Colombo Law Alliance & Chairman, Board of Directors, Sri Lanka International Arbitration Centre • Mr. David Morriss, Partner, Holman Fenwick Willan LLP, London • Mr. Steve Ngo, President, Beihai Asia International Arbitration Centre, Singapore • Ms. Ann Ryan Roberts, Former President, Chartered Institute of Arbitrators, London, UK • Justice Mohit S. Shah, Hon’ble Chief Justice (Retd.) High Court of Bombay • Dr. S. Shanthakumar, President, GIMAC • Mr. Jagmeet Makkar, Chairman, Institute of Chartered Ship Brokers, Hong Kong • Mr. Lalit Basin, Chairman, CIARB, India • Mr. Ganesh Chandru, Partner, Dua Associates • Capt. Pankaj Kapoor, Senior Partner, India Law Offices LLP • Mr. Samir J. Shah, Director, Chartered Institute of Arbitrators, ( CIArb) Today, India accounts more than 10% of world's seaborne cargo. However, it is still not recognized as a maritime nation. With an aim to being a 5 trillion dollar economy by 2025, the maritime sector in India is gearing up to be one of the best maritime locations across the globe. Disputes being an inherent part of any sector, the maritime sector too has its share of trade related disputes. These disputes might range from minor issues to complex jurisdictional claims with several parties involved in the contracts. Due to the popularity and observed benefits of arbitration, such as the privacy of the arbitral process and perceived certainty in the binding nature of arbitral awards, arbitral agreements have grown in use with the increase in international trade.

Despite the size or complexity of the matters involved, parties prefer to opt for alternative, cost effective, and efficacious forms of dispute resolution. It is, therefore, common for contracts – which govern marine adventures and those for the sale of goods – to contain an arbitration agreement, and a set of arbitral rules which will govern the dispute resolution between the parties. There are over 35 arbitral institutions in India, but none with an exclusive focus on disputes related to the maritime and shipping sector. Realising the fact that the absence of an exclusive ADR centre focusing on shipping and maritime dispute resolutions in the country is leading the maritime stakeholders to opt for such global maritime arbitral institutions based out of London, Singapore or Hong Kong at the cost of time money and e n e r g y, t h e G I M A C i s b e i n g d e v e l o p e d b y t h e Government of Gujarat under the ambit of the Gujarat Maritime University. The GIMAC will be housed in the Gujarat Maritime Cluster ecosystem, India’s first services- based commercial maritime cluster that is coming up at the global fintec hotspot - the GIFT City. The GIMAC is equipped with top-class Hearing Rooms, Breakout Rooms, Arbitrators’ Lounge and Business Centre. GIMAC is envisaged to shape the alternate dispute resolution system in maritime and shipping sector in India, with access to the experienced arbitrators, mediators and legal professionals practising in maritime and admiralty law, and professionals from the maritime and shipping sector. GIMAC has now taken up the process empanelment of arbitrators. It aims to be an efficient ADR centre competing at par with other globally renowned maritime arbitration institutions such as London Maritime Arbitrators Association (LMAA), Singapore Chamber of Maritime Arbitration (SCMA), Emirates Maritime Arbitration Centre (EMAC) and others. GIMAC is also working towards requesting the Supreme Court of India (International) and High Court of Gujarat (Domestic) to recognize GIMAC as an Appointing Authority towards appointment of Arbitral Tribunal, in the absence of agreement by Parties. The government is also being requested to nominate GIMAC as the preferred mode of arbitration in all contracts entered into by all the Government Departments. By establishing a trusted global standard for maritime ADR services in India, GIMAC aims to promote awareness of maritime and logistics dispute resolution services to further support the nation as it develops into a favoured maritime destination.
