CBIC prescribes measures for smooth implementation of Faceless Assessment under Customs NEW DELHI: The Central Board of Indirect Taxes and Customs (CBIC) has issued the circular prescribing measures for smooth implementation of faceless assessment under customs. The CBIC has reviewed the implementation of Faceless Assessment. While the implementation has been largely smooth, the Board’s attention has been drawn to some issues impacting the pace of assessment and clearances of consignments. As the prompt and timely assessment of Bills of Entry and clearance of imported consignments are key objectives of Turant Customs, these issues have been examined and remedial measures have been identified.

Accordingly, the Board prescribes the various measures for Faceless Assessment. Firstly, while addressing the aspect of Continuous Assessment, the Board said that one of the five Working Groups established under the NACs is responsible for timely assessments including resolving related IT issues. The Board further said that in the event of increase in the pendency for a particular NAC/FAG, the NAC Commissioners heading this Working Group shall take urgent measures for co - ordination with other NAC Commissioners/DG Systems for early disposal and resolution of the issues.

Director General Shipping notied as National Authority for Ships Recycling • DG Shipping designated as an apex authority under the Recycling of Ships Act, 2019 for the ship recycling industry of India • Ofce of National Authority will be set up in Gandhinagar, Gujarat NEW DELHI: Central Government has notified the Director General of Shipping as National Authority for Recycling of Ships under the section 3 of the Recycling of Ships Act, 2019.

As an apex body, DG Shipping is authorized to administer, supervise and monitor all activities relating to Ship Recycling. DG Shipping will look after the sustainable development of the Ship Recycling industry, monitoring the compliance to environment-friendly norms and safety and health measures for the stakeholders working in the ship recycling industry.

DG Shipping will be the final authority for the various

approvals required by the Ship-Recycling yard owners and State Governments.

Under Ship Recycling Act, 2019, India has acceded to H o n g Ko n g C o n v e n t i o n f o r S h i p R e c y c l i n g u n d e r International Maritime Organization (IMO). DG Shipping is a representative of India in IMO and all the conventions of IMO are being enforced by DG Shipping.

National Authority of Ship Recycling will be set up in Gandhinagar, Gujarat. The location of the office will benefit the Ship Recycling yard owners situated in Alang, Gujarat which is home of Asia’s largest ship breaking and ship recycling industry in the world.

THE Alliance announces updated service adjustments for November 2020 HAMBURG: In response to the COVID-19 pandemic, the member of THE Alliance have been making service adjustments to better align their resources with the fluctuating demand in the global shipping market. APM Terminals Mumbai’s container tracking platform receives industry-leading upgrade As part of APM Terminals’ global roll-out of a standardised container tracking system for customers, the company has now made a personalisation option available. Among other things, this enables customers to save containers to a Container Watchlist and set up email notications, to save time and optimise container ow.

MUMBAI: More than 22 of the company’s terminals provide access to container tracking, using the standard interface on www.apmterminals.com, known as Track & Trace (T&T). Over the coming months, this global solution will be rolled out to the company’s Mumbai terminal, which has a container throughput of more than 2m TEU. “This standardised approach not only offers convenience to customers working with multiple terminals but enables APM Terminals to focus its investment in just one industry-leading platform instead of multiple, potentially less innovative solutions,” says Wiebe-Jan Kloosterman, Landside Digital Solution Manager at APM Terminals.

Last quarter, the T&T platform saw the launch of a function that enables customers to save their import containers to a Container Watchlist. “This saves customers time and effort, continually copying and pasting their containers into the search to retrieve the latest status,” says Kloosterman.

“Filtering options in the Container Watchlist allow customers, for example, to quickly identify containers that are ready for collection, missing appointments or have issues (e.g. Customs Holds) that need resolving.”

Email notications This week, the company introduced an email notification feature for containers in the Watchlist. While this feature is currently available for APM Terminals in Los Angeles, Port Elizabeth and Mobile in the United States, it will be rolled out in November to the remaining terminals on the T&T platform including Mumbai. Customers can choose to receive the email snapshot of their Watchlist once or twice per day and can specify which exact days based on their convenience.

One central apmterminals.com customer account is used to access all T&T functions. Going forward, this account will be used to access a growing number of features available on the website.

“We acknowledge that in the past customers needed to have multiple accounts for different systems at different terminals, in order to do business with us,” says Kloosterman. “This isn’t ideal and requires time and patience from our customers.

Going forward, our goal is to provide access to all of our services from one place, and with just one account.”

For example, customers who have already set up an account for Terminal Alerts on apmterminals.com – a system which sends customers urgent operational updates via SMS or email – use the same login for Container Watchlist Notifications.

Over the coming months, APM Terminals plans to implement improved functionality and usability for live vessel schedules, which are currently available as part of T&T and to add live rail schedules, where relevant.

CBIC prescribes Measures for Smooth implementation of Faceless Assessment under Customs. The Central Board of Indirect Taxes and Customs (CBIC) has issued the circular prescribing measures for smooth implementation of faceless assessment under customs. The CBIC has reviewed t h e i m p l e m e n t a t i o n o f Fa c e l e s s Assessment. While the implementation has been largely smooth, the Board’s attention has been drawn to some issues impacting the pace of assessment and clearances of consignments.

As the prompt and timely assessment of Bills of Entry and clearance of imported consignments are key objectives of Turant Customs, these issues have been examined and remedial measures have been identified. Accordingly, the Board prescribes the various measures for Faceless Assessment. Firstly, while addressing the aspect of Continuous Assessment, the Board said that one of the five Working Groups established under the NACs is responsible for timely assessments including resolving

related IT issues. The Board further said that in the event of increase in the pendency for a particular NAC/FAG, the NAC Commissioners heading this Working Group shall take urgent measures for co-ordination with other NAC Commissioners/DG Systems for early disposal and resolution of the issues.

Secondly, while addressing the aspect of raising of queries by FAG Officers the Board said that the Working Group on Prohibitions/Restrictions are advised to identify the item wise CCV requirements for uniformity in the FAG and also communicate the same to RMCC for their central enforcement.

Once this is done, the Appraising / Assessment officer would no longer need to insert a remark to this effect in the system. Thirdly, while addressing the aspect of resorting to First Checks, the Board said that where an importer requests First Check on a regular basis, the FAG officers and the NAC must take due care that this request is genuine and is not being routinely used to avoid self-assessment.

Fourthly, while addressing the aspect of the role of RMCC/LRM in facilitation the Board clarified that all local alerts shall be reviewed periodically and continued, only if found absolutely necessary. LRM is also advised to use ICES to insert general instructions and Alerts rather than through the RMS. Fif thly, while addressing the aspect of re-assessment of B/E the Board highlighted three s c e n a r i o s n a m e l y, w h e r e t h e amendment is requested before OOC

and would impact the assessment; where the re-assessment is requested before OOC but would not impact the assessment; and Where the reassessment is requested after OOC has been given under Section 47 of the Customs Act, 1962.

Sixthly, while addressing the aspect of Certificate of Origin the Board said that the field offices must ensure that no physical copy of any supporting document is submitted and every relevant document is submitted only electronically via e-sanchit either by the beneficiary or by the Participating Government Agency. Lastly, while addressing the aspect of grievance redressal, the Board said that the details of the nodal officer and his/her contact details would be made available through Public Notice and in CBIC website for escalation of any issues including the B/Es in the FA requiring urgent attention.

The Principal Commissioner / Commissioner at the Port of Import may further make other necessary internal arrangements for coordination at the appropriate levels for early resolution. “Board expects that the aforementioned measures relating to streamlining the attendance of B/E during holidays, raising of queries, ordering First Check, re-assessment and submission of COO would certainly contribute to a reduction in the time taken for assessment and clearance of goods. It is expected that these measures would be strictly applied by all NACs and all FAGs,” the CBIC in the circular said.

MSME Ministry introduces AI & Machine Learning strengthening Single Window System Portal ‘Champions’ to assist MSMEs NEW DELHI: The Ministry of MSME in a major initiative has onboarded latest IT tools of Artificial Intelligence(AI) and Machine Learning (ML) for providing assistance and solutions to the issues of Micro, Small, and Medium Enterprises (MSMEs).

Ministry has implemented AI & ML on its robust Single Window System 'Champions' which was launched by the Prime Minister on 1st June, 2020. This multi-modal system has a portal at virtual level and technology equipped physical control rooms at around 69 locations of the country. It has emerged as one of the front runner platforms for the MSMEs in a very short span of time.

Ministry of MSME has taken Covid19 as a challenge and is converting it into an opportunity with futuristic interventions. In this difficult period, Ministry is not only whole-heartedly supporting the MSMEs and trying to convert this crisis into an opportunity, but is in fact making them break their

barriers, make a paradigm shift and become champions.

MSME Ministry further said that it is working aggressively to take the Nation and the MSMEs in the direction of Industry 4.0. They are not only adopting the technologies categorized as part of Industry 4.0 but are also encouraging the MSMEs to adopt the same. They are also helping the MSMEs to manufacture its essential and enabling products like sensors, motors, computer displays and other animation technologies.

In this very sequence, as promised earlier, Ministry has implemented Artificial Intelligence (AI) and Machine Learning (ML) on their Champions portal. Technology Company Intel is their partner in this journey. Intel have guided the Ministry for last five months in implementing some of the tools of AI & ML which are ready for use from TODAY. Ministry has also said that Intel and its technology partner have implemented the entire domain of AI &

ML at their Champions portal totally free of cost.

M S M E M i n i s t e r, M r. N i t i n Gadakari elaborated the work done by the Ministry in this direction during the AI Summit organized by Intel today. He specially thanked Intel and its partner for doing this service to India Pro-Bono.

He also said that the entire concept and scope analysis and design has been done inhouse in the Ministry with the help of NIC and under guidance of local team of Intel. He complimented these teams wholeheartedly.

The expor ter/ applicant is required to link relevant EDI shipping bills and e-BRCs and submit the application through online mode only. A maximum of 50 shipping bills would be allowed to be attached in one single application by the expor ter in the online module. c. Rebate under scrip mechanism under RoSL is admissible only for shipping bill (s) for which Drawback has been disbursed and RoSL amount has not been disbursed. Only those Shipping bills, on which Customs authorities/ ICEGATE have not disbursed RoSL will be transmitted online by the DG (Systems)/ ICEGATE to the DGFT Ser ver for expor ter to file an application. However, the applicant shall ensure that no application is flied against the shipping bill for-which RoSL claim has been received from the Customs Authorities alongwith Drawback. Any mis-declaration to that effect, would invite penal action as per the FT (D&R) Act, l992. d. Facility of Split Scrips: Provisions of para 3.09 of the HBP shall apply mutatis mutandis. e. The Jurisdictional RA for application of the RoSL would be according to para 3.06 (b) of the HBP. The applicants shall ensure that they are applying only to the concerned Jurisdictional RA, as per para 3.06 (b) of the Handbook of Procedures for getting the scrip and shall submit a declaration to that effect while applying for the scrip online. However, the limitation imposed in para 3.06 (a) regarding choosing an RA at the beginning of financial year and maintaining the Same RA for all applications in that Financial Year shall not apply. f. Choice of Por t of Registration For RoSL Scrips: While making an online application, the applicant can chose the Por t of registration from any one of the EDI por ts from where expor t has been made for the shipping bills in that online application.

Duty Credit Scrip (including splits) shall be issued with that single EDI por t of registration. g. After system based approval of the final rebate amount, scrips shall be issued by RAs in a paperless mode. However, RAs shall scrutinize 2 percent of issued RoSL applications ever y month under a Risk Management System (RMS), The RMS cases will be generated by the DGFT system. h. Registration of Scrips: Duty credit scrip needs to be registered at the por t mentioned on the scrip. This is to be done prior to allowing usage of duty credit. Once registered at EDI por t, scrip can be automatically used at any EDI por t for impor t and at any manual por t under Telegraphic Release Advise (TRA) procedure. i. Validity period and Revalidation: Duty credit Scrip shall be valid for a period of 24 months from the date of issue and must be valid on the date on which actual debit of duty is made. Revalidation of Duty Credit Scrip shall not be permitted unless covered under paragraph 2.20(c) of HBP. j. In the online module for filing claims under RoSL. applications containing shipping bills with Let Expor t Order (LEO) date between 01.10.2017 and 06.03.2019 are required to be submitted separately. Similarly, separate application containing shipping bills with LEO date before 01.10.2017 need to be submitted. Last date for submitting applications containing shipping bills with LEO date from 01.10.2017 to 06.03.2019 would be 30.06.2021. The last date for filing applications containing shipping bills with LEO date before 01.10.2017 would be notified at a later date k. After these submission deadlines, no application shall be allowed to be submitted and the shipping bills would become time barred. There is no provision of late cut under the Scheme for RoSL under the scrip mechanism I. All expor ters are eligible for making a claim under the Scheme for RoSL, except the entities/IEC which are in the Denied Entity list of the DGFT 4.98 Recovery Mechanism a. The record of-shipping bills and other documents related to expor t on which a claim under RoSL Scheme has been filed, is required to be maintained by the applicant for a period of 3 years from the date of issuance of scrip for post issue scrutiny and recover y purposes. Regional Authority may call such documents in original at anytime within 3 years. In case the applicant fails to submit the original documents on demand by Regional Authority, the applicant shall be liable to refund the rebate granted along with interest at the rate prescribed under Section 28AA of Customs Act, 1962, from the date of issuance of scrip. b. In case of claim for rebate under the RoSL scheme where the rebate is issued by DEFT in the form of Duty Credit Scrips, such rebate shall be allowed only on the basis of actual remittances realized by the expor ter. In case, excess payment is made due to error or miscalculation, the expor ter shall be liable to refund the same within 30 days from the date of demand raised by the concerned RA of DGFT. Such amount will be refunded by the expor ter with 15% interest or as prescribed under Section 28AA of Customs Act. 1962, whichever is more from the date of issue of such Duty Credit Scrip and till the date of actual refund. In case the expor ter fails to refund the amount so demanded by RA within the prescribed time limit, recover y, proceedings shall be initiated under the provisions of Section 11 of the Foreign Trade (Development and Regulation) Act, 1992 by the RA of DGFT. In case rebate is claimed on the basis of mis-declaration or suppression of facts or by submitting fabricated expor t documents, the expor ter shall be liable for penal action under the provisions of Foreign Trade (Development and Regulation) Act, 1992, as amended time to time, However, unutilized Duty Credit Scrip under RoSL can be surrendered without any interest liability. The amount (principal plus interest and penalty where applicable) so recovered shall be deposited the relevant account head of Customs i.e. "Major Head 0037 — Customs and Minor Head 101-Impor t duties" c. In case the applicant fails to refund any excess claim as stipulated above or does not respond to any communication by RA within 30 days of receipt of such communication. RA will initiate action as per FT (D&R) Act, 1992 and Rules.

3. The ANF-4SL is also notified and is an Annexure to this Public Notice.

Effect of this Public Notice: Based on notifications for issue of Rebate of State Levies (RoSL) for Shipping Bills prior to 07.03.2019, under a scrip mechanism, procedure for applying recover y mechanism and the new Aayat Nir yat Form ANF-4SL is notified. It is also notified that RoSL scrips would be available only for those shipping bills which have been transmitted from the ICEGATE ser ver to DGFT ser ver and for which expor ters have not received any RoSL amount.

Ocean carriers boosting their protability on pent up demand feels Shipping Analysts LONDON: Ocean car riers are “taking advantage of the moment”, according to Alphaliner, boosting their balance sheets on the back of booming demand and all-time high spot rates.

Carriers are “surfing a wave”, said the consultant, but added that mid-term visibility was low and global growth predictions for next year and beyond were shrouded in uncertainty.

Alphaliner said 2020 would be remembered as “one of the strangest years” for container shipping, with carriers issuing profit warnings at the start of the second quarter as the pandemic forced most countries into lockdown, severely impacting world trade.

Hapag-Lloyd CEO Rolf Habben Jansen last week provided a stark insight into the dilemma facing carriers at the prospect of a significant contraction in liftings due to Covid.

“If I look at Hapag and 20% of our volume is gone, then we are all of a sudden missing $200m of revenue a month, and of course in order to react to

that you have to take costs out of the system,” he said.

However, as lockdowns eased, pentup demand, boosted by changes in consumer spending, has encouraged carriers not only to reinstate blanked sailings, but also to deploy extra loaders.

“The reasons for this sudden resumption in container shipping demand are multiple: a catch-up effect, dislocation of air freight markets benefiting seaborne transport, a hefty rise in demand for hygiene products and people spending money on consumer goods rather than on travelling,” said Alphaliner.

Ahead of what analysts now expect to be an exceptionally strong thirdquarter results season for ocean carriers, Maersk upgraded its full-year ebitda guidance by almost 20% after reporting a staggering 45% increase in its unaudited revenue at $9.9bn, despite a 3% year-on-year decline in the number of containers carried.

H o w e v e r, C E O S o r e n S k o u cautioned that the outlook remained uncertain, due to the pandemic.

“The positive impact from stimulus packages may be less strong in 2021,” said Mr Skou. “Potential new lockdowns will impact demand and the timing and effectiveness of a potential vaccine will impact 2021.”

Notwithstanding the current strong demand, carriers are being hobbled by the dearth of containership tonnage on the charter market needed to cover the extra v o l u m e s o n o f f e r. A c c o r d i n g t o brokers, for vessels that do become available, daily hire rates two or three times higher than achieved in April and May are asked for.

“I thought that the market would soften after the Golden Week holidays, but if anything it seems to be stronger now,” said one Hamburg broker source this week. “I’ve a long list of fixture requirements but no ships are becoming available over the next four to five weeks.”

NICDC Logistics Data Services extends its services to Nepal and Bangladesh NEW DELHI: NICDC Logistics Data Services-NLDS (formerly DMICDC Logistics Data Services, DLDS) extended its services to Nepal and Bangladesh after the consent of Land Port Authority of India (LPAI) to install the RFID readers at Integrated Check Posts (ICPs) at India-Nepal and India-Bangladesh border. Extension of services in Nepal and Bangladesh region marks a successful growth story for NLDS and is a first step towards utilizing NLDS services for improving global logistics.

With this expansion, exporters and importers from Nepal and Bangladesh can track the movement of their containers through Logistics Databank Portal www.ldb.co.in and a mobile application named “NICDC-LDB”.

Following ICPs will come under the ambit of the expansion: • Agartala-India-Bangladesh Border • Petrapole-India-Bangladesh border • Jogbani-India-Nepal border • Raxaul-India-Nepal Border

With this coverage ICPs located at Agartala, Jogbani and Raxaul will help in road movement container tracking and Petrapole ICP will help in rail movement container tracking.

Speaking on the development, Mr. K. Sanjay Murthy, IAS, CEO & MD, NICDC (National Industrial Corridor Development Corporation) and Chairman, NLDS said, "The new extension of services reiterates our vision and commitment of streamlining logistics across the country and the brand’s ambition to improve the export-import trade, reduce the logistics cost and pave the way for India to become a logistics hub”.

Commenting on the occasion Mr. Ichiro Oshima, CEO NLDS said, “Since its inception in Dec 2015, NLDS has played a vital role in enhancing the operations of Ports and Maritime Industry in India. While aiming at 100% container volume tracking in India, this expansion will certainly mark a great milestone in bringing efficiency in Logistics and Supply Chain Industry.

Before NLDS came into existence, operators handled logistics independently through autonomous systems, which led to delays and inefficient tracking. Through its flagship product, LDB (Logistics Data Bank), NLDS streamlined container movement and today serves 25 port terminals while handling 96% of the country's total container volume.

Railways approves Alstom’s e-locos to run Freight Trains at maximum speed of 120 kmph NEW DELHI: The Railway Ministry has approved Alstom-built 12,000horsepower (HP) electric locomotives to run freight trains at a maximum speed of 120 kmph, a statement from the French company said on Wednesday.

Earlier in the year, the railways had inducted WAG 12B electric locomotives, the most powerful ones to run on Indian tracks, according to the company.

These locomotives have clocked over 1

million kilometres, providing a significant fillip to the country’s freight logistics sector.

“In line with India’s push towards self-reliance, we have successfully leveraged our local engineering and manufacturing capabilities. Alstom is also committed to support IR in reducing its carbon footprint and adopt cleaner technologies in its quest to transform into the world”s largest Green Railway network,” Alain Spohr,

Managing Director of Alstom India and South Asia, said.

Electric locos allow heavy freight trains to haul 6,000 tonnes at a top speed of 120 kmph. Planned to be deployed for operations on major freight routes of the railways, including the dedicated freight corridors (DFCs), they are expected to increase the average speed of freight trains in the country by at least 20-25 kmph, the company said.

Transatlantic All Transatlantic sailings will be maintained except for in the following weeks: Week 46 – AL1, AL4 void Week 48 – AL1 void Since the outbreak of the coronavirus pandemic, THE Alliance has acted with speed and agility to keep supply chains moving, and have done everything in their power to continue doing so. Maersk Air Freight services start with chartered airplane from Thailand to Japan THAILAND: With the first of the multiple chartered airplanes moved cargoes for a leading tyre manufacturer from Thailand to Japan on October 11th, Maersk’s product portfolio has been successfully expanded to air freight.

This marks the concrete development after Damco’s Air services combined with Maersk’s logistics and services products as of early October, to complement Maersk’s end-to-end offering for clients around the world.

When getting the urgent shipment request from the customer, Maersk’s team quickly re-searched options and recommended movement via air charter solution.

The team secured the best suitable aircraft while optimising and maximizing the load on each flight to meet its shipments transit, cost and dimensional requirements.

Rupesh Jain, Managing Director of Maersk Thailand, Malaysia and Singapore commented on this achievement, “I’m extremely proud of the Maersk team who came together in Thailand, Malaysia and Singapore to mount air solution for one of our key clients needing urgent and tailor-made solution to meet its promise to their client. The team worked around the clock with the client as well as our supplier partner to ensure an effective and cost-efficient solution.

The shipment was delivered to the customer in time without any issue. It also demonstrates our ambition to become the integrator of container logistics with value-added services to our customers.”

With the new capacity in air freight services, Maersk can manage time critical, oversized or high value freight transportation dedicatedly. By combining the speed of air with the cost savings of other modes, customers will be able to reduce inventory and improve their service offerings by fast response time at an affordable price.

China Merchants, Alibaba and ANT build digital partnership BEIJING: China Merchants Group signed cooperation agreement with Alibaba and Ant Group to further promote industrial digital upgrading.

According to the agreement, the three parties will jointly promote the digital upgrading of integrated logistics, financial service, internet, and emerging industries to better service for the real economy.

“China Merchants runs business all over the world, we are expecting to deepen our cooperation on technology and digitalization with Alibaba and Ant, and to establish more closer cooperation with them on overseas market” said Hu Jianhua, General Manager of China Merchants.

“We are planning to jointly promote the digital upgrading of transportation, logistics and finance sectors with China Merchants through the combination of digital technology and real industries, “said Hu Xiaoming, CEO of ANT.

In May this year, China Merchants Port, the port development, investment and operation unit of China Merchants Group, had established cooperation with Alibaba and Ant to develop smart port.
