Gujarat Star Awards 9th Edition to bring leading lights of Maritime Industry under one roof on March 11 Cont’d. from Pg. 2 As usual, leading lights of Maritime and Logistics sector, will present their respective perceptive in an insightful Panel Discussion to be held during the Awards function and moderated by none other than Mr. Samir J. Shah, Partner – JBS Group of Companies. Panellists include M r. S h a n k a r S h i n d e , C h a i r m a n – F F FA I , Mr. Dushyant Mulani, Chairman Elect – FFFAI, Capt. Inderpal Singh, Sr. VP – MSC Agency India, Mr. Lars Sorensen, Managing Director – Area India – Hapag Lloyd India, Mr. Ashish Sheth – Chairman and Managing Director Sarjak Container Lines - A SAKSHAM GROUP,

Mr. Rahul Modi - Managing Director - Pushpak Logistics Pvt. Ltd., Mr. Amit Bhardwaj, Chief Commercial Ofcer – APM Terminals Pipavav, Mr. Rohit Bajaj, CEO – Seagal Group of Companies, Mr. Keshav Gupta, Managing Director – Kiaora and Mr. Dhiren Rajde, Director – J. R. Roadlines. The event will see Top and Senior Most Bureaucrats from the Customs & Ports apart from leading Shipping Companies, Freight Forwarders, C H A s , Tr a n s p o r t e r s , M e m b e r s o f L e a d i n g Commercial and Maritime Associations under one roof gracing the Top achievers of the Maritime Trade. The Awards ceremony will conclude with Dinner presenting ample networking opportunities. Gujarat Star Awards will be held and organized following Covid Protocols of the State.

“A Welfare-oriented Forward-Looking Budget” feels Mark S Fernandes, Chairman, Shipping & Logistics Committee - IMC Chamber Cont’d. from Pg. 2

When implemented well, Gati Shakti will enhance the 'ease of doing business' and create potential to attract foreign direct investment (FDI) in the country. The Awards ceremony could not be held for the past two years owing to the current pandemic and hence is much awaited by the trade. MSMEs are likely to benefit from the extension of ECLGS by one year till March 2023. Financial inclusion has received a boost with the proposal to bring 100 percent of 150,000 post offices into the Core Banking system, delivering immense benefit to the rural population. On the Direct Taxation, there are a lot of positives as it was not touched adversely. The positive initiative permitting the Tax Payers being able to revise their tax returns within a period of 2 years, by paying the tax payable with the interest liability is laudable, but the interest levied is way higher that the interest paid by the Banks. On the Indirect Taxes, the Hon. Finance Minister made mention of exempting Duties on import of diamonds, Gems and jewellery to promote the industries. However, Customs Duties on more than 600 items stand being withdrawn over the year. The benefit for setting up new Project under

Chapter 9801, would end by the 3rd quarter of 2022, if Projects are not registered. Though the Govt. desires to promote make in India, these amendments surprised the Industry, as it could result in new projects being slowed, due to fresh Custom duties being imposed. There are amendments to the Customs Act 1962, which could also greatly impediment all the good work done to simplify processing of documents online/paperless, over the past 3 years, by the CBIC. The role played by CBIC, in achieving this goal was acknowledged by the Hon. Finance Minister in her budget speech. The Chamber is studying the Fine Print of the Finance Budget and shall be making representations with suitable suggestions, requesting the Hon. Minister of Finance to reconsider certain amendments to the Customs Act 1962. In order to Make in India becoming a reality. It is also being suggested, accountability on Service Providers to reduce Transaction Handling Cost, which in India is the highest at 14.5% and Globally its 7.5%, Under the Cargo Handling Rules 2009, be addressed on a war footing. We are glad that finally the Economist/Businessmen are not giving that much importance to the Fiscal Deficit. As long as the Economy grows and inflation is reasonably under control with productive expenditure, we can well live with this deficit.

Export subsidies not yielded results; still India's exports on track: Piyush Goyal NEW DELHI: Promoting exports through subsidies has not really given the desired results, but the government's RoDTEP scheme is helping grow exports which is expected to reach a record USD 400 billion this y e a r, C o m m e r c e a n d I n d u s t r i e s Minister Piyush Goyal said recently in the Rajya Sabha. Goyal, while responding to a query during the Question Hour in the Upper House on cut in budget for export promotion schemes, said the government has found "very good acceptance" of the RoDTEP (Remission of Duties and Taxes on Export Products) scheme. "Based on that (RoDTEP), exports have also been growing," he said. While there is a thinking that the government has reduced the export subsidies, the Goyal said the reality is this year, India is going to see a "record performance in exports". "We are already crossed USD 334 billion (one billion is equal to Rs 100 crore) of exports, which is higher than

any full year ever in the past, and we are well on track to go to USD 400 billion export in the current year," he said. In August 2021, the government had announced the rates of tax refunds under the RoDTEP for 8,555 products, such as marine goods, yarn and dairy items. It has set aside Rs 12,454 crore for refunds under RoDTEP scheme for the current fiscal. Holding that no country in the world can survive beyond the point of time only on subsidies to promote exports, the minister said: "India over a period of time has been promoting exports through subsidies, but that has not really given us the desired result or given us the huge impetus that one would have expected." In fact, the reality is that every nation has certain products and services which are its strength. Every theory in the world says the focus should be given only on those export products having competitive strength, he said.

Goyal further said India has moved more into an interconnected world, where such subsidies are actually not even permitted under the WTO. There have been bad instances that India has been dragged before the World Trade Organisation (WTO) on export subsidies. "Therefore, our approach is that we reimburse the taxes or cess or duties that are notified on the product by the states. As far as the central government is concerned, usually most products are under the GST (Goods and Ser vices Tax) and it automatically gets refunded when you export the product," he said. If there is any other tax which is levied on any export product, which is not marketable or reversible in the form of return, that is given back to the exporters under the RoDTEP scheme, he added. The minister also urged all the states to support economic activity through exports and create jobs in the system.

Government takes several steps to boost Indian exports highlights MoS Commerce NEW DELHI: The Minister of State in the Ministry of Commerce and Industry, Smt. Anupriya Patel, has i n f o r m e d t h e Pa r l i a m e n t t h a t Government has taken the following measures since 2014 to boost the India’s export: i. A new Foreign Trade Policy (FTP) 2015-20 was launched on 1st April 2015. The policy, inter alia, rationalised the earlier export promotion schemes and introduced two new schemes, namely Merchandise Exports from India Scheme (MEIS) for improving export of goods and ‘Services Exports from India Scheme (SEIS)’ for increasing exports of services. Duty credit scrips issued under these schemes were made fully transferable. ii. The mid-term review (2017) of the Foreign Trade Policy (2015-20) was carried out and corrective measures were undertaken. iii. Foreign Trade Policy (2015-20) extended by one year i.e. upto 31-3-2022 d u e t o t h e C OV I D - 1 9 p a n d e m i c situation. iv. A new Logistics Division was created in the Department of Commerce for integrated development of the logistics sector. v. Interest Equalization Scheme

on pre and post shipment rupee export credit was introduced from 1.4.2015 to provide cheaper credit to exporters. vi. T h e G o v e r n m e n t s t a r t e d implementing a NiryatBandhu Scheme with an objective to reach out to the new and potential exporters including exporters from Micro, Small & Medium Enterprises (MSMEs) and mentor them through orientation programmes, counselling sessions, individual facilitation, etc., on various aspects of foreign trade for enabling them to get into international trade and boost exports from India. vii. Assistance provided through several schemes to promote exports, namely, Trade Infrastructure for Export Scheme (TIES) and Market Access Initiatives (MAI) Scheme. viii. A comprehensive “Agriculture Export Policy” was launched on 6th December, 2018 to provide an impetus to agricultural exports. ix. A Central Sector Scheme, ‘Transport and Marketing Assistance for Specified Agriculture Products’ was launched for providing assistance for the international component of freight to mitigate the freight disadvantage for the export of agriculture products. x. Remission of Duties and Taxes

on Exported Products (RoDTEP) scheme and Rebate of State and Central Levies and Taxes (RoSCTL) Scheme have been implemented with effect from 01.01.2021. xi. Common Digital Platform for Certificate of Origin has been launched to facilitate trade and increase Free Trade Agreement (FTA) utilization by exporters. xii. 12 Champion Services Sectors have been identified for promoting and diversif ying ser vices exports by pursuing specific action plans. xiii. Districts as Export Hubs has been launched by identifying products with export potential in each district, addressing bottlenecks for exporting these products and supporting local exporters/manufacturers to generate employment in the district. xiv. Active role of Indian missions abroad towards promoting India’s trade, tourism, technology and investment goals has been enhanced. xv. Package has been announced in light of the COVID pandemic to support domestic industry through various banking and financial sector relief measures, especially for MSMEs, which constitute a major share in exports.

Gati Shakti Masterplan will be the main focus: MoRTH Secretary NEW DELHI: MoRTH Secretary and Chairperson of the National Highways Authority of India (NHAI) Giridhar Aramane explained how the Gati Shakti plan, announced during the Union Budget recently, will be the primary focus followed by integrated planning all across the Board. The former is expected to bring together energy and speed into the sector, thanks to the resources being pumped by the government. The latter will ensure easier living for the common man, make industries more competitive and make exports cheaper than before. The budget allocation for the MoRTH this year has been increased by 70 percent, especially for the road sector.

On the topic of NHAI’s aim of building 25,000 km of national highways, Aramane said that there were slowdowns earlier due to Covid-19, but they have an aim of building 12,00013,000 km per annum. By January 31, NHAI had built around 7,000 kilometres of road, but the target for this year seems to be in sight with a total of 11,500 kilometres by March. He also said that the 25,000 kilometres of road are being built to connect all the major infrastructure developments happening simultaneously, to make the connection between new airports, ports and other industrial points of interest stronger. In fact, NHAI hopes to provide

four-lane connectivity to most ports. He further spoke about how most of the borrowings were made for the Bharatmala plan, which consists of 23odd expressways. To generate further revenues, NHAI will take over highway projects from state Public Works Departments (PWDs), which is sure to bring in more toll revenues. Just last year, NHAI collected Rs 29,000 crore through toll revenue. For 2022-23, this figure is expected to go to Rs 35,000 crore and in the next three years to Rs 50,000 crore. This is down to the fact that there will be an increase in number of vehicles plying on the roads.

Indian Exports to China witness growth : MoS Commerce NEW DELHI: The Minister of State in the Ministry of Commerce and I n d u s t r y, S m t . A n u p r i y a Patel, informed the Parliament that exports from India to China have increased from USD 13.33 billion in 201617 to USD 21.19 billion in 202021, exhibiting growth. The trade with China was USD 87.07 billion in 2018-19, which registered a decline in 2019-20 to USD 81.87 billion, and was USD 86.40 billion in 2020-21. The Government of India has made sustained efforts to achieve a more balanced trade with China, including bilateral engagements to address the non-tariff barriers on Indian exports to China. The Government has also taken measures in form of trade remedies (Anti-dumping, countervailing duty etc.) against unfair trade practices and formulated technical regulations and also issued quality control orders to check substandard imports. Efforts have also been made to source critical

supplies from alternate sources and sensitize the concerned ministries/departments to ramp up domestic capacities. The Government has also launched schemes such as Production Linked Incentive Schemes (PLIs) to promote domestic manufacturing capacities in critical sectors such as Key Starting Materials(KSMs)/Dr ug Intermediates(DIs), Active Pharmaceutical Ingredients(APIs), domestic manufacturing of Medical devices, and for Pharmaceuticals apart from electronic components & mobiles, white goods (ACs and LEDs), Specialty

S t e e l , Fo o d P r o c e s s i n g industry, High efficiency Solar PV modules, Drones and Drone Components etc. These schemes will promote domestic manufacturing capacities and attract investment and reduce dependency on imports from China. Government of India follows a multi-pronged strategy to promote trade in services, which involves negotiating meaningful market access through multilateral, regional and bilateral trade agreements, trade promotion through participation in and organization of international fairs/exhibitions and addressing domestic sectoral challenges and difficulties which are identified through periodic consultations with the stakeholders. Moreover, efforts are made to engage with the nodal Ministries/Departments to pursue a domestic reform agenda to make the services sector competitive globally.

Freight rates flat in line with diesel; utilisation up: Crisil MUMBAI: Freight rates were unchanged on-quarter in January 2022, tracking largely flat diesel prices. Utlisation levels improved onquarter for bulk goods such as mining (driven by coal and iron ore mine dispatches) as well as for industrial goods such as cement and steel driven by revival of construction activities. However, for consumption goods, utilisation was range-bound due to the rapid spread of Covid-19 infections, said Crisil Research in a report. The close correlation of freight rates with diesel prices is because the fuel contributes 50-60% of the input cost of transport operators. "While there was a marginal uptick in freight rates on most routes, aggregated increase in rates was less than 1% on-quarter. Also, there was no change in freight rates on 10-15% of the

routes," the report said. On the dispatches front, there was improvement in mining products, such as coal, iron ore, limestone, etc, vis-à-vis a lull over the previous two months. Relatively better dispatches for retail as well as industrial petroleum derivatives also led to better realisations for tanker operators. "Freight rates were flat sequentially in January 2022, largely because of relatively unchanged fuel prices over the past two months. This led to stabilisation of the freight market," said Crisil. The flat freight rates were despite utilisation levels improving on-quarter for bulk goods, such as mining products, cement, etc. "Dispatches for consumer goods, though, were flat on-month, slightly impacted by rapidly rising Covid-19 infections. That said, the rise in infections had relatively marginal

impact on consumer goods dispatches compared with the sequential plunge during the second wave," the report added. In fact, this time around, the buoyant bulk and industrial goods segments offset the inertia faced in utilisation levels in the consumption goods segment. "All this translated into the CRISFrex Index remaining flat onquarter in Januar y 2022, at 120. Although, improving utilisation levels (especially in the bulk segment) have resulted in the industry ’s overall margins inching up to ~21% vis-à-vis ~20% in the previous month. But given the unpredictable nature of the pandemic, it is imperative to observe the freight rates as well as utilisation levels for the next 1-2 months as market dynamics could change rapidly," it noted.

Simplification of key indirect tax amendments will support Make in India, MSMEs and Exports : CBIC Chief NEW DELHI: Some of the key indirect tax amendments announced in the union budget directed towards bringing simplification will support Make in India, MSMEs and exports, such as simplification of customs tariff structure, elimination of 500 exemption entries from the

customs tariff, rate rationalization under customs, said Vivek Johri, Chairperson, CBIC. He was speaking at FICCI’s virtual post budget interactive session. “Amendment in the customs act to plug operational gaps to align customs provisions in line with

Supreme Court judgement in the case of Canon India, recognizing publishing of data declared in bill of entry/shipping bill as an offence, aligning tariff in line with HS 2022, digitisation of process relating to import of goods at concessional rate of customs duty are some of the additional changes,” he added.

Thirty-Nine (39) Towns have been recognized as Towns of Export Excellence (TEE) under the Foreign Trade Policy NEW DELHI: Thirty-Nine (39) Towns have been recognized as Towns of Export Excellence (TEE) under the Foreign Trade Policy 201520 (extended up to 31.03.2022). Towns of Export Excellence (TEE) can avail benefits under Para 1.35 (b) of Foreign Trade Policy i.e. (i) Recognized associations of units in Towns of Export Excellence

can avail financial assistance under Market Access Initiative (MAI) scheme, on priority basis, for export promotion projects for marketing, capacity building and technological services. (ii) Common Service Providers in the Towns of Export Excellence are entitled for Authorisation under Export Promotion Capital Goods

(EPCG) Scheme. Towns producing goods of Rs. 750 Crore or more can be recognised as Towns of Export Excellence (TEE) based on potential for growth in exports. However, for Town of Export Excellence (TEE) in Handloom, Handicraft, Agriculture and Fisheries sector, the threshold limit is Rs.150 Crore.

Government is committed to increase the tonnage under Indian flag NEW DELHI: The Government is committed to increase the tonnage under Indian flag. The major steps taken by the Government in this regard are as below: (i) Revision of the criteria for Right of First refusal (ROFR): The criteria for granting the Right of First Refusal in chartering of vessels through tender process has been revised through Directorate General of Shipping, Mumbai, DGS Circular No. 02 of 2021, for promoting tonnage under Indian flag and shipbuilding in India, so as to make India an Atma-nirbhar/selfreliant Bharat, in terms of tonnage and ship-building in India. DGS Circular No. 02 of 2021 is at Annexure. The following is the revised hierarchy of RoFR with highest priority to India built, Indian flag (Indian owned) vessels; (1) Indian built, Indian flagged (Indian owned); (2) Foreign built, Indian flagged (Indian owned); (3) Indian built, foreign flagged (foreign owned). This will promote demand of Indian built and Indian flag vessels as the Indian built and Indian flag vessels will have the priority in chartering and will also provide additional market access and business support to ships built in India. ( i i ) S h i p B u i l d i n g Fi n a n c i a l Assistance Policy (2016-2026): Government of India has approved the Financial Assistance

The details of tonnage capacity of the country in the last three years are as below:

Policy for Indian Shipyards on 9th December 2015, for grant of financial assistance to Indian Shipyards. Only those vessels shall be eligible for grant of financial assistance, for which the construction commences subsequent to the signing of valid c o n t r a c t s . Ve s s e l s w h i c h a r e constructed and delivered within a period of three years from the date of contract are eligible for availing financial assistance under the policy. For specialized vessels, the delivery period can be extended till six years. Financial assistance shall be @ 20% of the contract price, actual receipts, fair price (whichever is least) to Indian shipyards. Under the policy, the financial assistance extended would be reduced by 3% every three years. (iii) Subsidy support to Indian shipping companies: A scheme for the promotion of flagging of merchant ships in India by providing Rs.1624 crore over a period of five years as subsidy support to Indian shipping companies in global

tenders footed by Ministries and Central Public Sector Enterprises (CPSEs) has been approved by the Cabinet. The rate of subsidy support will be based on age of the vessel. (iv) Protection to Indian Flag vessels during engagement of foreign ships: Indian and Foreign entities intending to engage foreign flag vessels for coastal trade of India need to have a license under section 406 of Merchant Shipping Act, 1958 from DG Shipping, GoI. The DGS issues license to such foreign flag vessel only after ensuring that no Indian vessel is available for such trade/function to be performed by foreign flag vessel. Accordingly, Indian ships are given priority above foreign ships for such transportation. Because of this facility, these entities and even shipping companies make an effort to own or register vessels under Indian flag. This helps in increasing the Indian shipping tonnage.
