Shipping Ministry issues “Coastal Shipping Bill, 2020” draft for public suggestion NEW DELHI: In accordance with Prime Minister Shri Narendra Modi’s vision for augmenting people’s participation and transparency in the governance, Ministry of Shipping has issued the draft of Coastal Shipping Bill, 2020 for suggestions from the stakeholders and general public. As the shipping sector grows and evolves in the country, a need was felt to have a separate legislation on coastal shipping, which considers it an integral part of the transport chain and recognizes the policy priorities of the sector to meet the demands of the Indian shipping industry. While drafting this Bill, the global best practices have also been considered. The Ministry of Shipping has drafted a Coastal Shipping Bill, 2020 in lieu of part XIV of the Merchant Shipping Act, 1958. Some of the highlights of the Bill are following:

•

The definition of coastal shipping and coastal waters has been expanded. • It is proposed to do away with the requirement of trading licence for Indian flag vessels for coastal trade. • The Bill seeks to create a competitive environment and reduce transportation costs, while encouraging Indian vessels to increase their share in coastal shipping. • The Bill also proposes integration of coastal maritime transport with inland waterways. • There is a provision for a National Coastal and Inland Shipping Strategic Plan. The draft bill is uploaded on the Ministry of Shipping’s website. Citizens can submit their suggestions and opinions regarding the draft bill to coastalshipping2020@gmail.com latest by 06.11.2020.

The CMA CGM CHAMPS ELYSEES joins the fleet: Second 23,000 TEUs Container vessel to be powered by LNG MARSEILLE: The CMA CGM CHAMPS ELYSEES has joined CMA CGM Group’s fleet, a world leader in shipping and logistics, as well as the CMA CGM JACQUES SAADE, the Group’s new flagship, the world’s largest container vessel powered by liquefied natural gas (LNG). The vessel was then blessed and officially named by her Godmother, Dany Qian, Vice President SSE at Jinko Solar, who wished the ship, the captain and its crew the best of luck on their future voyages with the traditional words “May God bless this ship and all who will sail on her”. LNG, a pioneering choice aimed at preserving air quality and driving the energy transition Today, LNG is the most advanced solution when it comes to preserving air quality. It enables a 99% reduction in sulfur dioxide and fine particle emissions, and an 85% reduction in nitrogen dioxide emissions, going well above and beyond existing regulation. LNG emits up to 20% less CO2 compared to fuel motorization. This technology is one of the first step towards achieving CMA CGM Group’s ambitious 2050 objective of carbon neutrality. Innovation-packed vessels, the result of 7 years of research and development from CMA CGM experts These nine vessels are packed with innovations, the result of a long cooperation between CMA CGM’s research and development experts and industrial partners. In addition to LNG engines, these vessels feature state- of-the-art technologies, with a cockpit featuring the latest digital onboard technology to assist the captain and crew, especially during port maneuvers; or a straight bow with integrated bulb, rudder and

propeller with a redefined design that improves their hydrodynamics, thus reducing energy consumption. These 9 vessels bear a specific “LNG Powered” label that will be recognizable on all seas across the globe. CMA CGM pioneers France’s LNG eld of excellence in maritime transport The CMA CGM CHAMPS ELYSEES, along with its eight 23 000 TEU sister ships (twenty-foot equivalent unit), including the CMA CGM JACQUES SAADE, will be registered at the French International Register (FIR). They will bear the names of landmark Parisian monuments and other renowned venues and institutions from throughout the French capital (Champs Elysées, Palais Royal, Louvre, Rivoli, Montmartre, Concorde, Trocadéro, and Sorbonne).

Antwerp Port to use Drones for controlling port area ANTWERP: Drones will be used to support enforcement and control in the Antwerp port area. To this end, Port of Antwerp and the European Maritime Safety Agency (EMSA) have joined forces. Use of drones for enforcement The port of Antwerp covers more than 120km² and contains sensitive industrial infrastructure. The use of drones can make a major contribution to overall safety in this complex environment. After all, drones enable port authorities to manage, inspect and supervise a large area quickly and safely. This is why Port of Antwerp, in collaboration with the FPS Mobility and Transport, has concluded an agreement with EMSA. The drone pilot will accompany Port Authority Officers during their enforcement tasks, and provide them with a bird's-eye view of the situation on the ground. The images can also be accessed remotely, so they can be shared quickly with emergency services if necessary. Privacy is paramount here: the images are only used for monitoring purposes and are not stored. The drone will not only be used during regular checks, but also in the event of incidents in order to gain a quick insight into the situation. The imagery of oil incidents will also be used by the University of Antwerp to train algorithms to automatically detect oil incidents in the future.

Increasing role of drones According to Port of Antwerp, the use of drones will play an increasingly important role in the port of the future. As part of Port of Antwerp's participation in the SAFIR project, extensive tests have already been carried out to investigate the feasibility of manned and unmanned drones at the port. The ultimate goal of these projects is a network of autonomous drones that can provide a ‘live feed’ of the various port activities, in the context of a smart, safe and efficient port. Paul Wauters, Harbour Master at Port of Antwerp: “This collaboration with EMSA allows us to use new technologies in our enforcement, in order to respond to incidents more quickly and to create a safer port for port users.” Port alderman Annick De Ridder: “We are doing everything we can to ensure a safe port and drones will become indispensable for this in the near future, including at our port. Innovation is crucial to guarantee the sustainable growth of our port in the long term. This collaboration also confirms that the port is the ideal environment in which to test and further develop innovative technology.”

GOVERNMENT OF INDIA, MINISTRY OF FINANCE, DEPARTMENT OF REVENUE, CENTRAL BOARD OF INDIRECT TAXES AND CUSTOMS ROOM NO.49, NORTH BLOCK, NEW DELHI F. No.473/03/2015-LC

Dated : 27th October, 2020

CIRCULAR NO. 48/2020-CUSTOMS Sub. :Manufacturing and other operations undertaken in bonded warehouses under Section 65 of the Customs Act, 1962-reg. Section 65 of the Customs Act, 1962 provides that the owner of any warehoused goods may carry on any manufacturing process or other operations in the warehouse in relation to such goods, with the permission of the Principal Commissioner of Customs or Commissioner of Customs and subject to such conditions as may be prescribed. Manufacture and Other Operations in Warehouse (no.2) Regulations 2019, were issued vide Notification No.69/2019-Customs (N.T.) dated 01.10.2019, hereinafter referred to as, "MOOWR, 2019" prescribing the procedure, documentation and compliances to be followed under Section 65 of the Customs Act, 1962. 2. Board has from time to time received suggestions and requests from members of the trade and industry on the scheme of Manufacturing and other Operations in a Warehouse under Section 65 of the Customs Act, 1962. The requests revolve around making the scheme more investor friendly and seeking more clarity with regard to certain aspects. A Committee was therefore constituted by the Board to study the provisions of Section 65 of the Customs Act, 1962 and the regulations issued there under and make recommendations for consideration of the Board. The committee has since submitted its report. 3. The issues raised by the trade and the recommendations of the Committee have been examined. To bring in greater regulatory clarity and certainty for investors, Board has decided to clarify the following issues: (i) Job work for a Section 65 unit: Trade has sought clarity on the goods eligible to be sent for job work and the procedure to be followed for removal of goods for job work by a Section 65 unit. Clarification: Circular No. 34/2019-Customs dated 1st October 2019 had provided, in Annex B (Form to be maintained by a unit operating under section 65 of the Customs Act, 1962 for the receipt, processing and removal of goods) for removal of goods from a Section 65 unit for job work and receipt after job work, as part of the manufacture or other operations. Thus, only inputs are allowed to be sent out from a Section 65 unit for job work. The capital goods can be sent outside the Section 65 unit for repair, with the permission of the bond officer. The job work shall be subject to the following conditions: i. The goods upon import should be first deposited in the Section 65 premises and duly accounted for before the same is sent for job work. ii. It should be possible to establish the identity/ correlate the goods after job work with those sent for job work. iii. On completion of the job work, the goods can be brought back to the Section 65 unit or exported/ cleared to DTA from the job worker's premises. In case the goods are exported/ cleared to DTA from the job worker's premises, the procedure as per Regulations 14 and 15 of MOOWR 2019, as applicable shall be followed and the date of removal from job workers premise shall be deemed to be the date of removal from the warehouse. iv. Scrap, waste or remnants generated during the job work shall be either returned to the Section 65 unit or cleared from job-worker's premises on payment of applicable duties. v. The procedure and timeline for the return of goods sent for job work under Section 65 unit will be in line with GST provisions, as the Section 65 Unit is also a GST registrant. vi. The account to be maintained under Circular No. 34/2019-Customs dated 1st October 2019 will be kept updated as regards job work at all times. Trade has also requested that moulds, jigs, tools, fixtures, tackles, instruments, hangers, patterns and drawings be allowed to be sent to the job workers premises for use in the job work. Considering the nature of goods sought to be removed from a Section 65 unit for the purposes of job work, Board has decided to allow the said goods viz moulds, jigs, tools, fixtures, tackles, instruments, hangers, patterns and drawings to be sent to the premises of a job worker, subject to due accounting of the goods by the Section 65 unit in the account specified. Such goods will be used by the job worker exclusively for the concerned Section 65 unit. The procedure and timeline will be in line with the GST provisions. It may also be noted that the bond to be executed by a Section 65 unit, prescribed through the aforementioned circular, stays in full force notwithstanding the removal of goods for job work from a Section 65 unit. In case of violation of any of the above provisions, the goods shall be deemed to be cleared for home consumption on the date of clearance of the goods for job work. The applicable duties, interest and penalties shall be reckoned accordingly. (ii) Job work for others by a Section 65 unit: Trade has sought clarity on whether the Section 65 unit can itself carry out job work for other units and the procedure to be followed for the same. Clarification: The issue has been examined with a view to enhance capacity utilization and acknowledging the realities of manufacturing environment where various units support each other in producing the final product. It is clarified that a Section 65 unit being a GST registered unit, can perform job work operations and shall maintain due accounting of such job work as per the provisions of GST law. In case any imported inputs which are warehoused are consumed during the job work process, duty shall be paid on such goods (i.e. the warehoused goods) by filing Ex-Bond Bill of Entry, when such job worked goods are returned to the principal/owner. In case the goods after job work are exported from the premises of the Section 65 unit, the import duty on the warehoused goods used for the job work need not be paid as per section 69 of the Customs Act, 1962. (iii) Whether a Section 65 unit can procure goods from FTWZ: Circular 34/2019-Customs dated 1st October 2020, does not explicitly mention sourcing of goods from FTWZ. Hence there is apprehension on whether such sourcing is allowed. Clarification: Vide para 14 of Circular No. 34/2019-Customs dated 1st October 2020, Board has clarified that the objective of Section 65 is to enable manufacture and other operations in customs bonded warehouses. For this purpose, the units should be able to procure required raw materials, consumables, capital goods etc., imported or procured from domestic market. There are no restrictions imposed on sourcing of goods by units operating under Section 65. Moreover, the units are GST registrants, which are also allowed to procure goods from SEZ/FTWZs. In view of the foregoing, it is clarified that a Section 65 unit may source capital goods or inputs from a SEZ/FTWZ, following the applicable procedures. 4. The above provisions may be given wide publicity through issue of Public Notices. 5. Any difficulties faced in the implementation of this Circular may please be brought to the notice of Board. Sd/Temsunaro Jamir Additional Commissioner (ICD)

Economic recovery faster than expected, confident of meeting $5-trillion target by 2024 : Prime Minister Narendra Modi Cont’d. from Pg. 3

He also expressed confidence that the target of making India a USD 5-trillion economy will be achieved by 2024, saying that the crisis gave the government an opportunity to carry out

reforms that were waiting to happen for decades but no one earlier took the initiative. “Reforms across sectors such as coal, agriculture, labour, defence, civil aviation and so on have been

undertaken which will help us get back on the high growth path that we were on before the crisis,” Prime Minister Narendra Modi was quoted as saying in a recent interview given to a media house.

Railways nalises major upgrade plan to focuses on faster freight movement to spur growth in next 10 years NEW DELHI: Faster and seamless freight movement is the new focus of the government to accelerate economic growth in the next 10 years. While the Indian Railways has finalised a major upgradation plan to increase the freight loading to 3,200 million tonnes (MTs) or by more than two-and-half times by 2030, the shipping ministry has set the target to increase cargo handling capacity of all ports to 2,200 million tonnes, an increase of nearly two-fold. The road transport and highways ministry has also set the target to build nearly two dozen expressways and greenfield highways with combined length of 7,800 km to provide signal free connectivity from production hubs to major consumption centres by 2025. Sources said according to the National Rail Plan-2030, the national transporter has estimated that the

passenger growth is likely to go up by 50% to touch 12 billion annually by 2030. It also envisages investment of Rs 50 lakh crore in the next decade for this massive plan, which includes the upgradation of all rail tracks connecting the Golden Quadrilateral and Golden Diagonal to allow trains to run at 160 kmph and double the average speed from the current 25 kmph to 50 kmph. Officials said all these plans by three major transportation related ministries are aimed at reducing the logistics cost, which is currently 13% while the global benchmarking is about 5-6%. Railway board CEO V K Yadav had recently told reporters that railways planned to construct four more dedicated freight corridors (DFCS) taking the total length to nearly 6,800 km for faster movement of goods. The government has set the target for railways to increase its modal share to

45% in transportation compared to the current share of 26%. According to the Maritime Plan-2030 of the shipping ministry, the ministry has set the target to augment the capacity of existing ports and develop a few ports so that at least 2,200 MTs of cargo can be handled by 2030. In 2019-20, all ports handled about 1,320 MTs. As per the plan, the capacity of three big ports would be increased to handle more than 300 MTs per annum in the next 10 years. Currently Deendayal port (Kandla) handles a maximum of 261 MTs in a year followed by Paradip (233 MTs) and Mundhra (225 Mts). The plan also includes increasing the drafts of three more ports to 18 metres to take the total numbers to five. Another major thrust area is to reduce the vessel turnaround time in the case of containers from the current 32 hours to 20 hours by 2030.

2nd NOVEMBER 2020 19

Uttar Pradesh to come up with New Export Policy to encourage Exports from State LUCKNOW: Aiming to achieve a one-trillion-dollar state economy, the Uttar Pradesh plans to come up with a new export policy to encourage such endeavour from businesses operating in the state. The new policy will aim to increase the exports from present Rs 1.20 lakh crore to Rs 3 lakh crore annually by extending several incentives to the exporters in Uttar Pradesh. In order to ensure that exports increase as per the targets, the Uttar Pradesh governemnt plans to focus on sectors with high potential. The state houses around 18 per cent of India’s population, comprising a significant number of youths who are valuable human resource for industry. Also, the state has a large number of Micro, Small and Medium Enterprises. The state offers potential for increased

exports of various handicrafts in the global market. H o w e v e r, d e s p i t e t h i s h u g e potential, the state’s contribution to the Indian exports is only 4.55 per cent per annum. It is keeping in mind this situation that the state is now focusing on bringing in a new policy to boost exports. Companies which ferry goods from ports to neighbouring countries will be given subsidy in transport whereas the electricity duty of MSMEs which export 50 per cent of their production will be waived. A common facility centre would be set up under the Uttar Pradesh Export Development Scheme to provide the facilities of processing and packaging of products to different companies under one roof. Similarly, holding of buyer-seller meetings and providing facilities to

export-oriented units in exhibitions across the world are also on the anvil. The Uttar Pradesh government also plant to extend financial help to exporters for getting necessary certification for exports to the European Union and China. In every district, Export Development Centre will be set up in line with their potential for exports in different products. These centres will act as hubs to provide necessary assistance to exporters obtain necessary approvals and permissions from authorities concerned. Fe d e r a t i o n o f I n d i a E x p o r t s Organisations will be a knowledge partner in this endeavour. The District Magistrate concerned will head these export hubs to ensure coordination between export councils and export promotion committees in their respective districts.

DGFT permits Potato Imports from Bhutan without licence NEW DELHI: The Government has recently permitted imports of potatoes from Bhutan without licence, a move aimed at boosting domestic supply and control prices of the agricultural commodity. The imports are allowed without licence only up to January 31, 2021, the Directorate General of Foreign Trade (DGFT) said in a notification. Imports of potatoes, otherwise, fall in the restricted category, which means

that an importer requires a licence from the DGFT for the inbound shipments. But, the government recently partially relaxed the import norms. “Import of potatoes…is allowed for import from Bhutan without licence up to January 31, 2021,” it said. In a public notice, the Directorate has laid out the procedure for import of potatoes under the TRQ (tariff rate quota) scheme. According to the procedure, only one

application against one IEC (import export code) will be considered and successful applicants will have to ensure that the import consignment reaches the Indian ports on or before January 31 next year. Consumer Affairs Minister Piyush Goyal, who also holds the commerce portfolio, said 30,000 tonnes of potato is being imported from Bhutan in order to improve the local supply and control prices of the key commodity.

China is biggest Importer of Indian steel in H1FY 2021 NEW DELHI: China was the biggest buyer of Indian steel in the first six months of the current financial year, accounting for 29% of Indian steel exports during the period. The spurt in bilateral trade activity comes even as the armies of the two countries have been engaged in a face-off at the border in Ladakh since July. China bought 1.9 million tonnes of India’s 6.5 million tonnes steel exports during April-September, the highest in at least six years, a Reuters report said.

The country had imported a mere 2,500 tonnes from India in the same six-month period last financial year. Vietnam was the second-largest importer of Indian steel, buying 1.6 million tonnes. India’s steel exports during the period were mostly of hot-rolled coils, a flat steel product used to make pipes, automobile parts, and engineering and military equipment. “Many Indian steelmakers exported vast quantities of semis to China last few

months,” an executive with an Indian private steelmaker told Mint. Semis are used to make finished steel. The rise in steel exports to the world’s second-largest economy comes even as the Indian government has imposed curbs on imports from its neighbour. This includes imports of steel from China, the world’s largest producer and consumer of the alloy. India has also enhanced scrutiny of foreign investment coming from China.

Forex reserves surge $5.4 billion to all-time high of $560.532 billion MUMBAI: The country's foreign exchange reserves swelled by $5.412 billion to touch an all-time high of $560.532 billion in the week ended October 23, RBI data showed on October 30. In the previous week ended October 16, the reserves stood at $555.12 billion after increasing by $3.615 billion.

During the reporting week, the surge in the forex kitty was mainly on account of an increase in foreign cur rency assets (FCA), a major component of the overall reserves. FCA rose by $5.202 billion to $517.524 billion, the RBI's weekly data showed. Expressed in dollar terms, the

foreign currency assets include the effect of appreciation or depreciation of non-US units like the euro, pound and yen held in the foreign exchange reserves. The gold reserves were up by $175 million in the reporting week to $36.860 billion, as per the central bank data.

Indian Register of Shipping classes rst Indian owned LNG-FSRU for Triumph Offshore MUMBAI: Indian Register of Shipping (IRClass), an international ship classification society, has classed India’s first LNG-FSRU (Floating Storage Regasification Unit) marking a milestone in India’s energy shift towards natural gas. Constructed at Hyundai Shipyard in Ulsan, South Korea, the 180,000 cu.m FSRU which is flagged in India, is designed for continuous operations without the need for drydocking over a period of 20 years. The unit is assigned class notation for 20 years extended interval between successive dry-dockings and complies with the requirements of IRClass Rules and Indian Flag for this purpose. The unit is owned by Triumph Offshore Pvt Ltd., a wholly owned subsidiary of Swan Energy Ltd, an India-based listed company. The vessel can operate in two distinct modes – LNG Carrier Mode and Floating Storage Regasification Unit (FSRU) mode. This allows the utilisation of a FSRU for receiving LNG from LNG carriers, regasification of the LNG and sending it out. The vessel complies with the recently updated Rules of IRClass applicable for LNG carriers provided with regasification systems and takes into account various risks associated with such systems by appropriate risk control measures. The updated IRClass Main Rules for Seagoing ships, covers the requirements for regasification systems in a separate chapter addressing various aspects such as systems design,

fire safety, emergency shutdown arrangements, survey and testing requirements etc. The vessel has also been verified with respect to the requirements of the IGC Code and IRClass Rules for Gas carriers. W i t h s t r o n g government support and improved infrastructure in India, the prospects for natural gas are expected to rise significantly to meet growing energy demands in the country. This is also in line with the Indian government vision to build a gas-based economy and increase the share of natural gas in the primary energy mix to 15% by 2030, up from 6% today. This will also contribute towards IMO’s aim of reducing GHG emissions. “As we anticipate energy demand to soar in India, it is important to move towards the use of clean energy to meet that need. Undertaking this project demonstrates our commitment towards a greener future, and we at IRClass are delighted to play an essential role in meeting that goal.” Commented IRClass’ Joint Managing Director Vijay Arora.

The fund proceeds were used towards prepayment of NCDs totalling to Rs. 118.19 Crores (including interest). The consolidated debt has now reduced from Rs. 681 Crores as on March 31, 2020 to Rs. 509 Crores as on 30th September 2020. Business Restructuring In September 2020, the Board of Directors of the Company have approved the proposed composite scheme of amalgamation to reverse merge Gateway Distriparks Limited (GDL) into its subsidiary Gateway Rail Freight Ltd (GRFL). Post this restructuring exercise, GDL would be delisted and GRFL would be listed and renamed later. The rationale behind the business restructuring is to drive operational synergies and cost efficiencies, improve cash flows and debt servicing ability of the new merged entity GRFL and reduce statutory and regulatory compliances. This step goes in line with company's yearlong effort targeted to unlock value while aggressively eyeing reduction of debt.

Commenting on the performance, Mr. Prem Kishan D a s s G u p t a , C h a i r m a n & M a n a g i n g D i r e c t o r, commented, “First I would like to thank our shareholders for supporting the rights issue. Through our internal accruals and money raised through rights issue, we have completed prepayment of A1 series NCDs totalling to Rs. 250 crores since January 2020. This significant deleveraging of our balance sheet will allow us to focus on future growth opportunities through capex towards satellite rail terminals.

The business restructuring will enhance our future cash flows significantly and provide us flexibility for ramping up our business operations. The new structure will enable us to grow our Rail intermodal logistics business faster and capitalize on new growth opportunities. This restructuring enables the company to realize its full potential, whilst rationalizing the cost base which will create value for all our shareholders. Restructuring will also enable us to remain focused on operational and technological advances to maintain and extend our leadership positions. Industry dynamics dictates that rail transport will continue to gain transportation share at the cost of the road mode. Government also recognises that modal shift from road to rail freight has significant potential to help improve efficiency for transportation of goods as well as reduce carbon emissions. Ministr y of Railways recently announced that it is proactively taking efforts and working aggressively to attract wider share of freight with an aim to increase its modal share of freight to up to 40%. This shall benefit us due to our multimodal capabilities to cater our customers who are increasingly demanding integrated logistics solutions. The performance for the quarter has been as per our expectations. We continue to see a month on month improvement in business parameters thereby gives us hope of sustained recovery over the future quarters. A robust Balance Sheet combined with our strategically located state of the art infrastructure alongside the Western DFC will help us to capitalize on the future growth opportunities.”
