India, United Kingdom conclude round 1 of free trade agreement talks NEW DELHI: India and the United Kingdom recently concluded the first round of negotiations, for a bilateral Free Trade Agreement (FTA), the commerce and industry said in a Joint Outcome Statement. The talks covered 26 policy areas including trade in goods and services such as financial services and telecommunications, investment, intellectual property, customs, sanitary
and phytosanitary measures, technical barriers to trade, gender, sustainability and geographical indicators. “Both teams maintain a shared ambition to conclude negotiations by the end of 2022- as part of both sides’ efforts to secure a comprehensive agreement,” the ministry said in a statement, adding that the negotiations were “productive”. The negotiations were held virtually for
over weeks and saw the coming together of technical experts from both counties for discussions in 32 separate sessions. India and the UK formally launched negotiations for an FTA earlier this month with an aim to put an interim agreement in place by mid-April followed by a comprehensive deal by the end of the year. The second round of negotiations is due to take place on March 7-18.
India initiates anti-dumping probe against acid from China, Korea NEW DELHI: India has initiated an anti-dumping probe against 'Ursodeoxvcholic Acid', used in the medical field, imported from China and Korea following a complaint by a domestic p l a y e r. T h e c o m m e r c e m i n i s t r y ' s investigation arm Directorate General of Trade Remedies (DGTR) has started the probe into alleged dumping of this acid, which is used as medical therapy in gallstone disease (cholelithiasis) and for biliary sludge.
Arch Pharmalabs Ltd has filed an application before the directorate for initiation of anti-dumping investigation and imposition of the duty, according to a notification of the DGTR. The applicant, it said, has claimed that the injury to the domestic industry is being caused due to dumped imports from China and Korea. The Directorate said that "on the basis of the duly substantiated written application filed by or on behalf of the
domestic industry, and having satisfied itself, on the basis of the prima facie evidence submitted by the domestic industry about the dumping...the authority hereby initiates an investigation". Countries start anti-dumping probes to determine whether their domestic industries have been hurt due to a surge in cheap imports. As a countermeasure, they impose these duties under the multilateral regime of the Geneva-based World Trade Organization (WTO).
India-Uzbek PTA talks gather momentum coinciding with Central Asia summit NEW DELHI: Ahead of the IndiaCentral Asia summit on Thursday, India and Uzbekistan have fast-tracked talks for a bilateral trade pact, the first for India in that region. The first round of joint working group meetings with Uzbekistan was held in the first week of January and the intergovernmental commission on trade is also scheduled this month. “A trade pact with Uzbekistan is of strategic importance, especially after the political changes in Afghanistan,” said an official.
India and Uzbekistan had signed a joint statement in September 2019 to carry out a joint feasibility study for entering into negotiations for a preferential trade agreement (PTA). The proposed PTA will contribute to fast-tracking India’s connectivity to the landlocked region and vice versa. Smoother connectivity will also enable India to boost PTA, said an expert on Central Asia. The PTA with Uzbekistan will also enable India to tap into the markets of Tajikistan and Kyrgyzstan.
The Indo-Uzbek PTA is also expected to contribute to the proposed free trade agreement (FTA) between India and the Eurasian Economic Union. Talks between India-Eurasian Economic Union have gained momentum and negotiations are expected to be held in the near future. The proposed India-Uzbek PTA and FTA between India and Eurasian Economic Union is politically significant, raising India’s stakes in the region. Russia has thrown its weight behind India’s moves to increase presence in Central Asia and Eurasia.

Govt proposes an outlay of Rs 10,000-crore to develop 700 Districts as Export Hubs : Sources NEW DELHI: The Commerce and Industry Ministry has proposed a Rs 10,000-crore scheme to develop 700odd districts of the country as export hubs which will be part of the upcoming foreign trade policy. An announcement to this effect is likely in Budget 2022-23. "The contribution of the Centre will be almost Rs 10,000 crore and the rest would be done by the states. So, the scheme would have a larger outlay," said an official. States' contribution could be Rs 5,000-6,000 crore, according to people aware of the matter. Under the 'Districts as Exports Hub' initiative, products and services with export potential have been identified in
all districts of the country, including agricultural and toy clusters and products with geographical indications. In the next three to five years, the government is aiming at a double-digit export growth from 500 districts of the country. India's merchandise exports surged a record 38.91% year-on-year to $37.81 billion in December 2021 and amounted to $301.38 billion in the April-December period. "District as Exports Hub is an initiative right now, but it doesn't have any budgetary support. A proposal has been made to the finance ministry to launch a new scheme," said the official. Under the initiative, an institutional mechanism has been set up in each
district in the form of District Export Promotion Committees, whose primary function is to prepare and act on district specific export action plans in collaboration with all the relevant stakeholders from the Centre, state and district levels. Besides developing a database of all potential exporters in each district, work is also on to build an interface with the Indian Missions abroad to provide them access to exporters in each district for them to market outside India and find potential buyers. The Centre also plans to assist states and UTs to prepare an annual 'Export Ranking Index' of districts in the respective state to rank each district on its export competitiveness.

Imports, on the other hand, rose 28 per cent to USD 87.5 billion in 2021 as against USD 68.4 billion in 2019. According to the data, the trade deficit has increased to USD 64.5 billion last year as compared with USD 51.2 billion in 2019. Trade experts have stated that India's exports to China have increased at a faster pace than that of its imports from China in 2021 when compared with the normal year of 2019.
Khalid Khan, vice-president of the Fe d e r a t i o n o f I n d i a n E x p o r t Organisations, said the huge export potential is there for Indian exporters in China. "Our exporters are doing quite good in China. We can push our exports further," Khan said. The share of raw material, intermediate goods and capital goods imports from China increased in 2021 as compared to 2019, whereas imports of consumer goods have fallen from 14.7 per cent in 2019 to 10.4 per cent in 2021, another expert said. Pankaj Kapoor, Senior Partner, India Law Offices LLP • Mr. Samir J. Shah, Director, Chartered Institute of Arbitrators, ( CIArb) Today, India accounts more than 10% of world's seaborne cargo. However, it is still not recognized as a maritime nation. With an aim to being a 5 trillion dollar economy by 2025, the maritime sector in India is gearing up to be one of the best maritime locations across the globe. Disputes being an inherent part of any sector, the maritime sector too has its share of trade related disputes. These disputes might range from minor issues to complex jurisdictional claims with several parties involved in the contracts. Due to the popularity and observed benefits of arbitration, such as the privacy of the arbitral process and perceived certainty in the binding nature of arbitral awards, arbitral agreements have grown in use with the increase in international trade.
Despite the size or complexity of the matters involved, parties prefer to opt for alternative, cost effective, and efficacious forms of dispute resolution. It is, therefore, common for contracts – which govern marine adventures and those for the sale of goods – to contain an arbitration agreement, and a set of arbitral rules which will govern the dispute resolution between the parties. There are over 35 arbitral institutions in India, but none with an exclusive focus on disputes related to the maritime and shipping sector. Realising the fact that the absence of an exclusive ADR centre focusing on shipping and maritime dispute resolutions in the country is leading the maritime stakeholders to opt for such global maritime arbitral institutions based out of London, Singapore or Hong Kong at the cost of time money and e n e r g y, t h e G I M A C i s b e i n g d e v e l o p e d b y t h e Government of Gujarat under the ambit of the Gujarat Maritime University. The GIMAC will be housed in the Gujarat Maritime Cluster ecosystem, India’s first services- based commercial maritime cluster that is coming up at the global fintec hotspot - the GIFT City. The GIMAC is equipped with top-class Hearing Rooms, Breakout Rooms, Arbitrators’ Lounge and Business Centre. GIMAC is envisaged to shape the alternate dispute resolution system in maritime and shipping sector in India, with access to the experienced arbitrators, mediators and legal professionals practising in maritime and admiralty law, and professionals from the maritime and shipping sector. GIMAC has now taken up the process empanelment of arbitrators. It aims to be an efficient ADR centre competing at par with other globally renowned maritime arbitration institutions such as London Maritime Arbitrators Association (LMAA), Singapore Chamber of Maritime Arbitration (SCMA), Emirates Maritime Arbitration Centre (EMAC) and others. GIMAC is also working towards requesting the Supreme Court of India (International) and High Court of Gujarat (Domestic) to recognize GIMAC as an Appointing Authority towards appointment of Arbitral Tribunal, in the absence of agreement by Parties. The government is also being requested to nominate GIMAC as the preferred mode of arbitration in all contracts entered into by all the Government Departments. By establishing a trusted global standard for maritime ADR services in India, GIMAC aims to promote awareness of maritime and logistics dispute resolution services to further support the nation as it develops into a favoured maritime destination.
