Covid 19 impact on Total Traffic at Major Ports started from March, recovery began since June : Mansukh Mandaviya NEW DELHI: The cargo traffic at India’s Major Ports has declined considerably March onwards, adversely impacted by the COVID-19 pandemic, the Government said recently. COVID-19 impact at Major Ports started from March 2020, Shipping Minister Mansukh Mandaviya said in the Lok Sabha. “There was a considerable decline in the total traffic, containers traffic and other than containers traffic in March, April, May, June, July and August, 2020 as compared to the corresponding months in 2019,” the Minister said. However, recovery has started since June 20, he said. The Minister said Shipping Ministry issued necessary directions from time to time to all ports to put in place a screening, detection and quarantine system for disembarking seafarers or cruise passengers. Apart from this, the steps taken include obtaining self-declaration from arriving
crews/passengers, installing thermal scanners and procuring Personal Protection Equipment (PPE), N-95 masks, among others, besides creating awareness among the travellers at ports. “Further, Major Ports under the administrative control of Ministry of Shipping have taken several steps like formation of SoP (standard operating procedure) for disease surveillance/vessel and crew/passenger management, thermal scanning while moving outside port prohibited area, isolation wards at port hospitals,” he said. Other steps include non-charging of demurrage and other penalties/charges at ports. Mandaviya said various technological/digital inductions like e-invoice and e-payment, among others, were expedited to maintain smooth functioning without human interference. Cont’d. Pg. 19
Piyush Goyal highlight steps to promote Export during Pandemic NEW DELHI: During COVID-19 pandemic, since March 2020, regular meetings were held with the Export Promotion Councils (EPCs), Chambers of Commerce and Industry, Industry bodies and Associations to discuss issues and problems faced by the exporters and ways to promote exports during the pandemic. The issues raised by them were taken up with the concerned Ministries/Departments for an early redressal. Government has taken the following key steps to boost exports: i. The validity of Foreign Trade Policy (2015-20) extended
Port of Antwerp holds its ground thanks to Container Transshipment Recovery in sight ANTWERP: After a few less favourable months in May and June, container handling recorded stronger volumes in August. Thus, the container traffic remained almost unchanged on an annual basis, with -0.6% in TEU compared to last year. The number of blank sailings has been declining since August. Shipping companies are also organising extra runs outside the regular sailing schedules, which is partly compensating for the effect of the blank sailings. For breakbulk, with steel as the main product, the impact of global trade issues has been felt since 2019 and the shutdown of some industries due to the coronavirus crisis has led to a sharp drop of 24% by 2020. After a few better months in June and July, there was another relapse in August. Conventional transshipment of fruit did grow, but these volumes are rather limited. The total transshipment of new vehicles decreased by 32%, and that of second-hand vehicles by 25%, in 2020 compared to last year. For dry bulk, the picture is varied. Kaolin, scrap and fertilisers are relatively stable, while the other product groups, such as coal, are under pressure and in decline. In the liquid bulk segment, throughput has been falling by 7.2% in 2020. In the case of oil derivatives, we are seeing a recovery shift mainly on the discharge side, because the supply side always held up relatively well. Cont’d. Pg. 4

Extension of export obligation period in respect of Advance Authorizations and Export Promotion Capital Goods (EPCG) authorizations under Foreign Trade Policy (FTP), extension of Letter of Permissions (LoP) / Letter of Intents (LoI) of Export Oriented Units, various relaxations to SEZ units as a measure to make them functional and to ease compliances and simplification and liberalization of procedures of trade remedial Cont’d. Dated : 17.09.2020
PUBLIC NOTICE NO.120/2020 Sub. : Capturing additional details for Certificate of Origin (COO) as per Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 in Bill of Entry. Attention of Importers, Exporters, Customs Brokers, Shipping Lines/Agents, Logistics Service Providers, CFSs Custodians, Trade, Customs Staff and all other stakeholders is invited to ICES Advisory No. 34/2020 dated 17.09.2020 issued by Directorate General of Systems and Data Management, CBIC. 2. Reference is also invited to the CBIC’s Notification No.-81/2020 - Customs (N.T.) dated 21.08.2020 and JNCH’s Public Notice No. 114 dated 10.09.2020 on the subject Regulations. These Regulations apply to import of goods into India where the importer makes claim of preferential rate of duty in terms of a trade agreement. In terms of the Regulations, to claim preferential rate of duty under a trade agreement, the importer or his agent shall be required to file certain declarations at the time of filing Bill of Entry. In consonance with the same, following changes will come into effect in ICES w.e.f 21.09.2020: 2.1 Additional details in the Bill of Entry for capturing mandatory declarations while claiming PTA/FTA notifications for any item: Whenever an FTA/PTA Notification is claimed, it will be mandatory to declare the item wise details as per the BE_SW_INFO_TYPE table of the Bill of Entry, as mentioned in the Annexure 1. These additional declarations capture the requirement stipulated in the aforesaid Regulations. 2.2 Further, for each such item, in respect of which a PTA/FTA Notification is claimed, following things will be mandatory: 2.2.1 The relevant document pertaining to Certificate of Origin (hereinafter referred to as COO) under that PTA/FTA will have to be mandatorily uploaded on eSanchit and the IRN should be declared in the supporting document table for that specific item. Details of PTA/FTA Notifications and corresponding COO document code mapping along with description have been given in the Annexure 2. 2.2.2 If imported goods are transported directly from the country of origin and not through another country, then the COO code itself can be given in Transit Country field. In case of transport through different country, the country code of that country should be indicated in Transit country field. 2.2.3 As per the requirement of the above Regulations, for these items, a self-declaration will have to be made by the importer in the Bill of Entry as – “I/We declare that these goods qualify as originating goods for preferential rate of duty under the Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 notified vide Customs Notification No. 81/2020 - Customs (N.T.) dated 21.08.2020”. This declaration is codified as CUF02 in ICES. This declaration can be filed in BE_STATEMENT table for every item where FTA/PTA Notification is claimed. 2.3 Mandatory defacing of documents before out of charge: Further, the COO should be mandatorily defaced before the Out of Charge (OOC) at the port of import. An option is already available in the TSK and SUP roles for confirming defacement of supporting documents in System, wherever required. With effect from 21.09.2020, marking defacement of each COO uploaded for a Bill of Entry will be mandatory, without which Out of Charge would not be allowed to be given in system. 3. The above changes will come into effect from 21.09.2020. Trade and other stakeholders are advised to refer to the new BE message format for filing the Bills of Entry w.e.f. 21.09.2020. 4. Covid 19 impact on Total Traffic at Major Ports started from March, recovery began since June : Mansukh Mandaviya Cont’d. from Pg. 3
India has 12 Major Ports under the control of the central Government — Deendayal (erstwhile Kandla), M u m b a i , J N P T, M o r m u g a o , New Mangalore, Cochin, Chennai,
Kamarajar (earlier Ennore), V O Chidambarnar, Visakhapatnam, Paradip and Kolkata (including Haldia). Impacted by disruptions caused due to the pandemic, the Major Ports registered a 16.56 per cent dip in cargo
handled by them to 245.04 million tonnes (MT) between April and August this fiscal, according to apex ports body IPA. These 12 ports had together handled 293.67 MT of cargo during April-August 2019-20.

Line Ministries have notified various sectoral incentive packages, such as Production Linked Incentive Scheme (PLI) by Ministry of Electronics and Information Technology (MeitY) and PLI Scheme by Department of Pharma for Key Starting Materials (KSMs)/ Drug Intermediates and Active Pharmaceutical Ingredients (APIs). Common Digital Platform for Certificate of Origin has been launched to facilitate trade and i n c r e a s e t h e F r e e Tr a d e Agreements utilization by exporters.

Package announced to support domestic industr y, including through various banking and financial sector relief measures, especially for Micro, Small & Medium Enterprises (MSMEs), which constitute a major share in exports. This information was given by the Union Minister of Commerce and Industry, Shri Piyush Goyal, in the Rajya Sabha.
New rule for importers to get FTA concessions; industry raises concern NEW DELHI: Importers need to furnish proof of 35 per cent value addition in goods from the Country of origin to claim duty concession under Free Trade Agreements (FTAs). Without that, they will not get benefits, said a finance ministry official. While the move is aimed at plugging duty evasion through routing exports to India under FTAs, industry fears it will result in a compliance burden. According to the official, just a certificate by the exporter would not suffice. It will be the importer ’s responsibility to ensure value addition has been done. A provision was incorporated into the Customs Act during the budget session of Parliament in February this year, on verifying rules of origin of imports under FTAs. The rules in implementing this were issued last month. The Customs department will now step up its inspection of imports of mobiles, white goods, set-top boxes, cameras and other electronic products, and agarbattis from countries with which India has FTAs. In addition, the
goods must undergo some appreciable transformation (as prescribed for products separately in the FTA by way of product-specific criteria). For example, if a mobile is exported from Indonesia to India, it would qualify to be of Indonesian origin only if it is made significantly there and 35 per cent of its FoB (free on board) value is the Southeast Asian Country’s contribution, the official said. The new rules will be a change from the present ones by which a “Country of origin” certificate, issued by a notified agency in the Country of export, is produced by the importer, who has no additional obligation even though he claims substantial benefit. But industry says importers may not get the required documents from exporters. Harpreet Singh, Partner, KPMG, said: “With these r ules, onerous obligations are cast upon importers. To name a few, submitting multiple documents, giving undertakings, correctly filling up forms, possessing relevant information etc. are some of the key requirements.”
This may entail insights into the manufacturing process, which the Indian importer may not have. Ajay Sahai, Director General and Chief Executive Officer, Federation of Indian Export Organisations (FIEO), said while broadly the new rules should not result in delay in clearing shipments, it needed to be seen how it was operated. “In some cases, exporters may not like to provide additional detailed documents the customs authorities ask for,” said Sahai. Finance ministry sources said misuse had been rising for the past few years. Domestic industry, suspecting foul play, has repeatedly asked the Government to review FTAs and take action. Finance ministry officials said FTAs were expected to be mutually beneficial to all partner countries, but this was not the case. The same is the case with Singapore and the trade deficit with the Country stands at more than $4 billion. The trade gap has also widened with Malaysia, Thailand, and Indonesia.

India’s electronic component imports for 2019-20 stand at Rs 1.15 lakh crore: Union Minister NEW DELHI: The Country imported electronic components worth Rs 1.15 lakh crore in 2019-20, out of which, 37 per cent came from China, Minister of State for Communications and Electronics and IT Sanjay Dhotre said. The data was shared by the minister on the impact on the electronics sector due to shutting down of factories in China. “As per data available from the Directorate General of Commercial Intelligence and Statistics (DGCI&S),
the total electronic component imports in the Country in FY 2019-20 was Rs 1,15,558 crore, out of which the import from China was Rs 42,983 crore, which amounts to about 37 per cent,” Dhotre said in a written reply to the Rajya Sabha. The minister also said that as per the data available from DGCI&S, the total import of smartphone components in 2019-20 was Rs 56,039 crore; out of which, 45 per cent imports worth Rs 25,441 crore came from China.
“Steps are being taken to broad-base the sources of electronic components and raw material imports in India while promoting domestic electronics production at the same time,” Dhotre said. He added that the steps are also aimed at reducing dependency on a single market or a geographical region, so that any sudden event, such as the COVID-19 pandemic, does not cause large-scale shortage of inventory in the domestic market.
India to enhance surveillance of copper and aluminium imports particularly from China NEW DELHI: India is planning to raise sur veillance of copper and aluminium imports while developing policies to curb shipments from China and other Asian nations to protect domestic producers. Officials in New Delhi are expected to soon ask importers to register with authorities as a first step towards tighter controls that would require permits for individual shipments of the two metals, Government sources said. The move for greater screening is aimed at pushing economic self-reliance, the federal mines ministry said in a letter to the commerce ministry late last month. The letter reviewed by Reuters
refers to Prime Minister Narendra Modi’s push to reduce imports and increase exports of value-added products. “The purpose of (the) system is to have adequate information so that an appropriate policy intervention could be devised,” the mines ministry said in the letter. Government sources said the aim of the tighter surveillance would be to move copper and aluminium imports onto a restricted items list, which would require importers to get a Governmentissued license for every shipment. “The screening will help us devise policies like adding one or both the metals to the restricted list of goods as
we will have enough data to see what is being dumped into the Country,” one Government official said. China, Japan, Malaysia, Vietnam and Thailand are among the major exporters of copper, accounting for 45% of India’s $5 billion in copper imports for 2019/20, Government data showed. India plans a similar mechanism for aluminium imports, which mainly come from China, the sources said. “China is a huge threat for India’s aluminium i n d u s t r y, ” B . K . B h a t i a , J o i n t Secretary General at Federation of Indian Mineral Industries (FIMI), the Country’s biggest mining lobby, was quoted as saying to Reuters.
India on path of recovery but lags other countries : Kotak Research MUMBAI: Even while India continues to see a surge in coronavirus cases, the economy may be on a path of recovery as indicated by an increase in e-way bills, electricity consumption and p a y m e n t s d a t a i n S e p t e m b e r. “We continue to see incremental improvement in high-frequency indicators. Daily average e-waybills were higher in the second week of September, compared to the previous week and August figures,” a Kotak Institutional Equities report said r e c e n t l y, a d d i n g t h a t w i t h t h e
electricity consumption gap turning negative again, India consumed more electricity in the past week as compared to the same period in 2019. Further, payments data and import duty collection also continue to be strong in September. UPI and IMPS transactions have been encouraging too. NETC FASTag transactions also reported a spike on a week-on-week basis. In fact, the daily average NETC FASTag transactions in September were higher than February 2020 daily average, the month when the economy was running as usual.
Among other indicators, Maharashtra daily average property registrations in September crossed the figures of March 2020 daily average and were equal to February 2020. Railway freight volume also continued to be up in September as against August figures. While certain indicators show a rebound, India is still doing poorly as compared to other countries. “A crossCountry comparison of Google mobility data over a select set of countries shows that the recovery in India lags behind recovery in most countries,” the Kotak report said.

will be more opportunities for the sector. We should be prepared for unexpected challenges and at the same time, utilise the emerging market opportunities,” Panaruna said. Govt issues SOP for purchase/chartering of tugs by Major Port Trusts to boost ‘Make in India’ NEW DELHI: The Shipping Ministry will blacklist Indian tugboat owners from participating in vessel hiring tenders floated by major port trusts if they fail to replace a foreign built tug initially offered for work on winning the contract with an Indian built tug within 18 months of starting the charter. This is one of the key stipulations written into the standard operating procedures (SOP) issued by the Shipping Ministry for procurement/chartering of tugs by major port trusts to support the ‘Atmanirbhar Bharat’ and ‘Make in India’ initiatives and in turn boost local yards. In case none of the bidders in a tender is in a position to provide Indian built tugs, then the bidders shall be granted the option of offering an
alternative tug meeting the operational requirements of the port, on the condition that the tug initially offered is substituted with an Indian built tug as per the Approved Standardised Tug Design & Specifications (ASTDS) not later than 18 months from the date of commencement of the charter, failing which the party shall be liable for appropriate penalties as laid out in the tender, according to the SOP issued by the ministry. “Such defaulting parties shall thereafter be barred from participation in further tenders for chartering of any type of vessel for all ports under the Ministry of Shipping,” it said. Major port trusts are barred from floating global tenders for procurement or chartering of tugs of less than ₹200 crore. In the case of hiring of tugs, the
charter agreements should be for a minimum of seven years. The ministry will issue ASTDS to he lp m a j o r po r t t r u st s e x pe dit e implementation of the ‘Make in India’ policy. The ASTDS shall be developed by the Indian Ports Association (IPA) through Cochin Shipyard Ltd for a certain number of variants (initially about 5 types), based on the recommendations of a Standing Specification Committee (SSC), covering Outline Specifications, General Arrangement, Basic Calculations, Basic Structural Drawings, Key System Drawings and other Construction Standards. This will be technically vetted by the SSC and ‘Certified in Principle’ by the Indian Register of Shipping.
India allows export of Onions stranded at ports in transit to all countries: Govt. NEW DELHI: India has allowed export of onions lying stranded in ports across the Country for transit to all countries including Bangladesh, Government sources said. Directorate General of Foreign Trade (DGFT) sources had earlier said that onion-filled tr ucks and containers stranded at ports in the wake of the Centre’s export ban of the vegetable, might be given clearance as part of partial relaxation. DGFT was understood to have communicated to the Customs Department to give the go-ahead to cargo that have arrived at the port, but not to
ones which are in transit, they said. However, there was some confusion among the exporters on the relaxation and its grounds. “We are unsure whether all the cargo that have reached the ports would be allowed for export or only those which had received Let Export Order (LEO),” a trader said. LEO is the last step in the list of compliance requirements required to export goods out of India. “There are 500-600 tr ucks stuck at the land borders,”a Malhadipur Exporters’ Association official had told . The number of stranded Bangaldesh-bound trucks loaded with
onions continued to rise at various land borders in West Bengal in the wake of the Centre’s export ban of the commodity, official said on Thursday. “There are 500-600 trucks stuck at the land borders,” a Malhadipur Exporters’ Association official said recently. L and ports of Gojadanga and Petrapole in North 24Parganas District also reported stranded, onion-filled trucks, the officials said. The Centre on Monday banned the export of all varieties of onions with immediate effect, a move aimed at increasing availability and curbing prices of the commodity in the domestic market.

Business Group to be formed between these four countries ending China’s supremacy NEW DELHI: Indian exports are expected to receive booster doses after becoming part of the business group of Japan, India, Australia and the United States. A meeting has also been held between the business ministers of India, Japan and Australia over the business group. According to sources in the Ministry of Commerce and Industry, the group may soon include the US. The formation of a business group between these four countries will also end
China’s supremacy in the world’s supply chain. Japan, Australia and the United States want to reduce business relations with China, which is showing direct profits to India. According to foreign trade experts, 10% of the bilateral trade with Japan, Australia and the United States with China will also be a great increase in India’s exports. According to commerce ministry data, a turnover of $30 billion was made in the year 2018 between Australia and the Country.
But, in the meantime, Australia has 200 billion dollars of business with China. In the year 2019-20, the Country had an $88.75 billion business with the US. In 2019, the US had a $659.8 billion business with China. The US currently exported $120.3 billion to China, while the US imported $419.2 billion from China. More than 300 billion dollars of business is done between Japan and China. India and Japan had a business of only $17.6 billion in 2018.

Launching of SAROD-Ports, a dispute resolution mechanism, will be credit positive for the Indian Port sector entities: ICRA • •
The credit prole of several port sector entities has been impacted by large contingent liabilities arising from prolonged disputes and hence the launch of SAROD-Ports should be credit positive for the sector The initiative is targeted towards attracting more private sector investments and should be favourable for the sector if it is able to resolve disputes at low costs and in a time bound manner
MUMBAI: The Union Minister of Shipping, launched ‘SAROD-PORTS’ (Society for Affordable Redressal of Disputes – Ports) for dispute resolution in Maritime Sector, comprising of Major Ports, Non Major Ports and PPP players operating at Major Ports. The launch of ‘SAROD-Ports’ is a much needed alternative step to resolve/reduce the disputes in the ports sector in less time and in a cost effective manner. According to ICRA this is a positive development for the sector. SAROD-Ports will consist of members from Indian Port Association (IPA) and Indian Private Ports and Terminal Association (IPPTA) and the empanelled arbitrators will comprise of retired chairman/deputy chairman of Major Port Trusts or retired or serving members of the Judiciary, Civil Servants, Public Sector undertakings who have experience in port sector and arbitration process. Giving further insights, Mr. K. Ravichandran, Senior Vice President and Group -Head, ICRA Ratings says, “The credit profile of several port sector entities has been impacted by large contingent liabilities arising from prolonged disputes and hence the launch of SAROD-Ports should be credit positive for the sector. However, the success of the mechanism remains to be seen, as it will depend on willingness of existing concessionaires to opt for it. This should be more useful for disputes, where the quantum of liability is smaller and it will be prudent for both parties to settle in a speedy manner. Further, the provision to bring in experts in arbitration process should also be a favourable factor, as industry members have at times cited dissatisfaction with arbitrators not having sufficient understanding of the port sector”. In the last two decades, there has been increasing shift towards PPP projects and landlord port model by the Major Ports, where terminals for specific cargo segments are developed and operated by private players on BOT basis. However, in many cases there have been disputes with the Major Port Trust related to terms of concession
including revenue share/royalty; meeting of minimum guaranteed performance standards and volumes; facilities and maintenance work to be done by the Port Trust etc. apart from disputes with regulatory authorities like TAMP. These disputes in many instances have dragged on for several years, as the parties may first go for arbitration and then fight the cases in higher courts. This results in high arbitration and litigation costs for both the ports as well as the private players. The launch of ‘SAROD-Ports’ is a step to address such disputes through an alternative route to ensure faster resolution and in a cost effective manner. The SAROD mechanism has already been in place for some time in the road sector. The SAROD - Roads, comprises of members from NHAI and NHBF and has empanelled arbitrators. There are set rules, with regards to the number of arbitrators for a case, fees to be paid, provision for appointment of experts etc. The system was put in place to bring down the cost of arbitration and to ensure faster resolution. Over the last few years, there has been a fair share of disputes between NHAI and private players being resolved through the mechanism and thereby reducing pendency and reducing cost of arbitration. ICRA notes that the initiative is targeted towards attracting more private sector investments and should be favourable for the sector if it is able to resolve disputes at low costs and in a time bound manner. Mr. Sai Krishna, Assistant Vice President and Associate Head, ICRA ratings mentioned said, “The port sector’s ability to attract investments will also be contingent on resolution of policy issues which led to disputes in the first place. Further, while the Government has announced several policy measures over the last few years, they are in various stages of implementation. Early implementation of the planned measures, passage of important bills like “The Major Port Authorities Bill, 2019” which will allow more flexibility to Major Ports and timely execution of projects under Sagarmala initiatives will be crucial to attract additional private sector investments.”
