Port of Antwerp’s inaugural episode of the India-EU Thought Leadership Webinar series starts on 21st September 2020 MUMBAI: The Port of Antwerp will bring together eminent leaders from India and Europe to share their futuristic perspectives on functioning of business and government during these uncertain times in a three-part webinar series beginning from 21st September 2020. The Theme is “Imagine the future beyond the Covid-19 pandemic” which will be moderated by Mr. Luc Arnouts, Vice President International Relations and Networks, Port of Antwerp.

TS Lines places four-ship order at Huangpu Wenchong TA I WA N : T S L i n e s h a s commissioned the building of two 1,900 TEU ships from CSSC Huangpu Wenchong Shipbuilding of China.

Each newbuilding is priced at US$22.8 million and delivery is set for between the third and fourth quarters of 2022. The order comes with options for two more vessels. Huangpu Wenchong is part of state-owned shipbuilding conglomerate China Cont’d. Back Pg. State Shipbuilding Corporation.

The Port will install roof top solar power panels that will generate power to the tune of 930 kWp. The Port will also replace conventional high-power lights with LED lights in main cargo handling equipment.

In last three years, the Port has undertaken measures to reduce overall carbon footprints by 500 MT per year.

To ensure development of green belt and curb the carbon emission, the port has planted more than 2.5 lakh trees over and above mangroves plantation in over 500 hectares.

PIPAVAV: APM Terminals Pipavav has taken a leap towards sustainability with initiatives aimed at addressing the challenges of conserving the environment as well as utilising resources in optimum way through the philosophy of ‘reduce, reuse and recycle’.

These sustainability initiatives under the project ‘Gujarat Green Gateway’ are undertaken to reduce the

carbon footprint; while improving livelihood of employees & workers as well as surrounding community at the Port.

Under this project, the Port will install roof top solar power panels inside the port premises and will replace conventional high-power lights with LED lights in cargo handling equipment. The solar power plant will generate power to the tune of 930 kWp(kilowatt-peak) and would compensate power requirements across the port.

PUBLIC NOTICE NO.117/2020 Sub. : All India roll-out of Faceless Assessment - reg.

Attention of Importers, Exporters, Customs Brokers, Shipping Lines/ Agents, Logistics Service Providers, CFSs Custodians, Trade, Customs Staff and all other stakeholders is invited to CBIC’s Circular No. 40/2020 dated 04.09.2020.

2. Reference is also invited to CBIC’s Circular No.28/2020-Customs dated 05.06.2020 and Circular No 34/2020-Customs dated 30.07.2020. Reference is also invited to JNCH’s Public Notice No. 82/2020 dated 14.07.2020, 95/2020 and 96/2020 both dated 31.07.2020 regarding setting up of Turant Suvidha Kendra in JNCH and launch of Faceless Assessment for Group 2A commodities at Mumbai, under the umbrella of the next generational Turant Customs programme.

3. Faceless Assessment, duly supported by Paperless and Contactless Customs clearance processes, is a critical reform.

The pilot programme of Faceless Assessment was launched in Chennai on 14.08.2019 for electrical machineries falling under Chapter 85 of the Customs Tariff Act, 1975. These pilot programmes were followed by the launch of Phase I of Faceless Assessment on 05.06.2020, Phase II of Faceless Assessment, which was begun on 03.08.2020 at Customs formations in Chennai, Bengaluru, Delhi, for goods falling under the Chapters 50 to 71, 84, 85 and 86 to 92 of the Customs Tariff Act, 1975 and at Customs formations in Mumbai, for goods failing under the Chapter 29 of the Customs Tariff Act, 1975.

4. The CBIC has issued a further Circular No. 40/2020 dated 04.09.2020 for All India roll-out of faceless assessment at all ports of import for all imported goods by 31.10.2020. For imports made at Custom House, Nhava Sheva, the faceless assessment shall be extended beyond existing phase II (involving Group 2A) in the following phases and as per the dates shown therein – a) phase III on 15.09.2020 for Group 5, 5A, 5B b) phase IV on 01.10.2020 for Group 1, 2G, 2K, 3, 4, 6 c) phase V on 31.10.2020 for Groups 1A, 2, 2B, 2C, 2D, 2E, 2F, 2H, 2I, 2J. Accordingly, the assessment with respect to goods of these Groups imported at Nhava Sheva will get assigned by the Customs Automated System to officers of Faceless Assessment Groups.

5. Chief Commissioner of Customs, Mumbai Zone-II has nominated Principal Commissioner/Commissioner Nhava Sheva I (email id: commr-ns1@gov.in), Nhava Sheva III (email id: commr-ns3@gov.in) and Nhava Sheva V (email id: commr-ns5@gov.in) as nodal Principal Commissioners/ Commissioners vide JNCH Public Notice No. 113/2020 dated 10.09.2020.

Nodal Commissioners are administratively responsible for monitoring and ensuring speedy and uniform assessments of the Bills of Entry assigned by the System to the officers of the respective Faceless Assessment Groups specified above in their jurisdiction. For this, the CBIC Circular Nos. 28/2020-Customs dated 05.06.2020, 34/2020Customs dated 30.07.2020 and 40/2020-Customs dated 04.09.2020, and Instruction No. 09/2020-Customs dated 05.06.2020 provide self-contained guidance which shall be taken as Standing Order for the officers concerned including in the Faceless Assessment Groups which would consist of Appraisers / Superintendents and Assistant / Deputy Commissioner and be supervised by Joint / Additional Commissioner under the overall control and monitoring of the Commissioner.

Modalities of faceless assessment mentioned in CBIC Circular No. 34/2020-Cus dated 30.07.2020 are summarised as under: 6.1 Faceless Assessment Group A separate office order will be issued by Commissioners of Customs NS-I, NS-III and NS-V at JNCH to appoint a suitable complement of officers of Mumbai Customs Zone-II as the designated officers for handling Faceless Assessment.

6.2 Port Assessment Group Port Assessment Group (PAG) of all the chapters concerned would be the Appraising Groups of this Zone. The PAGs would handle all functions pertaining to the bills of entry which are not marked to the Faceless Assessment Group by the Customs Automated System as well as the bills of entry that are referred by the Faceless Assessment Group to the port of import for any reason. It is clarified that the port of import is the Customs station of import of the goods where the importer has entered any bill of entry under Section 46 or Section 68 of Customs Act, 1962 for home consumption or warehousing.

7. Responsibilities of the Port of Import: 7.1 The ports of import would continue to have the Port Assessment Group(s) to cater to all other functions pertaining to the bills of entry which are not marked to the Faceless Assessment Group by the Customs Automated System, including the cases referred by the Faceless Assessment Group to the Customs station of import for any reason. In addition, the port of import would continue to be responsible for handling the examination/inspection of goods and all other functions other than assessment. The request for waiver of fee for late filing of bill of entry, request in relation to Section 49 of the Customs Act, 1962 and request for permission under Section 48 of the Customs Act, 1962 shall also be processed by the designated proper officers of the port of import.

8. Turant Suvidha Kendra (TSK):TSK has already been set up in JNCH vide P.N. No. 82/2020 dated 14.07.2020 with effect from 15.07.2020. The details of the TSK are as under:Address : EDI Service Centre, Ground Floor, JNCH, Nhava Sheva, Taluka: Uran, District: Raigad’; E-mail ID: tsk-jnch@gov.in The TSK, already operational at JNCH, will also function as TSK for Bills of Entry pertaining to importation at Nhava Sheva, which are allocated by the Customs Automated System to one of the designated Faceless Assessment Groups.

8.1 TSK is a dedicated cell manned by Customs officers to cater to following functions: i. Accept Bond or Bank Guarantee (BG) in respect of import of goods including import related to Export promotion schemes; ii. Carry out any other verifications that may be referred by Assessment Groups; iii. Defacing of documents/ permits licences, wherever required; iv. Debit of documents/ permits/ licences, wherever required; and v. Other functions determined by Commissioner to facilitate trade.

Procedure for Verification of Assessment of Bill of Entry by Faceless Assessment Group: 9.1 Procedure to be adopted in normal course: 9.1.1 The importer shall present bill of entry on the Customs Automated System (i.e. ICEGATE portal) electronically, as per Section 46 of the Customs Act, 1962 and upload supporting documents such as Invoice, Packing List, Bill of Lading, as usual in all the cases, and License/ Authorisation/permission, BIS or other registrations, Scrips, Equipment Type Approval, Certificate of Origin, Certificate for claiming duty exemption etc., if required for the consignment, on e-Sanchit. As at present, the selection of a bill of entry for verification of self- assessment shall primarily be on the basis of risk evaluation through appropriate selection criteria.

9.1.2 In cases where the importer has prior knowledge that there is a requirement of execution of Bond or Bank guarantee for the assessment of the said bill of entry, such as in the case of a warehouse bill of entry or where the importer has sought provisional assessment or where a claim to any concessional rate of duty or exemption under duty remission/exemption schemes is subject to filing of Bond/ Bank Guarantee, they are encouraged to opt for Continuity Bond option, to avoid fresh registration of Bonds every time during filing of bill of entry.

9.1.3 The bill of entry would be assigned to an officer of the concerned Faceless Assessment Group for verification of assessment purposes by the Customs Automated System.

9.1.4 For verification of assessment of the bill of entry, the Faceless Assessment Group may decide to: a) return the bill of entry to the importer for payment of duty after verification on the basis of the declaration made and documents available in e-Sanchit; or b) seek additional information or documents for proceeding with the verification; and/or c) get examination and/or testing of goods carried out, for the determination of duty liability and/or for ensuring the compliance of restriction and prohibition; 9.1.5 Where the Faceless Assessment Group is of the opinion that additional information or documents are required for proceeding with the verification of assessment, the Faceless Assessment Group shall raise query electronically for additional information or seek additional documents, preferably in a consolidated manner, through ICEGATE portal.

The importer shall respond to the query electronically and/or provide additional documents through e-Sanchit. After scrutinising the same, the Faceless Assessment Group shall: a) Return the bill of entry to the importer for payment of duty after verification; or b) Not agree with the self-assessment and re-assess the bill of entry. In this case, if the importer does not agree with the re-assessment, the Faceless Assessment Group shall issue a speaking order, as prescribed in Section 17(5) of the Customs Act, 1962 following the procedure referred to in paragraph 5.4 of instruction No. 09/2020-Customs dated 05.06.2020.

9.1.6 The Faceless Assessment Group may, whether in course of accepting the selfassessment or re-assessing the bill of entry, order for second check examination of the goods including the directions to the shed officers at the port of import to verify original documents, deface documents, take custody of the document, NOC from PGAs, verify Country of Origin Certificate etc. Further, it is clarified that, wherever situation warrants that the authenticity of any document submitted through e-Sanchit has to be verified through any external agency, such communication shall be made by the port of import.

9.1.7 Where the Faceless Assessment Group is of the opinion that examination and/or testing of goods is required for proper verification of the assessment, based on own assessment or on the request from importer: a) The Faceless Assessment Group may order for first check examination or testing of the goods with specific directions or testing parameters to the shed officers at the port of import. The responsibility for sending the samples to the appropriate laboratory with the requisite test memo, if ordered by Faceless Assessment Group, would lie with the shed officers at the port of import. b) The shed officers/Centralised Cell, as the case may be at the port of import would feed the examination and/or the test report, when it is received from the laboratory, in the system and refer the bill of entry back to Faceless Assessment Group, and there upon, Faceless Assessment Group shall follow the procedure as laid down in paragraph IV to VI of para 5.3.1 of instruction No. 09/2020-Customs dated 05.06.2020, as applicable. c) If the Faceless Assessment Group concludes that the prior testing of goods is going to take considerable time and the bill of entry should be assessed provisionally, they may refer the bill of entry to the PAG at the port of import, following the procedure stipulated in para 5.3.2 of instruction No. 09/2020- Customs dated 05.06.2020 and clearly specifying the reasons thereof. In such cases, the bill of entry would be assessed by PAG at the port of import, after the receipt of the examination/test report. d) If the imported goods are found to be subject to some restriction or prohibition or mis-declared, on the basis of said test and/or examination report fed by the shed officers at the port of import, the Faceless Assessment Group shall refer the bill of entry to PAG at the port of import for action including action under Section 124 of the Customs Act, 1962. e) It is clarified that, irrespective of pending verification at Faceless assessment Group, if the importer requests for storage of the imported goods in warehouse pending clearance under Section 49 of the Customs Act, 1962, such request shall be processed by officers of the port of import promptly.

9.1.8 The shed officers at the port of import would carry out the necessary verification or examination or other tasks, as required by the Faceless Assessment Groups or required as per Compulsory Compliance Requirements of the Risk Management System. The shed examination officers must give complete examination report vis-à-vis various examination instructions with specific details of checks carried out and must also keep in mind that, in respect of a Bill of Entry wherein first check examination order has been given by Faceless Assessment Group, the examination report must be Cont’d Pg.7 submitted to the concerned Faceless Assessment Group only.

PUBLIC NOTICE NO.117/2020 9.1.9 Any time after the bill of entry is returned from Faceless Assessment Groups to the port of import, if the import of goods are found to be subject to some restriction or prohibition or mis- declared, PAG may carry out re-assessment and initiate action as prescribed under section 124 of the Customs Act, 1962, if required.

9.2. Procedure to be adopted by Faceless Assessment Groups in exceptional circumstances.

I. In certain exceptional circumstances (listed below) the proper officer of the Faceless Assessment Groups may, with the approval of a senior officer not below the rank of Joint Commissioner/Additional Commissioner, transfer the bill of entry using the Customs Automated System to PAG at the port of import for assessment, without completion of verification of assessment. The Faceless Assessment Groups may also transfer a bill of entry to the PAG in any other exceptional circumstances, but in this case, this would be done after due approval from the Commissioner supervising the proper officer. a. Where the Faceless Assessment Group has reasons to believe that the imported goods may be liable for confiscation as per the provisions of Section 111 of the Customs Act, 1962. In such circumstance, the reasons for such a transfer shall be duly recorded in the Customs Automated System. However, such cases may be referred to only in genuinely exceptional circumstances. b. In respect of `related party` transactions warranting investigation by SVB (other than cases that are already covered by an earlier order of the SVB such as in the case of continuing imports which have earlier been taken up for investigation by the SVB). In this case the port of import would refer the case to its jurisdictional Special Valuation Branch (SVB) for further investigation. c. Even after several electronic query-based interactions with importer, the Faceless Assessment Groups is not able to complete the verification for want of additional documents, test reports etc.

9.3 Procedure to be adopted by Port of Import in exceptional circumstances.

Notwithstanding anything mentioned above, the Principal Commissioner/ Commissioner of Customs at port of import may, at any stage pending at Faceless Assessment Groups, direct the PAG to pull the bill of entry from Faceless Assessment to the PAG in the following situations: a) Where specific alert or intelligence is available pertaining to the said bill of entry or class of bill of entry; and b) Where the Principal Commissioner/Commissioner of Customs has ordered to do so for the reasons to be recorded in writing.

9.4 Speaking Order: I. For any re-assessment done by the Faceless Assessment Group, which is at variance with the self-assessment done by the importer and in cases other than those where the importer confirms his acceptance of the said reassessment electronically in reply to the query raised by the assessing officer, the Faceless Assessment Groups shall pass a speaking order on the re-assessment, within fifteen days from the date of re-assessment of the bill of entry, as prescribed in section 17(5).

II. The Faceless Assessment Groups shall provide an opportunity to be heard to the importer, in accordance with the principles of natural justice, before proceeding with the re-assessment of the bill of entry. In the event a personal hearing is sought by the importer, the same can be conducted through video conferencing or other reliable technological means at the option of the importer. In this regard, the Board’s instructions vide F.No. 390/Misc/3/ 2019-JC dated 21.08.2020 may also be referred to.

9.5 Appellate Proceedings Any appeal against any speaking order on re-assessment passed by Faceless Assessment Groups shall lie before the Commissioner (Appeals) as per Notification No. 85/2020-Customs (N.T.) dated 04.09.2020. Thus, an appeal against an order passed by the proper officer of the Faceless Assessment Group as per Section 17(5) and/or Section 18, would lie with the Commissioner of Customs (Appeals) having jurisdiction over the port of import. To illustrate, Commissioners of Customs (Appeals) at Bengaluru would decide appeals filed for imports at Bengaluru though the Faceless Assessment officer is located at any other port of the country, say Delhi.

9.6 Review Proceedings The review of any speaking order on re-assessment passed by a proper officer of Faceless Assessment Groups, under sub-section (2) of Section 129D of the Customs Act, 1962, shall lie with the reviewing authority having administrative control over the that proper officer of the Faceless Assessment Group.

9.7 Demands under Section 28 of the Customs Act, 1962 Issuing of demands under Section 28 of the Customs Act, 1962, adjudication thereof and handling of audit objections shall be done by the officers of the port of import. In matters where clarifications and inputs are required to be given by the Faceless Assessment Groups to port of import in such matter, the nodal Commissionerates shall co-ordinate with the Ports of import.

9.8 Provisional Assessment I. If the requisite approval for provisional assessment as per the Customs Act, 1962 and departmental guidelines has already been obtained, the Faceless Assessment Group may assess the bill of entry provisionally. The bond and bank guarantee for the same are to be registered with the Turant Suvidha Kendra at the port of import.

II. If the Faceless Assessment Group concludes that the prior testing of goods is going to take considerable time and the bill of entry should be assessed provisionally, they may refer the bill of entry to the PAG at the port of import, following the procedure stipulated in Para 5.3.2 of instruction No. 09/2020-Customs dated 05.06.2020 and clearly specifying the reasons thereof. In such cases, the bill of entry would be assessed by PAG at the port of import, after the receipt of the examination/test report.

III. After receipt of the required test reports etc from the shed officers at the port of import, the finalisation of provisional assessment shall be done by the officers of PAG of the port of import.

9.9 Amendment of Bills of Entry I. Directorate General of Systems has enabled a facility whereby requests for amendments can be made online via ICEGATE Portal.

II. Once the amendments are filed online, System would queue them up before the proper officer of the Faceless Assessment Group if the bill of entry is pending for verification. In all other cases, the request would be queued to the proper officer of the Port Assessment Group.

III. The facility of online levy of Amendment fees as per Levy of Fees (Customs Documents) Regulations, 1970 has also been enabled. The applicable fee would be included in the duty challan for payment.

IV. Requests for amendments as per Section 149 of the Customs Act, 1962, and requests after the bill of entry has been returned for payment by the Faceless Assessment Group shall be processed by the port of import.

APM Terminal Pipavav takes a leap towards sustainability with ‘Gujarat Green Gateway’ initiatives • • • •

The Port will install roof top solar power panels that will generate power to the tune of 930 kWp. The Port will also replace conventional high-power lights with LED lights in main cargo handling equipment.

In last three years, the Port has undertaken measures to reduce overall carbon footprints by 500 MT per year.

To ensure development of green belt and curb the carbon emission, the port has planted more than 2.5 lakh trees over and above mangroves plantation in over 500 hectares.

This project will help the Port in reducing carbon footprints to the tune of 200 MT per year while ‘LED lights on equipment’ project will reduce carbon emissions by around 50 MT per year. Other initiatives such as rubber-tyred gantry cranes (RTGs) electrification, oil recycling, deployment of eCars and LED lights in Port operational and utility areas have already been completed under this programme.

Kind attention of importers, Customs Brokers and other stakeholders is drawn to – a) Public Notice Nos. 95/2020 dated 31.07.2020 and 96/2020 dated 31.07.2020 under which phase II of faceless assessment undertaken by CBIC had covered Group 2A imports made in this Zone. This was based on CBIC Circular No. 34/2020-Cus dated 30.07.2020, 28/2020-Customs dated 05.06.2020 and Notification No.50/2020-Cus (NT) dated 05.06.2020. Further, for the purpose of empowering the jurisdictional Commissioner of Customs (Appeals) at Mumbai Zone II to take up appeals filed in respect of Faceless Assessments pertaining to imports made in their jurisdiction (even though the assessing officer may be located at the other Customs station), the Board had issued Notification No. 63/2020Customs (N.T.) dated 30.07.2020. b) Setting up of Turant Suvidha Kendra (TSK) in this Zone vide Public Notice Nos. 80/2020 dated 08.07.2020 read with 82/2020 dated 14.07.2020 and specifying that TSK shall suitably cater to the relevant functions consistent with the above cited Board’s Circulars for Faceless Assessment Groups.

The CBIC has issued a further Circular No. 40/2020 dated 04.09.2020 for All India roll-out of faceless assessment at all ports of import for all imported goods. For imports made at this Custom House, the faceless assessment shall be extended beyond existing phase II involving Group 2A in the following phases a) phase III on 15.09.2020 for Group 5, 5A, 5B b) phase IV on 01.10.2020 for Group 1, 2G, 2K, 3, 4, 6 c ) phase V on 31.10.2020 for Groups 1A, 2, 2B, 2C, 2D, 2E, 2F, 2H, 2I, 2J. Accordingly, the assessment with respect to these Groups will get assigned by the Customs Automated System to officers of Faceless Assessment Groups.

For this purpose, para 4 of the Public Notice No. 91/2018 dated 30.05.2018 as amended by Public Notice Nos. 80/2020 dated 08.07.2020 and 95/2020 dated 31.07.2020 is hereby further amended as follows: a) against Commissionerate Nhava Sheva – I, for “Import Groups”, the words “Port Assessment Groups and Faceless Assessment Groups” are specified and description shall read as “1, 1A, 2, 2A, 2B, 2C, 2D, 2E, 2F, 2G, 2H, 2I, 2J, 2K”. b) against Commissionerate Nhava Sheva – III, for “Import Groups”, the words “Port Assessment Groups and Faceless Assessment Groups” are specified and description shall read as “3, 4”. c) against Commissionerate Nhava Sheva – V, for “Import Groups”, the words “Port Assessment Groups and Faceless Assessment Groups” are specified and description shall read as “5, 5A, 5B, 6”.

The Principal Commissioner/Commissioner Nhava Sheva I (email id: commr-ns1@gov.in), Nhava Sheva III (email id: commr-ns3@gov.in) and Nhava Sheva V (email id: commr-ns5@gov.in) are also the Nodal Commissioners administratively responsible for monitoring and ensuring speedy and uniform assessments, in regard to the Bills of Entry assigned by the System to the officers of the respective Faceless Assessment Groups specified above in their jurisdiction.

For this, the CBIC Circular Nos. 40/2020-Customs, 28/2020-Customs and 34/2020-Customs and Instruction No. 09/2020-Customs provide self-contained guidance which shall be taken as Standing Order for the Commissioner/officers concerned including in the Faceless Assessment Group which would consist of Appraisers/ Superintendents and Assistant / Deputy Commissioner and be supervised by Joint / Additional Commissioner under the overall control and monitoring of the Commissioner. The Principal Commissioners/ Commissioners of Import at Nhava Sheva shall issue further detailed Public Notice by 12.09.2020 for roll-out of phases III, IV and V of Faceless Assessment and make suitable directions for the officers and staff.

The concerned Commissioner(s) would interact with trade and industry for inputs, and on issues relating to assessment, and inter alia assist stakeholders, by taking suitable measures, locally and as part of National Assessment Centres constituted by Board, before, during and after roll-out of phase III, IV and V, so that the faceless assessment and clearance of goods occur smoothly to achieve objectives of the Turant Customs program.

The stakeholders are also informed that the CBIC has issued Notification No. 85/2020-Customs (N.T.) dated 04.09.2020 for the purpose of empowering the jurisdictional Commissioner of Customs (Appeals) to take up appeals filed in respect of Faceless Assessments pertaining to imports made in their jurisdiction (even though the faceless assessing officer may be located at any other Customs station).

PUBLIC NOTICE NO. -114/2020 Sub. :Guidelines regarding implementation of section 28DA of the Customs Act, 1962 and CAROTAR, 2020 in respect of Rules of Origin under Trade Agreements (FTA/PTA/CECA/CEPA) and verification of Certificates of Origin- reg.

Attention of all the Importers, Exporters, Custom Brokers, Shipping Lines/Agents, Logistics Service Providers, passengers, advocates, tax practitioners and authorized representatives and all other stakeholders is invited to Board’s Circular No. 38/2020-Customs dated 21.08.2020 issued vide F.No.15021/18/2020 (ICD) on the above mentioned subject.

Reference is drawn to Chapter VAA and section 28DA of the Customs Act, 1962, which has been inserted vide clause 110 of Finance Act, 2020, and to Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020 (hereafter referred to as the CAROTAR, 2020) issued vide Notification No. 81/2020-Customs (N.T.) dated 21st August, 2020.

1.1 The aforementioned section and rules aim to supplement the operational certification procedures related to implementation of the Rules of Origin, as prescribed under the respective trade agreements (FTA/PTA/CECA/CEPA) and notified under the customs notifications issued in terms of section 5 of the Customs Tariff Act, 1975 for each agreement.

1.2 The CAROTAR 2020 shall come into force on 21st September, 2020, to provide sufficient time for transition and to ensure that the prescribed conditions in terms of rule 4 are compiled with. Necessary modifications in bill of entry format are being made to allow declaration in terms of rule 3(a) and 3(d) of CAROTAR, 2020.

1.3 The above said circular aims to provide procedure for sending verification request to the Verification Authorities in exporting countries in terms of trade agreements, section 28DA and CAROTAR, 2020, and further guidelines for implementation of aforementioned section and rules.

2. The CAROTAR, 2020 and Rules of Origin notified for a trade agreement in terms of sub-section (1) of section 5 of the Customs Tariff Act, 1975, broadly provide the following grounds for verification: a) In case of a doubt regarding the genuineness of the Certificate of Origin (CoO) such as any deficiency in the format of the certificate or mismatch of signatures or seal when compared with specimens on record. b) In case of a doubt on the accuracy of information regarding origin, i.e. where a doubt arises on whether the product qualifies as an originating good under the relevant Rules of Origin. In other words, these are cases where there is a reasonable belief that a product is not grown or not produced/manufactured in a particular country or required value addition/change in CTH/PSR etc., as the case may be, has not been achieved for the goods to qualify as originating. c) Verification could also be undertaken on random basis as a measure of due diligence. For this purpose, factors such as the quantum of duty being foregone, the nature of goods vis-à-vis the country of origin, commodities that are prone to mis- declaration of country of origin, compliance record of the importer etc., may be given regard while selecting Certificates of Origin for random verification.

3. The Rules of Origin, by virtue of which goods attain origin of a country, have evolved with subsequent reviews of trade agreements. Most trade agreements have moved from single general rule to specific rule for most of the tariff lines, with inclusion of vast array of processes which can confer origin. Section 28DA makes it incumbent upon an importer to possess sufficient information as regards the manner in which country of origin criteria, including the regional value content and product specific criteria, specified in the Rules of Origin in the trade agreement, are satisfied. For this purpose, CAROTAR, 2020 has provided a form, containing list of basic minimum information which an importer is required to obtain while importing goods under claim of preferential rate of duty. Therefore, in case there is a doubt with regard to origin of goods, information would be first called upon from the importer of the goods, in terms of rule 5. read with rule 4 of CAROTAR, 2020, before initiating verification with the partner country in terms of rule 6.

3.1 Section 28DA of the Act further states that mere submission of a certificate of origin shall not absolve the importer of the responsibility to exercise reasonable care to the accuracy and truthfulness of the information supplied. Hence, the importer is required to provide information in terms of section 28DA(1) (iii) of the Act and as prescribed under CAROTAR, 2020, and has to take reasonable care to ensure the accuracy and truthfulness of the information furnished.

4. The Rules of Origin under various trade agreements lay down the format of the certificate of origin, the period of validity, manner of obtaining the certificate etc. One of the usual conditions for accepting the certificate is that it should be signed by the authorized signatories whose name, signature and seal have been communicated by the partner country through agreed channels. At present, the signatures and seals are received by the Board, either directly from the government of the partner country or through the Department of Commerce.

4.1 The Directorate General of Systems has built an online repository on ICES for storing the signatures/seals to facilitate comparison by the assessing officers. DRI has been tasked with uploading the data in the database.

4.2 For the benefit of non-EDI customs locations, copies of specimen signatures and seals will be circulated by DRI. For other locations, the ICES online repository may be utilized.

4.3 In case the specimen seal/signature is not available in the ICES online repository, the issue may be referred to the Board for verification.

5. Instruction no. 31/2016 – Customs dated 12.09.2016 vide F. No. 20000/4/2011- IC (ICD) stands superseded by the above mentioned Circular dated 21.08.2020.

6. Accordingly, JNCH Public Notice No. 128/2016 dated 26.09.2016 vide F.No. S/22-Gen- 41/ 2014-15/AM(I)/JNCH is hereby superseded by this public notice.

Move to cap Govt incentives may impact about 700 exporters NEW DELHI: Around 700 exporters of engineering items, automobiles, chemicals, pharmaceuticals, oil and gas, and textiles are likely to get impacted by the government’s move to cap incentives under the Merchandise Exports from India Scheme (MEIS) at Rs 2 crore per exporter for four months till December 31.

Besides these industries, marine products, dairy and processed foods and fruit, vegetables, spices and cereals are the largest beneficiaries of the scheme.

The top 50 exporters from these sectors account for around 20% of the benefits under the scheme, the outgo under which was Rs. 45,000 crore in fiscal 2020.

“There are around 700-750 exporters who will get impacted by the ceiling on incentives,” said an official.

More than 35,000 exporters claim benefit under the MEIS. The cap was introduced as the government found MEIS to have failed to deliver the desired result of boosting exports, which have hovered around $300 billion in the last five years despite its liberal application across sectors.

The government has said that 98% of the exporters who claim MEIS would be unaffected by the changes as per an analysis of claims in the same period of 2018-19.

It also said the new Import Export Code obtained on or after September 1 would be ineligible to submit any MEIS claim for exports, and the ceiling would be subject to a downward revision to ensure that the total claim didn’t exceed the allocated Rs 5,000 crore for the period.

“Unaffected exporters who have already factored in MEIS in the pricing of their products do Junot face any change or uncertainty since neither coverage of products nor rates of MEIS will be changed,” said another official.

However, industry said though the allocation might cover 98% of beneficiary exporters in numbers, in terms of value of exports covered, the percentage would be much less.

“The large exporters which have high-value exports would get adversely impacted. We also fear that this might act as a disincentive for exporters to become large,” the Confederation of Indian Industry (CII) said in a letter to the Ministries of Finance, and Commerce and Industry.

Export benefits need to seamlessly flow to exporters to help execution of new orders: Sharad Kumar Saraf, President, FIEO N E W D E L H I : Mr S K Saraf, President, FIEO said that despite the pandemic, Indian exporters have started receiving a lot of enquiries and orders from across the globe helping many sectors to show improved export performance, which is likely to get better in next few months.

However, exporters, particularly from MSME sector, are facing huge liquidity challenges due to the stoppage of MEIS benefits of over Rs 10,000 Crore from 1.4.2020 and IGST refund now. At this point of time when exporters are receiving new orders from new buyers and destinations, support needs to be given to help them to execute such orders. Unfortunately, many of the exporters have expressed their inability to honour such orders, in view of liquidity challenges, due to stoppage of exports benefits and refund of GST. President, FIEO urged the Government to look into the issue as any

letup in our export efforts, at this juncture, will cost us dearly while successful execution of these orders will bring additional export business from new and unexplored territories. All wings of the Government should sit together, opined Mr Saraf, to resolve the technical and financial issues, helping the seamless flow of liquidity to exports sector.

President, FIEO also said that banks are helping eligible exporters with the Emergency Credit Line Guarantee Scheme but due to hold up of GST refund and MEIS, the exporters are forced to seek additional loans from banks and such additional requirement is now subject to very high interest rates. Banks need to consider this pragmatically and provide a competitive interest rate to the exports sector particularly as the deposit rates have come down substantially with the reduction in key interest rate. Govt needs to pay interest on the delay in refunding GST to compensate the exporters.

FIEO also urged the Gover nment to address the issue of Risky Exporters by providing them duty drawback and IGST benefits against a b o n d , i f Mr S K Saraf physical verification of such exporters has been established.

The SOP issued for risky exporters may be meticulously followed so that after due verification, exporters are taken out from the category immediately.

Mr Saraf exuded confidence that export performance is improving and with due support from all the stakeholders, we can bring exports back on track by the end of the year.

Major Ports handles 17% less cargo in Apr-August period (YoY) at 245 mn tonnes NEW DELHI: Impacted by disruptions caused due to COVID-19, India’s major ports continued to witness a fall in cargo handling, registering 16.56 per cent dip to 245.04 million tonnes (MT) between April and August this fiscal, according to the apex ports body IPA. Cargo volumes at these 12 major ports under the control of the Centre declined for the fifth straight month in August 2020 and all ports barring Mormugao saw a negative growth.

These 12 ports had together handled 293.67 MT of cargo during April-August 2018-19, the Indian Ports Association (IPA) said in its latest data.

Ports like Chennai, Cochin and Kamrajar saw their cargo volumes nosedive about 30 per cent during April-August, while JNPT and Kolkata suffered a drop of over 20 per cent.

India has 12 major ports under the control of the central government — Deendayal (erstwhile Kandla), Mumbai, JNPT, Mormugao, New Mangalore, Cochin, Chennai, Kamarajar (earlier Ennore), V O Chidambarnar, Visakhapatnam, Paradip and Kolkata (including Haldia).

While Kamarajar port saw 31.64 per cent decline in cargo handling to 9.11 MT, Chennai port suffered a drop of 30.36 per cent to

14.42 MT in April-August, as per IPA data.

Cochin Port saw a dip of 29.88 per cent to 10.04 MT during the period.

Cargo handling at JNPT port slipped 25.53 per cent to 21.68 MT, while the same at Kolkata declined 23.74 per cent to 20.65 MT. Mumbai port logged a fall of 19.31 per cent to 20.15 MT. In the wake of the COVID-19 outbreak, sharp declines were witnessed in handling of containers, coal and POL (petroleum, oil and lubricant) among other commodities. These ports handle about 61 per cent of the country’s total cargo traffic. These ports handled 705 MT of cargo last fiscal.

Licence of 56 customs brokers suspended in one year: CBIC NEW DELHI : Licence of 56 customs brokers linked with fraudulent exporters have been cancelled in the last one year, said the Central Board of Indirect Taxes and Customs (CBIC).

Out of these, 37 are from Delhi. The tough action is part of the indirect tax administration’s efforts to check tax evasion using technology and data analytics. Data analytics led to suspension of 56 brokers while investigation is in progress in the case of six others.

The suspended brokers had handled more than 15,290 export consignments of

1,431 untraceable exporters. In one particular case, a customs broker handled exports of 99 untraceable exporters who claimed Rs.121.79 crore of Integrated Goods and Services Tax (IGST) refund, said an official statement.

The indirect tax authority has been able to block IGST refund of 226 crore in these cases so far. “The matter is under further investigation. These 62 customs brokers were placed in three categories based on the extent of their linkage with the non-existent or untraceable exporters,” said the statement.

Customs brokers are required to identify

their client using reliable and authentic documents, which was violated in the case of the 1431 exporters who have vanished.

Exporters are eligible for refund of taxes paid on raw materials and services that go into production of goods meant for exports.

The idea is to ensure competitiveness of the exported products in global markets.

However, this has been a major area of tax evasion.

In all cases where customs brokers are suspected of wrongdoing, full examination of all import consignments have also been ordered, said the statement.

DGFT bans Export of all varieties of onion with immediate effect NEW DELHI: India has prohibited the export of all varieties of onion except those cut, sliced or in powder form. “The export of all varieties of onion…is prohibited with immediate effect,” the Directorate General of Foreign Trade (DGFT) said in a notification. The ban includes Bangalore rose onions and Krishnapuram onions.

These varieties of onion were free for export till now. India exported $198 million of onions in the April-June period of FY21 and $440 million in the entire 2019-20.

Bangladesh, Malaysia, UAE and Sri Lanka are the top importers of Indian onions.

India had last year banned the exports of the key kitchen staple in the

wake of its rising prices in the country and set the minimum export price (MEP) of onion at $850 a tonne to curb its shipments and help bring down soaring prices in the domestic market due to floods in parts of major growing states of Maharashtra and Karnataka.

The MEP was lifted in March this year and onions were made free for export.

Railways register more than 10% jump in freight loading in 1st week of September (YoY) NEW DELHI: Indian Railways Freight loading for the month of September 2020 till 6 September 2020 crossed last year’s loading and earnings for the same period.

In the month of September 2020 till 6 September 2020 Indian Railways loading was 19.19 million tonnes which is 10.41% (1.81 million tonnes) higher compare to last year’s loading for the same period (17.38 million tonnes).

In this period Indian Railways earned

Rs. 1836.15 crores from freight loading which is also Rs. 129.68 crores higher compare to last year’s earnings for the same period (Rs. 1706.47 crores) In the month of September 2020 till 6 September 2020 Indian Railways loading was 19.19 million tonnes which includes 8.11 million tonnes of coal, 2.59 million tonnes of iron ore, 1.2 million tonnes of foodgrains, 1.03 million tonnes of fertilizers and 1.05 million tonnes of cement (excluding clinker).

It is worth mentioning that a number of concessions/ discounts are also being given in Indian Railways to make Railways Freight movement very attractive.

It may be noted that improvements in freight movements will be institutionalized and incorporated in the upcoming zero based time table.

Covid 19 has been used by Indian Railways an opportunity to improve all round efficiencies and performances.

Cochin Port Trust to observe Swachhata Pakhwada COCHIN: Swachhata Pakhwada 2020 will be observed in Cochin Port from 16th to 30th September 2020.

Activities proposed d u r i n g t h e Pa k h w a d a include cleaning of work places, office premises, crafts and public spaces within the Port area.

Swachhata Pakhwada activities will be launched by Dr. M. Beena IAS, Chairperson, Cochin Port Trust

Swachhata Pledge will be administered in all divisions/sections of the Port.

Providing ‘divyang’ access to offices, short film competition (using own mobile phone camera) for employees, poster designing competition for children of employees and several awareness programme are also

planned during the period. All activities will be carried out in compliance of the social distancing/safety instructions issued by the Government to contain Covid-19 pandemic.

Incidentally Cochin Port Trust was awarded First Rank by Ministry of Shipping, among the organisations under the Ministry, in recognition of the activities / awareness programme conducted in Cochin Port during Swachhata Pakhwada 2019.

India's economic activity almost at pre-lockdown levels but Covid looms: Nomura MUMBAI: Economic activity accelerated further in the week ended September 13, returning almost to prelockdown levels, a private tracker released showed. The Nomura India Business Resumption Index, which monitors economic activity normalisation, rose to 81.6 from 79 in the week ended September 6.

Separately, S&P Global Ratings said India’s economy will likely contract 9% in FY21 from a previous estimate of -5%.

Still, that was less steep than cuts forecast by its peers following the June

quarter ’s 23.9% contraction. Both Nomura and S&P sounded warnings about the threat posed to the economy by rising Covid-19 infections.

Meanwhile, consumer inflation dipped marginally but was still outside the upper limit of the target range.

“Business resumption defies pandemic and accelerates further in mid-September,” Nomura Global Markets Research said in its weekly report.

The “tracker of the pace of economic activity normalisation has been picking

up through August and raced ahead to a po st-lo c k do w n hig h” and is j u st 18 percentage points below the pre-pandemic normal, the report said.

The index was at 82.9 on March 22, just before the lockdown that started March 25. It touched a low of 44.7 on April 26.

“We believe the durability of the recovery remains in question, as rising cases may lead to the re-imposition of localised lockdowns or create more risk-averse consumers, despite current levels of lockdown fatigue,” Nomura said.

ADB expects India's economy to contract by 9% in FY2020-21, sees strong recovery in FY22 MANILA: Asian Development Bank expects India's economy to contract by 9% in FY2020-21 as against 4% forecast in June as the Covid-19 pandemic weighs heavily on economic activity and consumer sentiment in the country.

The revision comes on the back of S&P Ratings and Nomura changing their forecasts to a sharper contraction of 9% for India's economy in the current financial year as against their earlier

expectations.

ADB, however, forecasts a strong recovery for India's economy in FY202122 in its Asian Development Outlook (ADO) 2020 Update, with gross domestic product (GDP) to grow by 8% as mobility and business activities resume more widely.

“India imposed strict lockdown measures to contain the spread of the pandemic and this has had a severe

impact on economic activity,” said ADB Chief Economist Yasuyuki Sawada.

“It is crucial that containment measures, such as robust testing, tracking, and ensuring treatment capacities, are implemented consistently and effectively to stop the spread of Covid-19 and provide a sustainable platform for the economy’s recovery for the next fiscal year and beyond,” he said.

TT Club, WSC, ICHCA, COA & GSF join forces on Container safety improvements LONDON: In an effort to help reduce container-related incidents aboard ships, five international freight transport and cargo handling organisations have decided to produce new guidance on packing standards for freight containers and other cargo transport units.

The Container Owners Association (COA), the Global Shippers Forum, the International Cargo Handling Co-ordination Association (ICHCA), the TT Club and the World Shipping Council (WSC) are co-operating on a range of activities to further the adoption and implementation of cr ucial safety practices throughout the global supply chain.

As part of this longstanding cooperation, the five organisations have published a ‘Quick Guide’ to the United Nations sponsored Code of Practice for Packing of Cargo Transport Units (the CTU Code), together with a Checklist of actions and responsibilities for the guidance of those undertaking the packing of cargoes in freight containers specifically.

Dedicated to improving the safety,

security and environmental performance throughout the logistics supply chain, one of the aims of this collaboration is to promote awareness and wider use of the IMO/ILO/UNECE Code of Practice for Packing of Cargo Transport Units – the CTU Code.

There have been several widely reported container fires aboard ships, where containerised cargoes may have been the cause of, or contributed to, such fires.

The organisations believe that consistent, widespread and diligent adherence to the CTU Code by all parties within global CTU supply chains would significantly reduce these types of incidents, some of which have resulted in fatalities and serious injuries amongst ships’ crews and shore-side staff.

Other occurrences, such as container stack failures, vehicle rollovers, train derailments, internal cargo collapses and incidents of invasive pest contamination, can also be traced to poor packing practices. The organisations believe that a greater awareness of the CTU Code and the

packing practices and techniques it contains will help to reduce such incidents.

To do this, the organisations are working together as the Cargo Integrity Group and have identified the following four areas of activity to raise the awareness and improve understanding of safe cargo packing practices: • Promoting awareness and adoption of the CTU Code, of which the guidance material published is an example; • Seeking changes in regulatory requirements to improve their clarity, application, implementation and enforcement, including to the International Maritime Dangerous Goods (IMDG) Code; • Monitoring of CTU packing performance through support for strengthened cargo screening processes and more effective container inspection regimes; • Working with other industry and governmental stakeholders in promoting awareness and better understanding of safe cargo packing and handling practices.

Transaction, legal advisors working towards SCI disinvestment: Shipping Ministry NEW DELHI: The Shipping Ministry has recently said post ''in principle'' approval for strategic disinvestment of government shareholding in Shipping Corporation of India (SCI), transaction and legal advisors are working in this direction.

Replying to a query regarding SCI privatisation in the Rajya Sabha, Shipping Minister Mansukh Mandaviya also said, "The government can make requisition of any Indian assets, including Indian ships, during a war or national emergency".

"CCEA (Cabinet Committee on Economic Affairs) in its meeting held on November 20, 2019 accorded ''in principle'' approval for strategic disinvestment of Government of India's shareholding of 63.75 per cent in SCI along with transfer of management control to a strategic buyer. Transaction Advisor and Legal Advisor have been appointed by the Government for the transaction," Mandaviya said.

The TA (transaction advisor) and LA (legal advisor) are taking appropriate steps

for processing the transaction, he added.

"Director General of Shipping has power to issue directions to ships registered under- Merchant Shipping Act or licensed under Merchant Shipping Act in public interest or in the interest of Indian Shipping to proceed for any particular purpose," the minister said.

Shipping Corporation has a fleet strength of 59 vessels at present and is the largest Indian shipping company catering to the overseas and coastal transportation of goods.

Exports from Gujarat picking up while domestic sales remains subdued AHMEDABAD: Even as the domestic market continues to face challenges on the demand side, exports have come to the rescue of sectors such as pharmaceuticals, ceramics, chemicals and engineering. Export orders have not only helped these sectors stay afloat but also provided a cushion against slowing domestic demand.

Tile-makers see a surge in exports Ceramic tile-makers in Morbi — India’s largest cluster of ceramics — shipped tiles worth Rs 2,700 crore in the April-July. All big ceramic players across Gujarat and India are operating at 80-85% capacity as export demand remains robust.

Domestic demand for ceramic tiles continues to languish with slow recovery of real estate industry. The export market is going strong, with many countries looking at sources other than China. There is also pent-up demand in markets.

“The tile-makers are receiving export orders from the US, UK, Indonesia, Mexico and Europe and the Middle-East,” said Nilesh Jetpariya, president, wall tiles division, Morbi Ceramics Association (MCA).

Export orders rise in engineering Engineering goods exports from India surged by about 9% in July. Some companies in Rajkot even had to fly back their skilled labourers from other states to fulfil orders.

With relations between the US and China getting strained, several American and European companies have turned their eyes on sourcing key engineering components from India.

As far as the engineering industry in Rajkot is concerned, the experts say, the share of export orders in overall production has surged to 50% in the past two months. Before the Covid-19 outbreak, the share was 35%.

“There has been strong demand for agricultural tools from African countries. In addition, export orders for auto parts, pumps, valves and bearings have picked up providing a muchneeded cushion to the industry in this trying time,” said Brijesh Dudhagara, vice-president of Rajkot Engineering Association. The maximum orders are flowing in from European, American and African nations, said industry players.

Breather for cotton yarn makers A subdued textile market has left cotton yarn makers struggling for local orders, their exports have grown by 10% in the past two months. “Higher exports demand pushed up capacity utilisation of spinning mills to 70% in July and August.

The improvement in exports has helped manufacturers sustain their costs and ensure inflow of revenues,” said Saurin Parikh, president, All Gujarat Spinners’ Association (AGSA).

The garments and apparel The garments and apparel exports went down in April-July this year, as against the same period in 2019. However, when compared on a month-on-month basis, the readymade garment exports from the country firmed 55% in June and 32% in July.

“Since the markets in US and Europe have reopened, orders have started pouring in from the international market in a big way.

This helped recover export demand faster than domestic demand,” said Rahul M e h t a , c h i e f m e n t o r, C l o t h i n g Manufacturers Association of India (CMAI).

Due to Covid-19related travel restrictions, the newbuilding contract signing was done through video-conferencing on 11 September 2020, between TS Lines Chairman Chen TeSheng, Huangpu Wenchong’s Chairman Sheng Jigang as well as Wu Aijun, Deputy General M a n a g e r o f C h i n a S h i p b u i l d i n g Tr a d i n g , the CSSC group’s in-house broker.

The newbuildings will be fitted with scrubbers to comply with the International Maritime Organization’s sulphur emissions cap.

TS Lines now operates 56 routes and 44 ships, with a total capacity of 98,000TEU. The company owns 14 of the vessels, of which eight have scrubbers installed. It is expected that two more ships will be installed with scrubbers at the end of February 2021.

Next year, two 2,700TEU newbuildings will be delivered, giving TS Lines ownership of 50% of its operated fleet.

A company representative said, “Owning more ships means we can cut our charter costs. Intra-Asia shipping is doing well, and the low oil price environment is in our favour. We had wanted to order newbuildings, but the travel restrictions meant that it took a longer time to negotiate with overseas yards.”

With the upcoming addition of the CMA CGM JACQUES SAADE to its fleet, the first 23,000 TEU containership to be powered by liquefied natural gas, the Group reaffirms its commitment to the future whilst also demonstrating its loyalty to its longstanding family values of boldness, initiative, integrity, and imagination.

This vessel symbolises a major breakthrough for the improvement of air quality by significantly reducing SOx, NOx, and CO2 emissions.
