Will do whatever it takes to make India Global growth engine, Prime Minister to Large Global Investors NEW DELHI: Prime Minister Narendra Modi on Thursday, 5th November promised “whatever it takes” to make India the engine of global growth, as he invited the top executives of 20 global pension and sovereign wealth funds that together manage about $6 trillion in assets to be part of the country’s “exciting progress ahead”.

The virtual global investors’ roundtable is the latest in a series of meetings held by the PM to draw large-scale foreign investments, especially in infrastructure, to bring the Covid-hit economy back on its feet fast. It comes at a time when domestic private investments have remained anaemic and anti-China sentiments are growing globally.

Exports to improve in the coming months: DGFT NEW DELHI : While October data looked promising for exports, the situation will improve further in the coming months due to collaborative efforts of all the stakeholders, a top official of the Directorate General of Foreign Trade (DGFT) said recently.

Since April, when there was a huge downfall in exports, it has made good progress and is going to rise in the coming months, Director General of Foreign Trade Amit Yadav said while speaking to exporters through a virtual session. The countrywide lockdown was imposed on March 25 to contain the spread of coronavirus infection. “COVID still continues. In the earlier part, times were challenging for exporters and importers. But the October data looks promising. With collaborative efforts, there will be better results,” Yadav said.

After recording positive growth in September, India’s exports declined 5.4% to USD 24.82 billion in October on account of dip in shipments of petroleum products, gems and jewellery, leather, and engineering goods, the Commerce and Industry Ministry said. Yadav said that presently, availability of containers for exports is the biggest challenge the export-import fraternity is facing.

CBIC issues policy and guidelines for setting up ICDs, CFSs, and AFSs NEW DELHI: Central Board of Indirect Taxes and Customs (CBIC) issued policy and guidelines for setting up Inland Container Depots (ICDs), Container Freight Stations (CFSs), and Air Freight Stations (AFSs).

In the last two decades, both the cargo volumes and capacities of ICDs/CFSs have increased manifold. A few key initiatives transforming the manner of trade in recent years, such as implementation of the Authorized Economic Operator (AEO) program, rising penetration of the Direct Port Delivery (DPD) and Direct Port Entry (DPE) initiatives, Self Sealing (RFID seals), Self-Assessment, Electronic Cargo Tracking System (ECTS) and RMS based facilitation have completely changed the operation of Export-Import logistics.

“Therefore, on account of the plethora of changes in the policy, technology landscape and the logistics ecosystem over the time, there is a need for revising the policies and procedure for setting up of new ICDs/CFSs/AFSs to meet the requirement of the changing paradigm and the aspirations of the trade,” the CBIC said.

The new policy takes into account the present capacity, future growth potential, and regional imbalances and also addresses the need for bringing uniformity, transparency, and a seamless approval process.

The new policy further addresses the identied regulatory and logistics concer ns associated with the hard and sof t infrastructure of ICDs/CFSs/AFSs in India.

SCI observed Vigilance Awareness Week-2020 MUMBAI: The Shipping Corporation of India Limited (SCI), A Navratna, Public Sector Enterprise under the Ministry of Shipping, Govt. of India, observed Vigilance Awareness Week-2020 on the theme “Vigilant India, Prosperous India (सतक भारत, समृ भारत)” from 27th October to 02nd November, 2020 at Head Office in Mumbai and its regional offices located at New Delhi, Kolkata, Chennai, Haldia, Port Blair and London.

On 27th October 2020, the Inaugural day, ‘Integrity Pledge’ was administered by Mrs. H. K. Joshi, Chairperson & Managing Director of SCI, in the presence of Board of Directors and Chief Vigilance Officer to all the employees of SCI in Head Office at Mumbai. Due to covid-19 pandemic situation, the inaugural function was organised through phygital mode, wherein limited no. of employees were present in the auditorium hall and remaining employees were available live on digital platform. During inaugural function, annual e-magazine of Vigilance Division“SCI Voyager ” was released by Mrs. H. K. Joshi, Chairperson & Managing Director.

On the opening day, a session was conducted by Shri Sanjay Bhatia, Upa-Lokyukta, Govt.of Maharashtra on the topic of “Role of Intrinsic Virtues in Preventive Vigilance” in SCI Head Office at Mumbai. Shri. Sanjay Bhatia talked about the ways by which we can combat corruption in an efficient and diligent ways using meditation. The session was streamed live for all employees of SCI. Employees are benefitted with this informative and new way to combat corruption session by Shri. Sanjay Bhatia.

Various in house activities and competitions viz. online Vigilance Quiz, Essay writing, Slogan writing, poster drawing were organised for sensitization for employees on theme of vigilance awareness week during 27th October, 2020 to 2nd November, 2020.

On 31.10.2020, a radio programme by Chief Vigilance officer was broadcast on AIR FM Rainbow 107.1 wherein, CVO discussed wide range of topics such as the purpose of organising Vigilance Awareness Week, the significance of vigilance measures, complaint mechanism and vigilance administration in Public/Government organizations. FM radio was chosen as a medium to outreach large section of population for dissemination of Commission’s message and also creating general awareness about Vigilance Awareness Week.

On 02nd November 2020, a Valedictory Function for Vigilance Awareness Week - 2020 was organised through phygital mode in Head Office at Mumbai. A talent show was also organised, wherein employees and their children showcased their talents through digital mode due to current pandemic situation. On this day, a “Compendium on Vigilance Circulars” was also released

by Mrs. H. K. Joshi, Chairperson & Managing Director. Names of prize winners were announced for the various in-house competitions. The Rolling trophy of the Best Corporate Governance Practices was awarded to Technical & Offshore Division and the Rolling trophy of Best Participative Division was awarded to Personnel & Administration Division.

On the Valediction day of Vigilance Awareness Week – 2020, Shri Deepak Chaturvedi, Chief Vigilance Ofcer in his address to the audience emphasized on adopting preventive vigilance mechanism in daily working and also highlighted on “zero tolerance against corruption”. Further, Mrs. H. K. Joshi, Chairperson & Managing Director in her address to the gathering expected to be more vigil in own responsibilities and discharging so as to make SCI vigilant and prosperous organisation.

Bahri signs 5 year framework agreement with Presidency of State Security Agreement seeks to provide various internal and external sea, air, and land transport and freight services RIYADH: Bahri, a global leader in logistics and transportation, has announced the signing of a five-year framework agreement worth SAR 300 million with Saudi Arabia’s Presidency of State Security (PSS). Under the terms of this agreement, which encompasses various internal and external sea, air, and land transport and freight services, Bahri will serve as the official carrier for the Presidency of State Security and all its divisions.

In the presence of the Head of the Presidency of State Security H.E. Abdulaziz Al-Howairini and Bahri Chairman Mohammed Al-Sarhan, and officials from both parties, the agreement was signed by the Deputy Head of State Security for Financial Affairs and Support Services Saleh Al-Dabbasi and Bahri CEO Eng. Abdullah Aldubaikhi.

H.E. Abdulaziz Al-Howairini thanked the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud for agreeing to sign the framework agreement with Bahri to provide transport services for all the divisions of the Presidency of State Security. He praised Bahri’s leading role in serving different government and private sectors, emphasizing the importance of cooperation to achieve the aspirations of the Kingdom’s wise leaders and fulfil the objectives of Vision 2030.

Mohammed Al-Sarhan expressed his pride in signing the agreement, saying: “We would like to extend our sincere thanks and gratitude to the Presidency of State Security for choosing Bahri exclusively and giving us the opportunity to deliver our services to all PSS divisions. This confirms the trust that Bahri has earned in the fields of logistics and transportation, and this

agreement also reflects our commitment to strategic cooperation with different government institutions and agencies.”

Container Traffic at JNPT grows by 11.24% in October over last month • JN Port handled a record number of 548 trains as against the previous highest of 536 trains in May 2011.

• JNPort handled highest LPG of 1,07,530 MT in October.

NAVI MUMBAI: JNPT handled 423,155 TEUs in October, registering a growth of 11.24% in October 2020 compared to previous month and growth of 5.10 per cent over the same month last year. Out of this, 52,087 TEUs were handled at JNPCT (3.37%), 64,254 TEUs at NSICT (+77.78%), 153,548 TEUs at APMT (-7.50%), 80,500 TEUs at NSIGT (-5.32%) and 72,766 TEUs at BMCT (+11.82%). (%variation over same month LY).

The overall traffic handled was 5.73 million tons (MT) during October compared to 5.44 MT in October 2019, posting a growth of 5.37 per cent.

JNPT handled a record number of 548 trains in October, beating the previous highest of 536 trains handled in May 2011.

“This was possible due to the conscientious and excellent team efforts of all stakeholders, terminals, Railways and train operator’s both CONCOR and private operators,” said Shri Sanjay Sethi, IAS, Chairman, JNPT. The port also achieved a new milestone by handling the highest LPG of 1,07,530.67 MT at JNPT-Liquid cargo terminal through seven vessels in October 2020 surpassing earlier record

of 92,877 MT in August 2019.

For the period of AprilOctober 2020, JNPT handled 5,66,815 MT discharge of LPG which is 14.27% higher as compared to 4,96,052 MT handled in the same period LY. JNPT is giving priority and timely berthing to the LPG vessels for fulfillment of distribution of LPG, under Pradhan Mantri Ujjwala Yojna.

At the Liquid Cargo Terminal, JNPT is also handling essential commodities like high speed diesel, Motorspirit, Edible oil etc. LPG is transported through 13.5 KM cryogenic pipeline from ship (JNPT Berth) to LPG BPCL bottling plant at Uran. LPG is then distributed by rail/road/pipeline to Maharashtra, Goa, Madhya Pradesh, Karnataka, Telangana, Punjab, Delhi and Union Territory Chandigarh.

JNPT has systemically invested in enhancing its operational efficiency and handling capacity to enable seamless trade and be the Port of Choice for the Export Import Trade.

Observance of Vigilance Awareness Week -2020 in Mumbai Port Trust MUMBAI: Mumbai Port Trust (MbPT) observed Vigilance Awareness Week – 2020 from 27th October to 2nd November 2020 with the theme “Vigilant India, Prosperous India”. On 27th October 2020, at 11.00 am the Chairman administered Integrity Pledge to the Heads of the Departments of Mumbai Port Trust.

Thereafter, senior officers and employees of Mumbai Port Trust have taken Integrity Pledge in their respective Departments.

Employees have also taken e-pledge.

As a part of Vigilance Awareness Week, MbPT has conducted various activities such as workshops, meeting with customers / vendors / contractors, poem narration competition for employees, Elocution competition for employees and their family members for spreading awareness on the vigilance theme.

Considering the present pandemic situation, most of these activities were conducted online. On the concluding day, MbPT has organized a guest lecture on theme “Vigilant India, Prosperous India” by Dr. Sadanand Date, IPS, Superintendent of Police and Head, Economic Offence Wing, CBI, Mumbai. In September, CMA CGM JACQUES SAADE started sailing as the world’s largest containership to be fully powered by LNG on the French Asia Line 1 service. Named after the late Jacques Saadé, founder of the CMA CGM Group, the giant vessel has since been joined by sistership CMA CGM Champs Elysées and CMA CGM TENERE, the first of six 15,000-TEU, LNG-powered container ships chartered by the CMA CGM Group. They will form a part of the Group’s fleet of 26 LNG-powered vessels by 2022.

LNG is currently the state-of-the-art industry solution for preserving air quality and undoubtedly the best technical solution currently available in terms of energy transition.

Modi impressed on the global funds to take advanatge of the opportunities in the infrastructure sector. Projects involving potential investments of $1.5 trillion over a six-year period through FY25 are showcased under the government’s National Infrastructure Pipeline (NIP), he added.

Stressing the attractiveness of India as an investment destination even during the pandemic, Modi said overall foreign direct investment (FDI) inflows rose by 13% year on year to a record $35.73 billion in the April-August period.

India’s reliance on FDI grew substantially in recent years, as overleveraged domestic investors cut down on fresh expansions.

CBIC issues policy and guidelines for setting up ICDs, CFSs, and AFSs Cont’d. from Pg. 3 It establishes a framework of functional requirements pertaining to the design and operation of dry ports, as well as establish certain processes to enable sustainable growth of the sector.

Lastly, the new policy aims to lay down appropriate institutional, administrative, and regulatory frameworks for the development and smooth operation of ICDs/CFSs/AFSs, including procedures for regulatory inspection and the execution of applicable customs control and formalities.

It has been decided to group the country in three types of areas for the purposes of opening of new ICDs/CFSs namely Green Zone States, Blue Zone States, and Red Zone States. The Green Zone States are low on ICD/CFS infrastructure. These will be open for proposals for Himachal Pradesh, Bihar, Jharkhand, West Bengal, Sikkim, Assam, Arunachal Pradesh, Nagaland, Manipur, Mizoram, Tripura, Meghalaya and Telangana and Union territories of Jammu and Kashmir and Ladakh.

The Blue Zone States where the proposals can be accepted only for specic trade generating locations with no existing

facilities or with over-utilized facilities for Uttarakhand, Uttar Pradesh, Chattisgarh, Odisha, Andhra Pradesh, Goa, Karnataka and Kerala and Union Territories of Pudhucherry, Diu and Daman.

The Red Zone are the identied states that have adequate ICD/CFS infrastructure. These may be closed for any new CFSs development indenitely.

However, in exceptional cases, IMC may approve the setting up of ICDs in trade generating locations with high export & import potential and need for new facilities (all the states and union territories not listed in Green and Blue Zones).

Exports to improve in the coming months: DGFT Cont’d from Pg. 3 Yadav said that trade facilitators like ports are making their best efforts to make containers available to exporters.

According to Yadav, the government has plans to create district export hubs for which a draft report has been prepared.

He said that this will require districtlevel data and export potential of products and the various bottlenecks that are being

faced. Yadav said that the new Foreign Trade Policy will be implemented from April 2021 as the current one has been extended by one year.

Regarding the Merchandise Exports from India Scheme (MEIS), Yadav said although it is blocked at the moment, it will probably open shortly keeping in view the overall fiscal position of the country. The MIES is a scheme designed

to provide rewards to exporters to offset infrastructural inefficiencies and associated costs. The Commerce and Industr y Ministr y has blocked the online system for exporters to apply for availing tax incentives under the MEIS from July 23, as the Department of Revenue decided to limit the benefits under the plan at Rs 9,000 crore for April-December 2020.

Govt to soon launch self-certification scheme for chemicals industry to make Globally competitive - Mansukh Mandaviya NEW DELHI,: Mr Mansukh Mandaviya, MoS (IC) for Shipping & MoS for Chemicals and Fertilizers, Govt of India today said that the government is in the process to launch a self-certification scheme for the Indian chemicals industry, which will not only benefit the industry but also make India globally competitive in ease of doing business.

Addressing a webinar 'Post-COVID-19: The Future and Dynamics of Agrochemicals Industry', organized by FICCI, jointly with HIL, Mr Mandaviya said that the chemicals and agrochemicals industry is growing rapidly, and India will soon become the priority for foreign companies. "In the future, the world will trade with India and this is an opportunity for the chemicals sectors. Global companies

are today investing in India," he added.

The Minister stated that said that during the COVID period the government has worked to support the industry and the economy to bring ease of doing business.

"Post-COVID, the global scenario will change, and we will have to work to start exporting to those countries from where we currently import," he emphasized.

Nafed nalises bidders, issues order for supply of 15,000 tonnes of imported onions NEW DELHI: The Co - operative Nafed recently said it has finalised bidders and issued orders for timely supply of 15,000 tonnes of imported onions, which will help boost domestic availability and check price rise. Since the imported onions will be delivered at port cities, state governments have been asked to indent their quantity for faster dispatch of the commodity, it said.

Nafed plans to float regular tenders for supply of additional supplies of imported onions, it added.

“On 5th Nov, Nafed received a good response in the tenders with offers to supply at Tuticorin and Mumbai. Nafed very swiftly has issued confirmation to successful bidders last evening itself so that timely releases are made in the market," an official statement said.

Unlike last year when MMTC had directly imported yellow, pink and red onions from Turkey and Egypt, this year private importers have been offered to supply. This may ensure quality supply in minimal time, it added.

Nafed, on the directions of the central government, had floated tenders on October 31 for supply of 15,000 tonnes of imported red onions at port towns loaded on truck and rail from importers.

Sub. : Policy and Guidelines for setting up of Inland Container Depots (ICDs), Container Freight Stations (CFSs) and Air Freight Stations (AFSs)-Reg. 1. Introduction 1.1 An Inter-Ministerial Committee (IMC) was constituted in 1992 to act as a single window for clearance of proposals to set up Inland Container Depots (ICDs), Container Freight Stations (CFSs) and Air Freight Stations (AFSs). The Ministry of Commerce and Industry Guidelines, 1992 prescribed the requirements for setting up of the ICDs and CFSs. The subsequent guidelines issued by the Department of Commerce (DoC) and Central Board of Indirect Taxes and Customs (CBIC) set the rules for establishment & functioning of these facilities. The matters relating to setting up of ICDs/CFSs/AFSs were brought under CBIC in 2018. Accordingly, the Board had reconstituted the Inter-Ministerial Committee vide order issued under F.No. 434/04/2018-Cus.IV dated 20.06.2018.

1.2 In the last two decades, both the cargo volumes and capacities of ICDs/CFSs have increased manifold. A few key initiatives transforming the manner of trade in recent years, such as implementation of the Authorized Economic operator (AEO) programme, rising penetration of the Direct Port Delivery(DPD) and Direct Port Entry(DPE) initiatives, Self-Sealing (RFID seals), Self-Assessment, Electronic Cargo Tracking System (ECTS) and RMS based facilitation have completely changed the operation of Export-Import logistics. The CBIC is also targeting higher DPD, DPE numbers with minimum but more effective Customs interventions aided by technological measures.

1.3 Similarly, physical infrastructure has undergone exponential improvements with the development of expressways, national highways connecting ports to hinterland. Many new private ports & terminals within the existing ports have come up on both Western and Eastern coasts of the country. The operationalisation of Western and Eastern Dedicated Freight Corridors in near future is expected to completely change the dynamics of cargo movement.

1.4 At present, majority of CFSs are located up to 50 kms away from the port and are concentrated in high numbers in the western and southern India. ICDs on the other hand are concentrated in the northern hinterland. Similarly, the traffic across ICDs is also not distributed evenly, only 25 ICDs cater 83% of the total volume (in terms of Shipping Bills and Bills of Entries).

1.5 Therefore, on account of plethora of changes in the policy, technology landscape and the logistics ecosystem over the time, there is a need for revising the policies and procedure for setting up of new ICDs/CFSs/AFSs to meet the requirement of the changing paradigm and the aspirations of the trade.

1.6 Accordingly, the new policy: i takes into account the present capacity, future growth potential and regional imbalances and also addresses the need for bringing uniformity, transparency and seamless approval process; ii addresses the identified regulatory and logistics concerns associated with the hard and soft infrastructure of ICDs/ CFSs/AFSs in India; iii establishes a framework of functional requirements pertaining to the design and operation of dry ports, as well as establish certain processes to enable sustainable growth of the sector; and iv aims to lay down appropriate institutional, administrative and regulatory frameworks for development and smooth operation of ICDs/CFSs/AFSs, including procedures for regulatory inspection and the execution of applicable customs control and formalities.

2. Distinction between ICD, CFS and AFS 2.1 Inland Container Depot (ICD) : 2.1.1 An off seaport (or port) facility having such fixed installations or otherwise, equipment, machinery etc. providing services for handling / clearance of laden import, export containers for home use, warehousing, temporary admissions, re-export etc under customs control and with storage facility for customs bonded or non-bonded cargo.

2.1.2 An ICD is a "self-contained Customs station" like a port or air cargo unit where filing of Customs manifests, Bills of Entries, Shipping Bills and other declarations, assessment and all the activities related to clearance of goods for home use, warehousing, temporary admissions, re-export, temporary storage for onward transit and outright export, transshipment, etc., take place. An ICD would have its own automated system with a separate station code (such as INTKD 6, INSNF6 etc.) being allotted by Ministry of Commerce and with in-built capacity to enter examination reports and enable assessment of documents, processing of manifest, amendments, etc.

2.2. Container Freight Station 2.2.1 An off seaport (or port) facility having such fixed installations or otherwise, equipment, machinery etc., providing services for handling / clearance of laden import, export containers for home use, warehousing, temporary admissions, re-export etc under customs control and with storage facility for customs bonded or non-bonded cargo.

2.2.2 Though by definition, both ICD and CFS are similar, a CFS is only a Customs area notified under section 8 of the Customs Act, 1962, located in the jurisdiction of a Commissioner of Customs exercising control over a specified Customs port, airport, LCS/ICD while an ICD is notified under section 7 of the Customs Act, 1962. A CFS cannot have an independent existence and has to be linked to a Customs station within the jurisdiction of the Commissioner of Customs. It is an extension of a Customs port set up with the main objective of decongestion. In a CFS only a part of the Customs processes mainly the examination of goods is normally carried out by Customs besides stuffing/deÂŹstuffing of containers and aggregation/ segregation of cargo. Thus, Custom's functions relating to processing of manifest, import/ export declarations and assessment of Bill of Entry/Shipping Bill are performed in the Custom House/Custom Office that exercises jurisdiction over the parent port/airport/ICD/LCS to which the said CFS is attached. In the case of Customs Stations having facility of automated processing of documents, terminals are provided at such CFSs for recording the result of examination, etc. In some CFSs, extension Service Centers are available for filing documents, amendments etc. However, the assessment of the documents etc. is carried out centrally.

2.2.3 An ICD may also have several CFSs attached to it within the jurisdiction of the Commissioner of Customs just as in the case of a port.

2.3. Air Freight Station (AFS) 2.3.1 An off-airport common user facility equipped with fixed installations of minimum requirement and offering services for handling and temporary storage of import and export cargo etc.

2.3.2 While CFS handles maritime cargo, an AFS is meant to handle air cargo.

2.4. Important centers of activity relating to ICDs/CFSs/AFSs 2.4.1 Rail Siding (in case of a rail-based terminal): The place where container trains are received, dispatched and handled in a terminal. Similarly, the containers are loaded on and unloaded from rail wagons at the siding through overhead cranes and / or other lifting equipment.

2.4.2 Container Yard: Container yard occupies the largest area in the ICD/CFS. It is stacking area where the export containers are aggregated prior to dispatch to port, import containers are stored till Customs clearance and where empty containers await onward movement. Likewise, some stacking areas are earmarked for keeping special containers such as refrigerated, hazardous, overweight/over- length etc.

2.4.3 Warehouse: Public warehouse appointed under section 57 or private warehouse licensed under section 58 is a covered space/shed where export cargo is received and import cargo stored/delivered; containers are stuffed/stripped or reworked; LCL exports are consolidated and import LCLs are unpacked; and cargo is physically examined by Customs.

Export and import consignments are generally handled either at separate areas in a warehouse or in different nominated Cont’d Pg.21 warehouses/sheds.

2.4.4 Gate Complex: The gate complex regulates the entry and exits of road vehicles carrying cargo and containers through the terminal. It is place where documentation, security and container inspection procedures are undertaken.

3. Functions and benefits of ICDs/CFSs/AFSs 3.1 The primary functions of ICD/CFS/AFS include receipt and dispatch/delivery of cargo, stuffing and stripping of containers, transit operations by rail/road to and from serving ports; customs clearance, consolidation and desegregation of loose Container Load (LCL) cargo, temporary storage of cargo and containers, reworking of containers; and maintenance and repair of container units.

3.2 ICD/CFS/AFS, inter alia, offer the following benefits to the trade, namely, serving as concentration points for long distance cargo movement and transit facility, making available customs clearance facility available near the centers of production and consumption free movement of cargo at gateway ports and decongesting the ports, reducing the costs of transport, inventory, demurrage and level of pilferage; enabling intermodal transshipments 86 repositioning of containers for shipping lines.

4. Criteria for new ICDs/CFSs/AFSs 4.1. Geographical Criteria for approvals 4.1.1 It has been seen in the past that the tendency of developers to set up facilities in few selected areas led not only to proliferation at those centers but also has resulted in investments being made near big cities/ports, far from the manufacturing/ exporting units. Moreover, such distorted penetration results in higher costs for inland units apart from creating manpower issues for the departments.

4.1.2 Therefore, it has been decided to group the country in three types of areas for the purposes of opening of new ICDs/CFSs as under following: • Green Zone: States low on ICD/CFS infrastructure. These will be open for proposals (Himachal Pradesh, Bihar, Jharkhand, West Bengal, Sikkim, Assam, Arunachal Pradesh, Nagaland, Manipur, Mizoram, Tripura, Meghalaya and Telengana and Union territories of Jammu and Kashmir and Ladakh); • Blue Zone: States where the proposals can be accepted only for specific trade generating locations with no existing facilities or with over utilized facilities (Uttarakhand, Uttar Pradesh, Chattisgarh, Odisha, Andhra Pradesh, Goa, Karnataka and Kerala and Union Territories of Pudhucherry, Diu and Daman); and • Red Zone: The identified states have adequate ICD/CFS infrastructure. These may be closed for any new CFSs development indefinitely. However, in exceptional cases IMC may approve the setting up of ICDs in trade generating locations with high export & import potential and need of new facilities (all the states and union territories not listed in Green and Blue Zones).

4.1.3 Distance of ICD from ports - Rail transport is price competitive with road transport when the lead distance is more than 200 kms.

Rail connected ICDs are favored at hinterland locations with lead distances up to 1,500 kms in north India. The development of ICDs within 200 kms of a connecting/Nearest serving seaport shall be discouraged. The measure is expected to further encourage DPD & DPE movement between hinterland & ports. For calculation of distance, the chargeable route by rail and shortest road (National Highway / State Highway) from serving port shall be considered. This rule shall be applicable across all geographical zones.

4.1.4 Distance between ICDs - No Greenfield ICD shall be permitted to be established within 100 kms distance from existing ICD. Distance will be referred as chargeable railways route (both directions) between ICDs and shortest road distance (National Highway / State Highway, both directions) in case of road linked ICD. This rule shall be applicable across all Geographical zones.

4.1.5 Development in States with low Logistics Infrastructure - To support infrastructure development in states with limited logistics infrastructure, priority should be given to Identifying and promoting ICD/CFS/AFS facilities where presence of such facilities is limited. These are clustered in Green Zone as proposed above. IMC can give relaxation on Distance rules in Green Zone.

4.1.6 National Logistics Action Plan/ Policy - The approval and notification of all new ICD/CFS, including existing and new MMLPs will be processed in consonance with the national logistics action plan/policy.

4.1.7 Inland National Waterways - Development of ICDs based on Inland National Waterways as mode of transportation will be encouraged with relaxation being given on Geographical Zone& Distance rules.

4.1.8 Railways Freight Corridors - Approval of Greenfield ICDs directly along/ Linked with DFCs (Eastern & Western DFCs and any new operationalized railways freight corridor) will be accorded with no more than one ICD directly connected with these corridors within chargeable distance of 100 kms in both directions. It is expected that some of existing ICDs will get connected directly to freight corridors and while some will operate in Hub & Spoke model in future. With priority of increasing utilization of Freight corridors as they operationalize and lowering the logistics costs, IMC can accord approvals to these facilities in any zone while maintaining distance rules on the corridors.

4.1.9 Exceptions - IMC can approve creation of additional facilities near existing ICDs (all 3 zones) if the demand exceeds the existing capacity of ICDs/CFSs in trade generating location/area. This can be determined by analyzing the existing utilization of ICDs in designated trade generating location/area.

4.1.10 In no case a new CFS shall be set up which is linked to an ICD. Only CFSs connected to ports in the permissible Zones (as mentioned above) shall be allowed after considering existing capacity and utilization parameters.

4.1.11 AFSs are relatively new to India, hence, in the case of AFSs, the IMC while considering the application, will only take into account the demand-supply gap and take appropriate decision.

4.2. Volume 4.2.1 The facility must be economically viable to manage and attractive to the users, to the railways for full train load movements; to other transport operators; seaports; shipping lines; freight forwarders etc. and must operate at certain minimum amount of traffic. The applicants must therefore study carefully the viability of the project from the point of view of the TEU traffic availability.

4.2.2 In the time of growing international trade, the creation of any infrastructure facility must commensurate with the generation of demand in actual terms. This is particularly important as such facilities have a long gestation period for being fully operationalized. Accordingly, the minimum threshold performance shall be 7200 TEUs/consignmentsi per year (two way) for an ICD and 1200 TEUs/ consignments per year (two way) for a CFS. However, no such threshold performance is prescribed for an AFS. 4.3. Land 4.3.1 The minimum area requirement is seven hectare for ICD having minimum area of four hectares as Customs Notified Area and minimum one hectare nominated for DPD & DPE nominated space. For states in Green Zone, ICD with three hectares for customs notified area and one hectare for DPD & DPE may be considered. The minimum area requirement shall be two hectare for a CFS. For AFS 1000 Sq. meters of covered area each for imports and exports respectively shall be made available.

4.3.2 Ownership of Land - The applicant must have the legal rights over the land which is proposed for ICD/CFS construction.

If the land is not owned and the land is leased, the lease agreement with lessor must be for period of 30 years. Change of Land Use certificate, wherever required shall accompany the application and land should be free from acquisition proceeding at date of application. The land parcels should be contiguous with only exception for setting up non-bonded storage facility.

4.4. Other Criteria 4.4.1 Legal entity - The applicant must be a legal entity in India under applicable law. The entity must possess a valid GST registration and should have been operating for a minimum period of three years.

4.4.2 Prior experience - The applicant must have prior experience of operating as CCSP or should have other trans-border logistics experience such as logistics service provider including customs brokers, transporters, freight forwarders, shipping lines and port terminal operators. ...........to be continued 1 Consignments here refers to Shipping Bill/ Bill of Entry

Numerous companies reach out to Govt, raise concerns over import delays at ports NEW DELHI: Custom delays are troubling various sectors yet again. This time, the pain point is the new compliance norm through which duty benefits can be claimed under various Free Trade Agreements, where a company needs to justify the benefit claim keeping the rules of origin in mind.

According to sources, “Around 600 Japanese and over 100 companies from ASEAN nations have raised concerns with the Indian gover nment and customs authorities over the challenges they are facing at various ports to get goods cleared with duty benefits.”

In September, customs authorities started sensitising companies about the new rules and necessary precautions that importers need to take to comply with the latest rules.

The government amended customs laws in the 2020 Union Budget and issued new rules recently to curb the misuse of customs duty concessions

under FTAs. The domestic industry has been urging the government to take strict action to curb such irregular imports which were allegedly done by flouting FTA provisions.

Customs authorities are clear that importers must satisfy the mandatory rule of 35 percent value addition in the origin country to claim duty exemption under FTAs. According to sources, importers have submitted a detailed representation where they said: “Compliance with rules of origin to claim duty benefits under free trade agreements is leading to massive import delays. Companies are facing cash flow issues and blockage of working capital. Companies say that Customs Department is blocking bank guarantees for over a month.”

“Industry majors that have raised the matter with the government include the likes of Samsung, LG, Toyota,

Hyundai, Honda, Ford etc,” sources said and added, “Even the authorised economic operator companies are facing delays and challenges.”

Companies have also raised concerns with field officers of the Customs Department, but are unable to get any relief, sources added. Industry majors were exempt from furnishing bank guarantees earlier and the rules of origin norms kicked in from September 21 and since early October industry and trade has been reaching out to the government to ease bottlenecks.

When checked with the Customs Department, it learnt that the Central Board of Indirect Taxes and Customs – the apex policy making board for customs — has already started taking measures to resolve the issue. “CBIC is constantly reviewing both rules of origin and faceless assessment and is interacting with trade and field officers to ease the pain on a weekly basis.”

Basmati Exports to Iran to resume soon, feels Exporters NEW DELHI: Basmati rice exports to Iran are likely to resume as the country has lifted its ban on imports from India and indicated that it will make payments of over Rs 1,700 crore to Indian exporters which have been due since last year.

The lack of an effective payment system has hit trade with Iran, which is the largest importer of Indian basmati rice and absorbs about one-third of this variety.

"Exports of basmati rice to Iran from India have seen a drop of 36% in April August of this year compared to the previous year, largely due to stalled remittances,” said Vinod Kaul, executive director of All India Rice

Exporters Association. “However, we have got positive indications on resolution of the payments issue against shipment since December 2019.

Also, the Iranian government has opened its seasonal ban on imports a month in advance, which is good news for exporters."

The association has requested the government to work out a safe payment mechanism and see if it can permit third-party payment mechanism in dollar and UAE dirham.

India and Iran have been trading through a rupee account in UCO and IDBI Bank, but since May 2019, there was no inflow of funds in the accounts as there was no import of crude oil by India.

Exporters said that they are in talks with buyers in Iran and were expecting exports to pick up.

"We are waiting for the currency allocation by the Central Bank of Iran and the Indian government to guide us on which route to get the money. We should be signing contracts for January delivery soon, " said Satish Goel of Shree Jagdamba Agrico Exports.

Exporters said it was not easy to find new markets and drop in exports to Iran will make impact on other markets like Saudia Arabia, Yemen and Iraq.

Prices of export quality basmati rice are already 15% less than the previous year at Rs 46 a kg, which may increase once exports to Iran begins, said Goel.

Adani Ports to handle crude imports for HPCL’s upcoming renery in Rajasthan AHMEDABAD: Adani Ports and Special Economic Zone Ltd (APSEZ) has signed a 30-year deal to handle crude imported by Hindustan Petroleum Corporation Ltd (HPCL) for its upcoming refinery and petrochemical complex in Rajasthan’s Barmer district.

APSEZ did not disclose the value of the deal.

Rajasthan Refinery Ltd is a 9 million tonnes per annum (mtpa) refinery and petrochemical project being constructed

by HPCL with an investment of Rs. 43,129 crore. The crude imported by HPCL for the plant will be handled at Mundra port in Gujarat, the flagship port of APSEZ and India’s biggest commercial port by volume handled.

In the September quarter, the crude cargo handled by Mundra port grew 76 per cent on the back of higher imports

by Indian Oil Corporation Ltd and HPCL-Mittal Energy Ltd. Crude cargo accounted for 4.38 per cent of the 36.13 mt of cargo handled by Mundra during the second quarter of FY21, according to an investor presentation of APSEZ. In the first quarter, it had accounted for 2.5 per cent of the 25.75 mt of cargo.

Crude cargo accounts for 12 per cent of the overall cargo handled by APSEZ across its portfolio of 10 ports.

India's Cotton Exports could jump 40% to seven-year high as prices rally MUMBAI: India's cotton exports could jump 40% in 2020/21 from a year ago to 7 million bales, the highest in seven years, as depreciation of the rupee and a rally in global prices allow exporters to clinch export contracts, the head of a leading trade body said.

Higher exports by the world's biggest cotton producer in 2020/21 season, started on Oct. 1, could weigh on global prices and limit shipments from rivals such as the United States and Brazil to key Asian buyers such as China, Bangladesh and Vietnam.

“Export demand is good as our cotton is the cheapest in the world market," Atul Ganatra, President of

the Cotton Association of India, said.

A recovery in global prices could lift Indian exports to 7 million bales in the new season from 5 million bales a year ago, Ganatra said.

Global cotton prices have been near their highest in nearly 17 months, while the Indian rupee hit a two-month low this week, increasing traders' margins from overseas sales.

Indian cotton is being offered at around 74 cents per lb, cost and freightbasis, to buyers in China, Bangladesh and Vietnam for November shipment, versus more than 77 cents from Brazil and the United Sates, dealers with global trading firms said. Most of the shipments are

heading towards China and Bangladesh, said Ar un Sekhsaria, Managing Director of exporter D.D. Cotton.

India will have ample surplus for exports as the country is set to produce more cotton this year than last year's 35.45 million bales, Sekhsaria said.

In October traders exported 700,000 bales and contracts for another 1 million bales have signed for November shipment, said a Mumbai-based dealer with a global trading firm.

Limited availability of containers has been delaying exports by a few days and cotton exporters have requested the Commerce Ministry to provide more containers, Ganatra said.

Shanghai becomes World's 1st Port to handle 4 Mn TEUs in a month SHANGHAI: The Port of Shanghai has broken its own monthly container handling record, becoming the first port in the world to handle more than four million TEU in a calendar month.

Shanghai, the world's biggest boxport, handled 4.2 million TEU in

October, up 15.7 per cent year on year, surpassing the record it set in July by 297,000 TEU. "This shows the current strength of demand, but that might not last for m a n y m o r e m o n t h s . We h e a r anecdotal reports of western ports somewhat melting down, but it

appears that Shanghai - and the Asian ports generally - have the ability to rise to peak demand challenges," CTI Consultancy's Andy L a n e s a i d e r c e n t l y. S h a n g h a i handled 43.3 million TEU last year, 6.1 million TEU more than second place, Singapore.

Rail traffic disruption in Punjab hits Baddi’s ICD business hard NEW DELHI: Nearly 50 per cent business of the Baddi-based inland container depot (ICD), which transships industrial goods to dry ports in Punjab, has been hit with the disruption of rail traffic in Punjab. The problem has been compounded with the delayed availability to containers with the waiting time being two to four weeks.

On an average, five to 10 containers were transshipped per day earlier to

Punjab from where they were transported further to various ports in Mumbai and Gujarat by the railways.

“Disruption in rail traffic coupled with shortage of containers due to reduced import has drastically hit the business at the ICD, Baddi. Nearly 50 per cent business has been hit due to Covid and though we are offering alternative transportation through the roads it was a costlier proposition,” informed Anuj Kumar, in-charge, ICD, Baddi.

Curbs on imports, especially from China, have led to a fewer containers being available in the market. Since the trade thrives on a balance of export and import, the reduced import has led to fewer containers coming back at the ports.

This has further reduced their availability in the industrial clusters like Baddi-BarotiwalaNalagarh which houses 89 per cent of the state’s industry.

Forex reserves up USD 18 mn to record high of USD 560.72 mn MUMBAI: The country’s foreign exchange reser ves rose USD 183 million to touch a record high of USD 560.715 billion in the week ended October 30. According to the Reserve Bank India data, in the reporting week, the reserves rose due to an

increase in foreign currency assets.

FCA rose by USD 815 million to USD 518.339 billion.

The RBI’s weekly data showed that Gold reserves declined USD 601 million in the reporting week to USD 36.259 billion. The RBI data also showed the

special drawing rights with the International Monetary Fund (IMF) decreased USD 6 million to USD 1.482 billion during the week. The country’s reserve position with the IMF also declined by USD 25 million to USD 4.636 billion during the reporting week.
