Eligibi ity Requ rements: To be e igible to part c pate in the 2024 Av Clear® Holiday Perks Promot on (the “Promotion”) and to receive the Promotional Gift Card described below, an Av Clear® prov der: must be a Cutera, nc authorized AviClear® prov der (“Av Clear® Provider”); must be ocated n the United States or Canada; must be n good stand ng w th Cutera, Inc and have no past due payments or service ho ds on its account; and must uti ize the QR code pat ent D system and treat ten (10) new patients between November 1, 2024 and December 31, 2024

Under no circumstances n any such dispute shall the AviC ear® provider be permitted to obtain awards for, and hereby waives all rights to, punit ve, incidenta , or consequentia damages including reasonable attorney’s fees, other than the AviC ear® provider’s actual out-of-pocket expenses (i.e. costs associated with entering this Promotion). The AviClear® provider waives all rights to have damages mult plied or increased.
