The Boone County Sheriff’s Office is asking for help for any information on a hit-and-run accident which took the life of an elderly female on Nov. 25.

Anita Wernsing, 78, of Fayette, was believed to be walking from Mt. Tabor Primitive Church to her home, directly across the street in the 7000 block of South State Road 267, but was struck by a vehicle traveling northbound on SR 267. After striking Wernsing,the unknown vehicle ran off the road and continued northbound. The call to Boone County 911 came in at 6:03pm from witnesses who found her about 100 yards from the church. Wernsing was pronounced dead at the scene.

Zionsville Community Schools is among select U.S. and Canadian school districts being honored by the College Board with placement on the 3rd Annual AP District Honor Roll for simultaneously increasing access to Advanced Placement course work while increasing the percentage of students earning scores of three or higher on AP Exams.

“Alignment of top notch teaching services with motivated and hard-working students allows ZCHS youth to again distinguish themselves and our school community through Advanced Placement course success,” said Supt. Dr. Scott Robison. “Congratulations once again to students, teachers, counselors, schoolhouse leaders, and engaged, supportive parents. Young people who persist and succeed in hard courses do better and go farther in future academic challenges.”

Achieving both of these goals is the ideal scenario for a district’s AP program because it indicates success in identifying motivated, academically prepared students who are likely to benefit most from rigorous AP course work. Since 2010, Zionsville Community High School has increased the number of students participating in AP by 134 students. This participation increase is a 24 percent gain from 2010 to 2012.

The participation increase was achieved while continuing to attain a performance level in which more than 70 percent of AP students scored a three or higher on the exam. More than 90 percent of colleges and universities across the U.S. offer college credit, advanced placement or both for a score of three or above on an AP exam — which can potentially save students and their families thousands of dollars in college tuition.

My house settles on its foundation twice a year. Like clockwork. Once in the summer and again in the winter.

As a result, doors that stick or won’t close in the summer suddenly work perfectly when the frost is on the pumpkin. Conversely, the latches that won’t connect in the winter snap shut with precision when the temperature soars in July.

I didn’t always understand this. When it first happened right after we moved in, I whipped out my plane and reduced the size of a sticking door by an offending quarter inch. For six months it worked perfectly. Then I suddenly noticed that when the door closed, it was a good half-inch away from the latch. By the time I decided to replace the door a few months later, the house had settled again and it worked like a charm.

For several years I seesawed back and forth trying to find a solution. I removed and exchanged storm doors, rebuilt locks and latches, and checked the entire foundation for flaws.

When the seasons changed, I grabbed my level and got down on my hands and knees to check out the floors. Everything was fine. Except for the doors of course.

Over the years I’ve grudgingly grown accustomed to it. I know which doors I can use by whatever season it happens to be. Still, it’s aggravating. Especially since my dog Brutie doesn’t understand that he can’t come and go by the same door year round.

Actually, I may have a solution: Two doors for every opening. One for summer and another for winter. Sort of like we used to do back in the dark ages of my youth when we took down the screens and put up the storm windows.

I’m pretty sure Brutie will appreciate it.

Wandering around Z-Ville Commentary by Julie Osborne Christmas has arrived in Zionsville! From Father Christmas illuminating the village tree the day after Thanksgiving to Christmas in the Village being ushered in with the VIP Christmas Celebration on Friday night, one can’t help but feel the spirit while wandering around town.

While strolling down Pine Street, I found myself drawn to the oversized “Santa’s Post Office” mailbox parked in front of “The Best Little Toy Store on Earth,” Explorer Toys. It’s a kid’s paradise and ALMOST makes me want to have kids again when I step inside this magical place, which took me back to my childhood instantly. A few doors down at Ganache Chocolatier I actually did become a child again as I sampled the Chocolate Explosion candy bar which begins to slowly melt in your mouth, but then popping emerges out of nowhere. Yes, a candy bar laced with pop rocks! This childhood favorite is still around and can’t help but put a smile on your face when the explosion begins.

There was no need to look further for stocking

stuffers - dark chocolate malted milk balls, sea salt caramels, white chocolate pretzels. Done!

Soon, it was time to take a break and somehow I ended up at Cobblestone Grill. Not sure how that happened but there was a $5 martini special.

I have discovered in life that “specials” are usually special for a reason and relaxing at the bar confirmed it, especially with Brett mixing the drinks. The only discovery I made is that you can’t send a text message from the bar if you are sitting on the “other side of the pillar”. This makes no sense. None at all. I must go back for further investigation. When is the next $5 martini night?

Wandering around Zionsville is an adventure with many new discoveries along the way. I couldn’t think of a better place to be than this charming, little town especially during Christmas.

And my wandering continues...

On Nov. 4, members of the Hamilton/ Boone County Drug Task Force served a search warrant at a motel room in Lebanon. Officials discovered the remnants of an ongoing methamphetamine manufacturing operation, methamphetamine, and methamphetamine paraphernalia at the location along with a small child. The following were arrested: Joshua Reed and Brandi Reed, Lebanon – A Felony manufacturing methamphetamine within 1,000 feet of a family housing complex, B Felony possession of methamphetamine within 1,000 feet of a family housing complex, C Felony possession of precursors within 1,000 feet of a family housing complex, D Felony maintaining a common nuisance and D Felony child neglect.

All four suspects were taken to the Boone County Jail following their arrest. This raid and arrests come as part of a three-month ongoing investigation. More arrests are expected in connection with this investigation. The Hamilton/ Boone County Drug Task Force was assisted by the Indiana State Police Clandestine Team, the Lebanon Police Department and child welfare.

The Hamilton/Boone County Drug Task Force is comprised of officers from the Carmel, Fishers, Lebanon and Zionsville police departments and the Hamilton County Sheriff’s Office, with support from the Hamilton County Prosecutor’s Office and the Boone County Prosecutor’s Office.

Anyone wishing to report any type of illegal drug activity for Boone or Hamilton counties should contact the Hamilton/Boone County Drug Task Force Drug Hotline at 571-2545.

Hussey-Mayfield Memorial Public Library December events Our Heroes’ Tree – Through Dec. 23 • The library will partner with the Indiana State Library to present Our Heroes’ Tree, a national program founded to recognize and honor the sacrifices of current military personnel, veterans and deceased service members. Again.

The big issues simply keep coming for Zionsville, and the latest contentious talking point revolves around a proposal to erect a Walmart on Michigan Road near 106th Street in Zionsville.

It’s a revisiting of an issue dating to 2006, when the Arkansas-based retail giant first expressed interest in the parcel in question – 10950 N. Michigan Rd. – acreage which it now owns, despite being thwarted.

Whereas the first iteration of the issue has hung in the air for six years, this time around a clear answer could be had in six weeks. Particulars of the package will first be heard on Jan. 8 by the Zionsville Board of Zoning Appeals, and subsequently at a Jan. 22 Plan Commission meeting.

The latter hearing could well determine if it is Yea or Nay for the entire project.

The particulars

Both aforementioned meetings are rescheduled dates of previously-planned readings. A petition for a Development Standards Variance was scheduled to be heard at the Nov. 27 BZA meeting, but a continuance was made. On Jan. 8, it will be decided whether the proposed structure can exceed the B-2 zoning square footage limitation of 125,000 for an integrated center; the potential building eclipses that mark by 31,621 square feet.

The Plan Commission reading, originally on tap for Dec. 17, would grant approval for Walmart’s development plan – a defacto referendum on the project.

The Jan. 8 square footage decision is in direct response to 2006 negotiations between Walmart and Zionsville. Then, a 300,000-square foot building was proposed, which required rezoning. The sitting Town Council denied that move, and Walmart’s developer altered its plans to circumvent the ruling. The square footage parameters were then enacted, in essence tabling the idea until now.

Lawsuits followed, but no ground was broken.

The meeting

Nov. 12, the Zionsville Village Residents’ Association hosted a discussion with Walmart representatives to learn more about the proposal.

That meeting came on the heels of a similar October gathering, which both groups felt merited a reprise.

“The Walmart team has been open in responding to questions and is continuing the dialogue with the town,” the ZVRA said about the meeting in a statement. “There were many significant concerns expressed by residents and the impact Walmart would have on the community in terms of traffic, environment, aesthetics and taxes. We hope input from the residents will continue to be taken into consideration.”

Pleasantries aside, the second gathering produced much consternation. Accounts vary, but multiple sources reported a Walmart representative as either stating or implying the company had partnered with local cornerstone Akard True Value in an effort to show solidarity with the community.

It’s something both Walmart and True Value manager Leigh Ann Akard flatly deny.

“We weren’t in attendance,” Akard said of store representatives. “We’re confused as to Akard what was said – Walmart is saying what was said was mistaken, but it was strong enough that that’s what was implied from it, and that’s disturbing. Walmart’s reputation should stand on its own. They should not have brought us into the conversation.”

Akard understandably was reticent to engage in any aspect of the Walmart discussion, but now is eager to set the record straight.

Brewer “Competition is not a bad thing,” she said. “But we weren’t going to throw our dog in the fight, because they’re a bigger dog. The name Walmart does not scream upscale, and I think it will affect all Boone Village. If people are shopping for groceries (at Walmart) and decide to pick up a furnace filter or light bulbs there, that cuts into our business.

They’re trying to give the sense they’re being welcomed into town, and they are not. We encourage people to get educated and make the best decision, whether they are for or against.”

The other side

Zionsville’s Brian Stemme knows a little some-

thing about the issue, having dealt with several economic developers through his employer.

He’s convinced any backlash to Walmart, including worries the store’s introduction will Stemme spell doom for the Village, is misplaced.

“I don’t think they are competitors,” he said of Walmart and the Village. “When I go to the Village, I enjoy dinner, antiques, a mix of unique stuff. I don’t go there to get my staples: tuna fish, cereal. I don’t see Walmart as a threat.”

Part of Stemme’s stance deals with the idea that a large commercial improvement will help diversify Zionsville’s tax base – something almost universally sought.

“Walmart is not asking for a tax abatement,” he said. “They will pay property taxes from the first year on. If you have to choose between no growth and smart growth, you choose smart growth.”

Stemme also touched on the issue’s white elephant: There already are similar stores in the area.

“Look at the size of the Super Target (10401 N. Michigan Rd. in Carmel),” he said. “I don’t see that people are as concerned about it, even though it generates traffic and competition to local vendors. I think Walmart has a stigma. I respect people who feel having a Walmart here is a bad idea, but if you look at it logically and ignore that the name is Walmart, the discussion would be less intense.”

Walmart and property taxes – Based on the Indiana Property Record Card, the cost of the land that Walmart purchased was $4,821,805. This value appears to have been reduced to $15,500 for 2006 through 2009 for property tax purposes. In 2010, the assessed value was increased to $1,728,100, less than 36 percent of cost. The total taxes paid by Walmart from 2006 through 2009 was $1,312.18.

Retro Hoosier Hysteria It is our position that the Hoosier state is experiencing a phenomenal year in the world of sports. Visionaries who positioned “Naptown” as the amateur sports capital of the world should have their crystal balls enshrined. The year started out with the area hosting the Super Bowl – one of the largest sporting events in the country, to holding world-class auto-racing events, a major PGA tour playoff match and is ending with a BCS championship game bid for the Fighting Irish of Notre Dame and a number one ranking for the Indiana University Hoosiers basketball team.

Who couldn’t use a little luck of the Irish with threats of fiscal cliffs looming? We may have lost the delicious chocolate icing off of the top of the now defunct Hostess cupcakes; however, we’re having our cake and eating it too with such a delicious year in Indiana sports. It feels like the glory years again. And to add to the 1970’s nostalgia, “Martha the Mop Lady” is once again whistling the IU fight song before basketball games. Could red plaid jackets be next on the comeback trail?

They would survive nuclear holocaust. At least, this is the urban legend that pervaded my childhood – a storehouse of Hostess Twinkies would keep us all alive long enough to find our way to the pocket of humanity left in some bucolic compound unaffected by our selfdestruction. The yellow, little cakes represented a permanent indication of our ultimate civility.

Even if we couldn’t preserve our great buildings or the teetering amalgam of our races and beliefs, these snacks would long serve as a reminder of our great, if unsustainable, society.

Now we’ve got to rethink our food source during Armageddon. Twinkies, at least as we know them, are going away. In a particularly proud moment for central Indiana, a woman in the Indianapolis Hostess plant’s picket-line represented a union point-of-view on the front page of USA Today when she reportedly responded to warnings from the company that union demands were unsustainable by chanting, “Do it, shut it down.” And, she got her wish. Hostess is

no more. Her job is gone with it. Fear not, the extensive unemployment network and other safety-net programs will keep the woman from feeling real pain from her choice – at least for some time. And for the rest of us, it is very likely that we can still get our junk-food fix. Won’t some Chinese company snap up the brand and produce our empty calories without any pesky labor or environmental constraints? If the snack’s recipe could survive nuclear fallout, surely it could make the transpacific trip on a freighter.

Was there another solution? Who knows? But the outcome has been decided. 18,000 Hostess employee taxpayers were converted into tax-consumers. And, our snack dependency is in peril.

At least Hostess and the Bakery, Confectionery, Tobacco Workers and Grain Millers’ International Union got to make a point.

Ode to a Puppy

As I write, I have survived exactly 10 days with our new puppy. I’ve surprised even myself with my high levels of patience and tolerance for training a nine-week-old Labrador. (I’ve even caught myself petting her, and saying things like “Good job, Libby!” If you know anything about me, these small signs of affection are truly amazing.) Still, these Dog Days of December have inspired me to explore my usually-suppressed poetic side. Enjoy.

Carpet, rug, new bedspread, Is it any wonder I see red?

Go away, dog, I wish each day So life can return to the quiet old way.

No midnight feedings, no need for sitters, No stepping in (a mess) on the way to the (bathroom) This was the whole point of Doo getting “fixed,” So the pains of having infants would forever be nixed.

But we’re back to square one with this new little Lab, Who is, quite literally, driving me mad.

She yelps, she barks, she gnaws on my shoes, I swear to sweet Jesus, I need more booze!

They’ve wanted a dog since 2002.

The cat, not so much; that’s no real surprise.

The pup’s head on a platter would be her top prize.

I keep reminding myself, “I’m a good mom, the best!”

For trading a clean house for a canine-themed nest.

For tolerating the jumping, the yipping, the hairs, For sacrificing the flooring, the bedding, the chairs.

For putting my family above my own want, For faking a smile and not opting to punt When the freakin’ puppy wakes me at three, To have to go potty and slobber on me.

[Seriously, how long will it take for her to sleep through the night and learn to go potty outside? And why did Doo ever think this would be a good time for a dog? I think, like most mothers do with pregnancy, he blocked all the challenging aspects of puppy ownership and only remembered the good times.]

Back to my rhyme, there’s more to be said, Like how much I’m dreading this long year ahead.

At least I’ll have plenty of tales to tout, For the next installment of my book, the veryreasonably priced “Peace Out!”

Wishes do come true!

Trying to survive without my wife Commentary by Dick Wolfsie Mary Ellen is not a risk taker. Other than her commitment to me more than 30 years ago, she seldom gambles with the odds. But a business obligation in Chicago has required that she leave me to fend for myself. She has left me alone at home before, but my son was still living with us, so she knew if we had a power outage, someone in the house would know how to put batteries in the flashlight.

In the past, I always got very detailed instructions for how to muddle through the day when she was gone. It was even alphabetical.

B: (Bedtime) You both need to do this toward the end of each day. Do not skip a night.

D: (Dishes) Wash after each meal in the dishwasher. Do not mix dishes and underwear in same load.

M: (Meals) To be eaten while seated—not in the car and not standing at the sink. Space them out over the day.

V: (Vacuum cleaner) About three feet tall, with a hose coming out the side. I don’t expect you to use it, but I didn’t want it to scare you if you opened the closet by mistake.

This time, Mary Ellen simply abandoned me.

I was okay last night, stopping at a sub shop for some dinner. However, this morning when I walked into the kitchen to make breakfast, I realized what a bad personal relationship I have with our appliances.

My wife sets the toaster to light, so it’s already popping up while she’s putting the rest of the loaf back in the pantry. I like my toast very dark. I know it’s done when the smoke detector goes off.

There are no dials on our microwave. It’s just this high-tech control surface that makes me feel like Data on Star Trek determining if Planet RaNon 17 has sufficient oxygen for Captain Kirk and the crew. I don’t know how to change the power level; I don’t know how to set the timer; and I have no idea what DELAY means. The device does tell me the current time. It’s the biggest and most expensive clock we’ve ever had.

Given the opportunity, I’d swap the stove for a decent pool table. Our old stove had these coils that heated up, which was a pretty good indication that things were about to start cooking. But now the stove is called a glass-top and it is completely flat. Little circle thingies light up, then they go off, then they come back on.

Whose stupid idea was this?

Oops, gotta go. The smoke alarm just went off. Breakfast is ready.

The health of Cratchit’s young son, Tiny Tim, is as poor as the family is financially, but Scrooge’s heart is unmoved and his coffers remain unopened.

Scrooge’s inhumanity becomes so intense that it stirs the spirit of his late business partner, Jacob Marley, who appears to him on Christmas Eve. Marley tells Scrooge he will be visited by three more spirits, and advises to heed the messages they bring. The ghosts of Christmas Past, Present and Yet to Come then appear to Scrooge in succession – reminding him of what was, pointing out what is, and showing him what will be should he continue on his present path. Not only will his life be quickly forgotten if he maintains his miserly ways, but those around him face hardships that he could have easily prevented.

Great American Songbook Film Series launches in truly moving style

By Mark Johnson • mark@youarecurrent.com While thousands of filmgoers recently flocked to local theaters to embrace such modern blockbuster, the crowd at the Center for the Performing Arts in Carmel sought a different cinematic experience. The 1951 musical classic, “An American in Paris” was the marquee attraction at the Palladium as part of the ongoing presentation the Great American Songbook Movie Series, presented by Printing Partners.

The series is the result of collaboration between Heartland Truly Moving Pictures and the Michael Feinstein Great American Songbook Initiative. In addition to screenings of the classic film musicals, the series will also feature gallery exhibits, guest speakers, as well as memorabilia that are part of the Initiative’s archives.

"The films in the series were chosen because they are seen as being seminal film musicals," said Michael Feinstein, founder of the Michael Feinstein Great American Songbook Initiative and artistic director of the Carmel Performing Arts Center.

Feinstein explained why the film, “An American in Paris,” holds a special place in his heart.

“I guess this means so much to me because I personally knew so many of the people involved like Gene Kelly, Vincente Minelli, Saul Chaplin, and Ira Gershwin. These were artists who were very influential and helpful to me early in my career,” he said.

film musical was readily apparent.

“The great thing about this film is that every song advances the plot, each one serves a purpose,” he said, with wide grin, noting another film in the series. “‘The Wizard of Oz,’ for example, is a perfect combination of music and story, each song advancing the plot.”

Feinstein also pointed out one of the pieces of movie memorabilia that is part of the film series.

“We have an original billboard of the movie poster for ‘An American in Paris.’ It is the only one in existence,” Feinstein proudly proclaimed, as a champion of both the film series and as a champion of the arts.

Holiday Pumpkin Soup

Ingredients: 2 tablespoons finely chopped onion; 1/2 teaspoon curry powder; 1/4 teaspoon ground cumin; 1/4 teaspoon ground coriander; 1/4 teaspoon salt; 1 tablespoon butter or margarine; Two 15 oz. cans pumpkin; Two 14 oz. cans chicken broth; 1 tablespoon packed brown sugar or maple syrup (optional); 1 cup half and half, light cream or milk; Dairy sour cream (optional); Fresh sage

leaves (optional) Directions: In a large saucepan, cook onion, curry powder, cumin, coriander, and salt in hot butter until onion is tender. Whisk in pumpkin, chicken broth, and brown sugar or maple syrup, if desired, until well combined. Bring mixture just to boiling; reduce heat. Stir in half and half and heat through. If desired, garnish with sour cream and sage leaves. Makes 6 to 8 servings.

Ingredients: 2 cups dried elbow macaroni (8 ounces); 2 tablespoons butter; 2 tablespoons allpurpose flour; 1/2 teaspoon salt; 1/2 teaspoon ground black pepper; 1 cup whipping cream; 1 cup whole milk; 4 oz. Fontina cheese, shredded (1 cup); 1 15 oz. can pumpkin; 1 tablespoon snipped fresh sage or 1/2 teaspoon dried leaf sage, crushed; 1/2 cup soft bread crumbs; 1/2 cup grated Parmesan cheese; 1/3 cup chopped walnuts; 1 tablespoon olive oil; Sage leaves (optional) Directions: Preheat oven to 350 degrees F. Cook pasta in a large pot following package directions. Drain cooked pasta, then return to pot. For cheese sauce, in a medium saucepan melt butter over medium heat. Stir in flour, salt, and pepper.

Add whipping cream and milk all at once. Cook and stir over medium heat until slightly thickened and bubbly. Stir in cheese, pumpkin, and sage until cheese is melted. Stir cheese sauce

into pasta to coat. Transfer macaroni and cheese to an ungreased 2-quart rectangular baking dish. In a small bowl combine bread crumbs, Parmesan, walnuts, and oil; sprinkle over pasta.

Bake, uncovered, for 30 minutes or until bubbly and top is golden. Let stand 10 minutes before serving. If desired, sprinkle with sage leaves.

Best approach for inner-thigh liposuction Commentary by Barry Eppley Q: I am 48 years old and am tired of my ugly looking inner thighs. Not only do they touch and rub all the time, which is irritating and embarrassing, but the skin is loose and not very tight. I want to know if liposuction on my inner thighs will tighten them or make them even saggier.

I want some fat removed but I don’t want to make them look worse.

A: The inner thighs, although not a big area, represent a challenge for satisfying liposuction results. The quality of skin in the inner thighs is typically not good in that it has poor elasticity. This translates into a very limited ability to contract, which is a critical factor needed to get good liposuction outcomes. As a result, liposuction of the inner thighs does not tighten the skin and in some cases may even make it look worse.

While liposuction can help slim down the inner thighs, it is an area that is notorious for irregu-

larities and unevennessdue to the skin in the area does not shrink or tighten well after it is deflated by fat removal. It is also an area that is very difficult to get smooth results because it is a curved structure rather than a flat surface. While everyone’s skin elasticity is different, your description of your inner thighs does not sound very favorable for good skin contraction after liposuction.

This does not mean that you should not have it but that a conservative approach should be done with expected modest changes. You may want to consider liposuction combined with an inner thigh lift if skin looseness is a concern. inner thigh lift. That is a great way to hedge against the risks of loose and irregular skin but treating the skin problem at the same time.

Renter's coverage worthwhile Commentary by Jamie Ianigro Question from Matt P. from Fishers: I finally found a job and I’m moving out of my parents’ house and looking at apartments. Some places require renter’s insurance and some don’t. Is this something I should have either way?

Response from Jamie Ianigro: Congrats on the new job! Now it’s time to protect that paycheck with a renter’s insurance policy. People like to make a lot of excuses as to why they neglect to purchase a renter’s insurance policy.

“I can’t afford it.” “I don’t have enough stuff to insure.” “Nothing is going to happen to my stuff.” The liability protection alone is really enough reason to buy, but let’s break it down.

The first thing you need to know about renter’s insurance is that it’s pretty affordable. A typical policy can cost less than $200 per year.

That’s less than $4 per week. It’s worth the sacrifice. You are also in for a nice bonus if you already have car insurance. Many insurance carriers will give you a multi-policy discount if you package your auto and renter’s policy together with the same company.

The second thing you need to know is that your stuff is much more valuable than you realize. How much would it cost you to start over if you had a total loss? Apartments burn down and get robbed just like houses do. Starting over after a loss like that is much easier when your

independent insurance agent drops off a check to replace all of your stuff.

The last thing you need to know is probably the most important. A renter’s policy protects your financial assets by providing liability coverage. Liability insurance covers you for injury you cause to others and for damage to property that belongs to others. There are many ways to trigger a liability claim, so I’ve got some examples for you.

Claim Scenario A: You decide to play in a recreational softball league. While batting you hit a pitch back at the pitcher putting him in the hospital. The pitcher sues you and your renter’s policy steps in to defend you and settle the suit.

Claim Scenario B: You have some friends over for dinner. Your floor is wet and one of the friends slips and falls requiring medical treatment. Your renter’s policy steps in to pay for the treatment.

Grammar Guy

On furthering good grammar Commentary by Jordan Fischer Recently, I was fortunate enough to be invited to speak to two of Ms. O’Malley’s 8th grade classes at Sycamore School in Indianapolis. The subject, as you might imagine, was grammar.

Luckily, despite my tendency to wander into tangents when speaking to groups, we managed to talk about it a little bit.

The question came up as to the difference between the words “further” and “farther.” I gave them the same answer I’m going to give you, but since I am nothing if not a grammar nerd, I decided to research the distinction a bit more once I returned home.

The distinction between the two words evolved during the late 19th century upon the advice of an editor of the Oxford English Dictionary. Ironically, while we in America accepted the editor’s opinion, the majority of Brits did not. To this day, the two words are used interchangeably in Britain. (It’s worth noting that many dictionaries, British or otherwise, list the two words as interchangeable.)

Since we are in America, however, we can distinguish the two words from one another.

Here in the States, “farther” is used to indicate a physical, measurable distance. You can hit a baseball farther than someone else. You can run farther than the day before. Your destination can be farther up the road.

“Further,” on the other hand, is used to indicate improvement or metaphorical distance.

If you volunteer at the Red Cross, for example, you are furthering the cause of healthcare. You might further your education by going to college. You could even further British-American solidarity by using the two words interchangeably. You get the picture.

To wrap it up, as long as you’re on this side of the Atlantic, here’s your grammar rule: “Farther” indicates physical, measurable distance.

“Further” indicates metaphorical distance or improvement.

DIVORCE – WHAT TO EXPECT: Claiming Children as Dependants In each family law case involving children, a determination must be made as to which parent shall be allowed to claim the children as dependants on their State and Federal Income tax returns in any given year. While it may have once been common for Judges to order the parents to alternate claiming the children, under the Indiana Parenting Time Guidelines the objective is to achieve an order which will make the most money available for the children.

Therefore, there is no certainty that in each case the parties will be ordered to alternate claiming the children.

Under Indiana law, Courts are given discretion in determining which party shall claim the child(ren) as a dependent(s) subsequent to a divorce or in a paternity action. The Courts consider the following factors: (1) the value of claiming the child as a dependent at the marginal tax rate of each parent; (2) the income of each parent; (3) the age of the child or children and the number of years that the child or children could be claimed as a dependent or dependents; (4) each parent's percentage of the costs of supporting the child or children; (5) if applicable, the financial aid benefit for postsecondary education for the child or children; (6) if applicable, the financial burden each parent assumed under the property settlement in a dissolution proceeding; and (7) any other relevant factors.

It is imperative that parents understand that the Decree of Dissolution or Court’s Order may not be adequate to effectuate the terms in the Decree with respect to each parent’s ability to claim the children as dependents.

The problem stems from the fact that, in order for the noncustodial parent to claim the child(ren) on her/his tax return, the custodial parent must execute the IRS Form 8332,

thereby relinquishing her/his right to claim the children as dependants for that tax year. Thus, the Courts do not order that one party has the right to claim the children, but rather that one party must take all steps necessary in order for the other party to claim the children in a certain year, such as signing the IRS Form 8332. Additionally, signing the release is often contingent upon child support being current for the calendar year for which the exemption is ordered as incentive to keep child support payments current.

If one party refuses to sign the IRS Form 8332 required by the IRS in order for the noncustodial parent to claim the child(ren) on his/her tax return, the issue can become a headache to remedy due to the time and attorneys fees associated with correcting the issue. Thus, if you believe your ex-spouse may be inclined to act in contravention of the terms of your Decree, you may consider focusing on other terms/issues and concede on the issue of claiming the child(ren) on your individual tax returns. While measures may be taken to ensure one party's compliance, such as including language that the party who does not comply with the terms of the Decree be responsible for any attorneys fees incurred by the complying party to effectuate its provisions, if the violating party does not have the money to pay the awarded attorneys fees, this may be a futile request (and the basis of their erroneously claiming the exemption to begin with).
