Plan commission vote a setback for 200 West

By Ann Marie Shambaugh AnnMarie@youarecurrent.com The Zionsville Plan Commission unanimously voted to give the 200 West mixed-use development an unfavorable development recommendation on June 20. The Zionsville Town Council will have the final say on the rezoning project to a Planned Unit Development which is proposed on 4.32 acres on Sycamore Street west of Main Street.

“It’s the way this PUD is assembled. It’s a pretty open-ended ask, and I would prefer to see something that was a little bit more tailored for what might actually happen,” Commissioner Larry Jones said.

Representatives for developer Fabrico first brought the project before the commission in March. After several public meetings they made some changes to the development, including reduced building heights, increased setbacks for top floors of the tallest buildings and decreasing the number of single family homes.

“We have made changes, and unfortunately oftentimes it seems as though the only changes that some people accept are their way or the highway, but we have tried to compromise if possible,” said Tim Ochs, an attorney representing Fabrico, at the beginning of the meeting. “We still think this is a great project for the town and for the downtown Village.”

Steve Fehribach of A&F Engineering shared results from a traffic study filed with the town on June 17 and concluded that “this development does not add a whole lot of traffic to the intersection.” A drainage expert briefly presented a recommendation to construct underground retention areas to limit flooding issues. Ultimately, it wasn’t enough to convince commissioners that the project would be a good fit.

“I’m less enamored with this project as it is presented at this point in time as I was when it was first presented,” ZPC Vice President Jay Parks said. “It hasn’t solved some of the problems we have, and it will potentially increase the problems we do have.”

Several Zionsville residents spoke against the development, expressing concerns — as they have for months — about increased traffic, potential drainage problems and more.

Others said they couldn’t support the project because they believed it could add students to Zionsville Community Schools without generating additional taxes to cover the cost to the district.

“The bottom line is that it makes no sense at all for our town to allow apartments in a TIF (tax increment financing) zone. Every single student from those apartments will cost the school district more to educate than it will receive in revenue,” said Ann Royalty, a Village resident and professor of economics at IUPUI. “Moving forward with apartments in a TIF and the structural deficit that implies for the school system

would be very poor planning indeed.”

ZCS Chief Financial Officer Mike Shafer told Current in Zionsville the district used its spreadsheet-based computer model to evaluate the potential impact of 200 West, as it does when requested for all new developments, with information presented from the developer in April. The results showed 200 West would result in a total loss of $961 to ZCS, which the report identified as a “neutral fiscal impact.”

He also said the district is sometimes asked to recalculate the model with new numbers as projects change, but that did not happen in this case.

“Neither the developer, the town, nor concerned residents have provided Zionsville Community Schools with any revised or updated information with which to conduct a new run of the model for 200 West,” Shafer stated.

It is ZCS policy to not advocate for or against proposed developments.

The next Zionsville Town Council meeting is scheduled for 7 p.m. July 5.

ZPC won’t appeal Walmart ruling

By Ann Marie Shambaugh AnnMarie@youarecurrent.com The Zionsville Plan Commission voted unanimously June 20 to not appeal a ruling by Judge Steven Nation to mandate the aplegal proval of plans for a Walmart on Michigan Road near 106th Street.

Commissioners declined to comment on their decision, but Zionsville Mayor Tim Haak issued a statement after the meeting on behalf of the town.

“This issue has been going on now for more than 10 years, and while we are understandably disappointed in this ruling, we will not pursue any further appeal,” Zionsville Mayor Tim Haak

stated. “Given the judge’s mandate, it is now time to move on with the hope of reaching out and partnering with Walmart with the hope of finding a common solution in developing a store that is more suitable to today’s economic environment.”

Although Walmart now has the green light to proceed with its store, it is up to the retail giant whether or not it will continue to pursue building on a site that sits on the border of Zionsville and Carmel.

“Our top priority is to best serve our customers. Given the extended time frame since our original store proposal, we will consider our options. It is premature to comment further at this time,” stated Anne Hatfield, a Walmart

spokesperson.

After a decade-long legal battle, many Zionsville residents are still speaking out against the retailer, as they have since the beginning.

Steve Postma, a longtime Zionsville resident, has been opposed to Walmart coming to Zionsville for years. He worries that the store will lead to increased crime and shut down local small businesses, among other issues.

“They don’t do anything for the community.

They have their little fundraisers, but they’re so few and far between they don’t mean anything,” Postma said. “If the people told (Walmart) we don’t want you here, why do you want to provoke the neighborhood?”

Police search for 2 suspects in Cracker Barrel armed robbery news@currentzionsville.com Police are searching for two armed suspects who allegedly stole approximately $9,000 from the Cracker crime Barrel in Whitestown shortly after midnight June 20.

According to the Boone County Sheriff’s Office, a black male and black female approached the manager of the restaurant in the parking lot as he was about to head home. They displayed handguns and forced him to go back into the building, where they left him in a computer room and the maintenance employee in a freezer. After waiting for a short time, both employees called 911.

Police believe the suspects also may be responsible for more than $6,000 in fraudulent credit card transactions on the northwest side of Marion County near W. 86th Street and Michigan Road.

Zionsville Community High School baseball coach Jered Moore knows Jacob Hurtubise is deserving of every recachievement ognition he receives.

Hurtubise picked up the Indiana High School Athletic Association’s L.V. Phillips Mental Attitude Award for Class 4A baseball following a 3-2 loss to Roncalli in nine innings June 17 in the 4A state championship game at Victory Field.

“On the field and off the field, he’s an impressive kid,” Moore said.

Hurtubise, who has a 3.93 grade point average and was 10th in his 2016 graduating class, accepted an appointment to West Point to play baseball for Army. Indiana Farm Bureau Insurance awarded $1,000 to the general scholarship fund at ZCHS in Hurtubise’s honor.

“It’s a great honor to have, knowing that my classmates, my principal, my coach looked at me as a strong leader with a strong attitude and just a love for the game,” said Hurtubise, who plans to become a pediatrician.

Hurtubise is a member of the National Honor Society, Best Buddies Club, Fellowship of Christian Athletes and the Eagles Making Positive Choices Club.

“We accomplished so much this year,” said Hurtubise, a center fielder who led the Eagles in batting average and hits. “I’m so proud of my teammates, my family. I loved every moment playing with them. It’s heart-breaking.

It’s going to take awhile to get over. But life goes on.”

The Eagles, ranked No. 1 in the final 4A regular season poll, finished 30-5-1.

“This stings a little but doesn’t take anything away from the season they had,” Moore said.

Poet’s kin to read ‘Revere’

Remembering some characters

Henry Waldsworth Longfellow is well known for his poetry, especially “The Midnight Ride of Paul Revere.” His books great, great granddaughter, Elinor Williams of Indianapolis, will read the iconic poem from 10 a.m. to noon July 2 at Black Dog Books, 115 S. Main St. Williams will read the piece every 30 minutes for a total of four times.

“Black Dog Books was found through a friend of mine, and he brought me here and said I should check it out,” Williams said. “I’d really like to do a reading and get known at more bookstores. I think it’s important for people to be educated about (Longfellow’s) poetry.”

With the reading occurring during the Fourth of July weekend, Williams said she hopes people will stop in Black Dog Books to listen to the poetry to celebrate the nation’s birthday.

“I like the way (Longfellow) writes, especially in ‘Paul Revere,’” Williams said. “You can just feel his fear that something will happen that night. I think it’s good for all ages. I think adults can understand the fear aspect in a different way than the children

I love characters. You know, people who don’t color within the lines; folks who listen to their own music and march plain talk to their own drum.

Two of the greatest characters I ever knew were a German couple who lived across the street when I was a kid.

Mr. and Mrs. Boesch came to America from Germany when they were children. That was right after World War I, so they were already old timers when I got to know them.

A couple things made Mr. Boesch a character. Since he came to America during a period of high anti-German feeling, he vowed to become the most patriotic American in town.

He accomplished this by speaking nothing but English and by flying the American flag from his front porch at all times. Moreover, he walked onto his porch every morning, put his hand over his heart and recited the Pledge of Allegiance.

The second thing he did was to pull weeds.

He started with his own yard and dug out every dandelion, clover, burdock and thistle. With each dig, he uttered a soft but intense oath.

And, when his yard was weed-free, he headed down the block, clearing his neighbor’s lawns

“We did a reading last year but didn’t publicize it as much,” said Tania Roudebush, owner of Black Dog Books. “We have a direct connection here, a living relative of Longfellow reading one of the most important poems in U.S. history on Fourth of July weekend.”

And when he had finished for the day, he would retire to his front porch and drink a bottle of beer. This practice Mrs. Boesch believed was nothing less than a well paved road to perdition, and made her feelings known by stomping past the porch and uttering a damning “harrumph!”

Mr. Boesch died a couple years later, and Mrs. Boesch lived on for a few more years, tending her garden and sweeping the front porch. She began to lose weight. Her husband had been a big eater, but when he was gone, she lost interest in food. To perk up her appetite, her doctor told her to drink some beer every day.

Dutifully, she set her personal feeling aside and agreed. When she died some time later, the children cleaned out the house. In the refrigerator, they found a half-empty bottle of beer and a tablespoon. Yeah, she was a character, too.

Enjoy fireworks, help the park

By Heather Lusk • news@currentzionsville.com Fireworks and Independence Day go handin-hand at Lions Park for the annual July 4 celebration, a major fundraiser for event the Zionsville Lions Club.

The festivities begin at 5 p.m. culminating with a 25-minute fireworks display that begins at dusk, with between 12,000 and 15,000 people expected to attend.

“It’s one of the best venues to watch fireworks,” said Marty Miller with Mad Bomber Fireworks Production. “It creates a lot more avenues of what we can do when you have an audience that is right there.”

The second largest fundraiser for the Lions Club usually brings more than $10,000 to help with park improvements and maintenance.

“Not everybody knows that the park is 100 percent funded through donations and the programs that we put on,” Event Co-chair Steve Gayheart said.

Parking at Lion’s Park or the lot at the corner of Sycamore Street and S. Main St. is available for a $5 donation.

“There’s a lot of places that you can park, but you might have to walk a ways,” Gayheart said.

Miss Fall Festival and the newly crowned Miss Indiana and Miss Outstanding Teen are planning to make an appearance.

“Their first duty has been to attend our fireworks show,” Gayheart said. “So far, their schedules have worked out.”

Several food trucks plus Lions Club hot dogs, tenderloins, hamburgers and fries will be available throughout the evening.

The rain date for the celebration is July 9.

DIVORCE – WHAT TO EXPECT: CHILD SUPPORT In Indiana, in any Dissolution of Marriage, Post-Dissolution, or Paternity action, the court will enter a child support obligation to be paid by one of the parties, (typically, the noncustodial parent). The underlying philosophy is that a child should be provided the same lifestyle which would have been afforded to him/her had the family remained intact or had the parties married.

The Guidelines are presumed to apply in each case unless a reason can be shown as to why a deviation from the calculated obligation is warranted. In determining the support obligation, child support calculators are used to create a Child Support Worksheet, which must be filed with the Court in each proceeding. In addition to the parties’ gross incomes, other factors included in determining the support obligation are: actual work-related childcare expenses, healthcare insurance premiums for the children, parenting time overnights exercised, support or maintenance received or paid, and subsequent children in either parties’ home. When a Court deems appropriate, numerous benefits received by one party, including parties’ bonus incomes, commissions, or even regular gifts from family or friends, may be included as income for support purposes.

There are a number of reasons to deviate from the presumed obligation by the Guidelines. These include, but are not limited to, voluntary unemployment or under-employment by one of the parties. If a Court finds either of these to be a factor, it may impute potential income to that party for purposes of determining support.

There are cases wherein clients propose to their attorney an agreement with the opposing party to forgo the receipt of support. This is not appropriate in most cases. Such an arrangement may be appropriate if the parties equally share physical custody of the child(ren) and agree to share expenses due to the fact that their incomes are relatively similar, however, parties must understand that it is not their right to waive support for the child(ren), rather it is the child’s right to receive the same. Issues with respect to child support are very fact sensitive and different issues will arise in each case. A thorough knowledge and understanding of the Guidelines is necessary to determine the appropriate obligation in any given case when issues arise.

“The whole idea was to get kids participating to lower the obstacles for entry into it,” Boggs said. “So we shortened the distances, so the kids don’t have to go out and train for this, but it’s still a challenge for them.”

Swimming is the strength for Zionsville Swim Club members Carter and Brady, Cristie said.

“Biking is the one I struggle at, because it’s a longer distance and there are lots of hills,” Carter said.

Carter’s goal is to get a medal.

“It’s really hard to get in the top three,” Carter said.

Carter, who will turn 10 Aug. 20, said he might have a better shot because last year he was one of the younger ones in his age category.

Zionsville race helps young kids explore strengths

“You swim a lot, bike a lot and run a lot.

After that, there are a lot cover story of food options you can get,” said Carter, who will be a Union Elementary fourth grader this fall.

Carter, 9, will take part in the Zionsville’s Kids TRI for Kids for the third year. His brother, Brady, 7, who will be a Union second grader, will participate in his second triathlon.

“They have a great time doing it and want to do it again every year,” said their mother, Cristie Wilt.

The Zionsville Kids TRI is set for 7:30 a.m.

July 4 at Azionaqua Swim Club, 4875 Willow Rd. This is the ninth year the triathlon has been held in Zionsville. The ages of participants are typically 7 to 14, participating in age groups of two years (7-8, 9-10, 11-12 and 13-14). The age group of 11-14 competes in a longer race course, which is double the shorter course.

Boggs will make an age exception with more information from the parents.

“For instance, if you’ve got a good swimmer who is age 6, we’ll let them participate,” Zionsville Race Director Bryan Boggs said.

“It’s about safety for the kids, so we need to understand that a little more. Last year, we got some feedback that some kids were afraid of the swim, so we added a duathlon, which is run, bike, run instead of swim, bike, run. We run that concurrently in the same age groups.”

Boggs, a Zionsville resident, is the board president of Kids TRI for Kids, which is a series of triathlons in the Indianapolis area.

Boggs formed the events with Meg Osborne, an Indianapolis resident. Osborne serves as executive director.

“We consider Zionsville one of the pillars of Kids TRI for Kids,” Boggs said. “We’ve always had great participation. Year after year, it’s one of our biggest ones. The most we’ve had is 189 participants. We average 120 to 130 for each of our races.”

In 2015, Boggs and co-race director Dan Gehring, also a Zionsville resident, couldn’t make a July 4 race, so they moved it to Father’s Day, and participation was lower.

“July 4 is a celebration day for Azionaqua, so that’s why we’ve had it on the fourth,” Boggs said. “We’ve had pretty good luck with (that

“The first year we had 35 kids, and it was 50 degrees, and it was spitting rain that day,” Boggs said. “All of them finished it. We’ve come a long way since then. I was up the night before making directional signs. We didn’t have the backing of Kids TRI for Kids or all this equipment. We were doing it on a shoestring. We had just enough with volunteers to point the kids in the right direction.”

Boggs, 54, has been doing triathlons since he was in college and has competed in four Ironman races.

“I was a national age group champion in the 1990s,” said Boggs, who swam the English Channel. “My oldest son, Ian, is a professional triathlete, and my youngest is in a Triathlon Club at Purdue.”

Ian, 23, is in his second year at Indiana University medical school. Beau, 20, is a Purdue engineering student. Beau competed in the Kids Tri when he was younger.

Thumbs up for Walmart As you might know, the Walmart project on Michigan Road will proceed. We’re absolutely fine with that. We certainly understand the concerns of residents about traffic congestion, public safety, aesthetics and other topics, but in the end it just makes sense. Don’t get us wrong; it is up to the Bentonville, Ark.-based retailer to make it right and stick to the standards, if you will. Developing in our community should be treated as a privilege. All along, we have been pro-development where it makes sense. Development for development sake is nonsensical. This doesn’t fall into that category.

Essentially, we come down on Walmart’s side on this issue because of one primary tenet in which we wholeheartedly believe, and that’s this: Let the free market reign. But Walmart simply cannot throw open its doors and approximate market dominance. All the other players in the grocery, home goods and other spaces the mass retailer features, now have a chance to get a leg up on planning for incentives to retain and grow their market shares.

Competition is good. It keeps everyone on their toes. More than that, it puts the focus squarely on the customer – as it should be. We suspect this will turn out to be a win-win for the community. That is our hope, at least.

Mired in the minutiae Commentary by Terry Anker What difference does it make? Does anybody care if he asked first? It seems the order of things is routinely determined, well, by the order of things. Who says what and when makes all the difference in a contract.

Who says “I love you” first seems to carry an enormous burden, not because of the import or authenticity of the assertion, but because of the potential risk of laying out one’s position without absolute certainty of the listener’s point-of-view. Yet, the first mover, some think, has an advantage. They get to frame the issue and lay out an agenda to be matched – or refuted.

In the often Byzantine sphere of human social interaction, we can find ourselves mired in the minutiae. We hold back our desires and even our needs all for fear of how we might be perceived by others. But if we have a strong need and don’t share it, are we intentionally manipulating and attempting to control the perceptions of the

ones that we claim to care the most about?

Is it right to hold back, knowing our own feelings, simply to await the optimal time to spring our notion on our would-be target?

Relentless directness may be no better. Do we want to live in a world where folks blurtout every whim and yearning? As a former U.S. President was much maligned for asserting, “It wouldn’t be prudent.”

So how do we balance the admirable quality of forthrightness against the much less seemly trait of being constantly needy?

Perhaps, if we took the time to evaluate our own wishes in comparison with those of the others near us, we’d be best positioned to fairly interact. Don’t say “I love you” first or last unless we mean it. And, if we do, why wouldn’t we say with reckless abandon?

Well it’s been quite a week here at chez Wilson, and as I finally take a chance to reflect, I think I can make humor a column out of it. Here ya go.

On Sunday I participated in my firstever half Ironman event, fittingly in a town called Effingham. It was effing hot, around 91 degrees; I effing peed myself twice, inspiring a sheriff to come check on me; and I effing ended up walk-running the last effing six miles with an effing pound of ice tucked down my suit. But I finished without stroking out and met a New Year’s resolution. Eff yah!

On Monday, feeling much like I’d been hit by a MAC truck, I proceeded to fall down some steps at Clay Terrace. It was just a slight slip in my sandal, but with incredibly sore legs I couldn’t stabilize myself. So down I went, bruising nothing more than a toe and my ego, as my daughter watched in both horror and amusement. Admittedly, my slow motion crumble was pretty funny, but the public display of clumsiness certainly did not improve my mood.

Then on Tuesday, still recovering from my athletic ordeal, our basement flooded, ironically about an hour after I’d posted the last check to the restoration company for the toilet debacle from last fall. I spent three hours going up and down stairs, emptying the storage room of wet boxes, pictures, Barbie cars and, of course, all the furniture that we’d still not brought back up after our kitchen/main floor remodel. Jeeze Louise! Can’t a girl just lie down and binge-watch “House of Cards?”

And that brings me to today, Thursday, sitting patiently in the office of a GI group while Doo enjoys a colonoscopy. I’m surrounded by geriatrics in a sea of appropriately-colored brown décor, and in a few minutes, I’ll be asked to collect my spouse, high on anesthesia and hosting his own poop-joke comedy special. Good times. At least my body is almost back to normal So there you have it, a typical week in a Wilson summer. Peace out.

Sitting pretty to pass time Commentary by Dick Wolfsie What has happened to the art of sitting?

People nowadays don’t just sit, but they have to be involved in some activity humor like emailing, blogging, tweeting, reading or watching TV. When I was a kid, people in my neighborhood sat on their front porch. Of course, this was New York, so they were probably protecting their valuables or waiting for the police to arrive. But they were sitting, nonetheless. You do see people sitting outside a doctor’s office. But these people are waiting.

Big difference.

We need to recognize the historical significance of this leisurely activity. For it is, in this repose, that the truly lazy people of the world have made their impact. Do you think it was hard-working stiffs who came up with the idea for the backhoe, the chainsaw and the snow blower? Heavens no! It was the sluggish and the indolent solving the world’s problems while completely at rest. Cracker Barrel has the potential to bring back sitting as an art form. They have nifty front porches chock-full

of sturdy rocking chairs. This is sit waiting to happen.

Part of the charm of sitting is publicly displaying that you have the time and the inclination to just park your rear end in a chair. You can’t flaunt this in private. It is fun to sit on your front step and gaze into space with a slight smirk. Soon, there is immediate neighborhood speculation about an unexpected inheritance or a hot lottery ticket stashed in your sock, or spicy rumors about you and the new UPS driver.

Sometimes to relax, I just go and sit in my driveway in an old beach chair and wait for my wife to get home.

But when my neighbor Charlie sees me, he always grabs a stool from his garage and plants himself next to me. I hate being unfriendly, but lately I’ve mustered up the nerve to tell Charlie I’d rather be alone.

Some people just don’t sit well with me.

Cracker Barrel has the potential to bring back sitting as an art form.

Event venue coming to former Country Market site

By Heather Lusk • news@currentzionsville.com Hoping to open in three months, Jacqueline Bols is “full steam ahead” with her new event facility, Finley Creek Vineyards, new biz set in the former location of Country Market on US 421.

“I was looking for the right place,” said Bols, who owns Jacquie’s Cafe and Gourmet Catering. “I wanted to make it sustainable. I wanted to have that feel to it but I wanted to have that sophisticated edge.”

Set on five acres on Michigan Road, Finley Creek Vineyards will aim to convey a feeling of being in a vineyard setting without being a winemaking facility.

“We do so many weddings, we feel it would be perfect to have a vineyard setting,” said Bols who caters more than 100 weddings each year.

“It’s completely on its own, she said. “Kind of like their own oasis.”

The name comes from a creek about half a mile south of the property. “I saw it and I knew it,” she said of selecting the name.

The exterior will allow for al fresco dining or tents seating 300 people with the interior currently allowing for 220 individuals.

“You wouldn’t recognize it now,” she said.

The exposed beams on the interior will be white with chandeliers hanging from the ceiling. Reclaimed wood will cover the walls halfway.

“Completely different from what it was,” she said.

She will utilize the kitchens at her cafe location rather than the new building.

Bols has been a caterer for 14 years and opened Jacquie’s Cafe and Gourmet Catering on Michigan Road approximately six years ago.

“We want to turn it eventually into something that is sustainable,” said Bols, hoping to eventually have chickens and a few animals on site.

After the water contamination crisis in Flint, Mich., many Hoosiers might be wondering what’s in their water.

This is just what Zionsville safety resident Megan Glover had on her mind before setting out to co-found 120WaterAudit, a water-testing solution for consumers and businesses delivered to their front doors.

“There’s an awareness piece that I think we’ve all been out of sight, out of mind, for so long so getting people to test their water is the first step,” Glover said.

Before launching in May, Glover had been discussing with her co-founder, Chris Baggot, ways to test their own household water.

“It was around the Flint crisis, and we started talking about how there’s got to be a better way for you and I to know what’s in our water,” Glover said. “I went back to the house and I thought, what’s in my Zionsville water?”

After researching, Glover came up empty for a simple solution to test her own water.

“It’s not easy,” Glover said. “It’s not consumer-friendly. You can go to Home Depot and find labeled testing strips, but not all of them test for harmful contaminants.”

I went to a sneak-peek dress rehearsal of Civic Theatre’s “Trial of Goldilocks,” which is directed and choreographed by Brent E. Marty.

These young actors worked hard to bring a show that will put a smile on your face and bring back your favorite childhood memories. Gregory Hancock Dance Theatre features three pieces in ‘Metamorphosis’

By Anna Skinner • anna@youarecurrent.com Gregory Hancock Dance Theatre is known for its moving performances, and “Metamorphosis,” set for 7 p.m. July 1 and 2 at The Tarkington, 3 Center Green, is no performance exception.

“It’s called ‘Metamorphosis’ because over the past two years, I’ve gone through a lot of challenges. I felt that my life had to go through a metamorphosis, and I had to have a change,” said Gregory Hancock, choreographer. “The two years affected my company, so it’s a metamorphosis for the company and dancers as well. It’s a rebirth of everybody.”

Three separate pieces will be performed during “Metamorphosis,” including “Until There Is No More,” “The River’s Edge” and “The Violin Under the Bed.” “Until There Is No More” and “The River’s Edge” have both been performed before. After those are shown, there will be an intermission, and then “The Violin Under the Bed” will be performed for the first time.

“Until There Is No More” is the last performance Hancock’s mother saw before her death, which led to part of his metamorphosis. “The Violin Under the Bed” will show Hancock’s mother’s love of sport, travel, nature and art.

“This is a piece I made for my mom, which was daunting and challenging to do,” Hancock said. “It’s lots of little vignettes and memories and moments from her life because that’s what our life is all about is all these moments and how they connect together.”

The entire performance is contemporary ballet.

“These are personal stories, but this is a part of my metamorphosis,” Hancock said. “I’m not the same person I was, so my art shouldn’t remain the same either. Sometimes when we are younger, we worry so much about what people will think, and you get to a point in your career where it’s just about what you need to say and how to say it. That’s what makes art beautiful and unique.”

Wind symphony to play July 3

By Eric Kuznar • news@youarecurrent.com The Fishers Wind Symphony, directed by Dr. Keith Kunda, will play its first Fourth of July concert with an American-themed music performance at 4 p.m. July 3 at Legacy Bible Church, 2140 Greenfield Ave., in Noblesville.

“Fourth of July celebrates everything that America is, not just our freedom … but everything that America has become,” Kunda said. “When Kunda you look at the world of music, there is such a wide variety of distinctly American music.”

Kunda, who received his doctoral degree in conducting from Ball State University, is looking to bring a variety of American music to those in attendance.

“They should expect to experience American culture, American pride and American freedom.

We are one nation with one American culture,” Kunda said. “But within that there is a lot of variety.”

All of the concert’s selections have been arranged by American composers.

“My entire family is in the military, so I grew up in a very patriotic family,” Whisman said.

“So this is pretty meaningful … being the cofounder of an organization like this, it is really nice to see we are out there producing this type of music for the first time in four years.”

According to Whisman, concert attendees will receive a special gift and not be disappointed in what they hear from the 45-member group.

“These are all professional performers,” he said. “It’s a pretty high level of play we are performing.”

Blueberry vanilla ice cream cake with cream cheese frosting Submitted content courtesy of Family Features Prep time: 20 minutes Freezing time: 6-12 hours Servings: 10-12 Ingredients: • 10 ounces (about 2 cups) fresh blueberries, cold, plus extra for decorating • 16.9 ounces heavy whipping cream, cold • 6 ounces white granulated sugar, chilled • 1 packet The Curious Creamery Vanilla Ice Cream Cake Mix • 1 tub (14 ounces) cream cheese frosting • Sliced strawberries Directions: In blender or food processor, puree blueberries until smooth then place in refrigerator.

Pour heavy whipping cream in bowl of stand mixer fitted with whisk attachment. Add

sugar. Pour in ice cream cake mix and then add blueberry puree.

Mix on low for 30 seconds. Cover mixing bowl with dishtowel to prevent splattering.

Turn mixer to high and mix for 4 minutes. The mixture will become wavy and creamy and nearly double in volume.

Pour mixture into 9-inch, spring-form pan.

Cover with plastic wrap and freeze at least six hours. Once frozen, ice cream cake will easily release from pan.

Remove sides of pan, and decorate cake with frosting and berries. Return to freezer until ready to slice and serve.

Divvy Divvy in Carmel has a variety of small plates, and its take on a pork tenderloin involves two small sandwiches, called Hoosier Minis, for the lunch menu and three for dinner.

The tenderloins are topped with a sweet tomato aioli and leaf lettuce. The meal is paired with homemade sweet pickles and kettle chips.

Divvy suggested the tenderloins be paired with Bier Brewery’s Weizengoot.

America’s temple of justice Commentary by Don Knebel During its first 145 years, the United States Supreme Court was homeless. Its current home pays homage to the many sourctravel es of American legal traditions.

When the Supreme Court first convened in 1790, it had no established place to meet, so the justices gathered in the Merchant’s Exchange Building in New York City, then the federal capital. When the capital moved to Philadelphia, the court met in Independence Hall and then city hall. Since the plan for the new capital in Washington, D.C., made no provision for a home for the Supreme Court, it met in various locations in the Capitol Building. In 1929, former President William Howard Taft, then chief justice, convinced Congress to appropriate nearly $10 million to build a permanent home for the court. The building, just east of the capitol, was completed in 1935.

The colonnaded building, designed by architect Cass Gilbert, was inspired by the Parthenon, a temple to the goddess Athena in Athens, the birthplace of democracy. In place of the

Parthenon’s mythological scenes, the reliefs of the Supreme Court Building celebrate influential lawgivers. The east pediment, considered the rear of the building, pictures Moses, Confucius and Solon above the motto, “Justice, the Guardian of Liberty.” The theme that American legal and judicial ideals draw on many sources is continued in friezes along the inside walls of the court chamber. The frieze on the south wall features lawgivers from antiquity, including Menes, Hammurabi, Draco and Augustus. The north frieze includes the more recent Justinian, Charlemagne, John of England, Louis IX of France and Napoleon. The north frieze also includes a rare relief of Muhammad, carrying both a Quran and a sword, honoring his contributions to Islamic law. A visit to the Supreme Court Building provides visual reminders that our legal understandings have many ancestors.
