Help requested as county’s caseload highest per judge

By Sadie Hunter Sadie@youarecurrent.com For the past year, Hamilton County officials have been working to get help with its increasing COURTS court caseload. Now, the request is ready for state approval at the start of 2020.

The Hamilton County commissioners, council and prosecutor approved resolutions during the summer supporting the addition of a new magistrate Hughes judge. There currently are three in the county. In August, the request was formally sent to the state for review by the Interim Study Committee on Courts and the Judiciary.

On Oct. 17, that committee voted in favor of hiring a new magistrate.

State Rep. Donna Schaibley (R-Carmel) said she plans to author legislation for the legislative session that begins in January to support the addition of a magistrate. If approved, the new magistrate will aid the county’s six superior court judges and circuit court judge for large cases’ preliminary hearings and cases that involve minor offenses.

Judge William Hughes, who has been the county’s Superior Court 3 judge since its creation in July 1988, said the process is normal when communities and counties grow.

Statewide, the population growth rate is approximately 2.5 percent. Hamilton County’s rate the past decade is 17 to 18 percent.

“We have come to be the fourth-largest county in the state. We are projected to be the third-largest county in the state by the end of the decade and the second-largest by 2050 if our current rate of growth continues,” Hughes said. “This is a good thing, but with people come cases that require court intervention.

judicial officer for every 16,000 people.

We have one person for every roughly, 29,500 people.

“We have half as many judges as the county closest to us (in population, Allen County).”

All Indiana judges work under what is called a Weighted Caseload Measure, which sets the caseload rate per judge.

“It was an effort years ago to quantify how much judicial time could be expected to be used for a specific case type,” Hughes said.

Schaibley “Take the number of those cases filed with the amount of time that’s necessary and divide it amongst the judicial time that’s available. Everybody in our county is at about 1.3, (meaning) of the 10 people we have, we really need somewhere between 13 and 14 to do the work based on the amount of time available and the kinds of cases that are filed.

That puts us in a high-need position.

At least since 2015, I would say (is when) we started seeing an increase in our weighted caseloads.”

The limited space available in the judicial center in downtown Noblesville is another challenge for the county.

“We have a wonderful judicial center, but it is pretty full. There isn’t a lot of room left,” Hughes said. “The addition of judges is something that is a very good thing for us to do but is probably not going to be able to be dealt with until we deal with space.

That’s getting more and more critical all the time.”

Hughes said the inability to meet the need and the ever-increasing amount of cases isn’t for lack of trying. Judges often work long hours through the week, but Hughes said processing cases is still falling behind.

“The biggest (issue) is probably in the delay there is to get something done,” Hughes said. “Our pending caseloads have not kept pace with where they should be.”

David Weekley Homes helps 900 locally — Due to a partnership between David Weekley Homes Second Helpings, a nonprofit organization that has served the greater Indianapolis area for 20 years, nearly 900 local people in need were provided meals for Thanksgiving. David Weekley Homes’ fifth annual Thanksgiving Drive collected 150,000 pounds of food from Nov. 1-15. Nationwide, David Weekley Homes partnered with 18 charities and provided meals for 60,000 people.

CUMC recognized — Christ United Methodist Church, 318 N. Union St., has been selected for the 2019 Best of Westfield Award in the community churches category by the Westfield Award Program.

Each year, the Westfield Award Program identifies companies or organization that have achieved marketing success in their local community and business category.

Culver’s collects nonperishable items — Culver’s of Westfield is collecting nonperishable food items for Open Door of Washington Township through Dec. 31.

The Westfield City Council met Nov. 25 and approved various projects, including a rezone request for Claiborne Farms and a waiver request for Meijer signage. For more, visit westfield.in.gov.

What happened: The council approved a rezone request for the proposed Claiborne Farms by Del Web community.

What it means: Pulte Homes plans to build 490 age-restricted, single-family homes to the north and south sides of 151st Street, west of Towne Road. The zoning is now changed from agricultural/single-family rural to single-family high density. The council voted 5-2, with councilors Joe Edwards and Cindy Spoljaric voting against.

What happened: The council voted in favor of a waiver request for signage for a Meijer store.

What it means: Woolpert, Inc. is requesting waivers to the city’s sign standards. Meijer, which plans to build a new store at the southeast corner of Ind. 32 and Spring Mill Road, wants 1,557 total square feet of signage, but the city’s unified development ordinance only allows 500. The Westfield Advisory Plan Commission unanimously voted Nov. 6 to send the request to the city council with an unfavorable recommendation. Woolpert and Meijer presented a list of changes, which included reducing the overall sign square footage by 440 square feet and adding more appealing architectural features to the gas station. The council voted 5-2 in favor of the changes and sent the petition back to the APC, which will have final say.

What happened: The council approved a resolution for a road cut for Ind. 32 near the Meijer store.

What it means: Meijer is requesting a single, full-access curb cut on the south side of Ind. 32, east of Spring Mill Road. The drive would allow for vehicle access to other properties within the commercial development in the Maple Knoll planned unit development district. The council previously approved a curb cut that would allow drivers to enter the development from Ind. 32 only by turning right while heading east and exiting the development by turning right only to drive east on Ind. 32. Woolpert has requested that motorists be allowed to turn left into the property while traveling westbound on Ind. 32. The city and the Indiana Dept. of Transportation are required to pass the resolution, which INDOT has. The council voted 5-2, with Edwards and Spoljaric voting against.

What happened: The council approved an amendment for the planned Westgate housing development.

What it means: Lennar Homes of Indiana, Inc. requested an amendment to the Westgate planned unit development district to modify architectural standards and amenity requirements for a 230-acre property. Lennar plans to build a new residential development near 166th Street and Towne Road, west of Eagletown Road. The council approved the amendment, 7-0.

Townhome project advances

By Sadie Hunter sadie@youarecurrent.com Following a tie vote on the Westfield Advisory Plan Commission in October, a townhome HOUSING project is moving forward after the Westfield City Council approved a rezone request by a 4-3 vote at its Nov. 25 meeting.

Earlier in the fall, Estridge Homes and 11th Street Development petitioned to rezone a 1.26-acre property on the west side of Poplar Street between Jersey and Park street from multi-family, low density to single-family attached residential to make way for 24 new townhomes, to be called Poplar Street Townhomes.

Between the plan commission and city council, the primary concern was with the proposed location. Both bodies were split on whether the project should be constructed at the proposed location on the opposite side of Poplar Street.

Local writer pens ‘JACOB’

By Anna Skinner anna@youarecurrent.com Author and poet Kimann Schultz has published several works, but she’s particularly proud AUTHOR of one of her newest creations – a 93-page short story the tells the redemption of Jacob Marley, a character from Charles Dickens’ “A Christmas Carol.”

The Geist resident originally wrote a poem about Marley called “JACOB,” and later decided to turn it into a book.

“I’ve always thought, ‘What about Jacob Marley?’ This character is a real archetype for loss and pathos and somebody who wants to be redeemed in some way,” Schultz said. “Ebenezer Scrooge was redeemed and Jacob wasn’t. He was just left hanging there. I had an image of him sitting at a desk for eternity, and the poem is something he recites as he’s counting his coins over and over again.”

Schultz wrote the poem in 2014 and revised it in late 2018. She later

self-published the book “JACOB,” which is available for $17.95 on Amazon.

“A lot of focus of my story is about redemption, and I think there’s a need for that message today, and it’s a positive message and a proactive message,” she said. “Of all the things I have ever worked on and made myself go back through, this is one of the most fun things I have ever written.”

E-Skimming is the digital variation, where credit or debit card or other personal information is captured by a thief. Keep track of your purchases and check your statements often to make sure your account information hasn’t ended up in the wrong hands. Experts also recommend using a credit card or PayPal to make online purchases.

2. When you’re out shopping in the mall, leave identifying pieces of information, such as surplus credit cards, Social Security card, passports, and even checkbooks (if you are not using it) at home. Leaving them in your purse, pocket, or car is an open invitation for theft.

3. If it seems too good to be true, it probably is. Phone scamming is still in vogue among identity thieves. If someone reaches out via phone (or email) claiming you’ve won a prize, but in order to claim it, you must provide personal information (such as a Social Security Number, or bank account), hang up immediately.

4. Gift card scams are skyrocketing. If you are ever asked to pay for something via a gift card, or someone tries to sell you a gift card at a discounted rate, those are huge red flags. Only buy gift cards from trusted sources, or directly from the merchant.

5. Call 888-5-OPTOUT to stop banks from sending you preapproved credit offers in the mail. Also, you can stop unwanted sales calls by registering your phone numbers on the National Do Not Call Registry at www.donotcall.gov or by calling 888382-1222.

Westfield partners with Riverview to be first Hamilton County city to offer PulsePoint

By Anna Skinner anna@youarecurrent.com Westfield residents can perform life-saving measures with the aid of an app when someone suffers sudden cardiac arrest in Westfield, thanks to a partnership between the city COVER STORY and Riverview Health.

Riverview Health paid the implementation, subscription and licensing fees for the first-year use of the app, which totaled $19,500, to provide the PulsePoint mobile app in the City of Westfield. PulsePoint is a free citizen emergency response app that allows anyone with a smartphone who is trained in CPR to register on the app as a certified citizen responder. In a public emergency situation, local emergency dispatchers activate an alert to notify nearby app users. The certified citizen responder can then provide help.

When someone suffers sudden cardiac arrest, each minute without CPR decreases survival by 10 percent, according to PulsePoint.org. Even with adequate response times from local agencies, it can take several minutes for medic crews to arrive.

Within six and eight minutes without CPR, brain death occurs. The PulsePoint app alerts users who are within a quarter-mile of the victim in the event they can respond quicker than paramedics.

PulsePoint users are only notified if someone is suffering cardiac arrest in a public place. They are

Commentary by Terry Anker The leftovers are gone. The turkey bones have been boiled and the resulting soup was enjoyed. Soon, the decorations will be hung by the chimney with care. Our sights set on the coming holidays, and then the new year, distract us from the impending threat of winter.

Sparkling lights, abundant food and the closest friends and family all align to help us wrangle some deep-seated, primal fear about the hunger and isolation triggered by the frosty nights.

Still, doesn’t it all seem most harsh weeks past the solstice in the waning days of January? The festoons are packed neatly away, back in the attic awaiting next year.

Guests have gone home. And we are focused on bringing our waistlines back into pre-holiday circumferences. But, the days remain short, cold and blustery. Don’t we need each other much more after the fun is over?

Even the bitter and unrepentant Ebenezer Scrooge learning the depth of his error was heard to exclaim, “I will honour Christmas in my heart, and try to keep it all the year.” He could have sent a goose to the Cratchits, donated a few bucks and settled in to enjoy the 19th-century London equivalent of holiday football games. Instead, he vowed to play the long game. As family clears out for another year, can we make the same declaration?

A holiday survival guide Commentary by Danielle Wilson All right, people. Here’s my plan for surviving the holidays. Feel free to adopt, share or reject HUMOR outright. I really don’t care.

Because that’s my mantra as I wade through the next few sugar-filled, sleep-depriving, financially and emotionally draining weeks. It won’t be all bad, true. Who doesn’t love a season that embraces 1970s claymation, egg nog and ugly sweaters? But I’ve learned through the years that December can become your worst nightmare if you don’t prepare properly. The key? Don’t get too invested. In anything. You’ll only be setting yourself up for disappointment and alcoholism. So, here you go.

You’re welcome.

1. Just say no. “No, I can’t make it to the office party.” “No, I won’t be participating in Secret Santa.” And, “No, I’m not driving you, my darling daughter, to ice skating, Yogurtz, Castleton and then to Emily’s.” Borrow from the Mothers-of-Twins handbook: Just say no!

2. Expect the worst. The almighty flu will smite your house, and the 12-foot fir, laden with antique glass ornaments, will topple. If you expect high levels of chaos and stress, you’ll either be well-prepared when it hits or pleasantly surprised that you survived unscathed. Win-win.

3. Schedule “me time.” In this season of gift-giving, don’t forget to love yourself! Take 20 minutes after your fifth Meijer run to play solitaire. Lock yourself in the bathroom for an afternoon of “The Crown.” Have a second cranappletini with your gal pal. You can’t successfully navigate choppy Yuletide waters if your mental compass is perpetually pointing south.

Ignore the guilt, recite the mantra and practice self-care.

Trump’s attempts to pressure Ukraine to interfere in the 2020 election demonstrate that he is a danger to our democracy and the security of our elections. Thanks to whistleblower complaints, information released by the White House and the testimony of more than half a dozen witnesses, we have proof that Trump withheld military aid to coerce the president of Ukraine to interfere in the 2020 election.

No American is above the law, especially the president. I believe Congress has no choice but to draft articles of impeachment and vote to impeach Donald Trump.

Democrats are bravely standing up for the rule of law and our democracy. It’s not too late for Republican representatives to do the same.

Weekend segments: A year in review Commentary by Dick Wolfsie I’d like to celebrate some of the special people I interviewed while doing my weekend segHUMOR ments on WISH-TV in 2019.

Gregg Bell is 90 and still practices dentistry and is director of that department at Logansport State Hospital. But wait, there’s more! In 1953, Bell won the Olympic gold medal in long jumping in Melbourne, Australia.

When I interviewed him, I asked him to show me the 26-foot, 5.2-inch distance that won him first place. He eyeballed the floor and walked it off within a quarter of an inch.

At the age of 18, Carmel resident Ashton Gleckman wrote, filmed, edited and produced an incredible documentary about Holocaust survivors that was featured this year at the Heartland Film Festival. He learned to do all this from YouTube videos. Not to brag, but I learned from YouTube how to use dental floss to get a stuck

ring off my stubby finger.

Senior pickleball player Ralph Fowler is the star of the Monon Center pickleball league, and I was there with TV cameras to surprise him for his 90th birthday. He plays every bit as well as people half his age. He beat me in a game. I’m sure I could have beaten him if there had been a rematch, but I was too tired to play again.

Lonnie Bedwell lost his vision in 1997 when his best friend accidentally shot him during a hunting trip. The story of his adventures while blind include kayaking down the Colorado River, climbing to the top of Mt. Kilimanjaro and skiing down the world’s most challenging slopes. “I wish I had my sight back,” Lonnie said during our interview, “but I wouldn’t trade the last 23 years for anything.”

Kenny Sailors died in 2016. He was credited as the player who introduced the jump shot to basketball in the 1930s. I interviewed Jake Hamilton, who produced a biographical film about Kenny Sailors. Kenny is not in

the Basketball Hall of Fame, but he should be. The documentary should give him a better shot, just like he gave basketball.

Dr. Richard Moss, author of “A Surgeon’s Odyssey,” tells the story of how he (a Jasper head and neck surgeon) traveled across Asia, with extended stops in Bangkok, Nepal and Bangladesh to treat the locals, operating on people with almost unspeakable deformities. Stymied by limited resources and the challenges of diverse cultures, his story deserves a full documentary feature film, not just a 10-minute interview with me.

Westfield organization receives $10,000

By Anna Skinner anna@youarecurrent.com The Cocktails & Chemo Foundation recently received a $10,000 grant from Royal Neighbors of GRANT America. The foundation’s founder, Amanda Clark, plans to use the funds to help families across the nation.

Cocktails & Chemo began as a blog when Amanda’s husband, Joe, was diagnosed with colon cancer in 2012.

“We started this blog and ran this blog just as an outlet, but the blog grew and grew and then my husband passed away in 2014,” said Clark, a Westfield resident. “Soon after that, it kind of became a passion project for me, and the blog turned into a nonprofit where we focused solely on supporting caregivers. There’s not a lot of resources out there for caregivers, and I cared for my husband and just thought, ‘Gosh, there’s nothing out there.’”

The foundation supports caregivers by sending monthly care cards and giving large grants to families in need.

It also conducts events for caregivers to recharge and connect with other caregivers.

“It’s fun for everybody,” Hymes said. “We want everyone to have a great time and get into the holiday spirit. We know there is a lot going on and people are inundated with things to do at the holidays, but this is pretty fun, and then you walk outside and the Christkndlmarkt is going on.

“It’s a great time of the year at the Palladium, and the show is very festive.”

The Carmel Symphony Orchestra’s Holiday Pops concerts are set for 3 and 7:30 p.m. Dec. 14 at the Palladium at the Center for the Performing Arts in Carmel. The afternoon show is geared toward children with Santa and Mrs. Claus.

“I decided to bring in a mix of local talent, and I think it’s going to be fantastic,” Hymes said. “It’s really a concert that we really enjoy playing.

It’s so different from what we do with our masterworks. In fact, we are looking at increasing our pops offerings. We know the community really likes those concerts.”

Carmel High School’s Ambassadors, the mixed show choir, will perform.

“I haven’t worked with them before, so I think it’s really going to be fun to bring them to the Palladium because they are just so beloved by the community,” Hymes said.

“They are great singers. They are doing some fantastic music. One is a cappella and the rest is with the orchestra.”

Koz’s Christmas show set

By Mark Ambrogi mark@youarecurrent.com The concept for Dave Koz’s annual Christmas show started during an interview he was doing CONCERT with his good friend, pianist David Benoit, on Koz’s radio program.

“He had just lost his mother and I had lost my father, and he said, ‘What are we going to do for the holidays?

Maybe we should go out and play some music,’” Koz said.

They did, and Koz has been doing it ever since. Benoit has joined him on several tours.

“This is year No. 22, which is very unbelievable for me because I never would have thought it would go on this long,” Koz said. “It’s a tribute to the fact that people love holiday music. I love holiday music and we love putting together these shows.”

Harmony Magic concert set

The Harmony Magic Women’s Barbershop Chorus wants to infuse the holiday season with the MUSIC magic of music.

The group formed in 2006 when members of another chorus left to create their own choir.

“Over the years, the word has spread,” said Kelly Kahn, chorus member and Westfield resident. “We were having a meeting in a restaurant, and before our meal, we sang harmony grace, a short prayer. Our waitress was so impressed, we left her with our information. She’s been a member with us now for almost a year and a half.”

Harmony Magic is presenting a holiday concert at 3 p.m. Dec. 14 at Westfield’s Carey Ridge Elementary School,16231 Carey Rd. “We’ll be signing some traditional holiday music,” Kahn said. “Then we add in some not-so-traditional songs that are a lot of fun. The concert is

Pecos Historical Park: 800 Years of History Commentary by Don Knebel Pecos National Historical Park provides an opportunity to explore the ruins of an ancient PuebTRAVEL loan village and a Civil War battlefield.

In about 1100 A.D., the Puebloans, an indigenous people living throughout the American Southwest, established a village of mud buildings 26 miles east of what is now Santa Fe, N.M. Located near the strategic Glorietta Pass, the villagers became prosperous trading with other indigenous peoples. In 1540, Spanish forces under Vasquez de Coronado discovered the village, then a five-story pueblo housing 2,000 residents, and named it “Pecos. In 1598, the Catholic Church sent a Franciscan friar to Pecos. He destroyed the circular kivas the Puebloans used for religious ceremonies and smashed their idols, creating enormous resentment. The original priest was replaced in 1621 by a more tolerant one, who convinced the residents to build a massive adobe church, by far the largest in New Mexico. In 1680, Puebloans throughout New Mexico revolted against what they considered unnecessarily harsh

Spanish rule. The residents of Pecos killed their priest, demolished the huge church and built a new kiva near the church. The Spanish fled but soon returned and built a much smaller adobe church within the site of the earlier one. In the late 18th century, Pecos began to decline from disease and Comanche raids, and by 1831 Pecos and its historic church were abandoned.

In 1965, the ruins of Pecos became part of the Pecos National Historical Park, enlarged in 1990 to include almost 7,000 acres. A trail takes visitors past the foundations of the original adobe church, the still-standing walls of its replacement and a restored stone kiva. The park also incorporates the site of the Battle of Glorietta Pass, an 1862 battle along the Santa Fe Trail that ended the Confederate campaign to separate the Union from the West.
