CCS, Liberty Counsel in discussions over poster

By Ann Marie Shambaugh AnnMarie@youarecurrent.com Carmel Clay Schools may be on winter break, but its lawyers have been busy recently, speaking with officials from Liberty education Counsel regarding an antiabortion poster created by a pro-life student group the district allegedly allowed and then removed.

The Carmel Teens for Life’s display featured hearts representing 3,000 abortions that occur each day and the word “Abortion” with the “b” and “r” replaced with “d” and “p” to spell “Adoption.” The poster went up with proper approvals from the school, according to Liberty Counsel, an organization that works to “restore” what it terms the culture “by advancing religious freedom, the sanctity of human life and the family,” according to its website. But a student deemed the poster “offensive” and it was taken down.

Liberty Counsel, a nonprofit that provides free legal help, is representing the Teens for Life Club. On Dec. 19, CCS Supt. Dr. Nicholas Wahl said the two sides are in discussions about how to resolve the matter.

“Our legal team is now in talks with Liberty Counsel to work out an amicable resolution – one that will ensure the protection of student rights and encourage freedom of speech,” Wahl stated. “School clubs are a rich tradition at

David Orentlicher, a law professor at the Indiana University Robert H. McKinney School of Law and former Democratic state representative, said from his understanding it doesn’t appear that CCS officials were “thinking carefully” through the situation when they ordered the poster to come down.

“We have to recognize that important speech often makes us uncomfortable, and discomfort alone can’t be a sufficient reason to restrict speech, because then we never can deal with important issues,” he said.

Although a school does have a right to re-

strict some forms of speech that are permitted elsewhere – such as promotion of illegal activity or vulgarity – it can’t selectively forbid political speech or certain words just because they might be offensive to someone, Orentlicher said.

Liberty Counsel has asserted that signs from pro-LGBT and Young Democrat groups have been allowed at CHS, one reason its lawyers believe the Teens for Life poster should go back up.

Orentlicher said that is a valid point.

“If you’re saying you’re allowing one side to speak and not the other side, that’s a big problem,” Orentlicher said. “In general, if you’re going to censor student speech, you have to be able to make an argument that it’s interfering with the pedagogical mission of the school.”

Liberty Counsel said it first contacted CCS about the issue Dec. 5. It stated in a press release that it gave CCS a deadline of Dec. 23 to respond with its side of the story before taking additional action, but that changed Dec. 9 when it said that CCS “demanded” Teens for Life Club leaders sign an agreement to not seek outside legal help or parental input and not use the word abortion in any communications, among other stipulations. When Liberty Counsel didn’t receive a satisfactory explanation for the district’s actions, it went public about the situation, calling it a “game-changer.”

CCEA, ISTA at odds over dues

By Ann Marie Shambaugh AnnMarie@youarecurrent.com The union representing Carmel Clay Schools teachers has received notice that it is no longer in good standing education with the Indiana State Teachers Association after ISTA claimed it failed to pay dues that were deducted from teachers’ checks. Officials from the Carmel Clay Educaion Association, however, said that ISTA had been overdrawing what was due and that the two entities have been working for months to address the situation.

ISTA, which represents nearly 40,000 Hoosier educators, recently notified CCEA members that the two organizations “have been in a dispute over the local’s failure to transmit member dues that were deducted from payroll for the 2015-16 year.” The notice from ISTA President Teresa Meredith states that ISTA found out Sept. 1 that CCEA made a stop payment order on funds designated for ISTA. “Because this action of the CCEA Board threatens to deprive certain members of important rights and protections that ISTA membership affords, ISTA has been actively working to resolve this dispute with the CCEA Board,” it states.

In a note to CCEA members, CCEA President Brian Lyday stated that “the absurdity of this letter cannot be understated” and that his organization acted to prevent ISTA from automatically withdrawing payments after an audit showed that membership numbers submitted by CCEA did not match what was in ISTA’s database.

“ISTA’s own audit (in March) revealed it had overdrawn at least $9,484.31 from CCEA over the past few years. After nine months, ISTA remains unwilling to correct errors within its original reconciliation work that demonstrated this is a minimum amount owed,” Lyday stated.

Lyday stated that in November ISTA offered to repay $9,484.31 to reconcile the amount it overdrew for the 2015-16 and 2016-17 school years but not previous years. On Dec. 6, the CCEA board of directors unanimously did not accept the offer, “given ISTA’s repeated refusal to acknowledge the reconciliation issues continually presented and clearly documented,” Lyday stated.

ISTA indicated that it will work with individual CCEA members who are not on the board to answer questions and provide assistance.

As the holiday season wraps up and a new year quickly approaches, the 2016 tax year comes to an end as well. While it may feel too early to be thinking about taxes, a topic that is sometimes overlooked in family law matters is the determination as to which parent shall be allowed to claim the children as dependents on their State and Federal Income tax returns in any given year.

While it may have once been common for Judges to order the parents to alternate claiming the children, under the Indiana Child Support Rules and Guidelines the objective is to achieve an order which will make the most money available for the children.

Therefore, there is no certainty that in each case the parties will be ordered to alternate claiming the children. However, keep in mind, that when a Court is determining an order to release the tax exemption, there are several factors that can be considered. The following factors include: (1) the value of the exemption at the marginal tax rate of each parent; (2) the income of each parent; (3) the age of the child(ren) and how long the exemption will be available; (4) the percentage of the cost of supporting the child(ren) born by each parent; (5) the financial aid benefit for post-secondary education for the child(ren); (6) the financial burden assumed by each parent under the property settlement in the case; and (7) any other relevant factors,(including health insurance tax subsidies or tax penalties under the Affordable Care Act).

One imperative factor that parents must understand is that the Decree of Dissolution or Court’s Order may not alone, by itself, be adequate to effectuate the terms in the Decree with respect to each parent’s ability to claim the children as dependents. Remember, in

order for the noncustodial parent to claim the child(ren) on her/his tax return, the custodial parent must execute the IRS Form 8332, thereby relinquishing her/his right to claim the children as dependants for that tax year. In general, the Courts cannot order that one party has the right to claim the children, but rather that one party must take all steps necessary in order for the other party to claim the children in a certain year, such as signing the IRS Form 8332. Additionally, signing the release is often contingent upon child support being current for the calendar year for which the exemption is ordered, as incentive to keep child support payments current. In fact, the Indiana Child Support Rules and Guidelines indicates in order for the parent who is obligated to pay child support and wants to claim the exemption, that parent must have paid at least ninety-five percent (95%) of their court ordered support for the calendar year in which the exemption is sought by January 31st of the following year. Thus, in order for the child support paying parent to claim the exemption in 2016, that parent must be at least 95% current by January 31, 2017.

So, while taxes can be a nightmare in and of themselves, hopefully with discussion and thoughtful planning, the child tax exemption doesn’t have to be included in that headache. Music teacher visits Poland

By Eric Kuznar • news@currentincarmel.com Lisa Sullivan has accomplished much in her 27 years teaching at Mohawk Trails Elementary School, even earning the Carmel Clay Teacher of the Year Award in 2008. education But recently, Sullivan, 49, had the opportunity to participate in something new during the AMIS Music Educators’ Conference at the American School of Warsaw in Warsaw, Poland. She was invited to the international conference for music teachers, where she gave a presentation on Orff Schulwerk, an approach to teaching that uses both music and movement to engage students and help them learn.

“Young children need to move their bodies,” Sullivan said.

“They tend to learn better when the brain is fired up, and it Sullivan makes a big difference when that movement comes into play.”

Sullivan, who is a regional representative for Orff Schulwerk, helps train other teachers in the developmental approach.

She said interacting with teachers from around the world has been inspiring.

“Having the chance to share with teachers who are affecting children literally all over the world is the epitome of wanting to reach as many children as possible with what we do,” Sullivan said. “Thinking about the kids who are doing some of the activities that I presented to those adults, who are in Beijing, India, Germany, England, they are all over the place. It is just amazing to me.”

Sullivan knew she would teach music since her freshman year in high school.

She said giving kids music in the classroom is something they will be able to take with them.

“Music and art are the things that are going to follow these kids forever,” Sullivan said. “Connecting music to our emotions is also powerful. That can affect us when we’re 90 or 20.”

Food drive a success – David Weekley Homes hosted its second annual Thanksgiving Drive, collecting an aggregate of 147,000 pounds of turkey and nonperishable items in 20 participating markets. Cancer battle urges Carmel family to ease hospital stays for kids

College Wood makes record donation

By Sierra Solis • news@currentincarmel.com Each year, thousands of children receive treatment for cancer, and one Carmel family is doing its part to make a terrifying experience a little more comfortable.

The Halevi family created the nonprofit cover story Sheets from Home to provide donated kid-friendly, colorful bed sheets to replace the plain ones often found in medical facilities. The Halevis know the comfort it can bring to a child, because they’ve been there.

Tamir Halevi, 10, was diagnosed with neuroblastoma in 2010, not long after his mother, Ya-el, had battled melanoma and cervical cancer.

“You reflect back on that journey and you think about the things that made a difference,” said Asaf Halevi, Tamir’s father and Ya-el’s husband. “When he got admitted for his first inpatient stay, my wife actually took off his boring, white hospital sheets, and recognizing that he’s going to be there for many months to come, she put on fun, kid-friendly sheets to try to put a smile on his face.”

The experience led the family to believe that fun bed sheets could create a more home-like environment for other children battling cancer. Since its launching, Sheets from Home has donated approximately 6,000 sheets to several hospitals in the U.S. and beyond.

Natives of Israel, the Halevis moved around the East Coast before settling in Carmel to be near Asaf’s job with Eli Lilly. The family has a large network of friends and supporters who have helped Sheets from Home grow beyond the Midwest.

“For me it was a dream. It was something that I was hoping to do. Sitting here today, I’m speechless,” Ya-el said. “It’s a team effort. So I’m very thankful for all the good people who helped us make this a reality, and they keep supporting us. I’m very thankful for being able to give back and do more.”

The family frequently visits Peyton Manning Children’s Hospital to donate sheets. They spent much of their time at the facility during Tamir’s battle with cancer. Child life specialist Erin Draminski plays a major role in helping deliver the sheets to patients at the hospital.

Tamir Halevi enjoyed the sheets his parents gave him during his time in the hospital. He was diagnosed in 2010 with pediatric cancer when he was 3 years old.

“It’s really an incredible organization that is very personal,” Draminski said. “That’s what really hits home with families, is personal items and personal things, and the fact that someone else is thinking of something that these families aren’t thinking of. I think (that makes) all the difference in their day and their journey.”

College Wood Elementary collected 221 bed sheets Nov. 14-18 for kids fighting cancer, the largest single donation collected for Sheets from Home.

During the week, Tamir Halevi spoke to his classmates about cancer and how they could help other kids feel more at home. For every bed sheet donated, students wrote letters and drew pictures for a child in need.

Draminski prepares the sheets for children coming in for a procedure or being admitted to the hospital.

“It’s a little thing that sets the tone for the future, the rest of their stay,” Draminski said.

Tamir is now healthy and a student at College Wood Elementary. The young cancer survivor often helps deliver sheets and raise awareness.

“It took away all the annoying things, except for the things I couldn’t control,” said Tamir, reflecting on his own experience in the hospital when his parents first gave him fun bed sheets.

Ya-el said the organization’s goal is to put a smile on the faces of young patients going through what they have faced as a family.

“I’m not a doctor. I don’t know how to make it better,” Ya-el said. “But I know that this helped me, and hopefully it’s going to help others.”

Have hope as ’17 dawns Here we are - some would say thankfully - nearing the end of 2016. For our community, it mostly was a fine year, especially in terms of progressive growth and development as well as infrastructure improvements we couldn’t have imagined even 10 years ago. Our “world” is changing, and it is doing so for the better, we believe. Outside the local environs it was tumultuous, to say the least. The presidential election was a shock to many on both sides of the aisle, but the run-up to Nov. 8 was a war-torn effort that was equally, if not more so, a train wreck. We once termed primary season a clown show; that didn’t do it justice.

With apologies to our soon-to-be former first lady who said she doubts otherwise, we all should retain some sense of hope that what is wrong in our midst will be made whole at some point soon. Without hope, what is there? We prefer to not even contemplate that. In life, we’re often told to play the hand we’re dealt, and doing so really is as simple as this equation: E+R=O, or event plus response equals outcome. We believe if you seek the bad, probably it will be bad, and if you seek the good, probably it will be good. People have pointed fingers at us for focusing on “bad things.” We do that on occasion in the interest of protecting our readers’ rights. So as we prepare to turn yet another calendar page, we’re hoping for the good - with stability - and all things growth in 2017. Here’s to you, and Happy New Year from all of us at Current Publishing.

A drop of whiskey Commentary by Terry Anker Often, when meeting a person of some renown, we are deeply disappointed. Yet, in other precious encounters, our already high expectations are exceeded and overcome by the distinctive and important comportment of our hero. Such was the occasion in a recent exchange with famed author and television commentator Doris Kearns Goodwin. With best-selling books including “Team of Rivals” on Abraham Lincoln and “The Bully Pulpit” about Theodore Roosevelt, Goodwin is a bona fide success story. She has earned a place as the preeminent commentator on the American presidency and its place in our culture — and that of the modern and evolving world.

Thanks to the annual legislative conference of law firm Bingham Greenbaum and Doll, The Benjamin Harrison Presidential Site and Indiana Humanities hosted an interview and discussion with Goodwin during her recent visit. Invited to moderate the talk, I had occasion to interact and see her in action. Affable and open, she reflected on what

history can teach us regarding expansive current topics, including our natural desire to leave a legacy, the impact of fake news and the importance of common understanding to effective communication.

Goodwin spoke honestly about her concerns for our present — and for our future.

We considered the general loss of confidence in the institutions upon which we’ve built the very foundations of our nation. She told stories that gave us pause, and confidence, that the future is ours to shape. But we must hang on to a bit of humor to get us through the difficult patches. Goodwin quoted her most famous subject, Abraham Lincoln, thusly, “A good story is better than a drop of whiskey.” She has a point. But then again, doesn’t it depend on the story and, more importantly, on the whiskey?

The unthinkable has happened, people.

I’ve lost my calendar! My reliable, omnipotent, executive planner is humor GONE. And though I’m pretty sure it’s sitting on a shelf next to clearance candles at Bed Bath & Beyond, a phone call proved otherwise.

What am I to do?

I’m not exaggerating when I say that calendar is the only reason this family functions at a reasonably acceptable level. Appointments, practices, rehearsals, meetings, birthdays, games, competitions, parties, deadlines, surgeries, anniversaries — every single detail of our lives are in that calendar. In fact, if something fails to be placed in “the calendar,” it’s essentially dead to us.

It won’t be remembered, and it certainly won’t happen. It just won’t.

So I’m in full panic mode. I know two visits to the orthodontists are coming up, but I’m not sure which day or for which kid.

I also know January has eight family birthdays, and apart from my twin sister’s and my niece’s on the same day, I’ve got nothing! Sweet mercy, what am I to do?

Of course, my oldest thinks I’m silly for trusting such a monumental task to pen and paper when my phone could act more efficiently — and with better back-up capabilities. But I’m not going to lie. I look forward to sitting down at the start of each January and planning the year out. I like seeing how close spring break is. I like flipping to July and penciling in a prospective beach vacation. I like discovering what day Halloween falls on, and then considering whether a personal day will be in order. The experience isn’t the same on a Samsung 6.

More importantly, though, I love that my old calendars serve as physical reminders of the memories my family makes throughout the years. To know that when my kids grow up and have children of their own, I’ll be able to pull out 2016 and tell them all about their dad’s broken nose or their mom’s marching band championship. So I have to find that calendar. The alternative is unthinkable.

OneZone presents 2016 awards

Olson received the OneZone Most Valuable Volunteer Award at the chamber of commerce’s awards achievement luncheon Dec. 14 at Ritz Charles in Carmel.

“I was extremely honored and humbled and thoroughly surprised to receive the (award),” Olson said. “I know there are many people deserving of this award every year. I love our community Olson and everything it offers. I’ve never looked at volunteering like work, rather a great way to make friends, support our community and help others make memories.”

Olson moved to Carmel in 2006 and started BrightStar Care of Indianapolis, a home-care and medical-staffing agency, providing care to seniors.

“Being a business owner has allowed me to become involved with many organizations,” Olson said. “We have a wonderful team and they are always looking for organizations in need of our support. We have supported and/or volunteered with the Alzheimer’s Association, Indiana Blood Center, Humane Society of Indianapolis, Faith Hope & Love, and most recently we were able to volunteer for Hunter’s Hugs.

We collected more than 140 blankets that will be donated to local homeless this winter.”

Olson joined the Rotary Club of Carmel, which led to many other opportunities.

The final competition performance takes place in the state-of-the art, acoustically superior Palladium concert hall for an audience of more than 1,000. Crust: • 2 cups (8-ounce package) crushed gingersnaps • 1/4 cup melted butter Cake: • 1 1/2 pounds cream cheese, softened • 3/4 cup honey • 1/3 cup heavy cream • 1 tablespoon vanilla • 1 tablespoon gluten-free all-purpose flour • 1/8 teaspoon salt • 4 large eggs • 1 pint fresh blackberries Garnish: • 1 pint fresh blackberries (optional) • Honey (optional) Directions: Heat oven to 350F. In medium bowl, combine crushed gingersnaps and butter. Transfer mixture to 9-inch springform pan. Stick hand in sandwich bag and firmly press mixture into bottom of pan to form crust. Retro-fitting creates luxury spa-feel in bathroom Commentary by Randy Sorrell This stunning master bathroom in Avon showcases a classic retro-fit!

It’s home improvemnt amazing what a fresh coat of paint with updated colors will do for any space, but especially master bathrooms when charged with developing a luxury spa-feel. The high quality vanity was dated only by it’s tired finish and dated counter. The structure itself was very tasteful and relevant, so we painted it, installed a granite counter, new under mount sinks, fresh fixtures and door pulls. It looks fabulous!

Likewise, the Jacuzzi tub and surround shower needed a little happy bling added. A vigorous professional buffing, new fixtures and jet covers served to elevate the appearance to a spa-quality tub. A predominantly frameless shower door installation and abbreviated shower expansion opened up the footprint considerably and feels much more elegant.

Thousands of dollars were saved by retro-fitting instead of a complete tear out.

In addition, the residence districts may be described by reference to streets or other geographical features and these descriptions shall be deemed incorporated into this resolution but the map shall control any discrepancy between the map and the description. 4. Time Plan Effective. The Plan shall be effective as provided in IC 20-23-8.

5. Transition Provisions. The Board at the time this Plan is adopted is elected as specified in this plan and the only change in that plan is the redefining of the boundaries of the residence districts as set forth in this plan. Therefore, there is no need for transition provisions.

Not later than one hundred twenty (120) days after date of the publication of this notice, the voters of the school corporation may file with the Clerk of the Hamilton County Circuit Court a petition protesting the foregoing plan or a petition submitting an alternative plan.

The petition protesting the plan shall be signed by at least 20% of the voters of the School Corporation or 500 voters, whichever is less. A petition submitting an alternative plan shall be signed by at least 20% of the voters of the School Corporation. Any petition thus filed shall be certified by the Clerk and be filed with the School Corporation’s governing body, its Board of School Trustees, in accordance with IC 20-23-8-14.

Ruins of Shobak Castle Commentary by Don Knebel A Crusader castle approximately 130 miles south of Amman, Jordan, proved impenetrable but nonetheless vulnerable. Its travel capture ended with an unexpected gesture of wartime kindness.

On July 15, 1099, knights of the First Crusade captured Jerusalem from the Muslims and established the Kingdom of Jerusalem. In 1115, Baldwin I, the first king of Jerusalem, built an imposing stone fortress atop an isolated conical mountain east of the Jordan River to control trade between Damascus and the Red Sea. Named Krak de Montreal (Castle of the Royal Mountain) to reflect the king’s contribution to its construction, the fortress marked the eastern dividing line between Christian and Muslim territories. Because of its design and location, Krak de Montreal withstood a number of assaults. In 1187, after recapturing Jerusalem, Saladin began an 18-month siege of the fortress. Starving defenders exchanged their wives and children for food and reportedly went blind from lack of salt. Running out of both food and wives, the Christians sur-

rendered in May 1189. Saladin, known both for his skill in battle and magnanimity in victory, repatriated the wives and children.

The Mamelukes modified the fortress in the 14th century, and it gradually fell into disrepair.

The partially restored fortress, now known as Shobak Castle after its name in Arabic, lies in a still remote region along the highway that connects Amman to the Gulf of Aqaba. Visitors can see the remains of two churches from the Crusader period and large rocks used in unsuccessful efforts to attack the fortress with catapults. They also can see writings from the Quran carved in stone and a simple throne, both probably from the time of Saladin.

Medieval fortress ruins are not for everyone. But for anyone wanting to see a Crusader castle with an interesting history, Shobak Castle should be on the list.
