For some, the word party is taken just a little too literally. No one wants a bad situation; as a party host it’s a good idea to be conscious of how much liquor is being consumed by your guests. Even more important is to know what you are liable for should anything happen.

John D. Walls, of J.D. Walls and Associates, states that social host liability varies from state to state. “Indiana does have a statute that would impart liability on a social host in certain circumstances” says Walls. Walls says if a host serves alcohol to someone who is intoxicated, they can be held responsible for that person’s actions once they leave the home. In the case of an accident, a claim of negligence can be brought forth and a jury would decide liability. The best defense is to avoid any chance for trouble.

‘Tis the season: not only for making merry but also for fighting traffic, hosting ho-hum parties and celebrating with none other than family; the people we love, but don’t always love to be with. Knowing what to do when faced with those not-sopleasant situations can make for happier holiday memories. We’ve polled some local experts, and have the answers you need to make your holiday season shine.

A family falling-out divides your dinner table.

Hosting the holiday is one thing; doing so when the family is at odds is another. What’s the best way to maintain the peace at your next gathering?

“Think about how you might talk to family members ahead of time” says Dr. Donna Lazarick, a local psychologist.

Lazarick suggests letting relatives know in advance what you expect of them. Gently reminding your guests that the day is meant to be a joyous one may go a long way toward preventing an ugly outburst.

You can also prepare yourself.

Often times, says Lazarick, family upsets are about the same old thing. Your sister-in-law makes jabs about your parenting.

Think ahead about what you’ll do when such scenarios happen. Spend a moment planning the seating arrangements for the dinner table. Figure out how you’ll redirect the conversation should things become tense.

Your best response, says Betty Jo Trakimas, a Carmel-based etiquette consultant, is one with a little compassion.

“In our stress-filled society we all tend to walk around with our defenses on our shoulders” says Trakimas.

ing instead of reacting with anger. Trakimas urges everyone to be patient with their families. And if conflict arises, stay out of it. “Do not feed into a potentially volatile situation.”

You need gifts, and fast!

We’ve all been there: Just when you think you’re done shopping, you discover yet another distant relative will be at your holiday celebration.

Worse yet, finding a gift will be difficult as you know more about your neighbor’s dog than you do him. What’s your best last-minute shopping strategy?

Heather Pirowski, coowner of Lucky Lou in Carmel, suggests giving a gift that is personalized.

“Anything with their name [or initial] on it, like stationary or note cards, definitely makes a different and unique gift,” says Pirowski. A monogrammed gift shows you care

and can be done for just about anyone.

Another idea, adds Pirowski, is to “buy in multiples” when you shop. If you see something you like, buy an extra for those last-minute situations that almost always come up. Pirowski recommends staying away from seasonal items, “This way, if you don’t use it during the holidays, you can give it away later in the year, on another occasion.” With a few gifts such as candles, note cards or a bottle of wine stored away, you’ll always be ready for the last minute guest.

If you do find yourself empty-handed when receiving a gift, don’t sweat it, says Trakimis. Instead, be gracious. Look your giver straight in the eye and thank them. Sincerity (not fumbling around with lame explanations) is the key, says Trakimas. Later you can send a note or make a phone call to further express your gratitude.

It’s late but nobody’s leaving.

There’s nothing like a little holiday party to make your season sparkle. But when it’s over, it’s over; but not everyone gets this. How can you get guests to leave without being rude? “Be direct” says Lazarick; kindly let people know it’s time to go. Trakimas agrees, noting that many people just haven’t been taught proper etiquette. Both suggest a party host stand up, thank their guests for coming and suggest everyone get together again soon. That’s a message everybody will get.

While most divorce decrees specify custody arrangements for the holidays, ex-spouses aren’t always cooperative. How to proceed?

With care, says Trakimas. Parents need to be considerate of their children’s feelings. If your holiday schedule needs adjusting, try to work it out in advance, and do so without any yelling and screaming.

Walls concurs. “The key component to remember is that parental bickering is not helpful, nor is it appropriate for the children.” Be willing to compromise and your ex might be more accommodating. If communicating with an ex is impossible, Lazarick suggests utilizing a Parent Coordinator who can mediate difficult situations. If an ex repeatedly fails to follow the parenting time schedule, Walls notes that you may want to consider filing a request for a contempt hearing. Be kind, put your own grievances aside, and hopefully it will never come to that.

However you celebrate, have a strategy in place.

Doing so will make those not-so-merry moments that much brighter!

It is patented horse hockey that someone who has given more than the last eight years of her life to public service — a lot of it at the expense of family time, because she cares about parks and development — would be Hillaried by her peers (you know who you are), including her successor. Many have suggested, “It’s backroom Carmel politics.� Allow me to add: “at it’s most disgusting.� Shapiro, who is one smart cookie, is the embodiment of this: No good deed goes unpunished. from your husband’s, and then creating a new one unique to you and your kids. For example, we’ve kept my husband’s reading of “The Night Before Christmas” and my crazy way of tearing open presents. We haven’t figured out one just for us yet, but we’re dabbling with the idea of an annual FFHO (Forced Family Holiday Outing) to see “A Christmas Carol” or “The Polar Express.”

Now if you’re both being stubborn, immature crybabies (like I was as a newlywed), you can always alternate years that you practice certain traditions. One year he can pick the expensive Frasier fir, the next year you get the cheapo “Charlie Brown” white pine. That’s the only solution we’ve found that solves our ongoing tinsel debate.

Remember that just as your family will grow and change, so will your holiday traditions. And that’s OK. (I’m giving my kids two more years and then I expect some highquality Christmas Eve theater!). The important thing is being with your loved ones and making memories your children will cherish (and fight for) once they’re on their own.

KESTNER IS CARMEL’S MOST VALUABLE VOLUNTEER

I

have fond memories of taking the Worrell family to the Carmel Schwinn store to pick out new bikes so we could ride around Carmel together. It was like stepping back in time, as the proprietor of the local institution was also the person making sure I understood every detail about brakes, frame construction and dirt vs. road tires.

Little did I know at the time, that the man helping me load my shiny new bikes in the back of my mini-van would turn out to be one of the key people responsible for the luxury I feel lucky Jeff Worrell to enjoy called the CarmelCan! Monon Trail.

Last week, the Carmel Chamber of Commerce recognized Nick Kestner as the Most Valuable Volunteer in

our community at their annual awards luncheon. The MV2 award celebrates outstanding volunteer contributions in our community.

Nick Kestner’s celebraNick Kestner tion should last a very long time, because his list of accomplishments is extensive. A man known for avoiding the credit, he graciously accepted the award with all in attendance standing on their feet, hands vigorously clapping. True to his character, just 15 minutes after the luncheon concluded, he was back to volunteering, giving his expertise to a committee working on another project that citizens will appreciate, but most likely will never know Nick had a hand in guiding.

In the audience that day were not only his peers from the business community, but a crowd of Carmel Rotarians beaming with pride that one of their own was humbly accepting recognition long overdue. Last year’s winner, Ron Carter, a Carmel Rotarian himself,

properly showed his genuine admiration as he passed the traveling trophy to the 7th recipient to have his name engraved with honor.

Many groups and organizations have benefitted from the wisdom, time and energy of Nick Kestner. Although Nick will always point to others for the magnificent park system we enjoy today, he was on the founding board that got things started. He was president of the Central Park Building Corporation and helped start the movement promoting multi-use paths. In my opinion, his most famous legacy is the 10-person bike he built, seen annually in the July Fourth parade.

From his many simple efforts to the very complicated and visionary plans of action that he has implemented, the Kestner catalog of community gifts will never go out of print. I am thankful Nick Kestner made a difference in the place he calls home.

My husband’s Christmas was slightly different, which I quickly discovered the year we were married. Though I didn’t think it would bother me being away from my parents and sisters, by the end of Christmas Eve night, I was bawling in an upstairs bedroom and blaming the Wilsons for the worst Christmas ever. They’d done everything wrong!

Roast beef instead of turkey; chocolate peau-decrèmes instead of English Christmas fruit cake; no presents at all; and to my horror, no family skit! Just a stupid reading of “The Night Before Christmas” while everyone sipped pretentious brandy Alexanders.

The next morning? Even worse. Nobody arose until after 10 and the presents took five hours to open! What was the matter with these people? Who had I married? I want my mommy! (Unfortunately, that’s exactly how I acted too. So embarrassing!) If they hadn’t had a live tree with the Chernobyl lights just like the ones I’d grown up with, I’m certain we’d be divorced. (Of course, if I hadn’t birthed them four grandbabies, they may have never forgiven me!)

So how do you meld two beloved traditions into one that suits your own family? Very carefully, to be sure, and with as much understanding and patience as you can muster. It’s all about compromise. Try maintaining one thing from your past and one

stablishing holiday traditions is one of those frustrating processes that can often push the limits of marital compromise. Christmas in particular can be a nasty experience when both parties have different expectations of what the holiday should (and should not) entail.

For example, my family always celebrated Christmas Eve at our house with my father’s side, complete with gifts and a “show” put on by me and my sisters (Mom made us perform the nativity or sing carols when we were young, but Danielle eventually it evolved Wilson into each of us reenacting our favorite movie scenes, complete with costumes and musical scores. 1992’s “Silence of the Lambs” number has yet to be topped!) We had a live tree covered in silver tinsel and those enormous, fire-starting colored lights.

Christmas morning was just sheer chaos.

Five girls all unwrapping gifts simultaneously at 6:05 a.m. followed by the inevitable “She got prettier clothes”; “This doesn’t fit me!”; “I hate this dress!” (No wonder my parents dragged us to the early Mass — free wine!)

We loved it! Around noon we’d head to my grandmother’s house and celebrate with my mom’s side. More food, more presents, more booze. Priceless!

EX-TRUSTEE’S APPOINTMENT TO PARKS BOARD STIRS CONTROVERSY

Judy Hagan’s hiatus from government is turning out to be short-lived.

The former Clay Township trustee has been appointed to the Carmel/Clay Board of Parks & Recreation by her successor of one year, Trustee Doug Callahan. She supplants a stunned and saddened Sally Shapiro, an eight-year veteran who helped bring the $49 million Central Park to life, among other successes. Shapiro’s term expires Dec. 31, although she said she has ceased work on the board and on the Carmel Clay Planning Commission, of which she was a member for a year. That appointment was and is made from among parks board members.

It’s the way Shapiro was replaced as much as the move itself that has Carmel buzzing. Some have said the move resembles a chess match, with Shapiro in the role of a pawn.

Callahan says he turned to his predecessor, Hagan, a noted strong supporter of all parks initiatives. “This has nothing to do with Sally,” Callahan said. “As a matter of fact, I might consider putting Sally back on (the board) next year. I did talk to Judy to see if she was interested. She said she was. Judy is sharp. She

is very, very, very committed to the parks. ... I didn’t realize the planning commission seat came from the parks board, and I do feel bad about that.”

That Shapiro learned of her displacement through the grapevine has become a bone of contention to many, including incoming Carmel City Council Sally Shapiro woman Luci Snyder, who said, “It’s an insensitive thing to appoint someone before you have spoken to the person who would be replaced. ... For someone who donated eight years of inherently volunteer time – often until midnight – they deserve the courtesy of a phone call.”

Callahan since has spoken with Shapiro.

“Doug was extremely apologetic,” Shapiro said. “I just don’t think he understood his role.”

re-appointed to the parks board is appalling. I have seen several examples, over the years, of the insight and perspective that she brought to the parks board, and I always thought she asked just the sort of hard questions that a board member of a public body should ask,�

Sharp said. “Sally ... did not deserve being cast aside like an old shoe. It is hard enough to attract citizens willing to offer their time to city and township boards; such treatment of our current volunteers will make the job only harder.

If the planets align in just the right way, the $80 million Performing Arts Center under construction at Third Avenue Southwest and City Center Drive will become home to the leading collection of George and Ira Gershwin’s music and related memorabilia, as well as that of other noted composers.

Doris Anne Sadler of Indianapolis, executive director of the Michael Feinstein Foundation for the Preservation of the Great American Songbook, told Current in Carmel that discussions are ongoing between Carmel Mayor Jim Brainard, Feinstein and his partner Terrence Flannery, formerly of Indiana, and others to bring Feinstein’s Los Angeles-based collection here as the focal point of a museum and library in the PAC. Carmel is one of several cities under consideration by the foundation, Sadler said, preferring to not reveal the others.

Feinstein, 51, is a decorated singer, pianist and music revivalist. The Library of Congress elected him to the National Sound Recording Advisory Board, an organization dedicated to safeguarding America’s musical heritage.

“Michael has the largest collection of Gershwin and other composers ... certainly in this country,” Sadler said. “Michael worked for Ira as a young man, and he has collected original scores, autographed opening-night posters and other memorabilia, including movie reels.

He has wanted to preserve the collection for all Americans and make it available to children, generally, and young musicians who can be exposed to it and carry it on. That’s why the foundation was born.”

Brainard said his trip to New York two weeks ago was invigorating, adding, “Michael is clearly a genius. He is one of the most respected performers and anthropologists.

Brainard said the Feinstein foundation would utilize space at the PAC that has yet to be programmed, so there would be no cost to taxpayers to house the effort here.

Sadler sees a parallel reason why the collection would be a good fit. “It’s uniquely American and music easily understood by all people,” she said. “You don’t need to know the titles or the lyrics, and even if you’ve never heard it, it’s toe-tapping, very accessible to a lot of people and easily loved. It would attract a lot of people to a performing arts center. The other component is this: Michael has so many celebrities and performers who respect him.

He would put this Performing Arts Center and the foundation on the map.”

• A marked change in attitude, dress or habits It’s also vital to discuss with your “screenager” the importance of not participating in any online discussion that serves to demean or belittle others.

What may seem like a harmless action only serves to amplify the problem for the victim and encourages the instigator to continue.

From a technology standpoint, if you feel the need you can install a program that will track all of the activity that occurs on your child’s computer, including what others are sending them via instant messaging.

Firefox and Opera will support a new HTML tag specifically for embedding video in Web pages. WALKING FOR FITNESS: Run/Walk Club members, all of whom are fifth-graders, are using pedometers and logging their steps and miles to increase their physical fitness during this school year at Carmel Elementary School. The students meet after school on Tuesdays and Thursdays and head for a quarter-mile path that has been marked out on school property.

Members hope to log enough total miles this school year to equal walking across America.

With the dedication of Congregation Shaarey Tefilla on Dec. 9, Carmel now has its first synagogue, or shul.

This mitzvoth, or blessing, came during the Jewish month of miracles, coinciding with the celebration of Hanukkah, the so-called Festival of Lights.

Hanukkah, which this year was Dec. 5-12, celebrates a miracle during the rededication of the Second Temple in the second century B.C. Enough lamp oil for a single day burned for eight days. Jews today burn candles for eight nights of the holiday to commemorate the event.

So it was fitting that the miracle of the new temple, which replaces the congregation’s former home on Central Avenue in Indianapolis, took place this December. It’s equally appropriate that the congregation marked the occasion by presenting the city of Carmel with a large silver and brass menorah, or candelabra.

“Earlier this month, the mayor’s office called to inquire about purchasing a menorah for City Hall, and we decided to present one to the city that has welcomed us so warmly,” Rabbi Arnold Bienstock said.

Several hundred members of the congregation, many of whom live in Carmel, were on hand to witness the transfer of the sacred To-
