St. V to purchase 30 acre site

By Ann Marie Shambaugh AnnMarie@youarecurrent.com St. Vincent announced Sept. 28 that it plans to purchase 30 acres of land at W. 96th St. DEVELOPMENT and Spring Mill Road in Carmel, a site it eyed several months ago before dropping a rezoning proposal that was set to be heard by the Carmel Plan Commission.

The land is near the busy interchange of US-31 and I-465. The decision to purchase the land is tied to the hospital’s strategic vision to make health care more accessible for Hoosiers.

No decisions have been made regarding what will be done with the land.

“If St. Vincent makes a mission-driven decision to pursue development, we will bring plans forward and engage local and state officials, local businesses, area homeowners and other stakeholders in the process,” stated Dr. Joel Feldman, regional president of St. Vincent Indianapolis, in a press release.

St. Vincent plans to continue making improvements to its existing facilities, including St. Vincent Indianapolis on 86th Street.

Lawsuit alleges priest abused boy in 1982 in Carmel

A lawsuit was filed Sept. 20 in Hamilton County accusing a Catholic priest of sexually abusing a boy at Our Lady COURTS of Mt. Carmel Church in Carmel more than 35 years ago.

The lawsuit alleges that James J. Grear, a priest employed by the Roman Catholic Diocese of Lafayette at the time, sexually assaulted the plaintiff, now an adult male identified only as John Doe, in approximately 1982 at a Catholic youth rally at Our Lady of Mt. Carmel. It states that Grear’s current whereabouts are unknown.

A representative from Our Lady of Mt. Carmel said the local church has no comment and referred all questions to the diocese.

The diocese issued a statement to local media Sept. 27 addressing the matter.

“As of today, September 27, 2018, the Diocese of Lafayette-in-Indiana has not been formally served with notification of the lawsuit filed in Hamilton County regarding James Grear. Until the Diocese and its attor-

neys have been able to review the lawsuit, we are not in a position to comment on the elements of the suit,” it states.

The lawsuit states that the plaintiff returned to his hometown of Monterey, Ind., after the rally, where he attended confession at St. Ann Parish and told Bishop Raymond Gallagher about the incident. Gallagher died in 1991.

“At that time, Bishop Gallagher instructed John Doe to forget about the abuse, to ask God to forgive him, and not to disclose the abuse to anyone else,” the lawsuit states.

The lawsuit states that the diocese knew that Grear had sexually molested numerous children before the incident occurred. It describes Grear’s assignments as “suspect.”

It states he served at Ball State University, Brebeuf Preparatory School and in Phoenix before the alleged assault and that he served in New York City and Guam after it.

The lawsuit states that the plaintiff continues to incur expenses for medical and psychological treatment, therapy and counseling.

4 solar fields planned

By Ann Marie Shambaugh AnnMarie@youarecurrent.com The City of Carmel is planning to install four solar fields on municipal property in the next year or two ENVIRONMENT with the goals of helping the environment immediately and saving on energy costs in the long-term.

Solar panels are planned on top of the Veterans Way and Booth Tarkington parking garages, at the wastewater treatment plant at 106th Street and Gray Road and sanitary sewer pump station on Hazel Dell Parkway.

The solar panels at the parking garages would be built on a structure that could serve as a canopy and still allow cars to park on the top floor.

“Not only would it help provide power for city facilities, but we’re also very careful about making sure we get a good return on our investment in reduction in our electric bills,” Carmel Mayor Jim Brainard said.

The city estimates it will cost $3.2 million to install the 6,196 panels, which are

expected to save the city $7.5 million in energy costs in their lifetime. The panels are expected to provide energy to the sites where they are built and to adjacent buildings owned by the city.

City officials have been working with Carmel-based Telamon, which partners with business clients to increase efficiency and streamline operations, to plan the project.

Brainard said he expects to build solar panels on the city’s other garages in the future.

“All of our garages have the potential to do it,” he said.

Gabi Stigter may only be 15 years old, but she’s already making strides when it comes to giving back. Stigter, FUNDRAISER a sophomore at Carmel High School, has been named one of the champions for Best Buddies Indiana.

Stigter is competing against 11 other champions to be named the Best Buddies Champion of the Year, a title reserved for the person who raises the most awareness and funds. According to Stigter, the nextyoungest champion is a 20-something. The champion will be chosen Nov. 10 at the Best Buddies Indiana gala in Indianapolis.

Stigter’s passion for giving back to those with special needs spans a decade. When she was 5, she met Kevin Miller, a boy with Down syndrome. Miller is now a junior who attends Damar Services in Indianapolis.

“I was also in a special needs class when I was younger for hearing loss, so I grew up with people with intellectual and mental disabilities and always saw them as having a normal life, but as I grew older, I saw the isolation they had. The first round of Meet Your Neighbors sessions went so well that Carmel Interfaith Alliance FAITH President Jerry Zehr decided it was time to bring the series back.

The Carmel Interfaith Alliance is partnering with the Mayor’s Advisory CommisZehr sion on Human Relations to co-sponsor the Meet Your Neighbors forum. The free public sessions are held from 7 to 8:30 p.m. Thursday nights in the city council chambers room in City Hall, starting Oct. 4 with The Jewish Faith with Rabbi Dennis Sasso. Zehr, the pastor of Carmel Christian Church, will facilitate the sessions.

“We found we had such a great response from last year, we wanted another series and to give people an opportunity who didn’t get a chance to make all of them (last time) to come back and ask questions and learn more about the different faith traditions,” Zehr said.

Fishers Mayor Scott Fadness has seen his role change from a town manager to Fishers first elected mayor in 2014, HAND and with that came one important realization.

“Elected officials like to stay elected. It’s their singular obsession, that’s what I’ve learned,” Fadness said during Noblesvillebased HAND’s (Housing and Neighborhood Development) fourth annual suburban housing conference Sept. 21 at Cambria Hotel in Westfield. “They constantly contemplate, ‘How do I stay elected?’ If anyone thinks for one second that affordable housing was something popular with the masses that vote, that they wouldn’t do it, you are sorely mistaken. They all shy away from this particular conversation because it’s an ugly conversation for them.”

the forefront (with concern over their home value dropping),” Fadness said.

But Fadness said the conversation should be addressed in a broader sense that an integrated housing policy is necessary for the long-term sustainability of the community.

“We became more productive as a society when you have this serendipitous collection of people from different backgrounds,” Fadness said. “One of the things we talk about with our schools is we need to have diversity, and it always comes back to race.

I would argue in Hamilton County what is more ostracized from being a different race is being from a different socio-economic class.”

Shell Barger, a RE/MAX realtor in Carmel, knows how hard is to find affordable housing for buyers in Hamilton County.

“To qualify for a $175,000 home, bare minimum you have to make $45,000 income that means no car, no student loans, no debt,” Barger said. “So you make $50,000 with some debt, who are these people that make that? They’re our fire fighters, police officers, our public servants. You can qualify for $190,000 home. In Carmel, there are three on the market. It’s a seller’s market.”

Whitestown Town Manager Dax Norton is seeing similar issues in his community.

The town is in Boone County, an area where HAND recently extended its reach.

“Our redevelopment commission was asked to subsidize a bus to get workers from Marion County to Boone County to Whitestown specifically,” Norton said.

“We’ve given tax abatements to said company, millions of dollars. We’re proudly subsidizing some of the infrastructure that has been built to allow them be there. They said now they can’t find workers, would you go ahead and subsidize a bus to get the workers from Marion County to Whitestown? Are you serious? That was kind of our reaction.”

Carmel’s Shahid aims to empower as director of Women4Change Indiana

By Desiree Williams • news@currentincarmel.com Indiana received a D rating in the 2018 Status of Women in the States report conducted by the Institute for Women’s Policy Research. The grades are based COVER STORY on employment and earnings, political participation, poverty and opportunity, reproductive rights and health and well-being, among other factors.

Women4Change Indiana Executive Director Rima Shahid believes the Hoosier state can do much better.

“What can one do to be involved and to really help change? We think Indiana women deserve much better than a D,” the Carmel resident said.

Women4Change Indiana is a nonpartisan, nonprofit whose objective is to embolden women to be politically and civically involved in their communities. It was created after the 2016 presidential election when founders Rabbi Sandy Sasso and Jennifer Nelson Williams witnessed conflict and disrespect throughout the campaign cycle.

“There seemed to be so much unrest and incivility, and (the founders) knew when women came together, we could get things done,” said Alysa Villelli, W4CI communications and community coordinator.

Shahid said the organization’s mission requires everyone coming together to make a change.

“It’s more of a movement,” she said.

BUILDING A SISTERHOOD

Shahid grew up in Carmel and graduated from Cathedral High School in 2002. She began studying at IUPUI before moving to Bahrain to work and finish school.

Shahid spent 11 years in the Middle East with her husband and children, serving as the trade development officer and cultural attaché for the Pakistan Embassy. She facilitated trade between Pakistan and nations within the Gulf Cooperation Council as well as Western European countries.

Although Shahid said she had a phenomenal experience in Bahrain, she became ill and lost sight in her left eye. She returned to the U.S. four years ago and began working for the Muslim Alliance of Indiana.

Shahid then learned of a new women’s organization hosting its first meeting in 2016 and tried to attend, but the meeting was at capacity with more than 800 people.

She joined the original W4CI steering committees and task forces before assuming the executive director’s role in September 2017. During the past year, she focused on connecting with the community and building the organization’s network.

Shahid said the organization values civility, collaboration and the health, safety and dignity of all Hoosier women.

“That’s what being a women is, right? We partner together, we collaborate with one another and we uplift one another. That’s sisterhood,” she said.

PURSUING CHANGE

W4CI aims to empower women to engage in political and civil discourse by providing education, staffing tables at community events, joining coalitions, canvasing door-todoor, hosting panel discussions with legislators and working during legislative sessions, among other activities.

The nonprofit is focused on the November election by urging everyone to vote. Shahid said Indiana has the second-lowest voter turnout in the nation.

“Sometimes, it feels like your vote doesn’t matter, but there are so many reasons it does,” Villelli said. “We’ve seen local elections decided by such small margins.”

W4CI will host a reception Oct. 12 to celebrate women running in the election and another on Oct. 13 to discuss improving Indiana’s D rating in the Status of Women in the States report.

“This is my way of giving back to my home and my state and to lead (by) example for my children,” Shahid said.

“That’s what being a women is, right? We partner together, we collaborate with one another and we uplift one another.

On origins

Thanks to those who do the right thing

Commentary by Terry Anker We use them every day, these aphorisms. Old sayings and collective shorthand keep our conversations moving and meanings clear. Still, we so often forget from where they hail. We can use our favorite search engine to inquire as to the expression’s etymology, yet to rely blindly on a single entry can be foolish. We are required to surf from site to site seeking some intellectual satisfaction that each appearance is not a simple duplication of another.

The maxims themselves suffer from the same echo. Modern speakers will sample the words and concepts from earlier generations and co-opt them as their own, so the able-word historian will push back ever further looking for an accurate origin point. Many are found rooted in the Bible. Much of our collective literary and oratory memory commences there. But others can be directly or loosely traced to the earliest scrolls, clay tablets or hieroglyphs, leaving one to wonder if much of human thought has been consistent from our genesis.

It suggests, in part, that our thinking has been conscientiously, and unconscientiously, formed by all that we’ve heard or read – and perhaps by all that’s been heard or read by everyone that we’ve heard or read. Is the collection of human wisdom a thread rather than an evolution? Or, do we legitimately process information and ideas anew with each subsequent presentation to fresh generations?

Among the many adages with foggy attributions is an old favorite: Talk is cheap because supply exceeds demand. Perhaps it doesn’t matter who gets the acclaim as long as the concepts are urged to persist.

Hitting all the wrong notes Commentary by Danielle Wilson I learned something about myself this week, people: I am terrible at karaoke. I know! It came as a surprise HUMOR to me, too, but it turns out I only know the words to about seven songs, and anything by Cyndi Lauper is too high for my vocal range.

Granted, I have no vocal range, nor can I really sing. Usually, what I lack in talent I make up for in showmanship and pure enthusiasm. But this past Friday, while launching the new “Passing Period Karaoke” initiative in the social studies hallway where I teach (we are in a quasi-competition with science over which department is more fun), I learned even rock-solid rhythm and superb snapping can’t save someone from the embarrassment of belting out the wrong line or mumbling through a forgotten chorus as a throng of confused but highly entertained teens captures every moment

on social media.

Luckily, I wasn’t alone. Several other teachers, including younger, hipper ones, struggled to accurately sing along to Billy Joel, Neil Diamond and the Village People. We did a pretty good job with “My Girl” and the national anthem, but other than those we couldn’t find an appropriate song that everyone knew. Of course, later, as I rehashed my missed opportunity for internet fame, I came up with several that I would have nailed, including but not limited to, “Let It Go” from “Frozen,” and the Backstreet Boys’ “I Want It That Way.” Also, anything from “The Sound of Music,” though Broadway doesn’t generally play well with the under-20 crowds.

Editor, On my morning commute, I’ve started noticing a woman “of retirement age” who jogs with a bag to pick up litter along the way. I love this in so many different ways.

She’s intentionally bettering herself by staying fit and healthy as she ages while simultaneously bettering our community.

She’s consistent. She chugs along, doing what she does, despite the fact that inconsiderate people keep throwing trash along her path. I know everything I need to know about this woman’s character from seeing her a handful of times.

She has no idea I’m watching and it makes me wonder: Who is watching me?

I may stop someday and tell her. But for now, I just smile as I pass and let it serve as my reminder for the day that there are good people out there who do the right thing even when they think no one is watching.

Paying extra lip service Commentary by Dick Wolfsie In an article I recently read, no experts are quoted. There is no scientific polling, no international study referHUMOR enced. But the people from a well-known breath mint/gum company claim the average person spends 20,000 minutes in his or her lifetime kissing. Your smooching may vary, depending on whether you attend a lot of Greek weddings or have more than 15 grandchildren.

I’m not an overly competitive person, but I do believe in keeping up with Joneses, who, by the way, are our newlywed neighbors down the street. The Fettermans next door, married 40 years, might represent a more realistic goal for me.

I’d been doing OK until now, but I’m going to increase my output, so my obit can read: “Exceeded the standard kissing time by 2,000 minutes.” When it comes to lips, I can put two and two together.

When Mary Ellen came home the other night, I gave her the customary hello smooch, but I lingered a few seconds longer in the osculation. Osculation is the scientific term for kissing. Don’t use that word during romantic encounters. It’ll have a negative

impact on your lifetime total.

My wife became instantly aware that I had breached the unwritten rule for time spent on the customary, “Hi, honey, I’m home” kiss.

“What was that all about?” she asked.

“You were lingering on my cheek. You do know it’s only Thursday?”

It’s bad enough I’m newly obsessed with maintaining a respectable record in the puckering department, but apparently a slew of other situations exist when my breath should be pristine.

Now, there’s something to chew on. Which is exactly what the gum company says: “Hey, we sell something to chew on.”

In order for my wife and me to someday surpass the national average, I’m going to need her full cooperation. Last night, I told Mary Ellen how beautiful she is and how great dinner was, but I still don’t think I have a chance of reaching that 20,000 mark.

Apparently, kissing up doesn’t count.

Swim school starts with survival

By Maria Cook news@currentincarmel.com British Swim School, with locations throughout the United States, recently opened in Carmel. The NOW OPEN school is the first in Indiana and marks the company’s expansion into its 21st state.

British Swim School offers water survival instruction and learn-to-swim programs at two pools in Carmel.

“We’ve partnered with Residents Inn and the Spring Hill Suites in Carmel,” said Katie Blair, who runs the Carmel British Swim School franchise with her husband, Greg.

“The hotels share a parking lot. It’s another way that we’re able to keep our classes small and not overload one single location.

We partner with existing and underutilized pools, so it becomes a real win-win for everyone.”

British Swim School derives its name from its CEO, Rita Goldberg, a former competitive swimmer who developed British Swim School’s safety program in Manchester, England, in 1981. British Swim School focuses on teaching water survival skills without the use of swim aids before teach-

“Once we feel that a child has progressed through the program to where they are safer in the water, then we move them into our learn-to-swim program,” Blair said. “First and foremost, we want them to be comfortable rolling over and holding a back float. If you’re in the water, your back is the safest place to be. For our survival lessons, we do not allow goggles. Often, if a person were to fall in the water, their goggles may fill up with water, or they may not have goggles.”

Bootleggers’ Bash to benefit LLS

By Rick Morwick rick@youarecurrent.com When Mike Hoy won a courageous battle against leukemia a decade ago, his grateful brother and sister-inFUNDRAISER law — Brett and Hollie Hoy — wanted to do something to give back to the fight against blood cancers.

So in 2014, the Carmel residents created the Bootleggers’ Bash, an annual benefit for The Light the Night Walk, the chief fundraiser for the Leukemia & Lymphoma Society. The LLS’s mission is to find cures for leukemia, lymphoma, Hodgkin’s disease and myeloma and improve the quality of life for patients and their families.

“The LSS is near to our hearts for various reasons, one of which is our brother, Mike Hoy,” Hollie said. “He has been cancer-free for 10 years now, which is incredible.”

Featuring live music, food, dancing, gaming tables, silent auction, raffles and a costume contest, the fifth annual Bootleggers’ Bash will be from 7 to 11 p.m. Oct. 12 at the Columbia Club, 121 Monument Circle in Indianapolis.

Last year’s Bootlegger’s Bash raised nearly $30,000 for the LLS. Organizers are confident of exceeding that total this year.

“We are on board to raise more than $50,000 and we are well on our way,” Hollie said.

Heartland Film Festival features executive producer Pauszek’s documentary ‘Grateful’

By Renee Larr editorial@youarecurrent.com “Grateful” is a 17-minute documentary that tells the story of Jenni Berebitsky, who is battling ALS. She was diin March 2009 and was FILM agnosed given 18 to 24 months to live. The film explores her passion for living in the face of insurmountable odds.

The film was screened in July at the Indy Shorts International Film Festival Presented by Heartland International Film Festival. The documentary won the Audience Choice Award presented by Indiana Spotlight.

“That’s the most prestigious award because it tells the film industry that our film was chosen by the audience,” said Executive Producer/Producer Amy Pauszek, whose Where’s Amy photo column appears in Current publications.

The film was screened at the Sept. 27-29 Circle City Film Festival.

“Jenni’s story will warm your heart while teaching us to live an engaging, productive and meaningful life,” Pauszek said.

“I promise you will leave this film with tears of love, hope, inspiration and laughter. It’s uplifting and will change your outlook on life and those you love.”

“Grateful” also will be shown in the Indy Shorts Winners Program No. 1 at the Oct. 11-21 Heartland International Film Festival.

“We’re so excited because it’s such a prestigious festival to be in,” Pauszek said. “‘Grateful’ is a must-see film for everyone at the 2018 Heartland International Film Festival.”

Pauszek, a Geist resident, plans to submit the film to additional film festivals.

“We’ve sent it off to others and we’re hoping to get into more,” she said. “People really love it. This film will help anyone who has experienced ALS or any type of life-threatening illness. It shows there is hope, and through family and friends anybody can get through these obstacles.”

CHS seniors direct one-act plays

Carmel High School senior Allie Crawford wants to pursue a bachelor of fine arts degree in THEATER acting in college.

She figures serving offstage as a student director for the short play “The Philadelphia” will provide great experience.

Crawford “I really love the opportunity to expand my knowledge to put on a production by getting this new perspective,” Crawford said.

Her play is one of four student-directed, one-act plays. The Studio One-Acts will be performed in the school’s Studio Theater at 7 p.m. Oct. 4, 5 and 6.

“It’s the story of two guys going out to eat in New York City and one of them finds out every time he asks for something he gets the opposite of what he asks for,” Crawford said.

Crawford previously was the assistant director on “Peter and the Starcatcher,” the school’s play in February.

“I knew it would be a huge responsibility going in, but fulfilling those responsibilities is challenging and rewarding,” Crawford said. “It’s a lot of moving pieces, promoting the show, coordinating the technical elements, actors, technicians and rehearsal schedules.”

Brianna Ferracciolo is another of the senior directors.

“They are all comedic stories that are guaranteed Ferracciolo to make the audience laugh and smile in their brief hilarity,” Ferracciolo said. “The one act that I am directing is called ‘Mary Just Broke Up with This Guy,’ and it’s about a woman named Mary who goes on a series of hilarious and strange blind dates.”

The cast members are Maddie Nagel, who plays Mary, and Austin Audia, who switches characters rapidly and portrays 24 different blind dates.

“It’s been an incredible experience so far,” Ferracciolo said of directing.

The other student directors are Jenna MacNulty, “Master of Puppets,” and Austin Roberts, “The Matterhorn.”

What to get: Fish tacos Price: $8 Anna’s take: MashCraft Fishers is a relatively new brewery that opened in winter 2017. It also has locations in Greenwood and downtown Indianapolis, but the Fishers location is the first to feature a full menu. The menu is created by 5280 Bistro, a popular food truck in Fishers. I kicked off my experience by tasting the Bavarian Style Soft Pretzel paired with MashCraft’s own garlic beer cheese, or queso blanco. The pretzel was doughy, buttery, dusted with salt and, because of its size, easily shareable. For my main course, I opted for the fish tacos: two soft corn tortillas filled with grilled and blackened whitefish with a crunchy slaw. A spicy poblano crema is drizzled on top along with a healthy serving of cilantro. Combined

Cordoba’s historic synagogue Commentary by Don Knebel Cordoba’s Jewish Quarter includes a synagogue reflecting the turbulent religious history of medieval Spain.

TRAVEL After Muslim invaders from North Africa captured southern Spain from the Christian Visigoths in 711 A.D., they made Cordoba the capital of a new Islamic state. With the encouragement of the rulers, Cordoba became a center of learning and commerce, attracting Jews from all across Christian Europe. By the 10th century, Cordoba, with a population of about 500,000, was the largest city in the world, with running water and lighted streets. In about 1160, a strict Muslim sect conquered Cordoba and threatened its Jews with death if they did not convert to Islam, signaling the beginning of Cordoba’s decline and the end of the socalled “golden age of Judaism.”

In 1236, Christian forces under Ferdinand III of Castile reconquered Cordoba and gave its remaining Jewish residents the right to build a synagogue, which they did. When Cordoba’s bishop complained that the new synagogue rivaled his cathedral in size,

Pope Innocent IV had it demolished. In 1315, residents built a much more modest synagogue near where Moses Maimonides, the great Jewish philosopher, was born in 1135.

The interior of the synagogue was decorated in the Mudéjar style developed under Islamic rule and featured an ornate balcony reserved for women.

After Ferdinand and Isabella expelled all the Jews from Spain in 1492, the synagogue was used as a hospital and later became a chapel used by the local shoemakers’ guild.

In 1884, after inscriptions from the Book of Psalms were found on walls throughout the building, it was restored to close to its original appearance and maintained as a national monument. Today, the Cordoba Synagogue, which retains some evidence of its use as a chapel, is one of Cordoba’s most popular destinations. A statue of a seated Maimonides is nearby.

‘I before E except after C’ is a big, fat lie Commentary by Curtis Honeycutt Pluto isn’t a planet. There’s a fifth ocean. Davy Crockett didn’t die defending the Alamo; he was captured and later executed. At least, we think so. Our GRAMMAR GUY entire education was a lie!

Before we all get overdramatic and say stuff we don’t really mean, let’s just acknowledge that textbooks don’t always get things right. In fact, textbooks were kind of a new thing in the mid-1800s when the convenient rhyme “I before E except after C” gained popularity.

Too bad this mnemonic device is wildly incorrect.

The full rhyme states, “I before E, except after C — or when sounded like A as in ‘neighbor’ and ‘weigh.’”

But what about those foreign atheists who routinely seize caffeinated heifers? It doesn’t take an Einstein to figure out this rule is just plain weird. I’m not going to leave your education in a heap of rubble; instead, I’m going to make it more complicated and rebuild it (and then remind you there are always exceptions to the rule).

Here’s a new rule for you that will handle most of your spelling conundrums: Use I before E (believe, priest, thief) except when C is followed by L, P, T or V (receipt, conceive, ceiling), or when sounded like “A” as in weight or “I” as in height (neighbor, sleigh, heist, height), or when a prefix or suffix implies E-I (reiterate, deionize, canoeing).

Phew.

Unfortunately, even this long rule still has exceptions, like either, forfeit, sovereign and reveille. Still, the rule I outline above works 99 percent of the time.

Gen. Douglas MacArthur famously said, “Rules are mostly made to be broken and are too often for the lazy to hide behind.” We won’t judge the general too harshly for ending his sentence in a preposition; instead, we’ll just consider how his quote (if true even some of the time) makes English spelling and grammar so tricky.

The only way to know how to spell all these words correctly is to memorize them. I recommend investing in a nice set of flashcards; you can study them during your leisure time.

ORDINANCE NO. D-2430-18 VERSION B AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADDING SECTION 6-83 TO CHAPTER 6, ARTICLE 4 OF THE CARMEL CITY CODE Synopsis: Prohibits camping in a vehicle on public property in the City of Carmel.

WHEREAS, the City of Carmel, Indiana (“City”), pursuant to Indiana Code § 36-8-2-4 and its general police powers, has the power and authority to regulate conduct, use, and possession of property that might endanger the public health, safety, or welfare; WHEREAS, camping in a vehicle on public property increases the potential for damage to public property as well as the danger to public health, safety, and welfare ; and WHEREAS, prohibiting camping in a vehicle on public property is necessary and appropriate in order to protect the public health, safety, and welfare.

NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference.

Section 2. The Following should be and the same is hereby adopted and shall be codified as Chapter 6, Article 4, Section 6-83 of the Carmel City Code, to wit: Ҥ 6 Р83 Restrictions on camping in a vehicle on public property (a) Definitions.

1. “Vehicle” shall mean a device in, upon, or by which a person or property is, or may be, transported or drawn upon a highway or street.

2. “Public Property” shall not include Central Park, Founders Park, Hazel Landing Park, Lawrence W. Inlow Park, Meadowlark Park, River Heritage Park, Vera J. Hinshaw Nature Preserve and Park, and West Park, as long as these parks are under the permitting control of Carmel Clay Parks and Recreation.

3. “Vehicular Camping” shall mean the use of a Vehicle as a residence or dwelling for the purpose of living therein, as evidenced by, but not limited to: sleeping, eating food, storing personal belongings and/or changing clothes in the vehicle and/or by the length of time an individual occupies the vehicle when it is stationary, excluding time spent in a vehicle as a condition of an individual’s employment or in order to perform repairs or maintenance tasks on the vehicle. Any determination of Vehicular Camping must be made by assessing the totality of the circumstances. (b) Prohibition.

1. Vehicular Camping, as defined in subsection (a), at the Center for the Performing Arts without a valid permit issued by the Center for the Performing Arts Board of Directors (“Arts Board”) is prohibited.

2. Vehicular Camping, as defined in subsection (a), in the public right-of-way that borders a residential property without a valid permit issued by the Department of Engineering (“Department”) is prohibited.

3. Vehicular Camping, as defined in subsection (a), on any other Public Property located within the City’s corporate limits without a valid permit issued by the Carmel Board of Public Works (“BPW”) is prohibited.

4. If a valid permit is obtained, Vehicular Camping shall not be conducted within the City’s corporate limits in a location or manner that interferes with or impedes the regular flow of vehicular or pedestrian traffic. (c) Permits.

1. Any person may petition the Arts Board for a permit to conduct Vehicular Camping at the Center for the Performing Arts. i.

The Arts Board may issue a permit only when the permit furthers the mission of the Center for the Performing Arts. ii.

Any permit issued by the Arts Board under this Section shall expire after a specific period of time, not to exceed ten (10) calendar days. The Arts Board may grant one (1) permit extension, not to exceed ten (10) calendar days in length. iii.

The Arts Board may, in its sole discretion, place such lawful terms and conditions upon the use of any permit issued by the Arts Board under this Section as it deems appropriate.

The Arts Board may revoke any permit issued by the Arts Board under this Section at any time if it determines, in its sole discretion, that the need for the permit has ended or the permit holder fails to comply with any of the terms or conditions of the permit.

2. A resident of the City may petition the Department for a permit to allow Vehicular Camping in the public right-of-way that borders the property where the resident lawfully resides. i.

The permit may not be obtained for the purpose of monetary gain. ii.

Any permit issued by the Department under this Section does not supersede any limitations or restrictions as prescribed by a Homeowners Association’s restrictions and covenants and shall expire after a specific period of time, not to exceed seven (7) calendar days. The Department may grant one (1) permit extension, not to exceed seven (7) calendar days in length. iii.

The Department may, in its sole discretion, place such lawful terms and conditions upon the use of any permit issued by the Department under this Section as it deems appropriate. iv.

The Department may revoke any permit issued by the Department under this Section at any time if it determines, in its sole discretion, that the need for the permit has ended or the permit holder fails to comply with any of the terms or conditions of the permit.

3. A resident of the City may petition the BPW and the BPW may issue a permit allowing Vehicular Camping on Public Property when a specified emergency creates the need for such an accommodation. i.

A permit may be issued by the BPW when the emergency creating the need results from an act of nature, a technological failure or malfunction, a terrorist incident, a public health emergency, an industrial accident, a hazardous material accident, or destruction caused by a civil disturbance. ii.

Any permit issued by the BPW under this Section shall expire after a specific period of time, not to exceed thirty (30) calendar days. The BPW may grant one (1) permit extension, not to exceed thirty (30) calendar days in length. iii.

The BPW may, in its sole discretion, place such lawful terms and conditions upon the use of any permit issued by the BPW under this Section as it deems appropriate. iv.

The BPW may revoke any permit issued by the BPW under this Section at any time if it determines, in its sole discretion, that the need for the permit has ended or the permit holder fails to comply with any of the terms or conditions of the permit. (d) Fine. Any person who violates provision (b) of this Section shall be guilty of an ordinance violation punishable by a fine of Fifty Dollars ($50.00) for each violation, each day constituting a new offense.”

The following subsections of Carmel City Code Section 6-158 are hereby amended and shall read as follows: (a) No person shall play, within the City’s corporate limits, use or operate any machine, motor vehicle, device, or thing that produces or reproduces sound if the sound therefrom generated made, caused or otherwise emitted is: (1) Audible 50 feet or more from its Stationary Noise Source; or (2) At a level that exceeds that permitted on the chart below for a period of five minutes or more within any 15 minute period of time, when measured on a dB(A) scale from a distance of not less than 50 feet from its Stationary Noise Source; or (3) At a level of more than 70 decibels for any period of time, when measured on a dB(A) scale from a distance of not less than 50 feet from its Stationary Noise Source; and (4) If any of the aforementioned violations occur upon private property, the Stationary Noise Source must be audible from, or measured at, the property line of said private property, or if the Stationary Noise Source is located within an apartment complex or other shared-wall condominium/townhouse styled private residential structure, the Stationary Noise Source must be heard from, or measured at, the shared boundary between the residential units.

(b)The following are exempted from the provisions of this section: (1) Sounds emitted from authorized emergency vehicles.

(2) Lawn mowers, leaf blowers, weed trimmers, garden tractors, and power tools, when properly muffled, between the hours of 7:00 a.m. and 10:00 p.m. only.

(3) Burglar alarms and other warning devices when properly installed, providing the cause for such alarm or warning device sound is investigated and turned off within a reasonable period of time.

(4) Events authorized by the Board of Public Works in writing, including but not limited to, parades, festivals, carnivals, fairs, concert performances, band and drum corps performances, artistic performances, as well as any rehearsals for the same. .

(5) Attendant noise connected with the actual performance of athletic or sporting events and practices related thereto.

The emission of sound for the purposes of alerting persons to the existence of an emergency, or for the performance of emergency construction, repair or other work.

(7) Sounds associated with the use of legal consumer fireworks during the following days and times: a. Between the hours of 5:00 p.m. and two hours after sunset on June 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7, July 8 and July 9; b. Between the hours of 10:00 a.m. and 12:00 midnight on July 4; c. Between the hours of 10:00 a.m. on December 31 and 1:00 a.m. on January 1.

(8) Sounds associated with the use of the Carmel Police Department Firing Range.

(9) Sounds associated with the normal conduct of legally established non-transient businesses, organizations and governmental entities, when such sounds are customary, incidental and within the normal range appropriate for such use.

(10) Rubbish collection utilizing any mechanical equipment between the hours of 6:00 a.m. and 9:00 p.m. only.

(11) Subject to the other provisions of this section, and any other applicable law, rule or regulation, those sounds associated with motor vehicles lawfully operating on City streets. This does not include music or other sounds associated with a vehicle’s sound system, including portable devices capable of emanating sounds that may be located within the vehicle.

(12) Sounds associated with equipment or animals lawfully utilized by handicapped persons to accommodate their handicap.

(13) Sounds associated with the operation of aircraft or snow removal equipment.

(14) Sounds associated with church and temple bells and chimes, and with mosque minarets.

(15) Sounds associated with building construction between the hours of 7:00 a.m. and 9:00 p.m. only, as well as, and to the extent that, such construction is necessitated at other times due to a bona fide «emergency», as that term is defined in I. C., 36-1-2-4.5, as the same may be amended from time to time. Music is not considered a valid construction noise.

(16) Sounds associated with public speaking, public assembly, or other activities conducted on any public space or public right-of-way pursuant to constitutional or other lawful authority and assembly between the hours of 9:00 a.m. and 5:00 p.m.

(17) Reserved. (c) No person shall keep any animal which, by causing frequent or long-continuing noise that is audible 50 feet or more from its source when the animal is on public property or 50 feet or more outside of a private property line when the animal is on private property, does disturb the comfort or repose of any other person. (d) Any person who violates the provisions of this section shall be guilty of an ordinance violation, punishable by a fine of not more than: (1) First offense: Up to $250; (2) Second offense: Up to $1,000; (3) Third and subsequent offenses: Up to $2,500. (e) Citations for violation of this section may be issued by any sworn member of the Carmel Metropolitan Police Department and, additionally, in or on Carmel Clay Schools property only, by any sworn

special police officer appointed under I.C., 36-8-3-7 to serve the Carmel Clay Schools. (f) For purposes of this section, the following definitions shall apply: Ambient noise level. The A-weighted sound pressure level of all the encompassing noise associated with a given environment, being usually a composite of sounds from many sources. If possible, ambient noise level shall be measured at the same location as the measurement taken of the alleged offending noise source. If the alleged offending noise source is continuous and cannot reasonably be discontinued or stopped for the time necessary to measure the ambient noise level, the ambient noise level shall be determined by traveling away from the noise source to a point where at a steady decibel reading can be achieved and that is at least four feet from any wall or similar reflecting surface. If this is not reasonably possible, the noise level measured while the alleged offending noise source is in operation shall be compared directly to the noise level standards set forth in this section.

Stationary Noise Source. Any sound amplifying equipment and any other object, motor vehicle, facility, and/or source, whether fixed or movable, that is capable of emitting audible sound.

Section 3. The remaining provisions of Carmel City Code Sections 6-158 are not affected by this Ordinance and shall remain in full force and effect.

Section 4. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance, such repeal to have prospective effect only. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted.

Section 5. If any portion of this Ordinance is for any reason declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.

Section 6. This Ordinance shall be in full force and effect from and after the date of its passage and signing by the Mayor and such publication as required by law.
