Farewell everyone... we’ve seen a lot of changes

A

fter 29 years with SELECT and 14 as MD, this is my last Comment piece for CABLEtalk.

It’s been a long shift and a bit of a roller coaster, but overall a great ride and an enjoyable one at that.

I think all of us, Members and staff, have achieved a great deal over the years. Our association has grown considerably and Newell at his SELECT desk in the 1990s

SELECT is currently the ninth largest UK trade association by net assets, which provides a rock solid base for a vibrant and sustainable future for the organisation.

With almost 1,250 registered contractors, SELECT membership is now at a level that demands the attention of policy makers, and we are regularly consulted by a range of public and private organisations for our opinion on important industry matters.

We have delivered a lot for the Scottish electrotechnical industry. Space is too short to list all our achievements, but

I will, of course, be incredibly sad to leave SELECT, but it is time for a fresh pair of eyes to take our wonderful association to the next level. That job falls to SELECT’s new managing director, Darrell Matthews, and he has a great platform to start from.

Hopefully, Members will agree that the SELECT team has delivered excellent value for them over the years, and I am personally very proud of being able to hand over the association in much better shape than when I took on

the role. That may be down more to good fortune and hard work than talent, but I am nonetheless pleased to have been a sound custodian.

I am certain that with our great staff in place, a trusting and supportive membership, and under the new leadership of Darrell, SELECT will flourish and continue to deliver excellent service and value for the Scottish electrical industry.

So farewell and very best wishes to all SELECT Members and staff for a long, successful and exciting future.

Due to an increased demand, we are currently upgrading and adding to our test board simulators, which provide a realistic hands-on inspection and test facility for

candidates attending our SQAapproved training courses.

The simulators allow the practical assessment of individual candidates on a range of courses, including the Design and Verification of Electrical Installations, Initial Verification and Periodic Inspection and Testing of Electrical Installations.

olfers at the this year’s President’s Cup were fortunate enough to enjoy some great weather as well as 18 holes of golf round Dunblane.

The sunshine also contributed to some good scoring with outgoing SELECT MD, Newell McGuiness, carding 40 Stableford points. (A meeting of the handicap committee is reviewing Newell’s current handicap of 12).

The event was won by the East of Scotland team, ably skippered by

Graham Skinner. The day was also marked by a hole-in-one on the par 3 14th hole by George Rodgerson from PoweredUp365 Limited in Elderslie.

SELECT has responded to a recent consultation paper on Landlord Registration issued by the Scottish Government.

One of the paper’s key areas relates to a proposal to expand the ‘prescribed information’ that landlords have to provide when letting a house.

Among other things, the consultation proposes that landlords provide information that “a property meets the specific requirements relating to gas, electrical and carbon monoxide safety”.

SELECT has responded by stating that landlords should be required to submit written evidence that they have had electrical inspection and testing undertaken, and that fire, smoke and carbon monoxide alarms are fitted and operational.

GDPR templates are now available SELECT has compiled a suite of helpful General Data Protection Regulations (GDPR) templates that are now available in the Member Section of the SELECT website.

GDPR is a set of data protection legislation that replaces the old Data Protection Act 1998.

It governs how companies anywhere in the world deal with the personal data of EU citizens.

UK companies of all size who handle personal data of any sort must abide by this legislation now and after Brexit.

The legislation will be UK law whether we’re in the EU or not.

Giorgia picks up baton from Evelyne at AIE The European Association for Electrical Contractors (AIE) has a new General Secretary after Giorgia Concas took over the hotseat from Evelyne Schellekens.

Giorgia – former Senior Policy Advisor at SolarPower Europe – said: “AIE has more than 60 years of experience bringing together electrical contractors and representing their needs to ensure safe and quality electrical installations across Europe.

“I will work to bring even more visibility to the importance of electrical contractors for the European economy, in the electricity and building sectors.”

Evelyne, who was General Secretary for almost 20 years, said: “It has been a Giorgia Concas great honour and pleasure to serve the interests of both the AIE and electrical contractors.”

The AIE represents the interests of electrical contractors from 15 different countries, exchanging information and informing policy makers to ensure safe and efficient installation in Europe.

Thomas Carlsson, AIE President, added: “AIE has been an important voice for electrical contractors to make sure they have all the tools they need to bring electricity to all of us.

“Representing over 1.2 million jobs and 125,500 companies, AIE and electrical contractors really are at the heart of Europe’s electricity system.”

New campaign on asbestos danger

he Institution of Occupational Safety and Health (IOSH) has announced the fourth phase of its campaign to raise awareness of occupational cancer, focusing on diseases attributed to asbestos exposure.

As the world’s leading professional body for those responsible for safety and health in the workplace, IOSH launched its No Time to Lose campaign in November 2014. Its aim was to make the causes of occupational cancer more widely understood and help businesses take action.

The new focus on asbestos follows previous campaigns on diesel engine fumes, solar radiation and silica dust.

IOSH is now aiming to tackle cancer caused by asbestos by providing

businesses with free practical resources to help them take action.

s CABLEtalk went to press, Members were warming up and pulling on their walking boots for the first President’s Walk in aid of the Electrical Industries Charity.

SELECT President Kevin Griffin organised the six-mile trek on Saturday 2 June as part of his drive to support the industry’s own charity.

He said: “The EIC is very dear to my heart. It carries out extremely important work and helps with a whole range of

problems, both financial and emotional.

We’ve been raising awareness of its work within SELECT, and Members have been very generous so far. The President’s Walk is another way to help raise much-needed funds.”

The walk around the Pentland Hills outside Edinburgh was expected to take four hours, with Members’ dogs and families also welcomed.

Kevin added: “The EIC is a great charity that’s well worth supporting.

NEWS MEMBERS Apprentice Lee is a bright spark AKD first year apprentice Lee Simpson has been voted Student of the Year for Electrical Installation by Edinburgh College.

AKD Managing Director Keith Groom said: “Lee joined the AKD family back in October 2016 when another contractor had to let him go due to a downturn in work. Unfortunately, this meant that Lee just missed the college intake for that year, and I know this initial disappointment has driven him on to make sure he impresses. His SECTT reports have been some of the best I’ve ever seen.”

Sean Mossman, the college’s curriculum leader for Electrical Installation, said: “Lee has been an outstanding apprentice. His work has been of a consistently high standard and his enthusiasm is fantastic.”

Lee, who attends Sighthill Campus, will be presented with his prize, including new tools, at a special awards ceremony in June.

Double success for NES in business of the year awards

ES (North Electrical Services) Ltd has scored a double success at the Scottish SME Business Awards. The SELECT Member firm, which has bases in Inverness and Elgin, was shortlisted after a public vote for Business of the Year for firms with under 100 staff.

the national title for the category. NES Managing Director Kenny Duncan said: “We are thrilled to have won against such strong competition. We are still a young company and being recognised nationally is a great reward for our staff.”

The company has more than quadrupled its permanent workforce to 60 since setting up in 2012 and is now targeting another four-fold increase and a move into the central belt.

It also plans to recruit four new apprentices this year, bringing its total number to 17.

Its services include industrial and commercial electrical installation and maintenance works, control and instrumentation, electric motor repair, overhaul and rewinding for clients.

So...is the tail wagging the dog?

A

s this edition of CABLEtalk goes to print, we are awaiting a response to our proposal to the Scottish Government that they introduce Protection of Title for electricians. What could be simpler, you may ask? To be able call yourself an electrician would require you to hold suitable qualifications. What a groundbreaking thought!

But, there are some organisations out there who don’t agree that regulation is needed. Their view seems to be that there aren’t enough people being injured or worse by poor or unsafe work to introduce something as simple as Protection of Title. But who do these bodies represent? They don’t have members, so they can’t be reflecting member views. Have they asked their ‘customers’ what they want?

It is so disappointing to write that despite the views of Scotland’s largest

The tail wagging the dog indeed! I just hope that the Minister responsible for taking the final decision, Keith Brown, has the courage to make the right decision that will impact so positively on the public at large.

A recent business trip to London also reminded me that all too often it’s the minority who seem to carry more weight with government than the majority.

I was part of a delegation from the Specialist Engineering Contractors’ Group (SECG) who met representatives of the Department for Business, Energy & Industrial Strategy to discuss the

outcome of their recent consultation on dealing with retention payments. The consultation had posed three options to deal with the abuse of the current retentions system: ●●Do nothing ●●Promote greater awareness of existing statutory requirements to improve communication of the timing and amount of retentions ●●Create a retention deposit scheme to protect cash retentions (the SECG’s preferred option).

During the consultation, a number of responders had suggested another alternative – outlawing retentions altogether. With the Carillion crisis still fresh in everyone’s mind, it was astonishing to see how officials were trying to justify doing nothing just because a small selection of main contractors had complained that removing retentions would impact on their cashflow and profitability.

Rudi Klein, the SECG CEO, posed the very valid question: “Who does the retention money belong too?” It’s not the main contractors; it belongs to the firm it’s being withheld from.

So while we continue to work hard and hope for the best, it is so frustrating to see governments of all colours and their officials often take the easy way out and do nothing. We have become a reactive nation, only changing things after a crisis has happened, seldom looking to take pre-emptive action to stop events happening in the first place.

All of us could list so many incidents that could have been prevented if action had been taken sooner.

Let’s hope that on the issue of regulating the industry, the Scottish Government takes pre-emptive action and makes all our lives a little bit safer.

By Iain Mason Hello Susan. How did you get started as an electrician?

After leaving school, I worked with horses, but soon realised there wasn’t much money in it. I had a few office jobs, then went travelling to Israel, where I worked on a kibbutz, which was lovely.

When I came back, I asked Dad for a job, thinking he’d just stick me in the office.

Instead, he said: “If you want to work for me, you’ve got to go on the tools and learn to be an electrician. That way, you can eventually take over and know exactly what you’re doing.” I’d worked with him when I was younger for a few months and enjoyed it, but my heart was set on other things back then. But being a bit older, it made perfect sense.

What sort of training did you have?

I did a City & Guilds home study course, which meant poring over books and watching a lot of videos. Because I was working while I was learning, Dad gave me lots of pointers, so I got the most fantastic on-the-job training. Compared to just going through college, the amount of knowledge I had by the end of my training was great; I was actually out there doing it.

Did you struggle with anything to start with?

I didn’t find the maths and physics parts very interesting – I just loved the practical stuff. I’d always been pretty good with my hands and picking things up quickly; you only have to show me things once and I can usually do them fairly well.

So how is it working with your dad?

Any arguments?

No, not really, I’ve always got on very well with him and we have a great working relationship. It’s helped that it’s not always just him and me. We had five electricians working for us when I started, so I’ve learnt from a lot of different people who were all good in their own right.

What was the first big job you did?

That would be the old Norfolkline refrigerated transport in Larkhall, where we installed a big chill and offices. We 16

“Dad and I have a great working relationship...he’s seen so much, he’s the first port of call if I ever get really stumped” were running in a lot of big armoured cables for lights, small power and industrial power, and because it was in a chill, everything had to be waterproofed.

We’ve also done a lot of work in quarries, so I’ve covered industrial, commercial and domestic. That’s probably the best thing about working with Dad – we’ve done every aspect of electrical work.

Whatever the situation, going to any kind of job, finding the fault and fixing it is very rewarding.

And what’s the worst part of the job?

Working outside when the weather is bad. It’s not much fun putting lights up or pulling heavy cables in the rain. But saying that, I always like a challenge!

And how about being a woman in a traditionally male industry?

To be honest, ever since I was apprentice, I’ve never really had any problems. There’s only one person who’s ever had an issue with me being a woman, which is quite disappointing as everyone else has accepted me for who I am.

When I used to walk on to building sites, they guys

would look at me and go: “Oh, you’re the electrician.” But as they got to know me and saw I could do the work, they were absolutely fine.

What would you tell other women who want to take up the trade?

Go for it – don’t let anyone tell you that you can’t do it. I’m not particularly tall or well built, but I can do everything that needs to be done, so I don’t see any reason why someone else couldn’t.

Have you seen more women in the industry as the years have gone by?

I’ve come across a lot of painters and the odd joiner. I’ve not met any female plumbers yet, but I have met two other women in the electrical industry; one an electrician and the other an electrical engineer.

How else has the industry changed?

There are a lot of different regulations now, which is making it safer. The only change that I’d like to see in the future is electricians being regulated. There’s currently no law against an unqualified person touching your electrics, which is an absolute disgrace.

How do you see the future progressing personally?

I think I’ll probably run things once Dad steps down – although I’m not sure he’ll ever properly retire! And I don’t know if I’d want him to, because he’s a real mine of information. He’s seen so much that he’s the first port of call if I’m stumped.

And how has SELECT helped you and the business?

My dad’s been a Member since 1991 and it’s been really handy. If you have technical questions, or if you come across something which doesn’t look right, you can always get hold of someone and they’re always very helpful.

A trio from SELECT joined the Electrical Distributors’ Association (EDA) delegation to visit the Light + Building exhibition in Frankfurt.

Among them was our own Dave Forrester, who kept a diary of his two-day adventure…

An enlightening DAY 1: EDINBURGHPARIS-FRANKFURT

Catching the 06:10 flight to Paris meant an early start in Edinburgh, but the flight itself was uneventful with smooth skies and reasonable onboard catering. A slight delay made the transfer to Frankfurt interesting, but the cabin crew helpfully provided a map and directions on where to go. So we disembarked, boarded a bus to the terminal and endured a second round of security checks before getting back on another bus to take us to our next flight. As we trundled around the airfield, things started to look familiar.

“Are we heading back the way we came?”

I said. “Wouldn’t it be funny if we got back on the same aircraft?” said Kevin.

Well, that’s exactly what happened. As we climbed the steps to board the same aircraft we’d only recently disembarked, 18

the cabin crew gave us a wee smile of recognition and claimed they had been sworn to secrecy in case we decided to stay right where we were!

Once seated, the captain announced a short delay due to weather in Frankfurt – there was snow on the ground and the overnight temperature had been -7°C. We arrived to a slightly underwhelming volume of snow, but it was still cold. At the baggage carousel we waited for Kenny’s case... and waited... and waited.

(It would arrive at our hotel sometime later that day.)

We needed to take a monorail, then walk a considerable distance to the hotel – but walking would become a major feature of our two-day visit.

The majority of our delegates attending this year were doing so for the first time, and while two days provided a good introduction, it wasn’t enough to do justice to this global event. Senior representatives from the electrical contracting sector attending alongside wholesalers certainly helped to stimulate discussions and we hope to replicate this mix in our next visit to Light + Building.”

The remainder of the afternoon saw us visit several manufacturers’ stands to view their latest LED lighting and smart control systems. Manufacturers view the expo as the premier event in their calendar and can spend millions of pounds on showcasing their latest products. The sheer scale of corporate hospitality at the larger manufacturers’ stands would put many permanent high-class restaurants to shame.

After short visits to the Lutron, Sylvania, Megaman and Kosnic Lighting stands, we headed for the Eaton Electric stand where we saw a

demonstration of their latest arc fault detection devices, particularly relevant given their inclusion in the upcoming 18th Edition of BS 7671.

After being turned away at the Philips stand, the formal part of the day ended with a tour of the impressive LEDVANCE and Thorn lighting exhibits, where we saw a range of domestic and commercial/industrial lighting applications at the cutting edge of design and LED technology.

The day ended with dinner and drinks with the Lighting Industry Association, before we headed back to take the weight off our overworked feet. (Our phones showed we’d walked a combined total of 20 miles and around 45,000 steps that day.)

Continuing our series of essential technical updates, we look at Test 2: Continuity of ring final circuits – the next test required as part of the verification process for a new electrical installation

hile retaining focus on initial ‘power-off’ tests, the next test that should be considered in the test sequence is also a continuity test. However, this time it is specifically used to verify the continuity of ring final circuits.

Because this is a continuity test, the requirements for the instrument used to carry it out obviously remain the same as when carrying out Test 1: Continuity of

protective conductors. This means a low resistance ohmmeter or multi-function test instrument on the continuity setting capable of applying the required test voltage and current will be used.

In Chapter 61, Regulation 612.2.2 requires that “a test shall be made to verify the continuity of each conductor, including the protective conductor, of every ring final circuit”.

This is necessary to confirm that the all live – line and neutral – conductors and the circuit protective conductors (CPCs) of the ring final circuit are properly terminated at each socket-outlet. The test

method used for this purpose comprises of three specific steps. Where the three steps are carried out correctly, the tests performed verify that each of the ring final circuit conductors is continuous and unbroken and that there’s no interconnection or bridge within the circuit.

This also provides a method to measure the combined sum of the resistances of the line conductor and the CPCs or (R1+R2) for the circuit which, as mentioned in the previous article, can be used later in the verification process to determine the earth fault loop Continued on page 22

impedance using the formula Zs =Ze + (R1+R2). There is also an additional benefit to using the three-step test procedure in that polarity is verified as correct at each socket-outlet.

Performing the test: Step 1

First, identify the ring final circuit to be tested, then disconnect the line, neutral and CPCs of the circuit at the distribution board or consumer unit.

At this stage, it may also be of benefit to identify which of the conductors are incoming or outgoing. This will be necessary to complete Step 2 and 3 of the procedure, so identify either the incoming or outgoing conductors on one side of the circuit and apply temporary markers to each of them, e.g. using electrician’s tape.

Then connect the test leads in turn between both line conductors (r1), between both neutral conductors (rn) and

finally between both circuit protective conductors (r2) to measure the resistances.

If the incoming and outgoing conductors have been connected properly at all socket-outlets, a resistance will be displayed on the test instrument.

When measuring the resistance of the conductors, the values obtained will depend on the length and cross-sectional area of the conductors installed.

However, it should be expected that the values of resistance of each of the conductors of the ring final circuit will be similar if they’re all of a similar cross-sectional area.

A high resistance value obtained may either indicate an open-circuit where the value is greater than that which can be measured by the test instrument, i.e. off the scale, or a loose connection at one or more of the socketoutlets if a higher than expected value is obtained.

indicate that there is an interconnection or bridge somewhere in the circuit.

In a ring final circuit where a cable type with reduced size of CPCs is used, such as where the circuit is wired using BS 6004 cables (PVC flat twin and earth), the resistance will be higher than the value of resistance measured for the line and neutral of the circuit.

The value measured will be in the ratio of the size of the line to CPCs, e.g. for a cable with line conductor size of 2.5mm2 and CPC size of 1.5mm2, the resistance of the CPCs will be approximately 1.67 times that of the line conductors.

To conclude Step 1, the measured values of resistance between line to line, neutral to neutral and CPC to CPC should be recorded in the respective r1, rn and r2 columns under the ring final circuit continuity column in the schedule of test results.

Remember to compensate the measured values of resistance by deducting the resistance of the test leads (or null the instrument) before recording values.

Step 2: Verify there are no interconnections made within the circuit

At the distribution board or consumer unit, connect the incoming line conductor to the outgoing neutral conductor and similarly connect the outgoing line conductor to the incoming neutral conductor

using a reliable means of connection such as a terminal strip connector.

This creates a figure of eight connection in the line and neutral conductors of the ring final circuit. It also allows a measurement of resistance to be made between the line and neutral conductors at each and every socket-outlet connected in the circuit.

Note – there are special plug-in test adaptors that have been designed for this purpose that can help when measuring the resistance value.

The value obtained at each socket-outlet should be approximately half of the r1 or rn values measured in Step 1, and they should be of

similar value at each socketoutlet in the ring.

Where a socket-outlet may have been connected as an unfused spur on the ring, it is likely that this will be identifiable by having a higher than expected value.

If, for some reason, an interconnection or bridge has been made in the circuit, the resistance value measured will increase incrementally at each socket-outlet after the point where the interconnection has been made on one side of the circuit, until the middle of the interconnected circuit is reached.

It will then start to reduce in value at each socket-outlet decreasing from the middle of

the interconnected circuit until we reach the socketoutlet located where the interconnection has been made on the other side of the ring final circuit.

If the outgoing and incoming conductors are not correctly identified at the beginning of Step 2 when connecting the figure of eight, the error will be revealed during the continuity test from the first socket-outlet in the circuit onwards in a similar manner to that above, i.e. increase in resistance to the middle of the ring final circuit and then decrease.

Note – the value obtained in Step 2 does not need to be recorded on the schedule of test results.

Step 3: Establish the effective (R1 + R2) of the Ring Final Circuit

This is similar to Step 2, but this time at the distribution board or consumer unit connect the incoming line conductor to the outgoing circuit protective conductor and connect the outgoing line conductor to the incoming circuit protective conductor.

This again creates a figure of eight connection in the circuit which allows a continuity measurement to be made between the line conductor and circuit protective conductors at each of the socket-outlets.

As per Step 2, the special

plug-in adaptor developed for this purpose may be used.

However, the manufacturers of multi-function test instruments usually provide a test lead with a moulded BS 1363 plug which can also be used.

The value measured at each socket-outlet – as in Step 2 – should be of similar value. However, this time the value should be approximately a quarter of the combined r1 and r2 value measured in Step 1.

Any reversal of line or neutral conductors at any of the socket-outlets connected will be revealed during Step 2 and 3 and will produce an open circuit high resistance value at socket-outlets where an incorrect connection has been made.

To conclude the testing of ring final circuits, remember to reinstate the circuit back to its original condition before recording the value measured in Step 3, which is the (R1+R2) of the circuit, in the (R1+R2) column provided for continuity test results in the schedule of test results.

Instead of using the ‘bcc’ recipient line in Outlook (meaning that each recipient would think the message had only been sent to them), Jim Wire puts all of the email addresses in the ‘To’ recipient line, so that every recipient accidentally gets to see the full email address of every other recipient.

This is a breach of data protection under the GDPR as each customer’s email address was never meant to be given out to anyone outside of Wire & Co Electricians.

Jim Wire should now record this breach on the Data Breach Record Spreadsheet, and contact the ICO to let them know what has happened. Jim will then take advice about next steps from there.

The GDPR has provisions on: ●●Automated individual decision-making (making a decision solely by automated means without any human involvement) ●●Profiling (automated processing of personal data to evaluate certain things about a Data Subject). Profiling can be part of an automated decision-making process.

If your business does engage in automated decision-making or profiling, please seek further legal advice on how to comply with the GDPR in this regard.

The new Training, Skills and Development Committee met for the first time in April at The Walled Garden, with a brief to monitor and review all

training and development matters that affect SELECT Members.

It will also give strategic direction to BSE Skills and engage with third parties including the Scottish Government, Skills Development Scotland, Scottish Qualifications Authority, the Scottish Joint Industry Board, training providers and other trade bodies. In addition, it will monitor training content to ensure it is relevant, current and accurate.

Dangerous surprise was found lurking in ceiling

A

recent call to the SELECT Technical Helpline, followed by some photographic evidence, highlighted a problem faced by a SELECT Member company in the Perth area.

A representative from the Member company discussed with SELECT’s Technical Adviser on the best way to rectify a problem encountered when attempting to replace 24 in No 600mm x 600mm modular fluorescent lights with LED ‘flush panel’ luminaires in three separate areas in an office building.

The company had carried out a brief inspection of the existing installation prior to ordering the equipment in an attempt to confirm suitable circuit details, installation methods and to

establish how the existing lights were connected to the fixed wiring. Suitable standards were established at this point.

Unfortunately, the relatively good standards and working practices observed in the main office chosen for inspection were not found above the suspended ceilings in the other offices.

As the picture above shows, in the

other areas the wiring and installation practices, and the methods used to connect the luminaires and cable support, were not in line with BS 7671.

The company electrician was advised to inform the client of the problems and a programme of remedial works was subsequently agreed.

The electrician was forced to alter, repair, tidy and suitably secure the wiring in line with Regulation 522.8.4 (mechanical stresses).

Suitable connection methods were used to connect the new LED lights to the fixed wiring in line with Regulation 559.5.1 (connection to the fixed wiring ).

The system was then inspected and tested for suitable operation.

Without these remedial works, a potential hazard of electrical shock and fire would have existed.

Finally, an Electrical Installation Certificate – complete with a schedule of inspection and schedule of test results – was prepared after successful completion of the work.

Liam listens to views of local apprentices MSP Liam McArthur heard apprentices’ stories first-hand when he visited E Fraser Electrical in his Orkney constituency.

The politician met director Bruce Simpson, along with apprentices Scott Glen, Kyle Linklater, Connan Rendall, Paul Muir, Owen Rendall, Adam Shaw and David Grant. Doreen Rendall represented Skills Development Scotland.

Liam said: “As part of Apprenticeship Week, I dropped by E Fraser Electrical in Finstown to meet up with Bruce and

the team of apprentices. It was really interesting getting their perspective on the scheme, how they came to take up an apprenticeship and what their hopes are for the future.

“It was very clear to me that getting a chance to develop skills through a mixture of college courses and first hand work experience has been really positive for all the apprentices.

“It also helps lay solid foundations for what is and will remain a key part of the local workforce.”

nce again, we enjoyed another great Scottish Apprenticeship Week, during which we were able to showcase exactly what we do on a daily basis. The event recognises the high quality training we manage on behalf of the Scottish Joint Industry Board (SJIB), and I was delighted to organise a number of MSP visits on behalf of the Scottish Government through Skills Development Scotland.

During one such visit, I was lucky enough to meet the team at IQA Operations Group Ltd in Paisley when West of Scotland MSP Neil Bibby

visited. IQA – who have two apprentices and 15 adult trainees currently in training – mostly work through Scottish Power, covering the whole of the UK. Neil took time to chat to three adult trainees – Darren Leitch, Lewis McLean and Gary Murray – who are all in the 3rd stage of their training, and heard how they’re currently enjoying the work and what they covered. Darren, Lewis and Gary were happy to describe the different areas and excellent range of work that they have been involved in.

Neil said: “Scottish Apprenticeship Week is an ideal opportunity to not only showcase the variety of apprenticeships we have on offer in this country, but to showcase the enthusiasm and talent of those people of all ages taking up apprenticeships in order to work, learn and earn.

“I was pleased to meet some of the apprentices at IQA Group and to listen to their ideas for how we can work towards creating a balance between developing both technical skills and life skills that provide real value to

eing the Convener of the Education and Skills Committee gives me the opportunity to travel across Scotland to see the excellent work that goes on in our schools and in the higher and further education sectors. However, one of the things I enjoy most is visiting the many businesses that employ apprentices.

The Scottish Government’s Modern Apprenticeships Programme has made a huge difference to those young people who didn’t want to follow an academic route but wanted to explore their potential and creativity in other ways.

The programme offers the opportunity to learn on the job and gain the experience needed, while also working towards a recognised qualification and earning a wage.

There have been some changes to the Modern Apprenticeships. There is now the rural supplement for providers to cover the additional costs for delivering in rural areas. We have also abolished the public sector eligibility restrictions, ensuring public sector employers have the same access to Modern Apprenticeship funding.

The Scottish Government has also made provision for more opportunities to those over 25 and I am delighted that the enhanced contribution rates for young disabled people and those who have experience in care are

Investing in essential skills Our guest columnist reveals how apprenticeships have made a difference to so many lives across Scotland – and pays tribute to the SELECT Members who have helped give trainees a start in the electrotechnical industry providing the funding need for those up to the age of 29.

Not every young person wishes to follow an academic career. This is why I’m particularly pleased with the Foundation Apprenticeships, so that students in S5 and S6 can gain valuable work experience through accessing work-based learning, which is embedded into their senior educational experience while providing industry-recognised qualifications and experience that employers are looking for. It will be no small achievement for Scotland to reach the 5,000 Foundation Apprenticeships available in our schools by 2019.

One further development in apprenticeships that I am delighted with is the Graduate Level

Apprenticeships, where students can study for degree-level courses while in employment. This meets employers’ needs for high-level skillsets with invaluable industry experience gained within the workplace.

The UK government has also introduced a UK-wide apprenticeship levy which meant that, from April 2017, employers pay 0.5% of their annual pay bill of more than £3 million. The Scottish Government has announced that Scotland’s proportion of the levy shall support skills, training and employment.

I’m sure that many SELECT Members are benefiting from the bright young talent that they have taken on.

They shall be a great asset to these firms and I wish to thank SELECT Members for utilising the schemes and

incentives that the Scottish Government has provided and for giving these young apprentices the chance to learn, grow and take a stake in our society. It is also important for your customers, whether they are domestic customers, businesses or landlords. We all need the comfort of knowing our home and businesses meet electrical health and safety standards and can call on the industry’s technical inspection services.

The First Minister announced on 5 March 2018 that by the end of 2018 there shall be 27,000 Modern Apprenticeships with a target of 28,000 Graduate Apprentices for 2019.

Scotland’s commitment to our young people is underpinned by Skills Development Scotland, who manage the various apprenticeship programmes, organising a national apprenticeship conference in this, the Year of Young People.

Scotland shall continue its commitment to investing in the skills Scotland needs for a vibrant economy that can deliver for everyone in our society. It will allow our young citizens to play a vital role realising not only their own potential but also the potential business opportunities Scotland has in both domestic and international markets.

This impact should not be underestimated. The uncertainties posed by Brexit and other international developments around us requires Scotland to have a strong economy that is fit for the times ahead.

I believe that our apprenticeship programmes can go a huge way to meeting those challenges.

I enjoy practical work with my hands and working outside, and also have an interest in electrical projects.

So how did you go about getting an apprenticeship?

I did a work experience placement at RS Merriman through Orkney College, and they offered me an apprenticeship a few weeks after my placement.

Did you find you were treated any differently as a woman when working? Were attitudes towards you any different?

I feel I am treated differently – but actually in a really positive way.

Everyone I work with makes me feel relaxed and I feel everyone is helpful and understanding; they certainly don’t make me feel different. I fit in Melanie well, and I am won her involved in award last everything that October everyone else is.

Positive thinking Do you think the industry still has a ‘job for the boys’ attitude?

I’ve met a few people with that attitude, but maybe they think I’m not strong enough to do certain jobs. I’m not sure why they aren’t receptive to women working in the industry but I’m open to their opinions. It’s very rare that I come across this type of person – everyone in the company I work for is very open and welcoming.

What do you think needs to be done to encourage more women

to get into the industry?

Women need to see what the work involves and understand that everyone can do the job, no matter their gender. If you want to do it, just go ahead and do it.

So what are your plans for the future?

I don’t know, to be honest. I’ll continue to work where I am for a while and see where it takes me.

What would you tell other women considering a career in the industry?

Get a work experience placement for a few weeks to understand what the job is about and see the types of work available. I’d also advise to try and get an apprenticeship – it’s such a good thing to have for the future.

Beware: The Terminator is back

In the second part of his special focus on contract issues, Len Bunton turns his sights on termination by the contractor

n my last article for CABLEtalk, I dealt with termination by the employer, and in this article I will look at termination by the contractor.

I wanted to mention the two seminars that SEC Group Scotland held in Dundee and Cumbernauld on 16 and 17 May. We covered many important issues about payment and the issues of suspension were covered, which I wrote also about in a recent article for CABLEtalk.

Delegates considered that even threatening suspension for non-payment was a powerful and persuasive tool.

It definitely is, and should be considered by contractors and sub-contractors alike.

So what grounds are open to you to terminate your contract? Again, I am looking at the provisions of Clause 8 of the Standard Building Contract with Quantities, for use in Scotland, 2016 Edition, referred to as SBC/Q/Scot.

default by the employer, and there are four issues to consider: ●●If the employer does not pay by the final date for payment the amount due to the contractor, in accordance with Clause 4.11 ●●If the employer interferes with or obstructs the issue of any certificate under the contract, e.g. the employer interferes with a certificate on non-completion ●●If the employer fails to comply with Clause 7.1, relating to assignation ●●If the employer fails to comply with Clause 3.23, relating to the CDM Regulations.

If the employer does any of the above, then the contractor may give the employer a notice specifying the default or defaults. This is referred to as a ‘specified’ default or defaults.

It is interesting that failure to pay by the final date opens the door to the contractor to suspend or terminate – very powerful options.

In addition to the above, clause 8.9.2 provides that if before practical completion of the works, the carrying out of the whole or substantially the whole of the uncompleted works is suspended for a continuous period of the length stated in the contract particulars, by reason of any architects/

contractor administrators under clause 2.15 [this relates to giving notice of discrepancies] or clause 3.14 [this relates to instructions requiring variations] or clause 3.15 [this relates to postponement of the works], then the contractor may also give to the employer a notice specifying the event or the events.

This is referred to as a ‘specified’ suspension event or events.

Looking at the contract particulars, which you will find at the front of the contract, you can see that there is space to fill in a period. If none is stated, the default period is two months. You need to look at this carefully to ensure that an excessively long period is not inserted.

Clause 8.9.2.2 brings in a further issue.

If there is any impediment, prevention or default, whether by act or omission, by the employer, the architect/contract administrator, the quantity surveyor or any employer’s person [note employer’s person is defined in Section 1 of the contract under Definitions], then the

provisions above concerning a ‘specified’ suspension event or events, apply here as well.

So what are the further procedures in the contract?

If the specified default or specified event continues for 14 days from receipt of the notice under clauses 8.9.1 or 8.9.2, the contractor may on, or within 21 days from the expiry of the 14-day period, by a further notice to the employer, terminate the contractor’s employment under the contract.

You can see that it is very important that the above processes are fully complied with, and if they are not then you will be challenged for not following the contractual procedures. In fact you might be required to commence the whole process again.

Under Clause 8.9.4, if the contractor does not give the further notice

in a certificate and paid for by the employer previously? That would need to be resolved.

Other issues

referred to in clause 8.9.3, but the employer repeats the specified default, or the specified suspension event is repeated, such that the regular progress of the works is or is likely to be materially affected, then after or within a reasonable time after such repetition, the contractor may by notice to the employer terminate the contractor’s employment under this contract. Again these procedures may appear to be convoluted and clumsy, but they require to be fully complied with, so go carefully, take advice if you require to ensure you get the termination process right.

Wait! We’re not finished…

Clause 8.10 deals with insolvency of the employer. If the employer is insolvent, the contractor may by notice to the employer terminate the contractor’s employment under this contract. As a result, as from the date of the employer’s insolvency, the

In accordance with Clause 8.12.3, the contractor has to submit what effectively is his final account up to the date of termination, and this must be submitted not later than two months after the date of termination. In reality, the contractor has got to get his act together very carefully and quickly to measure and value the works completed on site, so taking a record via photographs and videos would be necessary. Common sense would dictate that the contractor would be best to get matters agreed with the employer’s quantity surveyor and/ or the administrator involved, to avoid disputes at a later date, as to what stage the works were at.

FOCUS RETENTIONS UPDATE

O

n 23 April this year, the Construction (Retention Deposit Schemes) Bill was published. It’s become known as the Aldous Bill since it was introduced by Conservative MP Peter Aldous at its first Reading in the House of Commons on 9 January.

The Bill has the backing of almost 130 MPs across all parties in the House of Commons. One such supporter is Kilmarnock MP Alan Brown who, as we highlighted in a previous edition of CABLEtalk, attempted to bring in legislation to safeguard retentions over a year ago. This was scuppered when Theresa May called a General Election.

The Bill was due to have its Second Reading on 27 April but this has now been moved to 15 June for two reasons: ●●It is hoped that there will be more time to discuss it, as Bills introduced

by MPs are called Private Members’ Bills and are always debated on Friday afternoons. ●●Having the extra time will provide more opportunities to pile the pressure on the Government to support it.

What the Bill says

The Bill will add a new section to the payment provisions in the Construction Act. Its key provision is as follows: “Any clause in a construction contract, entered into after the passing of the Construction (Retention Deposit Schemes) Act 2018, which enables a payer to withhold cash retentions shall 42

But that gives us more time to put pressure on our MPs and deliver a knockout blow to this unfair practice be of no effect unless: a) upon their withholding, the monies are deposited forthwith in a retention deposit scheme…and b) prior to the first withholding of the monies, the payer has notified: i) the payee of the scheme administrator’s name and contact details, and the scheme administrator of the payee’s name and contact details.”

This means that any retention deposit schemes will have to be approved by government. However, such schemes

may also offer alternatives. The basic version would be a ‘custodial’ scheme where the retention monies would be kept secure until release. This would be similar to the service provided by tenancy deposit schemes. The other main alternative would be an insurance-backed one. In other words, clients would be offered an insurance option as security instead of cash retention.

The retentions consultation

You may recall that last year the UK Government published a consultation on

Statutory safeguarding of retention monies is likely to reduce the demand for cash retentions. If the cash cannot be used to bolster working capital there is little point in asking for it. Moreover, to move now to a statutory ban on cash retentions would stir up considerable opposition. It is known, for example, that Scottish local authorities would not support an outright ban but they would be sympathetic to statutory protection for the monies.

Where to now?

the practice of retentions. The consultation period closed on 19 January 2018 and the Business Department in London has now analysed the responses.

The consensus was that the abuse associated with the practice of retentions is severely damaging to the industry, especially small firms. It appears the views were fairly evenly divided between safeguarding the monies and getting rid of the practice altogether.

SELECT, as part of UK SEC Group (and SEC Group Scotland) has urged

that we strive for protection of retention monies as soon as possible.

We now know that the liabilities of Carillion Construction were over £7 billion and still rising.

Almost £750 million could be outstanding retentions which are now lost forever. Therefore, we must register our anger about this loud and clear.

Collapse of reasonable skill and care?

By Rebecca Barrass Solicitor, MacRoberts LLP In January 2009, energy giant SSE began operating its Glendoe Hydro-Electric Scheme. The scheme was cited as one of Scotland’s biggest civil engineering projects, capable of generating power for 250,000 homes every 24 hours.

However, shortly after it became operational, SSE discovered the headrace tunnel which transports water from the reservoir to the turbine house had collapsed, leaving the whole scheme inoperable. SSE instructed remedial works costing a whopping £130 million.

SSE raised a court action to recover £137m from main contractor, Hochtief. The works were governed by an NEC2 contract with option M which stated: “The Contractor is not liable for Defects in the works due to his design so far as he proves that he used reasonable skill and care to ensure that it complied with the Works Information.”

SSE claimed that Hochtief were in breach of the Works Information and therefore responsible for the cost of the remedial works. However, the court found that option M put an “important brake on liability”, holding that Hochtief had not guaranteed the works.

Instead they had only accepted the lesser obligation of “reasonable skill and care”.

Ultimately, the court found that Hochtief had exercised reasonable skill and care, thus the collapse was an

employer’s risk event for which SSE was responsible.

SSE appealed and the appeal court overturned the original decision, stating: “The defect was not due to the contractor’s design of the works but rather to the implementation of design. In those circumstances, option M is not engaged, and the defence of having used reasonable skill and care to ensure that that design complied with the Works Information is not available to the contractor.”

The court decided the collapse was the result of a failure of Hochtief in implementing the design.

Simply exercising reasonable skill and care at the design stage did not protect them.

The court’s decision has arguably added ambiguity to where design obligations end and workmanship obligations begin, causing difficulties for employers, contractors and insurers alike.

However, given the sums involved, it is anticipated that we will see the decision appealed in the Supreme Court. Until then? Parties need to think very carefully about the extent of the obligations they are undertaking pursuant to their contracts.

It may not be as simple as it seems at first glance!

Managing Director Designate What’s a typical day for you at work?

There’s no typical day. I enjoy visiting and talking to Members. I also spend time meeting other organisations in the construction industry, as well as visits to the Scottish Government to discuss legislation. Time in the SELECT base at The Walled Garden gives me the opportunity to catch up with the team and I’m always happy for members to drop in for a coffee and a chat.

What does your job entail?

Making sure SELECT works for Members. Whether it’s on regulation and standards, working with the Policy and Technical teams, or on Member benefits, my role is to make sure we keep the Members’

needs in the forefront of all of our decisions.

What do you look forward to most in your new role at SELECT?

Meeting Members around Scotland and working with the President’s team and branches to promote the industry. A side benefit is that I get to visit the rest of beautiful Scotland!

Dog or cat person?

Both, one of each.

First car owned?

An Opel Ascona that fell apart when you applied the brakes.

First job?

I trained as a QS in a sleepy village near Reading.
