Behind-the-scenes work is bearing fruit

A

s I tour around Scotland and talk to Members, it brings home the value of what we are trying to achieve as a trade association. Without the shackles of shareholders, or the need for commercial gain, I am very proud to be at the helm of an organisation that answers only to our Members, and always tries to do the right thing by the industry.

This may show itself in the investment in apprentice training, the resources we put into training for you, or in the work we do through the SJIB to keep the industry on a calm footing, protecting rights all round.

However, it is most obvious when we have engaged with government bodies and it suddenly becomes clear that where there are issues to be resolved around qualification, certification or regulation – particularly post-Grenfell – authorities really need to do more.

SELECT can maintain a position of encouraging the highest standards, where some others in the industry will try to promote a commercial interest. It is sometimes difficult convincing people that have little understanding of the industry that an ‘assessment of competence’ doesn’t equal qualifications gained through a modern apprenticeship.

We will keep lobbying and influencing, which is a considerable amount of work that we do behind the scenes for Members. This

is vital, as people are shocked that someone can buy a van and tools and call themselves an electrician, or that going on a six-week course (or shorter!) doesn’t start to match up to the value of an apprenticeship, FICA and ACA. This doesn’t do justice to the history of the industry and the hard work done over the decades, to gain the position of encouraging qualifications, keeping knowledge up to date, and ensuring the industry is as safe as it currently is, both for the general public and your employees.

It is clear to me as a newcomer that SELECT has the progression of the industry in Scotland at the heart of everything we do. Unfortunately, this cannot be said about commercial certifying companies that see an untrained ‘electrician’ as a moneymaking opportunity, rather than a potential asset that will ensure safety for everyone throughout the length of their career. That’s why we will continue to update you on the progress we make on regulation with Scottish Government, including regular updates in CABLEtalk, so that you see the ‘behind the scenes’ work that goes on for the industry. The news items on pages 6&7 clarify where we are now and what you can do to assist SELECT in our aim of keeping the industry safe and credible.

It is clear that operatives, employers and many clients place great store on an SJIB grade card and we would ask members to ensure that all of their team have grade cards too, so that we keep raising the bar. As the leading industry training body, SELECT can help anyone on the pathway to obtaining their grade card, so please get in touch if required.

Membership of SELECT continues to grow, with contractors benefiting from a personal, local service, technical help, and many free Member benefits designed to help them operate. SELECT is also responsible for running all of the industry bodies that support the electrotechnical industry in Scotland, and with your continued support we will keep representing Members, promoting a safe progressive industry.

epresentatives from SELECT spoke at the recent Association of Gas Safety Managers (AGSM) Scotland 2018 conference and exhibition held at Crieff Hydro, Perthshire.

Dave Forrester and Bob Cairney addressed an audience of safety and compliance professionals in Scotland’s social housing sector as well as industry experts for a day of learning and networking.

Bob, Technical Standards Adviser at SELECT, spoke on the impact of the recently introduced 18th Edition of the Wiring Regulations, the “bible” of the UK electrotechnical industry. Dave, SELECT’s Head of Technical Services,

addressed the need to regulate the electrical installation industry.

Bob has vast knowledge of the 18th Edition, which is being introduced in January 2019. As part of Bob’s work, he has prepared a vital guide to assist SELECT members understand the changes contained in the new regulations. A central theme concerns improvements to the level of safety provided in new electrical installations with particular regard to fire safety.

Mr Halcro Johnston’s motion, which is due to be debated in parliament on the early afternoon of Thursday 25 October, will ask Holyrood to note the calls supporting the principle of the regulation of electricians and will also point out that, while more than 100 regulated professions exist in the UK there is no protection afforded to electricians.

It will again ask Parliament to appreciate that improperly installed electrical work creates a significant risk of fire as well as other harm to householders and that the installation of electrical work by unqualified or only partly qualified individuals carries a safety risk.

And finally, it will ask for acknowledgement of calls for the Scottish Government to consider how the Parliament’s powers over protection of title can be utilised to reassure the public of the safety of electrical work in domestic and non-domestic premises.

Trade associations appointed to pioneer future skills development

I

n conjunction with the Building Engineering Services Association (BESA) and Scottish and Northern Ireland Plumbing Employers’ Federation (SNIPEF), SELECT has helped create a joint body called BSE Skills Ltd, which has just been appointed to manage and develop apprenticeships, qualifications and National Occupational Standards for the building services engineering sector.

The move sets an historic precedent as it is the first time that trade bodies have received a government commission to carry out this work.

The government-sponsored sector skills council SummitSkills was the managing body until it was disbanded in 2017. Now, following a four-nation tender process, the central and devolved governments have turned to the three organisations in order to ensure a secure future for vocational training in these crucial specialist sectors.

As member bodies, the trade associations were able to demonstrate close links with employers as well as UK-wide capacity as part of the bidding process and are now poised to work with their respective memberships to manage the delivery of a training framework for the whole sector.

Fiona Harper, Head of Employment Affairs at SELECT and Secretary of the SJIB said: “Obtaining this agreement is testament to the hard work put in by all of the trade bodies involved. It was vital that we retained control over the development of our National Occupational Standards as these are the starting point for all the work we do in developing the training undertaken by our workforce.

“Everyone in the industry understands the importance of qualifications and it will be exciting to see how we can develop this work into shaping the training needs of the sector going forward. As new technologies and working practices develop, it’s vital that the industry controls its own destiny in the training and skills development.”

BSE Skills has also undertaken to align and coordinate all end dates for UK qualifications and modern apprenticeship frameworks in line with the rapidly changing landscape for apprentice recruitment and funding.

The industry bodies have also identified a need to establish mutual recognition and transportability of all BSE qualifications across the UK and to recognise the specific needs of each industry and in each region.

Expert Frank leads new contract course

An essential SELECT training course in Safe Management of Contracts is being rolled out in November.

Presented by experienced consultant Frank McCann, the two-day course gives practical advice on how to manage health and safety and environmental requirements for small to medium contracts.

Frank said: “The course gives candidates an understanding of construction design management (CDM) regulations and what their duties are. It also looks at reviewing methods of risk assessments.

“It’s important because CDM duties now apply to everyone, so whether you’re a large or small firm, you must meet the requirements.

“As well as delivery of knowledge, we have scenario workings, risk assessment preparations, quizzes and input from students. Everyone gets involved and we like to discuss how we could put things into practice.”

An earlier tutorial was held at the Walled Garden earlier this year.

IET warning over bogus copies of the 18th Edition

T

he Institution of Engineering and Technology (IET) is urging all electrical professionals to ensure that they are using genuine copies of BS 7671:2018, The IET Wiring Regulations.

The call comes as the IET has been made aware of a number of counterfeit PDF copies of its publications for sale and distribution through various channels.

The IET is warning that following misinformation in

these fake copies could be devastating for electrical professionals and the general public at large – with missing or corrupted information potentially leading to unsafe work being carried out which could result in fire, electric shock or even death in the most extreme cases.

Mark Coles, Head of Technical Regulations at the IET, said: “The counterfeit PDF copies of BS 7671:2018 we have seen initially look very convincing but are sprinkled with errors which

can lead to dangerous practices. Unless you know the origin of the document, how can you rely on it?”

To help combat the counterfeit activity, an official hologram has been placed on the inside front cover of the IET Wiring Regulations, commonly known as ‘the 18th Edition’.

This makes it more difficult to counterfeit the guidance and easier for individuals to identify genuine copies of the IET’s books.

The hologram contains the IET logo in two sizes and the word ‘GENUINE’. There are also extra identifiers, some of which can be seen with a magnifying glass.

As a registered charity, the IET has a responsibility to uphold standards and ensures that all proceeds from genuine books go back into the organisation and the electrical industry – meaning that it can continue to provide safe and reliable information for those professionals working in the electrical sector.

Mark continued: “Ensuring that genuine copies of IET publications are being used by electrical professionals is important in order that correct

standards are used to protect the public and those working in the industry from injury and fatality.

“My advice to people looking to buy a copy of any IET publication would be to buy it directly from the IET if they are in any doubt about the supplier they are making a purchase from, or to consult our list of validated suppliers across the UK. “Electronic access to BS 7671:2018 is provided by the IET through the Wiring Regulations Online platform, and also the BSI, through British Standards Online.”

SELECT plugs into the future We’ve just completed the installation of an additional four fast-charge electrical vehicle charging points at our Walled Garden offices, bringing the total number of charging points to six.

SELECT’s Head of Resources, John McGhee , said “ We realise that more and more members who use our facilities are now using electrical vehicles and we wanted to ensure that we were

able to offer them the opportunity of charging their vehicles on site.”

Members face double-whammy of late payments and rising costs

C

onstruction companies, including SELECT Members, are being hit by a doublewhammy of rising costs and late payments, according to an influential new business survey that tracks quarterly activity and trends.

On the issue of payment, respondents to the survey confirmed that just under half of all payments from public sector bodies were made within 30 days.

In contrast, only 30% of payments from commercial clients were made within 30 days, with the rest taking up to 89 days to settle their accounts.

The survey was carried out on behalf of the Electrical Contractors’ Association, the Building Engineering Services Association, SELECT and SNIPEF. It also showed that the costs faced by companies shot up in the second quarter of the year, reflecting political uncertainty and international commodity ramifications.

said material costs were higher than at the start of the year, with 29.51% saying the cost of being tendered to also had risen.

SELECT Managing Director Darrell Matthews said: “The construction sector is currently in a good place in Scotland, but this masks some bad practice in the industry, as this survey highlights. While it’s good to see some public sector clients’ efforts heading in the right direction, it’s vital to ensure that SMEs, the lifeblood of the Scottish economy, are paid on time.

“The Scottish government has done quite a bit to support small businesses but could help out more by enforcing their own powers to make sure payments are made on time.

“Changes to the levels at which Project Bank Accounts are introduced would also be a great way of speeding up payment.”

COMMENT

Remember: Be brave

O

n 25 October, the Scottish Parliament will debate a motion raised by Jamie Halcro Johnston MSP on the need to introduce protection of title for electricians.

Electricity is fundamental to modern life and its safe use is imperative.

However, like other sources of energy, it must be handled with extreme caution.

Consequences for poor work can be damage to property, injury and – mercifully only occasionally – death.

You would think, therefore, that we would treat the provision and use of any such product with care and attention but we don’t. Why is this so?

I joined SELECT after working for many years for the plumbing federation, where regulation is embedded for gas work via the Gas Safe Register. Yet I was amazed to learn that the people who enter our homes and businesses need no qualifications at all and yet they can still call themselves electricians. This should not be the case and MUST change.

SELECT has argued the case for regulation over many years. So too, has UNITE the Union. We have both have engaged with the Scottish Government in particular over the last three to four years, meeting every request with help and co-operation. When it argued that action in this area was not within its competence, we produced counsel’s opinion to show that it is. When it asked about the scale of the problem in Scotland, we investigated and produced research as to the numbers of unqualified and semi-qualified individuals.

Protection of title would mean that anyone who claimed, purported or advertised themselves as an electrician would commit a criminal offence if they did so without holding a specified level of qualification. This would give regulatory authorities the opportunity to call the unqualified to account and deter them from the marketplace. It works in the gas industry, as I well know. Wider than that, 102 professions across Europe have

This Parliament in the not too distant past even extended regulation to ‘door supervisors’ – i.e. nightclub bouncers – to rid that trade of untrained ruffians!

None of us would like to be treated by an unqualified dentist or doctor. But we seem to be happy allowing unqualified people to go into our homes, carry out potentially dangerous electrical work and put their health and lives at risk.

So how many unqualified, self-styled ‘electricians’ are there? It’s interesting that despite the advice we and UNITE provided, the Scottish Government tried to insist upon accurate figures. It’s not as if all the unqualified are readily going to put their hands up and say: “That’s me!”

When we researched the issue, we determined there could be as many as 4,000 individuals operating in this manner. But quite frankly, one is too many. Even if our figures are double the actual number, it would be cause to act.

The largest area of poor and unsafe work is in the domestic market. As customers ‘purchase’ electrical work so infrequently, they should at least be informed better about the sector.

During our survey of public opinion last year, 93% backed regulations to ensure only people with qualifications can advertise as an electrician, while 89% wanted to know how to check that an electrician is qualified.

In 2016, there were 619 casualties and 10 fatalities in electrical fault-related incidents in the UK. Figures for Scotland are proportionately less, which might lead to the conclusion that the problem isn’t so bad. That would be wrong.

Many faults are latent, lying in wait for months or years before circumstances create an injury. In any event, surely we should be aiming for zero-tolerance of these injuries as they are avoidable?

It’s right to say that protection of title would entail the mutual recognition of qualifications within the UK and Europe.

But those who claim a new regulatory burden will only hamper businesses miss the point. What’s being suggested is that individuals must obtain qualifications not businesses. Under protection of title, individuals would need to show their employer any qualifications before being taken on or alternatively join the employer’s pre-existing training programme or undertake other training.

Any additional administration costs would be minimal, as SELECT and UNITE already operate the Scottish Joint Industry Board, whose remit and membership could be widened. In short, the regulatory structure already exists.

Despite the views of commercial bodies in England, all we are asking is for the Scottish Government to remember two simple words: BE BRAVE – and take the right decision for Scotland.

Aims, ambition and modern apprenticeships Jamie Hepburn MSP is Minister for Business, Fair Work and Skills in the current Scottish Government. Here, we ask him to cast his eye over the construction industry and outline how he and his political colleagues are working towards future success

By Stewart McRobert Hello Jamie. What are your views on the current state of Scotland’s construction industry?

There was strong growth over several years, largely predicated on significant growth from high-profile and welcome public infrastructure projects, such as the Aberdeen West Peripheral Route and the Queensferry Crossing. Over the last year there has been some contraction in these projects, with the industry returning to previous levels. However, it’s encouraging to see that output in the last quarter was up by 1.8 % on the previous quarter. That’s very positive and something we want to continue supporting. That’s why the infrastructure investment of nearly £4 million we are taking forward is critical and why our ambition to deliver at least 50,000 more affordable houses over the five-year term of this Scottish Parliament is vital.

How aware is the Scottish Government of the impact on electrical businesses of issues such as retentions and late payments?

These are issues not just for electrical businesses, but I know they cause real concern in the construction sector.

The UK Government was consulting on retentions earlier this year. We will see what the analysis says and draw our own conclusions. Late payment causes difficulty across all sectors, in particular for small and medium enterprises (SMEs). We seek to lead by example and have our own policy of prompt payment for services we procure. In addition, we set up the Scottish Business Pledge, which we are encouraging businesses to sign up to, and one element of that is a commitment to prompt payment.

How important is it that the people of Scotland use properly-qualified electricians?

I’d hope that would be self-evident. It’s fundamentally important that if anyone is having electrical work done in their home or business, they are sure the person undertaking that work knows what they are doing. The need to have someone who is fully qualified cannot be overstated.

So how can we reassure the people of Scotland that electricians are properly qualified?

This is one area where trade bodies such as SELECT have an important role to play. Most electricians will register with those bodies and that should give

people reassurance. There is always an issue of whether or not those working in the sector should be compelled to register, and about the classification of people as electricians. That was raised with Keith Brown when he was Cabinet Secretary for Economy, Jobs and Fair Work and it has been raised with me.

Mr Brown subsequently set up a working group to look at this issue and we are continuing to look at it and, as always, I retain Jamie Hepburn an open mind.

Are you confident about the future of the construction industry?

Will Brexit have an impact?

“If someone is having work done, the need to have someone fully qualified doing it cannot be overstated”

Brexit could have an impact because we know there are EU nationals working in the construction sector. Employers from a range of sectors are concerned about sourcing labour, which up to now they have been able to do from other parts of the EU. We need to be able to fill any gaps that emerge. In the construction sector that situation is being helped by the huge number of people taking apprenticeships.

What’s more, through the Scottish Funding Council we are creating a first of its kind – a construction innovation centre in Scotland. This is a £7.5 million investment to make sure the Scottish sector can remain innovative, come up with new ideas and practices, and provide more ways of working to keep ahead of the curve.

What about the next generation? How important are modern apprenticeships to the industry’s future?

Apprentices are not only vital to this sector, but to all sectors and the future of Scotland’s workforce more generally.

We need to carry on supporting more opportunities for people to come through that are properly qualified and have the necessary skill sets. We will continue to do that with modern apprenticeships. In particular, it’s positive to see continued growth in the number of electrical apprenticeship starts.

But uppermost is that we must make sure that people are confident that anyone doing work for them is the appropriate person and knows what they are doing.

What is the Scottish Government’s position on making it an offence to install electrical work when unqualified to do so?

We will look at this issue through the working group I mentioned above.

Scottish Government civil servants are liaising with the sector and will communicate back to me. My door is always open and I will speak to any

representative body or employer who wants to discuss this. We really need to know what the ramifications would be.

For example, if someone decided to do work in their own house we couldn’t stop them, whether or not they were qualified. There are questions around making such action a criminal offence and protecting the status of electricians and I have an open mind on these matters. But ultimately, any decision made must be proportionate, focused on supporting the sector and, above all, help make sure that work carried out in a home, business or public building is done to a safe standard.

And finally, what is the Scottish Government doing to encourage more electrical apprenticeships?

I am proud that since the SNP came into government we have supported more than 250,000 people through a modern apprenticeship. In 2017/18 alone, we had a record year and this year we have a target of 28,000 new starts across all modern apprentice frameworks.

The good news is that we are on track to meet our target of having 30,000 starts in 2020. We are doing what we can to support young people – and also older people – to get the chance to gain an apprenticeship. Needless to say, construction and the electrical industry are an extremely important part of that progress.

Designed to keep Members at the cutting edge of next-generation technology, the new City & Guilds course was delivered in partnership with West College Scotland.

A total of 28 delegates attended four separate courses at the college in Paisley, East Renfrewshire, in August and September, each made up of two training days.

By the end of day two, the eager learners were able to understand and apply selection, installation and commissioning of electric vehicle charging equipment in domestic, commercial and industrial locations.

he unsung heroes who keep the nation switched on had their moment in the spotlight at the SELECT Awards 2018.

Professionals and companies from every part of the country gathered in Glasgow on 12 October to find out who’d won the industry’s most eagerly-anticipated honours.

Held at the city’s Radisson Blu Hotel, and expertly hosted by broadcaster Shereen Nanjiani, this year saw the top award split into three categories – Best

n outstanding and highly-regarded figure whose early years were spent in the crucible of British industry was honoured by his peers with the Lifetime Achievement Award.

The award recognised the long, varied and distinguished career of David Smith, who was President of SELECT between 2005 and 2007.

In a lifetime which saw David work in national enterprises such as British Steel before setting up in business for himself, the current Central Board Member always made sure that he could find time for others, particularly in the fields of training and skills.

Accepting his award from Neil MacEachern of sponsors Schneider Electric, David told the assembled

guests: “I’ve enjoyed my time with SELECT. I’ve met some wonderful people and realised I’m in a wonderful industry.”

ife Council reinforced its track record of excellence in training young people when one of its rising stars lifted the Apprentice of the Year award. Blair Hendry, 22, who works out of the Glenrothes depot, beat off competition from hundreds of other young hopefuls who are making their mark in the highly technical sector.

He said: “It’s a great honour at being recognised in this way. My employer, Fife Council, has always been supportive and encouraging in my apprenticeship and I am excited about working in a technologically developing sector which will allow me to put my skills to good use.”

The award follows a previous success for the council, which also saw one of its apprentices win in 2013.

Now we go through the fifth test in the test sequence and the first ‘power on’ test – earth fault loop impedance (EFLI)

B

efore carrying out the EFLI tests, it is important that the inspector is aware of Regulation 612.8.1 a) which requires that the effectiveness of the measures for fault protection by automatic disconnection of the supply (ADS) should be verified and comply with Regulation 411.4.

This requires, for a TN system, (1) measurement of the earth fault loop impedance (Zs), and (2) confirmation that the characteristics and /or effectiveness of the associated protective device are satisfactory and also verification that automatic disconnection will occur within the

maximum times given in Chapter 41.

For a TN system, the maximum disconnection time for a final circuit with a protective device rating not exceeding 32 A is 0.4 seconds (as per Table 41.1) and for a distribution circuit and a circuit with a protective device with rating exceeding 32 A is 5 seconds (as per Regulation 411.3.2.3).

To achieve ADS within the maximum time, a low EFLI is therefore essential to ensure that sufficient current flows to earth during a fault to operate the overcurrent protective device and disconnect the supply. Protective earthing is installed for this purpose as required by Regulation 411.3.1.

In a TN system the protective earthing usually comprises a connection to the distributor’s earthing system via the earthing conductor to the main earth terminal of the installation which provides for connecting the circuit protective conductors (cpcs) of the circuloch gaits.

Note: Protective equipotential bonding is also normally required within an installation to connect the main earthing terminal to extraneous conductive parts such as water and gas installation pipes. The purpose of this bonding is to limit the magnitude of voltage which may appear on these parts during an earth fault before ADS occurs.

The protective earthing is part of the overall earth fault loop path of a circuit and consists of, from the point of a fault: the circuit protective conductor, the consumer's earth terminal and earthing conductor, and for a TN system, e.g.

For example, where Ze has been measured and the (R1 + R2) of the circuit is obtained using test method 1 for cpc continuity the inspector can simply calculate the Zs value using the formula Zs =Ze + (R1+R2).

It can be seen from the diagram above that the earth fault loop impedance comprises two parts: 1) The earth fault loop impedance external to the installation (Ze) and 2) The resistance of the line conductor and the resistance of the circuit protective conductor of a circuit combined (R1+R2).

The earth fault loop impedance can therefore be determined where Ze and (R1+R2) are known values.

impedance values are provided in Tables 41.2, 41.3 and 41.4 of Chapter 41 of BS 7671.

Tables 41.2 and 41.4 are specific to fuses while Table 41.3 is relevant to BS EN 60898 Type B, C and D circuit breakers.

The inspector must have knowledge of these tables and also of the information contained in Appendix 14 of BS 7671 which provides guidance on “measurement of earth fault loop impedance and consideration of the increase of the resistance of conductors with increase of temperature” due to load current.

EFLI testing is normally carried out at ‘no load’ with conductors at ambient temperature.

To allow for the increase in resistance due to load current the ‘rule of thumb’ method suggested in Appendix 14 is to reduce the maximum tabulated Zs values in BS 7671 by 20 per cent – i.e. the tabulated value multiplied by 0.8 – for comparison with the measured values, to ensure that ADS will occur during ‘on load’ conditions.

The inspector may alternatively simply refer to information on EFLI in the IET On Site Guide where the tables given in Annexe B of this useful publication have been adjusted to approximately 80 per cent of the maximum values given in the Tables 41.2, 41.3 and 41.4 of BS 7671.

Assessing the earth fault loop impedance values

Overcurrent protective devices have different operating characteristics which depends on the type and current rating of the device, e.g. BS EN 60898 circuit breaker or BS 88-2 fuse.

To ensure there is sufficient fault current to cause operation of the particular device it is important that the EFLI value for each circuit does not exceed the maximum value for the particular protective device at the origin of the circuit.

earth fault loop impedance test instrument or a multi-function test instrument.

Some manufacturers of test equipment produce EFLI test instruments which can provide test options and this may be useful to the inspector if testing circuits where RCDs are connected. The options are either to use a test which passes a high current through the EFLI path or to use a test which passes a much smaller current.

The high current EFLI test usually passes a test current of anything from about 2.5 A up to 25 A depending on the model of test instrument being used and obviously this amount of current would trip any RCD in circuit therefore the other option where available (the no-trip setting) should be selected. This passes a test current of only 15mA which allows measurement of Zs without tripping the RCD in circuit. There can, however, be disadvantages to this, as the value obtained can sometimes appear inaccurate compared to other methods of determining the value. This inaccuracy could occur when testing circuits when there is a significant amount of mains borne interference.

The inspector should consider the above and ensure that the appropriate EFLI option is selected prior to testing and also remember that on some test instruments you may also need to select the line to protective earth (L-PE) function to test the EFLI path.

The first part of the test is to verify the Ze (that part of the earth fault loop impedance path external to the installation).

This can also be determined by enquiry to the supply distributor (DNO), who is required to provide this information on request under the Electricity Supply Quality and Continuity Regulations 2002. Typical industry values that are quoted for the two earthing systems that the DNOs provide are ≤ 0.8 Ω for TN-S systems and ≤ 0.35 Ω for TN-C-S systems.

Where Ze is obtained using this method it is, however, recommended that a test is also made to ensure the distributor’s earth terminal is actually connected to earth.

Where the low test current EFLI test option is selected, three wire test leads will be used and fused test probes should be used on the test leads applied to the line and neutral conductors with a crocodile clip accessory for connection to the protective conductor.

Next ensure that the main switch or switch disconnector at the relevant distribution board is switched off and that all circuit protective devices are also switched off.

To measure Ze

To ensure it is the distributor’s earth that is being tested, the inspector should disconnect the main earthing conductor from the main earth terminal. This ensures that the installation is not connected to earth through an alternative path provided by a connection to a gas installation or water installation pipe.

Note: It is also important to remember to reconnect the earthing conductor on completion of the test before proceeding with further EFLI tests on final circuits.

A fused test probe is then connected to the line conductor on the supply side of the switch disconnector, with test probe connections also made to the supply neutral terminal and to the earthing conductor.

When the test button is pressed, the measured value will be displayed and should be recorded as the Ze for the installation at the top

left-hand side of the schedule of test results.

Again, note that on some makes of test equipment the EFLI test proceeds automatically when the test probes are applied.

On larger installations, the measured earth fault loop impedance external to sub distribution boards remote from the main incoming supply will not be the Ze value for the installation and is normally referred to as the Zs at DB. Larger installations would also be TP & N and will therefore require the EFLI tests to be carried out on each of the incoming line conductors L1, L2 and L3 with the highest value of the three values obtained being the one that is recorded.

On smaller single-phase installations, however, the distributor’s incoming supply is generally located close to the consumer unit so EFLI measured here can be regarded as the Ze of the incoming supply.

To determine Zs

The second part of the earth fault loop impedance test is to determine the earth fault loop impedance (Zs) at the furthest part of each circuit.

If the inspector has measured the (R1+R2) of the circuit earlier in the test process, i.e. during test method 1 when testing continuity of cpcs, the inspector can simply add this value to the Ze or Zs at DB value and record it on the schedule of test result as the Zs of the circuit.

Alternatively, the inspector can measure Zs using the earth fault loop impedance test instrument connecting it to the furthest part of the circuit.

Again, as before, safety is very important during this live test so only switch on the circuit to be tested for the time necessary to carry out the test.

The test probes are then applied at

the connection point located at the furthest part of the circuit and the test button on the test instrument operated. If using the no-trip test it may take slightly longer for measurement and display of the value than if testing using the higher test current setting. When the EFLI value has been obtained record it in the appropriate column given for this in the schedule of test results.

As an example, the inspector carries out an EFLI test on a final circuit protected by a 63A BS EN 60898 Type B, circuit-breaker and obtains a value of 0.37Ω at the furthest part of the circuit.

To verify that this value satisfies the requirements to achieve automatic disconnection of supply and that disconnection will occur within the required time a check against Table 41.3 of BS 7671 for the maximum permitted value, which is then adjusted for temperature, is carried out.

For a 63A BS EN 60898 Type B CB this is given as 0.69 Ω. This value would have to be adjusted by a factor of 0.8 to allow for theoretical increase in temperature due to load current, giving a corrected value of 0.552 Ω.

Therefore, given that the maximum value of 0.69 Ω is greater than the measured value of 0.37 Ω the result of the test is satisfactory! Alternatively,

we could have referred to the temperature adjusted values given in the IET On Site Guide Appendix B Table B6 – this identifies the maximum value as 0.56 Ω (the value having been rounded up) so again comparing the measured value to this it is verified as being satisfactory.

The inspector can then proceed to complete EFLI tests for each circuit connected to the distribution board as outlined above.

Note: The intention of this series of technical articles is to provide guidance for those undertaking Section C of the final integrated competence assessment (FICA).

The FICA is at present based on the requirements of BS 7671:2008 + A3:2015 and therefore the remainder of this series of articles will reflect the requirements of this particular version of BS 7671 which remains in effect for design purposes until 31 December 2018.

s part of SELECT’s ongoing commitment to fostering strong ties within the local community, this summer we welcomed two high school students to complete a four-week paid internship as office assistants, organised through leading charity Career Ready.

Career Ready runs a two-year mentorship programme focused on introducing students to the world of work, expanding their career horizons, building skills and increasing selfconfidence. Each student is paired with a mentor in a local business who will support them as they work through the programme.

The students attend masterclasses, run by Career Ready, during school hours on topics such as personal

branding, interview skills, and communication and networking. In the summer following the first year of the programme, the students attend a work placement at their mentor’s workplace, which allows them to put into practice what they’ve learned during the previous year.

Charlotte Hickey, 16, from Beeslack High School in Penicuik, Midlothian, and Catherine Watret, also 16, from Penicuik High School, signed up for the Career Ready programme last year.

Having been mentored by SELECT Accountant Jenny Petrie and Benefits Adviser Michelle Courtney, they’ve just completed their paid internship.

The duo had the opportunity to work in various departments and understand the work of SELECT in more detail, being trained up to complete tasks in a range of departments including Reception, Membership and Communications, Training, Benefits and Employment Affairs.

Following our recent series of articles about payments and contracts, Members have bombarded our expert with questions about a wide range of matters. Here, we answer some of the most common queries

Are there any regular conferences on contract updates?

Yes, on 14 November the SBCC is holding its Annual Update Conference in Glasgow which will cover a whole raft of very interesting topics. It’s well worth attending to hear a range of interesting speakers. Contact the SBCC for more details.

I’ve heard about contracts from the Scottish Building Contracts Committee (SBCC), but where can I get them?

The SBCC website will give you a list of published SBCC Building Contracts, try www.sbcconline.com – you can also obtain them from the RIAS or RICS Scotland. You can also subscribe to the JCT website and get regular updates and newsletters.

We’ve been criticised recently for not giving proper notices in accordance with the sub-contract.

Is that a problem for us?

The answer to that is yes, and potentially a big one. If you look at any sub-contracts you’re getting, then read the provisions for notices very carefully – they’ll tell you what you 42

need to do and when, and in what format, so follow them to the letter.

The SBCC contracts require you to give notices for a number of events.

The contracts will tell you what the addresses for notices are, and to whom they should be sent, and when they should be sent. When I am acting as an adjudicator, one of the most common defences to a claim is that one party has not given proper notices in accordance with the contract or the sub-contract, so you have to make sure that your procedures are in order. The answer is to have template letters in

your company that the contracts and commercial mangers can use on a regular basis, and that will keep you right. Don’t worry about whacking these in continually. You are entitled to give notices, so do it!

In some of your articles in CABLEtalk, you mentioned how important it was to keep records.

Any further advice?

Yes, always keep plenty of records on your project. This will range from a record of daily resources on site, plant and equipment, signing-in records etc, records of inclement weather etc.

Record what work faces your resources are on, plus any situations where you can’t get access into work faces and/or you’re being held up by other trades. Record issues where you’re being disrupted including dates, and resources involved, and the time involved etc, and follow the notice procedures above. I encourage clients to also keep photos and/or videos of progress and disruption. I had a recent experience of a sub-contractor submitting a daily site audit report

time where a supervisor went round the site every day, and took photographs and e-mailed them to the contractor to record issues. It was of great assistance when we put a claim together for an extension of time. There is an app you

can get called Site Audit Pro that is very useful to capture on-site events.

We’ve started a new contract and the contractor missed the first payment dates. What should we do?

Don’t worry about that, and keep up the bombardment. The contract says you have to give notices so keep doing it. It’s a two-way street and the employers design team won’t hesitate to tell you that you are in delay, so just protect your corner.

The answer is to make plenty of noise. In previous articles, I’ve stressed the importance of having an agreed schedule of payment dates in your contract, so if you’ve not done this then my advice is to do this right away, and get the contractor to agree to this.

This schedule will show the application date, the due date, the final date for payment and the date when pay less notices have to be issued by. I cannot stress how important this is to protect your business. Take a robust approach to non, or delayed, payment.

What about bombardment?

We’re getting complaints from an employer that we’re bombarding them every day with notices of delay.

We keep getting told that payments are on account.

This is becoming an increasing problem, in my opinion. I have seen a number of situations recently where during the contract period, the contractor and sub-contractor agree the measurement and valuation of work in progress, then at a later date the agreed values are reduced, particularly if a dispute arises. I have seen some real horror stories in the last two months where thousands

This is another common problem these days. One important thing to do is to take photos before the work gets covered up. Also, deal with the issue now and don’t leave it for another day. Identify the problem, assemble the drawings and specifications etc.

You may just have to remove and redo the work in question and argue it out at a later date. One thing I would do is to get input from the manufacturer and/or a consultant, for example an independent expert architect, and get a report from them. I did this for a client recently and we were able to prove that the alleged defective workmanship was actually a design fault. of pounds have been taken off after the value of works on site had allegedly been agreed. I think all you can do is to keep writing and say: “The value of this variation is agreed between the parties at £xx” or words to that effect. And finally…we’re finding life in the construction industry is getting tougher. Are we alone?

No you’re not – we’re seeing an increasing number of payment and cash flow issues emerging. One really worrying issue is the fact that final account disputes are now being referred to adjudication, and in many cases the contractor will be looking for the repayment by the sub-contractor of monies previously paid to them. What is wrong with our industry that professional quantity surveyors and contractors cannot meet and agree a final account? It is truly shocking and unacceptable.

As the second reading of the Retentions Bill draws closer, politicians need to really listen and understand the seriousness of the payment problem across construction

nsolvencies in the construction industry in the UK have soared since the collapse of Carillion.

According to figures from the Insolvency Service, the first quarter of 2018 was one of the worst quarters in recent times for construction insolvencies.

During this time, some 780 companies went into insolvency, representing a 20% increase on the same quarter in 2017. And in the 2017/18 financial year, there were a 44

total of 2,764 insolvencies – that’s up 6% on the previous year. The UK Government’s Official Receiver and his ‘special managers’, PWC, are still trying to assess the total liabilities of the Carillion Group. For the group as a whole – which includes Carillion Construction – liabilities are likely to exceed a staggering £15 BILLION. We may have to wait until next year before we get any firm idea of the sum that was owed to trade creditors and how much of that represented retention monies. But against this background, the balance sheets of our major contractors continue to show increasing amounts of debt.

Payment records revealed

Large companies are now under a statutory duty to report twice yearly on their payment performance, thanks to The Reporting on Payment Practices

and Performance Regulations 2017.

These companies are required to publish their standard payment terms and the extent to which they pay late beyond those terms. This information can be accessed via a UK Government website, but our table above right sets out the top 10 worst payers.

However, the figures published by these companies are unlikely to represent the true picture. Indeed, it’s likely to be even worse because most will no doubt claim they’ve paid on time, even though they’ve withheld monies that were otherwise due because of some dispute.

Also, they may claim they’ve paid on time the amount they considered due because the application was either not submitted on time or not accompanied by sufficient supporting documentation.

Challenging lengthy payments

SELECT has recently published the results of a Members’ survey showing – unsurprisingly – that 30-day payments remain the exception rather than the rule.

SELECT Member firms should keep SELECT informed of payment abuse – especially where it occurs on installation or maintenance works for public bodies.

Under the Procurement Reform (Scotland) Act 2014, public bodies must ensure that 30-day payments are made right along the supply chain to Tier 3 contractors. This applies where their construction spend is over £5 million per year.

This 30-day payment requirement applies also to retentions; they must be released within 30 days of the due date for release.

The Construction (Retention Deposit Schemes) Bill 2018

It is exactly three years since the SEC Group’s lobbying secured a commitment from the UK Government to review the practice of retentions. It was also a year ago that the Pye Tait report following the review was published.

The consultation on whether cash

retentions should be protected closed on 19 January this year. Other than those who advocated no change, the consensus was that the practice of cash retentions had to be reformed.

But to date, the UK Government has been slow to act. Instead, it continues to rely on the fact there isn’t a consensus on the best way to reform the practice; there are some who want to abolish it altogether.

The Retentions Bill – or the ‘Aldous Bill’, named after Peter Aldous MP who introduced it – comes up for its second reading on 26 October. To progress, it requires support from the Government. I’ve said repeatedly in this column that ring-fencing cash retentions will have the effect of ending the system over time; if you can’t use the cash there’s little point in asking for it.

Where to now?

Since the Carillion debacle early in the year, insolvencies in the construction industry have soared. In the first quarter of this year there were 780 insolvencies – up 20% over the same period last year. This means that yet more retention monies are being lost.

Almost £1m worth of cash retentions per working day is being lost by firms due to insolvencies upstream of the supply chain.

TRAINING SECTT UPDATE

Talent of the future

The Scottish Electrical Charitable Training Trust (SECTT) once again delivered three successful Get Into Electrical Installation programmes this year, in partnership with the Prince’s Trust, SELECT (Electrical Engineering Training Foundation), Dundee & Angus College, Edinburgh College and West College Scotland. Here’s how the hopefuls fared… before moving on to electrical installation itself.

A week on work placement followed, organised by David Stebbings, SECTT Training Officer for the area. The candidates then spent the last week learning interview skills and CV writing before enjoying a celebration event.

Devon Cook was the contact for the Prince’s Trust both at Dundee and Paisley, working her magic with all the candidates and addressing any issues they had on a daily basis.

The next programme started at Edinburgh College, Sighthill Campus, where 11 candidates started and again 11 finished. The group was terrific and really motivated, with the lecturers noting that they were a joy to have in the workshop.

Deepi Bhardwaj from the Prince’s Trust was on hand to support the group and formed a strong bond with them.

Dundee & Angus College, Kingsway Campus, started us off in March with the first programme, with nine candidates starting and completing the course.

Steve Johnston, the college lecturer, took them through their paces and their enthusiasm was infectious.

The programme saw them spend four weeks at college, covering many aspects of health and safety and basic hand skills,

positive from both employers and candidates. By the time the programme finished, three had secured places on Modern Apprenticeships in full-time employment and those who wanted to were signed up to the electrical pre-apprenticeship programme.

Our last programme to start was at West College Scotland, Paisley Campus. On the first day we had 16 candidates and we finished the course with 12 who all proved to be reliable and hard working.

The group all went to different companies for their work placement and the feedback from both candidates and employers was again positive.

The celebration events that took place at all three campuses were a privilege to attend. Listening to the groups tell the audience about their experiences and life stories was memorable. The family,

friends and employers listening must have been so proud – I know I was!

In all three programmes, the groups all said they had formed friends for life.

I also noticed that when one of the group was struggling, those who were quicker immediately helped to ensure that no one was left behind. This was evident in all three programmes.

Neil Bibby MSP took the time to attend West College Scotland, Paisley Campus, and speak with the group, who were delighted to show him their work in the booths.

We were also fortunate to have a visit from Chloe Smith MP, which was shown in the last issue of CABLEtalk. During her visit, three of the apprentices from the very first programme came along for a chat and told of how it had changed their lives and are now well on their way to becoming electricians.

A number from all the groups will start on the Modern Apprenticeship and for those who wished to pursue a career as an electrician we were able to secure places on the electrical pre– apprenticeship course, which offers an excellent route into employment.

Some decided that becoming an electrician was not for them. However, the skills that they had learned on the course had given them the confidence to pursue other avenues. What more could we ask for?

SECTT is delighted to be partnering with West College Scotland and Skills Development Scotland to offer an all-female pre-apprenticeship early in 2019.

A series of events and awareness exercises will start in October, so watch this space!

Smash and grab: Where are we now?

The 2011 amendments to the Housing Grants, Construction, and Regeneration Act 1996 (‘the 1996 Act’) aimed to improve contractors’ rights to regular payment and encourage the resolution of construction disputes through adjudication. The result? An explosion of smash-and-grab adjudications.

Smash-and-grab is the term given to an adjudication, typically referred by the contractor, asking the adjudicator to find that the notified sum is due. In the absence of valid payment/ payless notices, the 1996 Act determines that the notified sum is that claimed in the contractor’s payment application. The adjudicator’s jurisdiction is restricted to the dispute referred to him, typically the adjudicator will find in the contractor’s favour if payment/payless notices are deemed to be invalid.

Until recently, ISG v Seevic and Galliford Try v Estura Ltd determined that failure to issue valid payment/payless notices, deems the employer to have agreed that the notified sum was the true value of the works. An employer’s remedy was reconciliation in the final account process.

Last month, Grove Developments Ltd v S&T (UK) Ltd smashed through this precedent (pun intended). S&T were employed by Grove to carry out the design and build CABLEtalk

of a new Premier Inn Hotel at Heathrow Terminal 4. Since practical completion in March 2017, there have been three adjudications, with the third deciding that a payless notice issued by Grove was invalid. This meant S&T were entitled to more than £14m, which was the notified sum claimed in interim application 22.

Justice Coulson considered “whether...Grove is entitled to commence a separate adjudication seeking a decision as to the ‘true’ value of interim application 22”. After finding the answer was yes, he concluded there was no basis in fact for the alleged ‘agreement’ of the true value, nor a basis for this under the Act, Scheme or contract.

Smash-and-grabs will likely still be a prevalent tool to encourage employers to pay up but we may now see the use of second true value adjudications by employers.

However, Justice Coulson thought that, following his decision in Grove, bringing a second adjudication would prove too inefficient and costly, and parties might even sit down and talk it out. Given the contentious nature of the construction industry, wishful thinking springs to mind.

I’m the CEO of the Specialist Engineering Contractors’ (SEC) Group, an umbrella body representing the industry’s premier trade associations in the specialist engineering sector. Our member trade associations have combined forces in order to be more effective when campaigning on issues such as improving payment security, changing procurement habits, and driving up standards of health and safety risk management.

An important development in recent years has been the launch of our devolved SEC Groups in Wales, Northern Ireland and Scotland; they’ve become the go-to bodies for the devolved governments. We are now preparing for the years to come, in which we’ll have to meet the challenges posed by Professor John Cole’s report on the Edinburgh schools defects, the Grenfell tragedy, and the Carillion debacle. And then there’s Brexit of course...

I’m aware it hasn’t been immune from the changes brought about by new digital and AI-driven technologies.

But we mustn’t get carried away – BIM was supposed to be transformative and is still to gain significant traction.

What’s a typical day like for you at work?

Every day is different, but let’s look at a recent 24 hours. I live on the Welsh border, so to get anywhere I have to be up early.

I was awake at 5.30am to catch a train to Birmingham, where I spoke at the Midlands Construction Summit. Once question time was over – one delegate insisted 30-day payments would put most major firms out of business – I then headed to London for a meeting of the UK Government’s Carillion Taskforce, of which I’m a member. I’m very keen that the Government should publish the list of lessons learned and actions taken to reduce the likelihood of another Carillion and its impact on the industry.

That done, I finished the day with a business dinner and a night in London.

How have you seen the electrical industry change?

Since I’m not an industry insider, it’s difficult to say. But

Through SEC Group Scotland, SELECT has the added power of the other associations, who lend weight to campaigning on matters relevant to Members.

Favourite holiday spot?

Sardinia, for its truly exceptional food, wine, people and scenery. What more does one want?
