By Camille Shavon Arie Sain was diagnosed with Breast cancerÊ in January 2008.Ê She missed her exam in November 2007 because she was at the hospital with her Mother who suffered 3 heart attacks and remained in ICU. Thus she was thinking of her & not herself.Ê When her mother returned home, she called to reschedule her appointment and was told the only available date was in January 2008. She proceeded to that appointment then after a week received a call from her PCP stating that she needed more test done.Ê An appointment with the Imaging Center was scheduled and after several ultrasounds, she was informed by the doctor that she had breast tumors. Her PCP scheduled a biopsy to confirm if they were benign or malignant.Ê The tissues removed on a Monday were found malignant and she was scheduled to have breast surgery on the following Friday.ÊÊ 16

FAMILY AND FRIENDS AT THE PARK. Everyone had their favorite thing that they enjoyed but I think the antique cars and antique tractors were my favorite. They had these beautiful paint jobs on them and some were as far back as 1929. However, that was just a drop in the hat for what we saw and did. There were arts and crafts, fiddlers, aquariums, food, dinosaurs, civil war tanks and weapons, zip line for kids, old school medicine houses, barns, log cabins, a giant slide and that is just to name a few. Everyone was friendly and the atmosphere was electric but calming at the same time. The landscape is filled with nice flowers that help make the nature walk relaxing and enjoyable whileÊ blooms are all along the paved trail. If you ever want to spend a day on vacation in the Great Outdoors of West Tennessee then Discovery Park is the place for you and you will get back home before dark. Just don’t leave without the kids.

FEDERAL LAWSUIT AGAINST CITY OF JACKSON DISMISSED WBBJ 7 EYEWITNESS NEWS STAFF JACKSON, Tenn. — A federal lawsuit filed by individuals arrested by officers with the Jackson Police Department and charged in Jackson City Court has been dismissed. The lawsuit, filed in February, alleges that the plaintiffs’ fourth and 14th amendment rights were violated during their arrests and detentions. The lawsuit claims the individuals’ rights were violated by warrants, issued through Jackson City Court, which had not been properly sworn by officers. The lawsuit also alleged they were illegally held without a probable cause hearing. Court documents say the case has been dismissed after the court determined the lawsuit was filed after the statute of limitations had expired for four plaintiffs’ complaints about being held over a 48-hour time limit without a hearing, and two other plaintiffs were released before being detained for 48-hours.

HUMBOLDT MAN SENTENCED ON GUN CHARGE WBBJ 7 EYEWITNESS NEWS STAFF JACKSON, Tenn. — A Humboldt man has been sentenced to more than seven years on a federal charge of felon in possession of a firearm. In a news release, U.S. Attorney Mike Dunavant announced the sentence for 34-year-old Matthew Pate. The release says Pate was arrested by the Gibson County Sheriff’s Office in July after deputies responded to a domestic assault complaint. The release says Pate was accused in that case of waving a .380-caliber pistol at his wife, mother-in-law and children. The release says Pate was prohibited from carrying a firearm due to a previous felony conviction for aggravated assault. During the investigation, deputies searched the home and found three pistols and two rifles. One of those guns had been reported stolen, and a second had a serial number that had been partially destroyed. Deputies also found numerous Alprazolam pills in the home. The release says Pate admitted to buying the guns from another person. In addition to his sentence, Pate will serve an additional three years of supervised release.

Jackson Police are investigating an incident involving a school bus from the Jackson-Madison CountyÊSchool System.Ê Tuesday, October 1st,Êat approximately 3:23Êp.m., officersÊof the Jackson Police DepartmentÊwere dispatchedÊto the area of Old Oak Circle forÊa report of a witness who sawÊan individual shooting at a school bus while it wasÊtraveling on I40. The incidentÊwas not originally reported by the bus driver.Ê Officers responded to the area and located the bus in theÊparking lot of the Speedway gas stationÊlocatedÊatÊ2522 Christmasville Road. Upon inspecting the bus and speaking with the driver, investigators located a broken window and a BB from anÊair guninside the bus.ÊBased upon preliminary investigations and witnesses,Êthe BB wasÊallegedlyÊfired from a small white car that was travelingÊnext to the bus which was traveling eastbound onÊI40. ÊThe bus was occupied byÊmiddle and high school students. ÊHowever,Êno injuriesÊhave been reportedÊfrom the incident.Ê Anyone with information about this incident or anyone who may have witnessed the incident is asked to contact the Jackson Police Department at 731-425-8400.

BY JULIA EWOLDT JACKSON, Tenn. — A witness recalled the details of a shooting that occurred in Jackson Wednesday night. Dozens of people watched Wednesday night as Jackson police responded to reports of a shooting and burning car on Middleton Street. Quincy Hawkins was one of them. “It was just chaos,” Hawkins said, “Just people running around and trying to do something. I bet it was eight or 10 squad cars, marked and unmarked, just rushing in in just two or three minutes.” Hawkins captured a video after he came across a car on fire on Middleton Street. “Everybody was rushing to the scene. They pulled the individual out of the car and took him to the other side of the road and were rendering first aid to him and everything,” Hawkins said. Police say two men, identified as 26-year-old Julio Almaraz and 20-year-old Joe Ramirez, were shot Wednesday. One was found on the corner of Middleton Street and Neff Street, and the second was found near Orchard Street and Laconte Street. Police say both men were taken to a local hospital. “Had I known it was more than just an accident, I would have gotten out and probably tried to render some help,” Hawkins said. People say it’s not only scary that they watched this happen, but they also feel like it could have been them since this road is so highly traveled and right next to Lane College. “It could have very easily been me with the guys on the bus or just any innocent individual walking down the street,” Hawkins said. Police say they are looking for a person of interest in the shooting, described as a black male, about six feet tall, wearing a blue shirt and khaki pants. Man arrested in Gibson Co. homicide investigation September 23, 2019ÊÊWBBJ 7 Eyewitness News Staff GIBSON COUNTY, Tenn. — A Milan man is now facing a second-degree murder charge in a homicide investigation in Gibson County. Anthony York, 61, (right) was arrested Monday, September 23, without incident at his home in Milan, according to a news release from the Gibson County Sheriff’s Office. York is charged with second-degree murder in the death of Timothy Jones. Jones’ body was discovered April 2 in his apartment on Bradford Highway. York was identified as a person of interest early in the investigation and was arrested Monday after investigators received preliminary lab results on two pieces of key evidence, according to the release. York is in custody at the Gibson County Correctional Complex in lieu of $150,000 bond. He was scheduled to appear at 9 a.m. October 1 in Trenton General Sessions Court. The investigation is ongoing and more evidence is waiting to be analyzed at the Tennessee Bureau of Investigation Crime Lab, according to the release.

Man lied about carjacking to cover up infidelity, policeÊsay BYÊERYN TAYLOR MEMPHIS, Tenn. —Ê A Memphis man was arrested after police say he lied about being carjacked so he didn’t have to tell his wife about his infidelity. On Monday, officers were called to Barnstable Street where they met Anthony Thomas. The man claimed that two men carjacked him while he was sitting inside his vehicle. After running the license plate information, police discovered that the vehicle had actually been towed from Summer Avenue several hours before Thomas claimed he was carjacked. Officers confronted him with the information and that’s when Thomas confessed to making the entire story up. Former Dallas police Officer Amber Guyger was found guilty of murder on Tuesday forÊfatally shooting her neighbor, Botham Jean, after thinking he was an intruder when she mistakenly entered his apartment. Guyger, who has been out on a $300,000 bond, faces a maximum of life in prison. She was not immediately taken into custody and is awaiting sentencing scheduled for later Tuesday afternoon.

Police: 18-year-old arrested in Family Dollar kidnapping, theftÊcase BYÊERYN TAYLOR MEMPHIS, Tenn. — A Memphis man was arrested after he allegedly stole a vehicle with a small child and a man with a disability still inside. Darion Conley-Rayford, 18, was charged with kidnapping and theft of property. In September, Memphis Police said a white Chevrolet Camaro was stolen from the parking lot of aÊFamily Dollar storeÊon Hickory Hill Road. Witnesses at the scene said a woman left the car to go inside the Family Dollar store. She left her child and adult brother, who has down syndrome, in the car. After the woman walked into the store, witnesses said they saw two men get into the car and drive off. When the car was stolen, the child and adult were still inside the car. Both of them were quickly found safe by police, but the suspects and the car were not located. During the course of the investigation, police said a former classmate of Conley-Rayford’s recognized him and called in the information. Conley-Rayford was arrested on Monday. The second suspect has not been identified.

A FAITH WALK Letitia Turner Lake was diagnosed with breast cancer on Aug .13, 2007. Surgery wss performed on Aug. 27, 2007 and a year of chemotherapy as well as 6 1/2 weeks of radiation were scheduled.Ê She drove herself to and from the clinic treatments with her faith 100% in God. However, in October of 2007 her faith was tested as she was then diagnosed with cancer of the kidney and surgery was performed once again to remove one of her kidneys.Ê “My journey was hard and got even harder but my faith grew stronger,” said Lake.Ê She expressed that she had to ask herself numerous times if she wanted to Win... Well she Won!!!!! ÊToday Letitia Turner Lake is a 12 year Cancer Survivor and says that she is still Depending on God!!!

GOD’S PERFECT TIMING - CONT’D FROM PAGE 2Ê Surgery was performed removing the cancerous tissue and after a follow up visit she was told sheÊ needed to complete a year of Chemo & 38 rounds of radiation. She lost all of her hair during treatment but it has since grown back healthy. “ItÊ is through the Grace of God, I am a Survivor.Ê I know if God brought me to it... I also knew He would carry me through it.Ê Praise God, Hallelujah,” said Sain. Amazingly, the Doctor stated that her cancer cell was so small that if she proceeded with mammogram in November of 2007 as originally scheduled, it may not have been detected, thus it would have been an entire year before another mammogram was scheduled and the cancer would have been worse! She truly believes it was Gods Perfect Timing behind the re-scheduling of her appointment!

WHEN CONSIDERING NUMBERS LOOK FOR CLARITY BEFORE PASSING JUDGEMENT! There has been much that has taken place in education since my last posting in the CSE News! The Madison County School board finally agreed to pursue the property on Ashport Road for the next K-8 school. Let us all hope that the next school board chair will do a better job of communicating and collaborating with the board and superintendent on issues impacting of future and well being of JMCSS. The numbers that were initially introduced and approved over a year ago were the ones that were used to base the current decision to move forward. I urge parents to pay attention to what their elected school board members are doing as their decisions impact the lives of your children as well as the future. Work with administrators, educators, and teachers to align them to take full advantage of the options and opportunities that are currently available as well as the ones to come.

Understanding the numbers. At the combined work session school board meeting; Dr. Jared Myracle had an opportunity to explain the real value of the numbers issued by the state’s “report card.” The 1.3 rating in 2017-2018 was regarded as satisfactory. For the 2018-2019 school year the same 1.3 rating indicated in need of improvement. To the untrained observer this would indicate a regression in progress in the school system. However, Dr. Myracle pointed out the reason for the rating: • Different formula in 2018-2019 • Takes into account Achievement, Growth, English Language Learners, Attendance, Graduation Rate, and Ready Graduate. Now let’s look at School-Wide Growth Composites from 20162017. Madison (5), JCM-ECH (5), South Side (5), Community Montessori (4), and South Elementary (4). 11 schools were a “1” in the composite, literacy, and numeracy categories. 7 schools were at a “1” in all categories (composite, literacy, numeracy, science, and social studies). Here is the data from 2018-2019. Madison (5), JCM-ECH (5), South Side (5), Community Montessori (5), Isaac Lane (4), Andrew Jackson (4), Alexander (4), JCT (3), Northeast (3), Lincoln (3). The district is still a “1” overall, but is moving in the right direction.Ê Context of JMCSS Plan “There are only three ways to improve student learning at scale: 1. You can raise the level of content that students are taught. Entering first year with curriculum in all 4 core areas 2. You can increase the skill and knowledge that teachers bring to the teaching of that content. 3. And you can increase the level of students’ active learning of the content. That’s it…”

Kennedy Not so long ago JMCSS was labeled as a “failing school system.” As evidenced by the accompanying picture (Gov. Lee with Jared Myracle), from his visit to JCM-ECH and L.O.O.P (Local Options and Opportunities Program). Gov. Lee called these programs models that should be replicated in communities across the state. Let’s all celebrate the positives and support the team at the forefront of the progress.

THE RECALL ELECTION SHOULD NOT BE HELD In its last session a few months ago, the Tennessee General Assembly passed legislation that provides for the procedures to be followed to recall school board members in Madison County. The bill was introduced in both houses at the behest of Sen. Ed Jackson and Rep. Chris Todd after some Madison County residents perceived that a bloc of Madison County School Board members failed to adequately support the previous, and now resigned, superintendent of schools. Among other things and as originally filed, any person who resides in the county of which a local board of education member is sought to be removed could file a petition with the county election commission to demand the recall of the local board of education member and the petition could be signed by registered voters of the county of which the local board of education member is sought to be removed if a sufficient number of signatures of registered voters of the county were obtained. During debate in both houses of the General Assembly, a significant number of lawmakers rejected the proposed legislation being applied to their respective counties. Rather than allowing the bill to fail, it was amended to only allow residents of the affected district to sign the recall petition and to apply the legislation to only Madison County. Both the House and Senate passed the revision and the bill became law upon the governor signing it. Using the provisions of this new law, a petition has been filed with the Madison County Election Commission seeking the recall of District 4 School Board member Doris Black. The Commission has set December 10 as the date for the recall election.Ê The recall election should not be held. Why? Because the new law that allows it is unconstitutional.Ê In this state, legislation that is not created pursuant to a private act is unconstitutional if it only applies to one county and not all 95 Tennessee counties. The very clear, precise, and applicable language that prohibits laws of this sort is found in Article XI, Section 9 of the Tennessee State Constitution, which states, in relevant part: [A]ny act of the General Assembly private or local in form or effect applicable to a particular county or municipality either in its governmental or its proprietary capacity shall be void and of no effect unless the act by its terms either requires the approval by a two-thirds vote of the local legislative body of the municipality or county, or requires approval in an election by a majority of those voting in said election in the municipality or county affected. In other words, the constitution allows for the creation of a law to recall a school board member that applies only to Madison County, but for this to be accomplished and for it to be legal and constitutional, the enabling legislation, by its terms, must require the approval of a two-thirds vote of the Madison County Commission or approval by a majority of the voters of Madison County. Not only has there been no approval by two-thirds of the members of the Madison County Commission or a majority of the registered voters of Madison County, there has been no vote by either body regarding Sen. Jackson’s and Rep. Todd’s legislation. This is the fatal flaw of their legislation.Ê In the 2012 federal case of Board of Education of Shelby County, TN v. Memphis City Board of Education, U. S. District Judge Sammy H. Mays was asked to determine the constitutionality of a state statute (Public Chapter 905) that had been passed by the legislature and enacted into law. He found that the statute was unconstitutional. In the headnote of the case, the following appears under the key entitled: Statutes—General laws compared and distinguished: In considering whether a statute applies “throughout the State,” within meaning of applicable provision of Tennessee Constitution, courts must decide whether the legislation was designed to apply in any other county in Tennessee, for if it is potentially applicable throughout the state, it is general legislation, but if legislation was not designed to apply to any other county in Tennessee, it is local legislation that is void without provision for local approval. West’s T.C.A. Const. Art. 11, § 9. In his ruling, Judge Mays wrote that “although general in form, Public Chapter 905 is local in effect. Because it does not include a provision for local approval, Chapter 905 is VOID under Article 11, Section 9 of the Tennessee Constitution. All actions taken under the authority of Chapter 905 are VOID.”Ê Likewise, the law promoted by Sen. Jackson and Rep. Todd is local in effect. It only applies to Madison County. Therefore, because it does not include a provision for local approval, it is void under Article 11, Section 9 of the Tennessee Constitution. The rule of law and procedure is to be followed by all citizens…even state senators and representatives. It is regrettable that a lawsuit is now necessary to correct errant procedural processes that were enacted by those who knew or should have known better.
