# Règlement / sale rules

1-OBJECT On the occasion of BRUNE 2016, BGS and Union Génisses des Pyrénées co-organize a Public Auction Elites Heifers, called «CREAM OF THE CREAM». It will be held Friday, April 8, 2016 from 5.30pm on the place of Foirail in Mende. The rules apply to everyone, Sellers and Buyers for what concern under penalty of exclusion or banned.

2-CATALOG The animals are presented by growing age order. Indexes are the latest available at the time of printing the catalog, both for the mothers of heifers and their fathers. Lactations mentioned are those known reference. For protein, the rate listed in the catalog is the total protein rate, calculated by dividing the protein content by 0.95.

3-QUALIFICATIONS 3.1 - ORIGINS AND LIVESTOCK QUALIFICATION Animals presented for sale are holding a Declaration of Birth and receivable are recorded in an official herd book. The information contained in this catalog are from pedigrees issued by BGS. Regarding the French

animal data is extracted from breed file.

3.2- HEALTH GUARANTEES The animals offered for sale meet the health requirements for participation in the EUROPEAN SHOW MENDE 2016 and will be in perfect condition on the day of arrival.

- For IBR-IPV and BVD the sale is made under a «Conventional Warranty Ticket» which requires the seller to return the animal to its load in case of positive reaction when performed purchase control by the Purchaser within the time limit.

Moreover animals offered for sale have: a) Regarding the Neosporosis, a negative result (screening by ELISA serology). b) With respect to the paratuberculosis: - For animals less than 18 months, a negative result of the natural mother or recipient if it is from an embryo transfer (screening by ELISA serology).

- For animals aged 18 months or older, an individual negative result (screening by ELISA serology).

# Règlement / sale rules

4-SELLERS The animals offered for sale are the responsibility of the breeder and seller are sold with guarantees of ordinary law. Every sellers will be required in the event of resolution of sale for any reason whatsoever, to reimburse the buyer fees and sales fees and all expenses incurred to the acquirer for the conservation of the object in dispute in France.

Any seller breeder agrees to bring the animals during the day of April 6, 2016. It also agrees to comply with these regulations and pay BGS to the sum of 100 Euros before tax proposed by animal for sale under right registration covering in particular the publication of the catalog, promotion, maintenance and preparation of animals as well as insurance specified in paragraph 6 below.

5-TERMS OF SALE Anyone wishing one or more lots may become the purchaser provided they have prior to this operation, read these regulations published in the auction catalog, to honor all the provisions and to pay in cash the amount of purchases all fees (bonds or evidence of solvency may be requested).

The sale is a sale to Public Auction will be according to the system of progressive auction. According to the law, the auction will be given in Euros legal. The minimum auction price will be determined for each lot, with the seller before the sale. Any animal that does not reach this price «withdrawal» will remain property of the seller except public intervention and immediate it would make his acceptance of the sale to the hammer price.

BGS and UGP expressly reserve the right to have the same day, for resale on false bidding of an animal which the purchaser would prove faulty or not.

The price given at the auction are prices excluding VAT is included. The buyer will be charged the animals at auction price plus selling charges amounting to 7% (price without tax). Non awarded animals for sale and would be sold privately during the event will be channeled through the Union Génisses des Pyrenees and 7% sales charge will also be applied to buyers.

6-PROPERTY, LIABILITY Once the sale is made the responsibility of the animal passes from seller to buyer.

The buyer is obliged to acquire all of the animals entrusted to it. There can be no recovery or deduction price.

Retention of title: the animal remains the property of the seller until full payment of the price (80.335 Act of 12 May 1980).

Any animal, object of this sale is provided by BGS, (organizer) for any damage they may suffer in case of accident and only in this case, during the precise period elapsing when the animal raises its four feet on the floor of the European show in Mende on his arrival April 6, 2016, and the moment he sets foot on the vehicle (bridge or other party) in his departure from this trade fair April 10, 2016.

Outside the accident and the period defined above, the responsibility of the animal vis-à-vis third parties and for damage to, rests with the seller before the auction and the buyer after the possible award.

7-REMOVAL AND TRANSPORT OF ANIMALS Animals can be removed the same day of the sale, and in any event no later than April 10, 2016, at the end of the EUROPEAN SHOW. The conditions should have been met prior (cash, deposit). The removal and transportation of animals are the responsibility of the buyer and can be organized with the assistance of officials of the sale; in this case the transport costs will vary depending on the number of animals and the distance. Specific exemptions may be defined with foreign buyers to house animals prior to export.

For a pregnant heifers calving Insurance may be contracted with UGP for interested buyers.

8-LITIGATION Disputes that may arise in favor of the sale, particularly in the application of this Regulation shall, as far as possible, be settled amicably with the parties concerned; if only the courts of UGP head office will be competent. This condition is critical.

Any foreign buyer wishing to acquire the animals may subject to compliance with the foregoing shall: all additional services (accommodation, additional health examinations, transport) will be borne and therefore charged in addition to the hammer price. Any bidder on behalf of a third party will be responsible for its purchase in the event of failure of its principal.

All payments should be made to the Union Génisses des Pyrenees and will be charged in full to the net invoice amount.
