WHEREAS, County is eligible for and receives federal funds pursuant to Public Law 106343, as reauthorized and amended by Congress, commonly known as the Secure Rural Schools and Community Self- Determination Act of 2000 ( the " Act"). IT IS THE PURPOSE OF THIS AGREEMENT to provide the County' s Title III funds to FIRE 7 to reimburse actual expenditures related to emergency response on federal forest lands that lay outside of the boundaries of FIRE 7, as more particularly described herein. THEREFORE,

IT IS MUTUALLY AGREED THAT FIRE 7 shall furnish the necessary

personnel, equipment, material and/ or service( s) and otherwise do all things necessary for or incidental to the performance of the work set forth in this Agreement. TERM OF AGREEMENT

The term of Agreement shall be January 1, 2026 through September 30, 2026. PAYMENT

During the term of this Agreement, in consideration of the performance of services to be provided by FIRE 7, County agrees to reimburse FIRE 7 for actual direct and related indirect costs not-toexceed maximum

amount of Seven thousand and no/ 100 Dollars ($ 7, 000).

Reimbursement under

this Agreement will be based on billings, supported by appropriate documentation of costs actually incurred.

FIRE 7 will submit detailed information to support the reimbursement request in

accordance with this Agreement. It is expressly understood that claims for reimbursement will not be submitted in excess of actual, immediate cash requirements necessary to carry out the purposes of the Agreement.

FIRE 7 will, at such times and in such forms as the County may require, furnish the County periodic reports as it may request pertaining to the work or services undertaken pursuant to this Agreement, the costs and obligations incurred or to be incurred in connection therewith, and any other matters covered by this Agreement.

1

Payment

shall include

reimbursement

of actual

expenses

incurred for wages and benefits of FIRE 7 employees, volunteers or contractors and other direct

and indirect costs associated such services, while training for, responding to and performing emergency services while on federal forest property or on lands immediately adjacent to the federal forest. Program income earned during the reporting period must be shown on the next invoice and deducted from the amount billed during that period.

The County has the right to withhold payment pending receipt of documentation sufficient to detail that such funds are being used for the authorized purposes as specified in this Agreement. Partial payments may be made. REPAYMENT

Payments will not be unreasonably withheld.

GUARANTEES

In the event that federal funds have been disbursed

to FIRE 7 and the funds are not used for the

intended purpose, FIRE 7 hereby guarantees that it will refund to the County all such proceeds disbursed

to it, together

with accrued

interest

at the same rate as if the funds

had been

invested

with the Washington State Local Government Investment Pool, provided that FIRE 7 may deduct such amounts

as it shall have expended

through the date on which a decision

is made that the

funds are not needed. RECAPTURE

In the event federal funds have been disbursed to FIRE 7 and FIRE 7 fails to comply with the terms

of this Agreement or to comply with applicable federal and state laws, County reserves the right to recapture funds in an amount necessary to compensate

County for the noncompliance,

in addition

to any other remedies available at law or in equity. This paragraph shall survive any termination, expiration or determination of invalidity of this Agreement in whole or in part. DISALLOWED

Appendix STATEMENT

A

OF WORK

Work Summary: Under direction of SPONSOR, crew( s) will perform restoration activities. Specific tasks could include invasive control, native species installation, plant nursery care, scientific monitoring, trail maintenance/ construction and fence installation or repair. Special terms and conditions:

1. WCC resources ( members, supervisors, tools and trucks) will not be utilized to clean public restrooms, monitor, survey, or clear active or abandoned encampments, and/ or to clean up hazardous materials including hypodermic needles. If a significant amount of hazardous or unidentifiable material is discovered on a project site, activity will cease until SPONSOR mitigates potential hazards or finds an alternate project site. If active or abandoned encampments prevent WCC activities from taking place at a project site, WCC supervisors and members may contact their partner organization and work with their coordinator on alternative activities. While WCC can share active or abandoned encampment information with project partners when relevant to service activities, WCC personnel will not monitor, survey, or report on encampments directly to regulatory agencies or anyone other than a partner organization.

2. WCC vehicle is not to be used for heavy hauling; the primary use is for transportation of crew, tools, and safety equipment. In the event that WCC vehicles are requested to tow SPONSOR- provided equipment( including rentals), it will only be on a limited basis and SPONSOR is solely responsible for accidental damages, unless damages are caused by WCC negligence.

3. WCC is not responsible for normal wear and tear when project requires the use of SPONSOR- provided tools, equipment, or safety gear.

4. The assignment of members shall not result in the displacement of currently employed workers, including partial displacement

such as reduction

in hours of non- overtime work, wages, or other employment

benefits. Agencies that

participate in the program may not terminate, lay- off, or reduce working hours of any employee for the purpose of using a member with available funds. In circumstances where substantial efficiencies or a public purpose may result, participating agencies may use members to carry out essential agency work or contractual functions without displacing current employees.

5. All state holidays and shutdown weeks are non- working days for members. Shutdown weeks are to be used by WCC staff/ supervisors for planning purposes. The WCC standard 40- hour schedule is Monday through Thursday from 7: OOam to 5: 30pm. An alternate schedule may be arranged with prior approval from the WCC. 6. WCC' s cost- share rate is calculated using the full costs of supporting WCC crews and IPs, including time spent training, required

community

service

events,

shutdowns,

etc.

Indirect

costs are

included in SPONSOR

share

at a standard

rate

of 5% of

direct costs.

7. If inclement weather, including hazardous air quality, makes a project site inaccessible, then the sponsor should reassign the WCC crew or IP to alternative projects in an accessible location. In inclement weather, WCC crews follow the weather- related guidance ( e. g. shut- down, delayed start, early end, etc.) from the regional Ecology office closest to the crew lock- up or IP service location. If the member' s assigned location is more than one hour from an Ecology regional office, then WCC follows weather- related guidance of federal, state and local governments. Only WCC can instruct a crew or IP to shut- down due to weather. Sponsors are not charged for WCC- initiated, weather related shut- downs or delays.

If a shut- down is requested by the SPONSOR for any reason, then the sponsor is responsible for crew costs. Appendix

ECOLOGY shall: 1. Provide WCC members for the number of weeks specified

in this agreement.

Full- term crews and Individual

Placements

are available to SPONSOR for a maximum of 170 days ( approximately 46 weeks) during program service year( OctoberSeptember).

2. Enroll full- term members to begin service no sooner than October 5, 2026 and no later than October 19, 2026. Any further member enrollment for the remainder of the program year is at the discretion of ECOLOGY and based on availability. 3. In the event of a disaster response deployment, ECOLOGY will make every effort to fulfill SPONSOR needs, including sending additional members, whenever possible. Unless disaster response activities are requested by the sponsor, sponsors are not charged for WCC' s emergency and disaster responses. 4. Provide training and development specified in Appendix B: eight days of formal WCC training, a two to four day Orientation Training, day of training in noxious weed control, and one day for a debrief meeting near the conclusion of the term. Beyond dates included in Appendix B, Ecology will schedule up to six additional days of Supervisor training or meetings during the term. WCC members and supervisors are logging hours on the dates identified for WCC- sanctioned events, but are unavailable to SPONSOR. ECOLOGY will provide a four day Assistant Supervisor training to the designated Assistant

Supervisor.

5. Each full- term crew or IP may spend up to two weeks( eight days) with an alternative sponsor during the crew year. These dates will be determined

6. For crews, ECOLOGY agrees to provide a crew of 5 members, a crew supervisor, vehicle, and basic hand tools. Rates are not based on actual attendance, however, invoices will be reduced for member or supervisor vacancies and absences lasting 20 days or more. If a crew has two or fewer individuals available to serve, ECOLOGY will not bill for that service day. 7. If members are enrolled in AmeriCorps, then these policies and procedures are in place: a. Members enrollment start and end dates will reflect the timeframe to complete a 1700- hour, full- term service

year, a 1200- hour, three- quarter service term year, or a 450- hour, quarter service term year, in order to receive an AmeriCorps

Education

Award.

b. WCC members will have one day dedicated to Community Service, listed in Appendix B. SPONSOR shall:

1. Guide completion of appropriate projects for number of weeks specified in this agreement by providing logistical, technical and safety- related support necessary for project completion. WCC will provide camera- ready logo. 3. For a SPONSOR hosting Individual Placement positions, SPONSOR agrees to provide computer access, email, transportation to and from WCC events( or private mileage reimbursement), and day- to- day direction of activities. 4. For a SPONSOR hosting full- term WCC Crew( s), SPONSOR shall provide a secure site to store tools and park crew vehicles that allows access to potable water and restrooms as well as desk and internet access for the crew supervisor. In the event of theft, vandalism, or loss due to negligence of the SPONSOR, the SPONSOR shall provide reimbursement( 75 percent sponsor share) of expenditures

and deductibles.

5. For a SPONSOR that assigns WCC crew( s) or WCC Individual

Placement

members to serve with other organizations,

SPONSOR shall inform the other organizations of WCC policies, procedures and contract terms.

Please have a representative available for questions at the Washington State Noxious Weed

Control Board Meeting July 18th, either in person or via Zoom. Zoom login information will be sent out prior to the meeting. Proposals without representation will not be considered. Please provide brief background information about the lead organization and partners:

Cowlitz County Noxious Weed Control Board protects land within Cowlitz County from the degrading impacts of invasive and noxious weed species by educating citizens to be responsible stewards. Our program participates in community events, surveys for noxious weeds, enforces

RCW 17. 10 as appropriate, advises property owners in controlling noxious weeds, and implements noxious weed control projects funded by grants. Our land-owning partners in the project areas include private farmers and residential properties, a local soil manufacturing business, two major forestry companies, BNSF, and many public agencies: City of Kalama, Cowlitz County, Port of Longview, Port of Woodland, Three Rivers Wastewater Treatment, Washington

Department

of Fish&

Wildlife, Washington Department of Natural Resources,

Washington State Department of Transportation, and Woodland Diking District. These partners

have worked in cooperation with our program to contain Class A noxious weeds, and they continue to seek assistance in achieving our common goal of eradicating the Milk Thistle, Slenderflower

Thistle, and False Brome.

Name of the Class A or B Designated noxious weed: False Brome ( Brachypodium sylvaticum) and Class A Thistles: tenuiflorus),

Turkish Thistle ( Carduus

cinereus),

Slenderflower Thistle ( Carduus

and Milk Thistle ( Silybum marianum)

Current total known acres in your county( please specify if using total infested acreage or total solid acreage):

False Brome: Roughly 3, 400 total acres are infested with False Brome, of that roughly

500 acres are connected and heavily infested, while the other 50 acres are sparse and in isolated locations.

Turkish Thistle: Roughly 1 acre is infested; in 2022, around 50 plants were identified in total, while fewer than 20 plants were found and treated in 2024 and 2025.

Slenderflower Thistle: Approximately 21 acres are infested, mostly scattered, with about 2 acres densely infested. Milk Thistle: Roughly 43 acres are infested, about 8 acres of that area would be

considered densely infested. How much of this acreage/ infestation will be treated in this proposed eradication project? All Class A Thistle sites will be treated and monitored in partnership with landowners. For False Brome, we estimate

of the False Brome will be treated by either our team

or our project partners. All of the isolated sites will be treated as part of this project, and about 400 acres of the core infestation that is distributed through smaller land parcels. Project partners are able to treat some of the larger areas encompassing nearly 3, 000

acres. We are working towards total treatment by adding to our success annually, however having a trained eye for this species has led to the discovery of additional infestations. File Name:

Please briefly describe the nature of the known infestation, including the number of known sites

or

populations ( if applicable),

geographic extent, habitat types, and if the infestations

are on private lands, public lands, or both. Date when infestation was first identified.

False Brome has been present in very small known amounts since 2009 ( 1 site) and 2013 ( 2 sites). In the past four years we have identified seven additional sites. In 2023, we discovered a very dense core infestation area spanning roughly 2500 acres in Castle Rock. In 2024, we

discovered another larger infestation spanning about 800 acres in a forest site where it was primarily invading the roadsides. The majority of the infestations are on private lands, though there are several public lands involved including the right of way, and some private timber company land. Most sites are along residential forest edges or other unmaintained habitat areas frequented by deer. The Turkish Thistle infestation was discovered in May of 2022 in Kalama and was initially identified and treated as Slenderflower Thistle. Upon follow- up surveys, flower heads began to develop, and the identification as Turkish Thistle was established based on morphological

features. This infestation is scattered along a freeway right-of-way and both sides of a local road. Only one parcel with a private landowner was found to have a few plants. Land managers in the area are providing ongoing mechanical and broadleaf herbicide treatments. In 2023, only a few suspected rosettes were identified, in 2024, we treated fewer than 20 plants, and in 2025, only one plant was found. The habitat is a somewhat rocky east- facing slope, gradually flattening out in the middle.

In the Woodland agricultural area, our project area has both Milk Thistle and Slenderflower Thistle. The Milk Thistle infestations

in this area were first discovered in 2008, while the

Slenderflower Thistle was first discovered in 2013. Nineteen parcels have ( currently or in the past) Milk Thistle, three with heavy infestations, and the others with small infestations of 50 plants or less. New infestations of Milk Thistle were found on two additional properties in 2024.

Four parcels have an infestation of Slenderflower Thistle, one parcel with a heavy infestation across three acres, and the other three with small infestations. Two new infestations of

Slenderflower Thistle were found on the right-of-way along Interstate 5 in 2023. These infestations span across private agricultural farms, as well as a few private vacant lots, and public properties owned by a port, and a diking district. These infestations have decreased in density

significantly since the last seeding opportunity due to a staff transition in 2019; however, we find that regular follow- ups are necessary to find the plants trying to flower at only a few inches tall.

The Longview/Kelso area currently has infestations of both Milk Thistle and Slenderflower Thistle within a bark/ soil/ dredge pile at the edge of a private soil manufacturing facility. Slenderflower

Thistle was first documented

here in 2008, while Milk Thistle was first discovered

in 2009. New infestations of Milk Thistle were identified on two new properties in 2022, a

nearby rail and public property in 2023, and additional right of ways in 2024 and 2025. Prevention of seed development at this project area is critical in order to contain both species in the Pacific Northwest region, as soil produced here is widely distributed in our region, and railways are significant pathways for the spread of weeds. These infestations are on commercial lands, several types of public lands, and one residential land. Do you plan to treat all sites in your county or jurisdiction, or will you target specific sites? All of the known Class A Thistle infestations will be treated as part of this proposed Class A eradication project, either with project funding or by project partners in cooperation with our program. For False Brome, all public sites and rights of way will be treated in partnership with

the public agency landowners. Our private forestry partners plan to continue treatments in their lands. This project funding would target the isolated sites owned by private landowners, as well as the core infestation. The core infestation will be treated from the outside boundary inward, with priority treatments to currently participating lands and lands immediately adjacent. Many File Name:

What previous control work has been done ( include any IPM methods)?

Include

information on the timing of each control measure and outcomes. If none please state so. False Brome treatments with herbicide or seedhead removal have occurred along the right of way

and at the public lands as long as each infestation has been known. Previous grant funds provided for herbicide treatments in the spring through June in 2023, 2024 and 2025 on the

private properties participating. Our herbicide treatments have been highly effective in reducing the density of sites by the second year of participation, and even more so in the third year of participation. Several landowners also mow in June to prevent seed production, and while the plants survive, this has been an effective short- term control method, allowing time to gather

resources and plan further. In a few cases where only a handful of plants were found, we have physically removed the plants.

Turkish Thistle has been treated using herbicides and by digging. Timing was key for the herbicide treatments, and the first year was applied too late resulting in the removal of

flowerheads to prevent seeding. Subsequently, broadleaf herbicides have been applied very early along the freeway right of way. The local right of way receives regular mechanical treatments mowing, hand pulling). Only a handful of plants were dug up in 2024 and 2025, some were sprayed with a broadleaf herbicide as well. Monitoring will continue. Our program has been working with property owners of our historic sites to control thistle

infestations since 2010. In recent years with our current program staff, our IPM strategies have included extensive surveying, education and outreach to property owners, herbicide treatments, flower head removal ( both pre or post herbicide treatment),

grazing goats where possible,

fertilization, and limiting site disturbance. One property owner also treated their infestation with lime in an attempt to improve the soil quality and encourage desirable plants to grow. Outcomes: Overall, the existing infestations seem to become less dense each year. No matter the treatment method used, we found that a follow-up site visit is essential in preventing seed production. We also encourage our agency partners to clean their equipment as new sites are

being established in areas that are likely contaminated by maintenance vehicles. File Name:

Herbicide treatments on Milk Thistle have been more effective when using aminopyralid than

when using glyphosate; however, the latter is the best selection in some scenarios. Flower heads that emerged at the time of treatment were removed. Herbicide treatments on Slenderflower

Thistle seem to be effective when performed prior to budding; plants with buds on them at time of herbicide treatment produced flowers and were on track to produce seed. Cutting the flower heads off of Slenderflower Thistle in combination with herbicide treatment was not effective, as

flower heads developed on lower leaf axils of the plant prior to the herbicide killing the plant. All budding plants should be removed entirely. One of the infested pastures

has goats and sheep grazing in it( year- round), Slenderflower

Thistle

was less prevalent, and the plants were smaller in the pasture than in the fence line where the animals don' t graze. This pasture did not have any Milk Thistle ( unlike the horse pasture on the same

property).

The goats adequately keep the plants smaller, but do not prevent seed production

altogether.

The Milk Thistle infestation in the area where lime was applied in the fall appeared to be less

severe than the year prior, and, paired with continued treatments, the Milk Thistle infestation has been significantly reduced annually as other plants have established. Please briefly describe steps to assure that all applicable laws will be followed if herbicides are used, e. g., permit coverage, applicant licensing, site- posting.

Each participating landowner will be provided with a permission and liability waiver that will be signed allowing access and treatments on their parcels. When herbicides are utilized, landowners

will be consulted regarding information from the label( s) of the herbicide( s) to be used on their property. A licensed pesticide applicator will perform and monitor the application of herbicides

in accordance with the instructions on the label. On public property, notification of herbicide treatment will be posted where required at the infestation site. We will also use appropriate methods to communicate treatments on private property. Pesticide application records will be kept for all applications. We do not anticipate the need to apply herbicide directly to any body of water, but should the need arise, we will obtain the proper NPDES permit to do so. Do you anticipate that enforcement of Washington State noxious weed law might be necessary in the process of the eradication? If yes, please provide a brief description of the readiness of involved county weed board( s) to carry out such enforcement within the proposal period. Enforcement of the Washington State Noxious Weed law might be used in select instances in the

process of eradication, but is not anticipated. The majority of the landowners with Class A thistle infestations have either participated in previous grant projects or have recently reached out for

assistance in controlling their infestations of Class A noxious weeds. We have yet to exhaust our non- enforcement options with the landowners in the False Brome project area and do not

currently anticipate that enforcement will become unavoidable. If necessary, our noxious weed board has the necessary procedures in place to carry out the noxious weed laws.

If the infestation to be eradicated lies in more than one county or jurisdiction, please provide a brief description of any coordinated efforts to treat and eradicate the entire

infestation in all applicable jurisdictions. The infestations to be addressed in this project lie within Cowlitz County' s jurisdiction. We share

information with neighboring counties when infestations are found within a few miles of the border to encourage strategic surveying. The Lewis County noxious weed team has participated

in site visits with our team to gain experience seeking out False Brome. Please describe local support( include match funding or in-kind efforts from local groups, county, municipalities, or volunteer efforts.)

Our program will contribute staff time for surveys, monitoring, outreach and planning, while the grant project will fund labor, travel and supplies for treatments. Our program will also provide File Name:

the majority of travel expenses for this project. An estimated $ 7, 000 of in- kind contributions from our program is anticipated. The WSDA&

USFS Private Forestry Grant contributed 12, 737. 54 toward this project between 2020 and 2024, though some of this funding was utilized for other Class A species, including Eggleaf Spurge and Giant Hogweed. Landowners, including farmers, private companies, and public agencies, are expected to contribute to control efforts and

monitoring of infestations. Our County Public Works spray truck operators, the Diking District within the project area, the Port of Woodland, the Port of Longview the City of Longview Parks Recreation

department, the City of Kalama, the Washington

the Washington

State Department of Transportation,

Department

of Fish & Wildlife,

the Washington Department of Natural

Resources, the Three Rivers Wastewater Treatment Facility, and the private timber companies owning land in these areas are aware of the Class A species in the project area, support our programs survey and monitoring efforts, and participate in treatments to the best of their ability. Please describe any post- eradication plans to monitor the project area, prevent, and

respond to any infestation. Will you be conducting any outreach with landowners to help in early detection?

The project area will be continually monitored for many years following the last known seeding year. Landowners with known infestations will be contacted regularly to help monitor the status of the infestations. Landowners surrounding known infestations will receive either early detection postcards or informational letters to inform them of the high- priority noxious weed species in the area. Through monitoring and outreach, as returning or new infestations are found,

we will respond quickly by contacting the property owner to ensure treatment is arranged and offering any resources our program has available ( herbicide reimbursement, disposal assistance,

equipment lending, or possibly staff time). We also plan to increase our general outreach about these species through standard and social media communications when appropriate and highlight these species during presentations and public events throughout the year. We have and will continue to offer several presentations

throughout the year to audiences such as the county board of commissioners, local public agencies, and master gardeners. Another addition to our outreach efforts is to preserve plant samples using drying silica to make available 3- D real samples of these plants for use at training events. In the past, for False Brome, we held a community meeting, and we will consider having

another meeting this year. We also developed a GIS Storymap for False Brome to share information about this species in our county. Estimated date when the current infestation would be eradicated ( no living plants or propagules), if it were assumed that the requested funding and the matching funds of project partners were continued annually. Any plants that emerge during the growing season of this grant project would be eradicated by

the end of the project period. However, the seed bank may sprout new plants annually for a number of years, requiring the need to exhaust the seed bank under frequent monitoring. Turkish Thistle has an unknown seed viability; however, if it is similar to Slenderflower Thistle, we could anticipate its eradication by 2029. If all project partners continue the work and funding is

available, Slenderflower Thistle would be eradicated in our historic infestation sites by 2029 based on an estimated seed viability of 7 years from the last known seeding date. A new site was

discovered in 2025, separate from other known sites, bringing the species' eradication potential into 2032. The historic infestations of Milk Thistle should be eradicated by 2028, based on an

estimated seed viability of 9 years, calculated from the date of the last known seeding event. Depending on the site and timeline of discovery, we anticipate site- level eradication beginning in 2030, with a county- level eradication in 2033.

Of this total request, roughly $4, 000 will be used for the False Brome part of the project, and 1, 000 for the Class A thistle part of the project. Matching funds, whether cash or in- kind, offered by other project partners not otherwise included above. Note that matching funds are not required, but discussion and disclosure of matching funds are required. If there are no matching funds, please state this. An estimated $ 7, 000 of in-kind contributions from our program is anticipated, comprised of staff

time to administer the project, survey, outreach, and monitor, as well as some travel and material expenses. Current matching funds from other agencies are not available. Our program previously

received funding from the Washington State Noxious Weed Control Board, and from the WSDA USFS Private Forestry Grant. Currently, we are not able to calculate the value of labor

contributions from our project partners and other participating agencies. However, we do anticipate a strong working partnership with each of them. Most of the public agencies and private timber companies perform their treatments with minimal assistance. Private farmers are monitoring and performing treatments to the extent that they are able. Additionally, residential

property owners are contributing if they can with either herbicide or mechanical treatments. Project Maps on the following pages
